S_ID PASS-21 — Idaho ordinary civil debt actions: jurisdiction, commencement, service, response, default, and set-aside boundaries
Fresh public-source access date: October 28, 2026, America/Los_Angeles.
Scope: The initial ordinary civil-court route for a generic debt claim. Small claims, specialized summary proceedings, full contested proof and trial, ordinary limitation periods, judgment enforcement, and appellate merits remain separate.
Evidence disposition
The official current-published Idaho Rules of Civil Procedure and Idaho Court Administrative Rules were recovered and read to the bounds recorded below. Official constitutional text and the narrowly necessary federal military-default provisions were also read.
The attempted official Idaho statutory bodies were inaccessible. Those statutory findings remain provisional readings of identified secondary reproductions. A material 2026 replacement of Idaho Code § 5-404 was found in a legislative mirror, with reported enactment history. The final official act was not recovered; the older 2025 venue text is not presented as current.
Earlier findings, provenance, C033/C035, and other holds remain unchanged. No earlier sector report supplies a substantive premise here.
Principal findings
Magistrate assignment amounts are not a universal limit on Idaho district-court jurisdiction. The statutes, ICAR 5–8, and Civil Rules 1.2–1.3 distinguish ordinary assignments, special assignments, enlarged assignments, transfers, and objections. No local assignment order was examined. [C002–C007.] Idaho Supreme Court+3
The 2026 venue amendment matters. The recovered S1369 text replaces § 5-404 and includes cause-of-action, residence, corporation, and nonresident branches. Its reported effective date is July 1, 2026. The unusual nonresident wording and the final-official-source gap are preserved rather than normalized away. [C008–C010.] LegiScan+1
Initial process, later-paper service, appearance, and waiver are different. Rule 4’s service routes are not interchangeable with Rule 5’s consent-based electronic service. Rule 12(h)(1) also has an Idaho-specific requirement for preserving personal-jurisdiction, process, and service defenses. [C017–C029.] Idaho Supreme Court+2
Idaho Rule 55 places default and default judgment with the court. It does not supply a federal-style clerk-only sum-certain shortcut. A missed response, an entry of default, an uncontested trial, and a final default judgment have different predicates. [C035–C041.] Idaho Supreme Court
Set-aside relief is not automatic debt discharge or an automatic stay. Entry of default uses good cause; a final default judgment uses Rule 60(b). The six-month limit applies to specified grounds, not every branch, and the separate nonpersonal-service and military-default provisions must not be merged into it. [C043–C052.] Idaho Supreme Court+1
1. Court authority, assignment, jurisdiction, and venue
The following labels apply:
- O — Official body read: current-published court rule, constitutional text, or official federal codification, within the stated read bounds.
- P — Provisional: dated secondary Idaho statutory reproduction.
- L — Legislative-version evidence: a read legislative mirror and reported status, not a recovered final official act.
- H — Held: a material source, incorporation, construction, or application dependency remains unresolved.
1.1 Distinct court questions
| Question |
Newly read authority |
Supported distinction |
| Subject-matter jurisdiction |
Idaho Constitution, Article V §§ 2, 20, 26; § 1-705 |
District-court authority is not determined solely by a magistrate assignment threshold. |
| Magistrate assignment |
§§ 1-2201, 1-2208, 1-2210; ICAR 5–8 |
Assignment depends on the governing statutory and court-rule category and authorized assignment orders. |
| Personal jurisdiction |
§§ 5-514–517; Rules 4 and 4.1 |
Service, sufficient statutory connection, and voluntary submission are separate questions. |
| Venue |
§§ 5-401–404, 5-408; Rule 40.1 |
Proper county is distinct from subject-matter and personal jurisdiction. |
| Claim validity |
Rules 8, 9, 11, 17 and applicable substantive law |
Jurisdiction or assignment does not prove a valid debt, ownership, breach, or recoverable amount. |
| Procedural scope |
Rule 1(b) |
Ordinary civil rules do not automatically replace small-claims or other designated special rules. |
| Local rules |
Rule 1(c) |
Internal-management/procedure rules require the stated consistency, approval, publication, and effectiveness conditions. |
| Jurisdiction/venue preservation |
Rule 1.1 |
The civil rules are not construed to extend or limit jurisdiction or venue. |
[C002–C003.] The official constitutional publication was read only for the identified court-structure provisions, not as a complete constitutional procedure report. Idaho Secretary of State+3
Rule 1(b)’s small-claims exclusion is explicit: the ordinary civil rules apply there only as provided by the Idaho Rules for Small Claims Actions. Its family-law and specified mental-health/developmental-disability exceptions remain separate. No small-claims monetary threshold or procedure is determined here.
1.2 Magistrate assignment is not one universal dollar cap
| Source |
Amount or assignment relation |
Qualification |
| Reproduced § 1-2208 |
Lists the statutory money/property category at $5,000 or less, among other assignable matters |
Subject to the Supreme Court’s rules and the other statutory provisions |
| Reproduced § 1-2210 |
Distinguishes attorney and nonattorney magistrate assignments and permits additional categories under court rules |
Does not alone select the proper judicial officer |
| ICAR 5(c)(1) |
Additional civil assignments involving damages/property value not exceeding $10,000 |
Administrative district judge approval is part of the rule |
| ICAR 6 |
Special assignment of one or more actions otherwise triable by a district judge |
Clerk notice to the parties is required |
| ICAR 7(a) |
Administrative district judge may enlarge civil assignments for a district, county, or specified magistrates |
Current published text includes the August 1, 2025 amendment |
| Rule 1.2 |
Excludes interest, costs, punitive damages, and attorney fees from assignment amounts; counts generally aggregate |
Overlapping claims for the same or similar relief may receive a written judicial amount determination |
| Rule 1.2(b)/ICAR 8 |
Transfer when a qualifying counterclaim, crossclaim, third-party claim, or action exceeds the applicable assignment authority |
Statutory/rule fee and transfer conditions remain |
| Rule 1.3 |
Written assignment objection before trial or hearing begins; specified waiver and collateral-attack consequences |
Improper assignment is not equated with absence of subject-matter jurisdiction |
[C004–C007.] No district assignment order, judge’s qualifications, claim amount, or actual transfer was examined. Justia Law+7
1.3 Venue: the 2026 replacement must be distinguished from the old text
The recovered S1369 text repeals and replaces § 5-404. Its reported enactment history identifies chapter 163, signed March 26, 2026, with a July 1, 2026 effective clause.
| New reproduced legislative branch |
Textual relation |
| General residual venue |
County where the cause arises or where any defendant resides at commencement, unless another chapter provision or law controls |
| No Idaho-resident defendant |
Uses the exact temporal wording concerning residence “at the time of the cause of the action, or prior to the filing of the complaint” |
| Life/fire insurer |
County of death or loss under the stated branch |
| Idaho-organized corporation |
Principal-place-of-business county or county where the cause arose |
| Transfer power |
Other lawful power to change place of trial is preserved |
[C008.] The nonresident clause’s wording is not restated as a simpler rule about residence only on filing day. No pending-action savings or transition rule beyond the bill’s effective clause was recovered. The 2025 § 5-404 reproduction is retained only as historical comparison, not current operative authority. LegiScan+1
Sections 5-401–403 contain separate real-property, penalty/public-officer, and county-party venue categories. They were read to prevent treating § 5-404 as universal; they are not applied to an actual claim. [C009.] Justia Law+2
Rule 40.1 requires a motion for a venue change. It distinguishes discretionary impartiality/convenience grounds from improper-county relief, with the latter’s no-later-than-fourteen-days-after-responsive-pleading-filing condition. Its retention exception and possible sanction for improper venue without good cause remain material. Section 5-408 addresses transmission and the receiving court’s role. [C010.] Idaho Supreme Court+1
1.4 Personal jurisdiction and out-of-state defendants
The complete §§ 5-514–517 were read. They identify enumerated Idaho contacts, claims arising from those contacts, out-of-state personal service, and preservation of other authorized methods. Their family/paternity branches were not applied to ordinary debt.
Statutory authorization, valid service, constitutional personal jurisdiction, and a meritorious debt remain different. No actual contact, consent, presence, agent, or jurisdictional fact is supplied. [C011.] Justia Law+3
2. Commencement, pleadings, verification, and ownership
2.1 Commencement is a procedural event
Rule 3 states that the civil action is commenced by filing the complaint, petition, or application. The rule’s case-information-sheet requirements have their own party and proceeding exceptions.
This does not resolve a substantive limitation period, tolling, relation back, statutory condition precedent, or whether filing alone satisfies every legal purpose. [C012.] Idaho Supreme Court
2.2 Complaint adequacy is not proof of the debt
| Rule |
Required or permitted matter |
Boundary |
| Rule 7(a) |
Enumerated pleadings |
A motion or informal communication is not automatically an answer. |
| Rule 8(a) |
Short and plain jurisdictional grounds, claim showing entitlement, and demand for relief |
Allegations do not establish evidence or actual entitlement. |
| Rule 8(b)–(d) |
Admissions, denials, insufficient-knowledge denials, affirmative avoidances, and alternative/inconsistent statements |
Undenied allegations and damages have different treatment. |
| Rule 9(a) |
Capacity/representative authority generally need not be alleged unless required for jurisdiction; challenge by specific denial with the stated factual support |
Does not eliminate substantive capacity requirements. |
| Rule 9(b)–(c) |
Particularity for the specified fraud/mistake/rights claims; general allegation of conditions precedent but particular denial |
No particular cause or defense is selected. |
| Rule 9(g) |
Special damages by category; general/punitive dollar pleading restriction with threshold exception |
A requested number is not an award. |
| Rule 10 |
Numbered paragraphs, separate claims when clarity requires, and incorporation of attached instruments |
It does not by itself require every ordinary debt complaint to attach a contract or full assignment chain. |
| Rule 11 |
Signature and reasonable-inquiry certification; verification only when specifically required |
A signature is not a judicial finding that the allegations are true. |
[C013, C015–C016.] No universal special “debt complaint” exhibit package was authenticated from these rules. Sector-specific documentation, negotiable instruments, evidentiary admissibility, and contractual prerequisites remain separate. Idaho Supreme Court+4
Rule 11.1 governs a verification when one is required or permitted. Its officer/declaration incorporations in Rule 28 and § 9-1406 were not completed; no verification was drafted. Idaho Supreme Court
2.3 Real party, capacity, and assignment
Rule 17 requires prosecution by the real party in interest, subject to its named representative categories. It provides a reasonable opportunity, after objection, for ratification, joinder, or substitution before dismissal on that ground. Capacity for a nonrepresentative party is determined by Idaho law.
Reproduced § 5-302 preserves the specified setoff and defenses against an assignee, subject to its negotiable-instrument exception. Neither source proves an assignment, instrument status, authority to represent an entity, or ownership of a debt. [C014.] Idaho Supreme Court+1
Minor/incapacitated-party representation under Rule 17(c) is separate from Rule 4’s recipient age thresholds and Rule 55’s default safeguards. The court’s protective duty does not establish a particular person’s status.
3. Initial summons and service
3.1 Issuance, contents, and service period
Rule 4 distinguishes the clerk’s issuance of process from service. Required contents include court/case/party/county identification, clerk and attorney-or-party contact information, direction to the defendant, response/default information, clerk signature, and seal. Amendment is discretionary subject to material-prejudice limits.
The ordinary, publication, and expedited-eviction summons forms are different prescribed categories. The API-hosted Appendix B files were not opened; their complete standalone formatting remains an identified incorporation gap. [C017.]
Service ordinarily requires summons and complaint together. If service is not accomplished within 182 days after filing, Rule 4(b)(2) provides dismissal without prejudice after the stated fourteen-day notice, but requires an appropriate extension upon good cause. No actual extension or dismissal is determined. [C018.] Idaho Supreme Court
3.2 Recipient and method distinctions
| Recipient or route |
Material conditions |
| Ordinary individual |
Personal delivery; dwelling/usual abode with a resident at least eighteen; or an authorized process agent |
| Authorized server |
Officer authorized by law, or a nonparty over eighteen |
| Person under fourteen |
Guardian; otherwise parent; otherwise the stated custodian; additional service on the minor unless the court orders otherwise |
| Judicially declared incompetent person |
The specified Idaho guardian, resident competent adult family member, institution officer, or court-directed recipient; additional service unless ordered otherwise |
| Conflicted recipient who is plaintiff |
Court-designated alternative |
| Corporation, partnership, qualifying association |
Officer, managing/general agent, or authorized process agent, subject to other Idaho law |
| Statutory agent |
Statutory copy and additional-mail requirements; specified state-official registered/certified-mail branch |
| Unavailable designated entity agent |
Rule 4(d)(3)(C)’s complete unavailability and mailing conditions |
| State/agency |
Two copies to Attorney General or assistant |
| Other governmental subdivision |
Specified chief executive, secretary, or clerk; additional statutory service remains |
| Acknowledged admission |
Written acknowledged receipt stating capacity under Rule 4(d)(5), also recognized in proof subsection (g) |
| Outside Idaho |
Statutory authorization plus Rule 4(d)/applicable statute |
| Publication |
Court/statutory predicates, claim-ground statement, publication, and required mailing |
[C019–C024.] These categories do not select a server, agent, address, or recipient. “At least eighteen,” “over eighteen,” and “under fourteen” have different functions. None is a universal definition of litigation capacity. Idaho Supreme Court
Unavailable entity agent is not ordinary mailed service
The special entity branch requires one of the stated nonresident-designation, resignation/removal/death/move, or due-diligence conditions. Mailing is to the specified registered-business and officer addresses, by registered or certified mail; completion and proof follow that paragraph.
It is not a general rule that an ordinary first-class demand, billing letter, or electronic message serves a complaint. [C021.]
The published Rule 4(d)(5) heading repeats the governmental-service title, while its operative sentence addresses acknowledged written admission. The report relies on that sentence and its express cross-reference in Rule 4(g)(1)(F), without inventing a federal waiver-request procedure. [C023.]
3.3 Publication and statutory conditions
Section 5-508 requires the specified grounds, affidavit, cause/proper-party showing, and court order. Its due-diligence language cannot be reduced to “an address was unavailable.”
Section 5-509 provides publication at least weekly for four consecutive weeks and, where residence is known in the stated branch, the ordered mailing within ten days. Rule 4 additionally specifies a mailed copy to the last-known address most likely to give notice.
Rule 4 states completion on the last publication; § 5-509 uses expiration of the publication period. No actual date or constitutional sufficiency is determined. [C024.] Justia Law+2
Section 5-510’s joint/several contract branch permits proceeding against served defendants as stated; service on one is not treated as service on all. Justia Law
3.4 Proof of service
Rule 4(g) requires written identification of documents, manner, date, and place, with the specified officer certificate, adult-server affidavit, mailing evidence, postal receipts, publication affidavit, or acknowledged admission.
The proof-filing exception when the served party appears does not itself establish valid service or waive every defense. Proof may be amended under the prejudice limitation. [C025.] Idaho Supreme Court
4. Later papers, appearance, response, and amendment
4.1 Rule 5 is not an alternative initial-service code
Later-paper service generally goes to counsel when represented, unless the court directs otherwise. Rule 5 permits its stated personal, office, dwelling, mail, clerk, fax, written-consent electronic, and agreed-method alternatives.
For written-consent electronic service, transmission has the stated completion rule unless the sender learns it did not reach the recipient. Mail service is complete on mailing. A new claim against a nonappearing defaulted party requires Rule 4 service.
The rule’s proof-of-service defect clause does not establish that defective initial process is immaterial. [C026.] Idaho Supreme Court
Actual e-filing platform requirements, electronic-consent validity, account access, and private transmission records were not investigated.
4.2 Appearance and preserved objections
Rule 4.1 generally treats voluntary appearance or service of a pleading as submission to personal jurisdiction, but lists exceptions for the specified jurisdiction/process/service motions, disqualification, extension requests, joined defenses, certain later participation, and a compliant special appearance.
A document labeled special appearance has a fourteen-day associated-motion condition unless the court permits later timing. A merits answer and an appearance are not identical. [C027.] Idaho Supreme Court
Idaho-specific Rule 12 waiver qualification
Rule 12(h)(1) requires the personal-jurisdiction, insufficient-process, and insufficient-service defenses to be asserted by motion before a responsive pleading or another motion, subject to its extension/disqualification exceptions.
That is not replaced by a federal-rule assumption that merely including the objection in an answer always preserves it. Subject-matter jurisdiction, venue, and the other preserved defenses have different provisions. [C029.] Idaho Supreme Court
4.3 Response periods and motion consequences
| Event |
Rule 12 relation |
| Summons and complaint service |
Answer within twenty-one days unless another rule/statute supplies a different period |
| Counterclaim or crossclaim service |
Twenty-one days |
| Ordered reply |
Twenty-one days after service of the order unless changed |
| Rule 12 motion denied or disposition deferred to trial |
Fourteen days after notice of court action, unless otherwise ordered |
| More definite statement granted |
Fourteen days after that statement is served, unless otherwise ordered |
| Failure to obey more-definite-statement order |
Fourteen days after notice or the court’s specified time; stated judicial consequences |
| Strike motion where no responsive pleading is allowed |
Within twenty-one days after service |
The motion-trigger provision refers to serving a Rule 12 motion. Merely preparing or naming a motion is not the rule’s event. [C028.] Idaho Supreme Court
Rule 12 also governs consolidation of available objections and conversion of a Rule 12(b)(6) or 12(c) motion when outside matters are accepted. Full summary-judgment procedure is held.
4.4 Motion papers, amendments, and counterclaims
| Topic |
Material rule |
| Ordinary motion papers |
Rule 7 requires stated grounds, applicable rule, and relief; its ordinary receipt-before-hearing intervals are fourteen, seven, and two days for moving, opposing, and reply materials. |
| Oral argument |
The court’s denial notice is at least one day before hearing; good-cause and other-rule/statute exceptions remain. |
| Facts outside record on motion |
Rule 7.1 permits the specified affidavit, oral-testimony, or deposition consideration. |
| Amendment as of right |
Once within the applicable twenty-one-day branch; the responsive-pleading/Rule 12-motion branch uses whichever is earlier. |
| Other amendment |
Written consent or court leave, under the justice standard. |
| Response to amended pleading |
Remaining original period or fourteen days after amended service, whichever is later, unless ordered otherwise. |
| Compulsory counterclaim |
Transaction/occurrence and jurisdiction predicates, with pending-action and nonpersonal-jurisdiction-process exceptions. |
| Relation back |
Complete Rule 15(c) was read; no limitation or party-substitution outcome is determined. |
[C030–C032.] No defense, counterclaim, motion, or amendment is proposed for an actual matter. Idaho Supreme Court+3
4.5 Counting and extensions
Rule 2.2 applies to the stated rules/orders and statutes without their own computation method. It excludes the trigger day, counts intermediate days, and supplies the weekend/holiday and clerk-inaccessibility qualifications.
Extensions before expiration use good cause; an after-expiration motion additionally requires excusable neglect. A filed written stipulation has its own orderly-business condition. The rule prohibits extending the specified post-trial and Rule 60(b) periods.
Three days are added only when the applicable act is due after service and service is by mail. This is not an automatic addition to judgment entry, every electronic transmission, or every period involving mailing. [C033–C034.] Idaho Supreme Court
5. Default entry, default judgment, and initial finality
5.1 Default stages
| Stage |
Required distinction |
| Failure to plead or otherwise defend |
Must be shown by affidavit or otherwise; response time must have expired unless the special shortened-time conditions apply |
| Entry of default |
Court orders entry; an appeared party receives the specified three-day written application notice |
| Shortened time |
Sworn written waiver plus a court good-cause order supported as the rule requires |
| Responsive pleading filed but no trial participation |
An uncontested trial, not a Rule 55 default hearing |
| Default judgment |
Separate Rule 55(b) requirements; entry of default alone is not the judgment |
[C035–C037.] No waiver, failure, appearance, or default is found. Idaho Supreme Court
5.2 Sum certain and other cases
| Branch |
Complete material conditions |
| Rule 55(b)(1) sum certain |
Court request; amount/computation affidavit; original claim instrument unless court permits otherwise; nonappearance default; neither minor nor incompetent; qualifying personal service |
| Express service exclusion |
The sum-certain paragraph excludes publication and personal service outside Idaho |
| Other cases |
Application to court; possible accounting, damage, allegation-truth, or other evidentiary hearing |
| Appeared party |
At least three days’ written notice of the default-judgment application before hearing |
| Minor/incompetent person |
Appeared guardian, conservator, or like fiduciary required for the stated judgment branch |
| State or governmental defendant |
Claim/right to relief established by evidence satisfactory to the court |
| Judgment notice information |
Required name/address certification, used by the clerk for notice |
[C038–C041.] Out-of-state service may have statutory jurisdictional effect without satisfying Rule 55(b)(1)’s narrower procedural shortcut. Neither an alleged sum nor absence of an answer validates unlawful charges. Idaho Supreme Court
5.3 Relief demanded, fees, judgment form, and notice
Rule 54(c) prohibits a default judgment that differs in kind from or exceeds the pleaded demand. Rule 54(e) requires an independent contractual/statutory attorney-fee basis, prohibits § 12-121 fees on default, and imposes its pleaded-amount and specified § 12-120 ceiling conditions.
The underlying fee statutes were not completely read; no fee entitlement, rate, cost schedule, or award is determined. [C040.] Idaho Supreme Court
Rule 54(a) requires the separate judgment/decree document and distinguishes final disposition of all claims/parties from an express partial-final certification. Rule 58 gives entry its legal effect; costs taxation does not postpone entry.
Rule 2.3 requires clerk notice after entry. Its lack-of-notice clause has the specific no recorded mailing and no actual notice exception. It is not a universal reopening period. [C042.] Idaho Supreme Court+2
No execution authority, appeal deadline, judgment interest, lien, or enforcement permission follows from this initial-finality discussion.
6. Set-aside and protected-party interfaces
6.1 Idaho default and final-judgment relief
| Route |
Governing condition |
Limit |
| Entry of default |
Rule 55(c): good cause |
Not the same test as relief from final judgment |
| Clerical error |
Rule 60(a): clerical mistake, oversight, or omission |
Pending docketed appeal requires appellate leave |
| Rule 60(b)(1) |
Mistake, inadvertence, surprise, excusable neglect |
Reasonable time and six-month outer limit |
| Rule 60(b)(2) |
Newly discovered evidence meeting the diligence/Rule 59(b) relation |
Same timing; not any later evidence |
| Rule 60(b)(3) |
Opposing-party fraud, misrepresentation, misconduct |
Same timing |
| Rule 60(b)(4) |
Void judgment |
Not every procedural error is voidness; construction held |
| Rule 60(b)(5) |
Satisfaction/release/discharge, reversed or vacated predicate judgment, or inequitable prospective application |
Not a declaration that the debt is discharged |
| Rule 60(b)(6) |
Other reason justifying relief |
No actual qualifying reason found |
| Rule 60(d) |
Independent action; specified one-year nonpersonal-service/no-appearance branch; fraud on the court |
Each is distinct from the six-month branches |
[C043–C046.] The rule’s reasonable-time text and ground-specific limits are retained. No blanket conclusion about discretion or timing for every allegedly void judgment is made. A Rule 60 motion does not itself suspend the judgment. Idaho Supreme Court
Rule 11.2(b)(2) bars a motion for reconsideration of the specified Rule 55(c), 60(a), and 60(b) orders. Rule 61 separately addresses errors not affecting substantial rights. Neither supplies an actual harmless-error or appellate result. [C047.] Idaho Supreme Court+1
6.2 Narrow federal military-default rule
The complete 50 U.S.C. § 3931 and material definitions/application clauses were read from official OLRC publications. This is not a full SCRA report.
| Issue |
Conditional federal rule |
| Scope |
Civil proceeding in which the defendant does not appear |
| Before plaintiff’s judgment |
Required supported military-status affidavit, inability-to-determine statement, or authorized perjury declaration |
| Military service appears |
Attorney appointment required before judgment; an appointed attorney unable to locate the person does not thereby waive defenses or bind the person |
| Status remains uncertain |
Court may require the statutory indemnity bond; amount is court-approved, not fixed here |
| Default stay |
At least ninety days when the statutory counsel/contact or defense predicates are found |
| Reopening |
Judgment during service or within sixty days after release/termination; application within ninety days after that event; material effect on defense and meritorious/legal defense |
| Purchaser protection |
The specified bona fide purchaser-for-value protection survives the described vacatur |
| Actual-notice stay |
§ 3932 is separately referenced; its complete operative branch was not analyzed |
[C048–C051.] No military-status database, actual status, affidavit, counsel appointment, bond, or eligibility determination was made. U.S. Code
Definitions and waiver limits
The read definitions distinguish armed-forces active duty, the specified federally funded National Guard orders exceeding thirty consecutive days, qualifying uniformed-service categories, and protected periods. “Military service” is not inferred from occupation or affiliation.
Sections 3917–3918 contain pre-service-order and waiver qualifications. A state procedural admission or sworn shortening waiver is not automatically a valid federal waiver. The separate-instrument and timing conditions apply to § 3918’s listed actions; a written contract-related waiver has its twelve-point requirement. [C048, C052.] U.S. Code+4
The original Act’s application note was actually read: the 2003 amendment applies to cases not final before December 19, 2003. Displayed later source credits were recorded, but no complete historical federal session-law audit was performed. [C054.] U.S. Code
Other SCRA branches, allied-service and secondary-liability extensions, state military incorporation, full induction law, and bankruptcy remain held.

14.3 Remaining gaps
The most consequential unresolved matters are:
- Final official 2026 venue text and its transition/application construction.
- Current official Idaho statutory bodies and complete material amendment chains.
- Original court adoption/amendment orders beyond displayed footers.
- Actual assignment orders and approved local procedural rules.
- Constitutional sufficiency of service and personal jurisdiction.
- Substantive debt ownership, capacity, instrument status, claim validity, and admissible proof.
- Standalone Appendix B forms, verification incorporations, attorney withdrawal, full fee statutes, and complete appellate/stay law.
- Remaining military, bankruptcy, federal collection/reporting, tribal, interstate, and special-proceeding regimes.
No actual or invented person, entity, creditor, debtor, account, agreement, address, service event, pleading, military status, disability, amount, date, case, or transaction was supplied or constructed. No filing, service, response, waiver, default application, set-aside motion, payment, enforcement, or calendar determination was prepared or performed.
This is a researcher self-check, not independent review. The initial ordinary debt-court component is supported by newly read official court rules and narrowly read federal authority, but remains conditional at the exact statutory, historical, incorporation, and construction gaps identified above. Earlier findings and holds remain preserved. No Idaho, dimension4, A066, parent, operational, or publication acceptance follows.
