S_ID PASS-15 — Idaho residential rent arrears, nonpayment termination, summary possession, and deposit boundaries

Fresh public-source access date: October 28, 2026, America/Los_Angeles.

Scope: Residential rent obligations, nonpayment notices, the special possession proceeding, associated monetary relief, security-deposit accounting, and narrowly necessary habitability, self-help, and review interfaces.

Evidence disposition: The official Idaho statutory routes attempted in this pass did not yield readable operative bodies. The Idaho statutory findings below are therefore provisional readings of the identified 2025 reproductions, not authenticated official current 2026 law. Official Idaho court rules, official court instructions, the July 2026 Attorney General manual, and selected legislative amendment texts were recovered. Guidance and legislative mirrors are not substitutes for the operative statutes.

Earlier findings, provenance, C033/C035, and other holds remain unchanged. No earlier foreclosure, limitations, collection, or exemption finding is a substantive premise here.

Principal findings

Rent liability, termination, possession, and a money judgment are different legal questions. The expedited nonpayment route is limited to the specified possession-only action. Combining possession with rent damages removes the statutory early-trial procedure; a possession judgment does not, by itself, adjudicate every alleged balance. [C002, C014, C026.] Justia Law

A nonpayment notice is payment-or-possession, not a demand that the tenant both pay and leave. Its amount, recipients, warning, service, and attorney-fee language have separate requirements. A notice is not a summons, and neither document is proof that the underlying rent is enforceable or unpaid. [C006–C009.] Justia Law

Two important procedural questions remain expressly qualified. The reproduced expedited statute says trial without a jury, while another chapter provision and the official civil rules preserve jury rights. Likewise, the statute’s appeal language and Rule 83’s automatic-stay language are not identical. No categorical no-jury or no-stay conclusion is made from one clause alone. [C018, C024.] Justia Law+2

Deposits are not automatically the last month’s rent or a lawful offset chosen by either side. The reproduced statute requires return after termination and surrender, permits only necessary deductions within the deposit arrangement, prohibits deductions for normal wear, and requires a signed itemization when less than the full amount is returned. [C030–C033.] Justia Law

The smoke-detector provision supplies a narrow express repair-and-deduct right. It is not a general authorization to withhold rent, deduct all repair costs, terminate the lease, or treat a repair complaint as an automatic defense to possession. [C034–C037.] Justia Law+1

1. Legal categories, actors, and scope

Status labels used below:

  • P — Provisional: statutory wording read in a dated secondary Idaho reproduction.
  • O — Official text read: official court rule or governmental publication, within its stated scope.
  • G — Guidance: generic instructions or explanatory material, not controlling statutory text.
  • H — Held: currentness, incorporation, construction, or application remains unresolved.

1.1 Distinct legal objects

Legal object Source-supported distinction What is not established
Rent obligation A claimed payment obligation under the relevant lease or agreement. The amount, validity, due date, permissible fees, or actual nonpayment.
Termination/nonrenewal A change in the legal tenancy relationship, governed by the applicable statutory and contractual branch. That a payment demand, lease expiration, or notice title alone terminates every tenancy.
Unlawful detainer A statutory possession claim requiring the applicable § 6-303 predicates. That all occupants or all disputes fit the same branch.
Expedited possession The specified possession-only proceeding under §§ 6-310–6-311A. An automatic award of rent, late charges, property damages, or all collection costs.
Rent/damages action Section 6-311E requires the facts supporting the monetary claim; combining it with possession removes the early-trial provision. A collectible judgment from an allegation or ledger.
Judgment Court-adjudicated relief, subject to entry, scope, review, and stay rules. That a missed hearing or unanswered document automatically validates every requested amount.
Restitution of possession Enforcement through the prescribed writ and officer-related process. Private lockout, seizure, or disposal permission.
Security deposit Money deposited for a purpose other than rent, subject to the statutory return/deduction rules. An automatic payment of rent or liquidated-damages fund.

[C002; S002 §§ 6-303, 6-310, 6-311E, 6-316, 6-321; S005 Rules 54, 55, 58.] Justia Law+2

1.2 Actor and property categories

Category Relevant read text Retained boundary
Tenant of real property for a term less than life Opening scope of § 6-303 No actual tenancy, authority, or enforceable rent is determined.
Landlord or successor in estate Appears in the nonpayment and holdover provisions Title or successor status is not established by the statutory label.
Actual occupying subtenant Separate notice and party provisions apply A guest, roommate, family member, and subtenant are not automatically equivalent.
Grantee, lessor’s assignee, lessee’s assignee §§ 55-301–303 address transferred rights and remedies A security assignment without possession has its own qualification; no actual assignment is examined.
Residential versus commercial Particular notice, fee, and belongings provisions distinguish them No universal residential definition or classification is supplied by those distinctions alone.
Tract of five acres or less Relevant to the expedited possession route Different provisions use more than five acres or five acres or more.
Agricultural tenancy Special holdover and habitability exclusions appear in the read statutes Not every rural or large tract is agricultural.
Current or former tenant under an owner-authorized oral or written rental agreement Expressly excluded from § 6-310A’s unauthorized-person-removal branch Nonpayment does not itself convert such a person into an unauthorized entrant.
Hotel/transient, manufactured-home community, owner-occupied/shared housing, subsidized housing Separate regimes or classification questions were identified No general housing rule is transferred to them without the necessary scope text.

[C003–C005, C047.] Justia Law+2

Section 6-310(3) also contains a distinct forcible-detainer route requiring a verified allegation that the owner or agent has never entered a lease or similar agreement with the defendant. That is not the ordinary rent-nonpayment route. Its wrongful-use consequence is separately stated in subsection (5). This pass does not develop the faster unauthorized-occupant procedures into an eviction alternative for tenants. [C004.] Justia Law

1.3 Jurisdiction and assignment

Section 6-305 places the described possession action in the district court of the county where the property or part lies. Section 1-2208(1)(b) permits assignment of forcible-entry, forcible-detainer, and unlawful-detainer proceedings to magistrates, subject to Supreme Court rules. The separate monetary-assignment paragraph is not treated as the jurisdictional ceiling for the possession category. [C012.] Justia Law+1

Rule 1 supplies civil-rule scope; Rule 1.1 conditions local rules. No county-specific assignment order, local rule, territorial fact, or personal-jurisdiction determination was examined.

2. Nonpayment notice, cure, termination, and service

2.1 Nonpayment predicate

Under reproduced § 6-303(2), the relevant predicate includes continued possession without the landlord’s permission after default in rent under the governing lease or agreement and service of a written three-day notice requiring payment, stating the amount due, or possession. An actual occupying subtenant must also receive the statutory notice. [C006.] Justia Law

The official court instructions explain the payment-or-possession alternative and limit their nonpayment notice to past-due rent rather than other charges or property damages. That is supporting instruction; it does not decide whether a disputed contractual charge is legally rent. [C007; S007, printed p. 1/index 0.] Idaho Court Assistance Office

The notice also must contain the statutory warning about the postjudgment belongings period. To obtain the chapter’s nonpayment attorney-fee award, § 6-324 requires the three-day notice to advise that attorney fees shall be awarded to the prevailing party. [C008.] Justia Law+1

Important timing and cure limits

Issue What the text supports What remains held
Notice period Three days in the nonpayment branch Actual service date, counting, and any overriding special regime
Notice timing relative to rent Notice may be served within one year after rent becomes due This is not adopted as a general rent-debt limitation period
Payment alternative The notice must offer payment rather than demand both payment and departure Sufficiency of a disputed tender, payment method, or tender rejected by an actor
Other covenant cure Section 6-303(3) gives the listed tenant, subtenant, mortgagee, or interested person the specified performance/payment opportunity; it contains an incapable-of-later-performance qualification That exception is not silently transferred to ordinary nonpayment
Partial payment or late payment No universal waiver or cure consequence was established from the read clauses Acceptance, reservation of rights, waiver, estoppel, and renewed notice require separate construction
Rental assistance No actual application, promise, or program status was supplied No automatic pause, satisfaction, or entitlement is inferred

[C006–C007.] Justia Law

2.2 Predicate notice service is not summons service

Section 6-304 provides alternative methods with prerequisites:

Method Statutory condition
Personal delivery Delivery to the tenant.
Substitute delivery plus mailing Tenant absent from both residence and usual place of business; copy left with a person of suitable age and discretion at either place, and copy mailed to the residence.
Posting, delivery if a resident is found, and mailing Residence/business cannot be ascertained, or a suitable person cannot be found; the complete posting-and-mailing requirements apply.
Subtenant The section applies the stated methods to the subtenant notice.

The section does not supply a universal numeric age for a substitute recipient, a certified-mail requirement for every tenant notice, or a receipt presumption. Those cannot be borrowed from another statute. [C009.] Justia Law

2.3 Nonpayment, holdover, nonrenewal, and rent increases

Branch Source-stated relation Boundary
Fixed-term holdover § 6-303(1) concerns possession after expiration without permission Residential nonrenewal notice and other law still require consideration; expiration is not treated as self-executing eviction.
Tenancy at will § 55-208 uses at least one month’s written notice and the prescribed service relationship One month is not automatically thirty days.
General month-to-month change § 55-304(1) uses at least fifteen days before month-end, with its continued-holding effect Residential rent increase/nonrenewal is governed by the more specific paragraph.
Residential rent increase or intended nonrenewal § 55-304(2) requires at least thirty days’ written notice before the specified event Not the three-day nonpayment demand; no conclusion that every fixed-term contract may be changed unilaterally.
Agricultural holdover More than sixty days’ holdover without the stated demand/notice produces the described additional-year relation Not applied to ordinary residential rent without its agricultural predicates.
Reentry language § 55-209 follows termination and expiration of the notice period It is not read as unrestricted force, lockout, or utility-interruption authority.

[C010–C011, C038.] Justia Law+3

3. Special court route and adjudication

3.1 Possession-only versus money relief

Section 6-310(1) supplies the expedited route for the specified possession-only action involving a tract of five acres or less. The complaint must contain the statutory property, possession, entry/holding, nonpayment, notice, and entitlement allegations. Section 6-318 requires verification of the complaint and answer. Section 6-308 addresses the tenant and actual occupying subtenant, while § 6-309 incorporates other civil-party provisions subject to that section. [C013–C014.] Justia Law+2

Section 6-311E expressly permits a rent-damages claim but removes the early-trial provision when damages are sought or combined with possession. The general summons then applies. The expedited route may include its authorized costs and attorney fees; that does not turn it into an adjudication of all unpaid rent, late charges, or property damage. [C014, C021.] Justia Law+1

3.2 Process and timing comparison

Event Source-stated rule Important distinction
Trial setting Within twelve days after complaint filing Not twelve days after receipt of summons
Service before trial Summons, complaint, and trial-setting notice served not less than five days before trial Separate from pre-suit § 6-304 notice
Expedited summons Rule 4(a)(3)(A) requires the designated special form General Rule 12’s answer period is not automatically imported
Ordinary answer rule Rule 12(a) begins with an exception for another time specified by rule or statute No universal twenty-one-day eviction-response finding
Continuance More than two days requires the defendant’s prescribed court-approved undertaking securing accruing rent if judgment is adverse Not a finding that the undertaking or a later trial is available in any particular action
Nonpayment notice Three days before the statutory nonpayment predicate matures Not a court-hearing date or writ date

[C015–C017.] Justia Law+2

The summons/complaint service provisions actually read include the authorized-server rule and the applicable individual-service alternatives. An authorized officer or a nonparty over eighteen may serve process under Rule 4’s general provision; its dwelling-recipient age rule differs from § 6-304’s “suitable age and discretion” wording. No completed service is assumed. [C016.] Idaho Supreme Court

3.3 Jury: unresolved statute/rule/construction issue

Source Textual position read
§ 6-311A The reproduced expedited provision says trial by the court without a jury.
§ 6-313 Issues of fact are tried by a jury unless waived in the ordinary manner.
Rules 38–39 Preserve constitutionally or statutorily protected jury rights and govern demand, waiver, and trial.

The relation among these provisions, constitutional requirements, and judicial construction was not resolved through case research, which was excluded. The report does not certify that every expedited residential nonpayment action must be jury-free. [C018.] Justia Law+2

3.4 Default, uncontested trial, and proof

The reproduced §§ 6-311A and 6-312 address default and judgment. Official Rule 55 adds material distinctions:

  • Entry of default is different from default judgment.
  • An uncontested trial after a responsive pleading is not a default hearing.
  • The court may require evidence to establish allegations, damages, or other matters.
  • Appearing parties receive the rule’s stated notice protections.
  • Minor/incapacitated-party and service conditions remain material.
  • Rule 54(c) limits default relief to the kind and amount demanded.

A missing response or missed appearance is therefore not treated as proof of every rent allegation, fee, or damages amount. [C019–C020.] Idaho Supreme Court+1

Rule 58 makes entry of the separate judgment the operative judgment event. Neither a hearing announcement nor a proposed judgment is substituted for that rule’s filing/entry requirement.

4. Restitution, belongings, appeal, and set-aside boundaries

4.1 Postjudgment cure is a narrow acreage/term branch

Section 6-316(1) provides a particular five-day post-entry opportunity where the tract is more than five acres, nonpayment is found, and the lease has not expired. The listed interested persons may make the specified payment into court to restore the estate. The required categories include rent, interest, assessed damages, and costs. [C021.] Justia Law

That branch does not establish a universal five-day postjudgment cure for every residential dwelling. It also is not an interest-rate determination.

4.2 Belongings and officer enforcement are separate conditions

Category Source-stated belongings period
Residential tenant Seventy-two hours under the judgment-related language
Commercial tenant Seven days, with the stated good-cause extension possibility
Tenant with tract of five acres or more Seven days under the specified branch

The statute then uses both the belongings period and three days after the court’s finding in describing the sheriff’s restoration of possession. It does not authorize compressing those into a single assumed clock. The landlord/agent may deliver the writ or request sheriff delivery, but the sheriff’s removal/restoration role remains distinct. [C022.] Justia Law

The statutory writ form’s “forthwith” language is read with § 6-316(2), not as erasing its conditions. Remaining property is expressly subject to the Article 9 and motor-vehicle incorporations. Those regimes, full abandonment law, and actual disposal rights were not completed. [C023.]

Acreage boundaries are not uniform

  • Expedited possession: five acres or less.
  • Special postjudgment cure: more than five acres.
  • Longer belongings branch: five acres or more.
  • Section 6-320 exclusion: five acres or more used agriculturally.

No one threshold is substituted for another.

4.3 Appeal and stay: an express hold

Source Rule read
§ 6-319 Appeal does not stay proceedings unless the judge directs otherwise.
§ 6-311D Describes an additional undertaking with two sureties and rental-value protection for the specified defendant appeal.
Rule 62 No automatic stay merely from judgment entry; court-ordered and appellate branches have their own conditions.
Rule 83(e) For covered magistrate-to-district appeals, states a fourteen-day automatic stay, with express civil-protection-order exceptions and court-order requirement for further stay.

These texts cannot responsibly be reduced to an unconditional statement that filing an appeal either always stops or never stops eviction. Their special-statute/procedural-rule relationship, the actual appellate route, and the surety incorporation remain held. [C024.] Justia Law+2

Rule 83’s ordinary filing provision uses forty-two days from the clerk’s file-stamped judgment/order, with specified timely-motion effects. That appeal period is not an extension of the notice, hearing, belongings, or possession periods. No deadline is calculated.

4.4 Set-aside is not an automatic stay

Rule 55(c) permits setting aside an entry of default for good cause and refers default judgments to Rule 60(b). Rule 60 contains distinct grounds; its timing provision requires a reasonable time and imposes a six-month outer relation for grounds (1)–(3). The motion does not itself suspend the judgment. The independent-action, nonpersonal-service, and fraud-on-the-court branches are separately preserved. [C025.] Idaho Supreme Court

No ground, timeliness, voidness, excusable neglect, or entitlement to relief is determined.

5. Rent debt, damages, fees, deposits, and offsets

5.1 Alleged rent is not a proved money award

Sections 6-311E and 6-316 require the relevant facts to be alleged and the rent/damages to be found by the factfinder. Possession relief and monetary relief have different procedural consequences.

The read provisions do not establish a universal daily holdover multiplier, acceleration of all future rent, automatic late charge, or current judgment-interest rate. Mitigation, reletting credits, partial-payment allocation, acceptance/waiver, res judicata, and double-recovery rules require further generic contract and remedial authority. [C026, C033.] Justia Law+1

5.2 Reasonable fees and the 2025 renumbering

The operative reproduced section is now § 55-305, formerly § 55-314.

Clause Material limitation
Subsection (1) Residential fees, including late fees, must be reasonable.
Subsection (2)(a) A fee, fine, assessment, interest, or other cost may not exceed the amount agreed in the rental agreement.
Subsection (2)(b) A charge not included in the agreement is restricted, with the specified oral-agreement or written thirty-day-notice branches.
Subsection (3) Applies to agreements entered into or renewed on or after July 1, 2023.
Subsection (4) The section is not a rent-amount cap.

The thirty-day branch is not generalized into permission to override every fixed-term contract or impose an unreasonable charge. No universal dollar fee cap was established; that is not a finding of unlimited permission. [C027.] LegiScan+1

Section 55-306 now separately addresses local restrictions on regulating private residential rent, fees, deposits, and compelled participation in optional federal assistance, with its local-government-property-interest qualification. It does not erase federal law, every local health/safety rule, or every housing-program obligation. [C042.] Justia Law

5.3 Treble damages and attorney fees

Provision Consequence Qualification
§ 6-317 Court may treble qualifying actual damages recovered by landlord or tenant under its stated branches. Not automatic triple rent, triple the entire deposit, or triple every alleged loss.
§ 6-310(5) Addresses misuse of the distinct forcible-detainer route where a landlord-tenant relationship existed and/or bad faith is found. Not an ordinary nonpayment penalty.
§ 6-324 Reasonable attorney fees are awarded to the prevailing party in covered chapter proceedings, except in cases where treble damages are awarded. Nonpayment notice must contain the statutory prevailing-fee warning.
§ 6-316(2) Court may award reasonable removal/restoration costs on good cause. Full property-disposal predicates are not completed here.

[C028–C029.] Justia Law+2

Contractual fees, statutory fees, taxable costs, actual damages, discretionary enhancement, and a collectible judgment remain separate.

5.4 Deposit definition and return

Section 6-321 treats money deposited for a purpose other than rent as a security deposit. Upon termination and surrender, the deposit is refundable except for amounts necessary to cover the specified deposit-arrangement contingencies. Normal wear and tear may not be charged to it. The definition excludes deterioration attributable to the listed negligence, carelessness, accident, misuse, or abuse conditions. [C030.] Justia Law

Requirement Exact statutory relation
Default refund period Twenty-one days when no time is fixed by agreement
Outer limit In any event, thirty days after surrender
Partial refund Accompanied by a signed statement itemizing amounts lawfully retained, their purposes, and a detailed expenditure list
Ownership change during tenancy New owner liable for refund
Third-party residential manager Separate account at a federally insured institution, apart from operating funds
Account-rule exclusions Property owner, specified commonly controlled managers, real-estate licensee, and qualifying nonprofit organization

[C031–C032.] Justia Law+1

The last category’s incorporated qualification regimes were not completed. An exclusion from the separate-account paragraph is not an exclusion from every deposit-return obligation.

No source read establishes that the deposit automatically becomes last-month rent, that a tenant may unilaterally net it against arrears, or that every late itemization eliminates every underlying damages claim. Nor was a deposit-cap or deposit-interest amount authenticated in this pass. [C033.]

6. Habitability, essential services, self-help, and retaliation

6.1 Statutory tenant action

Section 6-320 identifies failures involving:

  • Reasonable weather/water protection.
  • Supplied electrical, plumbing, heating, ventilation, cooling, and sanitary facilities.
  • Hazardous health/safety conditions.
  • Timely lawful deposit return.
  • Material lease terms affecting health/safety.
  • Required smoke detectors.

The landlord has the stated initial smoke-detector verification duty; the tenant has the stated maintenance duty. The definition of an approved detector was read in full. [C034.] Justia Law

Notice and court route

Before an action under § 6-320, the tenant must give the landlord three days’ written notice identifying each relied-on breach and demanding performance or cure. Section 6-323 supplies different landlord-notice methods: personal delivery to landlord/agent; the specified business-employee alternative; or certified U.S. mail, return receipt requested.

The statute says three days after service, not an unqualified “three business days after receipt” in every branch. [C035.] Justia Law+1

An action exclusively for specific performance has the stated twelve-day trial-setting and five-day pretrial-service relations. Adding damages removes that accelerated route. The tenant’s facts, property description, and breach circumstances must be pleaded; damages or performance relief depend on the adjudicated evidence. Agricultural tracts of five acres or more are excluded from this section. [C036.]

6.2 Narrow smoke-detector repair-and-deduct provision

The express deduction branch requires failure to install working smoke detectors, certified-mail return-receipt notice to the landlord or assignee, and failure to install within seventy-two hours after receipt. The text then permits installation and deduction of the cost from the next month’s rent. The installed detectors become the landlord’s property and may not be removed by the tenant. [C037.] Justia Law

This is not expanded into a general repair-and-deduct, rent-withholding, lease-cancellation, or essential-service reimbursement rule.

6.3 Self-help and utility interruption

Sections 6-301 and 6-302 define specified forcible-entry and forcible-detainer conduct. Sections 6-311C and 6-316 supply a court-writ/officer restitution framework. Section 55-209’s reentry language is not treated as unrestricted permission to bypass that framework. [C038.] Justia Law+2

The court-hosted tenant guide warns against physical exclusion by lock changes or utility interruption. That guidance is not a completed primary-law analysis of every peaceful reentry, abandonment, emergency, utility shutoff, or service interruption. The statutory maintenance duties may be material, but they do not establish an actual violation or remedy. [C040; S010.] Idaho Court Assistance Office

6.4 Retaliation and mitigation remain source-bounded

The July 2026 Attorney General manual states that retaliation for repair requests or tenant association activity is impermissible. The court-hosted tenant brochure gives a similar explanation. But a complete generally applicable statutory or judicial construction supporting all of those boundaries was not authenticated here. The manufactured-home statute’s separate retaliation provision was identified, not transferred to every dwelling. [C039.] Idaho Office of Attorney General+1

Likewise, generic guidance discusses reletting and loss reduction, but no complete statewide mitigation, accelerated-rent, double-recovery, or deposit-offset doctrine is certified from that guidance. A lack of completed primary authority is not permission to retaliate or recover twice.

6.5 Guidance must be checked against the operative clauses

Guidance shorthand encountered Qualification retained in this report
“Three business days” for a repair/deposit demand The read § 6-320(d) says three days after service; method and counting require their own analysis.
Treble the deposit plus fees § 6-317 concerns qualifying actual damages and discretion; § 6-324 has a treble-damages exception.
Hearing measured from receiving summons § 6-310 measures twelve days from filing and separately requires service at least five days before trial.
Belongings removal summarized as seventy-two hours § 6-316 contains other acreage/commercial branches and the separate three-day-after-finding condition.
Lease simply expires Residential nonrenewal notice and other applicable law cannot be omitted.

[C043.] The July 2026 manual itself says it is not a restatement of law. Its publication date does not cure the statutory-currentness gap. Idaho Office of Attorney General+2

15. Researcher self-check and conclusion

This pass newly researched the rent/nonpayment sector rather than importing foreclosure or ordinary-debt findings. The principal supported distinctions are:

  • Payment notice versus tenancy termination versus summons and court relief.
  • Expedited possession versus rent/damages adjudication.
  • Default versus uncontested trial.
  • Belongings periods versus officer restoration.
  • Reasonable contractual/statutory charges versus an asserted balance.
  • Deposit accounting versus automatic rent offset.
  • A habitability action versus a narrow express smoke-detector deduction.
  • State general rules versus covered-housing, military, special-property, and local dependencies.

The most important remaining gaps are official-current Idaho statutory authentication, the jury and appeal-stay reconciliation, complete mitigation/waiver/retaliation construction, and the exact federal and special-housing regimes identified above. The July2026 manual and current court website do not cure those gaps merely by being recent.

No actual or invented person, household, landlord, tenant, dwelling, lease, arrears, notice, deposit, assistance application, housing program, eviction, case, account, or transaction was supplied or constructed. No payment, withholding, tender, filing, service, lockout, move-out, property disposal, or calendar decision is made.

This is a researcher self-check, not independent review. The component is materially researched but remains partial and conditional at the specified authority and construction gaps. Earlier findings and holds remain preserved. No Idaho, dimension6, A066, parent, operational, or publication acceptance follows.
