S_ID PASS-29 — Idaho ordinary civil appellate briefing, format, appendices, and oral argument
Fresh public-source access date: October 28, 2026, America/Los_Angeles.
Scope: Ordinary magistrate-to-district appellate briefing and argument; higher ordinary civil appeals; necessary Court of Appeals, electronic-filing, citation, privacy, and compliance interfaces.
Evidence disposition
The official current-published briefing and argument rules were recovered and read, including the July 2026 word-count and formatting provisions. Necessary incorporated procedural and electronic-filing rules were also read.
The original amendment orders and the current incorporated Electronic Filing Guide were not recovered through an allowed readable route. The guide linked from the operative rule is API-hosted and was not opened. An independently discovered ordinary public guide route returned 404 and was identified in search metadata as a 2016 draft, not current adopted authority.
The holiday statutes were recovered only as 2025 secondary reproductions after the official statutory route failed. Original-history, statutory-currentness, incorporation, construction, and actual-application holds remain explicit.
No unreviewed P27 or P28 merits supply a premise. Earlier findings, provenance, C033/C035, and the resolved Rule 40 quantity clarification remain unchanged.
Principal findings
The current general limits are 14,000 words for a party’s first brief and 7,000 for a reply—not a universal fifty-page limit. Different handwritten and capital-case branches exist, and a qualifying certificate of compliance is required. [C021–C023.] Idaho Supreme Court
The opening-brief trigger is filing of the transcript and record in the higher appellate court. Responding and reply periods use different events. Rule 34’s cross-respondent sentence does not repeat an express “service” or “filing” verb, and Rule 35 generally combines that brief with the appellant’s reply. Those distinctions are preserved rather than resolved by an invented common deadline. [C005–C008.] Idaho Supreme Court+1
A brief, an addendum of legal authorities, and an augmented appellate record are different instruments. Exclusion of appendices from the word count does not establish that any material may lawfully be placed there or treated as evidence. [C018–C020.] Idaho Supreme Court+1
Argument is not governed by one universal entitlement. The Supreme Court rule states a default with exceptions; district appellate argument is discretionary under Rule 83; the Court of Appeals has express no-argument and telephone-argument provisions. Missing a brief can bar oral participation without automatically proving the merits. [C040–C046.] Idaho Supreme Court+3
1. Reviewed reuse and newly read route structure
Labels:
- O — Official body read: current-published operative rule.
- P — Provisional statute: dated secondary reproduction.
- D — Discovery only: index, search result, historical lead, or unopened source.
- H — Held: material history, incorporation, construction, or application remains unresolved.
1.1 Reuse versus new evidence
| Earlier material |
Retained scope |
New P29 reading |
Remaining boundary |
| Reviewed P25 C052 |
Necessary stay/appeal boundary only; full appellate regime remained open. |
No stay merits reused. Briefing and argument rules read independently. |
Stay, security, finality, and full lifecycle remain separate. |
| P27 C053 and related metadata |
Used only to identify deferred briefing/argument work. |
IAR 34–37, Rule 83’s briefing/motion/argument clauses, and necessary incorporations read afresh. |
No unreviewed gateway or notice-clock premise. |
| P28 C028/C051 and record metadata |
Used only to avoid repeating the record report. |
Only the record-filing event and record-versus-appendix boundary reread. |
No record preparation, fee, or certification report regenerated. |
| Resolved Rule 40 quantity clarification |
Preserved. |
Not reopened. |
No disqualification inquiry. |
| C033/C035 and other holds |
Unchanged. |
No provider, statutory market-access, or checklist work. |
No implied closure. |
1.2 Ordinary route comparison
| Route |
Governing briefing/argument relationship |
Limits |
| Magistrate-to-district appellate review |
Rule 83(o) incorporates IAR brief form, arrangement, filing, and service timing unless the district court orders otherwise. One signed original is filed with that court; other parties receive copies. |
It does not direct filing of the district-appellate brief with the Supreme Court clerk. |
| Rule 83 no-transcript alternative |
Rule 83(f)(2) requires an order setting the opening-brief date. The law-only branch expressly identifies record, briefs, and argument. |
The higher-court transcript-filing trigger cannot simply be applied to a nonexistent transcript. |
| District-original or district-appellate decision on higher review |
The ordinary IAR briefing rules apply, subject to the actual route, court order, and special rules. |
This pass does not decide appealability or jurisdiction. |
| Court of Appeals assignment |
IAR 101 applies the IAR; Rule 110 keeps subsequent appellate filings with the Supreme Court clerk and preserves the specified heading/title structure. |
Assignment does not create a new party-selected filing route. |
| Small claims and de novo proceedings |
Separate rules govern; IRCP 1(b) limits ordinary-rule application. |
Their briefing, evidence, or jury provisions are not imported here. |
| Family, juvenile, criminal, agency, special statutory, federal, tribal, or interstate proceedings |
Expressly different regimes may apply. |
Their shortened schedules and exceptions are not ordinary civil defaults. |
[C002–C004.] Rule 83(f)(3)’s inadequate-record de novo/remand branch was read only as a boundary: an ordinary record-based appeal is not automatically a new trial. Idaho Supreme Court+3
IAR 1’s historical application provision and IAR 2’s definitions were read. The IAR definition of “district court” excludes the magistrate division; Rule 83 supplies the distinct incorporation. No actual court assignment, order, or proceeding is classified.
2. Brief categories, timing, and supplemental submissions
2.1 Ordinary merits briefs
| Category |
Author and required/permitted act |
Source-stated reference event |
| Opening brief |
Appellant files the brief with the higher appellate clerk. |
Within 35 days after the reporter’s transcript and clerk’s or agency’s record have been filed with the Supreme Court. |
| Respondent’s brief |
Respondent files; a cross-appellant’s brief may be joined. |
Within 28 days after service of appellant’s brief. |
| Cross-appellant’s brief |
Cross-appellant files, separately or combined as permitted. |
Same stated responding period. |
| Cross-respondent’s brief |
If a cross-appeal exists, Rule 35(c) requires the appellant’s cross-response with Rule 35(b) contents. |
Rule 34(c) says within 28 days after the cross-appellant’s brief; it does not repeat an express filing/service verb in that sentence. |
| Reply |
Appellant or cross-appellant may reply in rebuttal to the respondent or cross-respondent. |
Rule 34(c) uses 21 days after service of any respondent’s brief. |
| Combined reply/cross-response |
Rule 35(c) requires combination unless the court orders otherwise. |
The different Rule 34 clauses and any governing order must be reconciled; this report supplies no assumed common deadline or added word allowance. |
| Multiple parties/consolidated appeals |
Any number may join a brief; a party may adopt part of another party’s brief by reference. |
No automatic multiplication of a word allowance is stated. |
[C005–C009.] Filing the appeal notice, lodging the transcript below, serving the record, filing the settled materials in the higher court, and receiving the clerk’s scheduling notice are not the same event. Idaho Supreme Court+1
IAR 29(b) and IREFS 20(e) require the appellate clerk’s notice to identify the record/transcript filing date and brief deadlines. Their earlier settlement/preparation periods were not regenerated. [C005.] Idaho Supreme Court+1
2.2 District appellate motions differ from merits briefs
Rule 83(n) requires district-appellate motions to be filed in the district court unless expressly required below, served as trial-court motions, and accompanied by a supporting brief. Its opposition period is fourteen days from service. The motion is decided without oral argument unless ordered.
That fourteen-day period is not the ordinary merits-respondent period, and Rule 7’s hearing-relative motion schedule does not silently displace a more specific rule. [C010.] Idaho Supreme Court+1
For higher appellate motions, IAR 32 requires a supporting brief, statement, or affidavit; service on the parties; and its fourteen-day opposition relation. Motion argument is ordinarily unavailable unless ordered. The printed uncontested-motion form was not reproduced or completed. [C011.] Idaho Supreme Court
2.3 Extensions and extraordinary alteration
An ordinary brief-extension motion under Rule 34(d):
| Required subject |
Legal function |
| Existing due date |
Identifies the period sought to be changed |
| Prior extensions and original due date |
Preserves extension history |
| Earlier denials or partial denials |
Separately disclosed |
| Grounds for necessity |
Supports the required good-cause showing |
| Requested duration and proposed due date |
Does not itself change the period |
| Any stipulation |
Not binding on the court |
| Opposing parties’ stated position |
Does not replace a court order |
| Assurance of timely completion within the requested period |
Part of the required affidavit showing |
The motion may be made no later than the brief’s due date. Extensions are not favored and require the specified clear showing of good cause. Rule 46 permits an immediate ex parte order, subject to review on a written objection filed within seven days of service of the motion, not seven days from the order. [C012–C013.] Idaho Supreme Court+1
IAR 44 separately permits altered, shortened, or eliminated steps upon a court finding of extraordinary circumstances. Its protected notice/rehearing periods are expressly excepted. No actual shortened schedule, excuse, extension, or tolling is determined. [C014.] Idaho Supreme Court
2.4 Supplemental authority versus supplemental argument
| Submission |
Rule 34(e) conditions |
| Additional authority only |
Before opinion issuance; written notice to court and all parties; identify the issue and relevant authority pinpoint; no written comment; prior leave not required by this branch. |
| Additional authority and argument |
Motion under Rule 32, with or without proposed supplemental brief; good cause why material was absent earlier; court order sets the adverse party’s reply time. |
[C015.] The rule’s reference to identifying a headnote or relevant pages is a submission-format instruction, not a determination that a headnote is controlling law. No opinion, headnote, or party argument was investigated. Idaho Supreme Court
2.5 Amicus briefs
Rule 8 is a distinct permission-based route:
| Issue |
Complete material condition |
| Appearance |
Attorney, or person/entity through an attorney; court request or leave on served motion |
| Motion |
Proposed brief accompanies it; interest, supported party, and requested brief/argument participation identified |
| Contents |
Tables; identity, interest, authority to file; required authorship/funding disclosures; argument |
| Relationship to Rule 35 |
Need not use all Rule 35 divisions; may include a statement of the case and need not include a standard-of-review statement |
| Form |
Rule 36 applies; cover identifies support and affirmance/reversal position |
| Filing |
No later than seven days after filing of the supported party’s initial brief; a neutral amicus uses appellant’s initial-brief filing |
| Later filing |
Court may permit and set the opposing response time |
| Objection |
Motion within fourteen days after service of the leave motion |
| Reply |
Requires court permission |
| Oral argument |
Requires court permission |
| Order |
Written order specifies the manner of appearance |
[C016.] Rule 8 does not state a separate numeric word allowance. Rule 34 begins with “all briefs” but specifies the general counts in terms of a party’s briefs. The exact limit for an amicus or specially ordered supplemental brief is not invented from that wording or treated as unlimited. Idaho Supreme Court
3. Content, issues, citations, and appendices
3.1 Required organization
| Division |
Appellant |
Respondent |
| Contents |
Page-referenced table, including argument outline |
Same |
| Authorities |
Alphabetically arranged case table, statutes, other authorities, with brief-page references |

To the extent of disagreement with appellant’s statement |
| Issues |
Concise, fair presentation; includes subsidiary issues fairly comprised |
May identify insufficient, incomplete, or additional issues in the prescribed form |
| Attorney-fee claim |
In issues, with basis |
In additional issues, with basis |
| Argument |
Contentions, reasons, authorities/statutes, and supporting transcript/record references |
Same substantive categories |
| Conclusion |
Precise relief requested |
Same |
[C017.] Rule 35’s listed divisions do not separately enumerate a jurisdictional-statement heading or a standalone standard-of-review heading. That does not establish that necessary legal analysis, an applicable standard, or another governing requirement may be omitted. Full standards and preservation law remain held. Idaho Supreme Court
Rule 41(a) supplies the narrow fee-claim qualification: the claim belongs in the party’s first appellate brief, but the court may permit a later claim on conditions. This is not a fee-entitlement or award finding. [C017, C048.] Idaho Supreme Court
3.2 Responding issues, adoption, and reply scope
IAR 15(a) distinguishes an additional issue that seeks no affirmative reversal, vacation, or modification from a cross-appeal seeking affirmative relief. This pass does not decide which category an issue occupies.
Rule 35(c) permits rebuttal argument in reply. Rule 35(h) permits joint briefing and adoption by reference in multiple-party cases, including consolidated appeals. Neither provision proves that an issue is preserved, supported, reviewable, or meritorious. [C009, C018.] Idaho Supreme Court+1
No categorical judicial doctrine of abandonment, “new issue in reply,” or incorporation by an unidentified filing is supplied without its necessary authority.
3.3 Record and authority citations
| Requirement |
Boundary |
| Reporter’s transcript |
Use the prescribed transcript designation with volume, page, and line |
| Clerk’s or agency’s record |
Use the prescribed record designation with volume, page, and line |
| Placement |
Record/transcript references belong in the body, not footnotes or endnotes |
| Authority citations |
Argument must cite relevant authorities/statutes |
| Case-name style |
Rule 36 requires italics or underlining |
| Party references |
Rule 35 prefers clear trial-role, descriptive, or other permitted identification rather than excessive appellate-role labels |
| Minor references |
Initials or another non-name designation under the rule |
[C019.] No printed sample citation, caption, party name, or numerical record example is reproduced. Exact citation-manual requirements, unpublished-authority restrictions, and precedential force remain held where their current operative source was not read. Idaho Supreme Court+1
3.4 Appendix/addendum and record boundary
Rule 35(f) permits reproduction in the brief or an end addendum of necessary statutes, rules, regulations, recent unpublished-in-reporter decisions, or relevant portions. Its separate real-property paragraph requires a record-based depiction when that category applies; it is not imposed on every debt appeal.
No general, mandatory federal-style joint appendix was authenticated from these read clauses. Conversely, Rule 34’s exclusion of appendices/exhibits from length calculations does not establish unlimited permissible content. [C020.]
Record augmentation under IAR 30 is different: it has its own motion, prior-presentation, service, opposition, and order requirements. Filing that motion does not suspend the briefing schedule. Attaching material to a brief is not a substitute for that procedure or proof of admissibility. Idaho Supreme Court+1
4. Length, form, signatures, and electronic structure
4.1 Current length provisions
| Branch |
Current published limit or requirement |
| General first party brief |
No more than 14,000 words |
| General reply brief |
No more than 7,000 words |
| Handwritten brief by qualifying prisoner |
First brief no more than 50 pages; reply no more than 25 pages |
| Unitary capital criminal/postconviction review |
Separate exception; not applied to ordinary civil briefing |
| Overlength |
Requires leave |
| Counted material |
Headings, footnotes, quotations |
| Excluded material |
Front cover, caption page, contents, authorities, signature block, service/compliance certificates, appendices/exhibits |
| Compliance certificate |
Except the stated handwritten-prisoner and non-word-processor typewritten-unrepresented branches, states word count and appears immediately before the submitter’s signature |
| Counting tool |
Preparer may rely on the word-processing system’s count |
[C021–C023.] The certification exception is not a blanket exemption from length limits. The current text does not expressly supply a combined reply/cross-response aggregate limit or multiply a joint brief’s allowance by the number of parties. Those questions remain qualified. Idaho Supreme Court
4.2 Preparation requirements
| Feature |
Rule 36 requirement |
| Uniform printable page |
8½ × 11 inches |
| Main text |
Double-spaced |
| Exceptions |
Headings, footnotes, block quotations may be single-spaced |
| Margins |
At least one inch on all sides |
| Pagination |
Page numbers in bottom margin |
| Typeface |
Proportionally spaced Times New Roman or Century Schoolbook |
| Color |
Black |
| Emphasis |
Italics or bold permitted |
| Type size |
14 point or larger, including footnotes |
| Unrepresented party without word-processing access |
Typewritten on the stated white-paper/black-ribbon basis; standard 12-point type permitted, other applicable requirements retained |
| Qualifying handwritten prisoner brief |
Legible hand-printing in black ink; remaining applicable requirements preserved |
| Cover |
Required appellate-court/action, brief-role, originating-court/official, and counsel/representation information |
[C024.] No colored-cover scheme, universal line numbering, fixed rebuttal-page allocation, or current brief-bookmark rule is invented. The linked model cover was not opened; the operative cover-text requirements were read. Idaho Supreme Court
4.3 One original, signatures, and certification
Rule 34 requires one signed original and no additional court copies. Rule 83(o) likewise requires one signed original for the district appellate court but service copies for the other parties. Court-copy counts and service obligations are different.
IAR 11.2 requires the stated Idaho attorney-of-record signature for represented parties and the party signature when unrepresented. The signature certifies reasonable inquiry, legal/factual grounding, and proper purpose; it is not a merits finding. [C025–C026.] Idaho Supreme Court+2
IREFS 9 permits specified electronic signature forms and imposes particular conventional-original or scanned-copy retention duties for other signers and substituted signatures. No signature specimen is reproduced. Professional admission under IAR 9 and its Bar Rule 227(j) incorporation remains a separate qualification; no attorney eligibility is determined. Idaho Supreme Court+1
4.4 Electronic filing and attachments
| Requirement |
Complete material qualification |
| Format |
Text-searchable PDF or PDF/A; direct conversion if possible |
| Scanned-attachment exception |
Applies to the described attachment/exhibit, not a brief or memorandum merely labeled as one |
| Per-file size |
No more than 50 MB; larger documents require separate compliant files |
| Envelope size |
No more than 100 MB |
| Same-case contemporaneous submissions |
Same envelope where the rule requires, with size exceptions |
| Attachments |
Unified PDF to extent practicable, except the specified separately filed categories |
| Separate items |
Proposed judicial-signature documents, protected attachments, and fee-waiver applications |
| Identification |
Separate-document descriptions must meet the rule’s consistency requirements |
| Technical guide |
Rule 6(d) incorporates the court-approved guide; current guide body was not recovered |
| Higher briefing |
IREFS 20(f) states electronic submission/service for briefs in all case types, with IAR compliance otherwise |
[C027–C029.] Rule 4’s self-represented choices, Rule 5’s exceptions, Rule 11(b)’s court digitization authority, and IAR 36’s paper/handwritten branches are preserved. This report does not infer universal portal access, mandatory account creation, or a universal paper-filing right from one clause alone. Idaho Supreme Court+3
The current guide’s unread status leaves brief-specific bookmarking, hyperlink, technical validation, and any additional appendix-layout requirements unresolved. A 2016 draft search excerpt is not used to prohibit or require present-day hyperlink behavior.
5. Filing, service, computation, and technical defects
5.1 Filing and service are separate
For higher appellate papers, IAR 20 distinguishes the special physical-receipt categories from other appellate documents that receive the stated mailing treatment. A brief’s service obligation extends to the parties specified by the rule; service must be certified.
Electronic rules prevail on conflicting filing, format, and service matters within their scope. Court service under IAR 47 and IREFS 18 is not the same as party service under IREFS 17. [C030–C031.] Idaho Supreme Court+2
Rule 17’s qualifying electronic appearance/consent and designated-service-contact conditions matter. Service completes when the system sends the email to the selected service contacts; the courtesy-copy function is not legal service. No account or contact was inspected or changed. Idaho Supreme Court
5.2 Electronic filing date and correction
| Event |
Governing relation |
| Filing |
Submission plus acknowledged acceptance under Rule 11, read with Rule 12 |
| Timestamp |
Court’s time zone; before-midnight receipt, error-queue, acceptance-relation-back, and nonbusiness-day clauses retained |
| Rejected document |
Explanation/correction notice; conditional resubmission and relation-back request |
| Correction period |
Three business days, excluding legal holidays, with the stated next-judicial-day qualification |
| Technical receipt failure |
Satisfactory proof plus the Rule 14 resubmission procedure |
| Technical-failure period |
Seven business days from notice that submission was unsuccessful, excluding legal holidays |
| Mandatory/discretionary relief |
On the required technical proof, filing-date relation back is mandatory; other scheduling relief is discretionary |
| Uncorrected rejection |
The rule’s not-filed consequence applies |
| Acceptance |
Does not establish that a later judicial format or merits challenge cannot occur |
[C032–C033.] No system-failure story, filing attempt, screenshot, log, rejected document, or relation-back entitlement was assessed. Idaho Supreme Court+3
5.3 Counting and additional time
| Source |
Rule structure |
| IAR 22 |
Excludes the trigger day; qualified last-day extension for Saturday, Sunday, or statutory nonjudicial day |
| §§ 1-1607, 73-108 |
Nonjudicial-day/holiday definitions and exceptions; only provisional 2025 bodies recovered |
| IRCP 2.2 |
Its own scope includes intermediate-day counting, clerk inaccessibility, extension, and mail-addition provisions |
| IREFS 17(h) |
Party electronic service after 5 p.m. local time adds one day to the prescribed period |
| IAR 46 |
Good-cause extensions subject to Rule 34(d) for briefs |
| IAR 48 |
Unspecified practice provision, not automatic adoption of every civil mail rule |
[C034–C035.] No universal three-day addition is attached to every appellate brief. Filing-based, service-based, order-date, and hearing-relative periods must remain separate. The briefing-specific Rule 34(d) due-date condition is not erased by a general civil extension clause. Idaho Supreme Court+3
6. Privacy, sealing, and appendix access
6.1 A filed appendix does not become unrestricted public material
IREFS 6–7 require protected attachments to be separately handled. A confidentiality label is subject to court verification; the court may make a wrongly designated document public.
IRCP 2.6 and IREFS 15 place redaction responsibility on the filer, even for a document the filer did not create. The clerk does not perform a universal redaction audit. Required limited identifiers, exceptions, reference-list/unredacted-copy mechanisms, and later-public-document conditions remain. [C036–C037.] Idaho Supreme Court+2
ICAR 32 controls conflicting public-access provisions. Privilege, public-access exemption, sealing, redaction, and appellate-record inclusion are not interchangeable.
6.2 Necessary sealing consequences
| Event |
ICAR 32(i) relation |
| Newly filed material subject to sealing/redaction motion |
Temporary seven-day seal; continued protection requires the prescribed judicial determination/order |
| Previously filed material |
Temporary sealing is discretionary under the stated criteria |
| Hearing |
Required when requested by the specified party or affected nonparty, except the personal-identifier redaction exception |
| Final sealing/redaction |
Least-restrictive protection, stated findings, specific written order; protected content must not be revealed by the public order |
| Denial concerning previously unfiled material |
Material is withdrawn; it cannot be relied upon as stated |
| Submission relying on withdrawn material |
Permitted amended submission within seven days from the denial order |
| Subsequent change |
Court may reconsider, alter, or amend under the rule |
| Protected access |
Does not authorize dissemination beyond the permitted purpose/order |
[C038.] The required grounds include the rule’s intimate-information, potentially libelous, financial-security, judicial-security, life/safety, fair-trial, and unredacted-identifier findings. No ground is found here. The distinct criminal presentence-report exception was read but not applied. Idaho Supreme Court+1
Failure to redact and knowing public disclosure have their separate contempt/sanction predicates. They do not establish an actual offense, sanction, fee, or loss of the appeal. Full privilege and public-records law remain held. [C039.]
7. Oral argument
7.1 Route-specific argument structure
| Route |
Rule |
| Supreme Court ordinary appeal |
Rule 37 states oral argument unless an all-party submission-on-briefs stipulation is approved or the court orders submission without argument. |
| Objection to Supreme Court no-argument order |
Written objection within 21 days of the order’s date, stating reasons; decided without argument. |
| Court of Appeals assignment order |
Rule 108(b) permits the Supreme Court to designate submission without argument, with the stated objection branch. |
| Court of Appeals’ own order |
Rule 109 independently permits submission on briefs; same stated twenty-one-day objection relation. |
| Magistrate-to-district appeal |
Rule 83(p) says argument may be heard after motion-style notice. Rule 83(f)(2)(A)’s particular law-only order expressly includes argument. |
| Appellate motion |
Ordinarily decided without argument under IAR 32(f) or Rule 83(n), unless ordered. |
| Amicus |
Argument requires separate permission under Rule 8. |
[C040–C042.] A request or objection is not itself a grant of time. These periods run from their stated events, not a selected actual hearing calendar. Idaho Supreme Court+3
7.2 Time, sequence, and multiple parties
| Subject |
Rule 37 relation |
| Merits argument |
Thirty minutes per side, subject to good-cause extension or shortening |
| Preliminary motion, if argument allowed |
One counsel per side, ten minutes each |
| Expedited calendar |
Court may alter procedure and shorten argument |
| Multiple parties |
Allocate within each side before argument; absence of agreement permits the stated court-allocation request |
| Allocation request |
At least fourteen days before argument |
| Court allocation |
At least seven days before argument |
| Allocation choices |
Equal, unequal, divided, or full time for co-parties in the court’s discretion |
| Opening/closing |
Appellant or petitioner opens and closes; court controls sequence with multiple/third parties |
| Fixed rebuttal reservation |
No separate universal numeric allotment is stated in Rule 37 |
[C043–C044.] No party count, time allocation, rebuttal choice, or oral presentation was prepared. Idaho Supreme Court
7.3 Telephone argument and actual appearances
Rule 111 permits Court of Appeals telephone argument by all-party stipulation and court approval. After argument or stipulated waiver, the court may order additional telephone dialogue. The general Rule 37 format applies insofar as practicable; the court may limit issues, and the clerk records it.
This does not establish a universal right to video argument, a Supreme Court remote-appearance procedure, or an approved platform/account. [C045.] Idaho Supreme Court
IAR 9’s non-Idaho-attorney route contains its fourteen-day motion/order and existing-admission qualifications. The Bar Rule 227(j) incorporation was not completed; no professional appearance eligibility is determined. [C025, C045.]
7.4 Missing briefs and nonappearance
| Event |
Source-stated consequence |
| No respondent brief |
Submission on appellant’s brief without argument unless appellant requests argument |
| A party filed no brief |
That party may not present oral argument |
| One or more parties fail to appear |
Court may hear appearing participants, vacate hearing, or decide on briefs |
| Nobody appears |
Decision on briefs unless otherwise ordered |
| Counsel fails to appear |
Court may impose penalties/sanctions including reasonable fees |
[C046.] These are procedural consequences, not a determination that appellant’s facts, legal conclusions, or requested relief are correct. Idaho Supreme Court
8. Compliance, correction, and consequence boundaries
| Issue |
Complete source-supported limit |
| Late brief |
IAR 21 and Rule 83(m) distinguish a nonjurisdictional step from the specified jurisdictional appeal-notice failures. Discretionary action can include dismissal. |
| Involuntary dismissal motion for noncompliance |
IAR 32(a) generally requires filing at least twenty-one days before merits argument; separate jurisdictional exceptions are not briefing deadlines. No no-argument-case timing formula is invented. |
| Unsupported or incomplete argument |
Rule 35 requires contentions, reasons, authorities, and record support. Actual abandonment, preservation, or reversible-error consequences require further authority and application. |
| Overlength/nonconforming brief |
Leave is required for overlength; electronic correction/rejection rules may apply. No universal automatic merits loss is stated by the length rule. |
| Signed paper violating IAR 11.2 |
Court must impose an appropriate sanction upon the predicate violation; reasonable causal expenses/fees are possible, not automatically a specified amount. |
| Signature sanction procedure |
Motion or court initiative is stated. No universal twenty-one-day safe harbor is imported from another rule system. |
| Vexatious-litigant referral |
IAR 11.2(b) incorporates ICAR 59; its complete regime was not examined. |
| Supplemental record motion |
Does not automatically stay briefing. |
| Fee claim in first brief |
Rule 41(a) allows a later claim only by court permission on conditions; underlying entitlement/amount remain separate. |
| Sealed material withdrawn after denial |
ICAR 32(i)(4) governs reliance and the limited amended-submission period. |
[C047–C050.] No defect, bad faith, waiver, dismissal, sanction, or professional misconduct is found. Constitutional notice and opportunity-to-respond requirements, full fee taxation, and sanction-merits law remain held. Idaho Supreme Court+4

16.3 Remaining gaps and conclusion
The principal unresolved matters are the original 2026 amendment orders, the current incorporated technical guide, combined reply/cross-response timing and length, amicus/supplemental length construction, current citation restrictions outside the read rules, and complete privacy, professional-appearance, sanction, standards, and special-regime law.
No actual or invented party, lawyer, judge, case, brief, appendix, record, account, financial input, notice, service event, filing, order, argument, or calendar was supplied or constructed. No conformity, preservation, waiver, entitlement, liability, sanction, or outcome was determined.
This is a researcher self-check, not independent review. The component is supported by newly read official operative rules, with expressly provisional statutory support and preserved original-history, incorporation, construction, and actual-application holds. Earlier findings and provenance remain unchanged. No Idaho, dimension4, A066, parent, operational, or publication acceptance follows.
