S_ID PASS-25 — Idaho ordinary civil trial, jury, verdict, findings, and post-trial motions

Fresh public-source access date: October 28, 2026, America/Los_Angeles.

Scope: Ordinary civil trial setting and management; jury demand and nonjury boundaries; instructions, verdicts, and findings; directed verdict and judgment notwithstanding the verdict; new trial, amended findings, and alteration of judgment.

Evidence disposition

The official current-published Idaho civil, evidence, administrative, and relevant small-claims rule text was recovered and read to the bounds recorded below. Official constitutional text was read and visually inspected.

The attempted official jury-qualification statute route failed. A county-hosted, undated statutory compilation and 2025 secondary reproductions supplied bounded statutory text, but do not authenticate current official 2026 statutory currency. Linked original court-rule orders were not opened; displayed footers are not a complete original-order audit.

Earlier findings, provenance, C033/C035, and other holds remain unchanged. The resolved Rule 40 quantity clarification is not reopened. No earlier report supplies a substantive trial-law premise.

Principal findings

Idaho’s published Rule 50 retains “directed verdict” and “judgment notwithstanding the verdict.” It expressly permits the latter motion without a prior directed-verdict motion. A federal prerequisite or federal rule formulation is not substituted. [C032–C036.] Idaho Supreme Court

The ordinary nonjury midtrial provision is Rule 41(b)(2). The published Rule 52(c) addresses assignment of error; it is not a federal-style judgment-on-partial-findings subsection. [C028–C031.] Idaho Supreme Court+1

The post-trial periods use different acts and events. Rule 50(b) says served; Rule 52(b) says filed; Rule 59(b) and (e) require filed and served. Jury discharge, judgment entry, service of opposing affidavits, and issuance of an appellate remittitur are separate triggers. [C031, C033, C039–C043.] Idaho Supreme Court+3

Verdict inconsistency does not have one universal consequence. Rule 49 distinguishes internally consistent answers that conflict with a general verdict from answers that also conflict with each other. It preserves different mandatory and discretionary branches. [C025–C026.] isc.idaho.gov

1. Scope, trial setting, pretrial orders, and continuances

Evidence labels:

  • O — Official body read: current-published court rule or official constitutional publication.
  • P — Provisional statutory text: secondary reproduction or undated government-hosted compilation.
  • H — Held: material history, incorporation, construction, or application dependency remains unresolved.

1.1 Procedural posture matters

Posture Newly read authority Distinction
Ordinary district or magistrate civil action IRCP 1(b) The ordinary civil rules apply within their scope; assignment and substantive entitlement remain separate.
Original small claims IRCP 1(b); IRE 101(e)(5); Small-Claims Rule 11 Special rules govern. The ordinary evidence rules are excluded except privilege, and the original hearing’s informal procedure is not imported into ordinary civil trials.
Small-claims de novo appeal Small-Claims Rule 15(c), (d)(2), (d)(6) A separate proceeding with its own jury-request and composition provisions.
Bench trial Rules 39, 41(b)(2), 52 The court performs the prescribed factfinding function and makes required findings.
Advisory jury Rules 39(c), 52(a)(1) Advisory input does not replace the court’s required findings.
Consensual jury on an issue without an entitlement as of right Rule 39(c)(2) Requires party consent and has the stated verdict effect.
Summary judgment Rule 56(a) A separate pretrial/adjudicative test; not a trial verdict or a default.
Default Rule 55 Separate predicates and safeguards; not rerun here.
Responsive pleading followed by nonparticipation at trial Rule 55(a)(3) An uncontested trial, not a Rule 55 default hearing.
Special proceedings IRCP 1(b); IRE 101(d)–(e) Enumerated special, family, treatment, and other exceptions remain separate.

[C002.] No claim is classified as jury-triable merely because it concerns debt or is called a civil action. Idaho Supreme Court+3

1.2 Scheduling duties and trial-setting requests

Rule 16 distinguishes a duty to take scheduling action from a requirement that a completed order already exist by the same date.

Event Source-stated relationship
Answer or notice of appearance filed Within thirty days, the court must take the specified scheduling action.
Complaint filed, at least one defendant served, no appearance Alternative ninety-day scheduling-action branch.
Resulting scheduling order Filed as soon as practicable after the court’s action; must address trial/pretrial dates and the other required subjects.
Court has not set a scheduling conference or trial after all defendants appear A party may make the Rule 16(b) request.
Response to that request Filed and served within seven days after service of the request.
After response time passes Court must issue the scheduling order or set the request for hearing.
Final pretrial process At least thirty days before trial; a formal conference is one permitted method, not the only method.

[C003.] No actual trial date, request, schedule, appearance, or order was supplied. Idaho Supreme Court

1.3 Modification, disclosures, amendments, and continuance

Subject Operative condition Limit
Trial/pretrial dates Leave of court and good cause under Rule 16(a)(3) Agreement alone is not stated to modify those dates.
Other scheduling deadlines in Rule 16(a)(2)(B) Leave and good cause, or all-party stipulation and court approval Not an automatic unilateral extension.
Formal pretrial conference On the record; at least one attorney for each represented party must have the specified stipulation/admission authority No actual representative’s authority is determined.
Witness/exhibit lists Court may order them; later discoveries must be supplemented as stated Untimely exclusion is discretionary, with the good-cause and prevention-of-injustice qualification.
Amendments during trial Rule 15(b) distinguishes objection-based amendment from express/implied consent to an unpleaded issue Continuance may be allowed; consent or prejudice is not assumed.
Trial or hearing set on court’s initiative Rule 2.4 requires the stated rule-compliant notice A setting is not an evidentiary or merits ruling.
Stipulated continuance/vacatur Rule 2.5 treats it as a joint motion, not a binding agreement on the court Court may approve, deny, or impose a cutoff; no universal numerical request period is supplied.
Consolidation or separate trials Rule 42 uses common questions, convenience, prejudice, expedition/economy, and preservation of jury rights Consolidation does not itself merge substantive entitlements or establish liability.

[C004–C006.] The sanctions portion of Rule 16 was read, but its Rule 37 sanction incorporation is not redeveloped here. Its expense provision retains causal, substantial-justification, and injustice qualifications. [C056.] Idaho Supreme Court+2

2. Jury right, demand, waiver, and nonjury alternatives

2.1 Constitutional and rule-based boundaries

Article I, § 7 preserves the jury right, permits a civil verdict by three-fourths of the jury, addresses civil waiver in the manner prescribed by law, and distinguishes the ordinary twelve-or-agreed-lesser composition from the not-more-than-six category for civil actions within inferior-court jurisdiction even when tried in district court.

Rule 38(a) preserves the right supplied by the Idaho Constitution or statute. It does not itself establish that every claim, issue, or requested remedy is triable by jury. [C007.] Idaho Secretary of State+1

A current separate statutory entitlement for every possible ordinary debt theory was not authenticated. Classification of legal/equitable issues and mixed claims remains a judicial-construction dependency.

2.2 Demand, issue specification, and withdrawal

Branch Exact procedural relation
Initial demand Written demand served no later than fourteen days after service of the last pleading directed to the issue, and filed under Rule 5(d).
Composition statement in demand Must state whether the demanding party will stipulate to fewer than twelve but at least six.
Demand specifying no issues Treated as a demand for all issues triable by jury.
Demand specifying only some issues Another party may serve a demand for other or all jury-triable factual issues within fourteen days after service of the limited demand, or a shorter court-ordered time.
Waiver Rule 38(d) ties waiver to a demand not properly served and filed.
Withdrawal A proper demand may be withdrawn only with the parties’ consent.

[C008–C009.] A pleading amendment, new issue, waiver, or actual “last pleading” is not identified. Idaho Supreme Court

2.3 Court trial, discretionary jury, advisory jury, and consent

Rule 39 separates four situations:

Situation Result supplied by the rule
Proper demand on an issue triable by right Jury trial unless the parties/attorneys stipulate as prescribed or the court finds no right on the issue.
No proper demand Court trial, but the court may order a jury trial on motion for an issue for which a jury could have been demanded.
No jury right Court may use an advisory jury.
No jury right, but party consent Court may use a jury whose verdict has the stated effect of a verdict as of right.

[C010.] These are different sources of authority, not interchangeable findings of entitlement. Idaho Supreme Court

2.4 Jury size and civil agreement threshold

Rule 47(l) provides:

  • Civil actions that may be assigned to the magistrate division use not more than six jurors, whether tried before a district or magistrate judge.
  • Other cases use twelve or a lesser number agreed in open court.
  • Three-fourths may render a verdict.
  • Jury cost may not be taxed to a party in a civil action.

[C011.] Rule 38’s demand-stipulation wording, Rule 47’s category-specific composition, and Article I, § 7 must be retained together. No actual classification, fractional-vote rounding, minimum-panel determination, or consent is supplied. Idaho Supreme Court+1

For the small-claims de novo route only, Rule 15(d)(6) states a fourteen-day jury request after service of the appeal-hearing notice and six jurors unless fewer are agreed. Those special terms are not imported into ordinary civil trial demand. Idaho Supreme Court

3. Ordinary empanelment and qualification boundaries

3.1 Statutory qualification is a separate inquiry

A county-hosted compilation supplies generic jury-selection policy, nondiscrimination, and role definitions. The 2025 reproductions of §§ 2-209 and 2-212 supply the following bounded qualification framework:

Issue Statutory actor/predicate
Language ability or disabling inability to perform satisfactory service Administrative district judge or designee, using the specified competent information; the medical-certificate branch has its own conditions.
Citizenship, age, county residence, felony/restoration category Clerk or jury commissioner under the stated proof framework.
Disqualification duration Generally two years under § 2-209; the specified disability finding permits longer or permanent excusal.
Age seventy or older Permanent excusal if the person indicates the stated wish; written request can restore the person to the list.
Postponement The specified hardship, inconvenience, public-necessity, or breastfeeding category, with written information and court/commission determination.
Postponement duration As deemed necessary; no fixed universal number of days.

[C012.] The statutes’ official-currentness and complete constitutional/restoration/disability incorporations remain held. No individual, questionnaire, medical information, record, or eligibility determination was examined. Justia Law+1

3.2 Confidentiality, examination, and challenge categories

Rule 47 protects questionnaire information from disclosure except by court order, with its limited trial-preparation access and limiting-order provisions. The court supervises random selection, qualification inquiry, and the order and scope of examination. That procedural access does not authorize an actual roster or questionnaire inquiry here. [C013.] Idaho Supreme Court

Cause and peremptory challenges

Category Material rule
Cause timing During questioning or by its stated conclusion; later challenge requires court-permitted good cause.
Cause grounds Statutory disqualification; specified relationship within the fourth degree; listed personal/business/fiduciary relationships; prior jury/witness/subpoena involvement in the same-party/same-cause trial; monetary interest; unqualified merits belief based on facts; hostility or bias.
Cause count No numerical limit; co-parties need not join.
Cause decision Tried by the court; replacement follows the rule.
Record Entire voir dire and challenge rulings reported verbatim unless all parties stipulate otherwise on the record.
Ordinary peremptories Four per party after cause challenges.
Co-parties Court allocates based on the degree of conflicting interest; equal, unequal, shared, or full allocations are possible.
Waiver of one peremptory Waives that challenge only.
Consecutive waiver by all parties Remaining peremptories are waived and the jury is deemed accepted.

[C014–C015.] Constitutional restrictions on challenges and the calculation of relationship degrees are separate dependencies; the text is not a license to exclude anyone for an unlawful reason. Idaho Supreme Court

3.3 Additional jurors and management

Rule 47(j) permits additional jurors. One or two additional jurors produce one additional peremptory per party; more than two produce two. After closing arguments, excess jurors are removed by lot. If an alternate replaces a deliberating juror, the court must direct the reconstituted jury to disregard earlier deliberations and begin anew. [C016.]

Rule 47(k) separately addresses sequestration discretion, juror conduct, notes, optional notebooks, court-screened written juror questions, objections outside the jury’s presence, and deliberation materials. Written instructions and practical admitted exhibits go to deliberations, excluding depositions. No notebook or juror question was constructed. [C017.] Idaho Supreme Court

4. Trial management, testimony, instructions, and the record

4.1 Open proceedings, testimony, and judicial roles

Rule 42.1 requires merits trials in open court, while preserving witness-exclusion rules. It distinguishes trials/evidentiary hearings outside the county by stipulation from other hearings that may occur elsewhere.

Rule 43 ordinarily requires open-court testimony, subject to its statute/rule exceptions. Contemporaneous remote testimony requires good cause in compelling circumstances and appropriate safeguards. An affirmation may substitute for an oath.

The interpreter paragraph incorporates ICAR 52 and uses a fourteen-day or as-soon-as-practicable expedited relation. Full interpreter eligibility, appointment, and funding authority was not completed. [C018.] Idaho Supreme Court+1

The narrowly read evidence rules distinguish:

Rule Trial-management boundary
IRE 611 Reasonable court control of testimony; scope and leading-question qualifications
IRE 614 Court may call a witness when it is the trier of fact; parties may cross-examine; the court may examine any witness, with the stated objection opportunities
IRE 615 Court may exclude witnesses, subject to natural-party, designated representative, essential-person, and other stated exceptions
IRE 605 Presiding judge cannot testify at that trial; objection is not needed to preserve that issue
IRE 606(a) Juror testimony before the other jurors is prohibited, with the specified opportunity to object outside their presence
IRE 606(b) Deliberative/vote/mental-process evidence is restricted; extraneous information, outside influence, resort to chance, and verdict-form mistake have separate exceptions

[C019.] The Rule 59 jury-misconduct affidavit requirement does not authorize every juror affidavit or inquiry into deliberations. Idaho Supreme Court+4

4.2 Required record versus transcript

Court setting Source-stated record rule
Magistrate division ICAR 25 requires a verbatim record or recording; logs, storage, transcription, and unread statutory reporter qualifications have separate conditions.
District court ICAR 27(a) requires certified reporter attendance for civil trials unless waived in the prescribed manner.
Electronic recording ICAR 27(c) generally requires it; the reporter-present/good-cause exception and emergency-absence branches remain.
Official transcript A certified transcript meeting ICAR 27(d) differs from a raw recording or realtime display.
Jury selection and instructions Rules 47(h)(4) and 51(f) contain their own record requirements.

[C020.] No transcript request, record, recording, reporter, or certification was examined. Full retention, transcript fees, and appellate-record preparation remain held. Idaho Supreme Court+1

4.3 Instruction requests, rulings, and preservation

Event Rule 51 condition
Initial written requests Filed no later than seven days before jury trial; served and received at least seven days before trial.
Late request Court need not consider it; unforeseen or overlooked matters may be permitted through and including close of evidence.
Court-proposed instructions Adequate time to consider and object outside the jury’s presence.
Submission format Original and copy; citations on the copy; specified numbering/ruling fields. No form was created.
Ruling At close of evidence, on record or endorsed as prescribed.
Objections/rulings Must be made part of the record.
Pattern instructions If the latest IDJI has an applicable instruction and the court decides the subject should be charged, the court should use it unless a different instruction is more adequate, accurate, or clear.
Preliminary instructions Permissible; instruction conference before trial is required for their consideration.
Preservation Distinct objection and grounds before the jury deliberates.
Final delivery Written instructions read before final arguments; jury receives original and at least two copies.
Jury follow-up question Written request; recorded response; party opportunity to be present/heard when available within a reasonable time.

[C021–C023.] The latest IDJI edition and actual substantive instructions were not retrieved. Pattern-instruction references do not establish the elements of any debt claim. Idaho Supreme Court

Rule 46 eliminates formal exceptions but still requires the stated action/objection and grounds when an opportunity exists. IRE 103 separately protects the specified definitive-ruling and no-opportunity branches. Its nonjury offer-of-proof provision has plainly inadmissible and privilege exceptions. Full appellate preservation is not certified from these clauses alone. Idaho Supreme Court+1

5. Verdicts, findings, and the nonjury midtrial route

5.1 Receipt and polling of a verdict

Rule 47(m) distinguishes:

Situation Consequence
All jurors agree Written verdict signed by the foreperson.
Not all agree Written verdict signed by all agreeing jurors.
Return Jury brought into court; verdict delivered and read; inquiry whether it is their verdict.
More than one-fourth disagree Court returns jury for further deliberation.
Poll requested Court or clerk asks each juror.
Three-fourths acknowledge Verdict accepted and jury discharged under the rule.

[C024.] Receipt, acceptance, polling, discharge, and judgment entry are distinct events. No vote, fractional rounding, verdict, or actual result is supplied. Idaho Supreme Court

5.2 Special verdict and general verdict with written answers

Branch Rule 49 consequence
Special verdict Court may require written fact findings, with necessary explanations/instructions.
Omitted factual issue Unless submission is demanded before the jury retires, the stated jury right on that issue is waived. Court may find it; absent a finding, the rule supplies the judgment-consistency treatment.
General verdict and answers all consistent Court must direct appropriate judgment.
Answers mutually consistent but one or more conflicts with general verdict Court may enter judgment according to answers, return the matter to the jury, or order new trial.
Answers conflict with each other and one or more also conflicts with verdict Judgment must not be entered; further jury consideration or new trial is required.

[C025–C026.] The official page places both the consistent-answer and mutually-consistent-but-verdict-conflict clauses in Rule 49(b)(2); the internally inconsistent branch is (b)(3). Federal numbering is not substituted. isc.idaho.gov

5.3 Mistrial

Rule 48 operates after trial begins and before a verdict is rendered. A trial occurrence preventing fairness permits, but does not automatically require, a mistrial. If the court finds deliberate party/attorney misconduct caused it, causal reasonable expenses, including fees, may be imposed. [C027.]

This is not the same as a postjudgment new trial, a harmless error, or automatic underlying liability. Idaho Supreme Court

5.4 Nonjury dismissal after the plaintiff’s evidence

Rule 41(b)(2), not a federal-style Rule 52(c), supplies the ordinary Idaho provision:

Predicate/event Rule consequence
Nonjury action after presentation of plaintiff’s evidence Defendant may seek dismissal because the facts and law show no right to relief.
Motion denied Defendant’s right to present evidence is not waived.
Court action May determine facts and enter judgment, or await all evidence.
Merits judgment against plaintiff Rule 52 findings required.
Rule 41(b)(3) effect Unless otherwise stated, the specified dismissal operates on the merits, with the stated jurisdiction and Rule 19 exceptions.

[C028.] This is a defined stage and function, not a universal authorization for any partial-finding judgment at any point. It does not adjudicate debt validity here. Idaho Supreme Court

5.5 Findings and conclusions

Rule 52 requires separate fact findings and legal conclusions after a factual bench trial or advisory-jury trial. They may be stated on the record after evidence or in a filed opinion/memorandum. Judgment remains a Rule 58 event.

The rule separately treats interlocutory injunctions, default, motions, and adopted master findings. No master or injunction regime is completed here. [C029.] Idaho Supreme Court

Two preservation statements must not be collapsed:

  • Evidentiary sufficiency: Rule 52(a)(1), (6) permits the stated challenge without prior objection or amendment request.
  • Absence of findings: Rule 52(c) requires the issue to have been raised by an appropriate trial-court motion.

Rule 52(a)(7)’s clearly-erroneous/deference language is recorded only as a narrow review boundary, not a full appeal analysis. [C030.]

A Rule 52(b) motion must be filed no later than fourteen days after judgment entry. The court may amend/add findings and amend judgment; the motion may accompany Rule 59 relief. [C031.] Idaho Supreme Court

6. Directed verdict and judgment notwithstanding the verdict

6.1 Idaho terminology and prerequisites

Rule 50 is titled Dispositive Trial Motions and uses directed verdict and judgment notwithstanding the verdict (JNOV). Rule 62(b) uses the broader “judgment as a matter of law” label for its stay reference; that does not replace Rule 50’s operative text.

Rule 50 branch Complete material relation
Directed verdict Motion must state specific grounds.
Motion at close of opponent’s evidence If denied, moving party may offer evidence without a reservation.
Jury right Denial does not waive jury trial, even if all parties moved.
Grant Order is effective without jury agreement.
JNOV after judgment Must be served no later than fourteen days after entry.
No verdict returned Must be served no later than fourteen days after jury discharge.
Prior directed-verdict motion Not required by Rule 50(b)(1).

[C032–C033.] The rule does not itself state a complete universal evidence-sufficiency test for granting these motions. That test and any constitutional limits require Idaho judicial construction; a federal formulation is not imported. Idaho Supreme Court

6.2 Alternative relief and conditional rulings

Event Rule 50 relationship
JNOV motion plus new-trial request May be joined or pleaded alternatively, conforming to Rule 59(a).
Motion to set aside/nullify verdict or for new trial Includes the rule’s JNOV alternative. This is not a blanket cure for untimeliness or missing grounds.
Verdict returned Court may leave judgment, reopen and order new trial, or direct judgment as authorized.
No verdict Court may direct judgment or new trial.
JNOV granted with new-trial motion Court must rule conditionally on new trial in case of later vacatur/reversal.
Conditional grant Grounds must be specified; finality of the judgment is not altered by that conditional order.
Party whose verdict is set aside Separate opportunity to serve a new-trial motion no later than fourteen days after judgment entry; conditional ruling required.
Failure under that subsection Waiver of the right to apply for new trial under the stated provision.

[C034–C035.] The scope of the “includes” clause is not turned into permission to disregard Rules 50 and 59. Idaho Supreme Court

Rule 50(b)(3) preserves the stated sufficiency review despite failure to move for directed verdict, JNOV, or new trial, when error is properly assigned on appeal. That does not erase every trial-preservation rule. The appellate alternatives following conditional rulings or denied JNOV are recorded only to preserve the rule’s structure. [C036.]

7. New trial, altered findings, and alteration of judgment

7.1 Complete Rule 59 grounds

Rule 59(a)(1) permits a new trial on all or some issues, to any party, upon the applicable ground:

Subdivision Ground and material qualification
A Irregularity in court, jury, or adverse-party proceedings
B Court order or abuse of discretion preventing a fair trial
C Jury misconduct
D Accident or surprise that ordinary prudence could not have guarded against
E Material newly discovered evidence that reasonable diligence could not have discovered and produced at trial
F Excessive or inadequate damages appearing influenced by passion or prejudice
G Evidentiary insufficiency to justify verdict/decision, or decision against law
H Legal error occurring at trial

[C037.] These are not automatic findings of misconduct, unfairness, invalid debt, or entitlement to relief. Idaho Supreme Court

7.2 Required support and time

Provision Requirement
Grounds A–E Motion accompanied by an affidavit detailing relied-on facts.
Grounds G–H Particular factual grounds must be stated.
Ground F The rule does not place it in those two specified support lists; that does not establish an evidence-free entitlement.
New-trial motion Filed and served within fourteen days after judgment entry.
Supporting affidavits Filed and served with the motion.
Opposing affidavits Filed and served within fourteen days after service.
Opposing-affidavit extension Up to twenty-one additional days by court order or written stipulation.
Reply affidavits Court may permit.
All Rule 59 affidavits Must satisfy Rule 56(c)(4).

[C038–C039.] Rule 56(c)(4) requires personal knowledge, admissible facts, competence, and the stated sworn/certified attachments. Rule 2.7’s declaration alternative depends on § 9-1406, not freshly authenticated here. No affidavit or declaration was created. Idaho Supreme Court+2

7.3 Nonjury new trial and court initiative

After a nonjury trial, Rule 59(a)(3) permits opening an entered judgment, taking additional testimony, changing or making findings/conclusions, and directing a new judgment. [C040.]

The court-initiative branch is precise:

Event Rule 59(d) consequence
No later than fourteen days after judgment entry Court may give notice of intent to order a new trial.
That notice Treated as a new-trial motion for the stated civil/appellate purposes.
Timely served party motion Court may grant on a reason not stated in the motion.
Before new-trial order Notice and opportunity to be heard required.
Order granting new trial Must specify grounds.

[C041.] The fourteen-day court-initiative clause concerns notice of intent, not a universal requirement that the final new-trial order be entered by then. Full appellate tolling is not determined. Idaho Supreme Court

7.4 Alteration and additur/remittitur

Rule 59(e) requires a motion to alter or amend judgment to be filed and served no later than fourteen days after entry. The rule does not supply an unrestricted right to relitigate every issue or a complete substantive standard for relief. [C042.]

Rule 59.1 separately governs a conditional new-trial disposition involving additur or remittitur:

Branch Period and event
Ordinary acceptance/rejection Forty-two days from entry of the conditional order
Notice of appeal filed Does not itself accept or reject; choice deferred until appeal determination
Successful appeal Further proceedings follow appellate opinion
Conditional new-trial order affirmed Fourteen days from issuance of the appellate remittitur

[C043.] The appellate remittitur is not the same event as a trial court’s damages-reduction remittitur. No amount, appeal, choice, or damages calculation is supplied. Idaho Supreme Court

7.5 Judge unable to complete post-trial duties

Rule 63 applies after a verdict has been returned or findings/conclusions filed and the original judge cannot perform the remaining duties for the stated reasons. Another regularly sitting or assigned judge may perform them; inability to do so permits a new trial.

The text is not generalized into unrestricted midtrial substitution. [C044.] Idaho Supreme Court

8. Judgment, computation, notice, reconsideration, and stay boundaries

8.1 Ruling, verdict, findings, and judgment

Rule 54 requires a separate judgment/decree document stating relief, with its stated prohibition on embedding reasoning or findings except where expressly required. A verdict or memorandum is not automatically that document.

Rule 58 makes filing/entry distinct. Costs do not postpone judgment entry. An amended judgment becomes effective through entry of the complete amended judgment. Partial-final certification has its own conditions; its appendix and complete appellate consequences remain held. [C045.] Idaho Supreme Court+1

8.2 Computation and extensions

Issue Rule 2.2
Trigger day Excluded
Intermediate days Included, including weekends and legal holidays
Last day Included, subject to weekend/holiday extension
Clerk inaccessibility Filing extension to the stated accessible nonweekend/nonholiday day unless otherwise ordered
Before expiration Good-cause extension under the stated request/action conditions
After expiration Motion and excusable-neglect condition
Written stipulation Subject to court-business/convenience limits and other governing provisions
Nonextendable periods Court must not extend Rule 50(b), 52(b), 59(b), (d), (e), or 60(b) periods
Mail addition Three days only when the act is due a specified time after service and service is by mail

[C046–C047.] Judgment entry, jury discharge, and appellate-remittitur issuance are not silently converted into service events. Rule 59(c)’s express opposing-affidavit extension is a distinct provision. No actual date is calculated. Idaho Supreme Court

8.3 Notice and later-paper service

Rule 2.3 requires the clerk’s immediate service of an entered order/judgment and recording of mailing. Lack of notice ordinarily does not alter appeal or postjudgment-motion periods, subject to its exact no recorded mailing and no actual notice exception.

The exception is not a newly supplied automatic restart formula. [C048.] Idaho Supreme Court

Rule 5 distinguishes service completion, filing, and electronic-consent conditions. Rule 7’s ordinary fourteen-/seven-/two-day hearing-relative receipt schedule yields when another governing provision supplies a different period. It does not turn Rule 50(b)’s service deadline into a fourteen-day filing deadline or change Rule 59’s dual requirement. [C049.] Idaho Supreme Court+1

8.4 Reconsideration, harmless error, and stays

Rule 11.2(b)(2) bars reconsideration of the specified orders on motions under Rules 50(a), 52(b), 55(c), 59(a), 59(e), 59.1, 60(a), and 60(b). Rule 50(b) is not listed there; that omission is not treated as a universal affirmative authorization or a way around another deadline. [C050.] Idaho Supreme Court

Rule 61 requires attention to substantial rights and the stated justice qualification. An identified error is not automatically harmless or automatically grounds for a new trial. [C051.] Idaho Supreme Court

Rule 62(b) permits a stay on appropriate security terms while the listed post-trial motions are resolved. Merely requesting relief does not establish a stay. The rest of the judgment-enforcement and appellate-stay lifecycle remains outside this pass. [C052.] Idaho Supreme Court

15.4 Researcher self-check

The strongest completed findings are the current rule-text distinctions: jury-right source versus demand procedure; general versus special verdicts; the Idaho nonjury Rule 41(b)(2) route; directed verdict and JNOV without a mandatory prior directed-verdict motion; findings versus absence-of-findings preservation; and the separate service, filing, entry, discharge, notice-of-intent, and appellate-remittitur events.

The principal remaining gaps are original adoption history, current official statutory qualification text, substantive entitlement and burdens, referenced forms/instructions and special regimes, and judicial construction.

No actual or invented party, lawyer, witness, juror, panel, account, debt, evidence, record, order, case, event, motion, verdict, judgment, amount, or date was supplied or constructed. No jury entitlement, waiver, challenge, admissibility, preservation, liability, relief, deadline, or outcome was determined.

This is a researcher self-check, not independent review. The component is supported by newly read official rules and constitutional text, but remains conditional at the exact statutory, historical, incorporation, construction, and actual-application boundaries recorded above. Earlier findings and holds remain preserved. No Idaho, dimension4, A066, parent, operational, or publication acceptance follows.
