Scope: The payday/deferred-deposit sector component of registry dimension 6, with only the necessary classification, disclosure, collection, and remedy interfaces.
Evidence disposition: The official Idaho statutory routes attempted in this pass did not yield readable operative bodies. The principal Idaho statutory findings are therefore provisional readings of the identified 2025 reproductions. Two incorporated provisions were recovered only in older editions, identified separately below. Official Department of Finance materials, an official rule-status index, and current-published federal Regulation Z text and commentary were read. These do not replace authentication of the current Idaho statutes or their final enactment chain.
Earlier raw findings, provenance, C033/C035, and other holds remain unchanged. No prior sector report supplies a substantive payday finding here.
Idaho’s payday category is a defined deferred-check arrangement, including specified electronic equivalents—not every small loan. Part 4 incorporates the Idaho Credit Code’s regulated-loan provisions except Part 3 of chapter 46. That incorporation makes consumer-credit classification and several general protections material, but it does not turn a general lender license into proof of payday authority. [C002–C006.] Justia Law+1
The operative distinctions include principal, check amount, cash advanced, fee, finance charge, and APR. They must not be collapsed into one number. The reproduced text sets principal and aggregate restrictions, requires dollar and APR disclosures, and permits only the payday fee and specifically authorized additional charges. Its state-law description of the payday fee does not decide federal finance-charge treatment. [C007–C013.] Justia Law+2
The no-cost rescission right, check-redemption right, general prepayment provision, and extended payment plan are different protections. “Fully earned” cannot be read in isolation from the express rescission right or converted into a universal conclusion that every early-payment refund is prohibited. [C016–C022.] Justia Law+3
A dishonored payment is not automatically fraud. The payday provision prohibits criminal threats for a payment deficit, bars treble damages, and incorporates only the specified dishonored-check charges with its own disclosure condition. The incorporated check law has additional notice, contract, court-fee, and justifiable-stop-payment qualifications. [C023–C026.] Justia Law+2
Two important cross-reference questions remain unresolved: the application of the general small-loan installment/term provision to the special payday structure, and the relationship between the general precomputed-charge rebate provision and the payday-specific earned-fee language. Neither gap is resolved by declaring unlimited terms or universally nonrefundable fees. [C014, C022.] Justia Law+1
The following status labels apply throughout:
| Category | Rule established by the read text | Boundary |
|---|---|---|
| Payday loan | A written arrangement under which the creditor accepts the maker’s check, defers negotiation/deposit/presentment for an agreed period, and advances the check amount less the permitted fee. | A small principal amount or short maturity alone does not establish this category. |
| Check for Part 4 | Includes the stated electronic equivalent and authorization to withdraw an agreed amount from the borrower’s account. | This expanded definition does not automatically satisfy every UCC “check” incorporation. |
| Licensee | Includes a person licensed or required to be licensed under Part 4. | Lack of a license does not remove the actor from duties directed to required licensees. |
| Regulated consumer loan | Requires the applicable Credit Code loan, consumer-purpose, regulated-credit, and exclusion predicates. | A business-purpose label, internet channel, installment schedule, or bank affiliation is not conclusive. |
| Supervised financial organization | The incorporated definition concerns the described authorized and supervised loan-and-deposit institutions. | An institutional label is not proof that the definition is met. |
| License-exempt institution | Section 28-46-402 exempts specified institutions from that section’s licensing requirements. | It does not say every payday conduct provision or every federal law is inapplicable. |
| General regulated lender | Part 3 licensing and payday Part 4 licensing are distinct. | A general license is not proof of payday authorization. |
| Assignee or collector | Particular provisions reach an assignee directly collecting or enforcing, and the payday dishonor restriction expressly reaches a third-party collector. | Assignment does not itself prove ownership, lawful charges, or collection authority. |
[C002–C006, C024, C030.] Justia Law+3
Section 28-41-204 generally applies the Credit Code to consumer-purpose transactions, while expressly extending listed provisions to other purposes. Payday Part 4 is not one of the provisions listed there as universally applicable regardless of purpose. The complete definition and exclusion analysis therefore remains necessary; the payday label alone does not decide a business-credit branch. [C003.] Justia Law
Section 28-41-201 contains several distinct connections to Idaho, including the place where a signed agreement is received and Idaho-resident transactions resulting from solicitation in Idaho, expressly including internet solicitation. It also contains physical-presence, nonresident, address-presumption, choice-of-law, and enforcement-proceeding qualifications. [C004.] Justia Law
Its licensing cross-reference to § 28-46-301 must be read carefully against § 28-46-401’s exclusion of Part 3 from the otherwise incorporated regulated-loan provisions. This pass does not resolve every overlap by importing Part 3 wholesale.
The complete § 28-41-202 exclusions were read. They include the specified government credit, insurance-premium, regulated-utility, and limited pawnbroker branches. Those exclusions are not interchangeable with § 28-46-402’s institutional licensing exemptions. [C005.] Justia Law+1
No actual residence, solicitation, contract location, charter, federal preemption, tribal status, or license was investigated.
Section 28-46-402 requires licensing before the covered business is engaged in, offered, made, or arranged, and requires a separate license for each location. It does not establish an actual license from an application or public statement.
For a payday loan made in Idaho in violation of that licensing requirement, subsection (3) expressly makes the loan void, uncollectible, and unenforceable, and removes the borrower’s obligation to pay principal or fees. It also identifies recovery from the violator or an assignee undertaking direct collection or enforcement. The administrator has the specified recovery and cease-and-desist authority. [C006.] Justia Law
This is a specific statutory consequence. It is not extended to every other violation without a separate source.
| Issue | Reproduced statutory relation | Qualification |
|---|---|---|
| Individual principal | No more than $1,000 | Principal is not automatically the check face amount or net proceeds. |
| Aggregate outstanding | Same licensee and common-control persons may not exceed the stated $1,000 aggregate-principal relation, plus allowable fees | Not a verified statewide aggregate across all unrelated lenders. |
| Income relation | Payday loan may not exceed 25% of gross monthly income when made | The text says “payday loan”; no unsupported substitution of net cash, check face, or another base is made. |
| Income information | Obtained at least once every twelve months | The statute provides its own evidence-or-written-representation condition. |
| Written agreement | Borrower-signed writing with licensee name, date, principal, and total condition-of-credit fees in dollars and APR | Does not establish compliance with every federal disclosure rule. |
| Fee posting | Conspicuous dollar fee per $100 at each licensed location | The $100 figure is a disclosure unit, not a fee ceiling. |
| Security | Only the permitted borrower check; no other property, title, or evidence of ownership as collateral | Does not import title-loan or repossession rules. |
| Electronic representment | No more than two electronic representments | “Representment” is not silently rewritten as total attempts or a federal safe harbor. |
[C007–C010, C015.] Justia Law+1
The income provision states that the lender is not in violation of the 25% subsection if the borrower presents evidence of gross monthly income or makes the specified written representation. This is not replaced by an invented verification standard or an actual affordability determination.
Section 28-46-412(3) permits a fee for each payday loan, describes it as earned at the transaction date, and prohibits other charges except those specifically provided by the Act. Section 28-42-201’s general agreed-finance-charge rule remains subject to special limitations and prohibitions. [C011.] Justia Law+1
Neither of those read provisions supplies a numerical payday origination-fee ceiling. That bounded textual finding is not a conclusion that any fee or APR is lawful. The relevant restraints include:
The state statement that the fee is not interest does not determine whether it is a federal finance charge. That federal distinction is addressed narrowly in Section 7. [C012, C044.]
The statute permits the listed cash, business-check, money-order, electronic-transfer, and other reasonable electronic disbursement methods, but prohibits an additional charge to access the payday proceeds. Repayment methods have their own agreement conditions. Only one postdated check may secure the described transaction, and endorsement must use the actual business name before negotiation or presentment. [C013.] Justia Law
None of those state clauses establishes valid federal electronic authorization, irrevocability, compulsory-use compliance, or permission for a particular debit.
Section 28-43-310, read in full, addresses regulated consumer loans that are not open-end credit and have principal of $1,000 or less. It requires substantially equal installments at equal intervals, subject to seasonal or irregular income, and states maximum periods of:
[C014.] Justia Law
Because § 28-46-401 incorporates regulated-loan provisions except Part 3 of chapter 46, this section cannot be ignored merely because § 412 describes an agreed check-holding period. But the exact reconciliation of the general installment rule with the special payday and EPP provisions was not established by an official interpretation or controlling construction.
Accordingly, this report does not state that payday loans have no maximum term, that every payday agreement must follow a particular installment schedule, or that the general maximum automatically resolves a given payday arrangement.
| Protection or restriction | Source-stated operation | What must not be substituted |
|---|---|---|
| Renewals | At most three consecutive renewals, then full repayment | Not three new loans free of the other restrictions. |
| Same/common-control refinancing | Repayment from another payday loan’s proceeds is prohibited | A new document does not evade the rule. |
| New loan after completion | Permitted by the stated clause after the prior loan is completed | Other aggregate, income, renewal, and repayment restrictions still matter. |
| Statutory completion | For the check-secured branch, presentation/deposit or borrower redemption | Not necessarily final bank clearance. |
| Rescission | No cost, before close of business on the next business day, through repayment of principal in cash or immediately available funds | Notice alone is not the stated tender condition. |
| Check redemption | Before presentment/deposit, by payment of the full check amount in immediately available form | Not the no-cost principal-only rescission right. |
| General full prepayment | Section 28-42-306 permits it without penalty, subject to § 307 | Does not itself determine the payday fee rebate. |
[C016–C018, C022.] Justia Law+2
No statutory definition of “business day” sufficient to calculate the payday rescission deadline was authenticated in this pass. The operative “prior to close of business” language and the prescribed disclosure’s shorter wording are preserved without calculating a date.
Section 28-46-414 requires the lender to allow the specified request once during any consecutive twelve-month period. The plan must be written and executed no later than the original due day. It must provide at least four equal payments over at least sixty days and include the prescribed disclosures.
The plan obligation may not exceed the amount owed under the original terms. No interest or additional fee is permitted except the incorporated dishonored-payment branch. Default permits the stated termination and acceleration; while the borrower complies, collection activities may not be initiated. [C019–C020.] Justia Law
This is not an unlimited right to repeated plans, a mandatory debt reduction, a new fee-earning event, or a definition of every kind of default.
The Department’s July 1, 2020 guidance interprets the first EPP payment as due no earlier than the greater of the original loan period or two weeks after the plan is entered. It explains why an immediate initial payment can defeat the plan’s purpose.
The document’s heading contains a § 28-46-114 citation, while its body discusses § 28-46-414. That discrepancy is recorded, not silently corrected into a different statute. The guidance says it replaces the October 9, 2014 statement. [C021; S008.] Department of Finance
The Department’s legal page expressly distinguishes guidance from law. Thus, the first-payment interpretation is recorded as the agency’s position, not as words added to § 414.
Section 28-42-307 contains a general unearned-finance-charge rebate structure for qualifying precomputed transactions, with its own exceptions, minimum-charge rules, accelerated-judgment provision, and additional incorporations. The complete body was read, but no rebate formula was calculated. [C022.] Justia Law
Three distinctions remain:
Neither a blanket prorated-refund entitlement nor a blanket “never refundable after the transaction date” rule is established.
The payday provision permits only § 28-22-105 charges that are disclosed in the loan agreement when the check is returned unpaid by the payor institution. It prohibits treble damages and carries the specified restriction into third-party collection. [C023.] Justia Law
The incorporated statute uses a UCC § 28-3-104 check. Part 4’s broader electronic definition does not automatically prove that every electronic payment falls within that separate incorporation.
| Branch | Required conditions and consequence |
|---|---|
| Statutory interest/collection-cost route | Dishonor, the stated unpaid period, and § 106 notice; where the check does not provide for the listed charges, the text permits 12% annual interest from dishonor and collection cost capped at the lesser of $20 or check face amount. |
| Written-agreement/posted-fee alternative | The stated flat collection fee may be assessed without § 106 notice, but may not exceed $20. |
| Payday overlay | The payday loan-agreement disclosure requirement still applies; a point-of-sale sign alone is not treated as satisfying it. |
| Court attorney fees | The statute’s notice and period conditions apply; its collection-agency/small-claims exception must be preserved. |
| Justifiable stop payment | The section does not apply to a check dishonored for that reason. |
[C024.] Justia Law
The flat-fee alternative does not automatically waive conditions for every other statutory charge.
Section 28-22-106 permits certified mail to the last-known address or regular mail supported by a retained mailing affidavit to the check address. It contains a three-day conclusive-notice provision tied to execution of that affidavit. Its prescribed notice uses fifteen days after postmark, while the actual-notice qualification in subsection (4) uses fifteen days of actual notice of dishonor. [C025.] Justia Law
Those events are not collapsed into one assumed deadline. The generic blank statutory form was read but not filled. No mailing, receipt, notice, identity presumption, or stop-payment justification is determined.
The payday text prohibits criminal threats arising from a payment deficit and unfair or deceptive payday-business conduct. It does not adjudicate whether unrelated conduct satisfies an offense, nor does a returned payment alone establish fraud. [C026.]
For the applicable regulated-consumer-credit branch, § 28-45-107 restricts contractual default to required-payment failure or significant impairment of payment, performance, or realization of collateral, with the creditor bearing the specified impairment burden. Section 28-45-301 limits default charges to those authorized by the Act, apart from its stated security-realization qualification. That exception does not authorize otherwise prohibited payday collateral. [C027.] Justia Law+1
| Provision | Narrow finding |
|---|---|
| § 28-43-304 | The prohibited earnings assignment is distinct from a qualifying revocable earnings-deduction authorization. The latter requires the specified copy and conspicuous revocation notice. |
| § 28-43-305 | The defined confession-of-judgment authorization is prohibited and void. |
| § 28-43-311 | A regulated consumer loan agreement with principal of $1,000 or less may not provide for the debtor’s payment of attorney fees; the prohibited term is unenforceable. |
| § 28-22-105 | A separate court-awarded dishonored-check fee branch has its own conditions. |
[C028–C029.] These provisions do not determine wage garnishment, bank-debit authorization, or an actual court award. Justia Law+2
Section 28-43-202 identifies when assignment notice changes the payment recipient and requires seasonable reasonable proof upon request. It does not establish that an asserted assignee owns the obligation.
The § 28-45-302 seller-assignee claims-and-defenses rule is expressly a consumer-credit-sale branch; it is not automatically imported into a standalone payday loan. [C030.] Justia Law+1
The payment-receipt provision was recovered only in a 2022 reproduction. It addresses free cash/coin receipts, specified periodic-statement treatment, requested twelve-month payment information, one free statement per year, and acknowledgment of full payment on request outside open-end credit. Its general additional-statement charge is not treated as a newly authorized payday fee. [C031.] Justia Law
Before disbursement, § 28-46-415 requires the prescribed written disclosures in at least twelve-point, bold, capitalized text. The six topics concern short-term use, renewal fees, rescission, high cost and alternatives, written complaints to the Department, and the annual EPP opportunity. [C032.] Justia Law
A required complaint-address disclosure is not an accepted complaint, proof of violation, regulator adjudication, or preservation of every possible claim.
| Provision | Generic duty or power | Limit |
|---|---|---|
| § 28-46-103 | Administrator is the Director of the Department of Finance. | Institutional role only. |
| § 28-46-407 | Notice/hearing-based suspension or revocation on the listed grounds. | No actual violation or license action. |
| § 28-46-408 | Written event reporting within fifteen days for the specified events and persons. | Not every event concerning every affiliate; the statute’s ownership/role conditions matter. |
| § 28-46-409 | GAAP records, reasonable availability, access, and composite annual reporting. | The “need not preserve more than two years after due date” wording is not a universal destruction authorization overriding other law. |
| § 28-46-410 | Examination/investigation, record access, costs, and subpoena/court-enforcement powers. | Not an actual examination or record request. |
| § 28-46-411 | Administrative Procedure Act applies except where otherwise provided. | Full APA hearing, review, and remedy law was not completed. |
[C033–C035.] Justia Law+4
Section 28-45-201 separates several branches:
| Branch | Consequence | Qualification |
|---|---|---|
| Enumerated violations | Actual damages and the specified nonclass penalty range | Not every payday violation automatically fits every listed incorporation. |
| Excess charge | Not owed; refund may reduce the obligation; specified direct-collecting assignee liability | The lawful amount must first be established. |
| Excess charge or delayed refund | Separate nonclass penalty branch, including its demand/reasonable-time condition | Thirty days is a presumption in that branch, not every refund deadline. |
| Effect on debt | Ordinarily does not impair rights on the debt except as otherwise provided | The specific payday unlicensed-loan rule is not erased. |
| Timely self-correction | Conditional protection from the specified penalties | Not a universal cure of all consequences. |
| Bona fide error | Statutory intent, procedures, and burden requirements | No actual defense found. |
| Successful statutory violation finding | Court-awarded costs and attorney fees under subsection (8) | No guaranteed recovery or accepted claim. |
[C036–C039.] Justia Law
The special remedy periods are registered below only as necessary conditions of these remedies; ordinary debt limitation law was not rerun.
Section 28-43-201 incorporates federal disclosure compliance only for transactions to which the defined federal law applies. The recovered 2024 § 28-45-203 reproduction has its own civil-disclosure, timing, alternative-liability, and final-judgment qualifications. It does not create universal federal rescission for every payday loan. [C040.] Justia Law+1
Section 28-41-106 limits waiver while preserving its stated good-faith settlement and compromise branches and court scrutiny of unconscionable settlements. Section 28-41-105 supplies severability. Neither validates an actual agreement. [C041.] Justia Law+1

The current-published official Regulation Z interpretation expressly addresses deferred-check/payday arrangements and electronic account-debit substitutes. Such deferral is credit; a fee can be a finance charge under § 1026.4 regardless of its state-law label.
That conclusion remains conditional on Regulation Z’s consumer-credit, creditor, purpose, coverage, and exemption predicates. The relevant operative definitions, exemptions, and complete § 1026.4 were read. No actual creditor status, APR, disclosure sufficiency, or federal liability was determined.
Issue · Reproduced statutory relation · Qualification · 8 data rows
