S_ID PASS-05 — Idaho generic provider agreements, disclosures, cancellation, and termination
Fresh source-access date: October 28, 2026, America/Los_Angeles.
Disposition: This pass establishes additional, conditional agreement and cancellation findings. It does not authenticate the current official text of the Idaho Collection Agency Act, complete C033 or C035, approve a provider or agreement, or complete Idaho, A066, any parent component, or publication review.
The original P1–P4 reports, source identities, formulas, examples, and recorded access limitations remain unchanged. The supplied coordinator-review descriptions are treated as supplied context—not as files accessed or reviews performed in this pass.
Principal findings
There is no single agreement or cancellation rule covering every Idaho debt-related service. The relevant relationships must be separated:
- A collection agency’s agreement with its creditor client.
- A collection agency’s separate agreement with a debtor concerning incidental charges.
- A debtor’s agreement with a debt counselor or settlement service.
- A credit-repair agreement, potentially subject to federal CROA.
- A service agreement sold through a particular channel, potentially subject to Idaho solicitation, door-to-door, telephone-sales, or automatic-renewal provisions.
The reproduced § 26-2229 writing requirement concerns the first relationship. It cannot, without another authority, be transferred to every debtor-side debt-relief agreement. A different reproduced provision, § 26-2229A(4)(e), expressly requires a signed, director-approved form for its particular debtor–collection-agency incidental-charge branch. Neither provision creates a generic approved debt-settlement agreement. [C005–C009] Justia Law+1
A readable official Idaho consumer-protection rule body was recovered: IDAPA 04.02.01. It contains material-offer disclosures, off-premises solicitation requirements, and a conditional door-to-door cancellation regime. Its recovered adoption record identifies a March 31, 2022 effective date. This is meaningful primary-source recovery, but it does not authenticate the blocked ICAA statute bodies or establish an exhaustive absence of later amendments. [C001–C002, C013–C019] Proddfmmainsa+1
The prior unresolved cancellation-return deadline is therefore narrowed, not universally resolved. Certain separately qualifying sales have express return deadlines. The reproduced § 26-2229(3)(b) itself still does not specify a cancellation-notice method or a refund-payment deadline, and a federal dedicated-account return rule remains a federal, coverage-dependent obligation—not an Idaho deadline. 1. Source status and interpretive boundaries
Three evidence levels are used throughout:
| Label |
Meaning in this pass |
| Official body read |
The operative legal text was actually readable from an official public publisher. Its stated publication currency and historical limits are preserved. |
| Provisional statutory reading |
The complete relevant wording was read in Justia’s 2025 Idaho Code reproduction. It is secondary, expressly subject to a currentness disclaimer, and not authenticated as official current 2026 law. |
| Held dependency |
A material incorporated definition, enactment chain, application fact, or other legal dependency was not sufficiently read or authenticated. No affirmative inclusion, exemption, permission, or outcome follows. |
The official IDOF index was readable. Bounded attempts to the linked ICAA section bodies did not recover them. The statutory interpretations below therefore retain the existing C035 limitation. [C001; S001–S008] Department of Finance
For IDAPA 04.02.01, the current official PDF was read together with the relevant 2022 adoption record. The official current cumulative-index route failed. Accordingly, the finding is that the currently published official rule body and the identified 2022 effective record were recovered—not that every subsequent rulemaking, judicial challenge, or statutory amendment was exhaustively excluded. 3. Idaho ICAA agreement provisions: provisional statutory findings
3.1 Necessary actor and relationship boundaries
The complete reproduced definitions and activity provisions were read before applying the contracts section.
A creditor client is the creditor-side person transferring or assigning an account for collection. The collection-agency and debt-counselor definitions point to different activity branches in § 26-2223. The debt-counselor branch includes receiving debtor money for creditor payment, counseling or managing debts, and contracting to adjust, compromise, or discharge indebtedness. The credit-repair branch is separate. [C003; S003–S004] Justia Law+1
The P2 credit-repair exclusions remain intact: the described consumer-reporting agencies and defined affiliates/subsidiaries; persons with the specified continuing contractual reporting arrangement for resale or monitoring; and persons, only to the stated extent, providing or facilitating access to those entities’ products or services. The incorporated federal CRA definition and any director rule defining the relevant affiliates/subsidiaries were not completed here. No actual exclusion is decided. [C003] Justia Law
The complete reproduced § 26-2239 exemption list was read. Its attorney, lender, institutional, escrow, mortgage, governmental, court-appointed, and other exclusions remain activity- and capacity-specific. The incorporated external definitions were not all independently authenticated. Neither a nonprofit description nor a claimed attorney, CRA, or institutional relationship establishes an exemption. [C004; S007] Justia Law
3.2 Collection agency–creditor-client contracts
Under reproduced § 26-2229(1), contracts between a collection agency licensed or required to be licensed and its creditor clients must be in writing. The clause does not itself prescribe both parties’ signatures, a debtor copy, a delivery method, or a consumer cooling-off period. [C005; S005 §(1)] law.justia.com
Subsection (2) prohibits specified creditor-client contract terms, including retention of collections other than authorized regular collection compensation and a penalty for an unintentional creditor-client error concerning the debtor’s correct name or address. Its commission restriction has written-agreement and statutory cross-reference qualifications. Those qualifications were read, but the dishonored-check and small-claims cross-reference regimes were not independently completed. No new fee calculation is made. [C006; S005 §(2)(a)–(c)] law.justia.com
Dependent effect: The existence of this writing requirement does not establish that a debtor’s settlement-service agreement must contain the same terms, uses the same parties, or receives the same statutory treatment.
3.3 Separate debtor–collection-agency incidental-charge agreement
Reproduced § 26-2229A(4) lists alternative bases for collecting interest or charges incidental to a principal obligation. Under its paragraph (e), the relevant charges must be provided for in a written form agreement:
- Signed by both the debtor and the licensee.
- Having prior director approval as to the agreement’s terms and the amounts of fees, interest, charges, and expenses.
This is a materially different agreement from B01. It does not mean every debt-relief contract requires or possesses director approval. Nor does it erase the other alternatives and qualifications in subsection (4). [C007; S006 §(4)(a)–(f)] Justia Law
Reproduced subsection (3) also requires disclosure on every collection contact when the collection-agency licensee and creditor client have the specified managerial or financial interest in one another. That is a collection-contact disclosure, not a generic debt-settlement contract clause. [C008; S006 §(3)] Justia Law
3.4 Regulatory contract filing is not consumer delivery or approval
Reproduced § 26-2224(1)(f) requires application materials that include contracts and forms. Subsection (1)(l) addresses updating, with the previously reviewed advertisements-and-solicitations exception.
Submitting a form to the regulator does not, by that fact alone, establish that a consumer received it, signed it, consented to it, or that it received substantive approval. The express prior-approval requirement in § 26-2229A(4)(e) should not be confused with general application filing. [C009; S008 §(1)(f), (l); S006 §(4)(e)] Justia Law+1
3.5 Debtor cancellation under § 26-2229(3)(b)
The existing C017 finding is retained without a numerical rerun. In the reproduced noncustodial debt/credit-counselor branch, when the debtor cancels before successful completion, the provision requires refund of 50% of collected fees associated with debt remaining unsettled at termination. [C010; S005 §(3)(b)] law.justia.com
The following distinctions remain essential:
| Issue |
What the paragraph establishes |
What remains unestablished |
| Actor/model |
The stated noncustodial debt/credit-counselor branch |
Automatic application to custodial counseling or standalone credit repair |
| Trigger |
Debtor cancellation before successful completion |
Automatic equivalence of provider termination, default, abandonment, or completed service |
| Money object |
Collected provider fees associated with unsettled debt |
Automatic inclusion of all unspent customer account money |
| Allocation |
Fees must be associated with unsettled debt |
A prescribed association formula, retrospective reallocation power, or contract-allocation safe harbor |
| Notice |
Cancellation is the operative event |
Named recipient, exclusive communication method, dispatch-versus-receipt rule, prescribed form, or required signature |
| Payment deadline |
A refund obligation upon the stated condition |
A specified number of days for payment |
| Contract discretion |
Actual terms may be relevant evidence |
Permission to waive, narrow, or defeat the statutory obligation |
[C010–C012; S005 §(3)(b).] These are bounded readings of this paragraph, not a universal finding that no other deadline, right, or legal consequence exists. law.justia.com
4. Official Idaho consumer-protection rules
4.1 Scope, cumulative operation, and exclusions
IDAPA 04.02.01 states that its rules are cumulative and nonexclusive. It preserves other rights and uses the Consumer Protection Act’s exceptions. Its definition of regulator-permitted actions concerns specifically authorized conduct, not merely the fact that a business has a license. The chapter also has an enforcement-referral provision for certain regulated conduct; that provision is not treated here as a blanket substantive exemption. [C002, C013; S009 Rules 004–009, 020.02; S012–S013] Proddfmmainsa+3
The chapter’s definitions include services and debt-collection activity within the relevant trade-or-commerce framework. Nevertheless, each specialized rule still requires its own predicate. A rule governing the sale of a service is not automatically applicable to every attempt to collect an existing debt.
The statutory exceptions incorporated through § 48-605 were read only in the secondary 2025 reproduction. That dependency remains provisional even though the rule body itself is official. [C013] Proddfmmainsa+1
4.2 Initial-offer and off-premises disclosures
Rules 030, 032, 040, and 041 prohibit material misleading representations or omissions, including material conditions disclosed too late. Rule 040 requires material contingencies, conditions, and qualifications to be clearly and conspicuously disclosed at the initial offer. Later disclosure, even before consummation, is not itself a defense to that rule. [C013; S009 printed pp. 12–13, PDF indices 11–12] Proddfmmainsa+1
For covered in-person or telephone solicitations away from appropriate trade premises, Rule 160 requires the initial contact—before substantive questions or statements beyond a greeting—to reveal the sales purpose, solicitor identity, represented trade name, and type of goods or services. In-person solicitation also requires displayed identification. Rules 161–163 address deceptive identities, misleading documents, leaving when requested, and business-name/address disclosures in the described materials. [C014; S009 printed pp. 23–24, indices 22–23] Proddfmmainsa
These are disclosure obligations. They do not themselves create an across-the-board right to cancel every telephone or off-premises service contract.
4.3 Door-to-door cancellation branch
Predicate and exclusions
Rule 020.22 covers the defined personal, family, or household sale of goods or services at the stated price threshold, personally solicited—including invited solicitation—with agreement away from appropriate trade premises.
The complete definition contains exclusions for prior negotiations at the seller’s fixed retail premises; a consumer-initiated bona fide immediate personal emergency with the specified separate handwritten, dated, signed statement; qualifying transactions conducted entirely by mail or telephone without other prior contact; specified requested repair or maintenance work, but not unrelated additional sales; and the identified real-property, insurance, and registered securities/commodities transactions. These are not interchangeable exceptions. [C015; S009 printed pp. 8–9, indices 7–8] Proddfmmainsa+1
Required writings, copies, and notices
When the branch applies, Rule 170 requires:
| Requirement |
Exact legal object and timing |
| Completed receipt or contract copy |
Furnished at execution; transaction date, seller name and street address; same language principally used in the oral presentation |
| Main cancellation statement |
Prescribed statement in 10-point type beside the consumer-signature space, or on the receipt’s front |
| Separate cancellation form |
Completed in duplicate, attached and easily detachable, prescribed heading and bold 10-point text, same language as the contract |
| Completed fields |
Seller identification/address, transaction date, and cancellation date no earlier than the prescribed third-business-day limit |
| Oral notice |
Given when the consumer signs or purchases |
| Waiver restriction |
No confession of judgment or contractual waiver of the protected rights |
[C016–C017; S009 Rule 170.01–.06, printed pp. 25–26, indices 24–25.] The separate emergency exclusion in the definition is not converted into permission to insert a routine waiver in a covered contract. Proddfmmainsa
Cancellation and consequences
The prescribed right extends to midnight of the third business day after the transaction date. The notice permits a signed, dated cancellation form or other written notice to be mailed or delivered to the seller’s business address, and also specifies telegram transmission. No determination is made about electronic substitution under E-SIGN, Idaho UETA, or another regime. [C017]
Upon receipt of a valid cancellation notice, Rule 170.07 requires the seller, within ten business days, to refund payments, return applicable trade-in property, cancel and return the negotiable instrument, and take the necessary action to terminate the transaction’s security interest. These are source-stated consequences; the rule does not state an earned-service-fee deduction from that refund. [C018] Proddfmmainsa
The goods-return, pickup, abandonment, and transfer restrictions in the remainder of Rule 170 are retained as goods or instrument branches, not turned into rules about returning performed counseling services. [C019]
5. Other Idaho cancellation channels: provisional statutory readings
5.1 Telephone Solicitation Act
The complete relevant definitions, § 48-1004, and § 48-1005 were read in the 2025 reproduction.
The telephone-sales definition is not simply “any conversation by telephone.” It includes specified solicitation activity and Idaho nexus. Section 48-1005 then exempts listed solicitors from § 48-1004, not necessarily from every provision of the Act. [C020; S014–S016] Justia Law+1
The particularly material exemption is a business actually licensed by a federal or Idaho governmental agency—other than the Secretary of State—having authority to revoke that license. A business merely required to be licensed is not shown by that wording to possess the exemption. No actual license, exemption, or transaction is adjudicated here. The person asserting an exemption bears the statutory burden in enforcement proceedings. [C020] Justia Law
If § 48-1004 applies:
- Specified oral disclosures are required.
- Unless an unqualified cancellation/return and full-refund right is provided, the solicitor must send the prescribed written confirmation.
- The confirmation includes the purchase date, complete business address and registration information, itemization and prices, total obligation, and the required cancellation notice.
- The notice uses bold 10-point type.
- Cancellation runs from receipt of the written confirmation, not automatically from the call or contract date.
- The stated return obligation runs from the solicitor’s receipt of cancellation.
The complete notice allows mailing or delivery of a signed and dated notice or other written cancellation to the identified solicitor. No specific deadline for sending the initial confirmation was located in the paragraphs read. [C021–C022; S014 §(14); S015 §(1)–(2)] Justia Law+1
5.2 Internet automatic subscriptions
Reproduced § 48-603G applies to the defined internet-entered automatic renewal agreements for Idaho consumers. An extended renewal concerns the specified renewal term of twelve months or more. It should not be rewritten as a test solely of the original contract term. [C023; S017 §(1)] Justia Law
The section requires clear renewal and cancellation-method disclosures and an online cancellation mechanism that is cost-effective, timely, and easy to use. The general sentence about an additional cancellation fee uses “should,” while the extended-renewal notice provision requires at least one no-cost cancellation method using “shall.” Those words are not silently substituted. [C024–C025] Justia Law
The extended-renewal notice window is tied to the delivery or provision of goods or services. It is not paraphrased as an unqualified “before contract expiration” rule. The section also contains utility, regulated-communications/energy, and insurance exclusions. Their external regulatory definitions were not fully investigated, and no actual exemption is decided.
The section expressly states that it does not create a private right of action or furnish the basis for one under another provision. It also has a good-faith civil-penalty qualification. Those limitations are specific to this section; they are not conclusions about all Idaho contract or consumer-protection remedies. [C026; S017 §(5)–(8)] Justia Law
5.3 Narrow negative-option and unordered-service rules
IDAPA Rule 020.34’s notice provisions are material through the specific restructuring-of-existing-services exception in Rule 020.49.d. They should not be applied to every recurring debt-relief service merely because it has repeated charges.
For that branch, the rule requires advance notice, cancellation methods, a first-bill cancellation opportunity, and specified treatment of charges. Rule 220 separately addresses unordered goods or services and attempts to force payment or consent. The separate federal negative-option-plan incorporation in Rule 020.49.e was not completed; no conclusion relies on that exception being satisfied. [C027–C028; S009 printed pp. 10–12 and 28, indices 9–11 and 27] Proddfmmainsa+3
5.4 Financed agreements: expressly held branch
Rule 210 addresses specified consumer-credit-contract and purchase-money-loan situations. The reproduced § 28-43-401 separately defines a regulated home-solicitation-credit-sale category with exclusions.
Those provisions do not establish that an ordinary provider-service agreement is a credit sale. The complete incorporated credit definitions and the downstream credit-sale cancellation provisions were not read. No financed-sale cancellation period, holder liability, or financing outcome is concluded here. [C029; S009 Rule 210; S018] Proddfmmainsa+1
6. Narrow federal overlap
6.1 CROA: only if its own definition and exclusions are satisfied
The official OLRC text read contains laws through Public Law 119-121, October 9, 2026. That is the publication’s stated currency, not an October 28 comprehensive amendment audit.
CROA’s definition requires the relevant consumer, interstate/mail, compensation, and represented credit-improvement or advice elements. Its nonprofit, own-creditor, and institutional exclusions remain separate from Idaho exclusions. Incorporated institutional definitions were not all completed, and no actual organization or transaction is classified. [C030; S019 §1679a] US Code
Precontract disclosure and acknowledgment
Section 1679c requires the prescribed credit-file-rights statement before any contract or agreement. It must be separate from the contract and other written materials. The organization must obtain the consumer’s signed acknowledgment of receipt and retain it for the specified period.
The mandated statement was read in full. Its references to other credit-reporting rights are recorded as content Congress prescribed; this pass does not independently revalidate every underlying FCRA rule. [C031] US Code
Contract and performance requirements
Section 1679d requires a written, dated contract signed by the consumer and prohibits beginning services during its stated waiting period. The contract must contain:
- Payment terms and the total payments to the organization or any other person.
- A detailed service description, performance guarantees, and estimated completion date or duration, including relevant services performed by another person.
- Organization name and principal business address.
- The prescribed conspicuous, bold cancellation statement immediately beside the consumer-signature space.
This section specifies the consumer’s signature; it is not rewritten to require a provider countersignature absent another authority. [C032] US Code
Copies, cancellation notice, and legal consequences
Section 1679e requires a duplicate cancellation form, the completed contract and disclosure statement, and copies of other documents the organization requires the consumer to sign, furnished at the specified signing event.
The operative cancellation provision uses business days and includes execution or the point when the agreement otherwise would become enforceable. The prescribed form in subsection (b) uses the shorter wording “3rd day.” Both were read; no textual correction or unresearched counting resolution is asserted. The contract’s performance waiting period and the cancellation period also have different statutory formulations, so they are not collapsed into one calculated date. [C033] US Code+1
Section 1679f makes specified waivers ineffective, prohibits obtaining them, and addresses enforceability of noncompliant service contracts. These are generic statutory consequences, not a conclusion about an actual contract. The read agreement/cancellation paragraphs do not specify a number of days for returning money after CROA cancellation. That bounded absence is not a finding that no refund duty or other remedy exists. [C034] US Code+1
6.2 TSR: disclosures before consent to pay, not a universal enrollment-form statute
The eCFR provisions were freshly read with their material definitions and exemptions. The retrieved edition was current through October 26, 2026; Title 16’s displayed last-amendment date was October 19, 2026. A title-wide amendment date is not the effective date of every debt-relief paragraph.
Coverage requires the actual telemarketing and debt-relief predicates and applicable exemption analysis. No actual sales channel, customer purpose, creditor type, or provider is classified. [C035; S020 §§310.2, 310.6] eCFR+1
Section 310.3 requires material disclosures before the customer consents to pay, including applicable total cost, material restrictions, refund/cancellation policy information, and negative-option terms. Its debt-relief paragraph additionally addresses expected time, creditor-specific offer timing, required accumulation, specified nonpayment risks where relevant, and dedicated-account rights where such an account is requested.
A disclosure that a policy is nonrefundable does not authorize violation of another cancellation law. These paragraphs also do not independently require every debt-relief enrollment agreement to be written and signed. [C036; S020 §310.3(a)(1)(i)–(iii), (vii)–(viii)] eCFR+1
The reviewed dedicated-account paragraph permits withdrawal from the debt-relief service, without penalty, and requires return of the covered account funds within seven business days of the request, less only fees earned under the referenced federal conditions. The complete independence, ownership, insured-institution, and referral-compensation conditions were read, but no account model is reapproved here. [C037] eCFR
CROA’s state-law preservation provision and the Idaho rules’ cumulative-operation language prevent a simplistic substitution of one regime for another. This pass does not adjudicate preemption or resolve every overlap for a hypothetical agreement. [C038] US Code+1

14. Researcher self-check and remaining limits
This pass newly read generic legal originals where available, including the official Idaho consumer-protection rule body and its identified adoption record, the relevant OLRC CROA paragraphs, and the necessary eCFR TSR paragraphs. It also read the complete relevant Idaho statutory reproductions while retaining their secondary 2025 status.
The pass did not:
- Authenticate current official ICAA statute bodies or complete the 2026 amendment chain.
- Recover or rerun NMLS checklist evidence.
- Inspect an actual or invented provider, creditor, customer, account, agreement, completed form, transaction, case, docket, roster, profile, or operational policy.
- Reopen historical orders or court opinions.
- Decide any actual actor’s Idaho, CROA, TSR, telephone-sales, door-to-door, subscription, financing, or institutional classification.
- Treat a regulator filing as contract approval, a fee ceiling as an earning event, or a cancellation formula as a return rule for all customer funds.
- Resolve electronic-signature law, all statutory incorporations, private remedies, preemption, enforceability of an actual agreement, or all financing-related cancellation regimes.
- Calculate a customer deadline, create a hypothetical numerical customer, or fill the worksheet.
- Access the supplied local review files or perform an independent review of the earlier reports.
Remaining central dependencies: official-current statutory authentication; the unread incorporated definitions and financing/electronic-record regimes; and the specific unresolved notice, association, and return-deadline questions that the reproduced § 26-2229 paragraph does not answer. Additional channel-specific obligations are now identified, but no whole-component, Idaho, A066, parent, operational, or publication acceptance follows.
