Component: Generic real-property trust-deed nonjudicial foreclosure, required notices, reinstatement, postponement and rescheduling, sale, and limited post-sale consequences.
Evidence disposition: The official Idaho statutory bodies attempted in this pass were not readable through the available public routes. The operative Idaho findings below are therefore provisional readings of the identified 2025 Idaho Code reproductions, not authenticated official current 2026 law. Official Idaho court-rule text and an official historical Attorney General publication were read. Legislative amendment copies were read from a mirror with their introduced or engrossed status preserved.
Earlier reports, raw findings, provenance, C033/C035, and all unrelated holds remain unchanged. No earlier provider, personal-property, wage, bank, or limitations conclusion supplies a substantive foundation here.
The statutory process depends on more than a recorded document labeled “deed of trust.” The reproduced provisions require qualifying real property, the statutory grantor/beneficiary/trustee relationship, a qualified trustee, the specified recordings, an actual default under a provision authorizing sale, the required notices, and the restriction concerning an action already instituted to recover the secured debt. [C002–C010.] Justia Law+2
Several distinct clocks operate from different events. The ordinary sale-notice period is measured before the scheduled sale; the reinstatement period is measured from recording the notice of default; the modification-request form uses receipt by a deadline measured from the notice date; the beneficiary’s response period runs from receipt of the form. These are not interchangeable. [C013, C022, C025.] Justia Law+1
Reinstatement is not post-sale redemption or full satisfaction. The reinstatement provision excludes principal that would not yet be due without acceleration and restores the obligation and deed as though acceleration had not occurred. The post-sale finality provision addresses a different class of rights and persons. [C025–C028, C038.] LegiScan+1
A trustee’s deed, recorded affidavit, and statutory evidentiary effect are different things. Some recorded materials are prima-facie evidence; specified purchaser or reliance conditions produce conclusive effects. Those provisions are not a finding that an actual title chain, default, notice, sale, or purchaser satisfies them. [C024, C029, C036–C039.] Justia Law+1
A deficiency is neither automatic nor universally prohibited. Section 45-1512 supplies a trustee-sale-specific three-month action window, a required fair-market-value finding, and two monetary limitations. It is not a general deadline for challenging a sale, and it does not replace the separately held debt-limitation inquiry. [C042–C043.] Justia Law
Throughout this report:
| Legal category | Supported distinction | What is not established |
|---|---|---|
| Mortgage | Reproduced § 45-901 defines a mortgage while expressly excepting a trust deed or transfer in trust. Section 45-904 treats the specified security transfer other than in trust as a mortgage. | That every security instrument uses the chapter 15 power-of-sale process. |
| Trust deed | Section 45-1502 requires a deed conforming to the chapter, conveying qualifying real property to a trustee to secure the grantor’s obligation or another named person’s obligation to a beneficiary. | Actual execution, enforceability, ownership, or secured-debt validity. |
| Trustee’s title | The reproduced definition limits the trustee’s title to the statutory power-of-sale and reconveyance purposes; other incidents of ownership remain with the grantor. | Unrestricted ownership or authority arising solely from a title label. |
| Beneficiary | The named/designated person for whose benefit the trust deed is given, or successor in interest; the definition says the beneficiary is not the trustee. | A valid assignment, actual successor status, or a real-party determination. |
| Grantor and successors | The grantor conveys the real property as security; other provisions separately address successors and other obligated persons. | That every occupant, borrower, owner, or obligor is the same legal person. |
| Judicial foreclosure | Section 45-1503 preserves the beneficiary’s option to use mortgage judicial foreclosure. | The full judicial mortgage procedure, redemption regime, or judgment rules. |
| Nonjudicial power of sale | The statute confers a conditional power after breach and requires the chapter’s advertisement-and-sale procedure. | A permission to proceed in an actual matter. |
[C002–C003, C007; S002–S003.] Justia Law+3
Section 45-1502(5) contains three alternative qualifying branches:
| Branch | Source-stated qualification | Boundary |
|---|---|---|
| Incorporated location | Real property within an incorporated city or village at the time of transfer | This branch states no acreage ceiling. |
| Larger nonagricultural parcel | Real property not exceeding 80 acres, regardless of location, that is not principally used for the listed agricultural production | The specified crop, livestock, dairy, and aquatic-production uses matter. |
| Smaller parcel | Real property not exceeding 40 acres, regardless of use or location | Agricultural use is not categorically excluded from this branch. |
The definition includes the grantor’s described right, title, interest, and claim at execution and later-acquired interests of the grantor or successors. No parcel, use, acreage, incorporation boundary, or transfer date is supplied. [C004.] Justia Law
The reproduced § 45-1504 permits the listed categories: an Idaho bar member; an authorized bank or savings-and-loan association; the specified chartered or federally authorized trust institution/corporation; or an Idaho-authorized title-insurance agent/company.
A trustee may resign or be replaced. Resignation becomes effective upon the specified recording, with prompt written notice to the beneficiary. A beneficiary’s appointment of a successor vests the statutory powers upon recording in each county where the deed is recorded. [C005–C006.] Justia Law
The underlying charter, licensing, professional-status, and corporate-authorization regimes were not completed. No trustee, beneficiary, or successor was investigated.
Section 45-1503 restricts judicial enforcement of the secured obligation against the grantor or successor, subject to its identified alternatives: the post-sale § 45-1512 action; judicial foreclosure; the specially defined substantially-valueless-interest branch; or an action excluded by § 6-101(3).
The substantially-valueless branch uses a statutory definition and court findings. It is not established merely by a beneficiary’s assertion that foreclosure would be inconvenient. Its final-judgment/reconveyance consequences remain tied to that branch. [C008.] Justia Law
The complete § 6-101(3) exclusion list was read. Its references to receivers, rents, other collateral, setoff, letters of credit, bankruptcy, probate, and other proceedings do not independently authorize those regimes. Their detailed operation remains outside this pass.
The reproduced § 45-1505 requires:
| Predicate | Required legal fact or act | Boundary |
|---|---|---|
| Recordings | Trust deed, assignments by trustee or beneficiary, and successor-trustee appointments recorded in the specified county mortgage records | A recorded label is not an adjudication of validity or ownership. |
| Default | Default by the grantor, another obligated person, or successor under a deed provision authorizing sale for that default | No contract, acceleration election, or default is supplied. |
| Notice of default | Trustee or beneficiary records the statutory notice in each relevant county | Recording is different from mailing, service, or receipt. |
| Recorded-request notice | Required mailed copy to persons requesting notice under § 45-1511 | The request’s statutory timing and form matter. |
| Other debt-recovery proceedings | No action, suit, or proceeding instituted to recover the remaining secured debt or a part of it, or the proceeding has been dismissed | Interaction with § 45-1503 and § 6-101(3) requires proper classification; no actual concurrent proceeding is assessed. |
[C009–C010; S002 §§ 1505, 1511.] Justia Law+1
The notice of default identifies the trustors and the deed’s recording location or the property description in the manner stated by the section, describes the breach, and states the election to sell or cause a sale. The trustee also has the separate mailing duty to an individual owning an interest in the property. [C010–C011.]
The default notice sent to an individual owner must be accompanied by and affixed to the prescribed warning on a separate sheet:
The warning’s reference to a five-day rescission right for certain foreclosure-rescue contracts is not a five-day period to stop a trustee’s sale or reinstate the loan. The underlying foreclosure-rescue regime was not completed here. [C011.] Justia Law
Section 45-1511 permits the described acknowledged, recorded request after recording of the trust deed and before recording the notice of default. It requires the specified identifying information, address, and showing of service upon the trustee. The recorder’s notation does not give the requester a property interest or alter title.
The later-request exception in § 45-1506A is specific to its rescheduled-sale branch. [C012.] Justia Law+1
After default-notice recording, § 45-1506(2) requires sale notice at least 120 days before the scheduled sale, by registered or certified mail, return receipt requested, to the last-known address of:
| Recipient category | Qualification |
|---|---|
| Grantor and recorded notice requesters | The statutory requester requirements apply. |
| Grantor’s successors | Includes the stated grantee, transferee, and lessee categories when recorded before default-notice recording or actually known to trustee or beneficiary. |
| Subsequent lien or interest holders | The same recorded-before-default or actual-notice alternative applies. |
| Legal representatives | Included as the statute provides; incapacity and death have additional conditions. |
The trustee is excluded from § 45-1506(2)(c)’s notice-recipient category by § 45-1502(4). [C003, C013.] Justia Law+1
The sale notice must contain the grantor, trustee and beneficiary names; property description; deed recording reference; default; secured sum; and sale date, time, and place. The sale-time provision uses after 9:00 a.m. and before 4:00 p.m., standard time, in the county or one of the counties where the property is situated. [C015.]
Disability, the statute’s stated incapacity category, or death does not itself delay the process provided the specified notice condition is met. The provision references summons service upon an incompetent person or mailing to the estate’s administrator or executor. Actual representative status, probate authority, and any additional due-process requirement remain held. [C014.] Justia Law
| Requirement | Statutory relation | Material exception or limit |
|---|---|---|
| Adult-occupant service attempts | At least three good-faith attempts on different days over at least seven days; each at least thirty days before sale | Summons-service manner is incorporated. |
| Posting | At each attempt unless the prior copy remains conspicuously posted | Successful personal service plus posting ends further attempts. |
| Posting exception | Adult personally served was also a required mailed recipient and was actually mailed the notice | In that branch, posting is not required. |
| Publication | Once weekly for four successive weeks, four publications, in a newspaper of general circulation in each relevant county | Last publication at least thirty days before sale. |
| Trustee publication conflict | Trustee may not have the stated financial interest or profit from publication | The criminal consequence is not developed into an enforcement analysis here. |
| Recorded proof | Mailing affidavit, required posting affidavit, and publication proof recorded | At least twenty days before sale. |
[C016–C018; S002 § 1506(5)–(7).] The official Rule 4 clauses were read only to the material service incorporation. Newspaper qualification, completed publication, service validity, and any actual return are not determined. LegiScan+1
Section 45-1506(14) makes mail service under that section effective at mailing. Section 45-1505 contains a corresponding rule for its specified registered/certified mailing. The overseas exception permits ordinary first-class mail only where the required certified or registered service is unavailable.
Those rules do not convert a different provision expressly requiring receipt, such as the modification-request form, into a mailing-deadline provision. [C019, C022.] Justia Law+1
Section 45-1506C applies to a noncommercial loan made by a state- or federally regulated beneficiary, secured by a deed of trust on the borrower’s primary residential property as the section defines it.
Its test is not simply present occupancy. The beneficiary or agent must use the county-assessor tax-roll mechanism before recording default, and the section deems the property primary residential property when it has been granted the homeowner exemption for the year in which the notice of default is recorded. No exemption for that year means this section does not apply by its own text. [C020.] Justia Law
The linked § 63-602G reproduction contains separate pre-January 1, 2026 and January 1, 2026-effective blocks. Selected relevant definitions and source notes were read, but complete tax eligibility and the incorporated tax definitions were not authenticated. No tax record was searched. [C046.] Justia Law+1
| Duty or condition | Source-stated relation |
|---|---|
| Supplemental notice | Accompanies the default notice; at least fourteen-point type; substantially prescribed content. |
| Request form | Must accompany the notice, give return address and deadline, and may require the specified financial/contact information. |
| Language | Notice and form in Spanish when the deed or an assignment is Spanish. |
| Return method/deadline | Prescribed notice requires certified mail, return receipt requested, and beneficiary receipt by thirty days after the notice date. |
| Evaluation | Timely returned form must be reviewed and evaluated. |
| Response | Written approval, denial, or request for additional information as soon as reasonably practicable, no later than forty-five days after receipt. |
| Sale restriction | Sale may not occur until after the beneficiary or agent timely responds. |
| Requested meeting | In-person or telephone discussion before the response, subject to the express no-meeting exception. |
| Meeting exception | The text addresses failure to schedule within seven business days after attempted contact and failure to attend the scheduled meeting/call. |
| Authority | The person meeting must have or be able to obtain authority to modify. |
| Recorded compliance affidavit | Trustee records the beneficiary/agent affidavit at least twenty days before sale in each relevant county. |
[C021–C024.] This is an opportunity for review with conditional procedural protection, not an entitlement to a modification or an automatic forty-five-day extension in every foreclosure. Justia Law+1
The affidavit’s conclusive effect is expressly tied to a party relying on it. The section’s Attorney General enforcement incorporation was identified, but the complete remedies in § 48-606 were not researched. No universal private right, absence of private rights, or remedy amount is inferred.
For the nonjudicial branch, § 45-1506(12) permits the listed persons to reinstate within 115 days after recording the notice of default:
The amount is determined by the statutory categories, not by an invented payoff formula:
| Included when legally due under the clause | Excluded from the reinstatement amount |
|---|---|
| Amount then due under the obligation and deed, including the described taxes, assessments, insurance premiums, and authorized advances | Principal that would not yet be due if default and acceleration had not occurred |
| Enforcement costs and expenses actually incurred | Unestablished, duplicated, or unauthorized expenses |
| Reasonable trustee fee, subject to § 45-1502(6) | A fee contrary to that section’s limits |
| Attorney fees as provided in the promissory note | A fee entitlement assumed without that predicate |
On qualifying cure, the proceedings are dismissed or discontinued and the obligation and deed remain effective as if acceleration had not occurred. [C025–C028.] LegiScan
No numerical prior-use limit appears in the reproduced subsection. That bounded observation is not a conclusion that every repeated cure, tender, waiver, or contractual provision is valid. No general authorization to waive these protections was established.
Section 45-1502(6) authorizes a reasonable charge and specifically addresses reconveyance compensation notwithstanding a deed provision prohibiting or limiting it. It permits refusal to reconvey until the stated reconveyance fee and recording costs are paid.
It also says the trustee is not entitled to a foreclosure fee for judicial foreclosure or work performed before default-notice recording. Cure before the last newspaper publication carries the section’s reasonable-fee rule. No fixed dollar amount, percentage, CPI index, or approved fee was found. [C027.] Justia Law
| Branch | Required predicates and relation | Held interaction |
|---|---|---|
| Ordinary postponement—§ 1506(8) | Beneficiary request; public announcement at the original time/place to a stated later date/hour; each postponement no more than thirty days. A postponed sale may be postponed again under the same limits. | No numerical aggregate postponement count appears in this clause; that is not a universal validity conclusion. |
| Original sale prevented by stay—§ 1506A | Sale could not occur because of the described bankruptcy or court stay; after expiration/termination, rescheduled-sale mailing at least thirty days beforehand, publication three successive weeks with last publication at least ten days beforehand, and statutory affidavits. | No stay existence, expiration, or federal permission is determined. |
| Stay lifted before original sale—§ 1506B | Eligible reinstater serves a written request before the original sale time; stated postponement permits the specified 115-day relationship excluding time under stay. | Exact pre-stay compliance and timely request are indispensable. |
[C029–C031.] Justia Law+2
The special sentence in § 45-1506(8) addresses a loan made by a state- or federally regulated beneficiary secured by the borrower’s primary residence determined under § 1506C(1). It requires:
The sentence does not itself repeat the word “noncommercial.” Its precise scope should not be silently rewritten from another paragraph. [C029.]
Section 1506A permits an additional notice requester who recorded the request at least forty-five days before the rescheduled sale, waiving the ordinary pre-default-recording request requirement for that section only.
Section 1506B distinguishes completed pre-stay notice/publication from a process whose publication can still be timely completed. If timely completion is impossible, it requires discontinuance and renewed compliance with the sale-notice procedure. Without the statutory postponement request, its text says the chapter’s time computation is unaffected by the intervening stay. [C030–C031.]
Unresolved interaction: Section 1506B(3)’s “no further or additional notice” wording and the later special fourteen-day postponed-residence notice require harmonization before a positive combined application. This pass does not choose one as overriding the other. [C032.]
Section 45-1506(8) calls for auction to the highest bidder in one parcel or separate parcels. It permits any person, including the beneficiary, to bid, and permits the trustee’s attorney to conduct the auction.
The purchaser must pay the bid price forthwith; upon receipt, the trustee executes and delivers the deed. The refusal-to-pay branch incorporates execution-sale law. That incorporated regime was not completed, and no credit-bid method, bid-credit amount, or resale practice is inferred. [C033.] LegiScan
The deed conveys the interest the grantor had or had power to convey at execution, together with later-acquired grantor/successor interests. Section 45-1513 treats the trust transfer as a real-property conveyance. Neither clause is a complete title warranty or priority adjudication. [C034.]
Section 45-1507 states the following order:
| Order | Category |
|---|---|
| 1 | Sale expenses, including reasonable trustee compensation and a reasonable attorney fee |
| 2 | The obligation secured by the trust deed |
| 3 | Persons with recorded liens subsequent to the trustee’s interest, as their interests appear |
| 4 | Surplus, if any, to the grantor or entitled successor |
[C035.] This order does not decide actual seniority, the amount of a secured obligation, a disputed expense, competing surplus claims, federal liens, or a distribution deadline. Justia Law
| Legal item | Statutory effect | Necessary limit |
|---|---|---|
| Trustee’s deed contents | Property description and the prescribed default, mailing, publication, conduct, and receipt-of-purchase-money recitals | A recital is not by itself an independently adjudicated fact. |
| Recorded deed and § 1506(7) affidavits | Prima-facie evidence of their recitals in court | Subject to the provision’s scope and other law. |
| Good-faith purchaser for value or successor | Specified conclusive evidentiary protection | No purchaser status is found. |
| Recorded within fifteen days, or stated next business day when recorder closed | Deed deemed effective at sale date/time for the section | Not a declaration that every later-recorded deed is void. |
| Required-notice recipients and those claiming through them | Sale terminates the specified interests; those persons have no redemption right against the purchaser | Not a universal extinguishment of every interest or every federal right. |
| Omitted notice | Sale validity is preserved as stated for notified persons and persons with actual knowledge | No actual notice/knowledge finding. |
| Good-faith purchaser protection under § 1508 | Specified § 1506 noncompliance does not defeat validity in favor of the protected purchaser/successor | Not an adjudication of fraud, authority, every statutory violation, or all remedies. |
[C036–C038.] Justia Law+2
Section 45-1510(2) addresses a sale invalid because of the identified stay, a court stay, or otherwise. Recording the prescribed notice restores record title and the stated lien existence/priority to the pre-sale status.
Only the trustee or beneficiary that caused the deed to be recorded, or its successor, may record the statutory notice. Required contents identify the deed, recording references, parties, property, and reason. [C039.] Justia Law
This is not a general convenience right to undo a valid sale. The clause does not supply a universal deadline for every challenge or rescission claim. No invalidity, authority to rescind, or actual recording is determined.
Section 45-1506(11) states possession entitlement on the tenth day following sale, except for the described interest prior to the deed. Its tenancy-at-sufferance language is not an operational eviction authorization and does not resolve federal tenant protection. [C040.]
Subsection (15) is a separate conditional branch: on or after that time, the purchaser must reasonably determine the premises unoccupied. Titled personal property remains governed by other applicable law. Nontitled property has the stated storage, ninety-day written-notice, mailing/posting, contents, and failure-to-claim conditions. [C041.] LegiScan
No vacancy finding, entry, removal, storage, disposal, or tenant outcome is supplied. The incorporated titled-property regime remains held.
Section 45-1512 permits a money judgment to be sought within three months after the trustee’s sale for the balance of the obligation secured by that deed. The complaint must state the enumerated debt, sale-price, fair-value, interest, cost, and attorney-fee information. Before judgment, the court must find fair market value at the time of sale. [C042.] Justia Law
The statute imposes two limits:
| Limit | Source-stated basis |
|---|---|
| Fair-value limitation | Amount by which indebtedness due at sale exceeds fair market value then, with the stated interest from sale |
| Sale-price limitation | Judgment must not exceed the difference between the secured indebtedness and the sale amount as stated in the clause |
The permitted judgment is not established merely by subtracting proceeds from a reported balance. Expense entitlement, debt validity, fair value, interest, defenses, and applicable special law remain prerequisites. [C043.]
The three-month provision is not a general sale-challenge deadline, an ordinary note limitation, a mortgage-maturity period, or universal debt forgiveness. Those other clocks were not rerun.
Section 45-1514 requires reconveyance upon performance of the secured obligation and the beneficiary’s written request, subject to the relevant trustee-fee provision. Refusal liability incorporates mortgage-discharge law, which was not completed. No penalty amount or return deadline is invented. [C044.] Justia Law

This pass newly read the trust-deed statutory framework and its necessary cross-references to the stated bounds. It recovered meaningful official historical and court-rule evidence, but did not recover authenticated current official Idaho trust-deed statutory bodies or a complete amendment/application chain.
The most consequential remaining issues are:
No actual or invented property, person, entity, deed, note, default, notice, payment, sale, bidder, account, title record, case, or transaction was examined. No legal outcome, filing/service direction, sale instruction, tender amount, calendar deadline, or operational permission is supplied.
This is a researcher self-check, not independent review. The component remains partial and conditional at the exact source and legal dependencies identified above. Earlier findings and all separate holds remain preserved. No Idaho, registry dimension6, A066, parent, operational, or publication acceptance follows.

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability.
