SID bounded rule-pinpoint clarification →Fresh public-source access date: October 28, 2026, America/Los_Angeles.
Scope: Generic enforcement of personal-property security interests, including the materially relevant vehicle, regulated-consumer-credit, and title-loan branches. This is not a determination about any actual security interest, agreement, asset, default, notice, repossession, sale, or deficiency.
Evidence disposition: The official Idaho statutory routes attempted in this pass did not yield readable operative bodies. The principal statutory findings below are therefore provisional readings of the identified 2025 Idaho Code reproductions. Official court-rule text, official vehicle-title instructions and a blank form, an official historical title-lending bulletin, and a selected official historical rulemaking notice were recovered. Those sources do not authenticate the current operative statutes.
Earlier raw reports, provenance, C033/C035, and all unrelated holds remain unchanged. No prior substantive finding was used to establish collateral-enforcement law.
The reproduced Idaho text contains several important distinctions that must not be replaced with assumptions about uniform legislation:
These findings are conditional statutory readings, not operational permission or a completed current-law certification.
| Question | Supported statutory distinction | What is not established |
|---|---|---|
| Is there an obligation? | An obligation and its enforceability are distinct from the remedies available against collateral. | No actual debt or contract validity. |
| Is there a security interest? | Article 1 defines the interest; Article 9 applies to the described consensual security transactions regardless of form. | Ownership of goods alone is not a security agreement. |
| Has it attached? | Section 28-9-203 requires value, the debtor’s rights or power to transfer rights, and an applicable evidentiary/formal condition. | A financing statement or title notation alone does not prove attachment. |
| Is it perfected? | Section 28-9-308 separates attachment from completion of the applicable perfection steps. | Perfection and priority were not fully investigated. |
| Who holds title? | Section 28-9-202 generally makes title location immaterial to Article 9’s application. | Title does not eliminate enforceability or default predicates. |
| Has default occurred? | Article 9 remedies operate after default; other law can restrict what constitutes enforceable default. | A contractual label, insecurity assertion, or missed-event description is not adjudicated. |
| May possession be obtained? | Judicial process and nonjudicial possession have different requirements. | No entry, force, or repossession tactic is approved. |
| May a deficiency be collected? | Disposition compliance, proceeds application, proof rules, and special consumer restrictions matter. | A subtraction does not establish an enforceable deficiency. |
[C002–C012; S003–S006.] Justia Law+3
The necessary definitions were read from § 28-9-102. They are not interchangeable:
| Category | Material distinction |
|---|---|
| Debtor | Generally the person with an interest in collateral, other than the specified lien/security interest, whether or not that person owes the obligation. |
| Obligor | A person owing payment or performance, whose property other than the collateral secures it, or otherwise accountable under the definition. |
| Secondary obligor | The defined secondary/subrogation relationship; not every person associated with the debtor. |
| Secured party | Includes the described holder of a security interest and other persons within the statutory definition. |
| Consumer goods | Goods used or bought primarily for personal, family, or household purposes. |
| Consumer transaction | The defined individual-consumer obligation and personal/family/household collateral-interest arrangement. |
| Consumer-goods transaction | A consumer-purpose secured obligation with a security interest in consumer goods. |
| Consumer debtor / consumer obligor | Distinct defined actors tied to the relevant consumer transaction or obligation. |
| Purchase-money security interest | Depends on the purchase-money obligation and collateral relationship in § 28-9-103, not merely the presence of a vehicle. |
The collateral category controls some provisions, while the transaction category controls others. For example, § 28-9-611’s additional-recipient branch turns on collateral being other than consumer goods, whereas § 28-9-614’s enhanced notice contents turn on a consumer-goods transaction. [C002–C004.] Justia Law+3
Section 28-9-109 covers the specified consensual security interests in personal property and fixtures and certain other transactions, including specified receivables sales and consignments. Its federal-law, governmental, foreign-law, and enumerated exclusions must be respected. The exclusions include particular liens, wage assignments, insurance interests, judgments, real-property interests, and specified tort/structured-settlement matters, with exceptions within those clauses. The detailed structured-settlement approval regime was not completed because it is outside this component. [C003; S003.] Justia Law+2
Section 28-1-203 distinguishes a true lease from a security interest through the transaction’s facts, nonterminability, economic-life and ownership-option conditions, and its express “not merely because” qualifications. The relevant economic predictions are assessed at transaction inception. No lease is reclassified here, and Article 2A remedies are not completed. [C005.] Justia Law
The ordinary authenticated-agreement branch of § 28-9-203 requires an authenticated security agreement describing the collateral, alongside value and the debtor’s rights or transfer power. Possession, delivery, or control alternatives have their own collateral-specific cross-references; their entire external regimes are not completed.
Section 28-9-108 generally permits descriptions reasonably identifying the collateral. A supergeneric description such as all assets is insufficient under that provision, and a type-only description of consumer goods is insufficient in the specified consumer-transaction branch. [C006–C007.] Justia Law+2
For vehicles, §§ 28-9-311 and 49-510 identify title-law perfection requirements and exceptions. Sections 49-504 and 49-505 were not fully read; therefore, no actual perfection or priority conclusion follows. Section 49-514’s title-transfer process likewise depends on proof and existing-interest conditions. [C008.] Justia Law+2
Section 28-9-201 preserves applicable consumer laws and makes them controlling in a conflict within its terms. Article 9 does not itself legalize a charge or practice prohibited elsewhere. [C009.] Justia Law
For the Idaho Credit Code branch, §§ 28-41-201, 28-41-202, 28-41-301, and 28-45-102 require transaction, purpose, exclusion, and territorial analysis. Section 28-41-201(3) addresses Idaho proceedings enforcing specified regulated-credit rights regardless of where the transaction was made. Other subsections contain residence, solicitation, physical-presence, and choice-of-law conditions. This is not a complete interstate, tribal, or conflicts determination. [C010, C056.] Justia Law+3
| Regime | Rule actually read | Important distinction |
|---|---|---|
| General UCC | Section 28-1-304 imposes good faith in performance and enforcement. Section 28-1-309 restricts the specified “at will” or insecurity acceleration/power clause to a good-faith belief that payment or performance is impaired. | Section 1-309 places its stated lack-of-good-faith burden on the person against whom the power is exercised. |
| Regulated consumer credit | Section 28-45-107 permits contractual default only for required-payment failure or significant impairment of payment, performance, or realization of collateral. | The creditor bears the statutory burden of establishing significant impairment. |
| Unconscionability | Section 28-45-106 provides the stated court scrutiny and opportunity to present context. | No actual clause is declared unconscionable; statutory permission alone is not treated as unconscionable. |
[C011–C012; S005–S006.] Justia Law+3
Section 28-9-602 identifies protected duties and debtor/obligor rights that generally cannot be waived or varied, including specified care, collection, disposition, accounting, acceptance, redemption, and remedial provisions, subject to § 28-9-624.
Section 28-9-603 permits agreed performance standards only when not manifestly unreasonable. It expressly excludes contractual definition of compliance with the duty not to breach the peace. These provisions do not make every post-default agreement valid. [C013–C014.] Justia Law+1
The Idaho Credit Code separately limits waiver and permits only its stated settlement-related exceptions. Those provisions were read without evaluating an agreement. [C013; S006 § 28-41-106.] Justia Law
Section 28-9-609 permits possession after default through judicial process or without judicial process only without breach of the peace. Its assembly provision depends on agreement and a location reasonably convenient to both parties. The equipment-related clause was read but is not converted into tactical instructions. [C015.] Justia Law
For a regulated consumer-credit transaction, § 28-45-108 adds the express no dwelling entry, no force, and no other breach-of-peace conditions for nonjudicial possession, apart from its voluntary-surrender branch. “Breach of the peace” remains an unresolved construction standard, not a completed factual test. [C016.] Justia Law
| Provision | Legal boundary established |
|---|---|
| Rule 64 | The provisional remedy is available only under governing law and circumstances; the rule does not itself establish entitlement. |
| § 8-301 | Claim-and-delivery is a distinct personal-property recovery procedure. |
| § 8-302(1)–(2) | Verified showing of ownership/right to possession and wrongful detention; ordinary notice and opportunity to oppose. |
| § 8-302(3)–(5) | Prehearing possession requires a stated probable-cause ground; protective orders and a preliminary entitlement determination are distinct from final adjudication. |
| §§ 8-303, 8-306 | Undertakings and stay/redelivery mechanisms have separate conditions. |
| § 8-307 | Surety objections and justification have their own procedure; incorporated civil-arrest qualification rules remain unread. |
| § 8-312 | Requested priority in setting possession proceedings, subject to other statutory priority. |
The statute’s larceny incorporation was not read, and no emergency, danger, ownership, or wrongful-detention predicate is assumed. [C017.] Idaho Supreme Court+4
Section 28-9-207 requires reasonable care in custody and preservation. It also addresses reasonable expenses, risk allocation, identification of collateral, permitted use, and application of money received. Special receivables-buyer/consignor qualifications remain distinct. Possession does not establish ownership free of the debtor’s rights. [C018.] Justia Law+1
Section 28-9-210 supplies a separate authenticated request mechanism for accounting, collateral lists, and statements of account, with response, former-interest, free-response, and charge conditions. It is not the post-disposition consumer explanation under § 28-9-616. [C019.] Justia Law+1
A title loan under § 28-46-502 is the specified consumer-purpose, nonpurchase-money loan secured by titled personal property, scheduled as a single installment or installments that are not fully amortized. “Titled personal property” excludes the listed motor-home, mobile-home, and manufactured-home categories. The statute incorporates the Credit Code and Article 9 except as its special provisions provide. [C020.] Justia Law
Section 28-46-509 exempts the identified licensed/chartered institutions, employees and agents, and qualifying wholly owned subsidiaries regularly examined for consumer compliance. No institution or exemption is classified here. [C020.] Justia Law
| Issue | Reproduced special rule |
|---|---|
| Cure notice | Before exercising default rights, lender mails notice to the debtor’s last address in its file. |
| Cure period | Ten days from the date of the notice. |
| Voluntary surrender | The stated cure-notice obligation does not apply. |
| After possession | No further finance charges may be assessed. |
| Expenses | Reasonable collection/enforcement expenses only as authorized by Article 9. |
| Recourse | Limited to taking possession and disposition, except the specified prevented-repossession, damage/waste, or fraud circumstances. |
| Waiver | No acceptance of a waiver of the protected rights. |
| Purchase by lender | Prohibited for the property securing that lender’s title loan. |
| Title and additional security | Clear-title, care, prohibited additional guaranty, and stated lien-consequence provisions remain material. |
[C021–C022; S007 §§ 507–508.] Justia Law+1
The official June 15, 2006 IDOF bulletin corroborates the historical cure and recourse framework, but it is archived guidance, not current operative text. Original 2006 and 2013 enacted bodies were not recovered. [C053.] Department of Finance+1
No general Article 9 right to reinstate by paying arrears, nor a universal ten-day pre-possession period, was established. Cure, redemption, voluntary surrender, and acceptance in satisfaction are different legal events.
Section 28-9-607 concerns collection/enforcement against account debtors and other persons obligated on collateral, when agreed and in any event after default. It imposes the stated commercially reasonable collection duty in recourse/chargeback circumstances and does not itself determine another obligor’s duty to the secured party.
Section 28-9-608 governs application of that collection. It is not a substitute for §§ 28-9-610–615 when tangible collateral is disposed of. Deposit-account and mortgage subbranches were read only to identify limits and are not applied here. [C029.] Justia Law+1
Every aspect of a § 28-9-610 disposition—method, manner, time, place, and terms—must be commercially reasonable. Public/private disposition, sale/lease/license, units/parcels, present condition or reasonable preparation are statutory alternatives, not findings that a chosen method is reasonable. [C023.]
A secured party’s purchase is allowed at a public disposition, or at a private disposition only within the stated recognized-market or widely distributed standard-price-quotation condition. The title-loan prohibition remains a separate stricter rule. Warranty and disclaimer provisions do not cure a defective enforcement process. [C024.] Justia Law
Section 28-9-627 says a higher obtainable price alone does not establish unreasonableness. Recognized-market methods, current market price, customary dealer practices, or the specified approvals can establish reasonableness under their conditions. Approval is not universally required. Neither “recognized market” nor commercially reasonable conduct is resolved for any asset. [C048.] Justia Law
| Topic | Exact distinction |
|---|---|
| Basic recipients | Debtor and secondary obligor. |
| Additional recipients | When collateral is other than consumer goods, specified interest claimants and filed/titled secured parties or lienholders. |
| Notification date | Statutory earlier-of sending to debtor/secondary obligor or their waiver. |
| Exceptions | Perishable collateral, speedy decline in value, or a type customarily sold on a recognized market. |
| Filing-search alternative | Limited compliance mechanism for the specified filed-interest-recipient branch; not a waiver of all notice duties. |
| Timeliness | Reasonableness is ordinarily a fact question; § 28-9-612(b) supplies its ten-day post-default safe harbor. |
[C025–C026; S004 §§ 611–612.] Justia Law+1
Important Idaho-text qualification: The complete reproduced § 28-9-612 has no “other than a consumer transaction” limitation. It should not be reported as a nonconsumer-only safe harbor. Conversely, a notice sent fewer than ten days before disposition is not declared automatically reasonable or automatically invalid by this reading; subsection (a) remains a fact question.
| Notice category | Required content structure |
|---|---|
| Other than a consumer-goods transaction, § 28-9-613 | Debtor/secured-party identification; collateral; intended disposition method; entitlement to an accounting and any charge; public-disposition time/place or time after which another disposition occurs. |
| Consumer-goods transaction, § 28-9-614 | Section 613 content plus deficiency-liability description, redemption-information telephone number, and contact information for additional transaction/disposition information. |
| Form and errors | Each provision has its own sufficiency and error rules. Section 613’s treatment is not automatically transferred to § 614. |
| Sending versus receipt | Article 9’s “send,” “authenticate,” and “record” definitions and Article 1’s notice/receipt provisions remain distinct. |
| Prescribed blank forms | Statutory forms may satisfy their stated content safe harbor; they do not establish a valid security interest, default, correct recipients, timely sending, or reasonable disposition. |
[C027–C028.] Justia Law+3
No form was filled. Electronic-signature, delivery-system, receipt, and organizational-knowledge questions are not decided for an actual communication.
Section 28-9-615 applies cash proceeds, in order, to reasonable disposition-related expenses and qualifying legal expenses; the enforced secured obligation; qualifying subordinate demands; and the stated consignor branch. Proof-of-interest and demand-timing conditions matter. Noncash proceeds require application only under the stated agreement/commercial-reasonableness conditions.
The debtor is entitled to the applicable surplus; the obligor’s deficiency liability remains subject to compliance, defenses, other law, and the special sale exceptions. Outright receivables-sale transactions have their own no-surplus/no-deficiency qualification. [C030.] Justia Law
Where the buyer is the secured party, a related person, or secondary obligor and the price is significantly below the relevant complying-disposition range, § 28-9-615(f) uses the hypothetical complying proceeds for the deficiency/surplus calculation. This is not an assumed fair-market-value credit in every disposition. [C031.]
A lawful application order must be established before any symbolic remainder can be described as a possible deficiency. Gross proceeds minus a stated balance is not the statutory analysis.
Section 28-9-616 requires the specified writing in a consumer-goods transaction before or with payment/accounting of surplus or the first written deficiency demand, and in response to the defined post-disposition request. A qualifying deficiency waiver is an alternative response in its stated branch.
The explanation must identify the amount, ordered computation, possible future adjustments, and an information contact. Its chronology and response quantities are recorded in Section 10 below. Minor errors have the statute’s own misleadingness qualification. [C032.] Justia Law+1
Section 28-9-617 specifies the rights transferred by disposition and discharge of the enforced and subordinate interests. Good-faith transferee protection can operate despite secured-party noncompliance; without it, the stated interests remain. No purchaser or good-faith status is supplied. [C033.] Justia Law
Section 28-9-619 permits the defined transfer statement for title/record purposes, but title transfer alone is not a disposition and does not discharge the secured party’s Article 9 duties. The official ITD blank affidavit likewise requests certification of lawful repossession; it does not adjudicate that lawfulness. [C034.] Justia Law+1
A transfer or subrogation to a secondary obligor under § 28-9-618 is not itself a disposition. Its stated succession and future-duty consequences must be kept separate from sale and acceptance. [C035.] Justia Law
Section 28-9-623 gives the identified debtor, secondary obligor, and other secured party/lienholder the right to redeem through tender of fulfillment of all secured obligations plus the specified reasonable expenses and qualifying legal expenses.
The right ends at the first applicable statutory event: collection under § 607; disposition or a contract for disposition under § 610; or acceptance under § 622. No source-supported ordinary “pay arrears and automatically reinstate” right is inferred. [C036.] Justia Law
| Right | Reproduced § 28-9-624 condition |
|---|---|
| Disposition notification | Debtor or secondary obligor may waive only by authenticated agreement entered after default. |
| Compulsory disposition under § 620(e) | Debtor may waive only by authenticated post-default agreement. |
| Redemption | Post-default authenticated waiver is permitted except in a consumer-goods transaction. |
These are exceptions to the general nonwaiver structure, not permission for a blanket original-contract waiver. [C037.] Justia Law
| Acceptance issue | Source-stated requirement |
|---|---|
| Partial satisfaction | Debtor’s authenticated agreement after default. |
| Full satisfaction | Authenticated post-default agreement, or the specified full-satisfaction proposal/no-timely-objection route. |
| Secured-party assent | Authenticated consent or proposal, plus all § 620(a) conditions. |
| Other interests | Required proposals and timely objections under §§ 620–621 must be respected. |
| Compulsory disposition | Acceptance cannot bypass § 620(e) unless its waiver condition is met. |
| Effect | Accepted obligation discharged to the consented extent; specified collateral interests discharged under § 622. |
[C038–C041.] Justia Law+2
The reproduced § 28-9-620 contains no categorical consumer prohibition on partial acceptance. That textual observation does not resolve special consumer-credit law, title-loan restrictions, current official wording, or validity of consent.
If possession has been taken and the relevant 60% threshold is met, § 28-9-620(e) requires disposition:
Disposition must occur within ninety days after possession, unless the debtor and all secondary obligors authenticate a post-default agreement allowing a longer period, or the separate statutory waiver applies. The two bases must not be substituted for each other. [C040.]
The rule applies, in its reproduced wording, to an action arising from a transaction in which a deficiency or surplus is in issue. It contains no express consumer carveout.
Compliance need not initially be proved unless the debtor or secondary obligor places it in issue. Once challenged, the secured party bears the statutory compliance burden. If compliance is not proved, the deficiency is limited using actual versus complying hypothetical proceeds; hypothetical proceeds are presumed to equal the secured obligation plus permitted expenses and attorney fees unless the secured party proves less. Section 628 remains an express qualification. [C042–C044.] Justia Law
Let:
The stated limitation uses:
T−max(A,H)T-\max(A,H)T−max(A,H)with the statutory presumption H=TH=TH=T, unless the secured party proves a smaller HHH.
This relation does not create liability, validate expenses, or override a rule prohibiting a deficiency. It is not a completed debt calculation.
For the separate § 615(f) related-purchaser adjustment, § 626(e) assigns the specified significantly-low-price burden to the debtor or obligor.
Section 28-45-103 applies to a regulated consumer credit sale of goods or services. Its repossession/surrender branches use a cash-price ceiling of $1,000 or less. Where the exact conditions are met, the buyer is not personally liable for the described unpaid sale balance. One branch also says the seller need not resell. Wrongful collateral damage and wrongful failure to make collateral available after default and demand have separate consequences. Obtaining a debt judgment in the stated no-deficiency circumstances bars the specified later repossession/execution against the collateral. [C045.] Justia Law
The threshold is not loan principal, sale proceeds, or current collateral value. It is not a universal rule for all consumer loans or all vehicles. Current official amount authentication remains held.
Section 28-43-303 supplies the referenced allocation rules for consolidated/open-end debts, including the specified first-in ordering and same-day rule. Section 28-43-302’s cross-collateral conditions were also read. No allocation or security-interest validity is determined here. [C046.] Justia Law+1
| Provision | Consequence actually supplied | Qualification |
|---|---|---|
| § 28-9-625(a)–(b) | Court restraint/order and causally resulting damages | No actual violation or loss adjudicated |
| § 28-9-625(c)(2) | Consumer-goods minimum-recovery formula | Applies to the stated actors, failure, and collateral category; subject to § 628 |
| § 28-9-625(d) | Coordinates deficiency reduction/elimination and damages; preserves lost-surplus recovery | No double-recovery inference |
| § 28-9-625(e) | Reproduced $100 amounts for two specified filing/termination failures | Not a general repossession penalty; §§ 509/513 filing merits remain outside scope |
| § 28-9-625(f) | Consequence of certain collateral-list/account-statement failures against a reasonably misled person | Not every unanswered communication |
| § 28-9-628 | Knowledge, reasonable purpose-representation reliance, and specified liability limits | No actual knowledge, reasonable reliance, or defense established |
[C047–C049.] Justia Law+1
The reproduced consumer-goods minimum is the applicable credit-service-charge-plus-10%-of-principal or time-price-differential-plus-10%-of-cash-price relation. No amount is computed. Section 628 excludes a § 616 failure from that particular minimum-damages provision and limits that recovery to once per secured obligation.

This is a researcher self-check, not independent review. The research establishes a substantial but provisional and conditional Idaho personal-property enforcement framework. The source-currentness and identified construction gaps remain explicit. No Idaho, registry dimension6, A066, parent, operational, or publication acceptance is implied.

| § 8-302(1)–(2) | Verified showing of ownership/right to possession and wrongful detention; ordinary notice and opportunity to oppose. |

| §§ 8-303, 8-306 | Undertakings and stay/redelivery mechanisms have separate conditions. |
| § 8-307 | Surety objections and justification have their own procedure; incorporated civil-arrest qualification rules remain unread. |

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
No currently queued material correction is mapped to this component. This does not remove its currentness, access, jurisdiction or application limits.
