Scope: Judicial foreclosure of a real-property mortgage, including a trust deed judicially foreclosed as a mortgage; the security-first/one-action framework; execution of a foreclosure decree; judicial sale; redemption; and limited deficiency, surplus, possession, and satisfaction consequences.
Evidence disposition: The official Idaho statutory routes attempted in this pass did not yield readable operative bodies. The Idaho statutory findings below are therefore provisional readings of the identified 2025 reproductions, not authenticated official current 2026 law. Official Idaho court-rule text was read. A historical sale-statute amendment was inspected through a legislative mirror, with its introduced-version status preserved.
Earlier findings, provenance, C033/C035, and other component holds remain unchanged. No earlier report supplies a substantive premise here.
The mortgage lien, the secured obligation, and personal liability are separate legal questions. A lien does not itself imply that a person owes the secured obligation, and a mortgage does not by itself confer possession. Assignment of a debt carries its mortgage security under the reproduced statute, but that rule does not prove an actual assignment or entitlement to enforce. [C002–C004.] Justia Law+2
The one-action provision has express exclusions and a separate installment-foreclosure rule. It is not accurately summarized as “one proceeding of any kind,” universal debt discharge, or a blanket prohibition on deficiencies. The consequences of violating the restriction, and its application to a particular guarantor or election, require further authority. [C006–C008, C012, C045.] Justia Law+1
Judicial and nonjudicial trust-deed routes have different cure and deficiency provisions. The newly read § 45-1506(12) permits the described judicial-route cure before entry of the foreclosure decree. The trustee-sale-specific three-month provision in § 45-1512 is not imported as a judicial-mortgage deadline. [C027, C044.] Justia Law+1
Statutory post-sale redemption depends on the property interest and acreage. The ordinary reproduced periods are one year for a tract exceeding twenty acres and six months for a tract of twenty acres or less, subject to the qualifying estate, eligible-person, later-redemption, and rents-accounting provisions. [C028–C039.] Justia Law+2
A sale shortfall does not establish the permitted deficiency. Section 6-101 requires the stated sheriff-return and personal-liability conditions; § 6-108 separately limits the judgment by a court-determined reasonable-value measure. A second or subsequent installment foreclosure under § 6-103 has an express no-deficiency rule. [C041–C043.] Justia Law+1
Throughout this report:
| Category | Source-supported distinction | Limit |
|---|---|---|
| Mortgage | Section 45-901 defines the security arrangement while excepting a trust deed or transfer in trust. Sections 45-904 and 45-916 identify the real-property mortgage category. | An instrument’s label does not establish its legal character. |
| Lien | A charge on specified property securing performance; it does not itself transfer title. | The lien’s existence does not establish personal liability. |
| Written formalities | Section 45-902 requires a writing with the formalities required for a real-property grant. Section 55-601 supplies the read writing/subscription requirement. | Electronic execution, authority, acknowledgment, community-property and other formalities are not fully completed. |
| Mortgage interest | Section 45-903 separates the lien from possession; § 45-906 addresses the interest capable of being mortgaged. | No title, fixture, ownership, or priority determination. |
| Assignment | Section 45-911 states the debt/security relationship. | No actual transfer, holder status, or real-party finding. |
| Real property | Section 55-101 includes land, specified land-related rights, things affixed, and appurtenances. | Detailed fixture, water-right, mining, and title regimes remain separate. |
| Possession | Section 6-104 does not treat the mortgage as a conveyance entitling the mortgagee to possession without foreclosure and sale. | A receiver or possession-related exclusion from the one-action definition is not independent self-help authority. |
[C002–C005; S003.] Justia Law+4
The read general mortgage provisions do not create a residential-versus-commercial split comparable to every federal servicing rule. Separate property and consumer statutes may nevertheless apply. No homestead, agricultural, community-property, probate, or federal-loan classification is made.
Section 45-1503 expressly permits a conforming trust deed to be foreclosed under real-property mortgage law instead of the advertisement-and-sale route. Its incorporated § 45-1502 definition distinguishes grantor, beneficiary, trustee, and qualifying property.
The qualifying-property definition contains alternative incorporated-city/village, nonagricultural eighty-acre, and forty-acre branches. Those are trust-deed predicates, not acreage limits silently imposed on all mortgages. [C005, C008; S004.] Justia Law+1
Section 6-101 frames the ordinary action as one proceeding to recover the secured debt or enforce the secured right. It authorizes a foreclosure decree, sale, application of proceeds, and—under its stated return and liability conditions—a remaining personal judgment. Subsection (2) directs a collateral-realization construction. [C006, C011, C041.] Justia Law
The section’s definition excludes the following categories:
| § 6-101(3) | Excluded category |
|---|---|
| (a)–(b) | Receiver/possession proceedings and enforcement of rents or income security |
| (c)–(d) | Specified out-of-state collateral enforcement or judgments involving additional outside collateral |
| (e) | Statutory trustee power of sale |
| (f) | UCC remedies, with the Idaho secured-debt-judgment exception expressly retained |
| (g)–(i) | Claim and delivery; specified deposit setoff/pledge/banker’s lien; letter-of-credit draw |
| (j) | Collection following the specified senior-lien sale to someone other than the creditor |
| (k)–(l) | Bankruptcy proceedings and specified probate claims |
| (m)–(o) | Noncollection proceedings, specific statutory exemptions, and incidental relief connected with authorized proceedings |
These are exclusions from this section’s defined “action,” not independent authorization for each underlying remedy. [C007.] Justia Law
The text does not establish that every alleged violation automatically destroys the debt, forfeits all security, defeats subject-matter jurisdiction, or is waivable. Those construction questions remain held.
Section 45-1503 separately restricts actions against the grantor or successor. Its alternatives include judicial foreclosure, the defined substantially-valueless-security branch, the referenced trustee-sale balance action, and § 6-101(3) exclusions.
“Substantially valueless” requires the statutory no-fault or practical-value circumstances. Relevant factors include the estate, senior liens and carrying costs, marketing burden, contamination liability, and other court-relevant factors. The statute permits alternative pleading, requires the specified court finding, and addresses reconveyance after a final obligation judgment and lack of judgment-lien relation back. [C008.] Justia Law
That express trust-deed provision is not generalized into an identical ordinary-mortgage exception. No valuation, alternative pleading, election, reconveyance, or lien priority is determined.
| Topic | Newly read rule or statute | Boundary |
|---|---|---|
| Real party and capacity | Rule 17(a)–(b) | Procedural categories do not prove ownership or enforcement capacity. |
| Joinder of claims | Rule 18 | Joined relief remains governed by substantive rights; joinder does not erase § 6-101. |
| Required parties | Rule 19(a)–(d) | Feasibility, prejudice, and adequate relief are conditional inquiries. |
| Unrecorded interests | Section 6-101(4) addresses interests not appearing of record at commencement. | Its relationship to due process and other necessary-party law is not resolved through an actual title record. |
| Venue | Section 5-401 places the described real-property actions where the property or part is situated, subject to change of place. | Venue is not an actual jurisdiction finding. |
| Lis pendens | Section 5-505 supplies a recorded notice and constructive-notice effect from recording. | Not service of process or proof of title; its real-name qualification remains. |
[C009–C010.] Idaho Supreme Court+2
No complaint, defendant list, summons, default request, or litigation strategy was constructed.
The foreclosure decree may direct sale of the encumbered property or the necessary part. If only installments, taxes, or other secured obligations are due, § 6-103 permits its specified partial foreclosure. The sale remains subject to the unpaid balance not reduced to judgment; later foreclosure is expressly permitted, but a second or subsequent foreclosure under that mortgage cannot produce a deficiency under this section. [C011–C012, C043.] Justia Law
Section 8-601(2) supplies a conditional receiver ground involving threatened loss/injury or unperformed mortgage conditions and probable insufficiency. Rule 73 governs the procedural interface. Neither guarantees appointment or transfers possession automatically. [C013.] Justia Law
Rule 62 separately governs stays, including its appellate-rule incorporation. An appeal, motion, or requested receiver is not treated as establishing a particular stay here. [C014.]
Section 11-104 distinguishes enforcement of a money judgment, a possession judgment, a judgment requiring sale, and a judgment requiring another act. For a sale judgment, the writ recites the relevant judgment and directs sale and proceeds application accordingly. Rule 69 supplies the general execution interface. [C015.] Justia Law
Sections 11-201 and 8-506 identify the real-property levy/recording relationship, including property recorded in another person’s name. That statutory mechanism does not adjudicate the debtor’s beneficial interest. The attachment-undertaking incorporation was inspected but is not treated as a universal mortgage-sale bond or release right. [C016.] Justia Law+1
| Issue | Source-stated requirement | Limit |
|---|---|---|
| Real-property public notice | Section 11-302(3): time, place, and particular description; posting for twenty days in the specified three public places; publication weekly during the same period in a county newspaper, if one exists | Not converted into a fixed number of publications or a trustee-sale notice period |
| Currency | Specified judgment currency must be reflected where the section requires | No payment method or actual currency determined |
| Missing notice | Section 11-303 states a $500 forfeiture plus actual damages against the officer under its conditions | Not an automatic declaration that every sale is void |
| Defacing/removing notice | Separate $500 consequence for the specified conduct | No actual offense or liability |
| Auction | Section 11-304: highest bidder; stop after sufficient property has been sold | No credit-bid rule inferred |
| Conflicts | Officer and deputy cannot be purchasers or interested in a purchase | No bidder investigation |
| Parcels | Known lots/parcels sold separately; third-party request and debtor-directed order provisions have stated conditions | No marshalling or priority outcome |
| Time of day | Current reproduced § 11-304 contains no former fixed 9 a.m.–5 p.m. clause | This does not establish that any hour is lawful under a decree or other law |
[C017–C020.] Justia Law+2
The 2018 H0535 mirror visibly strikes the former time-of-day language. Its official legislative link failed; final enactment authentication remains limited to the reproduced credit and secondary legislative history. [C020, C052.] LegiScan
The read execution-sale sections do not supply a complete resolution of direct notice to each affected person, constitutional notice, decree-specific service, or publication qualification. Posting/publication alone is not declared sufficient for an actual foreclosure.
No universal additional confirmation order, fixed adjournment interval, or unconditional credit-bidding entitlement was established from the provisions read. These remain held—not findings that such requirements or powers never exist. [C025.]
| Event | Statutory consequence |
|---|---|
| Successful bidder refuses payment | Section 11-305 permits the specified resale and recovery of resulting loss and costs. |
| Later bid by defaulting bidder | Section 11-306 gives the officer the stated discretion to reject it. |
| Officer’s corresponding liability | Section 11-307 limits it by the subsequent bid and recovered amount as stated. |
| Real-property sale certificate | Section 11-310 requires property description, parcel bids, total paid, redemption status, and specified-currency information; duplicate recording follows. |
| Successor sheriff | Section 11-311 permits completion of the deed in the listed predecessor-unavailability circumstances. |
| Property in multiple Idaho counties | Sections 6-105–107 address the executing sheriff, return/record transmission, and certificates in each relevant county. |
[C021–C024.] Justia Law+7
Section 11-309 was read only to distinguish it: its certificate provision concerns personal property not capable of manual delivery, not the real-property certificate governed by § 11-310.
| Concept | Governing text and effect | Not interchangeable with |
|---|---|---|
| Pre-foreclosure redemption from a lien | Section 45-113 recognizes the right after the claim is due and before that right is foreclosed. | A fixed universal post-sale period |
| Judicial trust-deed reinstatement | Section 45-1506(12), before entry of decree, under its payment and eligible-person conditions | Paying the entire accelerated principal or the nonjudicial 115-day branch |
| Statutory post-sale redemption | Sections 6-101, 11-310, and 11-401–407 | Contractual modification or ordinary arrears cure |
| Satisfaction/discharge | Full satisfaction, mortgage release, and judgment satisfaction have their own provisions | Redemption by a junior lienholder or mere sale of collateral |
Contracts restraining lien redemption or providing the specified forfeiture in satisfaction are declared void by § 45-110. Section 45-114 separately addresses junior-lien redemption and subrogation. No actual waiver or lien is assessed. [C026.] Justia Law+2
The judicial branch of § 45-1506(12) permits the listed grantor/successor and subordinate-interest persons to cure before entry of a foreclosure decree. It requires the then-due obligation and specified actual enforcement expenses, while excluding principal that would not be due without default.
Qualifying cure discontinues proceedings and restores the obligation and deed as if acceleration had not occurred. The trustee-fee cross-reference expressly denies a trustee foreclosure fee in a judicial foreclosure. [C027.] Justia Law+1
The text does not establish an identical arrears-only reinstatement right for every ordinary mortgage. No contractual cure promise, prior-use limit, tender sufficiency, or actual entitlement is inferred.
Section 11-401 identifies:
The second class is termed a “redemptioner.” It is not every unsecured creditor, guarantor, occupant, or interested observer. [C028.] Justia Law
Section 11-310 makes a sale absolute when the estate is less than a leasehold with two years unexpired. Other covered real-property sales are subject to the redemption chapter. Subject to those predicates, § 11-402 uses:
[C028–C029.] Justia Law+1
No residential-use shortcut, parcel measurement, aggregation rule, or actual sale date is supplied.
The first-redemption components are the purchaser’s amount, the incorporated interest, qualifying taxes/assessments paid after commencement of the action and not included in the judgment, and the specified superior lien held by a purchaser who is also a creditor. The sale judgment itself is excluded from that additional-lien component. [C030.] Justia Law
The incorporated rate is § 28-22-104(1), not subsection (2)’s annually determined judgment rate. The readable reproduction states “twelve cents (12¢) on the hundred by the year.” That wording is not normalized into a percentage or used in a calculation. Official text and any necessary construction remain held. [C031.] law.justia.com
The mortgage attorney-fee component has a separate limit: actual payment or an unconditional written obligation, competent proof, and the stated six-month relationship to issuance of the sheriff’s sale certificate. It is not automatically the amount printed in a demand. [C032.]
No redemption equation that adds attorney fees twice, assumes unproved liens, or assigns a numeric interest rate is supplied.
| Issue | Source-stated relation |
|---|---|
| Later redemption | Within sixty days after the last redemption and within the applicable base year/six-month period |
| Later-redemption amount | Prior redemption amount and incorporated interest, qualifying post-redemption taxes/assessments, and the specified prior liens; the sale judgment is excluded |
| Notice | Written notice to sheriff and duplicate recording |
| New taxes/assessments or other liens | Required notice/recording; omission has the stated later-redemption consequence |
| Tender | Section 11-404 equates a qualifying tender with payment and permits the stated recipient/officer alternatives |
| Proof by redemptioner | Certified judgment/lien record, necessary verified assignment, and affidavit of actual amount due under § 11-405 |
| Debtor redemption | Same required payment categories; sale’s effect terminates and estate is restored; acknowledged/proved certificate and recording follow |
[C033–C036, C039.] Justia Law+3
The repeated sixty-day language does not by itself create endless rolling extensions beyond the stated base period. The distinct § 11-407 extension can matter.
Section 11-407 entitles the specified purchaser or redemptioner to tenant rents/use value during its stated interval. Rents and profits received before redemption must be credited against redemption money. [C037.]
A timely written demand for a verified statement extends redemption five days after the statement is given. Failure or refusal for one month after demand permits the specified accounting action within sixty days after demand, extending redemption until fifteen days after final determination. These are different triggers and units. [C038.] Justia Law
Section 11-406 permits restraint of waste and preserves the described ordinary use by a person in possession at sale or otherwise entitled afterward. It does not decide who is entitled to possession. Rule 70’s possession writ depends on a judgment or order granting that entitlement. No self-help entry or eviction authority follows. [C040.] Justia Law+1
The read statutes impose separate conditions:
| Provision | Required legal relation |
|---|---|
| § 6-101(1) | Sheriff’s return shows insufficient proceeds and a remaining balance; the defendant must be personally liable. |
| § 6-108 | Court determines reasonable value in the decree upon evidence; the deficiency cannot exceed the statutory value-based ceiling. |
| § 6-103 | No deficiency in the second or subsequent foreclosure under its installment-foreclosure branch. |
[C041–C043.] Justia Law+2
Let:
Section 6-108 supplies the upper-bound relation:
D≤M+K−VD \leq M + K - VD≤M+K−VIt does not establish any component, authorize a negative judgment, or create personal liability. The sheriff-return condition and other prohibitions remain separate. The statute does not itself assign a standalone burden, prescribe an appraisal method, or use § 1512’s express “at the time of sale” valuation phrase. Those differences are preserved.
Section 45-1503(1)(a) expressly links the advertisement-and-sale route to § 45-1512; subsection (1)(b) separately identifies judicial mortgage foreclosure. The freshly read § 1512 contains a three-month post-trustee-sale action and its own complaint/value language.
This supports keeping that route distinct. It does not establish an unlimited judicial deficiency period or resolve all possible overlapping arguments. No ordinary limitation or revival clock is rerun. [C044.] Justia Law+1
Creation of a lien does not imply a personal promise. Section 6-101’s personal-deficiency language requires personal liability, while § 45-1503’s direct-action restriction expressly addresses the grantor and successor.
The read text does not resolve every guarantor, surety, accommodation-party, waiver, or independent-obligation question. No rule that all guarantors are protected—or that none are—is established. [C045.] Justia Law
Section 11-313 provides a narrow contribution/repayment and judgment-benefit mechanism for the specified joint-debtor or surety payment, including its ten-day notice filing condition. It is not a complete guaranty-law regime. [C048.] Justia Law
Section 6-102 permits the court to direct surplus to the person entitled and to hold it in court meanwhile. It does not automatically allocate every surplus to the mortgagor free of other interests. [C046.] Justia Law
Section 11-312 addresses the specified purchaser eviction or failure-of-possession circumstances and provides recovery or revival mechanisms under its notice, motion, and cause requirements. This is not acknowledgment/part-payment revival and does not establish general judgment duration. [C047.] Justia Law
Sections 45-912–914 describe marginal or certificate-based mortgage discharge and recording. The failed/liquidated-bank alternative in § 45-913 has an unread § 26-908 incorporation.
Section 45-915 requires the described release action immediately on demand after satisfaction and states actual damages plus a $100 forfeiture for refusal under its conditions. No grace period or actual entitlement is invented. [C049.] Justia Law+2
Rule 58.1 separately requires judgment satisfaction filing and recording after full payment. Mortgage release, debtor redemption, junior redemption, judgment satisfaction, and bankruptcy discharge are not interchangeable. [C050.] Idaho Supreme Court
No positive federal entitlement, exception, period, or permission is supplied in this table.
| Dependency | Precise later generic inquiry | Why it remains separate |
|---|---|---|
| Bankruptcy | 11 U.S.C. §§ 362, 524, 108 and applicable definitions, exceptions, orders, and application provisions | One-action exclusions do not decide stay, discharge, or time extension. |
| Mortgage servicing | 12 C.F.R. §§ 1024.30–.41, including coverage, loss-mitigation, and current amendment status | State process alone does not establish federal servicing compliance. |
| Regulation Z | Applicable §§ 1026.36, .39, .41 and high-cost/coverage provisions | No notice, payment-crediting, payoff, or high-cost determination here. |
| Military protection | 50 U.S.C. § 3953 with definitions, waiver, order, and temporal predicates | No service status or federal foreclosure result. |
| Federal tax/government liens | 26 U.S.C. § 7425; 28 U.S.C. § 2410 and relevant regulations | State joinder/publication is not proof of federal lien discharge or redemption compliance. |
| Federally insured or guaranteed loans | Applicable FHA/VA/USDA or other program statutes and regulations | No program identity or servicing condition supplied. |
| Tenancy/possession | Current federal foreclosure-tenant law, Idaho possession procedure, and lease-priority law | Certificate or deed does not alone resolve eviction. |
| Homestead/community property/probate | Relevant exemption, consent, estate, and representative statutes | No residence, spouse, estate, or exemption classification. |
| Title, priority, assignments | Governing recording, transfer, lien, and instrument-enforcement law | No title search or holder finding. |
| Agriculture and special property | Property-specific state/federal lending and preservation regimes | Acreage is not a proxy for every special protection. |
| Local/tribal/interstate | Jurisdiction, sovereignty, venue, and governing-law rules | No favorable-law election or territorial permission. |
| Consumer and appellate remedies | Applicable consumer statutes, Rule 60, appellate stays, and sale-challenge law | No universal challenge period, automatic voidness, or accepted claim. |

The remaining issues include mortgage-recording formalities; representative/guarantor capacity; Rule19/due-process interaction with §6-101(4); attachment-undertaking application to execution; appellate stays; full receiver and rents law; direct sale notice; confirmation and adjournment; credit bidding; tract/acreage construction; redemption-interest text; tender sufficiency; full recording acknowledgments; the failed-bank discharge branch; and the federal/special regimes in Section6.
No search failure was treated as absence of a law, protection, amendment, or remedy.
This pass newly read the judicial mortgage, execution-sale, and redemption provisions identified above. It did not treat the earlier nonjudicial or limitations reports as authority.
The strongest completed findings are the textual distinctions: security versus personal debt; express one-action exclusions; installment foreclosure and its later-deficiency restriction; judicial trust-deed cure before decree; separate certificate/deed/redemption stages; acreage-based statutory periods; conditional accounting extensions; and the reasonable-value deficiency ceiling.
The central unresolved issues are official-current statutory authentication, the material original enactment/application chains, the redemption-interest wording, and the specifically identified judicial-construction and incorporated-law questions.
No actual or invented mortgage, deed, note, property, debtor, creditor, guarantor, bidder, payment, sale, value, tender, case, or transaction was supplied or constructed. No filing, service, sale, payment, possession, redemption, calendar, or enforcement instruction is given.
This is a researcher self-check, not independent review. The focused judicial-mortgage component remains partial and conditional at the exact gaps recorded above. Earlier findings and holds remain preserved. No Idaho, dimension6, A066, parent, operational, or publication acceptance follows.

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
No currently queued material correction is mapped to this component. This does not remove its currentness, access, jurisdiction or application limits.
