S_ID PASS-27 — Idaho ordinary civil appellate gateways, timing, motion interactions, and stays
Fresh public-source access date: October 28, 2026, America/Los_Angeles.
Scope: Ordinary civil appeals from magistrate decisions, district-court original and appellate decisions, and the necessary finality, notice, timing, postjudgment-motion, stay, security, and remittitur interfaces.
Evidence disposition
The official current-published civil, appellate, administrative, and electronic-filing rules were recovered and read to the bounds recorded below. Official constitutional text was read and visually inspected.
The attempted official statutory route was inaccessible. The relevant statutes therefore remain provisional readings of identified 2025 reproductions. Original court-rule orders were not recovered through the ordinary public routes used. Displayed footers establish what the current rule pages report; they are not a completed original-order audit.
Reviewed P25 findings are retained only within their supplied scope. P21 Rule 60 merits and P26 judgment-lifecycle merits are not used as substantive premises. C033/C035 and all other existing holds remain unchanged.
Principal findings
The ordinary magistrate-to-district route and the higher appellate route have different motion and cross-appeal provisions. Rule 83 lists qualifying timing-reset motions; IAR 14 uses broader wording. Rule 83’s late-filed-appeal cross-appeal branch runs from service, while IAR 15’s additional cross-appeal window runs from filing. [C012–C018.] Idaho Supreme Court+2
A 2026 rule addresses certain timely magistrate appeals taken to the wrong court. IAR 11.3 preserves the original filing date upon the specified transfer. It does not declare every late or misdirected notice curable. [C005.] Idaho Supreme Court
Appeal, stay, and security are distinct. The two ordinary routes have limited automatic-stay provisions, but continued stays, money-judgment security, nonmoney relief, partial appeals, and permissive appeals have separate conditions. [C036–C046.] Idaho Supreme Court+1
Electronic submission, acceptance, service, correction, and technical-failure relief are separate events. Their rules do not turn a rejected document, a courtesy copy, or an attempted transmission into a universally effective appeal. [C025–C030.] Idaho Supreme Court+3

2. Ordinary appellate routes and court authority
2.1 Constitutional and statutory framework
Article V, §§ 9, 13, and 20 distinguish the Supreme Court’s appellate authority, constitutionally protected appellate structure, and district-court original and appellate authority. Section 1-2213 separately addresses review of magistrate decisions; § 1-2406 addresses Court of Appeals assignment.
These provisions do not establish a particular claim’s validity, an actual assignment, or jurisdiction over a particular appeal. The statutory bodies were read only in provisional reproductions. [C002–C004.] Idaho Secretary of State+2
2.2 Route comparison
| Origin and posture |
Ordinary destination or mechanism |
Material qualification |
| Ordinary magistrate final civil judgment or qualifying appealable order |
District court under IRCP 83 |
Special direct-review and statutory proceedings remain separate. |
| Otherwise nonappealable magistrate interlocutory order |
District permission under Rule 83.1 |
Permission from the receiving appellate court is indispensable. |
| Magistrate specially assigned to act as district court under ICAR 6 |
Supreme Court under Rule 83(a)(3) |
Original assignment may state differently; no actual order examined. |
| District court acting originally |
Supreme Court under the IAR gateway |
Requires an appealable category or permission. |
| District court deciding a magistrate appeal |
Supreme Court under IAR 11(a)(2) |
Dismissal, affirmance, reversal, and remand decisions are listed; no merits finding follows. |
| Appeal within Court of Appeals assignment authority |
Assigned by the Supreme Court |
A party does not select the Court of Appeals merely by captioning a notice differently. |
| Small claims, family, probate/guardianship, criminal, juvenile, agency and other special proceedings |
Their specified routes |
Their thresholds, expedited periods, and stay rules are not transferred to ordinary debt litigation. |
[C003–C004, C006.] Rule 83 ordinarily uses record-based appellate review. Its inadequate-record branch permits the specified de novo or remand disposition; that is not the automatic small-claims de novo route. Idaho Supreme Court+1
IAR 2’s definition of “district court” excludes the magistrate division for that rule set. The more inclusive definition in ordinary civil Rule 1 cannot be substituted without regard to the appellate route. Idaho Supreme Court+1
2.3 Court of Appeals assignment and further review
IAR 101 applies the appellate rules to Court of Appeals practice except where otherwise provided. IAR 108 preserves Supreme Court assignment discretion and its excluded categories. IAR 114 permits reassignment; IAR 110 generally routes subsequent appellate papers through the Supreme Court clerk.
Supreme Court review of a Court of Appeals decision is discretionary under IAR 118, not an ordinary appeal as of right. Complete briefing, oral-argument, and review-merits practice remains a follow-on component. [C006, C051.] Idaho Supreme Court+3
2.4 The new wrong-court transfer rule
IAR 11.3 applies to its defined timely magistrate notices:
| Wrong-route branch |
Rule consequence |
| Notice to Supreme Court from a magistrate decision not directly appealable under IAR 11.1(a) |
Supreme Court may transfer to district court. |
| Notice to district court from a magistrate decision that must go directly under IAR 11.1(a) |
District clerk must forward; Supreme Court may order transfer. |
| Ordered transfer |
Original filing date is preserved; proceeding continues as specified in the receiving court. |
| Fee |
No additional fee except correction of an existing deficiency. |
[C005.] This is not a general extension, an actual jurisdiction finding, or permission to disregard the proper route. Idaho Supreme Court
3. Appealability and finality
3.1 Final judgment is not established by a caption alone
Rule 54(a) requires the prescribed separate judgment document. A judgment is final when it resolves all claims for relief against all parties, except the stated costs/fees issue, or when it satisfies the partial-final mechanism.
Rule 54(b)(1) requires more than a label: multiple claims or parties, the express no-just-reason-for-delay determination, and the prescribed certification. Without effective certification, the described partial disposition remains revisable.
An amended judgment must be entered as a complete amended document under Rule 54(a)(2). That requirement does not itself answer whether every amendment restarts appeal time for every issue. [C007–C008.] Idaho Supreme Court+1
Rule 58 supplies the entry event. Proposed rulings, oral announcements, findings, filing, and formal judgment entry remain distinct. Taxation of costs does not postpone entry. Idaho Supreme Court
3.2 Ordinary IAR 11 categories
The complete relevant IAR 11(a) text was read. Its categories include:
| Category |
Material limit |
| Final judgment under Rule 54(a) |
Actual finality remains necessary. |
| District appellate decision |
Includes the listed dismissal, affirmance, reversal, and remand dispositions. |
| Certified partial judgment |
Requires Rule 54(b) compliance. |
| Contempt order/judgment |
Full contempt merits remain separate. |
| Grant/refusal of new trial |
Includes conditional additur/remittitur orders. |
| Grant/denial of JNOV |
Different from merely requesting relief. |
| Post-final order |
Includes denial of vacatur; excludes an order granting vacatur. |
| Post-Rule-54(b) order |
Must relate to or arise from that certified judgment for the specified branch. |
| Statutorily appealable order |
The statute and its complete predicates must be read. |
| Vexatious-litigant designation |
Separate special branch; denial of permission to commence new litigation is excluded from this route. |
[C009.] A copy of the appealed instrument is required; the postjudgment branch also calls for the final judgment. No actual instrument was inspected. Idaho Supreme Court
A grant of vacatur excluded from IAR 11(a)(7) is not thereby declared immune from every conceivable review mechanism. The proper alternative, if any, requires its own authority.
3.3 Permissive interlocutory review
Both ordinary permission rules require a controlling legal question, substantial ground for differing opinion, and the stated advancement of orderly resolution. Their courts and sequences differ:
| Step |
Magistrate-to-district: IRCP 83.1 |
District-to-Supreme: IAR 12 |
| Initial request |
Motion to magistrate |
Motion to district court |
| Initial period |
Fourteen days after order entry |
Fourteen days after order entry |
| Lower ruling |
Reasoned ruling within fourteen days after hearing |
Same stated hearing-based relation |
| Next request |
District court |
Supreme Court |
| Next period |
Fourteen days after approving/disapproving order |
Fourteen days after approving/disapproving order |
| Lower court has not acted |
Twenty-one-day filing-based branch |
Twenty-one-day filing-based branch |
| Lower recommendation |
Does not itself complete permission |
Does not itself complete permission |
| Acceptance |
Receiving court must grant leave and prescribe a time certain for notice |
Supreme Court must grant leave and prescribe a time certain |
| Denial |
District denial has the rule’s finality/no-further-request limitation, subject to its express exceptions |
No automatic right to permission |
[C010–C011.] The time certain in a grant is not replaced with an invented universal notice period. No interlocutory issue or permission request is evaluated. Idaho Supreme Court+1
4. Notice, timing, cross-appeals, and motion interactions
4.1 Distinct notice clocks
| Route |
Required act and reference event |
Special cross-appeal relation |
| Magistrate-to-district |
File notice with district clerk within forty-two days from the clerk’s file stamp on the judgment/order |
If the appeal is filed and served more than twenty-eight days after entry, the opposing party’s specified cross-appeal window is fourteen days after service. |
| District-to-higher appellate court |
File notice under IAR 14 within forty-two days from the clerk’s file stamp |
IAR 15 uses the later of the otherwise applicable forty-two-day period or twenty-one days after the original notice was filed. |
[C012–C013, C018.] Service-triggered and filing-triggered windows are not interchangeable. No actual trigger, date, notice, or deadline is supplied. Idaho Supreme Court+2
If a respondent seeks no affirmative reversal, vacation, or modification, IAR 15 and 35(b)(4) permit the stated additional-issue route without a cross-appeal. Whether particular requested relief is affirmative is not decided. Idaho Supreme Court+1
4.2 Filing, service, and receipt
IAR 20 requires actual filing rather than a mailing-date substitute for notices of appeal and cross-appeal. Its rule deeming other mailed appellate documents filed when mailed is separate.
The notice-service requirement reaches the specified parties who appeared below, even if not parties to the appeal, and the requested reporter. Rule 83 separately requires immediate service on the magistrate court and the other parties.
These duties do not make late service automatically identical to an untimely notice. The rules expressly classify certain filing failures as jurisdictional; other defects can still produce sanctions or dismissal. [C014–C015.] Idaho Supreme Court+1
4.3 P25 motion distinctions retained; appellate predicates newly verified
| Motion/interface |
Reviewed trial-rule relation retained |
Newly read appellate distinction |
| JNOV |
Rule 50(b) uses timely service; no prior directed-verdict motion is required merely to make the motion. |
Rule 83(b)(1)(B)(i) expressly requires a timely filed JNOV motion following a timely directed-verdict motion for that timing-reset branch. |
| Amended/additional findings |
Rule 52(b) uses timely filing. |
Rule 83 expressly includes it even when judgment alteration is unnecessary. |
| Alter/amend judgment |
Rule 59(e) requires filing and service. |
Rule 83 excludes Rule 60 and cost/fee motions from its listed judgment-alteration branch. |
| New trial |
Rule 59(b) requires filing and service. |
Expressly listed in Rule 83. |
| Higher civil appeal |
No trial-motion act is rewritten. |
IAR 14 uses timely filing of a motion that, if granted, could affect findings, conclusions, or judgment, excluding Rule 60 and costs/fees. |
| Reconsideration |
Rule 11.2 supplies its own permitted/excluded categories. |
The word “reconsideration” does not automatically satisfy IAR 14, and Rule 83’s list is not rewritten as an unlimited reconsideration category. |
| Rule 60 |
Merits not rerun. |
Excluded from these timing-reset provisions, while lower-court authority to decide it during appeal is separately preserved. |
[C016–C017.] Motion availability, timely service, timely filing, appeal-period termination, and an eventual ruling are different legal questions. Judicial construction of their interaction remains held. Idaho Supreme Court+3
Under the qualifying higher-court rule, the appeal time begins anew from the clerk’s file stamp on the granting/denying order. The published rule speaks to all judgments/orders in that action; no actual motion is found to satisfy its predicate.
Rule 59(d)’s court-issued notice of intent is treated by that clause as a new-trial motion for the stated purposes. No automatic result is inferred from an informal announcement. Idaho Supreme Court
4.4 Premature and amended notices
| Situation |
IAR 17 relation |
Boundary |
| Premature notice |
A notice from an appealable judgment/order before formal written entry becomes valid upon the later prescribed entry. |
Does not declare a permanently nonappealable ruling appealable. |
| Scope of notice |
Includes the specified prior interlocutory, unexpired prior final, and subsequent orders, subject to exceptions. |
Does not reopen an expired independent appeal by label alone. |
| Amended notice |
May correct information or address later facts; no additional filing fee. |
Relation back requires a timely original notice from an appealable judgment/order. |
| Ordinary amendment cutoff |
Except capital cases, no amendment after the record has been filed in the Supreme Court. |
Not the same as final-judgment amendment. |
| Cross-appeal amendment |
IAR 18 has its own correction/relation-back provision. |
An unstated duplicate cutoff is not invented. |
[C019–C020.] The notice’s preliminary issues are nonexclusive, but that does not complete preservation, briefing, or appellate-error law. Idaho Supreme Court+1
5. Filing gateways, fees, electronic rules, and computation
5.1 Notice contents and record gateway
The rules require court/decision identification, appellate-jurisdiction basis, appropriate judgment/order copies, preliminary issues, and the specified record/transcript, service, and fee information.
For Rule 83, the preliminary issue statement may be filed separately within fourteen days of the notice and is nonexclusive. The ordinary review is on the record. A qualifying inadequate-record determination can lead to de novo review or remand; no such determination is made here.
The Rule 83 transcript-payment gateway and statutory-fee incorporation were read. Complete transcript designation, settlement, correction, augmentation, and preparation are reserved for a later component. [C021–C022.] Idaho Supreme Court+1
5.2 Appellate fees are not stay security
IAR 23 lists $94 for the ordinary higher civil appeal and $94 for its cross-appeal. Those figures are not a complete record/transcript/system-cost quote or the district-appellate filing-fee schedule.
IAR 16(a) says no undertaking for appeal costs is required. That is not an exemption from a money-judgment stay bond.
Fee waiver under IAR 23 uses district recommendation and Supreme Court decision. Its four automatic representation categories are expressly listed, but actual representation or financial eligibility is not determined. The referenced indigency/public-actor statutes remain unread dependencies. [C023–C024.] Idaho Supreme Court+1
The automatic categories named by the rule are representation through the Idaho Law Foundation Volunteer Lawyers Program, University of Idaho Legal Aid Clinic, Idaho Legal Aid Program, or the specified private attorney contract with Legal Aid. No program, attorney, roster, or applicant was investigated.
5.3 Electronic filing and service
The Idaho Rules for Electronic Filing and Service govern within their scope and control conflicting filing/format/service provisions. Their exceptions and self-represented-party choices remain material.
| Event |
Source-stated relationship |
| Submission and acceptance |
Rule 11 requires electronic submission and acknowledged acceptance, subject to the other filing-date rules. |
| Electronic filing day |
Uses the court’s location/time zone, with the rule’s midnight and nonbusiness-day provisions. |
| Accepted filing |
Relates to the system’s received timestamp as stated, including the error-queue qualification. |
| Proposed order |
Not file-stamped merely because submitted; judicial signature is required under Rule 12(b). |
| Rejected filing |
Rule 13 provides a conditional corrected-resubmission and relation-back request. |
| Technical receipt failure |
Rule 14 requires satisfactory proof and its timely resubmission procedure; then its mandatory relation-back language applies. |
| Electronic service |
Completion is the system’s transmission to the selected service contact under Rule 17; courtesy copy is not equivalent. |
| Party service after 5 p.m. local time |
Rule 17(h) adds one day to the prescribed period. |
| Court service |
Rule 18 has its separate designated-address and conventional-service conditions. |
[C025–C030.] No system log, failed submission, accepted filing, consent, contact, or actual transmission was examined. Technical relation-back is not simply a discretionary extension of an expired jurisdictional appeal period. Idaho Supreme Court+4
Rule 10(c) gives Supreme Court notices a specific original-submission-date treatment while fee waiver is considered. It is not replaced with the general Rule 10(b) fee-denial branch. [C029.] Idaho Supreme Court
5.4 Computation and notice
| Rule family |
Complete material distinction |
| IAR 22 |
Excludes the trigger day; includes the last day unless Saturday, Sunday, or statutory nonjudicial day, then uses the specified next day. |
| Statutory nonjudicial days |
Sections 1-1607 and 73-108 contain holiday definitions and exceptions; no calendar was selected. |
| IAR 46 |
General good-cause extensions exclude notices of appeal/cross-appeal and the other specified petitions. |
| Rule 83(m)/IAR 21 |
The prescribed notice/cross-appeal filing period is jurisdictional; other steps are treated differently but may still result in dismissal. |
| IRCP 2.2 |
Applies within its scope; contains inaccessibility, extension, nonextension, and service-by-mail provisions. |
| Clerk notice, Rule 2.3 |
The no-recorded-mailing and no-actual-notice exception is conjunctive. |
| Electronic correction/technical failure |
Separate filing-date rules; not automatic relief from every defect. |
[C031–C035.] No universal three-day mail addition is applied to the forty-two-day entry-based notice period. No universal excuse, notice-based restart, or clerk-inaccessibility outcome is determined. Idaho Supreme Court+4
6. Appeal effects, stays, security, and retained jurisdiction
6.1 Route-specific stay matrix
| Route/category |
Source-stated stay relationship |
| Magistrate-to-district |
Rule 83(e) gives its fourteen-day automatic protection for the appealed proceeding/judgment; further protection requires a magistrate or district order. |
| Higher ordinary civil appeal/cross-appeal |
IAR 13(a) supplies a fourteen-day automatic stay unless otherwise ordered; its specified protection-order exclusions remain. |
| Post-trial motion before/during appeal |
Rule 62(b) permits a court-ordered stay on appropriate security terms; filing alone does not establish one. |
| Nonmoney judgment, injunction, or mandatory order |
IAR 13(b)(8), (14), and (g) use their discretionary/security and likely-success/irreparable-harm predicates. |
| Money judgment |
Separate security provisions below. |
| Permission request pending |
IAR 13(f)(1) does not automatically stay proceedings or enforcement. |
| Permission granted |
Rule 13(f)(2)’s text is expressly subject to its exceptions; enforcement and unaffected matters are separately addressed. |
| Certified partial/permissive appeal |
IAR 13.4 preserves jurisdiction over unaffected matters unless the specified stay is entered. |
[C036–C042.] No protection-order, agency, criminal, tenancy, bankruptcy, or military exception is imported as an ordinary money-judgment result. Idaho Supreme Court+3
6.2 Money-judgment security and exceptions
IAR 13(b)(15) requires the stated authorized-company bond or cash measure, with a nonexecution agreement alternative. It separately regulates copies, objections, possible lien release, continuation after an amount-only remand, and remittitur-related payment.
The quantity register below gives the complete relied-on numerical conditions without applying them. Section 13-202 separately corroborates the punitive-excess waiver, good-cause waiver, and dissipation-related reinstatement structure, provisionally. [C039–C040.] Idaho Supreme Court+1
Additional distinctions:
| Rule |
Narrow effect |
| IAR 16(b) |
A filed written agreement not to execute by the party entitled to execution requires the district court to issue the stated stay without a supersedeas bond. |
| IRCP 62(e) |
When granting a stay to the specified state/public actor, the court must not require a bond. |
| IRCP 62(f) |
All-party written stipulation may waive the stated security requirement. |
| IAR 23 |
Filing-fee exemptions are a different question from these bond provisions. |
[C041.] None establishes actual eligibility, creditworthiness, insurer authorization, waiver, or debt forgiveness. Idaho Supreme Court+1
6.3 Retained trial-court powers
An appeal does not eliminate every lower-court function. IAR 13(b), incorporated for the magistrate route by Rule 83(e)(2), preserves specified authority over transcripts, listed postjudgment motions, costs/fees, property preservation, enforcement subject to stays, partial-final certification, unaffected issues, and other enumerated matters.
Authority to decide a Rule 60 motion is not the same as a Rule 60 motion extending the appeal period. [C043.] Idaho Supreme Court
6.4 Different stay-review routes
| Stay request |
Lower-court nonaction event permitting the specified higher request |
Other condition |
| General IAR 13(g) stay |
Fourteen days after filing, or denial |
Lower-court application ordinarily comes first. |
| Stay of remaining matters under IAR 13.4 |
Twenty-one days after filing, or denial |
Lower court must issue its reasoned order within fourteen days after hearing. |
| Stay already granted |
Specified request to modify/vacate is permitted |
Supreme Court order takes precedence. |
| Magistrate appeal |
Rule 83(e) identifies magistrate/district authority |
Not automatically the same as direct IAR 13(g) relief to the Supreme Court. |
[C044–C046.] Neither timing branch is a finding of delay in an actual proceeding or permission to bypass the prescribed forum. Idaho Supreme Court+1
7. Appellate decision, remittitur, and restoration boundaries
7.1 Magistrate-to-district endpoint
Rule 83(r) requires the district appellate decision and directions to be filed and transmitted as stated. If no further appeal is filed within its forty-two-day relation, the district remittitur returns the matter to the magistrate division with the decision’s directions. A higher remittitur has its separate transmission branch.
A Rule 83 de novo judgment follows its trial-court judgment route instead. Full review standards, record correction, and mandate construction remain outside this component. [C047.] isc.idaho.gov
7.2 Higher appellate opinion and remittitur
IAR 38 distinguishes opinion filing/announcement, finality, and issuance/filing of the remittitur. Its twenty-one-day last-event relation covers the original, rehearing, and modified-opinion categories. Costs/fees do not necessarily postpone remittitur.
Rehearing and Court of Appeals review rules can affect the procedural setting. Therefore, the report does not declare that every opinion produces an enforceable mandate automatically on a fixed date without checking those branches. [C048–C050.] Idaho Supreme Court+3
IAR 13.3 also permits a limited temporary remand for good cause before an opinion. The appeal remains pending, and the lower court’s authority is bounded by the remand. [C049.] Idaho Supreme Court
7.3 Court of Appeals and further-review boundary
IAR 118 supplies a discretionary petition-for-review route, with its stated opinion/rehearing/modification events. It does not require a prior rehearing petition. IAR 122 prevents a Court of Appeals remittitur after review is granted and ends that assignment as provided.
The full petition, briefing, rehearing, and review-merits process remains a later inquiry. Only the indispensable finality effects and source periods are registered here. [C051.] Idaho Supreme Court+1
Reviewed Rule 59.1’s fourteen-day postaffirmance election runs from issuance of the appellate remittitur. That differs from the bond language using filing of remittitur, and from the trial court’s damages-reduction remittitur. [C052.] Idaho Supreme Court

Remaining gaps and conclusion
The most important unresolved matters are:
- Original rule adoption/amendment orders and current official statutory codification.
- Claim-specific finality, aggrievement, amended-judgment effects, and motion-timing construction.
- Exact statutory fee-waiver and authorized-surety predicates.
- Complete record, briefing, argument, rehearing, further-review, costs, and remittitur-enforcement practice.
- Special statutory, protected-party, federal, bankruptcy, military, local, tribal, and interstate regimes.
- Any actual order, notice, filing, service, system failure, security, or appellate event.
No actual or invented party, judgment, order, account, property, notice, payment, security amount, filing event, motion, or calendar was supplied or constructed. No appealability, timeliness, waiver, stay, bond sufficiency, liability, strategy, or outcome determination was made.
This is a researcher self-check, not independent review. The component is supported by newly read official rules and constitutional text, with explicitly provisional statutory support and preserved original-history and construction gaps. Earlier findings and holds remain unchanged. No Idaho, dimension4, A066, parent, operational, or publication acceptance follows.
