S_ID PASS-17 — Idaho consumer credit sales, retail-installment obligations, and motor-vehicle sale distinctions
Fresh public-source access date: October 28, 2026, America/Los_Angeles.
Scope: Generic consumer-credit sales of ordinary personal-property goods, including material motor-vehicle sale rules, agreement requirements, charges, payment and prepayment, default, assignment, and narrowly necessary remedies.
Evidence disposition: The official Idaho statutory routes attempted in this pass did not provide readable operative bodies. Statutory findings are therefore provisional readings of the identified 2025 reproductions, with the older editions expressly identified. Official current-published Idaho consumer-protection rules, official rule-history material, and an official indirect-lending interpretation were recovered. Those sources do not authenticate every current statutory clause or its original enactment chain.
Earlier findings, provenance, C033/C035, and other holds remain unchanged. No earlier Article 9, payday, medical, mortgage, utility, or collection finding supplies a substantive premise here.
Principal findings
The governing framework is not determined by the label “retail installment contract.” The Idaho Credit Code defines regulated consumer credit sales, consumer purpose, installment payment, open-end credit, and related categories. Article 2 supplies additional goods-sale formation rules. Motor-vehicle sales have additional requirements in the official Idaho consumer-protection rules. No actual sale, loan, lease, security interest, or creditor is classified. [C002–C008.] Justia Law+2
A sale and an assigned sale are not automatically consumer loans. The Department’s official 2022 indirect-lending guidance distinguishes a genuine seller credit sale from a transaction that is substantively a loan. The guidance is an interpretation, not a license determination or a substitute for the definitions. [C005.] Department of Finance
Late charges, deferral charges, refinancing, prepayment rebates, and insurance refunds have separate conditions. A permissible charge category is not proof that a particular charge was agreed, earned, disclosed, or lawfully imposed. A prepayment rebate is not a general cancellation right. [C016–C025.] Justia Law+2
The assignee provisions use different legal measures. Section 28-45-302 uses the amount owing when the assignee has notice for its stated liability limit. The holder notice required by Idaho Rule 210 uses amounts paid under the contract. Those clauses cannot be collapsed into a single universal cap or treated as a completed federal Holder Rule analysis. [C038–C040.] Justia Law+1
There is no verified general buyer’s-remorse period for every credit sale. The read authorities instead contain specific branches for home-solicitation credit sales, financing-contingent vehicle purchases, and prohibited referral sales. Each has distinct predicates and consequences. [C011, C028–C030.] Idaho Administrative Rules+2
1. Classification, scope, and legal amounts
Throughout this report:
- P — Provisional: statutory wording read in the identified secondary reproduction.
- O — Official text read: official rule or governmental publication, within the stated bounds.
- G — Guidance: official interpretation, not newly enacted law.
- H — Held: a material source, incorporation, construction, or application dependency remains unresolved.
1.1 Product and actor distinctions
| Category |
Material statutory distinction |
Boundary |
| Regulated consumer credit sale |
The sale must satisfy the regular-seller or seller-credit-card condition, installment-or-finance-charge condition, and consumer-purpose condition. Refinancing and consolidation are addressed expressly. |
No actual seller, agreement, or purpose is determined. |
| Consumer purpose |
Primarily personal, family, or household use. |
The Credit Code treats the specified agricultural, investment, first-real-estate-mortgage, and organizational-debtor branches as business purpose. |
| Installment sale |
The definition distinguishes a sale with a finance charge, a sale without one, and the stated unusually large-payment branch. Down payments are excluded from the installment count. |
A payment schedule’s title does not establish the statutory category. |
| Open-end credit |
The complete definition requires the specified agreement structure, contemplated repeated transactions, creditor expectation, balance-based finance charge, and replenishment of available credit. |
A revolving label alone is insufficient. |
| Loan |
The statutory advance/payment/forbearance definition has exclusions, including the specified sale-debt and seller-card relationships. |
A creditor funding or purchasing a sale obligation is not automatically making a loan. |
| Seller or creditor assignee |
Included in the relevant definitions, but inclusion alone does not impose every original seller/creditor obligation. |
Specific assignee provisions still control. |
| Cash transaction |
A sale may be governed by goods-sale and consumer-protection law without meeting the Credit Code’s consumer-credit-sale definition. |
Cash payment does not eliminate every consumer protection. |
| True lease or rental-purchase arrangement |
The Credit Code’s expanded sale definition and UCC § 28-1-203 must be considered separately. |
No lease is reclassified; full lease/rental-purchase law remains held. |
| Security interest |
Some sale agreements may retain security, but security is not a universal prerequisite to consumer-credit-sale classification. |
Attachment, perfection, priority, and Article 9 enforcement are not completed here. |
[C002–C004; S003, S004.] The definition read does not impose one universal dollar ceiling on all regulated consumer credit sales. Particular remedies and charge provisions do contain amount thresholds, which must not be mistaken for the general scope definition. Justia Law+1
1.2 Territorial and exemption conditions
Section 28-41-201 uses several Idaho connections: receipt of a signed offer/agreement, Idaho-resident transactions resulting from solicitation in Idaho—including internet solicitation—and the specified enforcement and out-of-state-transaction branches. It also contains physical-presence, address-presumption, choice-of-law, forum, and venue qualifications.
Section 28-41-202 separately excludes the stated government-credit, insurance, regulated-utility, and limited pawnbroker categories. Section 28-41-204 generally confines the Act to consumer-purpose transactions while extending specified provisions more broadly. Section 28-41-108 permits the stated signed-written election for otherwise noncovered credit. [C003–C004.] Justia Law+3
None of those clauses establishes jurisdiction, governing law, federal preemption, or an exemption for an actual actor.
1.3 Motor-vehicle sales: additional rules, not a separate assumed code
The official consumer-protection chapter contains motor-vehicle advertising, pricing, add-on, credit-sale, and financing-contingency rules. It uses its own dealer, financing, document-fee, and motor-vehicle definitions; the motor-vehicle definition incorporates Title 49.
The relevant reproduced Title 49 definition was read. It includes the self-propelled category and its stated exclusions, while the federal-safety-standard reference is expressly tied to titling/registration. Full title, registration, dealer licensing, and federal vehicle-safety law remain outside this pass. [C006; S013–S014.] Justia Law+1
No separate comprehensive motor-vehicle retail-installment statute was authenticated in this research. That is a bounded source result—not proof that no additional vehicle-specific law exists.
1.4 Amount categories are not interchangeable
| Category |
Legal meaning relevant here |
| Cash price |
The ordinary cash-buyer price under § 28-41-301(10), with the specified taxes, accessories/services, and registration/title/license items that may be included. The disclosed cash price receives the statute’s stated presumption. |
| Down payment |
Cash or trade-in component within the statutory amount-financed definition. |
| Trade-in allowance versus trade-in debt |
Separate from each other. The amount-financed definition expressly addresses the seller’s agreed payment of a lien or debt on traded property. No “negative equity” calculation is supplied. |
| Amount financed |
The statutory total in § 28-41-301(5), not automatically cash price, principal, check amount, or total payments. |
| Finance charge |
Includes the listed time-price, interest, service, credit-loss-insurance, investigation, and other incident-to-credit charges, subject to express exclusions. |
| Precomputed transaction |
Finance charge is calculated in advance and added as stated by the definition; furnishing federal disclosures alone does not make a transaction precomputed. |
| Unpaid balance |
Depends on whether the obligation is precomputed, refinanced, consolidated, paid early, or accelerated. |
| Total payments |
A disclosure category requiring its applicable legal framework; it is not substituted for the cash price or amount financed. |
| APR |
A disclosure measure governed by its own calculation and coverage rules. No APR conversion or determination is made here. |
[C007.] The unusual wording of § 28-41-301(5)(a) was preserved rather than replaced with an assumed trade-in formula. Justia Law
2. Agreement formation, writing, delivery, and prohibited terms
2.1 Ordinary goods-sale formation
Article 2 applies to transactions in goods, subject to its security-only and other statutory qualifications. Sections 28-2-104 through -106 distinguish merchants, financing agencies, goods, sale, termination, and cancellation.
Section 28-2-201 ordinarily requires a signed writing for a goods-sale price of $500 or more, but its complete merchant-confirmation, specially manufactured goods, judicial-admission, and payment/acceptance exceptions matter. The writing need not contain every term, but enforcement under that writing is limited by the quantity shown.
Section 28-2-204 permits formation by conduct and allows some open terms when the stated intent and reasonable-remedy basis exist. [C008.] Justia Law+2
This is not a conclusion that an oral retail-financing agreement satisfies every consumer disclosure, home-solicitation, security-agreement, or electronic-signature requirement.
2.2 Disclosure incorporation and retention boundary
Section 28-43-201 requires compliance with the defined Federal Consumer Credit Protection Act for transactions within that law. Section 28-41-302 defines the incorporated federal law by reference to amendments as of January 1, 2005, or a later date adopted by rule.
The official cumulative index records former IDAPA 12.01.09 as expired March 31, 2022. A presently effective later incorporation date was not authenticated. Current federal law also may apply independently, but its full scope and disclosure requirements were not rerun. [C009, C052.] Justia Law+2
No universal Idaho credit-sale document-retention period or complete stand-alone retail-installment form was established from the read provisions. Specific writing, delivery, receipt, and insurance-document duties are identified below; federal record retention and electronic records remain held.
2.3 Motor-vehicle disclosures and financing contingency
| Official rule |
Material requirement |
| Rules 232–235 |
Credit and vehicle advertising must satisfy the applicable material-term, price, fee, and financing disclosures. |
| Rule 233.01 |
Advertised-price treatment distinguishes usual/necessary charges from the stated taxes, title/license items, and disclosed dealer-imposed document fee. |
| Rule 234.11 |
Post-negotiation add-ons require the stated prior disclosure and consent. |
| Rule 235 |
Financing calculations and disclosures differ depending on which taxes, title/license items, and document fees are included or excluded. |
| Rule 237 |
A qualifying Idaho vehicle contract subject to financing, except a dealer resale, must contain the prescribed conspicuous notice and provide a copy at signing. |
If financing fails on the agreed terms and time, Rule 237 supplies its null-and-void and trade-in-return branches. If the trade-in cannot be returned, the specified allowance must be returned within one business day, under the rule’s conditions. A subsequent different agreement is not barred. [C010–C011.] adminrules.idaho.gov
This does not establish a universal vehicle cancellation period, a fixed document-fee cap, or permission to impose an undisclosed fee.
2.4 Prohibited clauses and security boundaries
| Provision |
Restriction or qualification |
| § 28-43-301 |
Permits specified sale security; other-goods and land branches have amount and relationship conditions. A prohibited security interest is void; that does not automatically void the entire debt. |
| §§ 28-43-302–303 |
Cross-collateralization and allocation have their own conditions, chronological ordering, same-day rule, and release relationship. |
| § 28-43-304 |
Prohibits the specified earnings assignment; a qualifying revocable deduction authorization is treated separately and requires the stated copy/notice. |
| § 28-43-305 |
Confession-of-judgment authorization is prohibited and void. |
| § 28-43-306 |
A seller/lessor may not take the prohibited negotiable evidence of a consumer-credit-sale obligation; the specified near-date check exception remains. |
| §§ 28-43-311–312 |
The small-loan contractual attorney-fee prohibition is a loan provision. The separately recovered sale-applicable clause allows only the stated reasonable, agreed post-default referral fee. |
[C012–C015.] The assignee effect of a prohibited negotiable instrument is addressed separately; negotiability, security validity, and actual wage authorization are not adjudicated. Justia Law+5
3. Finance charges, delinquency, deferral, and refinancing
3.1 Agreed finance charge is subject to other restrictions
Section 28-42-201 permits the agreed finance charge within its scope and subject to other express limits. Its precomputed-credit paragraph assumes scheduled payment and directs the prepayment-rebate treatment. It is not a finding that every agreed rate, ancillary fee, or collection charge is lawful. [C016.] Justia Law
No current market rate, APR, cost comparison, or general unlimited-charge permission is supplied.
3.2 Delinquency-charge limits
Let UUU denote the legally relevant unpaid installment amount. The reproduced ordinary-goods branches state:
| Transaction branch |
Maximum agreed delinquency charge |
| Precomputed consumer credit |
max(0.05U, $12.50)\max(0.05U,\ $12.50)max(0.05U, $12.50) |
| Other covered consumer credit, excluding the separate mortgage branch |
max(0.05U, $15)\max(0.05U,\ $15)max(0.05U, $15) |
The installment must remain unpaid for more than ten days. A delinquency charge may be collected only once for an installment, regardless of duration. The same installment cannot carry the prohibited overlap with an agreed deferral charge.
An installment fully paid within the stated ten-day period cannot generate a delinquency charge merely because an earlier installment remained unpaid; the section gives a limited allocation rule for that purpose. [C017.] Justia Law
When at least two installments or parts have remained delinquent for the stated period, § 28-42-301(6) supplies a separate precomputed-to-unpaid-balance election with a rebate reference and no deduction of the minimum charge. This is not an actual election or a universal acceleration right.
3.3 Deferral
Section 28-42-302 permits a written deferral agreement before or after default. The maximum agreed deferral charge uses the previously disclosed annual rate, amount deferred, and deferral period. Its fractional-period rule treats a day as one-thirtieth of a month.
The inception-agreement unilateral-deferral branch requires its own written authorization and ten-day unpaid condition. No deferral charge may be made after the stated acceleration election, and the overlapping delinquency charge must receive the statutory treatment. [C018.] Justia Law
This is not a statutory entitlement to obtain a deferral, nor authority to add a fee merely because payment was late.
3.4 Refinancing, consolidation, and conversion
| Provision |
Conditional relation |
| § 28-42-303 |
Refinancing uses the proper unpaid balance; precomputed credit requires the rebate treatment, without retaining the minimum charge prohibited by this section. |
| § 28-42-304 |
Same-creditor consolidation has two stated agreement structures. The relevant aggregate becomes amount financed or principal as the applicable paragraph provides. |
| § 28-42-305 |
Conversion to open-end credit requires agreement at the conversion or within the preceding ten days and uses the referenced unpaid-balance rule. |
| § 28-43-203 |
Open-end terms may change under its statutory language, but that clause does not itself resolve all notice, federal, contract, or retroactivity restrictions. |
[C019.] No new balance, weighted rate, refinancing charge, or retroactive rate increase is calculated or approved. Justia Law+3
4. Payment, prepayment, rebates, and cancellation
4.1 Payment records and assignment notice
Section 28-43-202 distinguishes payment to the original creditor before the specified assignment notice from payment after notice identifying the assignee and rights. Reasonable proof may be requested; the assignee’s seasonable response matters.
The receipt/account-statement provision was recovered only in FindLaw’s January 1, 2024 reproduction. It requires the stated free cash/coin receipt, addresses periodic statements, provides requested twelve-month payment information and a period-end balance for non-open-end credit, and requires acknowledgment of full payment on request. One such statement is free each year; additional statements have the stated reasonable-charge ceiling. [C020.] Justia Law+1
No assignment, payment history, record-retention practice, or actual statement charge is examined.
4.2 Full prepayment is different from cancellation
Section 28-42-306 permits full prepayment without penalty, subject to § 28-42-307 and its separate real-property branch. Same-creditor refinancing or consolidation has an express no-prepayment-charge condition.
A credit-sale prepayment discharges the paid obligation to the extent lawfully satisfied; it is not automatically cancellation of the goods purchase, return of the goods, or recovery of every ancillary charge. [C021.] Justia Law
4.3 Precomputed unearned-charge rebate
Section 28-42-307 was read completely. Its principal structure is:
| Branch |
Rule |
| Full prepayment of covered precomputed credit |
Rebate at least the unearned finance charge calculated under the section, subject to its exceptions. |
| Rebate below $1 |
The section does not require that rebate. |
| Minimum charge |
Only the specified non-open-end, non-refinancing, nonconsolidation branch; contracted minimum and statutory ceilings both matter. |
| Standard unearned-charge method |
Uses the statutory proportion of remaining scheduled combined balances to original scheduled combined balances. |
| Longer transaction branch |
For the stated post-July 1, 1978 transactions originally payable in more than sixty-one installments, the creditor has the two specified actuarial alternatives. |
| Irregular periods |
Monthly/weekly rules and fractional adjustments are expressly prescribed. |
| Deferred payments |
The section supplies adjustments for the deferral charge and timing. |
| Acceleration and judgment |
The stated rebate is measured at judgment entry. |
| Insurance-funded payoff |
The provision supplies a special prepayment-date relation to insurance payment and satisfactory proof of loss. |
[C022–C024.] Justia Law+2
Symbolic standard relation
Let:
- FFF = the relevant precomputed finance charge;
- SRS_RSR = the sum of the statutory remaining scheduled combined balances;
- SOS_OSO = the sum of the original scheduled combined balances;
- RRR = the unearned-charge rebate before the applicable adjustments and exceptions.
The section’s standard relation is:
R≥F×SRSOR \geq F \times \frac{S_R}{S_O}R≥F×SOSRThe symbols do not replace the statutory nearest-installment-date, period, minimum-charge, irregular-payment, deferral, or other qualifications. No values or rounding are supplied.
The current federal short-term-credit rebate restriction in 15 U.S.C. § 1615, and the state actuarial-method rule incorporation, remain precise dependencies before treating the state formula as the complete governing rule for a transaction.
4.4 Balloon-payment refinancing
Section 28-43-307 applies when a scheduled payment exceeds twice the average of earlier scheduled payments. It supplies a right to refinance that payment when due without penalty on terms no less favorable, subject to its complete exceptions:
- Open-end credit.
- The stated seasonal/irregular-income or scheduled-obligation circumstances.
- An administrator-exempted class.
- The specified second-mortgage residential branch.
[C025.] Justia Law
No actual balloon, administrator exemption, new payment schedule, or refinancing outcome is determined.
4.5 Category-specific cancellation
| Category |
Source-supported right |
Limit |
| Financing-contingent motor-vehicle purchase |
Rule 237’s failure-of-agreed-financing consequence and return obligations |
Not every vehicle purchase or financing dissatisfaction |
| Home-solicitation credit sale |
§§ 28-43-401–405 |
Requires the residence/solicitation/credit-sale predicates and no stated exclusion |
| Prohibited referral inducement |
§ 28-43-308 makes the induced agreement unenforceable by the seller and gives the stated buyer alternatives |
The contingent referral representation must meet the section |
| Ordinary prepayment |
§§ 28-42-306–307 |
Not a general right to return goods |
| UCC cancellation or termination |
§ 28-2-106 distinguishes breach cancellation from nonbreach termination and preserves specified accrued rights |
Does not independently create a buyer’s-remorse right |
[C011, C026–C030.] Idaho Administrative Rules+3
Home-solicitation branch
The complete scope excludes the specified prior open-end, prior retail-premises negotiation, wholly remote, and federal-rescission categories. A qualifying agreement must be written, dated and signed by the buyer, with a copy and required cancellation notice furnished at signing.
The buyer’s cancellation period runs to midnight of the third business day after signing a compliant agreement. The written-notice and mailing rules differ from actual receipt. Failure to comply with § 28-43-403 preserves its broader cancellation formulation.
After receipt of cancellation, the seller’s ten-day return/tender duty and the buyer’s goods-care/tender duties operate under §§ 404–405. The forty-day presumption concerns failure to demand goods within a reasonable time. [C026–C029.] Justia Law+3
The reproduction of § 403’s embedded statutory form was incomplete at its final address line. The operative alternative requiring compliant notice was read, but no complete approved form is represented as recovered. No general business-day definition is imported from a different rule chapter into the Credit Code.
5. Insurance and ancillary-product boundaries
5.1 Scope and authorization
Chapter 44 governs the described insurance connected with regulated consumer credit. Insurance-premium loans have the stated limited application; property insurance and credit life/disability have different branches. Its provisions supplement Title 41, and its administrator penalties do not automatically apply to a person acting as insurer.
An agreed insurance charge is not permission for prohibited coverage, an unqualified insurer, or an excessive charge. Title 41’s credit-life/disability chapter excludes the stated longer-than-fifteen-year and isolated-insurer transactions. [C031.] Justia Law+3
5.2 Evidence, premiums, refunds, and choice
| Topic |
Read rule |
Retained condition |
| Evidence/disclosure |
§ 28-44-105’s evidence-delivery or prompt failure/delay-notice wording; § 41-2308’s policy/certificate and application/notice requirements |
No inference that failure notice authorizes retaining a charge for unprovided insurance |
| Premium ceiling |
Charges cannot exceed the relevant filed insurer premium schedules or computed insurer premiums under the applicable provision |
No insurer filing or product rate retrieved |
| Missing coverage |
Written notice and appropriate credit duties under § 41-2310 |
Actual nonissuance not found |
| Early termination/refund |
Prompt refund/credit under the applicable statutory method, subject to stated exceptions |
“Prompt” is not converted into a fixed number of days |
| Small aggregate refund |
§ 28-44-108 uses a less-than-$5 condition |
Title 41 also references a director-prescribed minimum; that current amount was not authenticated |
| Refinancing/deferral/consolidation |
Additional insurance charges require the stated agreement, new coverage, old-coverage refund and premium conditions |
No duplicate charge authorized merely by rewriting credit |
| Choice of coverage |
Existing coverage or another acceptable insurer may satisfy the requirement under the stated provisions |
Reasonable rejection criteria and written/notice predicates remain |
| Property/liability cancellation |
§ 28-44-304 permits creditor-requested cancellation only under default or written authorization and requires the stated notice timing |
No actual default, cancellation, or replacement policy |
[C032–C036.] Justia Law+6
5.3 Coverage amount and term are separate from debt amount
The read provisions limit individual credit-life amounts by the specified original and remaining-debt relations and periodic-benefit insurance by the unpaid-installment and periodic-payment relations. Open-end future advances and group coverage have separate qualifications.
The term provisions address commencement, delayed evidence of insurability, the last scheduled payment, shorter-term disclosure, and the limited fifteen-day post-maturity extension. No actual coverage, insurability, benefit, premium, or refund is determined. [C035.] Justia Law+2
Property-insurance § 28-44-301 was recovered in a 2024 reproduction. It uses the substantial-risk, reasonable-value/term, insurer-qualification, and $500 predicates. Its cross-reference to insurer authority and the failed §§ 28-44-203, -302 and -303 bodies remain held. No universal authority for liability insurance, gap coverage, debt cancellation, warranties, or other add-ons is inferred. [C036.]
6. Default, assignees, defenses, and remedies
6.1 Default is not automatic acceleration or deficiency
Section 28-45-107 restricts contractual default to payment failure or significant impairment of payment, performance, or realization of collateral, placing the stated impairment burden on the creditor. Section 28-45-301 restricts default charges to those authorized by the Act, apart from its stated reasonable-security-realization qualification.
No general sale-specific pre-acceleration notice or arrears-only cure period was established by those clauses. Their silence does not negate another applicable statute, rule, contract protection, or federal law. [C037.] Justia Law+1
6.2 Assignee liability and holder notice must be separated
| Authority |
Legal effect |
Measure or qualification |
| § 28-43-202 |
Assignment notice and reasonable-proof relationship |
Determines the stated payment-recipient consequences, not actual ownership |
| § 28-45-302 |
Assignee is subject to the seller claims/defenses under the section, notwithstanding contrary agreement; special treatment of an instrument taken contrary to § 306 |
Liability cap uses the amount owing when the assignee has notice |
| § 28-45-302(2) |
Allocation for determining that cap |
Chronological and same-day ordering; open-end finance-charge treatment |
| Idaho Rule 210 |
Requires the specified holder notice in covered consumer credit contracts and purchase-money-loan branches |
Notice uses recovery limited to amounts paid under the contract |
| § 28-45-202 |
Damages/penalties under that part may be set off and raised defensively without its stated time limits |
Does not automatically extend affirmative-action periods |
[C038–C040, C047.] Justia Law+2
The two assignee measures are not silently merged. No affirmative-recovery theory, rescission result, double recovery, holder status, or federal Holder Rule result is determined.
6.3 Narrow sale-specific deficiency/election boundary
Section 28-45-103 applies to regulated consumer credit sales of goods or services. Its specified repossession or surrender branches use a cash-price ceiling of $1,000 or less. It contains a no-personal-balance rule under those conditions, a separate wrongful-damage/nonavailability clause, and a judgment-election restriction.
This is not a general rule that every consumer vehicle debt is nonrecourse, nor an instruction to surrender collateral. Article 9 possession, notice, disposition, valuation, and deficiency rules were not rerun. [C041.] Justia Law
6.4 Unconscionability and excess charges
Section 28-45-106 allows the court to refuse enforcement, sever, or limit an unconscionable agreement or provision, with an opportunity to present context. A charge specifically permitted by the Act is not unconscionable solely for that reason.
Section 28-45-201 distinguishes:
- Enumerated violations with actual damages and the specified nonclass penalty.
- Excess charges not owed, with refund or credit.
- Direct-collecting assignee liability for the described excess payment.
- Separate excess-charge/refund-delay penalties.
- General preservation of debt rights except where otherwise provided.
- Conditional correction and bona-fide-error protections.
- Court-awarded costs and attorney fees upon the statutory finding.
[C042–C046.] Justia Law+2
A prohibited clause does not automatically erase every obligation. Conversely, the general debt-preservation clause does not erase an express invalidity or nonpayment consequence elsewhere.
6.5 Special remedy periods and defenses
| Provision |
Material relation |
| § 28-45-201(1), (3) |
Different remedy periods for open-end and other consumer-credit transactions |
| § 28-45-201(3) |
Thirty days is the stated presumption of reasonable refund time in that branch |
| § 28-45-201(6) |
Conditional self-correction before the stated debtor notice/action and within forty-five days after creditor notification |
| § 28-45-201(7) |
Preponderance burden for the specified unintentional bona fide error despite adapted procedures |
| § 28-45-202 |
Defensive setoff is not barred merely by the part’s action periods |
| Older § 28-45-203 |
Disclosure liability excludes credit advertising, uses the defined federal incorporation, has a one-year provision, and avoids duplicate liability/final judgments |
[C045–C048.] These are regime-specific remedy conditions, not a rerun of ordinary debt limitations. Justia Law+2
6.6 Nonwaiver and regulator authority
Section 28-41-106 permits only its defined good-faith disputed-claim settlement and other specified compromise branches, subject to its qualifications. No actual waiver or settlement is validated.
The administrator’s Part 1 scope reaches the stated in-state making/soliciting and direct collection/enforcement of regulated consumer-credit transactions. The Director of Finance is the administrator. Supervised financial organizations have a special allocation of examination and administrative enforcement authority.
Investigation, cease-and-desist orders, injunctions, and civil recovery have different predicates. Section 28-46-113 permits recovery after demand only for expressly granted debtor recoveries; its separate repeated-and-intentional-violation penalty is not a consumer’s automatic award. [C049–C051.] Justia Law+4
The general administrative-power and debtor-remedies-preservation sections, §§ 28-46-104 and -115, were not recovered. Full APA, Consumer Protection Act remedies, criminal penalties, and licensing/examination procedures remain outside the completed findings.

14.3 Remaining gaps
The principal unresolved issues are:
- Official current Idaho Credit Code and material Title 41/Title 49 bodies.
- Original 1983 application/savings provisions and the relevant final amendments.
- The present legal effect of expired Credit Code rules on actuarial definitions, federal incorporation, and administrator-created exemptions.
- Current versions of §§ 28-43-204, 28-43-312, 28-45-203, and 28-44-301.
- The failed insurance, administrative-power, debtor-remedies-preservation, and severability sections.
- Complete statutory home-solicitation form text and its current federal interface.
- Federal rebate, disclosure, Holder Rule, cooling-off, military, payment, collection, reporting, and bankruptcy regimes.
- Actual legal classification, lawful fee components, allocation, refund method, assignee liability, affirmative recovery, and judicial construction.
No actual or invented buyer, seller, dealer, lender, assignee, guarantor, household, vehicle, goods, cash price, trade-in, down payment, agreement, balance, payment, notice, insurance policy, or transaction was supplied or constructed. No contract, disclosure, cancellation, payment, refund, complaint, filing, or enforcement action was prepared or performed.
This is a researcher self-check, not independent review. The credit-sale component is materially researched but remains provisional and conditional at the exact source, version, incorporation, and construction gaps identified above. Earlier findings and holds remain preserved. No Idaho, dimension6/7, A066, parent, operational, or publication acceptance follows.
