S_ID PASS-11 — Idaho medical billing, collection conditions, financial assistance, and federal boundaries

Fresh public-source access date: October 28, 2026, America/Los_Angeles.

Scope: The medical-sector portion of registry dimension 6, with only the necessary dimension 7 enforcement and remedy interfaces.

Evidence disposition: The relevant official Idaho statutory routes attempted in this pass did not yield readable operative bodies. Idaho statutory findings below are therefore provisional readings of the identified 2025 reproductions, supplemented by historical legislative texts whose introduced or engrossed status is preserved. Official Idaho rule-repeal material, official court-rule text, federal statutory text, current-published federal regulations, and original federal regulatory publications were recovered.

Earlier reports, raw findings, provenance, C033/C035, and all other holds remain unchanged. No earlier report supplies the substantive medical-sector findings below.

Principal findings

Idaho has a medical-specific collection framework: the Idaho Patient Act, Title 48, chapter 3. It distinguishes timely billing and notices, extraordinary collection actions, court-awarded collection expenses, and non-extraordinary collection of principal. It does not establish that every billed amount is valid or that a billing failure automatically cancels principal. [C002–C024.] Justia Law+2

Its clocks are not interchangeable. Charge submission, receipt of a consolidated summary, receipt of a final notice, accrual of ancillary charges, reporting, judicial collection, and resolution of good-faith disputes have distinct reference events. In particular, the Act’s reporting alternative carries a consequence for later judicial collection; it is not a general permission to report any medical balance after a national waiting period. [C009–C016.] Justia Law

The former county medical-indigency and catastrophic-cost programs require a repeal-and-transition analysis, not reuse of old eligibility tables. The recovered materials distinguish services received through March 31, 2022, the March 1, 2022 statutory snapshot, later program and rule repeals, residual reimbursement provisions, and the reported July 1, 2026 repeal of § 31-3502. The latter is not the separate § 31-3503 reimbursement provision. [C027–C034.] Justia Law+2

Federal hospital financial-assistance requirements are conditional tax-law requirements, not a uniform policy for every provider or hospital. The regulations contain different reasonable-efforts routes, application duties, limits on patient charges, and exceptions. Neither “120 days” nor “240 days” is a universal medical-debt collection moratorium. [C035–C048.] GovInfo+2

The CFPB’s 2025 medical-reporting rule cannot be treated as operative. The agency’s current compliance page records its July 11, 2025 vacatur. Separately, the agency records withdrawal of specified medical-debt guidance. These status findings do not repeal the underlying FCRA, FDCPA, No Surprises Act, or Idaho Patient Act, and no underlying case or order was investigated here. [C049–C051.] Consumer Financial Protection Bureau+1

1. Actor, debt, and legal-category distinctions

The following labels are used throughout:

  • P — Provisional: wording read in a dated secondary Idaho statutory reproduction.
  • O — Official body: official statute publication, court rule, or original administrative publication actually read.
  • E — eCFR: authoritative but unofficial current-published regulatory text, with its displayed currency preserved.
  • H — Held: a material incorporation, currentness, construction, or application dependency remains unresolved.

1.1 Actor and authority comparison

Generic role or category Relevant rule Boundary
Health-care provider The Idaho Patient Act definition includes the described licensed, accredited, or certified practitioner, a health-care facility, and their stated agents or third-party representatives. A marketing label does not establish qualification. The Act’s use of this term is not a separate collection license.
Health-care facility The definition extends beyond hospitals to the listed physical or virtual places and services where care is provided. Federal hospital tax rules have a narrower, separately defined institutional scope.
Patient Includes the care recipient and the specified parent, guardian, or person contractually or otherwise financially liable. Inclusion in the definition does not independently prove that a particular parent, guardian, or other person owes a debt.
Billing entity Appears in the required summary and final-notice framework. A notice identifying a billing entity is not adjudication of the entity’s entitlement to payment.
Outside collector or debt buyer “No person” may take a covered extraordinary collection action without the Act’s conditions. The definition expressly addresses certain transfers and third-party collection authorization. Transfer or sale does not establish licensing, ownership, enforceability, or a federal exclusion.
Third-party payor Incorporates a health carrier under § 41-5903 and the identified private or public self-funded plans. Multiple payors may be involved. The payor definition does not determine coverage, network status, claim allowance, or ERISA treatment.
County/state legacy assistance program Historical eligibility, transition, and reimbursement statutes govern a different relationship. Government assistance paid on a person’s behalf was not necessarily unconditional charity or discharge.
Covered federal hospital organization/facility Section 501(r) and its regulations impose facility-specific conditions on the defined tax-exempt-hospital organization. Not every nonprofit, physician, facility, or hospital is automatically within the same federal branch.
Health plan or insurer Insurance and surprise-billing law may determine allowed charges, cost sharing, appeals, and payment responsibility. Those determinations cannot be derived from the Patient Act’s notice contents alone.

[C002–C003, C035–C036, C052; S003–S004, S017–S018.] Justia Law+3

1.2 Idaho extraordinary collection action is a defined category

Conduct Reproduced Idaho treatment Important qualification
Sale, transfer, assignment, or authorization of third-party collection in another name An extraordinary collection action when undertaken before sixty days from receipt of the final notice. Later transfer falls outside that particular timing-defined branch, but other conduct and laws remain applicable. No general authority to sell or collect is established.
Adverse consumer reporting An extraordinary collection action. Special timing and later-judicial-action consequences appear in § 48-304.
Judicial or legal action and related filings/recordings An extraordinary collection action, including the listed lien, seizure, suit, and wage-garnishment categories. The specific medical-lien exception must be separately satisfied.
Action under § 28-22-105 Excluded only when pursuant to and in compliance with that provision. Complete dishonored-payment incorporations were not completed; no exception is applied.
Medical lien under § 45-701 The Act does not prevent the specified authorized provider from filing the lien. The lien must comply with Title 45, chapter 7’s timeline and provisions. Full lien law remains held.
Non-extraordinary demand or collection of principal Section 48-312 preserves that category. It does not establish the debt’s validity or authorize conduct prohibited by other law.

[C004–C006, C024.] Justia Law+1

“Contested judgment” is also a defined court category: the challenge must occur through a court filing or presentation of evidence or argument at a hearing. An informal billing disagreement is not, solely for that reason, a “contested judgment,” although it may be material to § 48-304’s good-faith-dispute condition.

2. Idaho billing, notice, dispute, and collection conditions

2.1 Two different information documents

Document Required contents and function What it is not
Consolidated summary of services Patient and facility contact information; visit date and duration; general service description; identity and contact information for each billing entity; conspicuous prescribed notice that it is not a bill. Not necessarily an itemized final invoice, a payment demand, or proof of patient liability.
Final notice before extraordinary collection action Patient/facility identification; reasonable-detail list of services, initial charges and dates; availability of a full itemized statement on request; payor information; reductions, adjustments, offsets and payments; resulting asserted patient responsibility. Not an adjudication that the charges, coding, coverage decision, or remaining balance are legally correct.

For unchanged information in successive notices, the definition uses the first notice supplying the required information. A later duplicate does not automatically reset every period. [C007–C008; S003 § 48-303(1), (4).] Justia Law+1

Summary exception and delegated delivery

Section 48-309 excuses the facility’s consolidated summary only when all stated conditions are met: one billing entity will send the final notice for all goods and services at the facility, the patient was clearly informed in writing of that entity’s name, address, and telephone number, and all other § 48-304 requirements are satisfied.

Section 48-310 permits a facility to contract with a provider to deliver the summary on its behalf. It does not declare the contractor licensed, approve a collection agreement, or prove delivery. [C010.] Justia Law+1

2.2 Ordinary sequence

Requirement Actor and reference event Qualification
Submit charges Provider submits to the patient-identified payor, or to the patient if no payor was identified, within forty-five days of the latest stated event. The reference event is not always the service date.
Deliver summary Patient receives the free summary within sixty days of the latest stated event. Subject to the complete § 48-309 exception.
Deliver final notice Patient receives a free final notice from the provider’s billing entity. The clause does not prescribe a separate fixed interval between summary and final notice.
Delay ancillary accrual Provider does not charge or cause interest, fees, or ancillary charges to accrue until at least sixty days after the later receipt of summary or final notice. This is not an interest-rate authorization or proof a particular fee is lawful.
Ordinary extraordinary-collection condition Section 48-304(1)(e) links at least ninety days from the later notice receipt with final resolution of internal reviews, good-faith disputes, and appeals concerning charges or payor obligations/payments. No universal dispute-submission cutoff or automatic charge validity is supplied.

The “latest” billing event is the latest of service/goods, discharge, or the first date permitted by the applicable published billing codes and related national-association policies and procedures. No actual code or care episode is supplied, and those external billing materials were not investigated. [C009, C011–C012.] Justia Law

Construction hold: unresolved reviews and the ninety-day clause

The complete text includes both the later-notice receipt relation and “final resolution” of the listed reviews, disputes, and appeals. It supports requiring both conditions; it does not justify ignoring an unresolved good-faith dispute.

This pass does not resolve, through judicial construction, whether a later resolution event starts an additional ninety-day interval in every circumstance. That precise temporal construction remains held. The statute is not simplified into a universally applicable “ninety days after the bill.”

2.3 Reporting alternative and its consequence

The ninety-day condition may be shortened to forty-five days for adverse reporting, but only with the specified advance written notice received at least thirty days before reporting. That notice must disclose the consequent prohibition on the defined judicial/legal extraordinary collection actions.

Section 48-304(2) separately prohibits those judicial/legal actions when adverse reporting occurred before ninety days from receipt of the final notice. Its reference event is not worded identically to subsection (1)(e)’s later-of-two-notices event. [C013.] Justia Law

No actual reporting right, reporting accuracy, FCRA compliance, or later litigation result is determined.

2.4 Payor identification and receipt

The final notice must contain the payor name, group number, and last four digits of the membership number, unless all charges were submitted to the correct payor. That exception does not waive subsection (1) or § 48-306. The pleading requirement in § 48-307 is a separate provision. [C014.]

Section 48-308 establishes a rebuttable three-day receipt presumption for first-class mail to the address confirmed at the last visit or subsequently updated in written or electronic communications. Written agreement to electronic delivery is permitted, but the section does not expressly turn every electronic transmission into the same three-day presumption. [C015.] Justia Law+1

2.5 Late submission or late summary

Section 48-306 provides a limited alternative after:

  • Charge submission within an additional forty-five days; or
  • Summary compliance within an additional 180 days.

All other § 48-304 requirements must still be met. In that branch, the patient has no liability for collection costs, expenses, and fees, including attorney fees, notwithstanding contrary law or agreement. [C016.]

This is not a cancellation of principal, an interest-rate rule, or an unlimited opportunity to cure every defect. The clause does not expressly include the same pre- and postjudgment-interest language found in § 48-311; the two provisions are not silently made identical. LegiScan

2.6 Burden and pleading

The person seeking an extraordinary collection action bears the burden of establishing prior compliance with §§ 48-304 and, when applicable, 48-306. A judicial complaint must plead compliance particularly and identify the payor name, group and policy numbers, and each charge-submission date as stated by § 48-307.

This is an evidentiary and pleading obligation, not proof that a required event occurred. [C017.] LegiScan

3. Fees, interest, nonwaiver, and medical-specific remedies

3.1 Court-awarded collection amounts

The figures below are medical-specific court-award limits, not debt-settlement provider fees, automatic collection charges, or a universal medical-debt interest ceiling.

Branch Source-stated ceiling or condition
Uncontested judgment Court may award up to the lesser of $350 or 100% of outstanding principal, plus qualifying prejudgment and court-awarded postjudgment interest.
Contested judgment Court may award up to the lesser of $750 or 100% of outstanding principal, with the stated interest qualifications.
Successful postjudgment motion or writ application to a particular garnishee Up to $75.
Subsequent writ application to the same garnishee Up to $25.
Garnishment service charge The county-board fee under § 11-729 may be awarded; no county fee was looked up.
Supplemental contested-case award Requires the prescribed affirmative showing of gross disproportion and fees caused by a willful attempt to avoid a bona fide debt; the court then has discretion under Rule 54(e)(3).

[C018–C020; S003 § 48-305; S006–S007.] Justia Law

The complete incorporated Rule 54(e)(3) factor list was read: time/labor; difficulty; skill and experience; prevailing charges; fixed or contingent character; time limits; amount/results; undesirability; relationship; comparable awards; reasonable automated-research expense; and other appropriate factors. No factor is applied to an actual claim.

Section 11-729’s county fee structure is tied to specified service costs, interim-service treatment, and public fee criteria. It does not supply a statewide fixed dollar service charge.

3.2 Prevailing patient and noncompliant extraordinary collection

Provision Consequence in the text Qualification
§ 48-305(3) A prevailing patient in a contested judgment is entitled to the stated incurred costs, expenses, and attorney fees and has no liability to nonprevailing parties for their specified costs and prejudgment interest. No actual prevailing-party status is supplied.
§ 48-311(1) Noncompliant extraordinary collection removes liability for collection costs, expenses, fees, and pre- and postjudgment interest. Trigger is the defined noncompliant extraordinary collection.
§ 48-311(2) Liability to the patient for actual damages or $1,000, whichever is greater. Actual damages and statutory predicates remain necessary.
§ 48-311(3) On a court finding of willful or knowing violation, the court may award the stated enhanced amount: up to three times actual damages or $3,000, whichever is greater. No automatic enhancement or cumulative stacking of subsections (2) and (3) is assumed.
Successful enforcement action Costs and reasonable attorney fees as determined by the court. Not an accepted claim, standing determination, or guaranteed result.

[C021–C023.] Justia Law+1

The “notwithstanding law or agreement” language gives the specified provisions their stated overriding effect. It is not expanded into an unverified universal nonwaiver rule for every aspect of medical billing.

3.3 Principal, settlement, and cancellation

Section 48-312 preserves non-extraordinary methods of demanding or collecting principal. It does not establish:

  • That the billed principal is correct.
  • That insurance properly denied or reduced payment.
  • That a patient agreed to every service or charge.
  • A mandatory settlement percentage.
  • A universal installment-plan entitlement.
  • Cancellation of principal because a summary or final notice was late.
  • Permission to use deceptive, unlicensed, or otherwise prohibited collection methods.

[C024.] Judicial construction, debt validity, insurance liability, and actual settlement terms remain outside this pass. Justia Law

4. Effective-date and transition qualifications within the Patient Act

Instrument or clause Evidence actually recovered Application consequence and limit
2020 H0515 Introduced-version legislative text, including § 2; secondary passage history Stated effective date January 1, 2021. Final official session-law body was not recovered.
2021 chapter 13 / § 48-313 Complete 2025 reproduced section and source credit Special treatment for services/goods before July 1, 2021. Original adopted act was not recovered.
2022 H0778 Complete material amendment text and § 11 Sections 8 and 10 effective on passage/approval and retroactive to January 1, 2021; other specified sections effective on passage/approval for ECAs commenced then or later.
§ 48-315 Reproduced legislative-intent clause States the original January 1, 2021 date applies to ECAs commenced on/after that date regardless of service date.
2024 H0501 Engrossed text, medical-lien amendment, §§ 5–6 Application tied to services provided on/after passage/approval; immediate effectiveness.
Current official code Not recovered The historical texts do not certify every current 2026 clause or the absence of later amendments.

[C025–C026.] LegiScan+2

Retained wording mismatch

Section 48-313 still refers to the additional forty-five- and ninety-day periods, while the amended § 48-306 now uses forty-five and 180 days. Both bodies were read.

The older reference is not silently rewritten. Application to the legacy-service branch requires the original 2021 enactment, the later amendment relationship, and any necessary generic construction. [C025.] Justia Law+1

5. Public assistance, indigency, catastrophic costs, and residual reimbursement

5.1 The assistance question divides into four different regimes

Regime What was established What was not established
Former county medical-indigency/CAT program Repeal, transition, and rule-repeal evidence was recovered. A current general application entitlement under the former program.
Legacy assistance for earlier services The reproduced transition uses services received through March 31, 2022, processed under the chapter as it existed March 1, 2022. A current eligibility decision, application deadline, or appeal result.
Residual reimbursement A separate § 31-3503 continues to describe obligations and adjustment/settlement powers for specified historical assistance. Automatic discharge from program repeal.
Medicaid, insurance, and hospital financial assistance Separate legal categories; the federal hospital branch was examined below. A statewide uniform poverty threshold or equivalent coverage for every institution.

[C027–C034.] Justia Law+2

5.2 Repeal and transition chronology

Source Material change Status limit
2022 H0735 Repealed numerous medical-indigency provisions; renumbered the transition provision to § 31-3502 and reimbursement to § 31-3503; separated effective dates for different sections. Engrossed mirror plus secondary enactment history, not authenticated official final act.
Services through March 31, 2022 The transition provision directs treatment under the chapter as of March 1, 2022. These are two different dates with different functions.
2023 H0070 Cleanup of the repealed programs; changed the CAT-board repeal timing; repealed the CAT fund; added county settlement/full-lien-release authority to reimbursement. Introduced mirror and reproduced source history; final official act not recovered.
IDAPA 16.03.24 repeal Official rulemaking material records repeal of the entire medical-indigency rule chapter. Final-rule record gives April 6, 2023; temporary repeal record gives March 29, 2022. Relevant official prose read; PDF screenshot route failed, so no pixel confirmation is claimed.
2026 H0591 Text repeals § 31-3502, with a July 1, 2026 effective clause. One-page introduced mirror read and visually inspected; secondary status reports enactment as chapter 67, signed March 18, 2026. Official final body/status route was inaccessible.

[C027–C030.] LegiScan+4

The 2025 reproduction of § 31-3502 cannot be described as newly authenticated operative eligibility law in October 2026 in light of the recovered repeal evidence. Conversely, the repeal of that section cannot be used to declare that every prior application, reimbursement obligation, lien, or saved right disappeared.

5.3 Residual reimbursement is not current charity eligibility

The complete reproduced § 31-3503 provides:

  • Reimbursement of a reasonable portion of assistance paid for services received through March 31, 2022, based on resources over a reasonable time.
  • Possible later increase, up to the total assistance claim paid, on a substantial change in circumstances.
  • Review of a petition to reduce reimbursement following a substantial change.
  • Continued validity of the specified historical automatic liens.
  • State/county allocation and county authority to negotiate a settlement including full lien release on behalf of the state.

[C031.] Justia Law

The statutory recovery incorporations in §§ 56-218 and 56-218A, interstate enforcement, full lien procedure, and actual county implementation were not completed. The twenty-day objection language appearing in the interstate branch is not a current medical-assistance application appeal period.

5.4 Nonmedical aid is not a substitute medical program

Reproduced § 31-3401 concerns temporary nonmedical county assistance where no alternatives exist and rejects a general ongoing entitlement. It is not treated as a successor medical-bill forgiveness program. [C032.] Justia Law

No current uniform state income, asset, resource, or poverty-dollar threshold for medical-bill cancellation was authenticated. Historical eligibility/application/appeal provisions cannot be applied without the saved version and repeal analysis. No county resolution or provider policy was inspected. [C033–C034.]

6. Conditional federal hospital financial-assistance framework

6.1 Institutional scope comes first

The recovered official § 501(r) text and regulations concern the defined hospital organization and each qualifying facility it operates. The regulations distinguish state-recognized hospitals, direct/disregarded/partnership operation, unrelated activity, and specified partnership exceptions.

A facility not operated within the regulatory definition, a facility not required by a state to be recognized as a hospital, or unrelated-trade-or-business activity falls within the stated § 1.501(r)-2(e) limitations. No actual organization or facility is classified. [C035.] GovInfo+1

The grandfathered educational/scientific partnership branch includes its historical date, no-more-than-35% interest, governance, and compliance-control conditions. The § 707(b)(3) ownership incorporation was not completed; no exclusion is applied.

6.2 Required policy versus a uniform eligibility entitlement

A covered facility must establish and implement a written financial-assistance policy and emergency-care policy under the regulation. The FAP must address eligibility, whether assistance is free or discounted, the calculation basis, application method, collection actions or a separate collections policy, and the specified additional information and provider-coverage list.

The regulations do not supply one universal FPL percentage, asset ceiling, or identical benefit for all covered hospitals. They also distinguish the facility’s care from separately billed providers whose services may or may not be covered by its FAP. No actual policy or provider list was examined. [C036.] eCFR+1

Required publicity includes the website, free paper copies, admissions/emergency-department availability, community notification, a plain-language summary offered at intake or discharge, and billing-statement information. The translation rule uses the lesser of 1,000 persons or 5% of the relevant community/population language group under its terms. Electronic delivery requires the stated preference. [C037.] eCFR

The required emergency-care policy must not discourage emergency care through the prohibited collection/prepayment practices. The incorporated emergency-medical-condition definition and complete EMTALA obligations were not investigated; no care episode is classified.

6.3 Billed charges, AGB, and patient responsibility

For FAP-eligible emergency or other medically necessary care, the regulation limits the amount charged to amounts generally billed (AGB) to insured individuals. “Charged” for this purpose concerns the individual’s personal responsibility after the relevant reductions and reimbursements, not a bare gross-charge line or the combined amount paid by all sources.

Other FAP-covered care has the regulation’s less-than-gross-charges rule. The permitted look-back and prospective methods were read, but no facility percentage or dollar limit was calculated. [C038.] eCFR

The above-AGB safe harbor has conditions, including that the charge was not an upfront condition of medically necessary care, the specified absence of a completed application/determination at the relevant time, and correction if the individual is later found eligible. It is not general permission to overbill.

6.4 Federal ECA is not the Idaho definition

Conduct Federal hospital rule Difference from Idaho Patient Act
Debt sale Generally an ECA unless all conditions of the binding-agreement exception are met Idaho’s transfer branch contains a sixty-day timing element.
Adverse reporting ECA Idaho additionally has its specific reporting/judicial-action sequencing rule.
Judicial collection ECA under the defined list Both regimes still require their own coverage and exceptions.
Deferring/denying medically necessary care or requiring prepayment because of earlier unpaid FAP-covered care ECA, with a special reasonable-efforts route Not silently imported into Idaho’s enumerated definition.
Lien on specified injury judgments, settlements, or compromises Excluded from federal ECA definition under the stated condition Different from Idaho’s § 45-701/chapter 7 exception.
Bankruptcy proof of claim Not an ECA under this federal paragraph Not approval of the claim, its amount, or bankruptcy compliance.

[C039.] eCFR

Debt-sale exception

The federal non-ECA sale exception requires a binding agreement addressing no ECA, the stated interest limitation, return/recall conditions, and the combined-payment protection if the person is FAP-eligible. The interest reference is § 6621(a)(2) at the relevant sale time or the specified IRS-guidance alternative. That rate provision and any current guidance amount were not completed, so no numerical rate is supplied. [C040.]

6.5 Reasonable efforts: several routes, not one clock

Branch Required distinction
Presumptive eligibility The regulation permits qualifying third-party/prior determinations. Less-than-most-generous assistance requires the stated notice and reasonable opportunity to seek more.
Standard notification/application route Includes the 120-day no-ECA condition in that branch, the advance warning, plain-language summary, oral-notification effort, and processing duties.
Complete application Suspension, determination, written basis, and required remedial steps can establish reasonable efforts under its own paragraph.
Incomplete timely application Suspend covered ECAs and notify the person of missing required material and assistance contact information.
Care-deferral/denial/prepayment ECA Special expedited conditions and deadline relationships; not the ordinary timing branch.
No application Duties not dependent on receiving an application still apply; no blanket 240-day prohibition is inferred.
Waiver A signed waiver alone is not a determination of ineligibility and does not itself establish reasonable efforts.

[C041–C045.] eCFR+1

The application period begins with care and ordinarily extends at least to the 240th day after the first post-discharge billing statement is provided, with later deadlines under the specified notice or presumptive-eligibility branches. “Provided” is defined differently from Idaho’s receipt concept.

The standard warning deadline must be no earlier than thirty days after the notice is provided. Aggregated care has its own most-recent-care billing reference. These periods cannot be combined into a universal state or federal calendar.

6.6 Refund, reversal, and downstream collection

For a complete timely application followed by an eligible determination, the regulation requires the applicable revised patient-responsibility statement, refund of excess payments subject to the stated small-amount exception, and reasonably available reversal of ECAs, with exceptions for the debt sale itself and the specified care-deferral/denial ECA.

The text uses less than $5, or another IRS-published amount, for the refund exception. No determination was made that $5 is the only currently possible guidance amount. No refund amount is computed. [C043–C044.] eCFR

A hospital’s debt referral or sale, outside the special sale exception, requires an enforceable written agreement designed to preserve the reasonable-efforts, suspension, combined-payment, and reversal requirements. Downstream referral or sale during the application period requires the specified further agreement. [C046.] GovInfo

6.7 Tax consequences are not a state damage award

Section 1.501(r)-2 provides a facts-and-circumstances revocation framework, limited correction rules for minor errors, correction/disclosure relief for specified nonwillful and nonegregious failures, and a conditional noncompliant-facility income-tax regime.

These provisions do not establish an automatic loss of exemption for every error, a fixed patient damage award, or cancellation of every medical obligation. A state private cause, tax sanction, refund duty, and collection restriction remain distinct. [C047.] eCFR+1

The final regulations were effective December 29, 2014, but §§ 1.501(r)-1 through -6 generally apply to taxable years beginning after December 29, 2015. The original statute’s application notes use different dates. [C048.] GovInfo+2

7. Reporting, surprise billing, insurance, and other held interfaces

7.1 Reporting status

The CFPB’s official compliance page states that the 2025 medical-debt Regulation V rule was vacated on July 11, 2025. That is an agency status source, not an independent review of the underlying decision or subsequent treatment. No named opinion, docket, or order was opened. [C049.] Consumer Financial Protection Bureau

The official withdrawn-guidance list records the May 12, 2025 withdrawal of:

  • The 2024 medical-debt collection advisory opinion.
  • The 2022 medical-debt/No Surprises Act collection and reporting bulletin.

Withdrawal of guidance is not repeal of the governing statutes. No voluntary credit-bureau policy was inspected or converted into law. [C050.] Consumer Financial Protection Bureau

7.2 Precise special-regime dependencies

Subject Exact generic inquiry still needed Why the Idaho finding does not resolve it
Insured surprise/balance billing Complete 45 C.F.R. Part 149 scope, emergency and nonemergency provider restrictions, network predicates, and notice/consent exceptions Patient Act notices do not establish the lawful balance.
Uninsured/self-pay estimate disputes Complete §§ 149.610–149.620 definitions, notice, dispute and collection-related conditions No national estimate-dispute amount or deadline is imported here.
Emergency services Complete incorporated emergency-condition and EMTALA provisions “Emergency” is not determined from a bill label.
Medicare/Medicaid Coverage, beneficiary-billing, payment-in-full, cost-sharing, appeals, and recovery rules A payor name does not establish coverage or patient liability.
ERISA/self-funded plans Plan status, preemption, benefit claims and remedies Idaho’s payor definition is not an ERISA outcome.
State insurance law Complete applicable plan/claim, prompt-payment, appeal, and balance-billing provisions DOI guidance is a locator, not adjudication.
Medical liens Full Title 45, chapter 7 creation, timing, notice, enforcement, and priority § 48-303’s exception is conditional, not a lien approval.
Dishonored payment Complete § 28-22-105 and incorporated §§ 104/106 A statutory exception requires compliance, not merely a returned payment.
Military, older-adult, tribal, local or interstate law The applicable generic special regime No status, residence, jurisdiction, or actual care facts supplied.

14.3 Remaining gaps

The principal unresolved issues are:

  • Current official Idaho Patient Act bodies and the complete relevant enactment/amendment chain.
  • The legacy § 48-313 reference and later § 48-306 amendment relationship.
  • Final official authentication of the 2022–2026 assistance repeal/transition acts and the effect on any saved procedural rights.
  • Complete historical assistance eligibility/application/appeal rules where a saved branch genuinely requires them.
  • The specified lien, dishonored-payment, billing-code, insurance, tax, partnership, emergency-care, IRS-guidance, and benefit incorporations.
  • Full No Surprises Act, state insurance, Medicaid, Medicare, ERISA, FCRA, FDCPA, bankruptcy, military, older-adult, local, tribal, interstate, and judicial-construction questions.

No actual patient, household, provider, hospital, creditor, collector, insurer, account, bill, care episode, diagnosis, debt, policy, agreement, case, or transaction was evaluated. No application, dispute, complaint, payment, settlement, reporting, filing, or litigation instruction is supplied.

This is a researcher self-check, not independent review. The medical-sector inquiry is materially developed but remains partial and conditional at the exact source, version, incorporation, and construction gaps identified above. Earlier findings and holds remain preserved. No Idaho, dimension6/7, A066, parent, operational, or publication acceptance follows.

Generic role or category · Relevant rule · Boundary · 9 data rows

Generic role or categoryRelevant ruleBoundary
Health-care providerThe Idaho Patient Act definition includes the described licensed, accredited, or certified practitioner, a health-care facility, and their stated agents or third-party representatives.A marketing label does not establish qualification. The Act’s use of this term is not a separate collection license.
Health-care facilityThe definition extends beyond hospitals to the listed physical or virtual places and services where care is provided.Federal hospital tax rules have a narrower, separately defined institutional scope.
PatientIncludes the care recipient and the specified parent, guardian, or person contractually or otherwise financially liable.Inclusion in the definition does not independently prove that a particular parent, guardian, or other person owes a debt.
Billing entityAppears in the required summary and final-notice framework.A notice identifying a billing entity is not adjudication of the entity’s entitlement to payment.
Outside collector or debt buyer“No person” may take a covered extraordinary collection action without the Act’s conditions. The definition expressly addresses certain transfers and third-party collection authorization.Transfer or sale does not establish licensing, ownership, enforceability, or a federal exclusion.
Third-party payorIncorporates a health carrier under § 41-5903 and the identified private or public self-funded plans. Multiple payors may be involved. The payor definition does not determine coverage, network status, claim allowance, or ERISA treatment.
County/state legacy assistance programHistorical eligibility, transition, and reimbursement statutes govern a different relationship.Government assistance paid on a person’s behalf was not necessarily unconditional charity or discharge.
Covered federal hospital organization/facilitySection 501(r) and its regulations impose facility-specific conditions on the defined tax-exempt-hospital organization. Not every nonprofit, physician, facility, or hospital is automatically within the same federal branch.
Health plan or insurerInsurance and surprise-billing law may determine allowed charges, cost sharing, appeals, and payment responsibility. Those determinations cannot be derived from the Patient Act’s notice contents alone.

Sale, transfer, assignment, or authorization of third-party collection in another nameAn extraordinary collection action when undertaken before sixty days from receipt of the final notice.Later transfer falls outside that particular timing-defined branch, but other conduct and laws remain applicable. No general authority to sell or collect is established.
Adverse consumer reportingAn extraordinary collection action.Special timing and later-judicial-action consequences appear in § 48-304.
Judicial or legal action and related filings/recordingsAn extraordinary collection action, including the listed lien, seizure, suit, and wage-garnishment categories. The specific medical-lien exception must be separately satisfied.
Action under § 28-22-105Excluded only when pursuant to and in compliance with that provision.Complete dishonored-payment incorporations were not completed; no exception is applied.
Medical lien under § 45-701The Act does not prevent the specified authorized provider from filing the lien. The lien must comply with Title 45, chapter 7’s timeline and provisions. Full lien law remains held.
Non-extraordinary demand or collection of principalSection 48-312 preserves that category. It does not establish the debt’s validity or authorize conduct prohibited by other law.
