S_MN PASS-17 — Minnesota consumer money-debt court gateway
Research/access date: October 27, 2026, America/Los_Angeles / October 27, 2026 UTC.
Baseline: October 22, 2026; not represented as current verification.
Scope: Ordinary unsecured consumer contract/account actions in Minnesota district and conciliation court, from forum and service through response, default, and the set-aside gateway.
Disposition: The principal rules and several controlling constructions are established within the version and factual limits below. Important holds remain concerning actual jurisdiction, claim classification, service, admissible default proof, representation, particular vacatur grounds, local scheduling, and several statute/form inconsistencies.
P13 and P15 are not premises. P16’s earnings-discharge correction supplies no original-action deadline. Earlier reports and their provenance remain unchanged.
Throughout, S001 means S_MN-P17-S001. The source register supplies complete HTTPS URLs and actual read boundaries. C001–C080, V01–V120, and H01–H08 identify this pass’s claims, coverage rows, and remaining holds.
A. Court, claim, actor, and venue
A1. District and conciliation court are not interchangeable
| Gateway |
District court |
Conciliation court |
Consequence |
| General authority |
Section 484.01 supplies general civil jurisdiction |
A district-court division with the jurisdiction conferred by Chapter 491A |
A small dollar amount does not eliminate subject-matter or personal-jurisdiction requirements |
| Monetary limit |
No conciliation-style ceiling established for an ordinary contract action |
Generally $20,000; $4,000 for the specifically defined consumer-credit transaction |
Classification precedes selection of the cap |
| Type exclusions |
Ordinary jurisdiction and other controlling law apply |
Section 491A.01(4) excludes listed matters, including title to real estate, defamation, class actions, prejudgment remedies, eviction, medical malpractice, and specified equitable/family/probate matters |
A claimant cannot convert an excluded claim merely by requesting a small amount |
| Jury |
Applicable civil rules and actual demand control |
No conciliation jury trial; a properly removed case has its separate jury-demand procedure |
Removal is not merely a change of hearing room |
| Execution |
Separate judgment-enforcement rules |
Conciliation itself does not issue the stated execution writ or garnishment summons |
Enforcement is outside this pass |
| Real party |
Rule 17.01 applies, including its ratification/joinder/substitution safeguard |
Actual claimant and statutory conditions still matter |
A caption is not proof of ownership |
[C002–C004; S001–S002, S014.] MN Revisor+1
The $4,000 category is narrower than “consumer debt”
Section 491A.01(3a) requires a sale of personal property, or a loan arranged to facilitate that purchase, with all listed conditions: regular credit seller/lender, natural-person buyer, claimant as the seller/lender in the transaction, and primarily personal/family/household—not commercial, agricultural, or business—purpose.
Therefore, neither “credit card,” “consumer account,” nor “debt buyer” automatically resolves the applicable cap. Whether a particular assignee fits the claimant condition requires its own legal and factual analysis; no universal assignee result is established here. [C003; H01.] MN Revisor
A2. Venue and jurisdiction are separate
| Issue |
Operative rule |
Required facts / limit |
| Ordinary district venue |
Section 542.09 generally permits the county where a defendant resides at commencement or where the cause, or part of it, arose |
Actual residence, transaction and performance facts—not a mailing label |
| Corporate venue |
Section 542.09 supplies its office/agent/business-place rules and separate public-service-corporation treatment |
Do not substitute registered-office information for every possible venue fact |
| Venue demand as of right |
Section 542.10 uses a 20-day demand period after summons service, a supporting affidavit, and the specified filing within 30 days after demand service |
This is not the 21-day answer deadline |
| Discretionary transfer |
Section 542.11 addresses the stated agreement, impartiality, witness/convenience and other predicates |
A transfer requires the actual statutory basis and procedure |
| Conciliation territorial authority |
Section 491A.01 ordinarily uses county-based jurisdiction, with specified foreign-defendant, multiple-defendant and other exceptions |
Special student-loan, rental, dishonored-check and county-claim branches are not general account-debt venue rules |
| Out-of-state service/jurisdiction |
Section 543.19 requires its actual contacts and cause-related predicates |
Residence outside Minnesota neither automatically defeats nor establishes jurisdiction |
| Federal debt-collection venue |
15 USC 1692i applies to an actual covered debt collector and consumer debt; ordinarily the signing or commencement-residence district, with a separate real-property branch |
It supplies no substantive right to sue and does not establish state jurisdiction |
[C006–C009; S003–S004, S022.] MN Revisor+3
A federal venue violation, improper state venue, lack of subject-matter jurisdiction, and lack of personal jurisdiction are different questions with different consequences. No actual county or forum is selected in this report.
A3. Representation and the corporate-statute conflict
Individuals ordinarily may represent themselves. Conciliation permits the specified business representative under §491A.02 and its rules. District-court representation must be examined separately.
A material conflict must remain visible: §491A.02(4) still contains a small-corporation/LLC or association sentence concerning district removal. But:
- Nicollet Restoration, Inc. v. Turnham requires a corporation to appear through licensed counsel in district court and emphasizes judicial authority over court practice.
- Current Rule 521 expressly requires a corporation’s removal demand to be signed by its attorney.
- Rule 523’s commentary and current civil instructions identify the district-court counsel requirement.
Nicollet did not adjudicate every later statutory sentence or every entity form. Nevertheless, the printed statutory exception is not established permission for a corporation to proceed without counsel in district court. LLC, partnership and other entity applications require their actual status and governing authority. [C005, C063; H01.] Justia Law+1
B. District commencement and service
B1. The action, service, receipt, and court file are different events
| Event |
Rule and effect |
What is not established |
| Personal or qualifying substitute service |
Rule 3.01(a): commencement against that defendant when summons is served |
Filing a complaint alone is not this event |
| Signed waiver |
Rule 3.01(b), with Rule 4.05 |
Mailing a waiver request is not a signed waiver |
| Delivery to sheriff |
Rule 3.01(c): authorized delivery to the proper county sheriff, followed by actual service or legally available first publication within 60 days |
Any electronic delivery without required sheriff consent; mere intent to serve |
| Complaint delivery |
Rule 3.02 generally requires complaint with summons, except the publication procedure |
A summons alone is not universally sufficient |
| Court filing |
Rule 5.04 imposes separate filing requirements, including the one-year rule |
An unopened court file does not prove no action has commenced |
| Actual notice |
Important factual evidence |
It does not invariably cure defective service |
| Proof of service |
Rule 4.06 records time, place and manner |
Failure of proof is distinct from failure of service; a false affidavit does not create service |
| Amendment of service/proof |
Rule 4.07 permits the specified court-approved amendment absent material prejudice |
Not automatic correction of every jurisdictional defect |
[C010–C020.] MN Revisor+2
B2. Who serves whom, and how?
| Defendant/route |
Required method or predicate |
Factual hold |
| Individual personally |
Delivery by sheriff or qualifying nonparty adult under Rule 4.02, unless otherwise ordered |
Identity, date, time, actual delivery |
| Individual by abode service |
Usual place of abode; recipient of suitable age and discretion then residing there |
A visitor, workplace receptionist, former residence or unrelated address is not automatically sufficient |
| Partnership/association |
Rule 4.03(b)’s actual recipient category |
Actual membership/managing-agent status |
| Corporation |
Rule 4.03(c)’s officer, managing agent or authorized-agent conditions |
A job title, reception desk or acceptance of mail alone does not prove authority |
| Other entity/registered-agent statute |
Actual applicable entity and statutory service route |
Secretary-of-state and every entity-specific cross-reference were not fully examined |
| Out of state |
Applicable Rule 4 and §543.19 predicates |
Actual minimum contacts, cause connection, method and any federal/international service requirements |
| Publication |
Enumerated Rule 4.04 grounds, filed complaint/affidavit, required mailing or stated inability, and prescribed publication |
Mere inability to find a person, a belief statement, or actual awareness is not a universal substitute |
| Consent/waiver |
Actual consent or compliant signed waiver |
Generic contract language or an unreturned request is not presumed sufficient |
| Later electronic papers |
Rules 5 and General Rule 14 |
Later-paper e-service does not itself replace original summons service |
Thiele v. Stich held service on an office receptionist insufficient on its facts; actual knowledge did not cure that defect. Shamrock Development, Inc. v. Smith requires the actual publication predicates, not merely an affidavit of belief, and remanded for necessary factual determinations. [C012–C017.] Justia Law+1
Service proof and burden
The published service decisions require the actual jurisdictional facts to be established. An affidavit can supply prima facie evidence and affect the burden of producing contrary evidence; the precise dispute and record matter. No universal finding is made that either a debtor’s denial or a server’s form always controls.
Dwelling residence, the recipient’s residence there, age/discretion, entity-agent authority, identity, and actual delivery remain H02.
B3. Publication and a newly enacted 2026 provision
Rule 4.04’s publication procedure includes the enumerated grounds, the required affidavit, mailing where an address is known, and the prescribed publication duration. Rule 4.042 has its own appearance/complaint/answer sequence; it is not the ordinary 21 days from a personally delivered complaint.
Laws 2026, chapter 71, §2, establishing §484.085, was read. It permits a court website route only under the statute’s judicial-branch determination and court-publication predicates when an appropriate qualified local newspaper is unavailable. It does not authorize a private creditor to publish a summons on any website.
The standalone statute route failed; the enacted body was recovered. Its exact general effective-date classification and operational implementation were not completely resolved, particularly because the act also extends an appropriation. No worked example relies on the new website route. [C015–C016; H07.] MN Revisor
B4. Waiver of summons is not waiver of every defense
A compliant Rule 4.05 request includes the prescribed materials and gives a domestic recipient at least 30 days to return the waiver, or at least 60 days when sent outside the United States. A defendant who timely returns a waiver before formal service ordinarily receives 60 days from the request’s sending date to answer, or 90 days for the specified foreign case.
The signed date is material to commencement; the request’s sending date is material to the extended answer period. Personal-jurisdiction and venue objections are not waived merely by waiving summons service.
Unjustified failure to waive can produce the rule’s service-expense and motion-expense consequences, but only when its predicates are met. No such expense is calculated here. [C018–C019, C077.] MN Revisor+1
C. District response, filing, and default
C1. Response and preservation matrix
| Stage |
Required step/clock |
Exception or qualification |
| Ordinary answer |
Serve within 21 days after valid summons service |
Different statutory rule, waiver, proper motion or court order can change it |
| Proper Rule 12 motion |
Alters the response period under Rule 12.01 |
Negotiation or a document request is not automatically such a motion |
| Motion denied or postponed to trial |
Generally 14 days after service of notice of the court’s action |
Court may set another time; actual notice-service event matters |
| More definite statement granted |
Generally 14 days after service of the statement |
Actual order and service required |
| Personal-jurisdiction/process/service defenses |
Preserve through the applicable first-motion/pleading rules in 12.07–.08 |
Subject-matter jurisdiction is treated differently; venue demand has separate statutory requirements |
| Answer content |
Admissions, denials and affirmative defenses under Rule 8 |
Allegations requiring a response are not all safely ignored; damages are separately treated |
| Motion content |
Rule 7.02 requires particular grounds and relief |
A document’s label alone is not sufficient |
| Later-paper service |
Rule 5; ordinarily counsel if represented |
Ordinary email is not universal service |
| Filing after service |
Rule 5.04’s reasonable-time and one-year framework |
A timely served answer is not nullified solely because the claimant has not opened a court file |
| Extensions |
Actual enforceable agreement or court order; Rule 6.02 and nonextendable limits matter |
Informal settlement discussions do not necessarily alter a deadline |
| Electronic filing/service |
General Rule 14 status, election/order and transmission rules |
Filing and service are separate; a rejected filing does not necessarily mean no electronic service occurred |
[C021–C030.] MN Revisor+3
Section 481.08 recognizes specified attorney agreements in court minutes or signed writings. It does not make every informal exchange an extension, nor override every statutory or nonextendable deadline. The actual agreement and authority remain necessary. MN Revisor
A debt-dispute letter requires precise treatment
A generic request for documents, regulator complaint, negotiation, or “I disagree” message is not automatically a Rule 8 answer, Rule 12 motion, appearance, or stay.
But the assigned-consumer-debt statutory default notice expressly invites an Answer or written response contesting the debt. That specific provision must not be erased by saying “a letter never matters.” Its effect on a particular proposed default requires the actual response, delivery and procedural record. [C024, C026, C037.] MN Revisor
C2. Default is a requested judicial result, not an automatic balance finding
Minnesota Rule 55.01 differs from a shorthand federal “sum certain” description:
| Default branch |
Decision-maker and required showing |
Additional limits |
| Contract for payment of money only |
Court administrator acts on the prescribed request and affidavit of amount due |
Demand limits, service, assigned-debt law, protected persons and SCRA remain applicable |
| Other case |
Application to court |
Court determines the monetary relief or necessary proof |
| Party has appeared, within Rule 55.01(b) |
Written notice at least 14 days before the default hearing |
Actual appearance is fact-dependent |
| Nonmoney relief/accounting |
Court may require facts, accounting or reference |
No automatic relief beyond pleaded entitlement |
| Publication/out-of-state delivery |
Court may require the specified restitution security |
Actual court requirement and exceptions |
| Note/draft/bill of exchange |
The instrument must be filed as specified when judgment is entered |
Not satisfied by merely naming an instrument |
| Default relief |
Rule 54.03 limits relief |
Nonresponse does not authorize an unpleaded or excessive award |
Minnesota Rule 55.02 is not the federal-style set-aside rule. It addresses parties entitled to default and incorporates Rule 54.03. Relief from judgment is principally analyzed under Rule 60.02 and other actually applicable provisions. [C031–C033.] MN Revisor
General Rule 117 supplies default-hearing application requirements. Its affidavit treatment does not override §548.101’s express admissible-evidence requirements. [S017.]
C3. Assigned consumer debt: separate mandatory proof and notice
Section 548.101 applies where the obligation was incurred primarily for personal, family or household purposes and was in default when assigned.
| Required submission |
What must be established |
| Original terms |
Original written contract; if none exists, other admissible evidence of the account terms and amount entitlement |
| Liability |
Admissible evidence that this defendant owes the debt |
| Identifier |
Last four Social Security digits, if known |
| Balance |
Admissible charge-off/first-assignment balance and itemized later fees, interest and charges included in the request |
| Ownership chain |
Valid complete chain from original creditor to applicant, tying this specific debt to the assignments |
| District procedural proof |
Proper summons/complaint service and no timely answer |
| Conciliation procedural proof |
Reasonable efforts to give the administrator the correct debtor address |
| District advance default notice |
Mailing to last known address at least 14 days before the request/application/motion |
A periodic statement is not a universal substitute for every requirement. A document can satisfy multiple requirements if admissible, and the court may permit foundation by affidavit. Except for conciliation or a court-rule-required hearing, the court has the stated hearing/administrator alternatives. [C034–C037.] MN Revisor
These are default prerequisites, not a completed merits report on business records, assignments, account stated, licensing, limitations or standing.
C4. Military, minor, and competency safeguards
| Situation |
Required safeguard |
Consequence/limit |
| Defendant has not appeared |
50 USC 3931 requires supported military-status information, including an inability-to-determine statement where appropriate |
Unknown status cannot be converted into a false nonmilitary affidavit |
| Defendant is in military service |
Appointment of counsel before covered default judgment; specified stay provisions |
Counsel’s appointment is not a merits waiver |
| Status cannot be determined |
Court may require the stated bond |
Not automatic judgment permission |
| Counsel cannot protect absent servicemember |
At least 90-day stay when the statutory predicates are met |
Actual military/material-effect facts required |
| Default during service or within 60 days afterward |
§3931(g) reopening can apply on timely application within 90 days after service ends and the required material-effect/defense showing |
Not an automatic grant merely from military status |
| Servicemember has notice/appears |
§3932 is a distinct stay route with required duty/availability and command information |
A request does not waive jurisdictional defenses; prerequisites still matter |
| Minor or incompetent party |
Rule 17.02 requires the appropriate representative/guardian process |
Default cannot bypass the protective procedure or the guardian’s response opportunity |
No military database or actual individual status was queried. [C038–C041, C079.] US Code+2
C5. Entry and notice
An order for judgment, a default determination and an entered judgment are not the same event. Rule 58 makes the specified entry the operative judgment event. Rule 77.04 requires the administrator’s notice to affected parties, including the stated nonappearing-party treatment.
That administrative notice is not automatically every “notice of filing” or service event required by a different rule. Appeal and enforcement deadlines require their own triggers. [C042.] MN Revisor+1
D. District set-aside and vacatur
D1. Grounds, clocks and decision-maker
| Route |
Predicate |
Time and consequence |
| Rule 60.01 |
Clerical mistake or oversight/omission |
Court correction; not a method to rewrite a substantive merits decision |
| Rule 60.02(a) |
Mistake, inadvertence, surprise or excusable neglect |
Reasonable time and no more than one year after entry/taking |
| Rule 60.02(b) |
Newly discovered evidence meeting diligence and Rule 59 timing condition |
Same outer-year limitation |
| Rule 60.02(c) |
Fraud, misrepresentation or adverse-party misconduct |
Same outer-year limitation; fraud-on-court/independent-action boundaries remain separate |
| Rule 60.02(d) |
Judgment is void |
Text uses reasonable time; controlling void-service jurisprudence must also be applied |
| Rule 60.02(e) |
Satisfaction/release/discharge, reversal of predicate judgment, or specified prospective inequity |
Not a generic allegation that the judgment was wrong |
| Rule 60.02(f) |
Other qualifying reason |
Not established as a way to evade the specifically applicable one-year limits |
| Rule 4.043 |
Defendant not actually personally notified under its conditions |
Special route preserved by Rule 60; no universal publication judgment vacatur |
| Appeal/new trial |
Their own statutes/rules and triggers |
Not substituted for a Rule 60 motion; comprehensive appellate procedure deferred |
A Rule 60.02 motion does not itself suspend the judgment. Relief or a stay requires its own applicable authority and order/security conditions. [C043–C048.] MN Revisor+1
D2. Excusable default: four findings, not one favorable fact
Under Finden and Gams, the required showing addresses:
- a reasonable defense on the merits;
- a reasonable excuse for the failure;
- due diligence after learning of the judgment; and
- no substantial prejudice to the opposing party.
Gams requires affirmative establishment and findings on the factors; it does not authorize automatic relief whenever one factor is strong. Howard illustrates that the actual excuse and procedural record matter. [C044.] Justia Law+2
“Reasonable time” is not always one year. One year is an outer limit for specified grounds, not permission to wait that long regardless of circumstances. A claim learned of late does not automatically restart the one-year clock.
D3. Void service is different from excusable neglect
In Peterson v. Eishen, defective abode service was conceded. The court treated the judgment as void for lack of personal jurisdiction and did not impose the ordinary excusable-default merits test. It also reserved the possibility of extraordinary circumstances involving actual knowledge and delay.
Peralta holds that, on the assumed no-service/no-notice record, due process did not permit requiring a meritorious-defense showing as the price of undoing the deprivation. It does not declare every technical service objection meritorious.
Thus:
- actual service facts must be decided;
- actual notice does not invariably cure invalid service;
- not every legal error makes a judgment void; and
- no automatic vacatur or unlimited-delay permission is inferred for a real defendant.

E. Conciliation court: separate filing, service, hearing and reopening rules
E1. Current July 2026 procedure
| Stage |
Actual rule |
Required event or proof |
| Commencement |
Rule 505 |
File required statement and fee, or satisfy the specified fee-affidavit/waiver route |
| Claim |
Rule 507 |
Required facts, amounts, names/addresses, certification and military information if known |
| Trial setting |
Rule 508(a) |
Ordinarily at least 28 days from summons mailing/service unless judge orders otherwise |
| Claim not exceeding $2,500 |
Rule 508(d) |
Administrator first-class-mail route where territorial predicates fit |
| Claim over $2,500 |
Rule 508(d) |
Plaintiff certified-mail service and proof; authorized alternative/special service must actually fit |
| Out-of-state defendant |
Rule 508(d)(3) |
Plaintiff causes service under applicable law and files proof |
| Service completion/proof |
Rule 508 |
Proper service and proof within 60 days after summons issuance; otherwise stated dismissal without prejudice |
| Mail service |
Rule 508(d)(4) |
Complete upon mailing, subject to valid address and all governing predicates |
| Electronic service |
Rule 508(f), General Rule 14 |
Qualified electronic method, not arbitrary email replacing required personal/special service |
| Counterclaim |
Rule 509 |
Prescribed service, filing and fee/waiver at least 14 days before trial |
| Oversized counterclaim |
Rule 510 |
Separate removal/dismissal framework, not unilateral expansion of conciliation jurisdiction |
| Exhibits |
Rule 512 |
Upload to MNDES and provide to other parties at least three days before trial, unless judge directs otherwise; stated alternatives for access/good cause |
| Nonappearance |
Rule 512 |
Court may default/dismiss after proper notice and necessary proof |
| Remote appearance |
Actual summons/order and applicable remote-hearing rule |
A scheduled remote appearance is not permission to use any platform or ignore check-in requirements |
[C049–C056.] MN Revisor+1
New electronic hearing-reminder requirement
For the specifically defined consumer-credit transaction, when plaintiff and defendant previously communicated electronically, current Rule 508(d)(5) requires an additional hearing reminder through the form of electronic messaging previously used.
Before the hearing, plaintiff must file the specified affidavit addressing whether prior electronic communication occurred and, if so, the reminder’s date, time and medium. Failure may result in denial of default.
This reminder supplements the summons; it does not replace proper mail or other service. [C052.] MN Revisor
Wrong address and failed delivery
“Complete on mailing” is not permission to use a known false address. Assigned-consumer-debt defaults separately require reasonable efforts to provide the correct address. Proper notice, due process, failed service, and the current Rule 520 grounds remain distinct.
The exact effect of a returned envelope or failed certified delivery requires the actual address, mailing, return reason, reasonable efforts and court determination. No universal “returned mail always void” or “mailing always sufficient” rule is supplied.
E2. Conciliation entry, stay, vacation and removal
| Route/event |
Trigger and required acts |
Decision/consequence |
| Judgment notice |
Rule 514 |
Must identify the pertinent judgment, stay and relief dates |
| Initial effectiveness/stay |
Rule 515 |
Generally 21 days after administrator transmits notice, subject to actual service additions and specified exceptions |
| Early default vacation |
Rule 520(a) |
Judge may vacate within the 21-day period on the stated lack-of-notice/mistake/inadvertence/excusable-neglect showing |
| Later default vacation |
Rule 520(b) |
Specified nonreceipt circumstances or other good cause; reasonable time after learning; district-motion procedure filed in conciliation court |
| New trial/cost condition |
Rule 520 |
New trial follows vacatur; court may impose costs not exceeding $50 as specified |
| Full removal |
Rule 521(a)–(b) |
Aggrieved party after contested trial performs all required service, filing, good-faith affidavit and fee/waiver acts |
| Removal perfected |
Rule 521(d) |
Court issues the specified vacating/transfer order as to removing parties |
| Denied vacation |
Rule 521(e) |
Limited removal for de novo review of the vacation decision; different district judge and return to conciliation as prescribed |
| Formal pleadings after removal |
Rule 522 |
Conciliation pleadings stand unless replaced within the specified period; an unanswered formal pleading has the rule’s deemed-denied treatment |
| District practice after removal |
Rule 523 |
Civil rules and counsel requirements apply as provided; no automatic transfer of every small-claims exception |
[C057–C063.] MN Revisor+2
The 21-day clocks are not ordinary district answer clocks
Rule 503 governs conciliation counting. Its current text supplies three additional days for qualifying U.S.-mail service and one additional day for qualifying nonmail service after 5 p.m. Minnesota time.
Rule 520(a) speaks of the judge vacating within the period, not merely the party lodging any request by the last day. Rule 520(b) is not universally governed by Rule 60.02’s one-year limit.
Full de novo removal normally follows a contested trial. A defaulting party’s route is ordinarily the vacation gateway and, if denied, the limited-removal procedure—not simply asserting entitlement to a new merits trial under Rule 521(a). [C057–C061.] MN Revisor+1
In Roehrdanz v. Brill, the Supreme Court held that the applicable conciliation-removal rule permitted first-class-mail service without the old district acknowledgment requirement. The historical 20-day period in that opinion is not substituted for today’s 21-day text. [S048.]

H. Eighteen fictional workflows
| Posture |
Fictional facts |
Required next step or hold |
| P01 — Personal service |
Nonparty adult hands both papers to the named individual |
If valid, calculate Rule 12 response from actual service; proof and identity remain necessary |
| P02 — Substitute residence unknown |
Papers left with a person at a former address |
Usual abode and recipient’s residence/discretion are unproved; no unconditional answer date |
| P03 — Waiver request only |
Request mailed, never signed/returned |
No waiver commencement or extended-answer entitlement established |
| P04 — Entity receptionist |
Front-desk worker accepts papers |
Actual officer/managing/authorized-agent status must be proved |
| P05 — Answer served, file unopened |
Defendant timely serves answer before plaintiff files |
No default merely because no court file yet exists; later filing requirements remain |
| P06 — Proper motion |
Timely Rule 12 motion served |
Apply actual motion/order and subsequent response trigger |
| P07 — Negotiation only |
Parties discuss payment, no binding extension/order |
Do not assume response period or enforcement is stayed |
| P08 — Appearing nonanswering party |
Notice of appearance served, no answer |
Appearance notice protection and response failure are different |
| P09 — Assigned debt with missing chain |
No answer, but assignment does not identify the account |
Default prerequisites remain unsatisfied despite nonresponse |
| P10 — Military status unknown |
No appearance; plaintiff cannot determine service status |
Truthful supported inability statement and court safeguards, not invented nonmilitary status |
| P11 — Void-service allegation |
Defendant says no valid service ever occurred |
Court must determine actual jurisdictional facts; ordinary neglect test is not assumed |
| P12 — Uneven excuse factors |
Some balance defense, weak excuse, prompt motion, disputed prejudice |
All applicable factors require findings; no automatic balancing shortcut |
| P13 — Exact $2,500 conciliation claim |
In-county natural-person defendant |
Rule 508 threshold—not CCT100’s omitted boundary—controls |
| P14 — Returned conciliation mail |
Court/plaintiff learns address is wrong |
Correct-address efforts, service and notice must be resolved; mailing alone does not prove due process |
| P15 — Electronic history |
Consumer-credit parties previously used text |
Additional reminder and affidavit duty, not substitute summons service |
| P16 — Conciliation nonappearance |
Proper notice alleged, defendant absent |
Court proof/default safeguards still apply; Rule 520 pathway is separate |
| P17 — Contested-trial removal |
Aggrieved party timely completes all Rule 521 acts |
Court’s vacating/transfer order follows; mere intent or one form is insufficient |
| P18 — Late vacatur/denial |
Party learns later, seeks Rule 520(b) relief, then receives denial |
Reasonable-time/good-cause facts and limited-removal route—not automatic merits retrial |
[C068–C073.] None is an actual actor, service, eligibility or permission determination.
I. Four worked dated/proof models
Common assumptions
All dates are fictional 2026 dates. Local procedural time means Minnesota time, not the user’s Pacific time. Unless expressly varied, service/transmission occurs before 5 p.m.; endpoints are accessible weekdays; no special order changes time; and no extraordinary court closure or additional postal holiday is assumed.
Intervening weekends and holidays count in the calendar-day periods. A service-based mail addition is applied only where the governing rule actually supplies it. No filing, service or contact occurs through this research.
M01 — Valid personal service, an unopened file, and motion versus negotiation
Claim accounting
Plain text
Original claimed principal: $4,000
Actually credited payment: $500
Claimed unpaid principal: $3,500
Stipulated new interest/fees: $0
The $3,500 is a claimed balance, not an adjudicated amount.
Main route
- Tuesday, September 1, 3 p.m.: qualifying nonparty adult personally delivers summons and complaint to the individual.
- Monday, September 21: defendant serves a responsive answer.
- Plaintiff opens the court file October 1.
- Defendant files the answer October 2; the model assumes this is within the applicable reasonable-time requirement.
Plain text
September 1: trigger excluded.
September 2–22: 21 calendar days.
Ordinary answer endpoint: Tuesday, September 22.
No mail or after-hours addition applies. The answer is served before the endpoint. The unopened file does not excuse missing service of an answer, and it does not make the served answer nonexistent.
For a separate venue demand, §542.10’s 20-day period would reach September 21, subject to actual venue facts and its own affidavit/filing requirements. It is not the same as the answer clock.
Proper-motion alternative
Instead of the answer, assume a proper Rule 12 motion is timely served September 15. Notice of the denial is personally served Thursday, October 1.
Plain text
October 1: excluded.
October 2–15: 14 days.
Resulting response endpoint: Thursday, October 15,
unless the court orders another time.
Negotiation alternative
A September 15 payment discussion, document request or regulator complaint is not assumed to be the Rule 12 motion or a binding extension. Without another valid event, the September 22 response endpoint remains the candidate.
Outcome: No default is supported in the timely-answer branch. In the negotiation-only branch, response failure still does not establish debt validity or automatic judgment. [C069.]
M02 — Waiver request, missing return, disputed abode and entity service
Compliant waiver branch
- Monday, July 6: plaintiff sends a compliant domestic waiver request and required materials.
- Monday, July 20: defendant signs.
- Wednesday, July 22: waiver returned before formal service.
- Thursday, July 23: plaintiff files it as required.
Minimum 30-day return opportunity:
Plain text
July 7–31 = 25 days.
August 1–5 = 5 days.
Total = 30.
Minimum return-period endpoint: Wednesday, August 5.
Extended answer period:
Plain text
July 7–31 = 25
August = 31 cumulative 56
September 1–4 = 4
Total = 60
Answer endpoint: Friday, September 4.
The commencement event in this branch is the July 20 signature, not July 6 mailing. No additional three mail days are added to the expressly request-sent-based 60-day calculation.
Unreturned request branch
No signature or return occurs. The request does not establish service. Suppose valid personal service instead occurs Monday, August 10:
Plain text
August 11–31 = 21 days.
Answer endpoint: Monday, August 31.
Disputed substitute-service branch
If August 10 instead involved leaving papers with a person at an address, and usual abode/residency/discretion remain unproved, August 31 is only the conditional date if service was valid. Actual receipt of a later copy does not conclusively cure the defect.
Entity branch
If papers were delivered to a receptionist for a corporate defendant, officer/managing-agent/authorized-agent status must be established. The model does not assign an unconditional response deadline from acceptance alone.
Outcome: A correct calendar does not establish valid service. No expense award for failure to waive is assumed. [C070.]
M03 — Appearance, assigned-debt proof, default notice and alternative vacatur
Facts
- Assigned household debt was in default at assignment.
- Claimed opening amount: $4,000.
- Actual preaction credit: $500.
- Correctly stated claimed remainder: $3,500.
- Valid personal service: Monday, July 6.
- Defendant serves a notice of appearance July 20, but no answer.
Plain text
July 7–27 = 21 days.
Ordinary answer endpoint: Monday, July 27.
Separate default notices
- Statutory intent notice mailed Monday, August 3.
- Default application made Tuesday, August 18.
- Court sets a default hearing for Tuesday, September 1.
- Appearing defendant personally receives hearing notice Tuesday, August 18.
Assigned-debt minimum interval:
Plain text
August 4–17 = 14 days.
Application August 18 is later than that minimum.
Hearing notice interval:
Plain text
August 19–31 = 13 days.
September 1 = 1 day.
Total = 14 days.
The two notices have different predicates and endpoints. Neither notice repairs missing admissible evidence.
Missing-proof branch
The submitted assignment documents do not tie the defendant’s account to the chain, the balance affidavit omits the $500 payment, and military status is unverified.
Result: The model does not establish entitlement to default. A request for $4,000 is not justified by failure to answer. A truthful SCRA status showing and the statutory evidence must be addressed.
Complete-proof, entered-judgment alternative
Only for a separate hypothetical branch, assume all prerequisites are satisfied and judgment is actually entered Thursday, September 3 for $3,500.
Defendant learns September 8 and files a supported Rule 60 motion September 21:
Plain text
Entry to motion: September 4–21 = 18 days.
Knowledge to motion: September 9–21 = 13 days.
The one-year outer date for grounds (a)–(c) would be September 3, 2027, subject to applicable counting and reasonable-time analysis. Filing in 18 days is not automatic entitlement.
| Factor |
Stipulated showing |
Assessment held |
| Merits defense |
A documented payment or account-specific defense is offered |
Must be a reasonable defense, not just dissatisfaction |
| Excuse |
Defendant thought negotiations delayed the answer, with no proved extension |
Potentially weak; no finding supplied |
| Diligence |
Motion 13 days after learning |
Favorable timing evidence, not conclusive |
| Prejudice |
No identified loss beyond ordinary delay, but opposing evidence unknown |
Court must determine |
A different branch alleging invalid original service invokes the jurisdiction/voidness analysis. It does not automatically require the same merits showing, but the service defect must actually be established.
No stay, vacatur or collection permission follows merely from the motion’s filing. [C071.]
M04 — Conciliation mail service, default vacation and contested-trial removal
Claim and service
Assume an original seller’s $3,500 financed personal-property claim satisfies all four narrow consumer-credit conditions, lies within the proper county/territorial authority, and is not otherwise excluded.
- September 1: statement and required filing fee FcF_cFc, or a qualifying fee-waiver filing, satisfy commencement.
- September 2: summons issued.
- September 4: plaintiff sends valid certified-mail service because the claim exceeds $2,500.
- September 8: actual delivery.
- September 10: proof filed.
- October 5: trial.
Plain text
Mail service completion under this route: September 4.
September 5–30 = 26 days.
October 1–5 = 5 days.
Total before trial = 31 days, exceeding the ordinary28-day minimum.
Actual delivery September 8 is not substituted as the rule’s mailing-completion date. Proper address and valid mailing are stipulated; the failed-address branch remains a separate factual problem.
The parties previously used email. Plaintiff sends the required hearing reminder September 15 and files its Rule 508(d)(5) affidavit September 25. Exhibits are uploaded and shared October 1, four days before trial. Any counterclaim must satisfy its own 14-day rule; no ordinary district 21-day answer is imported.
Default branch
Defendant fails to appear. The court still needs proper notice, supporting claim proof and applicable SCRA safeguards. Assume the court orders judgment and electronically transmits notice to a properly registered recipient at noon Tuesday, October 6.
Plain text
October 7–27 = 21 days.
No mail or after5p.m. addition.
Modeled stay/early-relief endpoint: Tuesday, October 27.
Alternative transmissions:
- U.S. mail October 6: three-day addition gives October 30, on these assumptions.
- Qualifying nonmail service after 5 p.m. October 6: one-day addition gives October 28.
These are separate branches, not cumulative additions to the noon electronic branch.
For Rule 520(a), assume a request October 15 and an actual judicial vacating order October 20. The timely judicial act—not merely lodging a request—satisfies the modeled early route. Any costs, if ordered, are no more than the verified $50 limit; the model assumes none.
Later-learning branch
If the party instead learns of the judgment November 3 and moves November 4, one elapsed day supports diligence but does not prove the required nonreceipt circumstances or other good cause. Rule 520(b), not an automatically imported Rule 60 one-year rule, supplies the relevant gateway.
Contested-trial alternative
If both sides contested the October 5 trial, a qualifying aggrieved party could complete all Rule 521 acts by the applicable deadline. Assume service, filing, good-faith affidavit and fee FdF_dFd/waiver are completed October 26.
The court then issues the prescribed vacating/transfer order. Formal pleading after removal has Rule 522’s distinct deemed-denied treatment; no ordinary answer-default assumption is imported.
Denial-of-vacation alternative
If notice of denial is properly transmitted at noon November 10:
Plain text
November 11–30 = 20 days.
December 1 = 1 day.
Total = 21.
Candidate limited-removal endpoint: Tuesday, December 1.
Intervening holidays count; no endpoint holiday is assumed. This removal concerns the vacation decision before a different judge, not automatic merits retrial.
FcF_cFc, FdF_dFd, and any jury fee FjF_jFj remain variables. No unverified fee is presented as current law. [C072.]

Actually read: The identified statutes, current clean court rules, necessary federal venue and SCRA provisions, selected enacted amendments and final rule orders, official forms, and material majority bodies/dispositions. Relevant PDF pages were visually inspected; no complete pixel certificate is claimed.
Not established: A real forum, claimant, service, residence, agent, military status, debt amount, assignment chain, appearance, excuse, order, deadline, fee or entitlement. No account, docket, private record, completed form, filing or contact was used.
The models distinguish valid service, actual receipt, waiver, court-file opening, response, appearance, notice, proof, order, entry, vacation and removal. Their calendars do not validate the underlying service or facts.
Bottom line: District and conciliation procedure must be kept separate. Valid service—not mere receipt or an unopened file—controls the ordinary district response analysis. Default still requires its applicable proof and safeguards. Reopening depends on the actual ground and court-specific route; neither a missed answer nor a filed motion automatically decides liability or stays enforcement.
No independent review, actual filing/service/collection permission, operational approval, full-state or parent completion, A066, A097 or A098 acceptance is claimed.
