Scope: The wages portion of registry dimension 5. This pass addresses generic earnings restrictions, the materially related Idaho exemption, continuing-writ mechanics, and the procedure for asserting an exemption. It does not determine an actual withholding amount, deadline, employer duty in a particular proceeding, or entitlement to an exemption.
Preservation: Earlier reports and their holds remain unchanged. P5 and P6 were not used as substantive foundations. C033 and C035 are not resolved by this pass. The newly encountered Idaho-source limitations below are separate P7 observations.
The official Idaho section routes attempted for the ordinary cap, the chapter 7 cap, and the unpaid-earnings exemption did not produce readable statutory bodies. Consequently, the Idaho statutory findings are provisional readings of the identified 2025 reproductions, not authenticated official current 2026 text. Official Idaho court-rule text, official generic court forms, federal statutory text, federal regulations, and original federal enactment text were recovered.
The most important additional Idaho exemption found is not a flat paycheck allowance: reproduced § 11-605(11) protects qualifying earned-but-unpaid compensation up to $2,500 in a calendar year, subject to chapter 6’s qualifications. It expressly preserves the operation of § 11-207. Its interaction with the percentage/floor restriction must not be replaced by an invented stacking formula. [C014–C017.] Justia Law+1
The reproduced Idaho definitions and the federal CCPA distinguish earnings from disposable earnings:
| Term | Meaning established by the read text | Boundary |
|---|---|---|
| Earnings | Compensation paid or payable for personal services, including wages, salary, commissions, bonuses, and periodic pension or retirement payments | The statutory label is broader than a regular hourly paycheck. Whether a particular payment is compensation for personal services remains a classification question. |
| Disposable earnings | Earnings remaining after amounts required by law to be withheld | This is not automatically gross wages or take-home pay. |
| Wage garnishment | A legal or equitable procedure requiring earnings to be withheld to pay a debt | A voluntary wage assignment is not automatically the same procedure. |
| Chapter 7 garnishment | The statutory judicial process directed at a third party owing or holding property of the judgment debtor | The garnishee’s role and the relevant property must be established. |
| Continuing wage garnishment | The chapter 7 mechanism reaching future employment money under the statutory conditions | Its duration is not simply the deadline for the sheriff’s return. |
The Idaho chapter 7 definition expressly excludes an Idaho income-tax refund from “earnings.” That exclusion does not decide whether the refund is otherwise reachable or exempt; that separate property branch is outside this pass. [C002–C004; S002–S003, S012.] Justia Law+2
The DOL’s generic instructions distinguish legally required deductions from voluntary deductions such as union dues, insurance premiums, charitable contributions, and voluntary retirement contributions. The instructions explain the statutory base; they do not authorize treating every payroll deduction as legally mandatory. [C003; S017.] DOL Web Apps
| Money or property state | Treatment in this pass |
|---|---|
| Compensation still owed by the employer | Directly relevant to wage garnishment and the earned-but-unpaid exemption |
| Compensation paid or payable within the earnings definition | Relevant to the statutory earnings restriction, but does not alone settle post-payment tracing |
| Money already deposited in a bank account | Bank levy, tracing, and benefit-protection questions remain excluded |
| Periodic pension or retirement payments | Included in the earnings definition; separate pension exemptions are not completed here |
| Income-tax refund | Expressly excluded from chapter 7 “earnings”; its separate collection rules are not applied |
| Employer’s administrative charge | A separate statutory charge from remitted money, not an addition to the disposable-earnings base |
| Provider fees, trust-account money, or homestead value | Not wage-withholding allowances and not imported into these formulas |
No conclusion about a bank balance follows merely because its original source was wages. [C004, C017, C042.]
The ordinary federal ceiling and the reproduced Idaho ceilings use the lesser of a percentage and a residual-income test. They operate on aggregate disposable earnings, not a fresh percentage for each creditor or writ. [C005; S002 § 11-207, S003 § 11-712, S012 § 1673(a).] Justia Law+2
Let:
For one workweek, the nonnegative expression of the source-stated relation is:
G≤min(0.25D, max(0, D−30M))G \leq \min\left(0.25D,\ \max(0,\ D-30M)\right)G≤min(0.25D, max(0, D−30M))This is a ceiling, not an instruction to withhold that amount. It does not establish the validity of a writ, the remaining judgment balance, priority, an applicable additional exemption, or a particular employer’s jurisdictional obligation.
The retrieved official § 206(a)(1) states $7.25 per hour as the final step of the enacted federal schedule. The original 2007 amendment was also read at Public Law 110-28, § 8102, 121 Stat. 188. Thus, the reference was verified from statutory text and original enactment—not only an FAQ. [C006; S015–S016.] US Code+1
The wage-garnishment provisions incorporate that federal subsection. They do not direct substitution of a higher state minimum wage, an individual’s contractual wage, a tipped cash wage, or a CPI-adjusted figure. No separate Idaho indexing provision was established in the relevant text.
| Pay period | Federal relation established | Limitation |
|---|---|---|
| One workweek or less | Full 30M30M30M protected floor; ordinary percentage remains 25% | The federal regulation does not prorate the floor downward merely because the period is shorter than a week. |
| More than one workweek | Multiply 30M30M30M by the number of workweeks or fractions compensated; apply 25% to aggregate disposable earnings for that period | Actual pay-period classification is required. |
| Two-week period | Symbolically, floor =60M=60M=60M | No paycheck amount is calculated. |
| Calendar month | Regulation treats a month as 4134\frac13431 workweeks; symbolically, floor =130M=130M=130M | This is a regulatory conversion, not an assumed four-week month. |
| Semimonthly period | The federal schedule supports the corresponding 65M65M65M floor | Do not confuse semimonthly with biweekly. |
| Other or irregular period | The regulation requires a consistent equivalent calculation | The actual period, allocation of compensation, and any rounding question remain unresolved. |
Federal authority: 29 C.F.R. § 870.10(b)–(c). Its printed numerical examples use historical minimum wages and are not current dollar thresholds. [C007.] eCFR
The Idaho statutes direct the labor authority to prescribe an equivalent nonweekly multiple. This pass did not recover the actual Idaho rule adopting that conversion. The federal conversion is verified; an Idaho court-form chart is supporting instruction, not proof of the state rule’s adoption. [C008.]
| Category | Federal CCPA | Provisional Idaho text | Remaining limitation |
|---|---|---|---|
| Ordinary civil judgment wage garnishment | Lesser-of formula under § 1673(a) | Same principal formula in §§ 11-207 and 11-712 | Actual process, priority, and additional exemptions remain necessary |
| Regulated consumer-credit judgment | General federal ceiling still applies | § 28-45-104 separately repeats the ceiling for its defined regulated consumer-credit sale/loan branch | Consumer-purpose, regulated-transaction, exclusion, and territorial predicates must be satisfied |
| Support order | Separate 50%/60%, conditionally 55%/65%, limits | Parallel percentages in §§ 11-207 and 11-712 | Full support-withholding law and competing-support allocation are not completed |
| State or federal tax debt | Ordinary § 1673(a) ceiling excepted | Tax exception appears in the reproduced state cap | Exception is not authority for unlimited withholding; the tax regime is held |
| Chapter 13 bankruptcy order | Ordinary federal ceiling excepted by the modern Chapter 13 clause | Reproduced state text retains the older “chapter XIII of the Bankruptcy Act” terminology | No silent rewriting of Idaho text; bankruptcy-order law is not completed |
| Federal administrative debt collection | May involve a separate federal statute | Not determined by the ordinary Idaho writ provisions alone | Administrative garnishment/offset regimes remain held |
| State as wage payer/garnishee | Federal earnings protection remains relevant | § 11-718 supplies a special state-controller service/answer branch | State-as-garnishee is not the same as State-as-tax-creditor |
| Earnings already paid into an account | Not resolved solely by Title III’s definition | Separate tracing/property provisions may matter | Excluded from this wages pass |
Sources: S002–S005, S012, S014. Justia Law+3
The support ceiling is:
The higher percentage is not triggered merely by the word “arrears,” nor does it necessarily apply to every dollar withheld under a mixed current-support/arrears order. Federal law includes qualifying state administrative support procedures with substantial due process and judicial review; the reproduced Idaho cap’s court-order wording must not be expanded without the separate support authority. [C009–C010.] US Code+1
Federal regulations do not establish priority among competing garnishments. Other applicable law does. A priority withholding can consume the amount otherwise available under the ordinary ceiling; the ordinary percentage is not automatically added on top of a support withholding. [C011; S014 §§ 870.1, 870.11.] ecfr.gov
Idaho’s reproduced continuing-writ provision addresses the sequence of writs presented to the sheriff and restricts service of an additional wage garnishment while the existing garnishment is taking the maximum. It expressly accounts for the existing garnishment being satisfied or the amount withheld falling below the maximum. That is not a complete priority code for support, taxes, bankruptcy, federal administrative orders, or multiple employers. [C024–C025; S003 § 11-704.] Justia Law
15 U.S.C. § 1677 preserves state laws that prohibit garnishment, impose a lower garnishment limit, or provide broader protection against discharge for multiple indebtednesses. It does not give a person an unrestricted choice of the most favorable jurisdiction’s law. [C012.] US Code
A state’s similar statute does not automatically exempt it from federal administration. Section 1675 provides a federal regulatory exemption process. The current § 870.57 body read lists Virginia; it does not list Idaho. No Idaho exemption from Title III was established. [C012; S012, S014.]
Federal § 1674 prohibits discharge because earnings have been subjected to garnishment for one indebtedness. Multiple writs concerning one indebtedness are not necessarily multiple indebtednesses. The statutory limitation is not affirmative permission to discharge an employee whenever more than one debt exists. [C013.] US Code+1
The reproduced Idaho Consumer Credit Code provision, § 28-45-105, prohibits discharge because a creditor has subjected or attempted to subject unpaid earnings to garnishment to enforce a judgment arising from the specified regulated consumer-credit sale or loan. Its text does not contain the federal one-indebtedness limitation. Its additional protection remains conditional on that statute’s scope. [C019.] Justia Law
Section 11-605(11) addresses disposable earnings, wages, salaries, and compensation for personal services that have been earned but have not been paid, up to $2,500 in a calendar year. It states that this exemption does not affect the application or operation of § 11-207. [C014.] Justia Law
That wording does not establish:
The annual usage, whether compensation remains unpaid, the applicable claim category, and the governing chapter 6 law must be established before an amount could be determined. No such facts are supplied here.
Chapter 6 defines “individual” as a natural person rather than a corporation. Section 11-602 gives Idaho residents the chapter’s exemptions and directs nonresidents to the exemption law of their jurisdiction of residence. Its residence definition concerns intent to maintain a home in Idaho. This chapter-specific rule is not silently transferred to every general wage cap. [C015.] Justia Law+1
Section 11-607 materially qualifies chapter 6 exemptions:
| Exception category | Why it matters to the unpaid-earnings branch |
|---|---|
| Alimony, support, or maintenance | Chapter 6 exemption may not operate against the claim in the ordinary way |
| A claim for an employee’s unpaid earnings, within the stated one-month/full-time-equivalent limit | This describes the creditor’s wage claim, not an extra month of wages protected for the judgment debtor |
| State or local taxes | Separate from the federal ordinary-cap tax exception and from general public debts |
| Specified criminal, intentional-injury, motor-vehicle-conviction, false-pretense, or intentionally false written financial-condition claims | Exact statutory elements matter; no actual claim is classified |
| Dwelling rent, food, and lodging | An exception to chapter 6 protection does not itself eliminate the federal CCPA ceiling |
| Purchase-price/purchase-money and specified property-work claims | Property-specific conditions must be met |
| Existing statutory liens or security interests | The section preserves their stated treatment; full secured-rights analysis remains excluded |
The special § 11-603 property and child-support-enforcement incorporations were not completed because they concern separate property/benefit branches. No conclusion is made about those assets. [C016–C017.] Justia Law
The reproduced § 11-605 history identifies 2020 chapter 232, § 1. A mirror of 2020 H0464, introduced version, was recovered and visually inspected. Its amendment markup changes the unpaid-earnings amount from $1,500 to $2,500. Its § 3 contains passage-and-approval effectiveness language and a bankruptcy-petition application clause.
The official Governor’s final action table records H0464 as signed on March 23, 2020. However, the official enrolled/session-law body was not recovered. Thus:
[C018; S010–S011.] LegiScan+2
The reproduced § 28-45-104 is not an independent universal garnishment statute. Its defined judgment categories depend on the Idaho Consumer Credit Code.
The necessary definitions read distinguish regulated credit sales and loans from regulated consumer credit sales and loans. The consumer-purpose definition concerns primarily personal, family, or household purposes and contains exclusions, including the identified agricultural, investment, first-mortgage, and organizational branches. Regular-credit activity, installment/finance-charge elements, credit-card distinctions, and the exclusions in § 28-41-202 also matter. [C020; S005.] Justia Law+1
Section 28-41-201(3) makes the creditors’-remedies part applicable to actions or proceedings brought in Idaho to enforce the described regulated credit rights, wherever the transaction was made. Other subsections address transaction location, residence, solicitation, physical presence elsewhere, and choice-of-law agreements. None establishes a universal rule based only on where an employer has an office or where a paycheck is issued. [C021.] Justia Law
Held: Actual residence, forum jurisdiction, work location, employer contacts, transaction classification, and any interstate enforcement mechanism. No favorable-law election or actual employer obligation is inferred.
All Idaho statutory steps in this section are provisional 2025 readings. The court-rule provisions are official current-published text.
Official Rule 69 distinguishes an enforceable money judgment/order from the execution process. It generally uses a writ of execution unless the court directs otherwise. Amounts beyond the face of the judgment and approved additions require the rule’s verified computation support. This pass does not reopen judgment finality or renewal law. [C022; S006.] Idaho Supreme Court
| Stage | Responsible actor and required legal instrument | Source |
|---|---|---|
| Continuing wage writ | Creditor applies to the court; clerk issues the statutory writ directing future employment money to the sheriff | § 11-704 |
| Service package | Creditor/attorney gives written instructions and the required writ, attachment/garnishment notice, exemption notice, instructions, and claim form | §§ 11-703, 11-706–708 |
| Copies and mailing materials | Creditor supplies sufficient copies, addressed envelopes, and postage; sheriff must not delay solely for missing copies/postage and may recover the stated actual costs | § 11-706 |
| Standard forms | Supreme Court prescribed or substantially compliant forms; statutory English/Spanish availability requirement | § 11-707; Rule 69.1 |
| Interrogatories | Written interrogatories accompany the writ/notice as prescribed | § 11-708 |
[C023, C027.] The exact current official interrogatory/answer instrument was not independently recovered; the statutory duty was read. Justia Law+3
Section 11-703 identifies the garnishee recipients, including the specified corporate officers/agents and municipal/public officers. Section 11-706 incorporates summons service and permits the sheriff’s stated mail alternatives:
Under the stated statutory rule, depositing an item in U.S. mail establishes mailing. Service through those alternatives occurs when the garnishee signs the return receipt or sends the acknowledgment. First-class mailing alone is not treated as completed garnishee service under that alternative. [C028.] Justia Law
Rule 4’s recipient and service provisions were read. Its general allowance for service by an officer or a nonparty over eighteen does not erase statutes assigning a particular garnishment act to the sheriff. Out-of-state service and jurisdictional predicates remain separate. [C029; S006.] Idaho Supreme Court
Within two business days after service under § 11-703, the sheriff must hand-deliver or mail the required documents to the judgment debtor and identified third-party claimant using the statutory address arrangement. The exception is the garnishee’s written statement at service that it owes no debt and holds no property subject to the process. [C030; S003 § 11-709.] Justia Law
This notice clock is not:
| Provision | Source-stated duty or consequence | Qualification |
|---|---|---|
| § 11-719 | Answer under oath, filed in the action within five days after service | The text says days, not business days; applicable counting rules remain material |
| Failure to answer | Creditor may seek default or an order compelling an answer | Not an automatic liability determination |
| Judgment against garnishee | Subject to the stated underlying-final-judgment, liability-amount, and maturity limits | No execution before the garnishee’s debt is due under the stated condition |
| § 11-715 | Garnishee holding property or owing debt at service remains subject to the stated liability unless it delivers or pays as authorized, or the process is released/satisfied | Earnings exemptions still constrain what is reachable |
| § 11-716 | Payment to the sheriff discharges the garnishee’s corresponding obligation to the debtor to the extent paid | Sheriff holds subject to the governing court process |
[C031–C032.] Justia Law+2
A continuing wage garnishment reaches future employment money until the statutory satisfaction/release condition is met. The creditor is assigned responsibility against overcollection. The maximum and sequential-writ provisions must be respected. [C024–C025.]
The following are return/reporting periods, not ordinary paycheck exemptions or automatic writ-expiration dates:
| Proceeding | Sheriff’s return relation |
|---|---|
| General execution under § 11-702 | Return within the stated 10–90 days after sheriff receipt, subject to § 11-705 |
| Ordinary continuing wage garnishment | Interim returns no more than 14 days apart when at least $100 was collected in the relevant fourteen-day period; in all events, no more than 60 days apart |
| Specified delinquent-support continuing garnishment | Parallel 14-day/$50 threshold; in all events, no more than 30 days apart |
| Support withholding continuation | Each succeeding disbursement interval until the specified sheriff release or satisfaction of the stated writ amount |
The official blank continuing-writ form says return within ninety days while separately directing continuation until payment. Those are not contradictory statements that authorize treating every continuing writ as expiring after ninety days. [C026.] Justia Law+2
Section 11-728 permits the employer’s stated one-time charge of no more than $10, associated with the first answer and deducted from money remitted to the sheriff. It does not establish an additional $10 levy against otherwise protected earnings. [C033.] Justia Law
Section 11-718(1) is a special branch for debts owed by the State, excluding the stated elective-official category. It uses service by the sheriff of the debtor’s Idaho county of residence upon the state controller, duplicate documents, a $10 fee collected from the officer, and a thirty-day answer period. Exemptions remain preserved. The separate tax-refund subsections were read to distinguish scope but are not applied here. [C034.] Justia Law
The following table consolidates the reproduced § 11-203 procedure. It is not a filing instruction or actual deadline calculation.
| Step | Actor | Required act | Trigger and period |
|---|---|---|---|
| Claim | Judgment debtor or representative; qualifying third-party claimant | Complete and deliver or mail the claim to the sheriff | Within 14 days after the sheriff hand-delivers or mails the statutory notice documents |
| Mailed claim | Claimant | Ensure the claim reaches the sheriff | The statute requires receipt within the same fourteen-day period; timely dispatch alone is insufficient |
| Copy to creditor | Sheriff | Deliver/mail the claim copy, with the stated phone-plus-copy option | Within one business day after receipt of the claim |
| Contest | Judgment creditor | File a motion stating grounds and lodge the claim with the court | Within five business days after the sheriff delivers or mails the claim copy |
| Hearing | Court/process specified by statute | Set the hearing | Not fewer than five nor more than twelve days after filing the contest motion |
| Notice of contest/hearing | Creditor | Mail or deliver motion and hearing notice to claimant | Same date the motion is filed |
| Notice to sheriff | Creditor | Notify sheriff, with the stated written-confirmation requirements | Within the contest period |
| Continuance | Court | Continue hearing | The statute permits the identified continuance only at the debtor’s request |
[C035–C038; S002 § 11-203(a)–(b).] The generic official packet confirms the claim-arrival requirement and the hearing interval, but the statutory dispatch/receipt distinctions are more precise than shorthand such as “after the creditor is notified.” Justia Law+1
The sheriff generally must not sell or deliver the property to the creditor before the claim period expires, subject to the stated perishable-property exception. An uncontested claim—or failure to give the sheriff timely notice of the contest—produces the statutory release consequence for the claimed property. Late claims are refused unless the court orders otherwise. [C039.]
The same section also preserves:
[C040.] The historical 2017 bill text was inspected for these procedural changes; it remains an introduced bill mirror, not current official codification. LegiScan+2
Section 11-711 permits facts showing that the property or debt is exempt or otherwise not liable to the judgment creditor’s claim. If contested, the issue is tried with garnishee liability. The generic instructions require a reasonable, good-faith basis and supporting documents, but this pass did not establish a universal evidentiary standard or burden-allocation rule for every exemption. [C041.] Justia Law+1
The statute permits a prevailing party’s costs under the civil rules. The packet separately warns of possible court costs and attorney fees for a claim lacking reasonable basis and good faith. Neither is converted here into automatic fee shifting, a fixed sanction, or an adjudication of a claimant’s conduct.
The exemption instrument is not a substitute for attacking the underlying debt or judgment’s validity. That distinction does not narrow the statutory ability to show that particular property is not liable.
The federal regulation expressly says Title III’s restriction need not be raised as an affirmative defense. Idaho’s exemption-claim process therefore must not be paraphrased as permission to violate the federal ceiling whenever a claim form is late or absent. The state claim process, federal restriction, and possible later remedies are distinct questions. [C043; S014 § 870.51(c).] ecfr.gov
| Rule | Effect established | What is not inferred |
|---|---|---|
| § 11-203(a) | Exclude triggering day; include intervening weekends/holidays; extend a last day falling on weekend/holiday to the stated next business-day close | No actual date calculated |
| § 11-203(g) | Prescribed personal service or first-class mailing; mailing means U.S.-mail deposit; trigger day excluded | “Mailing” is not automatically actual receipt |
| § 11-706 | Distinguishes mailing from acknowledged service; supplies last-day rule | Its extension provision expressly does not enlarge the specified hearing-setting period |
| Rule 2.2 | General computation where applicable; clerk-inaccessibility rules; limited extra time after service by mail | Three mail days are not automatically added to § 11-203’s specific claim-arrival or dispatch-triggered periods |
| Rule 4 | Governs incorporated summons-service methods and recipients | Does not by itself establish jurisdiction over every out-of-state employer |

The federal ordinary ceiling, its reference wage, nonweekly conversion, support qualifications, greater-state-protection clause, and one-indebtedness employment protection were read from the relevant public legal texts. The original minimum-wage amendment and original CCPA enactment were also inspected.
The Idaho analysis remains conditional because the current official statutory bodies were not recovered. The principal additional gaps are:
No actual withholding decision, filing deadline, residence finding, consumer-credit classification, employer liability, default, exemption entitlement, or discharge-from-employment outcome was made. No actual or fictional identifying party, payroll, account, completed form, contract, case, docket, or private employer policy was investigated.
This is a researcher self-check, not independent review. The wages component is materially researched but remains partial and conditional at the exact source and legal dependencies identified above. No Idaho, A066, parent, operational, or publication acceptance is implied.

| One workweek or less | Full 30 𝑀 30M protected floor; ordinary percentage remains 25% | The federal regulation does not prorate the floor downward merely because the period is shorter than a week. |
| More than one workweek | Multiply 30 𝑀 30M by the number of workweeks or fractions compensated; apply 25% to aggregate disposable earnings for that period | Actual pay-period classification is required. |
| Two-week period | Symbolically, floor = 60 𝑀 =60M | No paycheck amount is calculated. |
| Calendar month | Regulation treats a month as 4 1 3 4 3 1 workweeks; symbolically, floor = 130 𝑀 =130M | This is a regulatory conversion, not an assumed four-week month. |
| Semimonthly period | The federal schedule supports the corresponding 65 𝑀 65M floor | Do not confuse semimonthly with biweekly. |
| Other or irregular period | The regulation requires a consistent equivalent calculation | The actual period, allocation of compensation, and any rounding question remain unresolved. |
