S_ID PASS-08 — Idaho bank-account garnishment, protected benefit deposits, and exemption-claim boundaries
Fresh public-source access date: October 28, 2026, America/Los_Angeles.
Component: The bank/deposit-account and protected-benefit portion of registry dimension 5.
Evidence disposition: Official federal regulatory and statutory bodies, official Idaho court-rule text, and an official generic exemption packet were recovered. The relevant official Idaho statutory routes attempted in this pass remained inaccessible. Idaho statutory findings below are therefore provisional readings of the identified 2025 reproductions, not authenticated official current 2026 law.
Earlier reports, raw findings, provenance, C033/C035, and other holds remain unchanged. P6 and P7 were not used as substantive foundations. No actual or invented account, depositor, bank, creditor, payment, writ, transaction, or filing date is evaluated.
Principal findings
Three protections must be kept separate: the bank’s preliminary statutory review, the substantive exemption attaching to particular funds, and the judicial procedure for claiming or contesting additional protection. Neither a bank’s review nor the account’s title resolves every ownership or exemption question. [C002, C018–C020, C029–C034.] Justia Law+2
Idaho’s reproduced bank-review provision and the federal rule are not identical. Idaho § 11-714 uses a two-month period preceding service and deems the opening balance exempt solely for that review. Federal Part 212 uses a two-month lookback tied to account review, identifies encoded payments from four federal benefit agencies, and protects the lesser of the qualifying payment total and the balance when the review is performed. No combined formula or automatic “choose the larger amount” instruction is established here. [C018–C020, C027–C030.] Justia Law+2
Federal automated protection does not require an exemption claim. A properly calculated protected amount must remain fully available, while additional money may still be exempt under federal or state law. Failure to detect a qualifying electronic deposit does not adjudicate that all remaining money is nonexempt. [C030, C034.] eCFR+1
The Idaho claim clock is not the bank’s notice clock. The reproduced claim provision measures its fourteen-day period from the sheriff’s delivery or mailing of the required documents; a mailed claim must arrive at the sheriff within that period. The bank’s state notice and its conditional federal benefit-review notice have different triggers and recipients. [C042–C047.] Justia Law+2
1. Legal categories, roles, and authority levels
Throughout this report:
- P — Provisional: Idaho statutory wording read in the 2025 secondary reproduction.
- O — Official body read: official court rule, federal statutory publication, or original federal regulatory publication.
- E — eCFR: authoritative but unofficial, with its displayed currency preserved.
- H — Held: indispensable factual, incorporated-law, currentness, or construction dependency remains unresolved.
1.1 Different proceedings and legal objects
| Category |
Supported rule |
What it does not establish |
| Postjudgment execution/garnishment |
Official Rule 69 provides the execution framework for an enforceable money judgment or order; Idaho chapter 7 supplies the garnishment process. |
The existence, validity, amount, jurisdictional reach, or priority of any particular judgment or writ. |
| Prejudgment attachment |
Title 8, chapter 5 supplies separate eligibility, affidavit, notice/hearing, undertaking, and limited prehearing procedures. |
That a creditor may freeze any account merely by alleging a debt. |
| Bank as garnishee |
The statutory role concerns a third party owing a debt to, or holding property of, the judgment debtor. |
That every account bearing a name is entirely that person’s beneficial property. |
| Deposit interest |
The process can concern a debt owed by the institution or property held for the debtor, subject to exemptions and claims. |
Available balance, ownership shares, contractual setoff rights, or the effect of another person’s interest. |
| Setoff |
Part 212 regulates responses to garnishment orders and preserves only account terms consistent with the rule. |
A general bank right to set off protected benefits. Setoff law remains a separate held inquiry. |
| Joint or third-party interest |
Idaho provides notice and a third-party claim mechanism; federal review occurs despite a co-owner. |
A conclusive division of ownership or a rule that every co-owner’s money is liable. |
| Federal protected amount |
A qualifying Part 212 calculation creates automatic protection under the rule. |
The final nonexempt status of the amount above it. |
| Substantive benefit exemption |
The underlying benefit statute may protect paid or payable money beyond the automated review. |
That every payment carrying a government or retirement label satisfies that statute. |

1.2 Prejudgment attachment is not ordinary postjudgment collection
The reproduced § 8-501 identifies limited attachment categories, including the stated unsecured—or valueless-security—contract/judgment branch and the nonresident branch. Section 8-502 requires an application and supporting affidavit, including the amount above legal setoffs or counterclaims and the applicable security facts. The ordinary show-cause hearing may not be set sooner than five days after issuance of the order. [C003–C004.]
A prehearing writ requires the stated probable-cause predicate. The bank-account branch requires specific facts showing threatened imminent withdrawal and limits the levy to the specified property. It is not a universal account-freeze exception. The statute also provides a request for an earlier hearing with at least forty-eight hours’ notice to the plaintiff. Sections 8-503 and 8-506C contain undertaking and release mechanisms; they are not replaced by the ordinary exemption form. [C004–C005.] Justia Law+3
Sections 8-507 and 8-527 connect attachment to chapter 7 and the § 11-203 exemption/third-party procedure, subject to consistency. Official Rule 64 does not independently create attachment authority; it makes the remedies available under the governing law and circumstances. [C005.] Justia Law+2
2. Idaho protected-money categories
2.1 Deposit preservation is fund-specific
The complete reproduced § 11-713 was read. Its categories preserve protection for qualifying deposited funds; they do not automatically exempt an entire mixed account.
| Category |
Reproduced Idaho rule |
Qualification or hold |
| Disability, illness, support, injury, death-related money |
§ 11-713(1) preserves money exempt under § 11-604(1) when deposited. |
Section 11-604’s reasonably-necessary-for-support qualification remains material. |
| Wages already exempt from execution |
§ 11-713(2) preserves the exemption after deposit. |
It states that the subsection does not apply to an accumulation of wages greater than $7,500. It does not itself supply a payroll formula or resolve every over-threshold consequence. |
| Social Security, SSI, veterans’ benefits and public assistance |
§ 11-713(3) preserves the listed federal/state exemptions when deposited. |
Underlying statutory coverage and exceptions remain controlling. |
| Medical savings accounts and medical benefits |
The listed § 11-603 categories are preserved. |
The incorporated medical-savings-account qualification was not completed. |
| Child-support deposits by the Idaho agency |
Expressly included in § 11-713(3). |
No actual source, ownership, or payment classification is established. |
| Unemployment benefits |
Included through §§ 11-603, 11-713 and 72-1375. |
The older segregation wording and newer commingling provision require reconciliation, discussed below. |
| Retirement and pension benefits |
Qualifying § 11-604A funds remain exempt on deposit. |
Plan qualification, federal exceptions, support orders, and other incorporated requirements remain material. |
| Workers’ compensation |
Qualifying § 72-802 benefits remain exempt on deposit. |
The stated support exception and compensation-program predicates remain. |
[C009–C015; S002–S004.] Justia Law+3
The phrase preserving the listed benefits “without limitation” on deposit is not treated as eliminating the qualifications of the underlying exemption or exempting unrelated nonexempt deposits.
2.2 Residence and individual status
Chapter 6 defines an individual as a natural person rather than a corporation. Section 11-602 provides chapter 6 exemptions to Idaho residents and directs nonresidents to the exemption law of their residence. Its residence definition concerns intent to maintain a home in Idaho. [C008.] Justia Law+1
This is not a complete choice-of-law ruling for every account or garnishment. Account location, forum jurisdiction, institutional contacts, beneficial ownership, and federal protections require their own analysis.
2.3 Support-necessary categories under § 11-604
The reproduced provision protects the identified disability/illness, support, injury, wrongful-death and insurance-related interests to the extent reasonably necessary for support. Its court-determination paragraph directs attention to present and anticipated needs, responsibilities, and income and property, including other exempt property. [C010.] Justia Law
Thus, “disability deposit” or “settlement proceeds” is not by itself a completed exemption determination. No personal circumstances or judicial valuation are supplied.
2.4 Pension and retirement qualifications
Section 11-604A contains several distinct provisions: specified United States government pension protection, employee-benefit-plan rights and payments, defined plan categories, support-order and federal-law qualifications, and community-property language. The text does not make an account exempt merely because it is marketed as retirement savings. [C011.] Justia Law
The incorporated Internal Revenue Code plan definitions and all federal exceptions were not completed. Actual plan qualification and special support/property-division treatment remain held.
2.5 Workers’ compensation and unemployment
Section 72-802’s reproduced text protects compensation and contains a child-support exception. The out-of-state-compensation provision depends on the specified Idaho-resident circumstances. No compensation eligibility or support determination is made. [C012.] Justia Law
Section 72-1375(3) protects unemployment benefits received while they are not mingled with other funds. Section 11-713(4), however, says the deposit protections in its preceding subsections are not affected by commingling and directs FIFO identification. Both texts were read; neither was silently discarded. [C013, C015.] Justia Law+1
The generic child-support withholding incorporation in § 72-1365(2) was also read, including its agency-plan, order, notice, reimbursement, and other conditions. It does not establish an ordinary private creditor’s bank-garnishment authority. Its additional incorporations remain outside the completed ordinary-levy branch. [C013.] Justia Law
Held: authoritative reconciliation of § 72-1375’s segregation wording with § 11-713’s later deposit/commingling rule. No conclusion that every commingled unemployment dollar is either protected or unprotected follows here.
2.6 Commingling, tracing, and proceeds are different issues
| Issue |
Source-stated rule |
Boundary |
| Commingling under § 11-713 |
Does not defeat the listed subsection (1)–(3) protections |
Identification of the exempt money still matters. |
| Identification within the account |
FIFO accounting is directed by § 11-713(4) |
No tracing sequence, allocation, or balance is constructed. |
| Federal automated review |
Separate review of each account; no interaccount tracing |
This is not a prohibition on every later substantive tracing claim. |
| Exempt-property loss proceeds |
§ 11-606 supplies a distinct three-month proceeds rule and tracing/value qualifications |
It is not a universal three-month expiration for benefit deposits. |
| Joint ownership |
Federal review ignores co-owner presence as a reason to skip review; state law provides third-party notice/claims |
Review does not adjudicate ownership shares. |
| Wage accumulation threshold |
§ 11-713(2) uses the “greater than $7,500” boundary |
No CPI adjustment, per-account multiplication, excess-only rule, or whole-account forfeiture rule is inferred. |
[C007, C014–C016, C029.] Justia Law+2
2.7 Debt-specific Idaho exceptions
Section 11-607 qualifies chapter 6 protection. Its paragraph (1)(a) excludes § 11-603 property from that paragraph’s list of claims, while other paragraphs contain different property-specific and support provisions. Relevant categories include support, specified employee-creditor compensation claims, state/local taxes, identified criminal/fraud-related damages, rent/food/lodging, purchase-price claims, and labor/material claims against the relevant property. Statutory liens and security interests are separately preserved. [C017.] Justia Law
Those state exceptions do not, by themselves, override a federal antiattachment statute. The support, tax, secured-rights, and other special-debt regimes are not completed merely because § 11-607 mentions them.
3. Idaho bank review and federal Part 212 compared
3.1 The reproduced Idaho review
Section 11-714 directs a financial institution with accounts in the debtor’s name to review them before taking action affecting the funds. The review is limited to the two months immediately preceding service. Solely for that review, the balance on the corresponding date two months earlier—or the last date of that month when no corresponding date exists—is deemed exempt. [C018–C019.] Justia Law
The institution determines qualifying direct/electronic deposits from information transmitted by the payor. It has no obligation under that section to investigate the source of paper or other non-electronic deposit items. That limit on the bank’s review duty is not a substantive ruling that such money is nonexempt. [C020.]
A qualifying federal Notice of Right to Garnish Federal Benefits attached to or included in the process triggers the section’s no-review exception. The statutory review-related immunity and correction remedy are read within their expressed scope; they are not treated as eliminating every federal right or unrelated claim. [C021–C022.] Justia Law
3.2 Federal scope and benefit detection
Part 212 applies to the financial institutions and accounts it defines. The account holder is a natural person identified in the institution’s records as a direct or beneficial owner against whom the order is issued. The rule’s definition is an operational predicate for review, not a final property-title adjudication. [C024–C025.] eCFR
For automated detection, a “benefit payment” must be a covered payment from SSA, VA, RRB, or OPM, directly deposited with the specified encoding:
- “XX” in positions 54 and 55 of the Company Entry Description field.
- “2” in the Originator Status Code field of the Batch Header Record.
The rule does not equate every government payment, paper benefit check, transferred balance, private pension, or account label with such an encoded payment. [C024.] eCFR

Source-stated symbolic relation only
Let:
- SSS mean the sum of qualifying benefit payments posted within the regulation’s lookback boundaries.
- BBB mean the account balance when the account review is performed.
- PPP mean the protected amount.
The regulation’s relation is:
P=min(S,B)P=\min(S,B)P=min(S,B)The lookback uses the period bounded chronologically by opening of business on the older endpoint and close of business on the day preceding review, with the corresponding-date/last-date rule. No sixty-day substitution, actual date, balance, deposit sequence, or rounding rule is supplied. [C028.] eCFR
3.4 Review timing and special notice exception
The institution first determines, within two business days after receiving the order and before other affected-funds action, whether it contains the prescribed Notice of Right from the United States or a state child-support enforcement agency. If it does, §§ 212.5–212.6 review procedures do not apply under that branch. [C026.]
Otherwise, account review is due no later than two business days after receipt of both the order and sufficient creditor-supplied identifying information, unless already present. A later batch-processing date requires the stated creditor permission, consistency with the orders, and records. [C027.] eCFR+1
The notice exception is not triggered merely by a governmental creditor’s name or the word “support.” Appendix B specifies an official notice and certification. The underlying federal-debt, restitution, tax, and support authorities cited by that notice were not all completed; their actual applicability remains held.
3.5 Automatic access, subsequent deposits, and fees
When qualifying benefits are detected:
- The institution establishes the protected amount immediately.
- Full customary access must remain available.
- The holder need not first assert an exemption.
- The protected amount is conclusively exempt under the rule.
- Excess money follows otherwise applicable procedures, without extinguishing broader exemption rights.
[C030, C034.] eCFR+1
For that qualifying branch, review occurs once upon first service of a given order. Re-service of the same order does not generate another review or additional action. A new or different order requires a new review. The institution must not use the existing order to freeze funds deposited after review in the manner prohibited by § 212.6(g). This is not a universal duration rule for every nonqualifying bank garnishment. [C031.] eCFR
A garnishment fee cannot be taken from the protected amount. The regulation permits the specified fee collection within five business days after review from newly deposited non-benefit funds, limited to the amount of those funds. That is not a new fee entitlement independent of other law. [C032.]
3.6 Conditional federal notice
The § 212.7 notice is required when all three conditions exist:
- A qualifying benefit payment was deposited during the lookback.
- The balance is above zero and a protected amount is established.
- Funds exceed the protected amount.
The notice must be sent within three business days after review. It explains the order, review, protected and frozen amounts, any fee, covered benefits, and the right to claim additional protection. Delivery is to the holder or the fiduciary receiving communications for the holder; one notice may cover multiple accounts. [C033.] eCFR
This notice does not replace the sheriff’s Idaho exemption notice or establish the state claim deadline.
3.7 Rights, preemption, safe harbors, and records
Part 212 preserves further federal exemption claims and account terms only when consistent with the rule. Its preemption clause displaces inconsistent state requirements, while greater protection is not inconsistent if compliance with both is possible. No comprehensive Idaho–federal preemption adjudication is made here. [C034, C052.] eCFR+1
The rule’s good-faith protections and account-holder instruction exception are specific. The latter requires an express written instruction, dated after service of the particular order; it is not a general advance waiver in an account agreement. Relevant records must be retained at least two years from receipt of the order. Amendments to Part 212 require the stated joint-agency process. [C035.] eCFR+2
4. Underlying federal antiattachment authorities

[C003, C006, C041–C049; S002, S005, S007.] Justia Law+2
5.2 Designated office, affiliates, and territorial limits
The reproduced § 11-703 permits a qualifying institution to designate an office for service. Its text distinguishes service at that office from service at another Idaho office and addresses when the designated office receives forwarded process. It also distinguishes the named institution from unnamed affiliates, parents, or subsidiaries. [C006.] Justia Law
The statute’s branch language does not itself resolve constitutional jurisdiction, foreign-account law, beneficial ownership, or priority. No nationwide restraint authority is inferred from the phrase describing the institution’s branches. [C007.]
5.3 Service, mailing, acknowledgment, and notice
Section 11-706 incorporates summons-service rules and permits the specified certified-mail or acknowledged first-class-mail alternatives. Mailing means deposit in U.S. mail; service through those alternatives occurs at the stated signed return receipt or fax/email acknowledgment event. Unacknowledged first-class mailing is not silently treated as completed service. [C041.] Justia Law
For a financial institution garnishment:
| Duty |
Trigger |
Period and recipient |
| Sheriff sends statutory documents |
Service under § 11-703 |
One business day to the debtor and identified third-party claimant; stated written no-property exception |
| Bank sends copies of documents served on it |
Service on bank |
Three business days to debtor’s recorded statement address and recorded co-owner/interested person |
| Federal benefit-review notice |
Completed review plus all § 212.7 conditions |
Three business days after review, to holder or communicating fiduciary |
The sheriff’s general two-business-day rule has the bank-specific one-business-day qualification. [C042.] Justia Law+2
5.4 Bank response and creditor exceptions
The reproduced § 11-719 requires an answer under oath within five days after service. Failure permits the creditor to seek the specified default or compulsion process; it is not a finding that the bank owes the claimed amount. Final-judgment, liability-amount, and maturity limitations remain. [C043.] Justia Law
Section 11-720 separately gives the creditor thirty days to except to the garnishee’s answer for insufficiency, with the court’s stated amendment power. This is not the five-business-day period for contesting an exemption claim. [C043.] Justia Law
Sections 11-715 and 11-716 describe garnishee liability and discharge to the extent of authorized payment to the sheriff. Those provisions do not authorize payment of protected money contrary to the applicable exemption and review requirements. [C043.]
5.5 Fees
The reproduced statutes identify a $7 search fee and a separate single processing/service fee of no more than $12, deducted from money transferred to the sheriff. The latter is not multiplied by the number of notice recipients. [C041.]
When the specified release occurs because of an exemption determination or an uncontested claim, the bank must recredit or reimburse that processing fee, and the creditor reimburses the bank. Federal Part 212 separately forbids charging a garnishment fee against its protected amount. No combined fee-debit permission is inferred. [C032, C041.] Justia Law+2

[C044–C046; S005 § 11-203(a)–(b).] Justia Law
6.2 Uncontested release, contested determination, and late claims
The sheriff generally holds the levied property until the claim period expires, subject to the stated perishable-property exception. If the creditor declares the claim uncontested or fails to provide timely notice of contest, the statute directs release of the claimed property. A late claim is refused unless otherwise ordered by the court. [C047.] Justia Law
These state procedural consequences do not authorize withholding the federal protected amount until a claim is filed. Part 212 expressly provides immediate access without that prerequisite.
Section 11-203 also preserves a pre-levy determination branch after the referenced enforceable judgment, common-law remedies, and a limited consequence concerning later collection costs after an earlier exemption claim or determination. The later-levy provision is not a categorical prohibition on all subsequent process. [C048.]
6.3 Third-party ownership, proof, and costs
A third-party claimant must state the grounds for ownership or security interest; the secured-party branch requires the stated amount and contains additional procedures. No actual ownership share or security priority is determined. [C007, C048.]
Section 11-711 permits facts showing exemption or that the property is otherwise not liable to the creditor’s claim. The generic blank instructions call for a reasonable, good-faith basis and supporting documents. This pass did not establish one universal evidentiary standard or burden allocation for every contested benefit, ownership, or tracing issue. [C049.] Justia Law+1
The official packet’s general statement that an exemption must be claimed is qualified by the automatic federal protection and the state review duty. A generic instruction cannot override the legal text. [C051.]

14. Researcher self-check and retained gaps
This pass established the federal automatic-review framework from the operative regulation and material original rulemaking, and read the underlying federal benefit protections to the stated bounds. It also newly read the Idaho deposit, review, attachment, service, and claim provisions in their identified secondary 2025 form.
The principal unresolved dependencies are:
- Official current Idaho statutory authentication, including the final 2021 amendment and any later changes.
- Substantive classification and incorporation gaps, including particular retirement-plan definitions, special support/tax/federal-debt authority, and the current edition of the recovered railroad-unemployment statute.
- Generic construction questions, including wage-accumulation threshold operation, unemployment commingling reconciliation, ownership, territorial reach, setoff, and tracing adjudication.
No bank operation, account review, transfer, beneficiary inquiry, private-record access, form completion, filing, deadline calculation, or legal outcome was performed. No actual or invented account facts were used. The symbolic federal relation does not establish a protected amount for any account.
This is a researcher self-check, not independent review. The component remains partial and conditional at the exact source and legal dependencies identified above. Earlier raw findings and all unexamined dimensions remain preserved; no Idaho, A066, parent, operational, or publication acceptance is implied.
