S_MN PASS-13 — Bank-account and non-earnings garnishment, exemptions, tracing, and release
Research/access date: October 27, 2026, America/Los_Angeles.
Baseline: October 22, 2026; not represented as the date of current verification.
Scope: Ordinary civil consumer money-judgment collection from deposit accounts and other non-earnings obligations, protected-fund tracing, and the claim–objection–hearing–release process.
Disposition: The principal statutory routes, federal account-review requirements, and several tracing rules are established within the version limits below. Material holds remain concerning particular ownership and exemption facts, older-action applicability, some statutory-form inconsistencies, certain cross-references, and the application of exemptions to converted assets or specialized accounts.
P12 is not a premise. Necessary provisions, forms, and opinions were freshly examined. Earlier reports, source-access histories, model provenance, and review limitations remain unchanged.
Throughout, S001 means S_MN-P13-S001. Each source identifier resolves to its complete HTTPS URL, operative pinpoint, read scope, and limitations in section I. Claims C001–C068 belong to this pass.
A. Conclusions that control this component
A1. There are three materially different routes
Chapter 571 garnishment, sheriff execution under §§550.135–550.143, and attorney summary execution under Chapter 551 have different issuers, limits, disclosure provisions, and remittance mechanisms.
Most importantly, failure to claim within the initial bank-notice period does not have the same consequence under all three:
- Chapter 571: the money remains subject to garnishment; that sentence does not itself direct immediate payment to the creditor.
- Sheriff execution: the bank ordinarily remits to the sheriff within the specified six-business-day period after the initial no-claim interval.
- Attorney summary execution: the corresponding remittance is to the creditor’s attorney, subject to that route’s amount limit.
A general form instruction cannot erase these differences. [C005, C014–C018.] MN Revisor+2
A2. Automatic federal protection is not the entire exemption determination
For qualifying coded federal-benefit deposits, 31 CFR Part 212 requires a bank review and protection of the lesser of:
- qualifying benefit payments in the defined lookback period; or
- the actual account balance when reviewed.
The lookback is two calendar months under the regulation’s date rule—not universally 60 days. Money above that automatic amount may still be exempt under federal or Minnesota law. Conversely, an unprotected residual is not automatically the creditor’s property. [C041–C050.] eCFR+1
A3. Minnesota expressly requires FIFO for specified deposited exemptions
For the deposited earnings and public-assistance protections in §550.37(13)–(14), and the traceable funds listed in subdivision 20, Minnesota specifies first-in, first-out tracing and places the tracing burden on the debtor.
That is not permission to use FIFO for every possible federal benefit, trust, investment, or converted asset without examining its governing law. It also does not permit treating every withdrawal as coming from nonexempt money first. [C031–C035, C067.] MN Revisor+1
A4. Joint-account access is not the same as beneficial ownership
Minnesota’s multiple-party-account law generally assigns lifetime ownership according to net contributions unless the required evidence establishes a different intent.
Under Savig, a creditor may initially garnish a joint account without first proving each contribution. The account holders then bear the stated contribution burden. Under Enright, funds proved to belong to the nondebtor are not ultimately available merely because the debtor had withdrawal access.
There is no universal 50/50 ownership rule for the modeled joint account. [C028–C029.] mn.gov // Minnesota's State Portal+1
A5. Late claims are not automatically waived—but recovery still requires the proper process
The current bank provisions expressly preserve exemption rights despite a late claim or omitted bank statements. The published Investors Savings Bank v. Miller decision also recognized a hearing and return of exempt funds after disbursement under the former statute.
Neither proposition establishes an automatic refund, damages award, or stay from an informal complaint. A court order, applicable release direction, or other actual statutory trigger still matters. [C020, C025–C026, C054.] MN Revisor+1
B. Routes, actors, property, and judgment predicates
B1. Route-specific authority
| Issue |
Chapter 571 garnishment |
Sheriff execution |
Attorney summary execution |
| Principal provisions |
§§571.71–.85 and .911–.915 |
§§550.01, .04, .135, .143 |
§§551.01–.05 |
| Modeled judgment predicate |
Postjudgment route under §571.71(3) |
Court-issued writ based on the money judgment |
Attorney must obtain the court-issued writ under §550.04 |
| Who initiates/processes |
Creditor issues garnishment summons; bank is garnishee |
Court administrator issues writ; sheriff executes levy |
Creditor’s attorney serves and administers statutory execution levy |
| Ordinary account reach |
Nonexempt debt/money/property owed to or owned by debtor at service |
Bank debt/funds reached by the writ and levy, subject to exemptions |
Nonexempt money owing to debtor at service |
| Retention ceiling |
Generally no more than 110% of the unpaid claim |
Bank provision/form uses 110% of the unpaid claim |
No more than 100% remaining judgment or $10,000, whichever is less |
| Special route limit |
No $10,000 limit established for this route |
No Chapter 551 $10,000 limit imported |
No more than $10,000 per levy; no more than one execution against the same third party per calendar day |
| Remittance |
Requires the applicable levy, written authorization, court order, or operation of law |
Route-specific bank remittance to sheriff |
Route-specific bank remittance to creditor’s attorney |
| Statutory forms |
Incorporated with force of law under §571.711 |
Forms and bank-specific provisions must be read with §550.135 |
General and specific provisions both apply; statutory forms have force of law |
The models stipulate a valid entered and, where required for the writ, docketed judgment, with no applicable stay. Rule 69 uses execution by writ unless the court directs otherwise; Rule 62 requires examination of the actual stay posture. This is not a general judgment-validity or enforcement-duration opinion. [C005–C006, C015–C016.] MN Revisor+2
Important scope distinction
Chapter 571 also contains non-postjudgment procedures. They were not used to justify the ordinary postjudgment models. The special affidavit requirement tied to the first §571.71(2) service is not silently imported into the modeled §571.71(3) route.
The statutory definitions are not confined to consumer debt, but this pass’s examples are confined to ordinary consumer judgments. Natural-person status is particularly important to the bank exemption-notice provisions. Business-entity accounts and other special property require their own ownership and exemption analysis.
B2. What attaches—and what does not automatically attach
| Property/event |
Established treatment |
Limit |
| Ordinary deposit balance owed to debtor |
Non-earnings attachment is a service-time inquiry, subject to exemptions and ownership |
A balance shown later is not automatically the service-time property |
| Future deposits |
No general continuing non-earnings attachment was established from these service-time provisions; Part 212 expressly bars continuing freezes under the same order after review |
A new or different order requires its own analysis |
| Debt not yet payable |
It can be within the described attachment category, but a bona fide payment agreement is not automatically accelerated |
Contingent obligations have separate exclusions |
| Less than $10 |
The relevant statutory exclusions/forms address this threshold |
It is not a general $10 exemption added to every account |
| Joint account |
Initial hold and final ownership are distinct |
Contributions, withdrawals, intent and exemptions require proof |
| Agent or convenience signer |
Authority to transact is not automatically beneficial ownership |
Actual account agreement and MPAA status matter |
| POD account |
Lifetime ownership differs from a beneficiary’s expectancy |
Death and estate issues are outside the models |
| True fiduciary/trust or business account |
The MPAA definition excludes specified business and genuine fiduciary arrangements |
Do not apply ordinary joint-account presumptions without classification |
| Retirement account |
Account label alone is not dispositive; plan, source, statutory conditions and federal law matter |
No universal IRA/ERISA or rollover conclusion |
| Closed or empty account |
Bank must disclose the actual service-time obligation and applicable facts |
An empty account is not authority to seize later deposits under the same ordinary snapshot process |
Authorities: §§571.73, .75; §§550.135, 551.04; §§524.6-201, .6-203; 31 CFR 212.5–.6. [C010–C013, C028–C030, C047.] MN Revisor+2
B3. Priority, setoff, and third-party ownership
Section 571.81 creates the lien at service on attached property. It addresses preexisting perfected interests and later-perfected interests, and restricts a debtor’s recently incurred indebtedness to the garnishee from being used as the specified setoff.
The bank must disclose claimed setoffs, liens, exemptions and adverse interests. Section 571.83 permits a person claiming an interest to intervene or be joined. These provisions do not establish that every bank setoff is valid or that every assertion of an adverse interest prevails.
Form discrepancy: The current non-earnings form describes a debtor “payment” within ten days as something that cannot reduce garnishment. The operative §571.81(2) wording concerns indebtedness incurred within that period. This report does not silently treat those as identical or approve an account debit from the form alone. [C012–C013, C052, C064.] MN Revisor+1

| Prior compliant garnishment converted to levy |
Follow actual conversion provisions |
Additional exemption notice not required in the stated circumstance; only previously garnished funds reached |
Same limitation, plus Chapter 551 amount limits |
The $15 payment is a creditor-to-garnishee procedural charge. It is not automatically a bank debit against protected benefits. Other sheriff deposits, writ fees, service expenses or extraordinary expenses were not given invented amounts. [C007–C009, C015–C017.] MN Revisor+2

No automatic import of 180 days |
No automatic import of 180 days |
[ C011, C014–C018.] MN Revisor+2
Chapter 571 retention is not creditor ownership
Section 571.78 identifies levy, debtor authorization, court order and operation of law as remittance mechanisms. Section 571.79 governs discharge, including the postjudgment 180-day retention period and specified motions that can prevent or undo discharge.
Section 571.79(h)’s motion provisions have their own service and hearing conditions. A negotiation, informal complaint or general statement that a dispute exists is not automatically that motion. [C014.] MN Revisor+1
A Chapter 551 cross-reference remains unresolved
Section 551.05(4) refers to retention until court order, agreement, or a “garnishment” lapse under subdivision 7. Subdivision 7 is the voluntary written-release provision. No opened authority resolved that internal reference as a particular automatic lapse period.
It would be improper to substitute Chapter 571’s 180-day rule merely to make the sentence easier to administer. [C024, C052.] MN Revisor
D. State exemptions, indexed amounts, and tracing
D1. Deposited funds matrix
| Source of deposited funds |
Protection established |
Duration/tracing/application limit |
| Exempt disposable earnings |
The portion already exempt under the earnings law remains protected after deposit |
20 days after deposit, single or joint account; FIFO; debtor bears tracing burden. This pass does not recalculate the underlying wage exemption. |
| Need-based government assistance and covered protected earnings |
§550.37(14) includes specified assistance, including SSI and listed tax-credit programs |
60 days after deposit, single or joint account; FIFO and debtor burden. Program and recipient predicates still matter. |
| Child support/minor child earnings |
§550.37(15), subject to its special-benefit-of-the-child liability qualification |
Subdivision 20 preserves the listed deposited proceeds and specifies FIFO. No blanket immunity for every family deposit. |
| Damage/destruction proceeds for exempt property |
Subdivision 9 protects the specified replacement proceeds |
Not a universal rule for voluntary sale proceeds or conversion of every exempt asset. |
| Qualifying life-insurance proceeds |
Subdivision 10, subject to its beneficiary and amount conditions |
Deposit tracing under subdivision 20; corrected indexed amount applies where relevant. |
| Beneficiary-association payments |
Subdivision 11 appears in the statutory trace list |
The Revisor carries a constitutional-case note; underlying controlling body was not freshly read, so categorical reliance is held. |
| Employee/retirement benefits |
Subdivision 24’s actual conditions, limit/additional support protection and federal overlays must be applied |
Neither the account label nor the displayed dollar cap resolves ERISA, government-plan, rollover or support exceptions. |
| Personal-injury recoveries |
Current subdivision 22 expressly includes the specified rights and money received |
The 2024 amendment and cause-commencement condition matter. Subdivision 20 does not list subdivision 22; no universal tracing method after further conversion is invented. |
| HSA/MSA funds |
Separate subdivision 26 protection, if its conditions fit |
Not automatically an unlimited exemption for cash withdrawn into another account. |
| Bankruptcy wildcard |
Subdivision 28 is a bankruptcy-specific provision |
Not a general ordinary-judgment protected bank balance. |
Authorities: §550.37(9)–(15), (20), (22), (24), (26), (28). [C031–C035, C067.] MN Revisor+1
A benefit label does not prove the exemption
The relevant evidence includes the payer/program, recipient, payment dates, account ownership, deposit entries, subsequent withdrawals and the statutory duration. A 60-day statement requirement is a procedural evidence requirement; it does not establish that every substantive exemption lasts 60 days.
Likewise, the form’s lookback questions about assistance or incarceration do not independently establish which dollars in an account are exempt. Those wage/recipient predicates and the deposit source must be proved separately.
D2. Corrected 2026 indexed amounts
Commerce’s current page states that an earlier 2026 publication was incorrect. The corrected amounts below are effective July 1, 2026. The page was updated June 29, 2026.

Money versus converted property
Philpott and Porter support protection of the deposited funds on their records when they retained the quality of readily available money. They do not establish that purchasing a house, investment, business asset or other property with benefits preserves every original exemption.
The state’s express tracing provisions and each federal benefit statute must be applied to the actual source and conversion. A bank transfer also differs from a purchase: Part 212 does not automatically trace transfers between accounts, although a later substantive exemption claim may. [C053, C067.] GovInfo+1
E. Federal benefit-account review under 31 CFR Part 212
E1. Coverage and sequence
| Step |
Actual federal requirement |
Important distinction |
| Identify covered account/order |
Part 212 defines the financial institution, account, account holder, benefit payment and garnishment order |
A securities account or private pension deposit is not automatically within this administrative rule |
| Examine for Notice of Right to Garnish Federal Benefits |
Before other action, no later than two business days after receipt |
Only the specified United States/state child-support notice route changes the review procedure |
| Notice attached/included |
Follow otherwise customary procedure, not §§212.5–.6 |
Does not itself prove that every benefit or dollar is legally reachable |
| No such notice |
Review qualifying accounts within two business days after receipt of order and sufficient identifying information |
A documented batch-permission exception exists; it is not a general extension |
| Review before freeze |
Account review precedes actions affecting funds |
State instructions cannot require freezing the protected amount first |
| Identify benefit payments |
Apply the ACH identifiers specified in §212.3 |
A memo saying “benefit,” a paper check, or an interaccount transfer is not automatically a coded payment |
| Calculate protected amount |
Lesser of qualifying lookback deposits and actual review-time balance |
No line-of-credit addition; intraday balance matters |
| Make protected amount available |
Full customary access without requiring an exemption claim |
The amount is conclusively protected under this rule |
| Handle residual |
Apply otherwise applicable procedures, consistent with the rule |
Residual is not a decision of creditor entitlement |
Sources: §§212.2–.6 and Treasury’s final explanation. [C041–C046.] eCFR+1
Exact lookback construction
The rule looks backward from the date preceding account review to the corresponding date two months earlier. If that earlier month lacks the corresponding date, use its last day. The rule’s defined opening/closing-of-business boundaries and Appendix C examples govern.
Thus, for a September 1 review:
Plain text
Date preceding review: August 31.
Corresponding date two months earlier: June 31 does not exist.
Earlier endpoint: June 30.
This is not a universal 60-day window. Review-day benefit deposits are not automatically included in the lookback sum merely because they are in the current balance. [C044–C045.] eCFR
E2. Commingling, joint accounts and later deposits
Part 212 requires the review despite commingled money, co-owners, multiple beneficiaries, different covered programs, or contrary instructions in the order. It does not require the bank to reconstruct actual spending of each benefit dollar for the automatic amount.
Each account is reviewed separately. The bank does not automatically trace a benefit transferred from Account A into Account B. Re-service of the same order does not create a second review or continuing sweep; a new or different order requires a new review. [C046–C047.] eCFR
That rule is different from Minnesota’s FIFO tracing. The two protections operate on the same cash; they are not added together to exceed the balance.
E3. Notice, fee and record rules
| Requirement |
Conditions and clock |
| Federal notice |
Required when a qualifying benefit was deposited, a positive protected amount was established, and funds exceed it |
| Required notice content |
Order/date/account, protected and frozen amounts, fee if any, covered benefit categories, further-exemption rights, legal-help option and creditor identity/contact information if supplied |
| Delivery |
Directly to holder or qualifying fiduciary; state garnishment notices may be combined under the rule’s conditions |
| Notice deadline |
Within three business days after account review |
| Entire balance automatically protected |
The federal notice is not required under the stated three-condition test; Minnesota notice duties remain separately applicable |
| Garnishment fee |
Cannot be charged against the protected amount |
| New nonbenefit deposit |
Limited fee collection within five business days after review, no more than that new nonbenefit deposit, subject to other applicable law |
| Records |
At least two years from receipt of the garnishment order |
| Safe harbors |
Conditional good-faith protections, including specified clearing adjustments and post-order express written holder direction—not blanket immunity |
| More protective state law |
Preserved where consistent; federal inconsistency preemption is limited to the actual conflict |
No federal fee maximum or affirmative state authority for every bank charge was inferred. A permitted federal funding source for a fee is not proof that the fee itself is otherwise lawful. [C048–C051.] eCFR+1
E4. Boundaries not converted into ordinary-consumer exceptions
Support, federal tax, federal debt, restitution, administrative offsets and bank setoff require their own authority. Appendix B’s certification mechanism is not a general creditor form for obtaining access to benefits.
A bank’s own setoff is not resolved by calling it a garnishment. The state wage/assistance deposit provisions expressly address certain setoffs, but the complete federal and state setoff doctrine remains deferred. [C050, C066.]

The postmark-versus-receipt tension
The bank’s release provision uses the postmark on a mailed claim, while the creditor’s objection period uses actual creditor receipt. Mailed copies can therefore generate different dates.
The report does not resolve that tension by silently granting a longer hold or shortening the creditor’s time. The worked examples use acknowledged personal delivery to both recipients on the same day, eliminating that factual mismatch without announcing a real-world filing recommendation.
F2. Pending objection and release
A timely objection preserves the claimed funds while the appropriate proceeding is resolved. Depending on the route, release can follow a court order, the stated mutual-agreement mechanism, or a post-service written direction by the debtor or creditor to release to the other party.
For Chapter 571, the general retention/discharge provisions also remain relevant. The unusual Chapter 551 cross-reference is expressly held rather than repaired by assumption. [C024–C025.] MN Revisor+2
If money has already reached the creditor, a bank release is no longer the necessary cash transaction. The claimant may need a court determination and return from the recipient. Filing an exemption claim does not itself restore money that is no longer in the account.
F3. Evidence and burdens
| Question |
Necessary evidence |
| Is the account the debtor’s? |
Account agreement, parties, authority, beneficial ownership and MPAA applicability |
| What did each joint holder contribute? |
Deposits, withdrawals, contribution records and intent evidence |
| Is a deposit a protected source? |
Award/payment record, source identity, eligibility, deposit identifier and date |
| How much protected money remains? |
Opening balance, each receipt/withdrawal and the applicable tracing rule |
| Is the duration satisfied? |
Deposit date and relevant seizure/claim facts—not merely a current benefit letter |
| Did the notice or claim clock start? |
Service, bank mailing/postmark, actual creditor receipt and proof of delivery |
| Can money be remitted? |
Correct route, expired/ongoing hold conditions, order or authorization and applicable exemptions |
| Was the judgment actually credited? |
Creditor receipt and payment application—not the bank’s initial hold |
Under Savig, net-contribution proof uses the stated preponderance standard; an asserted different ownership intent requires clear and convincing evidence. Under the specified exemption statutes, the debtor bears tracing. These are different burdens. [C028–C033.] mn.gov // Minnesota's State Portal+1
F4. Failure, late claims, and limited sanctions
A garnishee’s failure to disclose can support a creditor motion, affidavits and notice for the statutory judgment against the garnishee; good-cause relief is available. It is not automatic forfeiture of the debtor’s exemption.
Bad-faith claims or bad-faith disregard of a valid exemption can trigger the specified actual damages, costs, attorney fees and limited additional award. Losing a dispute alone is not a finding of bad faith.
The state bank-protection clauses and Part 212’s safe harbors have their own predicates. They are not a universal defense to federal noncompliance or a promise that an exempt-fund claimant automatically obtains damages. [C026.] MN Revisor+1
F5. Counting rules
The applicable civil rules exclude the triggering day and distinguish ordinary days from expressly stated business days. Endpoint weekends/holidays and service-specific additional time must be evaluated under Rule 6 and §§645.15/.44.
No automatic three mailing days are added to a clock expressly tied to actual receipt or postmark. Rule 6’s mail provision applies according to its own service-based trigger. The examples avoid after-5-p.m. service and contested endpoint holidays.
Full appeal, reconsideration, tolling and automatic-stay analysis remains deferred. The ordinary appeal reference does not itself create a stay of bank turnover. [C027.] MN Revisor+2

Specific form/text conflicts preserved
- The statutory operative provisions require a penalty-of-perjury signature; the retrieved JGM401 signature area does not itself display a complete matching declaration.
- JGM401 contains a “Creditor’s Signature” label within the debtor-copy certification area, followed elsewhere by the debtor’s signature.
- JGM401’s broad treatment of retirement, insurance and other funds is not a substitute for caps, source qualifications or federal overlays.
- JGM406’s six-day “receipt” summary differs from statutory postmark language.
- Generic statements that court action is required before turnover do not erase the execution statutes’ no-claim remittance mechanism.
- JGM601’s abbreviated hearing wording must be read with the statutes’ business-day language.
- Chapter 551’s lapse cross-reference remains unresolved.
- Statutory forms have legal force in the applicable chapters; discrepancies cannot be dismissed merely because they appear in form text.
No corrected form, automatic cure or agency resolution was invented.

H1. Twenty distinct postures
| Posture |
Fictional facts |
Result or hold |
| P01 |
Single-owner account contains only ordinary savings |
Service, ownership, exemptions, amount limits and remittance still require proof; “ordinary” is a stipulated source fact |
| P02 |

H2. Shared model assumptions
All events below are fictional. Each model uses a valid ordinary consumer money judgment arising from an action commenced after August 1, 2024; required entry/docketing and absence of a stay are stipulated.
No interest or new judgment costs accrue in the ledger unless stated. The creditor’s actual claim, interest entitlement, fee recovery and satisfaction procedure remain independent of arithmetic.
A hold or release of a hold is not a deposit or withdrawal.
Plain text
Opening cash + deposits − actual withdrawals = actual account balance.
Held funds = released from hold + remitted + still held.
Creditor principal changes only on stipulated actual credited payment,
or an expressly stipulated reversal of that credit.
All amounts calculate exactly to cents; no rounding rule is invented.
M01 — Ordinary garnishment, claim, objection, hearing and release
Funds before service
| Date |
Event |
Cash balance |
Source remaining |
| Opening |
Ordinary savings |
$2,800 |
Ordinary $2,800 |
| Sept. 4, 2026 |
Child-support deposit |
$4,300 |
Ordinary $2,800; support $1,500 |
| Sept. 5 |
$300 ordinary spending |
$4,000 |
FIFO: ordinary $2,500; support $1,500 |
Assume the judgment is not a liability contracted for the child’s special benefit.
Judgment principal is $10,000. The 110% ceiling is $11,000, so it does not enlarge the $4,000 balance. The creditor separately pays the statutory $15 service fee; that is not deducted from the account or credited as debt payment.
Process
| Date |
Event and rule |
| Tuesday, Sept. 8 |
Valid personal service on bank with complete package and $15. No coded federal benefit appears in the account review; Part 212 does not automatically protect these child-support deposits. |
| Wednesday, Sept. 9 |
Bank mails required notices/forms; creditor mails its required debtor copies. Both are within their respective periods. |
| Thursday, Sept. 10, before 5 p.m. |
Debtor personally delivers signed claim for $1,500 to bank and creditor’s attorney; supplies prior 60-day statements and support evidence. |
| Monday, Sept. 14 |
Creditor files objection and hearing request and delivers copies to bank/debtor. |
| Wednesday, Sept. 16 |
Bank serves disclosure within 20 days, identifying funds and claim. |
| Monday, Sept. 21 |
Court hearing. |
| Tuesday, Sept. 22 |
Stipulated order finds $1,500 exempt and authorizes $2,500 remittance. |
| Wednesday, Sept. 23 |
Bank releases the $1,500 hold; cash remains $4,000. |
| Thursday, Sept. 24 |
Bank actually remits $2,500 under the order. |
| Friday, Sept. 25 |
Creditor actually credits $2,500 to principal. |
Counts
Creditor’s six-business-day period after September 10 receipt:
Plain text
Sept. 11 = 1
Sept. 14 = 2
Sept. 15 = 3
Sept. 16 = 4
Sept. 17 = 5
Sept. 18 = 6
The September 14 objection is timely.
Five-to-seven-business-day hearing window after September 14 filing:
Plain text
Sept. 15 = 1
Sept. 16 = 2
Sept. 17 = 3
Sept. 18 = 4
Sept. 21 = 5
Sept. 22 = 6
Sept. 23 = 7
The hearing is on day five; the next-day order avoids a disputed endpoint.
Reconciliation
Plain text
Cash:
$2,800 + $1,500 − $300 − $2,500 = $1,500.
Held disposition:
$4,000 = $1,500 released + $2,500 remitted + $0 still held.
Principal:
$10,000 − $2,500 actually credited = $7,500.
The court may assess the statutory $1 objection filing charge; the model assumes it is paid separately by the creditor and not added to principal. No other assessed cost is included.
Adverse branch: If source evidence fails, the label “child support” is not conclusive. If no timely objection is interposed, the statutory release rule applies; the entire account is not automatically exempt merely because $1,500 was claimed. [C056.]

Federal sequence
- Monday, August 31: bank receives the order with sufficient identification.
- No Appendix B Notice of Right to Garnish is attached.
- Tuesday, September 1: bank conducts the review before freezing funds.
- Review lookback: August 31 back through June 30, using the regulation’s missing-date rule.
- Coded benefits inside that period: $1,200 + $1,200 = $2,400.
- Actual review-time balance: $2,600.
Plain text
Automatic protected amount = min($2,400, $2,600) = $2,400.
Residual potentially held = $2,600 − $2,400 = $200.
The bank sends its federal notice September 2, within three business days, and satisfies the separate state bank-notice requirement.
Residual claim
The actual remaining sources are:
Plain text
SSI: $700 + $1,200 = $1,900.
Child support: $700.
Total traceable protected sources on stipulated facts: $2,600.
Both SSI deposits are within the stated state deposit-duration facts at review. Federal SSI protection also remains independently relevant.
The debtor supplies source records and claims the remaining $200 on September 2. On September 3 the creditor gives a valid post-service written direction to release it, and the bank does so.
Plain text
Cash:
$500 + $1,200 + $700 + $1,200 − $600 − $400 = $2,600.
Hold:
$200 = $200 released + $0 remitted + $0 still held.
Final available balance: $2,600.
Creditor principal, stipulated $8,000: unchanged.
No double counting: The result is not $2,400 automatic + $700 support = $3,100. Both legal protections apply to the same $2,600 pool.
No bank fee is charged in this model. The creditor’s separate $15 procedural payment is not a debit against protected funds.
Adverse branches: An uncoded check may produce no Part 212 automatic amount but still support a substantive exemption. An actual balance of $1,000 would cap the automatic amount at $1,000; the rule does not replenish money already spent. [C057.]
M03 — Commingled support, exempt earnings and ordinary funds
This model does not use P12’s wage formula. It stipulates that the deposited $900 has independently been established as the exempt portion of earnings. No current need-based-assistance status is assumed.

| Sept. 21 |

$1,800 |
Same cash; exemptions assessed on actual facts |
Plain text
Deposits = $400 + $1,000 + $900 + $500 + $600 = $3,400.
Withdrawals = $600 + $1,000 = $1,600.
Actual balance = $1,800.
Protected under stipulated facts:
$700 earnings, within20days of Sept.10
+ $600 child support
= $1,300.
Ordinary residual = $500.
There is no qualifying coded federal deposit in this account, so the automatic Part 212 calculation does not replace the state analysis.
Assume required notices and disclosure are timely, the debtor supplies the records September 24, the creditor authorizes release of $1,300 on September 25, and a September 30 court order authorizes remittance of the $500 residual.
Plain text
Bank cash after remittance:
$1,800 − $500 = $1,300.
Held disposition:
$1,800 = $1,300 released + $500 remitted + $0 still held.
Principal:
$3,000 − $500 credited October1 = $2,500.
Different initial-service date—not aging an existing hold
If a different initial service occurred October 5 with no intervening transactions, the September 10 wage deposit would be more than 20 days old. Subdivision 13 alone would no longer establish protection for that $700. The $600 support remains separately analyzed; other wage or benefit protections cannot be assumed absent without checking the facts.
This is not permission to let an already protected September 21 seizure “age out” while the bank holds it.
Evidence failure branch
If the $900 source or its exempt portion cannot be proved, the amount is unresolved—not automatically exempt and not automatically zero. The statute supplies FIFO for the applicable categories; a party cannot replace it with a favorable last-in or pro-rata assumption. [C058.]
M04 — Sheriff versus attorney execution, no initial claim, and a later return
Facts
- Ordinary opening money: $1,400.
- September 1, 2026: identifiable VA paper-check deposit of $1,600.
- Account balance: $3,000.
- No withdrawals before service.
- Judgment principal: $6,000.
- No qualifying coded direct deposit appears in the Part 212 review.
- Underlying VA exemption is nevertheless stipulated to apply; money remains ordinary available cash, not an investment.
- This is an adverse procedural path, not a conclusion that seizure of exempt VA money is substantively lawful.

Oct. 5 = 4
Oct. 6 = 5
Oct. 7 = 6
The modeled October 2 execution remittance falls within that interval. No automatic extra mail days are inserted.

Cash and principal reconciliation
Plain text
Account:
$1,400 opening + $1,600 VA deposit − $3,000 remittance
+ $1,600 court-directed return
= $1,600 ending cash.
Original held amount:
$3,000 = $3,000 remitted + $0 initially released + $0 still held.
Subsequent creditor transaction:
$3,000 received − $1,600 returned = $1,400 net retained.
Principal:
$6,000 − $3,000 credited October5 = $3,000.
Court-directed reversal of exempt $1,600 credit:
$3,000 + $1,600 = $4,600.
The increase to $4,600 is based on the expressly stipulated order and accounting correction—not a universal rule about every refund.
The creditor separately pays the $15 service charge and, if assessed, the $1 objection charge. Neither is silently added to the judgment or deducted from VA funds.
Failed-service branch: Missing required forms or the required service fee has the stated void/no-action consequence. The model does not treat a defective package as a valid $3,000 seizure followed by an automatic cure.
Late-claim limit: Nonwaiver preserves the exemption issue; it does not guarantee that the claimant will prove the source or obtain immediate payment without an order. [C059.]

Other access and interpretation limits
The attempted official Enright route was:
https://mn.gov/law-library-stat/archive/supct/0707/opa060347-0719.htm
It failed; S042 is the disclosed recovery. The initially unsuccessful direct JGM403/JGM602/JGM805 requests were later recovered through their actual Judiciary landing-page links.
The bounded search covered the bank sections, exemption/tracing terms, joint-account ownership, federal benefit accounts, and official published-opinion sources. It did not produce a complete citator or every relevant rule/order. No private docket, account, borrower, bank customer, provider or claimant was searched.

M. Researcher self-check and disposition
Actually read: The identified Minnesota bank-garnishment and execution provisions, necessary exemptions and ownership law, relevant court rules, selected enacted amendments, corrected Commerce publication, current official blank forms, the full responsive Part 212 account-review framework, necessary federal benefit provisions, and the five published majority opinions identified above.
Not established: Any actual account’s ownership or source, a real judgment’s enforceability, a completed form’s sufficiency, the full railroad-retirement statutory exception body, every converted-asset exemption, every later-law change, or a complete citator. The failed official routes and successful alternatives are disclosed.
The four models distinguish account cash, holds, releases, creditor remittances, refunds, costs and actual debt credits. They do not count protected funds twice or treat an unproved source as either automatically exempt or automatically collectible.
Bottom line: Minnesota’s bank process requires separate analysis of the collection route, account ownership, source-based exemptions, tracing, federal automatic protection and the actual release/remittance trigger. The federal two-month review is not the end of the exemption inquiry, and a missed initial claim does not automatically extinguish the protection.
No actual permission, eligibility, independent review, full-state or parent completion, A066, A097 or A098 acceptance is claimed.
