S_ID PASS-19 — Idaho ordinary personal-property exemptions and homestead protection
Fresh public-source access date: October 28, 2026, America/Los_Angeles.
Scope: Ordinary judgment-execution personal-property exemptions and homestead protection, including the necessary selection, valuation, claim, contest, appraisal, release, and cost interfaces.
Evidence disposition: The official Idaho statutory routes attempted in this pass did not yield readable operative bodies. The statutory findings below are therefore provisional readings of the identified 2025 reproductions, supported where available by legislative texts whose introduced or engrossed status is preserved. Official Idaho constitutional text, current-published court rules, and generic exemption instructions were read. Those materials do not authenticate every current statutory clause or its complete amendment chain.
Earlier findings, provenance, C033/C035, and other holds remain unchanged. No earlier wage, bank, mortgage, Article 9, or bankruptcy finding supplies a substantive premise here.
Principal findings
The personal-property provisions use different kinds of limits. They distinguish per-item limits, aggregate limits, one-item limits, a debtor-interest allowance, necessity/use qualifications, and claim-specific exceptions. The amounts cannot be combined into an undifferentiated household allowance. [C007–C018.] Justia Law+1
The reproduced 2025 homestead law materially changes the spouse provision. Section 55-1002 now says each spouse may separately claim the amount specified in § 55-1003. The later amended H0282 text supports that change. Its introduced version also proposed a proceeds amendment, but that provision was omitted from the later amended text; it is not treated as law here. [C022, C030, C052.] Justia Law+2
Homestead status, a lien against excess value, and authority to sell are separate questions. A statutory allowance alone does not establish an executable surplus, divisibility, a qualifying bid, or a valid sale. Chapter 55-11 supplies a special appraisal-and-sale procedure with its own proof, notice, and payment requirements. [C029, C031, C034–C040.] Justia Law+2
Three proceeds protections have different predicates and durations: three months for specified traceable indemnity proceeds; one year for qualifying voluntary homestead-sale or destruction-insurance proceeds; and six months for the exemption money paid after the special execution sale. None is a universal exemption for every sale receipt. [C019, C030, C039.] Justia Law+2
The general post-levy claim procedure is not the only statutory branch. Section 11-203 preserves a court-motion route after an enforceable judgment, common-law remedies, and a limited repeat-collection-cost consequence. That consequence is not a categorical prohibition on another levy. [C045–C047.] Justia Law
1. Governing framework and legal distinctions
The following status labels apply:
- P — Provisional: wording read in the identified secondary statutory reproduction.
- O — Official body read: constitutional, court-rule, or governmental publication, within its stated bounds.
- H — Held: a material currentness, incorporation, construction, or application dependency remains unresolved.
1.1 Execution, exemption, ownership, and debt are different questions
| Legal category |
Source-supported distinction |
What is not established |
| Enforceable judgment |
Rule 69 and § 11-104 provide the execution framework for the specified judgment or order. |
Validity, finality, jurisdiction, amount, duration, or enforceability of any actual judgment. |
| Property subject to execution |
Section 11-201 concerns the debtor’s property and interests that are not exempt by law or court order; it also distinguishes levy from mere issuance of execution. |
That property belonging partly or wholly to another person is the debtor’s property. |
| Personal-property exemption |
Chapter 11-6 protects defined property subject to its conditions and exceptions. |
Ownership, value, use, dependency, or eligibility from an item’s label. |
| Homestead |
Chapter 55-10 supplies its own ownership, principal-home, selection, declaration, and exception rules. |
A tax homeowner exemption, bankruptcy election, or actual title result. |
| Lien |
Certain liens remain preserved, and § 55-1009 addresses a judgment lien on excess homestead value. |
Automatic lien validity, priority, avoidance, release, or sale authority. |
| Claim or contest |
Section 11-203 provides procedures for asserting exemption or third-party interests. |
Automatic cancellation of the judgment or affirmative damages. |
| Release of property |
A statutory or court-directed release ends the particular restraint as provided. |
Satisfaction or discharge of the underlying debt. |
| Bankruptcy exemption |
Section 11-609 addresses a separate federal proceeding. |
The ordinary execution rules do not complete federal domicile, election, avoidance, or discharge law. |
[C002–C004, C018, C050; S002–S008.] Justia Law+2
The official constitutional text actually read includes general property, due-process, open-courts, and debt-imprisonment provisions. Those provisions do not themselves supply the dollar allowances used below, and no broader constitutional remedy is determined. [C002.] Idaho Secretary of State+2
1.2 Individual, dependent, and residence predicates
Section 11-601 defines an individual as a natural person, not a corporation, partnership, or other artificial entity. A dependent is an individual deriving support primarily from another individual.
Section 11-602 gives Idaho residents the chapter’s exemptions and directs nonresidents to the exemption law of their residence. Its resident definition concerns intent to maintain a home in Idaho. This is a chapter-specific rule, not a completed interstate or federal-bankruptcy domicile analysis. [C004.] Justia Law+1
No general “household exemption” permits all persons living together to pool every allowance. Ownership and each provision’s individual/dependent conditions remain necessary.
1.3 Married persons and separate property
Section 11-204 protects the described premarital and subsequently acquired separate property, and noncommunity rents, issues, and profits, from execution for the other spouse’s separate debts. It is not a universal exemption from the owner’s own debts. [C005.] Justia Law
Sections 32-903 and 32-906 were read to identify separate/community-property distinctions. The gendered provisions in §§ 32-910 and 32-911 were also read but are not generalized into a complete modern community-debt rule. The full management, support, consent, estate, and creditor-priority regimes remain held. Justia Law+2
The express 2025 homestead spouse provision discussed below does not, by itself, establish doubled personal-property caps, the allocation of jointly owned goods, or permission to count the same ownership interest twice. [C006.]
2. Ordinary personal-property categories
2.1 Categories and limits
The following table states the reproduced statutory categories. Every row remains subject to the applicable ownership, use, residence, exception, and claim requirements.
| Property category |
Source-stated protection |
Important boundary |
| Burial plot |
Plot for the individual and family, § 11-603(1) |
No numerical value limit appears in this clause; other applicable exceptions are not erased. |
| Health aids |
Reasonably necessary to enable the individual or dependent to work or sustain health, § 11-603(2) |
Medical label alone does not establish necessity. |
| Household furnishings, goods, appliances |
Held primarily for personal, family, or household use of the individual or dependent |
Shares § 11-605(1)’s per-item and aggregate limits. |
| Apparel, animals, books, musical instruments |
Reasonably held for personal use of individual or dependent |
Same subsection limits; not every business or investment item. |
| Portraits and heirlooms |
Particular sentimental value to the individual |
Same subsection limits; sentimental importance is not an unlimited-value exemption. |
| Section 11-605(1) group |
Not more than $1,000 on one item and $7,500 total for that subsection |
The aggregate is not a separate allowance for each subcategory. |
| Jewelry |
Personal use of individual; $1,000 aggregate |
Not $1,000 for each item. |
| Implements, professional books, business equipment, tools of trade |
$10,000 aggregate |
Occupational classification and ownership remain necessary. |
| Motor vehicle |
One vehicle, exempt to a value not exceeding $10,000 |
Not a $10,000 allowance for each vehicle. |
| Food or water, containers and shelving |
Sufficient for twelve months for the individual or dependents |
No household quantities or market values are supplied. |
| Required occupational/service equipment |
Arms, uniforms, and accoutrements required for use as a peace officer, National Guard member, or military service member |
Distinct from the separate firearm provision. |
| Irrigation water right |
Not over 160 inches, used to irrigate land actually cultivated by the individual |
No conversion of the statutory unit or water-right validity finding. |
| Crops |
Crops grown or growing on fifty acres leased, owned, or possessed and cultivated by the individual, with value not exceeding $5,000 |
Land interest, cultivation, area, and value predicates all matter. |
| Firearm |
One firearm valued at $1,500 or less |
The wording is a whole-item value condition, not expressly a partial $1,500 interest in a more valuable firearm. |
| Tangible-personal-property allowance |
Individual’s aggregate interest in any tangible personal property, not over $1,500 |
Does not by itself establish stacking, duplicate valuation, or an exemption for intangible property. |
[C007–C014; S003 §§ 11-603, 11-605.] The monetary provisions were also compared with the 2020 amendment text and the dated official exemption notice, without treating either as current official codification. Justia Law+3
2.2 Public property and the price/mortgage qualification
Section 11-605(5) separately lists specified public buildings, grounds, equipment, and dedicated public property. Those are not ordinary household allowances.
The same subsection contains a sentence referring to property mentioned in “this section” and excluding execution exemptions for a judgment recovered for its price or upon a mortgage on it. Its placement does not justify silently narrowing that sentence to public buildings alone. Its interaction with the general § 11-607 exceptions and secured law remains material. [C015.] LegiScan
2.3 Insurance, pensions, benefits, and earnings: bounded treatment
Section 11-605(9) was read. It addresses an owned life-insurance contract, excludes credit-life insurance, and excludes specified value attributable to premiums paid within the stated six-month period before the applicable bankruptcy or attachment/levy event.
No conclusion is made that every policy, cash value, beneficiary interest, recent contribution, or insurance proceeds balance qualifies. Full insurance law and federal-bankruptcy interaction remain held. [C016.] Justia Law
The following categories remain separate:
| Category |
Treatment in this pass |
| Earned-but-unpaid compensation and wage restrictions |
§ 11-605(11) identified; P7 wage formulas and amounts not rebuilt. |
| Deposited earnings and federal benefits |
P8 bank-review/tracing regime not reused or rerun. |
| Disability, support, injury, death-related payments |
§ 11-604 and its full application remain a separate qualified-money inquiry. |
| Retirement, pension, and education-related plan interests |
Complete § 11-604A and every necessary tax/plan incorporation remain required before a positive qualification. |
| Federal public benefits and medical savings |
Read only to identify exclusions and dependencies, not to apply federal protection. |
| Education savings outside a verified plan provision |
No automatic exemption or no-protection conclusion. |
Unknown limits or unread incorporations are not unlimited protection.
2.4 Personal-property proceeds
Section 11-606 protects traceable indemnity proceeds when property that could have been claimed exempt is condemned, lost, damaged, or destroyed and the owner is indemnified. The protection lasts three months after receipt and does not increase the aggregate value limit otherwise applicable.
Its statutory examples do not make the protection a universal rule for voluntary sales or every replacement purchase. [C019.] Justia Law
3. Exceptions, preserved liens, and election limits
3.1 Chapter 6 claim-specific exceptions
| Provision |
Exception |
Qualification |
| § 11-607(1)(a) |
Alimony, support, maintenance; specified unpaid employee earnings; state/local taxes; enumerated criminal, intentional-injury, driving-related, false-pretense or written-false-financial-statement claims; dwelling rent, food and lodging |
This paragraph expressly excepts § 11-603 property from its listed levy authority. |
| Employee-earnings claim |
Up to one month’s compensation or full-time equivalent |
This describes the creditor’s unpaid-compensation claim, not an extra month of wages protected for the debtor. |
| § 11-607(1)(b)(1) |
Purchase price or a loan expressly made and used to enable purchase of the property |
Not every loan associated with the debtor. |
| § 11-607(1)(b)(2) |
Labor/materials to make, repair, improve, preserve, store, or transport the property |
Property-specific relationship required. |
| § 11-607(1)(c) |
Identified agency support enforcement against the specified unemployment category |
Full support and benefit incorporations held. |
| § 11-607(2) |
Statutory liens and security interests preserved |
Does not authenticate a lien, resolve priority, or override federal avoidance law. |
[C017–C018.] Justia Law
These chapter 6 exceptions are not silently transferred into the separate homestead chapter. Homestead exceptions are addressed in Section 4.5.
3.2 Selection, combination, and nonwaiver
The read text supports specific category caps and, for § 11-605(10), an aggregate interest allowance. It does not provide a complete general formula for:
- Stacking that allowance on every other exemption.
- Combining spouses’ personal-property limits.
- Allocating jointly owned indivisible goods.
- Counting the same interest in two categories.
- Selecting replacement property after every kind of sale.
- Treating a contractual waiver as invariably valid or invariably void.
No blanket ordinary-property nonwaiver statute was authenticated in this pass. Section 55-1007’s marital-consent protection, statutory lien preservation, procedural late-claim rules, and federal bankruptcy waiver law are distinct issues. [C006, C050.]
This is a construction gap, not permission to waive or seize property.
4. Homestead creation, amount, spouses, and preservation
4.1 Qualifying property and owner
Section 55-1001 includes:
| Category |
Condition |
| Dwelling house or mobile home |
Owner resides or intends to reside there, with the described buildings and land. |
| Manufactured housing |
Included in dwelling/mobile-home definitions. |
| Unimproved land |
Owned with the intention of placing a house or mobile home and residing there. |
| Mobile home on unowned land |
May qualify whether or not permanently affixed and whether or not the underlying lot is owned. |
| Principal home |
Property must actually be intended or used as the owner’s principal home. |
| Owner |
Includes purchasers under deed of trust, mortgage, or contract, and a life-estate holder. |
[C020.] These are legal categories; no title, occupancy, future intention, life estate, or ownership share is found. Justia Law
4.2 Amount and the 2025 spouse amendment
The reproduced § 55-1003 sets a $175,000 homestead exemption amount and permits qualifying land regardless of area. It does not use a county median, property-tax homeowner formula, federal median, or CPI mechanism. [C021.] Justia Law
The reproduced 2025 § 55-1002 permits selection from community, jointly owned, or either spouse’s separate property and states that each spouse may separately claim the § 55-1003 amount. An unmarried owner may select from that owner’s property. [C022.] Justia Law
No combined dollar result is calculated. Ownership, claims, net interests, creditor category, and application of the new provision remain necessary.
The later amended H0282 text contains that spouse change and a July 1, 2025 effective clause. Its introduced version proposed an additional § 55-1008 bankruptcy-proceeds change; that addition is absent from the later amended text. [C052.] LegiScan+1
4.3 Automatic protection and declaration-dependent branches
| Branch |
Statutory event |
| Occupied principal residence |
Automatic protection from the time the qualifying property is occupied as the owner’s principal residence. |
| Improved or unimproved land not yet occupied |
The prescribed declaration or declarations must be recorded. |
| Other owned property presently occupied or claimed |
The specified abandonment declaration is also required for that other property. |
| Unoccupied mobile home on unowned land |
Section 55-1004(1) refers to delivery of a declaration “as described in § 55-1006.” |
The declarations have prescribed statements, legal-description and value/date information, and acknowledgment requirements. No declaration was created or filled. [C023–C025.] Justia Law
Cross-reference hold: Section 55-1006 is the abandonment/nonabandonment provision. It does not plainly supply every delivery detail for an unoccupied mobile home on someone else’s land. This pass does not invent a recipient, recording requirement, or substitute route.
4.4 Abandonment and marital consent
Section 55-1006 creates a presumption of abandonment after continuous vacancy for at least six months. The nonabandonment declaration branch addresses an absence of more than six months without intent to abandon and without another principal residence. It requires the specified statements, temporary-residence information, reason/duration, description, recording, and acknowledgment. [C026.] Justia Law
The replaced 2025 § 55-1007 requires the other spouse’s consent for conveyance or encumbrance and recognizes the stated power-of-attorney mechanism. Consent is evidenced by either:
- Both spouses executing and acknowledging the instrument; or
- The specified deed from one spouse to the other establishing sole and separate property.
This is not an asset-transfer recommendation or a finding that a consent instrument is valid. [C027.] LegiScan
The 2025 consent provision and § 55-1005(3)’s older dual-execution wording must be read together; their application to a particular consensual lien remains a construction question.
4.5 Homestead exceptions and liens
| Provision |
Source-stated qualification |
| § 55-1005(1) |
Pre-effective-homestead judgments constituting liens, or an action with attachment levied before the homestead became effective |
| § 55-1005(2) |
Mechanic’s, laborer’s, or vendor’s lien debts |
| § 55-1005(3) |
Specified mortgages, trust deeds, or other consensual liens executed and acknowledged by the stated marital/unmarried actors |
| § 55-1005(4) |
Specified consensual liens executed and recorded before homestead effectiveness |
| § 55-1009 |
A recorded judgment becomes a lien on value in excess of the homestead exemption, from the stated recording event |
| § 55-1010 |
Preserves the Title 55 and § 56-218 exceptions |
[C028, C031–C032.] The incorporated § 56-218 recovery regime was not completed. Taxes, federal liens, support, probate, priority, and consensual enforcement require their own authority; this report does not declare them all protected or all excepted. Justia Law+2
4.6 Validity presumption and proceeds
Section 55-1008 presumes a homestead created under the chapter valid to the stated extent until contested in a court of general jurisdiction in the county where it lies. That is not conclusive title or immunity from a contest. [C029.]
The same section protects, up to the statutory amount:
- Good-faith voluntary-sale proceeds held for acquiring a new homestead.
- Destruction-insurance proceeds held to restore or replace the homestead.
- The qualifying new homestead acquired with those proceeds.
The proceeds period is one year from receipt. [C030.] Justia Law
No blanket rule for ordinary voluntary sales of personal property, every insurance payment, all commingled funds, or proceeds remaining after the period is inferred.
5. Value, co-ownership, appraisal, division, and sale-excess procedure
5.1 Different value concepts
| Value concept |
Statutory use |
Limit |
| Debtor’s property interest |
Section 11-201 and third-party claim provisions |
Does not establish whole ownership of jointly held property. |
| Per-item or aggregate value |
Section 11-605 categories |
Not interchangeable with the explicit “aggregate interest” wording of subsection (10). |
| Homestead net value |
Section 55-1001(3): market value less all liens and encumbrances |
Defined for chapter 10; not a complete priority or sale-distribution formula. |
| Estimated actual cash value |
Required homestead-declaration content |
A declaration estimate is not a court appraisal. |
| Appraised value and divisibility |
Chapter 55-11 |
Requires the special procedure and proof. |
| Bid amount |
Section 55-1111 |
Must exceed the applicable exemption; this alone does not validate a sale. |
| Sale proceeds |
Sections 55-1112–1113 |
Separate from market value, net value, or a judgment balance. |
[C033.] Justia Law+2
The source-stated net-value relation is:
Net value=market value−all liens and encumbrances.\text{Net value}=\text{market value}-\text{all liens and encumbrances}.Net value=market value−all liens and encumbrances. No values are inserted. The current § 55-1003 does not repeat the former “lesser of net value or allowance” wording removed in the 2020 amendment. This report neither reinstates that deleted wording nor treats the allowance as ownership of value the claimant does not possess. LegiScan
Full co-ownership allocation, stacking, disputed-lien valuation, sale expenses, and the interaction of separate spousal claims with chapter 11’s singular terminology remain held.
5.2 Special homestead appraisal procedure
| Stage |
Actor and source-stated duty |
Reference event or condition |
| Application |
Judgment creditor may apply to the district court in the county |
After levy on homestead, under § 55-1101’s nonexception-judgment branch |
| Petition |
Verified petition states levy, claimant, and alleged value above the exemption |
Allegation is not proof of excess |
| Filing |
Clerk filing under § 55-1103 |
No filing performed |
| Hearing notice |
Petition copy and time/place notice served on claimant |
At least two days before hearing |
| Appointment |
Judge may appoint three disinterested county residents |
Upon proof of service and petition facts |
| Oath |
Appraisers take the statutory oath |
Before performing duties |
| Inspection and appraisal |
View premises, appraise, and assess division without material injury if value exceeds allowance |
No actual appraisal |
| Report |
Written value/divisibility report to judge |
Within ten days after appointment |
[C034–C036.] Justia Law+4
The statute states proof prerequisites but does not itself supply a universal preponderance standard for every exemption or appraisal dispute.
5.3 Division, indivisibility, minimum bid, and proceeds
| Finding or event |
Limited statutory consequence |
| Divisible without material injury |
Judge directs setting off land including the residence equal to the exemption, with the remainder subject to execution as stated. |
| Value exceeds exemption and cannot be divided |
Judge directs sale under the special provision. |
| Bid equal to or below exemption |
Section 55-1111 does not permit that sale; its wording requires a bid exceeding the exemption. |
| Qualifying sale |
Exemption amount paid to claimant; balance applied as the chapter states. |
| Money paid to claimant |
Protected for six months thereafter under § 55-1113’s language. |
| Appraiser compensation |
Court fixes compensation, not exceeding $5 per day per appraiser for actual engagement. |
| Initial costs |
Creditor pays initially; if appraisal exceeds the exemption, the stated costs are added to execution. |
[C037–C040.] Justia Law+4
Section 55-1113 retains older wording concerning voluntary disposition by the husband. No gender-neutral expansion, waiver rule, or asset-movement conclusion is inferred from that wording.
The special chapter does not complete lien priority, secured-sale law, ordinary auction procedure, title transfer, federal interests, or every co-owner’s rights.
6. Limited claim, contest, hearing, and release interface
6.1 Applicable routes
Section 11-608 incorporates § 11-203 for chapter 6 exemptions. Section 11-203 also addresses third-party ownership or security-interest claims. It generally requires a levy for the sheriff claim route but contains the separate subsection (h) court-motion branch. [C041, C045.] Justia Law+1
Official Rule 69.1 requires the prescribed documents to be substantially in Appendix B form. The recovered generic packet’s property and homestead checkboxes are procedural tools, not adjudications or a complete current exemption schedule. [C041, C055.] Idaho Supreme Court+2
6.2 Necessary event/actor sequence
| Event |
Actor/duty |
Source-stated period and trigger |
| Statutory notice documents |
Sheriff delivers or mails the required documents under the applicable § 11-709 branch |
The provision’s service-based period and no-property-answer exception remain; no universal tangible-levy service outcome is assumed |
| Exemption or third-party claim |
Claimant delivers or mails to sheriff |
Within fourteen days after sheriff hand-delivers or mails the statutory documents |
| Mailed claim |
Must reach sheriff |
Receipt within the fourteen-day period |
| Claim copy to creditor |
Sheriff |
Within one business day after receiving the claim |
| Contest |
Creditor files motion stating grounds and lodges claim |
Within five business days after sheriff delivers or mails the claim copy |
| Hearing |
Set by the statutory process |
Not fewer than five nor more than twelve days after motion filing |
| Motion/hearing notice |
Creditor to claimant |
On the date motion is filed |
| Contest notice to sheriff |
Creditor |
Within the contest period, with required copy follow-through |
| Continuance |
Court |
The stated continuance is only at the defendant’s request |
[C042–C043.] Justia Law+1
This table is a statement of legal relations, not a filing or service instruction.
6.3 Holding, release, late claims, and court motion
The sheriff generally must not sell or deliver the levied property before the claim period expires, except for perishable property as provided by law. An uncontested claim, or failure to notify the sheriff timely of the contest, produces the section’s release consequence. [C044.]
The late-claim text says the sheriff shall refuse an untimely claim and, unless otherwise ordered by the court, proceed after the period as stated. That wording should not be paraphrased as an unlimited sheriff discretion to accept a late claim.
Subsection (h) permits the described motion at any time after entry of a judgment enforceable by execution, identifying the property, grounds, and secured amount where relevant. It is not confined by its words to pre-levy motions. Subsection (f) preserves common-law remedies. [C044–C045.] Justia Law
The interaction of that general route with the special homestead presumption/appraisal procedure remains a construction question. Neither route is treated as automatically displacing the other.
6.4 Repeat costs and third-party release
| Provision |
Exact limited consequence |
| § 11-203(d) |
After failure to contest or a court exemption finding, the creditor cannot recover subsequent collection costs for applying the same property to the same judgment unless the property is applied to satisfaction of that judgment. |
| § 11-203(e) |
A secured third-party claimant with the stated default/right-to-possession predicate may use the specified debtor-executed release affidavit or the alternative default affidavit, hold-harmless agreement, and qualifying undertaking. |
| Undertaking branch |
Indemnifies sheriff and debtor in double the actual value stated in the third-party claim. |
| Release/report |
Sheriff takes the prescribed receipt and reports the proceeding by return. |
[C046–C047.] The first provision is not a ban on another levy. The second is not an Article 9 entitlement, proof of default, or ordinary exemption bond required from every claimant. Justia Law
6.5 Counting, proof, and costs
Section 11-203 excludes the triggering day, defines mailing as first-class U.S.-mail deposit, includes intervening weekends and holidays for its fourteen-day period, and provides the stated last-day extension.
Section 11-706’s general last-day provision expressly does not extend the prescribed hearing-setting period. Rule 2.2 applies within its scope when a statute does not specify a computation method; its additional mail days are not automatically added to § 11-203’s specific dispatch/receipt relations. [C048.] Justia Law+1
The statute permits prevailing-party costs under the civil rules. Rule 54 leaves prevailing-party determination, reasonable-incurrence, bad-faith/harassment objections, and discretionary costs to their stated conditions. A generic form’s warning about attorney fees is not itself a universal statutory fee award. No complete affirmative damages claim for an improper levy was authenticated. [C049.] Idaho Supreme Court+1
7. Amendment, version, and proposed-law findings
| Instrument |
Material evidence read |

Tracker reports engrossed/dead in committee, last Senate referral March 13, 2026. Not used as enacted law. |
[C051–C054.] LegiScan+3
The proposed H0775 wording is not added to the current statutory finding. Its omission from the reproduced law also does not, by itself, establish the opposite operability or registration rule. That construction remains held.
The read allowance sections contain fixed figures; no applicable CPI adjustment, county median, tax-assessed-value formula, or annual execution-exemption notice was authenticated. No inflation calculation was made.

No official final session law, failed form, or unviewed PDF page is represented as visually inspected. Multiple versions of one bill are version evidence, not independent corroboration of current law.
15.3 Remaining gaps and conclusion
The principal unresolved issues are:
- Official current Idaho statutory text and the complete material enactment/application chain.
- The unoccupied-mobile-home declaration cross-reference.
- The interaction of the 2025 spouse and consent amendments with older exception and appraisal wording.
- Personal-property stacking, co-ownership allocation, valuation, nonwaiver, and the precise general-claim/special-homestead interaction.
- Qualified insurance, pension, education, benefit, tax, support, estate-recovery, bankruptcy, secured-enforcement, and jurisdictional regimes.
- Full affirmative remedies, damages, immunity, and judicial construction.
No actual or invented owner, debtor, spouse, dependent, household, creditor, judgment, residence, property, vehicle, lien, value, proceeds, account, transaction, or notice was supplied or constructed. No asset selection, transfer, declaration, filing, service, valuation, sale, payment, withholding, or calendar determination was made.
This is a researcher self-check, not independent review. The ordinary-property and homestead component is materially researched but remains provisional and conditional at the exact source, version, incorporation, and construction gaps identified above. Earlier findings and holds remain preserved. No Idaho, dimension5, A066, parent, operational, or publication acceptance follows.
