S_MN PASS-16 — Bounded correction supplement to PASS-14
Fresh research/access date: October 27, 2026 Pacific / October 27, 2026 UTC.
Correction: §571.79(h)’s later-of-disclosure-service-or-actual-return trigger.
The reviewer’s concern is supported. PASS-14’s July 17 → August 6 calculation is arithmetically correct, but incomplete if presented as the final §571.79(h) endpoint when funds are actually returned later. The statute expressly uses “whichever is later.” The correct treatment is two conditional calculations—not one unconditional deadline. [P16-C001, C010–C012.] revisor.mn.gov
This supplement does not replace the original report or alter its raw history. The supplied PASS-14 acceptance/capture metadata, response identifier, model provenance, hash-review results, and original 44 source groups, 64 claims, 70 coverage rows, H01–H08, and seven separate crosswalk rows remain historical records. They were not independently reverified here. PASS-15’s unreviewed limitations findings are not premises.
A. Verified statutory correction
A1. What §571.79(h) requires
The complete paragraph establishes:
| Element |
Verified requirement |
Qualification |
| Actor |
An interested person |
Not exclusively the creditor |
| Twenty-day trigger |
Later of disclosure service or actual return of the specified debtor property |
Nominal expiration of retention is not proof of return |
| Act required |
Service of either a garnishment-related motion or the specified supplemental-complaint motion |
Filing alone is not the event named here |
| Hearing condition |
Motion scheduled to be heard within 30 days after motion service |
Not 30 days after disclosure or return |
| Discharge/vacatur language |
Paragraph includes court vacatur upon a proper showing |
A calculated date alone does not establish a stay, vacatur, renewed retention, or entitlement |
The supplemental-complaint alternative cross-references §571.75(4), which separately addresses creditor notice, alleged liability, probable cause and service of the supplemental pleading. This supplement does not replace those requirements with deadline arithmetic. [P16-C001–C003, C007.] MN Revisor+1
A2. Necessary surrounding discharge provisions
| Paragraph |
Distinction preserved |
| (a) |
Disclosure denies attachable indebtedness/property; the paragraph nevertheless preserves the specified retention duty for disclosed nonexempt property. |
| (b) |
Disclosure acknowledges indebtedness; conclusiveness does not eliminate the stated retention duty. |
| (c) |
Prejudgment service plus retained property: the 270-day discharge/return provision, subject to paragraph (h). |
| (d) |
Postjudgment service plus retained property: the 180-day discharge/return provision, subject to paragraph (h). |
| (g) |
Discharge under (a)–(d) is not, by itself, determinative of rights under another summons, subject to the stated adjudication qualification. |
The corresponding enacted language was also read in Laws 2000, chapter 405, §20. These different discharge predicates must not be collapsed into a universal return, stay, or resumption rule. [P16-C004–C005.] MN Revisor
Section 571.78 separately distinguishes remittance to the creditor from return to the debtor. Its return obligation does not establish that a particular return actually occurred. PASS-14’s 90-day-form-payment harmonization hold remains unchanged. [P16-C006.] MN Revisor
B. Corrected fictional calculations
B1. Shared assumptions
Each calculation assumes 2026, personal service/receipt before 5 p.m. Minnesota time, no mail addition, no different governing court order, and no separately declared holiday, postal nonoperation, or court-office inaccessibility affecting the endpoint.
Rule 6.01 excludes the triggering day, counts intervening calendar days, and extends a Saturday/Sunday/legal-holiday endpoint as prescribed. Its mail and after-5-p.m. additions are not applied on these facts. Office-inaccessibility and filing-end-time provisions are not converted into a universal motion-service cutoff. [P16-C008–C009.] MN Revisor
B2. Branch A — Disclosure-date-only calculation
Stipulated event: Garnishee’s disclosure personally served Friday, July 17, 2026.
| Counting step |
Days |
| July 17, triggering day |
Excluded |
| July 18–31 |
14 |
| August 1–6 |
6 |
| Total |
20 |
Disclosure-based endpoint: Thursday, August 6, 2026.
This preserves the original arithmetic. It is not a conclusion that August 6 remains the final paragraph-(h) endpoint when a later qualifying return occurs. [P16-C010.]
B3. Branch B — Actual later return stipulated
Additional hypothetical fact: Funds are actually returned to the debtor Wednesday, October 14, 2026, and that is the later relevant event.
| Counting step |
Days |
| October 14, triggering day |
Excluded |
| October 15–31 |
17 |
| November 1–3 |
3 |
| Total |
20 |
Later-return-based endpoint: Tuesday, November 3, 2026.
The dates and weekdays were independently calculated. August 6 and November 3 are not holidays listed in §645.44(5). November 3 is not made a legal holiday by that provision merely because it is election day. No additional closure or postal-nonoperation fact is assumed. [P16-C009–C011.] MN Revisor
Critical qualification: PASS-14’s nominal 180-day endpoint of October 14 does not prove that money was returned that day. If actual return is unestablished, the return-based endpoint—and therefore a definitive later-event deadline—remains unknown. The known disclosure-date calculation does not authorize indefinite delay while awaiting an assumed future return.
No actual motion-service date is stipulated, so no actual 30-day hearing endpoint is calculated. Nor is proper service, a scheduled hearing, a proper showing, or vacatur assumed. [P16-C002–C003, C012.]
B4. Ledger preserved only in the stipulated actual-return branch
Plain text
Previously withheld: $600
Actually returned to debtor: $600
Remitted to creditor: $0
Still held: $0
$600 = $600 returned + $0 remitted + $0 held.
Creditor principal: $4,000
Actual creditor payment credit: $0
Remaining principal: $4,000
The return does not pay or extinguish the debt. The corrected deadline calculation does not create a new credit, recovery entitlement, or permission to resume withholding. [P16-C013.]
C. Execution-route comparison: no later-return transplant
The freshly read execution provisions differ from §571.79(h).
| Route |
Paragraph (a) trigger and requirement |
Paragraph (b), read only as necessary |
| Sheriff execution — §550.135(14) |
Interested person serves an execution-related motion within 20 days after service of the third party’s disclosure; hearing scheduled within 30 days after motion service |
Separate creditor motion for supplemental-complaint leave under subdivision 8 and court vacatur upon proper showing |
| Attorney execution — §551.04(15) |
Same disclosure-service-only trigger in paragraph (a) |
Corresponding separate subdivision-8/vacatur provision |
Neither paragraph (a) contains §571.79(h)’s later-return alternative. The execution provisions’ adjacent discharge and supplemental-complaint qualifications remain applicable; they are not replaced by a generic deadline. [P16-C014–C015.] revisor.mn.gov+1
PASS-14 M04 calculation retained
Stipulated disclosure service: Friday, May 29, 2026, personally before 5 p.m.
Plain text
May 29: excluded.
May 30–31: 2 days.
June 1–18: 18 days.
Total: 20 days.
Endpoint: Thursday, June 18, 2026.
June 18 is not a listed holiday; Juneteenth is June 19. No modeled endpoint extension applies. The calculation remains subject to the actual execution route, motion purpose, service and hearing requirements. A later debtor return is not substituted as a new paragraph-(a) trigger. [P16-C009, C016.] MN Revisor
D. Exact PASS-14 replacement and annotation text
These are correction instructions for the identified passages, not changes to immutable originals.
D1. Canonical replacement text
R1 — Replace PASS-14 C012’s assertion and B1’s qualification description
Section 571.79(h)’s twenty-day motion-service calculation uses the later of disclosure service or an actual return of the specified property to the debtor. Apply its two stated motion alternatives, the thirty-day scheduled-hearing condition measured from motion service, and its court-on-proper-showing vacatur language. A calculated endpoint alone establishes neither procedural compliance nor substantive relief.
Authority: S_MN-P16-S001, paragraph (h); S009, §20. MN Revisor+1
R2 — Replace the final paragraph of PASS-14 M01 Branch C
A separate interested-party motion can affect this branch, subject to §571.79(h)’s complete conditions. For disclosure personally served before 5 p.m. on July 17, 2026, the disclosure-date-only calculation is July 18–31 (14 days) plus August 1–6 (6 days): Thursday, August 6. That is not the final endpoint for a later-return branch. Only if funds are actually returned to the debtor on October 14, 2026 and that is the later relevant event, October 15–31 (17 days) plus November 1–3 (3 days) produces Tuesday, November 3. The nominal 180-day date does not establish actual return. Without the relevant return facts, the actual later-event deadline remains unresolved. The motion-service, scheduled-hearing and discharge/vacatur predicates remain necessary; no indefinite stay, automatic vacatur or collection entitlement is inferred.
The date arithmetic is independently checked; its legal selection follows R1. The preceding $600-return ledger remains conditional as specified in section B4.
R3 — Replace PASS-14 C057’s assertion
M01’s original arithmetic remains correct. Branch C now distinguishes the August 6 disclosure-based calculation from the November 3 calculation conditioned on an actual later October 14 return. Neither a return, proper motion, hearing, vacatur nor lawful continued holding is established merely by the calendar. The stipulated actual-return ledger remains $600 returned, $0 remitted, $0 held, with $4,000 principal unchanged.

No substantive replacement by this supplement |
V58’s counting-rule finding remains supported; no separate correction to its legal rule is needed. The new dates are annotations to the affected M01 analysis, not a new statewide coverage item.

H. Preservation statement and self-check
The fresh work was limited to the identified statutory bodies, Rule 6, the incorporated holiday definition, one narrow supplemental-complaint cross-reference, the selected 2000 enacted paragraph, and a bounded 2026 index check. The three date differences and weekdays were recalculated; the stipulated cash equation was checked.
All unrelated PASS-14 holds remain: the 90-day statutory-form payment conflict; absence of an automatic six-business-day employer-release rule; actual percentage-error motion/proof/recipient/calendar questions; employer postorder mechanics; the §551.06 sheriff-versus-attorney conflict; exact direct/indirect tier incorporation and older-case issues; form multiplier/units/revision defects; and incomplete responsive-construction, citator, later-law and actual-record coverage. Irregular pay, tips, benefits, sector, local/tribal, territorial/country and contract issues remain outside this correction.
This supplement contains 9 source/access entries, 18 atomic claims, 16 coverage rows, two conditional garnishment-date examples and one unchanged execution-date comparison. It does not alter the original PASS-14 counts or convert correction coverage into a newly accepted state dimension.
Final correction: August 6 is valid as the disclosure-date calculation. November 3 is valid only on the expressly stipulated actual later October 14 return. Neither date establishes an actual filing deadline, court order, stay, vacatur, renewed collection authority, or payment entitlement.
