S_ID PASS-23 — Idaho contested debt proof, documentary evidence, and summary judgment

Fresh public-source access date: October 28, 2026, America/Los_Angeles.

Scope: Ordinary contested civil debt proof; relevance, knowledge, authentication, hearsay, originals and summaries; and the current Idaho summary-judgment rule. Initial process/default, full discovery, trial practice, arbitration, appeals, enforcement, and substantive debt-sector law remain separate.

Evidence disposition

The official current-published Idaho evidence and civil rules were recovered and read to the bounds recorded below. The original 2016 civil-rule adoption PDF and 2018 evidence-rule adoption PDF returned 404s. Their displayed rule footers are therefore preserved as publication evidence, not a reconstructed original-order history.

The necessary declaration statute, Idaho Code § 9-1406, was recovered only as a 2025 secondary reproduction after the official route failed. Its current official wording and enactment/application chain remain held.

No earlier report supplies a substantive premise. Earlier findings, provenance, C033/C035, and all other holds remain unchanged.

Principal findings

Filing, authentication, hearsay admissibility, weight, and entitlement to recover are separate questions. A document attached to a pleading does not become indisputably genuine or true merely because the opposing party did not file a verified denial. [C004–C006.] Idaho Supreme Court+1

The records exception has conditions, not a creditor-status shortcut. The rule requires the specified knowledge, timing, recordkeeping, regular-practice, and witness-or-certification foundation, while preserving the opponent’s trustworthiness challenge. No categorical rule for or against a debt purchaser establishing another entity’s records is determined without judicial construction. [C019–C021.] Idaho Supreme Court

Idaho Rule 56 must not be silently replaced with its federal counterpart. The published Idaho text has its own timing, hearing-admissibility wording, affidavit-attachment requirement, and remedial structure. [C032–C043.] isc.idaho.gov

An unsupported response, unavailable evidence, partial adjudication, and bad-faith submission have different consequences. None independently establishes a valid debt, an admissible record, a damages amount, or discharge. The operative findings are set out in the claim register and timing register below.

1. Scope and procedural posture

Evidence labels:

  • O — Official body read: current-published rule text.
  • P — Provisional: dated secondary statutory reproduction.
  • H — Held: a material incorporation, historical, construction, or application dependency remains unresolved.

1.1 Applicable rule systems

Context Newly read authority Boundary
Ordinary civil action IRCP 1(b); IRE 101(b) General civil/evidence framework, subject to express exceptions.
Original small-claims proceeding IRCP 1(b); IRE 101(e)(5) Ordinary civil rules apply only through the special rules; ordinary evidence rules are excluded except privilege.
Small-claims de novo appeal Small-claims Rule 15(c), (d)(2) A distinct proceeding; civil rules apply subject to that rule and the court’s stated discretion. The initial small-claims exclusion is not transferred automatically.
Preliminary admissibility question IRE 104(a), 101(e)(1) The court is not bound by evidence rules other than privilege when resolving the specified preliminary questions.
Specialized proceedings IRE 101(d)–(e); IRCP 1(b) Enumerated criminal, family, juvenile, contempt, medical-treatment, and other qualifications remain separate.
Summary judgment IRCP 56, with necessary incorporated rules Not a default hearing or an ordinary trial merely conducted on paper.
Appeal from a final judgment Separate appellate rules Full appellate review and preservation consequences are not completed here.

[C002–C003.] The complete scope provisions were read. A proceeding’s label as “summary” does not itself establish an exemption from the evidence rules. Idaho Supreme Court+2

1.2 Allegation, admission, proof, and weight

Item Legal effect actually supported Limit
Pleaded allegation Rule 8 supplies pleading and admission/denial consequences. Pleading a fact is not ordinarily evidence proving it.
Failure to deny Rule 8(b)(6) distinguishes allegations requiring a response, damages allegations, and allegations requiring no response. The exceptions cannot be omitted.
Instrument attached to pleading Rule 10(c) makes it part of the pleading. Not automatic authentication, hearsay clearance, or proof of ownership.
Failure to make a verified denial of an attachment Rule 36(c) expressly rejects automatic admission of genuineness, accuracy, or truth on that basis. Does not decide some other admission or stipulation.
Formal Rule 36 admission Conclusive in the pending action unless withdrawal/amendment is permitted under the stated merits/prejudice conditions. Not an admission for another proceeding.
Evidence admitted for a limited purpose Rule 105 requires the stated limitation on timely request. Admission for one purpose is not unrestricted substantive use.
Preliminary admissibility ruling Rule 104 allocates qualification, privilege, and admissibility questions to the court. Weight and credibility remain distinct under subsection (e).

[C004–C008.] Discovery request mechanics were not rerun. Only the effect and use of an admission, and the attachment limitation, are relied on. Idaho Supreme Court+4

Rule 11’s signing and reasonable-inquiry certifications likewise do not establish that every factual assertion is true or admissible. A verified pleading based on belief is not automatically equivalent to personal-knowledge summary-judgment evidence. [C046.] Idaho Supreme Court+1

2. Relevance, knowledge, and evidentiary purpose

2.1 Relevance and exclusion

Rule Complete material relation
401 Evidence must tend to affect the probability of a fact and that fact must matter to deciding the action.
402 Relevant evidence remains subject to other exclusion rules; irrelevant evidence is inadmissible.
403 The court may exclude relevant evidence when its probative value is substantially outweighed by the specified prejudice, confusion, delay, waste, or cumulative-evidence dangers.
104(b) Conditional relevance requires sufficient support for the predicate fact; the court may condition admission on later proof.
105 Proper party/purpose limits remain material.
106 Fairness may require contemporaneous consideration of the remainder or a related writing/recorded statement.

[C006–C008.] Rule 106’s published text is not treated as an automatic override of hearsay, privilege, or every other objection. Its relationship to another exclusion rule remains a construction question where material. Idaho Supreme Court+4

2.2 Personal knowledge, competency, and oath

Rule 602 requires evidence sufficient to support personal knowledge; the witness’s own testimony can supply that showing. Its express expert-testimony exception refers to Rule 703.

Rule 601 separately addresses competency, including court-found incapacity and the specific unwritten-communication/agreement branch involving claims against an estate. Rule 603 requires an oath or affirmation before testimony. [C009.] Idaho Supreme Court+2

These are not interchangeable:

  • Personal knowledge of a recordkeeping system is not automatically personal knowledge of every underlying event.
  • A “custodian” title alone is not a judicial qualification finding.
  • Taking an oath does not remove hearsay or establish the truth of the testimony.
  • Expert-basis Rule 703 is not a general business-record substitute. Its reasonable-reliance and jury-disclosure conditions differ; expert qualification and reliability remain a later inquiry. Idaho Supreme Court

No person, witness, expertise, incapacity, estate, or recordkeeping practice was examined.

3. Authentication and self-authentication

3.1 Rule 901 foundation

Rule 901 requires sufficient evidence for a finding that the item is what the proponent claims. Its listed methods are examples, not an exhaustive checklist.

Material examples include knowledgeable testimony, nonlitigation-acquired handwriting familiarity, comparison with an authenticated specimen, distinctive characteristics in context, public-office source, and an accurately functioning process or system. Electronic storage does not eliminate that requirement. [C010–C012.] Idaho Supreme Court

Published-text qualification

The official HTML places public-record wording under Rule 901(b)(6)(B), within the telephone-conversation example, and repeats that wording in (b)(7)(B). The original adoption PDF was inaccessible.

That telephone subbranch is not corrected by assumption or relied on here. The independent general standard and other complete examples remain the basis of this report. [C048.] Idaho Supreme Court

3.2 Self-authentication is limited to authenticity

Category Material condition
Domestic public document The applicable seal/signature or officer-certification conditions in Rule 902(1)–(2).
Foreign public document Authorized attestation and final-certification chain; the stated opportunity-to-investigate/good-cause alternatives remain.
Certified public-record copy Correct-copy certification by the custodian/authorized person or the specified compliant certificate.
Official publication Must purport to be issued by a public authority.
Acknowledged document Lawfully executed acknowledgment by an authorized officer.
Commercial paper Only to the extent allowed by governing commercial law, which is not completed here.
Statutory authenticity presumption Requires the particular statute or Supreme Court rule.
Domestic business record Rule 902(11)’s qualified certification plus reasonable written pre-hearing/trial notice and inspection opportunity.
Foreign business record Rule 902(12)’s country-of-signing criminal-penalty qualification and incorporated notice conditions.

[C013–C016.] These categories do not independently establish hearsay admissibility or the truth, legal effect, or enforceability of the contents. Idaho Supreme Court

The business-record certification is a legally qualified declaration, not merely a signature, letterhead, or “certified” label. The records exception’s remaining conditions still matter.

Rule 903 requires a subscribing witness only when the law governing the writing’s validity requires one. That is not a universal demand for—or universal exemption from—such testimony. [C014.] Idaho Supreme Court

4. Hearsay and regularly conducted activity records

4.1 Statement, purpose, and opposing-party exclusions

Rule 801 defines a statement as an intended human assertion and hearsay by its out-of-court and truth-of-the-assertion conditions. Rule 802 supplies the exclusion rule and its rule-based exceptions.

Rule 801(d)(2) requires an opposing-party use and the applicable party, adoption, authority, employment/agency, or conspiracy predicate. A statement alone does not establish the authority, relationship, or conspiracy specified in the final paragraph. Prior witness statements under subsection (d)(1) have different testimony, cross-examination, and statement conditions. [C017–C018.] Idaho Supreme Court+1

A source-generated number, an automated output, and human-supplied information may present different statement questions. The rule’s definition does not resolve every electronic-data construction issue merely because the material is digital.

4.2 Records of regularly conducted activity

Rule 803(6) requires:

Element Required relationship
Timing/source Made at or near the relevant time by, or from information transmitted by, someone with knowledge
Activity Kept in the course of a regularly conducted business, organizational, occupational, or other calling, whether for profit or not
Practice Making that record was a regular practice
Foundation Qualified custodian/witness testimony or a compliant Rule 902(11)/(12) certification
Trustworthiness Opponent does not establish the specified source, method, or preparation circumstances indicating untrustworthiness

The declarant’s availability is not a prerequisite to this exception. [C019–C020.] Idaho Supreme Court

Transferred or predecessor records

The rule does not expressly declare that a debt purchaser always can—or never can—establish a predecessor’s records. Nor does it state that every foundational witness must have personally participated in every underlying transaction.

The supported conclusion is narrower: the complete foundation and any layered-statement problem must be addressed. Acquisition, storage, reliance, integration, authority, and witness qualification cannot be presumed from a purchaser or custodian label. The applicable judicial construction remains held. [C021.]

4.3 Absence, public records, and layers

Branch Source-stated boundary
803(7), absence of business record The kind of matter must ordinarily be recorded, and the trustworthiness qualification remains.
803(8), public record The public-office activity, observation, or legally authorized investigation categories have Idaho-specific exclusions, including the stated office-party and special-investigation material.
803(10), absence of public record Requires a diligent-search showing and the relevant regular-recordkeeping predicate; its criminal notice provision is not a civil deadline.
805, multiple layers Each hearsay part must satisfy the applicable rule. Filing or certifying an outer record does not automatically cure every embedded statement.
806, declarant credibility Admission of the specified hearsay or opposing-party statements does not immunize the declarant’s credibility from the rule’s permitted challenge.

[C022–C024.] A private document filed in a public office does not automatically turn all private assertions into admissible public-office findings. Idaho Supreme Court+2

4.4 Ancient and residual branches are not shortcuts

The published Idaho provisions use at least thirty years, not a federal date cutoff, for their identified ancient-document branches. Authentication still has separate condition and location requirements. Rule 803(24)’s residual exception requires its trustworthiness, materiality, comparative-probativeness, interests-of-justice, and reasonable-notice conditions. Neither branch is applied here. [C025.] Idaho Supreme Court+1

Unavailable-declarant exceptions under Rule 804 and medical-specific Rule 904 were not completed. Their prerequisites cannot be inferred from the absence of a witness or the label of a record.

5. Originals, duplicates, summaries, and judicial notice

5.1 Content proof is not the same as authentication

Rule Material relation
1001 A qualifying accurate, readable output of electronically stored information can be an “original”; a duplicate must accurately reproduce the original.
1002 Content proof ordinarily requires an original unless a rule or statute provides otherwise.
1003 Duplicates are generally treated like originals, subject to a genuine authenticity question or unfairness.
1004 Alternative content proof has separate loss/destruction-without-bad-faith, unavailable-process, opponent-control/notice/nonproduction, or noncontrolling-issue branches.
1005(a) Public-record copies require otherwise-admissible material and the specified certification or comparison testimony; reasonable-diligence failure is a separate branch.
1007 The opposing party’s testimony, deposition, or written statement may establish content without accounting for the original.
1008 Court and jury functions differ for the specified existence, originality, and accurate-content issues.

[C026–C030.] These provisions do not establish physical possession, chain of assignment, signature validity, or a right to enforce an instrument. Idaho Supreme Court+6

The official-transcript branch in Rule 1005(b) incorporates ICAR 27(d). That definition distinguishes a certified reporter’s transcript from the specified certified transcription of an electronic recording; a raw recording or realtime display is not automatically the official transcript. The incorporated certification-form/current-cross-reference question remains held. [C028.] Idaho Supreme Court

5.2 Summaries

Rule 1006 permits a summary, chart, or calculation for voluminous material that cannot conveniently be examined in court. It requires the originals or duplicates to be available for examination or copying at a reasonable time and place; court production may also be ordered.

A summary does not itself supply a missing foundation, cure hearsay, prove the inputs, or establish an amount owed. Those conclusions follow only through the applicable rules and substantive law, not the summary label. [C029.] Idaho Supreme Court

5.3 Judicial notice and presumptions

Rule 201 concerns adjudicative facts not reasonably disputable under its two stated tests. Judicial notice of court-file materials requires identification of the specific items; a timely opportunity to be heard remains. It is not blanket judicial notice that all assertions in a file are true. [C031.] Idaho Supreme Court

Rule 301 ordinarily shifts the burden of producing rebuttal evidence, not the ultimate burden of persuasion, unless the specified law provides otherwise. Rule 302 directs to federal law when federal law supplies the claim or defense’s rule of decision. No substantive presumption or federal claim is applied. Idaho Supreme Court+1

5.4 Settlement communications

Rule 408 restricts specified compromise material offered to establish a disputed claim’s validity or amount, or for the stated impeachment use. Other permitted purposes and otherwise discoverable evidence remain distinct.

This is an admissibility rule, not a complete mediation privilege, confidentiality guarantee, or discovery prohibition. [C047.] Idaho Supreme Court

6. Ordinary summary judgment

6.1 Governing test and record support

Rule 56 provision Operative distinction
(a) Grant requires both absence of a genuine material factual dispute and legal entitlement. A claim, defense, or part may be addressed.
(c)(1) Particular record citations or the specified demonstration of evidentiary insufficiency must support factual positions.
(c)(2) Idaho’s objection wording is “not admissible in evidence at the hearing.” A federal “capable of later presentation” formulation is not substituted.
(c)(3) The court need consider cited material only, but may examine other record material.
(c)(4) Personal knowledge, admissible facts, competence, and attached/served sworn or certified referenced papers are required; supplementation is discretionary.

[C032, C035–C037.] Substantive burden allocation, inference rules, and any bench-trial qualification require judicial construction not undertaken here. isc.idaho.gov

6.2 Missing evidence, defective support, and partial disposition

Provision Source-stated consequence
56(d) Specified inability shown by affidavit/declaration permits deferral, denial, additional evidence/discovery time, or another appropriate order.
56(e) The court may permit correction, treat a fact undisputed for the motion, grant only upon demonstrated entitlement, or otherwise order. Nonresponse is not automatic judgment.
56(f) An undisputed material fact or relief item may be established for further proceedings without granting everything requested.
56(b)(3) Good cause permits timing alteration; continuance, costs, fees, and sanctions are discretionary.
56(g) Bad faith or sole-delay submission, after notice and reasonable response time, requires causally incurred reasonable expenses, including fees; contempt or other sanctions remain discretionary.

[C039–C043.] None is debt discharge, an automatic fee amount, or a finding that an actual submission was improper. Idaho Supreme Court+1

The published Idaho Rule 56(f) is not a separately authenticated authorization for every federal-style sua-sponte summary-judgment procedure. No absence-of-authority conclusion is made; that distinct inquiry remains held.

6.3 Timing, service, and conversion

The complete source-stated timing appears in the quantity register in Section 10. Rule 7(b)(3)(I) prevents its ordinary motion schedule from replacing a different period supplied by Rule 56. Filing, service, receipt, and hearing dates remain different events. [C033–C034, C044.] Idaho Supreme Court

Rule 5’s later-paper service clauses include mailing completion and qualified written-consent electronic transmission. They do not authenticate initial service, electronic consent, or actual receipt. Rule 2.2’s mail addition applies only to an act due a specified time after service by mail, not mechanically to every hearing-relative interval. Idaho Supreme Court+1

Under Rule 12(d), a qualifying motion becomes a Rule 56 motion if outside material is presented and not excluded; all parties must receive a reasonable opportunity to present pertinent material. Full Rule 12 practice was not rerun. [C045.] Idaho Supreme Court

6.4 Declarations and verification

Rule 2.7 includes a qualifying § 9-1406 declaration within “affidavit.” The reproduced statute requires a subscribed written penalty-of-perjury certification in substantially the statutory form and excludes depositions, office oaths, specified-official oaths, and acknowledgments.

Its current official statutory body remains unverified. No declaration form was constructed. [C038.] Idaho Supreme Court+1

Rule 11.1’s belief-based verification is expressly qualified where personal knowledge is required. Rule 28 was read for its oath-officer and disqualification incorporation, not as a discovery guide. A Rule 902 records certification, a notarized acknowledgment, a verified pleading, and a qualifying affidavit are not automatically the same legal instrument. [C037–C038, C046.] Idaho Supreme Court+1

Rule 2.8’s foreign-declaration route has its own location, exclusions, medium, and prescribed-form requirements. Its appendix form and federal electronic-signature relationship were not completed; no foreign declaration is approved. Idaho Supreme Court

6.5 Motion, order, partial fact, and judgment

A motion requests relief; an order resolving an evidentiary or factual issue is not necessarily a final judgment. Rule 54(a)–(b) governs separate judgment form and partial-final certification. Rule 58 makes entry a distinct event. No appeal, execution, interest, or collection consequence is determined. [C041.] Idaho Supreme Court+1

56(f)An undisputed material fact or relief item may be established for further proceedings without granting everything requested.
56(b)(3)Good cause permits timing alteration; continuance, costs, fees, and sanctions are discretionary.
