S_ID PASS-24 — Idaho ordinary civil discovery, disclosures, depositions, subpoenas, and protective/enforcement boundaries

Fresh public-source access date: October 28, 2026, America/Los_Angeles.

Scope: Generic pretrial discovery in an ordinary civil debt action. Initial jurisdiction/service/default, small claims, substantive debt validity, evidentiary rulings, full trial practice, appeals, and postjudgment discovery remain separate.

Evidence disposition

The official current-published Idaho civil-rule bodies were recovered and read to the bounds recorded below. The relevant provisions are not identical to familiar federal formulations. The original March 2016 adoption PDF returned 404. Displayed adoption and amendment footers are preserved as publication evidence, not as a completed original-order audit.

No actual request, response, record, witness, privilege claim, discovery event, order, or misconduct was supplied or evaluated. Earlier findings, provenance, C033/C035, and other holds remain unchanged. The resolved Rule 40 quantity clarification is not reopened.

Principal findings

The read Idaho rules do not state a universal automatic initial-disclosure package or a universal discovery-planning conference prerequisite. They instead contain request-based discovery, specified expert disclosures, supplementation, court-ordered disclosures, and scheduling-order requirements. That is not a finding that no special statute or valid order can impose additional duties. [C003–C005.] (Idaho Supreme Court)

The ordinary interrogatory limit is forty, including discrete subparts. Document requests and admissions have different content, signature, objection, effect, and retention rules. The absence of a numerical limit in a particular method is not unlimited discovery permission. [C019–C026.] (Idaho Supreme Court)

A deposition notice, party production request, and nonparty subpoena are not interchangeable. Idaho’s oral-deposition leave provisions, written-question sequence, simultaneous stenographic-record requirement, county-based attendance limits, and third-party advance-notice rule must be kept separate. [C027–C040.] (Idaho Supreme Court)

Discovery protection does not automatically establish privilege or nonwaiver. The rules prescribe withholding descriptions and postproduction handling while a claim is resolved. They do not adjudicate an actual privilege or erase a separate confidentiality, privacy, or public-access inquiry. [C009, C013–C014.] (Idaho Supreme Court)

The published ESI-loss provision is Rule 37(e)’s routine, good-faith-system-operation protection, subject to exceptional circumstances. This report does not replace it with a different federal intent/prejudice framework or infer unrestricted permission to destroy information. [C048.] (Idaho Supreme Court)

1. Scope and procedural setting

Evidence labels:

  • O — Official body read: current-published court rule or official locator, within the stated bounds.
  • H — Held: a material original-history, incorporation, construction, or application dependency remains unresolved.

1.1 Ordinary discovery versus other proceedings

Context Newly read rule relationship Boundary
Ordinary district-court or magistrate-division civil action Rule 1(b) applies the civil rules uniformly within its scope. Assignment, subject-matter jurisdiction, party status, and claim validity are not determined.
Original small claims Ordinary rules apply only as the small-claims rules provide. The full ordinary discovery framework is not imported automatically.
Small-claims de novo appeal Small-claims Rule 15(d)(4) permits discovery only by written court order, within court-set limits. Not a general unrestricted right to ordinary discovery.
Special statutory, family, and identified treatment proceedings Rule 1(b) preserves the specified alternative regimes. Their discovery rules were not investigated.
Pre-action or appeal-period perpetuation Rule 27 has separate petition, order, and scope provisions. It is not treated as ordinary pending-action discovery or a general pre-suit records demand.
Trial and summary judgment Discovery access and production are not themselves admissibility or merits rulings. P23 proof and Rule 56 findings are not reused.
Postjudgment discovery Separate enforcement authority is required. No Rule 69 or collection procedure is completed here.
Local procedure Rule 1(c) requires consistency, Supreme Court approval/publication, and its emergency qualification. No local rule, scheduling order, or actual assignment was inspected.

[C001–C002; S001 Rules 1, 27; S002.] (Idaho Supreme Court)

1.2 Discovery is not adjudication

Item Legal function What does not follow automatically
Request Invokes a permitted method within its scope. Relevance, proportionality, control, or entitlement to every requested item.
Response or production Supplies information or access subject to governing duties. Authenticity, truth, admissibility, debt ownership, or liability.
Admission Can establish the admitted matter for the pending action under Rule 36. A judgment for all requested relief or use in every other proceeding.
Deposition Preserved testimony taken under specified conditions. Admissibility of every answer or automatic proof of the claim.
Subpoena Court process with defined issuance, service, scope, and protection rules. Valid service, compliance entitlement, or absence of privilege.
Protective order Conditional judicial protection. A universal privilege or permanent public-access seal.
Discovery sanction A consequence under its own predicates. Automatic validation of the underlying debt or unlimited relief.

[C006, C024–C025, C035–C049.] (Idaho Supreme Court)

2. General discovery scope, disclosures, sequencing, and protection

2.1 Relevance, burden, and inaccessible ESI

Rule 26(b)(1) permits discovery of nonprivileged matter relevant to a claim or defense. For good cause, the court may permit subject-matter discovery. The published Idaho text retains its stated relationship between discovery and potentially admissible evidence; discovery is not limited to material already admissible at trial.

The court must limit otherwise permitted discovery when the stated cumulative/duplicative, better-source, ample-opportunity, or burden-versus-benefit condition is found. The factors include case needs, amount in controversy, resources, issue importance, and importance of the discovery. [C006.]

For identified ESI sources claimed not reasonably accessible because of undue burden or cost, the responding party bears the specified showing on a motion. A requesting party’s good-cause showing can still support ordered discovery, with conditions. Inaccessibility is not established by merely using that label. [C007.] (Idaho Supreme Court)

Rule 26(b)(2) separately permits discovery of a qualifying insurance agreement’s existence and contents. Disclosure does not make it admissible, and the insurance application is excluded from that particular disclosure provision. [C008.]

2.2 Initial disclosures and scheduling

The read Rules 16 and 26 do not state a universal automatic initial-disclosure exchange analogous to a different jurisdiction’s rule. They do impose or authorize the following:

Duty Trigger and scope
Court scheduling action Within thirty days after an answer or appearance is filed; alternatively, within ninety days after complaint filing if a defendant has been served but none has appeared.
Scheduling order Must address discovery completion and expert-disclosure deadlines, along with the other listed management matters.
Scheduling-order modification Court leave/good cause, or the permitted all-party stipulation with court approval, depending on the paragraph.
Expert identification and substance By interrogatory answer or court order under Rule 26(b)(4).
Trial witness/exhibit lists Court may order them; later-discovered material receives Rule 16(d)’s supplementation treatment.
Supplementation Governed by Rule 26(e), not a universal assumption that every complete answer must be continually rewritten.

The thirty-/ninety-day provisions require court action leading to an order as soon as practicable, not necessarily a fully entered scheduling order by the same deadline. [C003–C004.] (Idaho Supreme Court)

Discovery methods may proceed in any sequence unless ordered otherwise; one party’s discovery does not automatically postpone another’s. Rule 29 permits procedural stipulations unless the court orders otherwise, but court approval is required when a discovery-time extension would interfere with trial or another order requires approval. [C005.] (Idaho Supreme Court)

2.3 Work product and prior statements

Rule 26(b)(3) distinguishes:

Material Rule relationship
Documents/things prepared for litigation or trial by or for a party or representative Ordinarily protected; the stated substantial-need and undue-hardship showing can permit discovery of otherwise discoverable material.
Mental impressions, conclusions, opinions, legal theories Court must preserve the specified protection when ordering production.
A person’s own prior statement The person may request it without the substantial-need showing; signed/adopted written and substantially verbatim contemporaneous-recording categories are defined.
Refusal to provide that statement Motion and Rule 37(a)(5) expense provisions apply.

[C009.] No actual preparation purpose, statement, representative, waiver, or privilege is found. (Idaho Supreme Court)

2.4 Expert disclosures and protection

The rule distinguishes retained/specially employed or party-employee experts from nonretained persons whose relevant knowledge was not acquired in trial preparation.

The retained branch includes opinions and bases, considered information, supporting exhibits, qualifications, publications during the preceding ten years, compensation, and testimony history during the preceding four years. The nonretained branch uses subject matter and a summary of facts/opinions. No actual expert, publication, prior case, or testimony was searched.

Draft protections and attorney-expert communications have express compensation, supplied-facts/data, and relied-on-assumptions exceptions. Non-testifying consulting experts receive the exceptional-circumstances/Rule 35(b) qualification. Contact with an opposing retained expert requires the specified permission. [C010–C011.]

Expert-discovery payment under Rule 26(b)(4)(E) is separate from taxable prevailing-party costs:

  • The published provision requires reasonable responding/testifying fees in its specified branches, absent manifest injustice.
  • Consulting-expert discovery carries the stated fair-portion expense requirement.
  • The nonretained branch’s additional expense sharing is discretionary.
  • The paragraph’s express references to (A)(ii), (A)(i), and (D) are preserved as printed; they are not silently replaced with federal numbering.

[C012.] (Idaho Supreme Court)

2.5 Privilege assertions, produced material, and protective orders

Event Required or permitted treatment
Withholding otherwise discoverable information Expressly claim the privilege/protection and describe the material sufficiently to allow assessment without revealing the protected substance.
Claim asserted after production Notify recipients of claim and basis; producer must preserve the material pending resolution.
Recipient notified Prompt return, sequestration, or destruction; no use/disclosure pending resolution; reasonable retrieval steps if previously disclosed; permitted sealed presentation for determination.
Protective-order motion Party or affected person; appropriate court; certification of good-faith conference or attempt.
Protective relief Good cause; possible limits on method, subject, people present, time/place, trade-secret/commercial information, or specified sealed handling.
Motion denied wholly or partly Court may order discovery on just terms; expense rules remain applicable.

[C013–C014.] These handling duties do not themselves decide privilege, waiver, confidentiality, sealing under public-access law, or ownership of information. Filing a protective-order motion is not established as a universal automatic stay. (Idaho Supreme Court)

2.6 Supplementation and signing

Rule 26(e) begins with no general duty to add later-acquired information to an answer complete when made, subject to its express exceptions: material incorrectness; a formerly true response whose noncorrection would be knowing concealment; identity/location of knowledgeable persons; agreement, timely supplementation requests, or court order; and expert supplementation.

Rule 26(f) requires the appropriate attorney or unrepresented-party signature and reasonable-inquiry certification. An unsigned item need not be acted upon until signed and must be struck unless promptly corrected. An unjustified certification violation requires an appropriate sanction; reasonable causal expenses may be included. [C015–C017.] (Idaho Supreme Court)

Rule 11 qualification: Rule 11(d) excludes discovery papers and motions under Rules 26–37. Yet Rule 30(a)(2)(B)(ii) expressly refers its early-deposition certification to Rule 11 sanctions. Both texts are preserved. Their exact reconciliation is held; a universal Rule 11 safe-harbor period is not imported into discovery sanctions. [C018.] (Idaho Supreme Court)

3. Interrogatories, production, and admissions

3.1 Method comparison

Method Recipient and permissible subject Number and response
Interrogatories, Rule 33 Party; Rule 26 matters, including permitted fact/law-to-fact contentions Forty including discrete subparts, unless stipulated or specific additional number ordered for good cause; thirty-day service-based response
Production/inspection, Rule 34 Party’s possession, custody, or control; documents, ESI, things, or qualifying property inspection No numerical count stated in Rule 34; thirty-day written response, subject to Rule 29/order
Admissions, Rule 36 Party; pending-action facts, application of law to fact, opinions about either, document genuineness No numerical count stated in Rule 36; thirty-day answer/objection period, subject to Rule 29/order

The general scope, burden, protection, and scheduling limits still apply. Each may be served on the plaintiff after commencement and on another party with or after summons/complaint service. This is not an initial-process service instruction. [C019, C022, C024.] (Idaho Supreme Court)

3.2 Interrogatory answers and records option

Rule 33 requires separate, full written answers under oath to the extent not objected to. An organizational officer/agent supplies information available to the party, not merely personal recollection. The answerer signs answers; the attorney signs objections, with Rule 26’s unrepresented-party framework also relevant.

Objections must be specific. Untimely unstated grounds are waived unless the court excuses them for good cause.

The business-record option requires substantially equal burdens of deriving the answer, sufficiently specific identification, and a reasonable examination/copying opportunity. An undifferentiated document production is not declared sufficient. [C020–C021.] (Idaho Supreme Court)

3.3 Production response and ESI form

Rule 34 requires reasonable particularity and reasonable time, place, and manner. The response must address each item/category, state permission or reasons for objection, identify a partial objection, and permit the unobjectionable remainder.

The response deadline is not automatically an independently stated completion date for every production. Requested timing, agreement, and court orders remain material.

Documents must be produced in usual business order or organized to the requests. ESI-form objections require the intended form to be stated. Without a specified form, ordinarily maintained or reasonably usable forms apply; duplicate forms generally are not required. The court may allocate reasonable extraordinary retrieval/production expenses to the requesting party. [C022–C023.] (Idaho Supreme Court)

3.4 Admissions: different from production or an answer to a complaint

Rule 36 requires separately stated matters and the specified document copy/access condition. A response must admit, fairly deny, or detail inability after reasonable inquiry into known or readily obtainable information. Qualified responses must identify admitted and disputed parts. A genuine trial issue alone is not a sufficient objection.

Failure to serve a qualifying signed answer or objection within the applicable period produces the rule’s admission consequence. A sufficiency motion may result in an answer order, an amended answer, or admission. [C024.]

An admission is conclusive only in the pending action unless withdrawal/amendment is allowed under the merits and prejudice conditions. It does not independently award judgment. A pleading attachment is not admitted merely because no verified denial was made. [C025.] (Idaho Supreme Court)

3.5 Nonfiling and retention

Rules 33, 34, and 36 direct that the requests and responses themselves are not routinely filed. A notice of when and on whom service occurred is filed. The propounding party retains the originals and proof of service for one year following final disposition and expiration of any appeal period, or longer if ordered.

Use of selected materials with the court is separately authorized. These provisions do not establish a universal destruction permission notwithstanding another preservation duty or order. [C026.] (Idaho Supreme Court)

4. Depositions

4.1 Oral versus written-question depositions

Issue Oral deposition Written-question deposition
General availability Any person, including a party, subject to leave conditions Same general availability, with different leave conditions
Prison confinement Leave required Leave required
Early plaintiff examination Rule 30’s initial-service period applies, with stated exceptions That Rule 30 early-plaintiff condition is not automatically imported
Previously deposed person No separate repeat-deposition leave condition appears in Rule 30(a)(2) Without stipulation, leave required; grant is subject to Rule 26(b)(1)(C)
Notice Reasonable written notice to every other party; time/place and identifying information Notice plus direct questions, served on every other party; officer identified
Other parties’ questions Oral participation or the specified sealed-written-question method Cross, redirect, and recross sequence
Organizational witness Reasonably particular subjects and designated consenting representative(s) Rule 30(b)(6) incorporation
Attendance Subpoena where compulsion is required Same distinction

[C027–C029, C034.] The published Rules 30 and 31 do not state a general numeric deposition-count ceiling or a default hours-per-deposition limit. Court orders and Rule 26 limits remain; this is not unlimited permission. (Idaho Supreme Court)

4.2 Early-plaintiff leave condition

Rule 30(a)(2)(B) uses the wording “more than thirty days have not passed” since the specified initial service. The exceptions concern the defendant’s having sought discovery or the supported departure/unavailability certification.

The latter involves departure from the district to more than 100 miles from the place of trial, or departure from the United States, before expiration of the period, plus later unavailability. If the other party shows inability despite diligence to obtain counsel for that deposition, the stated use prohibition applies.

These exceptions do not automatically erase the separate prison-confinement leave requirement. [C028.] (Idaho Supreme Court)

4.3 Officer, organization, remote method, and recording

Rule 28 requires the appropriate oath-authorized or appointed officer and disqualifies the listed relatives, employees, attorneys, related/employed persons, and financially interested persons. Foreign and military officer branches exist but are not certifications of actual authority.

An organization must designate one or more permitted persons to testify about information known or reasonably available to it. No requirement that a particular “custodian” or officer always be chosen is inferred.

Remote examination requires stipulation or court order. For the specified rules, the deposition is located where the deponent answers.

Audio/audiovisual recording must also be simultaneously stenographically recorded unless the governing rule/order exception applies. Rule 30.1 regulates opening/closing identification, oath, units, indexing, edits, custody, and costs; an edited copy does not authorize alteration of the original. [C027, C029–C030.] (Idaho Supreme Court)

4.4 Objections, termination, review, and retention

Event Rule consequence
Ordinary objection during examination Recorded; examination generally proceeds subject to it
Instruction not to answer Only the specified privilege, court-limitation, or Rule 30(d)(4) motion ground
Impeding/delaying/frustrating examination Discretionary sanctions under Rule 30(d)(3)
Bad-faith or unreasonably annoying, embarrassing, or oppressive examination Motion to terminate/limit; on the stated demand, suspension for the time needed to obtain an order
Examination terminated by order Resumption requires order of the court where the action is pending
Review Unless waived by deponent and parties, thirty days after officer notification that transcript/recording is available
Changes Signed statement of form/substance changes and reasons
Unsigned after period Officer’s signature and reason statement; use remains subject to Rule 32(d)(4)
Transcript custody Not routinely filed; attorney retention until one year after final disposition, unless longer ordered
Recording/notes Officer retains the specified notes or recording copy; no universal separate destruction date inferred

[C031–C033.] The deposition transcript retention event is not rewritten to match the written-discovery “final disposition and appeal-period expiration” language. (Idaho Supreme Court)

Rule 31’s sequence is fourteen days for cross-questions, seven for redirect, and seven for recross, each measured from the specified service. Good cause permits court alteration. Written questions remain a deposition before an officer, not Rule 33 interrogatories. [C034.] (Idaho Supreme Court)

4.5 Objection waiver and use boundaries

Rule 32 distinguishes prompt written notice objections, officer-qualification objections, curable examination defects, written-question-form objections, and prompt motions concerning completion/return defects.

Its short-notice protection requires less than fourteen days’ notice, a prompt protective motion requesting nonoccurrence or another time/place, and the motion still pending when the deposition occurs. It is not a universal fourteen-day minimum deposition notice.

Taking or producing a deposition does not make all testimony admissible. Full trial-use and unavailable-witness branches are not reapplied here. [C035.] (Idaho Supreme Court)

5. Subpoenas, nonparties, and costs

5.1 Issuance, service, and proof

Rule 45 distinguishes:

Matter Material rule
General issuing court Court where the action is pending
Issuer Clerk under the stated signed/sealed procedure, or Idaho-licensed attorney as officer of the court
Required form/content Substantially Appendix B form; court, action, command, time/place and recording method where applicable
Server Nonparty at least eighteen
Service Delivery to the named person
Attendance fees One day’s attendance and lawful mileage tendered if requested, subject to government exceptions
Attorney service for party The stated Rule 5 branch concerns hearing/trial attendance, not every nonparty or deposition subpoena
Proof Officer certificate or other server affidavit with required details

[C036.] The standalone Appendix B form was not opened. No subpoena was issued, completed, served, or paid. (Idaho Supreme Court)

5.2 Party production versus nonparty production

Branch Conditions
Party deponent required to produce Rule 34 scope/procedure; at least thirty days to comply
Nonparty production/inspection After all parties have appeared or defaulted, unless otherwise ordered
Advance party notice Opposing party receives a copy at least seven days before service on the nonparty, unless court specifies otherwise
Costs Issuing party pays reasonable production/copying cost; requested copies to another party carry reasonable-cost conditions
Document-only command No personal attendance unless separately commanded
Organization/form of production Usual-course or category organization; ordinarily maintained/reasonably usable ESI; generally one form

[C037.] Rule 45(c)(2)’s heading refers to a “Non Attending Party,” but its operative text says a person who is not a party. The operative scope is retained. (Idaho Supreme Court)

5.3 Quashing, privilege, and geographic limits

Upon timely motion, Rule 45(d) says the court may quash, modify, or condition compliance under the unreasonable, oppressive, insufficient-time, protected-material, undue-burden, and cost provisions. A universal fourteen-day objection period or automatic compliance stay was not established by this text.

Nonparty ESI inaccessibility and privilege claims use the burdens and postproduction handling in Rule 45(e). They do not establish actual waiver or confidentiality.

For a resident deponent, the attendance limit is the county of residence, employment, or in-person business. A nonresident may be required to attend in a county where served. Hearing/trial subpoenas have their stated statewide branch. [C038–C039.] (Idaho Supreme Court)

Rule 45(j)’s interstate mechanism is separately identified, not certified as a complete international/tribal procedure. Its published cross-references to 45(e)(2) for service and 45(c) for form need reconciliation before operational reliance.

5.4 Fees: payment duty versus later taxable costs

Source Limited relationship
Rule 45(b), (h) Attendance tender and witness-fee incorporation
Rule 54(d)(1)(C)(iii) $20 per day for a nonparty, nonexpert witness testifying at deposition or trial
Rule 54(d)(1)(C)(iv)–(v) One-way $0.30 mileage language; the private-transport paragraph expressly refers to trial testimony
Rule 54(d)(1)(C)(ix) Ordinary taxable expert-cost ceiling of $2,000 per expert for all appearances
Rule 26(b)(4)(E) Separate reasonable expert-discovery payment duties; not automatically capped by that taxable-cost figure
Rule 54(d)(1)(C)(x)–(xi) Reporting/transcription and one deposition-copy costs, subject to reasonableness
Rule 54(d)(1)(D) Additional exceptional/necessary costs require the specified showing and findings
Rules 30.1(g), 34(b)(2)(E)(iv), 45(c)–(d) Separate discretionary taxation or allocation of recording, extraordinary retrieval, and production costs

[C040.] No universal deposition-travel payment is calculated from the trial-specific mileage language. A permissible cost category is not an actual award; nonuse of a deposition does not by itself make its reasonable preparation cost improper. (Idaho Supreme Court)

Failure without adequate excuse to obey a served subpoena may be treated as contempt under Rule 45(i). A disputed command, missed event, or asserted expense does not itself establish that consequence. [C041.]

6. Discovery disagreements, expenses, and sanctions

6.1 Motions to compel and protective motions

Rule 37(a) requires notice to parties and affected persons and certification of a good-faith conference or attempt. Motions to a party belong in the pending-action court; the rule separately addresses discovery outside Idaho involving a nonparty.

Evasive or incomplete responses count as failures for subsection (a). A deposition may be completed or adjourned before a motion concerning an unanswered question. Admission sufficiency has its separate Rule 36 motion. [C042.] (Idaho Supreme Court)

6.2 Conditional expense rules

Outcome Rule 37(a)(5)
Motion granted, or discovery supplied after filing Expenses required after opportunity to be heard, unless no prior good-faith attempt, substantial justification, or other injustice
Motion denied Opponent’s expenses required after opportunity to be heard, unless substantial justification or other injustice; protective order may issue
Granted in part/denied in part Protective relief and apportionment are discretionary after the stated opportunity

[C043.] The rule does not turn every discovery disagreement into a fee award or establish any amount. (Idaho Supreme Court)

6.3 Distinct sanction branches

Branch Predicate and consequence Exception or limit
Violation of discovery order, Rule 37(b) Court may impose just issue/evidence, pleading, stay, dismissal, default, or contempt-related consequences Prior order is material to this branch; contempt excludes the stated examination order
Failure to produce another person for examination Specified sanctions may apply Inability-to-produce showing is expressly preserved
Expenses caused by order violation Required instead of or in addition to other relief Substantial justification or unjust circumstances
Failure to supplement or obey court-ordered disclosure, Rule 37(c)(1) Information/witness use excluded in the specified settings Substantial justification or harmlessness; additional/alternative sanctions require motion and opportunity to be heard
Failure to admit, Rule 37(c)(2) After later proof, reasonable proof expenses required on motion Objectionable request, immaterial matter, reasonable belief of prevailing, or other good reason
Complete failure to attend/answer/respond, Rule 37(d) Motion-based sanctions for the specified properly noticed/served failures No universal prior compel order is stated; certification required for specified response failures
Mere objection as excuse Insufficient under Rule 37(d)(2) unless a protective motion is pending Pending motion is not declared a universal immunity or automatic stay
General order violation, Rule 37(f) Additional discretionary sanctions/conditions/fees/costs/expenses Requires failure to comply with an order under the rules

[C044–C047, C049.] Dismissal/default is an authorized consequence in specified branches, not an automatic result of every missed step. Full constitutional sanction standards and judicial construction remain held. (Idaho Supreme Court)

6.4 ESI loss

Rule 37(e) limits sanctions under these rules, absent exceptional circumstances, where the loss resulted from routine, good-faith operation of an electronic information system.

It does not specify a complete standalone preservation-trigger code, every source of sanctions authority, or a universal intent/prejudice test. The rule is not permission to destroy material subject to a valid preservation obligation, order, or pending privilege dispute. [C048.] (Idaho Supreme Court)

6.5 Scheduling sanctions and examination boundary

Rule 16(e) separately addresses order violations, nonappearance, substantial unpreparedness, and lack of good faith. Its just-order discretion and causal-expense requirement have their own substantial-justification/injustice exceptions. [C050.]

Rule 35 was read only because Rules 26 and 37 incorporate it. Examination requires an in-controversy condition, good cause, notice, and an order specifying scope and conditions. Report-sharing, inability, agreed-examination, and a particular privilege-waiver provision are separate. Examiner qualification includes an unread statutory definition. No medical facts, examination, report, or waiver were evaluated. [C051.] (Idaho Supreme Court)

7. Timing, service, and motions

Rule 5 applies to discovery papers required to be served, subject to specific exceptions. Represented-party service ordinarily goes to counsel. Mail service completes on mailing; electronic service requires the stated written consent and nonreceipt qualification. Actual electronic-filing rules and local practices were not completed.

The specific nonfiling provisions of Rules 30, 33, 34, and 36 are not displaced by Rule 5’s general filing language. [C052.] (Idaho Supreme Court)

Rule 2.2 excludes the triggering day, counts intermediate days, and supplies the stated last-day and inaccessibility qualifications. Three days are added when an act is due a specified time after service by mail—not automatically after receipt, filing, notification, or every hearing-relative event.

Rule 29 and Rule 16’s approval requirements remain applicable even where Rule 2.2 permits a stipulation or extension. No actual deadline is calculated. [C052.] (Idaho Supreme Court)

Rule 7’s ordinary motion papers must be filed and served so as to be received under its fourteen-/seven-/two-day hearing-relative sequence, unless another rule/statute or authorized good-cause alteration applies. This is distinct from mere service completion. Discovery-specific notice and opportunity-to-be-heard requirements remain. [C053.] (Idaho Supreme Court)

PDF and visual status

No PDF body was successfully recovered or analyzed in this pass. The original adoption route returned 404. Search-indexed PDF snippets remained discovery leads.

Accordingly, no parsed-PDF body, original-order read, screenshot, or page-pixel inspection is claimed. The operative sources used were official HTML rule bodies.

Remaining gaps and conclusion

The principal gaps are:

  • Original adoption/amendment orders beyond displayed footers.
  • Rule 30’s Rule 11 reference, Rule 28’s Rule 29(a) reference, and Rule 45(j)’s published cross-references.
  • Complete privilege, waiver, privacy, sealing, preservation, contempt, and sanction-construction law.
  • Statutory examiner, oath, witness-fee, foreign, federal, and special-sector incorporations.
  • Actual scheduling orders, agreements, requests, responses, control, burden, loss, notice, or justification facts.

No actual or invented person, entity, creditor, debtor, lawyer, witness, employer, custodian, account, transaction, record, request, response, order, discovery event, amount, or date was supplied or constructed. No disclosure, objection, subpoena, motion, payment, sanction, or calendar outcome was determined.

This is a researcher self-check, not independent review. The discovery component is supported by newly read official rules but remains conditional at the exact original-history, incorporation, construction, and actual-application boundaries identified above. Earlier findings and holds remain preserved. No Idaho, dimension4, A066, parent, operational, or publication acceptance follows.
