SMN Credit-repair representations, Minnesota CSOs, CROA, and the TSR →Research/access date: October 27, 2026, America/Los_Angeles. Baseline: October 22, 2026; not represented as the date of current verification. Scope: Ordinary civil consumer money-judgment collection from earnings, the applicable protected amounts, and Minnesota’s debtor exemption procedure.
Disposition: The principal amount limits and procedural routes are established within the source-version limits below. Material holds remain concerning older-case applicability, irregular-pay allocation, certain earnings classifications, statutory-form inconsistencies, automatic employer release after an uncontested claim, and the relationship between the earnings form’s remittance instruction and the general garnishment retention provisions.

For a proceeding to which the amended tiered rule applies, Minnesota selects a 10%, 15%, or 25% percentage using weekly income, then compares that percentage of disposable earnings with the amount above the statutory minimum-wage floor.
The applicable 2026 referenced Minnesota rate is $11.41, making the weekly floor $456.40. These are not necessarily the figures applicable to every older case, every special-purpose debt, or every pay period. [C002–C005, C013–C018.] MN Revisor+1
Section 550.37(13) makes the ordinary earnings exemption nonwaivable and applicable whether claimed or not. The protected pay remains payable when due.
Separately, §550.37(14) can exempt all earnings of a qualifying current recipient of need-based government assistance and provides a specifically conditioned six-month protection following the relevant return to employment or farming. The form’s simplified checkboxes do not replace those statutory conditions. [C019–C023.] MN Revisor
Chapter 571 garnishment is not interchangeable with a sheriff’s earnings levy under §550.136 or an attorney’s summary execution under §551.06. They have different issuers, recipients, disclosure/remittance provisions, and procedural cross-references.
The older 25% language still displayed in the direct-execution provisions does not justify ignoring their express incorporation of §§550.37 and 571.922. Conversely, Chapter 571’s objection procedure cannot simply be copied into every execution proceeding. [C026–C027, C041–C042.] MN Revisor+1
The 90-day earnings-capture period, disclosure deadline, retention obligation, exemption proceeding, and actual remittance are separate events.
The current statutory earnings form instructs an end-of-period remittance, while §§571.78 and 571.79 separately address authorized remittance and retention/discharge. No responsive published construction harmonizing every application of those provisions was located. The final worked example therefore uses an express court order, not an assumed automatic transfer. | Authority | Change actually read | Effective/applicability result |
|---|---|---|
| Laws 2024, chapter 114, article 3, §§90, 96–102 | Relevant assistance, objection/hearing, actor, tier and retaliation changes | Selected provisions contain August 1, 2024 applicability to causes of action commenced on or after that date. The wage-tier provision’s original later date was subsequently changed. |
| Laws 2025, chapter 18, §21 | Replaces the tier provision’s original April 1, 2025 date | Tier amendment effective June 1, 2025, for causes of action commenced on or after that date; §21 is retroactive to March 1, 2025. |
| Laws 2025, chapter 18, §§1–20, 22–23 | Revises statutory forms and publication provisions | Selected form changes effective June 1, 2025; the act’s form-publication protection is not a perpetual exception to current requirements. |
| Laws 2025, first special session, chapter 4, article 7, §§32–34 | Replaces the old state-wage cross-reference with §177.24(1)(a)(4) in §§550.136, 551.06 and 571.922 | July 1, 2025, at 12:01 a.m. is the supported default-date construction: the act actually contains appropriations, was enacted June 14, and the selected sections have no local alternative date. |
| 2026 statutes-changed Table 2 | Relevant alphabetical entries were inspected | No listed amendment to Chapters 550, 551 or 571 appeared in that inspected regular-session portion. This is not a complete later/special-session certificate. |
The selected 2025 special-session act provisions, actual appropriation language, signature, and §645.02 were read. The neighboring section’s special date was not transferred to §§32–34. No fresh sequential read of every section of the omnibus act is claimed. [C001–C004.] MN Revisor+4
Important transition hold: The tier amendment uses the commencement of the cause of action, not simply the paycheck date, garnishment-service date, or date of a new form. This pass does not decide that phrase for an actual older action. Every worked example stipulates a cause commenced after June 1, 2025.
Section 571.922 refers to the greater of the specified state rate under §177.24(1)(a)(4) and the federal minimum wage, measured when earnings are payable. It does not direct use of a local ordinance rate, the worker’s actual hourly pay, or the youth-training rate.
| Period | Official DLI rate relevant to the referenced state category | Status |
|---|---|---|
| 2026 | $11.41/hour | Used in this pass’s 2026 models |
| January 1, 2027 onward | $11.87/hour | Announced future rate; not used for 2026 pay |
The state wage-adjustment statute provides its own annual process and nearest-cent treatment. That is not a garnishment-fee or withholding-rounding rule. No separate universal cent-rounding convention for the garnishable amount was established. [C005, C060.] MN Revisor+1
The Minnesota section pages retrieved remain labeled 2025 Minnesota Statutes. The federal U.S. Code pages used are through Public Law 119-120, October 7, 2026. The current eCFR retrieval displayed Title 29 through October 23, 2026.
Section 870.10 still prints historical dollar examples based on older federal wage rates. Its operative formula and current 29 USC 206 rate—not those historic dollar examples—control the federal calculation used here. [C001, C016–C017, C060.] eCFR+2
| Item or actor | Established rule | Necessary limitation |
|---|---|---|
| Employee compensation | Chapter 571 earnings include compensation paid or payable for personal services, including wages, salary, commissions and bonuses. | The actual payment must be classified; a label alone is insufficient. |
| Independent contractor/self-employed person | Current §571.921 expressly includes personal-service compensation to these persons. | Corporate business receipts, inventory proceeds, reimbursements and gross business revenue are not automatically all personal earnings. |
| Fees, profit-sharing, severance and similar compensation | The current definition expressly reaches the listed compensation forms. | Allocation to workweeks, unusual lump sums and separate exemptions may require further analysis. |
| Periodic pension/retirement payment | Included in the earnings definition. | A separate plan-specific, state or federal exemption may protect more or all of it. No retirement-cap/index/ERISA determination is made here. |
| Specified agricultural proceeds and maintenance | Included by the applicable statutory definition and cross-references. | Detailed family-farm and domestic-support regimes remain outside the ordinary model. |
| Tips | The wage-rate statute’s no-tip-credit rule does not itself answer the garnishment classification. | Responsive DOL guidance bodies were inaccessible; no universal tips inclusion/exclusion is declared. |
| Employer/garnishee | The person owing or expected to owe the debtor earnings is the relevant third party. | Independent-contractor and employee definitions differ between Chapter 571 and the older direct-execution text. |
| Money already deposited | No longer analyzed here merely as unpaid employer earnings. | Deposit tracing, bank holds and postdeposit exemptions are separately deferred. |
| Minnesota resident working in Minnesota | §571.92 supplies the express residence/place-of-employment condition for its §550.37 protection. | Cross-border or remote-work location questions require actual facts and further territorial analysis. |

Plain text
Disposable earnings
= gross earnings
− amounts required by law to be withheld.
Actual legally required tax and similar withholding must be distinguished from elective deductions. Voluntary health insurance, retirement contributions, charitable payments, loan repayments or union deductions do not become deductions from statutory disposable earnings merely because payroll processes them.
Whether a particular deduction is legally required must be established from its actual authority. An independent contractor’s expected future tax liability is not automatically an amount required to be withheld from the particular payment. [C008–C009.] MN Revisor+1
The statutory worksheet separately uses gross weekly earnings for the tier and disposable earnings for the percentage/floor calculation. Treating take-home pay after voluntary deductions as disposable earnings can materially understate the withholding base.
| Protection | Recipient/source and conditions | What is not inferred |
|---|---|---|
| Current need-based assistance | §550.37(14) protects the assistance and the earnings/salary of a person currently receiving qualifying assistance. The list includes SNAP, SSI, medical-assistance-related programs and specified low-income tax credits. | A generic “government payment” label does not establish need-based status. |
| Former recipient/return to employment or farming | The statute requires the relevant return and contains both the six-month return-to-work condition and termination-of-eligible-assistance language. | Not every former benefit recipient gets six months of exempt wages measured from whichever date is convenient. |
| Former correctional inmate | The return-to-private-employment/farming provision expressly includes the specified inmate situation. | No broader criminal-record or unemployment exemption is inferred. |
| Unemployment benefits themselves | §268.192(2) protects the benefits against the listed ordinary debt remedies and bars waiver. | It does not automatically exempt every later paycheck for six months. |
| Social Security | 42 USC 407 protects the covered paid/payable benefits against the specified legal process, subject to its actual statutory qualifications. | Support, tax and other express federal exceptions are not analyzed here. |
| Workers’ compensation | §176.175(2) provides a qualified nonassignment/exemption rule. | The displayed 2025 amendment’s complete effective-date chain and application to an actual award remain held; no award calculation is modeled. |
| Minor child’s earnings/support received | §550.37(15) supplies its stated protection against the debtor’s liabilities, with the child-benefit qualification. | No universal exemption for all family income. |
| Retirement/employee benefits | Separate §550.37(24) and federal issues must be considered before using a wage percentage as the entire answer. | The displayed dollar amount is not certified as the applicable indexed or federally permissible limit. |
The debtor bears the statutory burden of establishing the relevant benefit/fund exemption. The prescribed wage claim authorizes limited eligibility verification; the statute also permits the identified agencies to confirm relevant benefit or incarceration history. [C021–C024.] MN Revisor+3
No universal head-of-household allowance, counseling-enrollment exemption, or discretionary hardship percentage was established in the opened wage provisions. A court’s power to protect interested parties’ rights is not treated as an unlimited power to invent an exemption. [C025.]
For the applicable amended rule, let:
For 2026, R=$11.41R=$11.41R=$11.41.
| Weekly gross earnings | Percentage branch |
|---|---|
| At or below 40R=$456.4040R=$456.4040R=$456.40 | The floor ordinarily leaves no garnishable amount |
| More than $456.40 through $684.60 | 10% of disposable earnings |
| More than $684.60 through $912.80 | 15% |
| More than $912.80 | 25% |
Plain text
State floor for the pay period = 40 × R × W.
State amount limit =
the smaller of:
applicable percentage × D, and
D − state floor,
but not below zero.
The floor and percentage are alternative limits on the same withholding—not amounts to subtract twice. [C013–C015.] MN Revisor+1
Minnesota directs use of actual workweeks and its specified fraction based on excess workdays divided by normal workweek days. For example, two workweeks plus two excess workdays in a normal five-day workweek gives:
Plain text
W = 2 + 2/5 = 2.4.
2026 state floor = 40 × $11.41 × 2.4 = $1,095.36.
That calculation does not resolve how an irregular bonus or unequal weekly gross amount must be attributed for the tier. The biweekly worked example avoids that gap by stipulating two equal, separately known weeks.
The federal regulation expressly treats a calendar month as 4⅓4⅓4⅓ workweeks. That federal convention is not silently substituted for Minnesota’s differently worded workday calculation.
For an ordinary debt covered by 15 USC 1673(a):
Plain text
Federal limit =
the smaller of:
25% of aggregate disposable earnings, and
disposable earnings − the applicable federal floor,
but not below zero.
Using the verified federal $7.25 rate:
| Federal pay period | Multiplier | Protected floor |
|---|---|---|
| Weekly | 30 | $217.50 |
| Biweekly | 60 | $435.00 |
| Semimonthly | 65 | $471.25 |
| Monthly | 130 | $942.50 |
The federal ordinary formula has specific support, tax and bankruptcy exceptions. Those processes are not modeled here. More protective applicable state limits remain effective under §1677. [C016–C018.] U.S. Code+2
Section 550.37(13) protects the exempt portion without a claim and forbids waiver. Multiple processes cannot collectively seize more than the period’s nonexempt disposable earnings.
For ordinary competing Chapter 571 earnings garnishments, §571.923 generally uses order of service, then the specified judgment-entry rule for simultaneous service, with an employer-selection rule for the stated remaining tie. Support priorities are separately reserved.
A second order does not create a second full percentage allowance. The 110% judgment-related retention ceiling likewise is not a wage percentage or authority to withhold 110% of disposable earnings. [C019–C020, C033.] MN Revisor+1
The modeled route is postjudgment garnishment under §571.71(3), with no applicable stay. Chapter 571 also contains other routes; this report does not imply that every Minnesota garnishment requires an entered judgment.
For execution, Rule 69 points to a writ unless the court directs otherwise, and §§550.01 and .04 identify the judgment/writ framework. Rule 62 does not supply an automatic federal-style 30-day stay for every Minnesota money judgment; actual stay orders and appeal rules must be checked. No real judgment was examined. [C026–C027.] MN Revisor+3
| Stage | Actor, event and clock | Consequence or limit |
|---|---|---|
| Prenotice | Creditor serves the earnings notice and claim form at least ten days before employer garnishment service, by the authorized personal/mail route. | This is advance notice, not a hearing or permission to withhold. |
| Repeated process | Renewed notice is required in the specified one-year circumstances. | Do not assume the original notice lasts indefinitely. |
| Benefit claim | Debtor supplies the signed, perjury-subject claim and eligibility information. | Missing the initial ten-day opportunity does not waive the exemption. |
| Employer service | Creditor issues and serves the summons using the authorized method; certified-mail service is effective on employer receipt. | Publication is not the authorized substitute. |
| Service fee | The statutory $15 garnishee fee accompanies service. | Failure has the specific void-service consequence; no additional charge is invented. |
| Debtor copies | Creditor mails the summons and served papers within five days after employer service. | The statute makes that service effective on mailing—not actual receipt. |
| Capture | Covered nonexempt earnings in the current and subsequent pay periods whose paydays fall within 90 days after service. | Irregular-payday definition is the fifteenth and last day of the month; not a new arbitrary payroll date. |
| Employer response | The current form calls for an initial affirmation within 20 days. Where attachable earnings exist, §571.75(1) provides the final disclosure/worksheet deadline after the last payday within the 90-day window. | No-earnings disclosure and a final earnings accounting are distinct. |
| Disclosure content | Amounts, applicable setoffs/adverse interests, known exemptions and claims; debtor receives the required copy. | Employer must supply calculation information when the debtor asks under the statutory form. |
| Remittance/retention | Apply §§571.75, .78 and .79 together, including orders, levy, written authorization, operation of law and discharge provisions. | The unresolved form/general-provision interaction is preserved below. |
Sources: §§571.72–.76, .924–.926; statutory and court forms. [C028–C036.] MN Revisor+3
The 90-day capture period is not itself the same as the general postjudgment 180-day retention/discharge provision. Section 571.79 also permits the specified interested-party motion to prevent or vacate discharge, and a court may release amounts exceeding what is needed.
The current statutory earnings form directs inclusion of withheld money after the 90-day period. Section 571.78 separately conditions remittance on the identified legal mechanisms. Both must be preserved; neither may be erased by calling one “just a form,” because §571.711 gives the statutory forms legal force. [C035–C036.] MN Revisor+2
| Event | Actual rule | Evidence/limitation |
|---|---|---|
| Claim received by creditor | §571.72(9) applies to all Chapter 571 garnishments. Within six business days of receipt, creditor must use the statutory return-or-objection route. | The return language concerns debtor funds already released by the garnishee and held by the creditor. |
| Creditor objects | File the objection and request hearing in the district court that issued judgment; mail or deliver copies to debtor and garnishee. | A private disagreement or unanswered letter is not the prescribed objection. |
| Hearing scheduling | §571.914(1): no sooner than five and no later than seven business days after filing. | Court administrator may charge the stated $1 filing fee. |
| Debtor continuance | Notify creditor and court; continued hearing within seven days of original date. | The continuation provision does not say seven business days. |
| Decision | Court issues the exemption order within three days after hearing. | No automatic ruling for whichever side loses an argument. |
| Supporting evidence | Eligibility records, earnings/deduction/pay-period evidence, notices, receipts and the disputed calculation as applicable. | JGM403 directs compliance with the court’s document-submission instructions. |
| Judicial protection | On an interested party’s motion and notice, court determines exemption validity and may protect interested rights. | Not an unrestricted hardship exemption. |
| No timely objection | Creditor’s statutory obligation and automatic wage protection remain. | No precise bank-style mechanical employer release deadline was established by copying §571.914(4) or bank instructions. |
| Funds pending hearing | Apply the employer’s retention duties and actual court directions. | Section 571.914(4) expressly addresses financial institutions; it is not automatically every employer’s rule. |
[C037–C039.] MN Revisor+1
JGM802 asks for the applicable assistance/inmate facts, program/case/county information where known, a signature under the stated certification, and limited verification authorization.
That form is not a universal prerequisite to the automatic percentage exemption. A payroll-calculation dispute may need a supported motion or claim identifying the error rather than falsely checking a benefit box.
JGM406’s bank-account instructions—including bank statements and bank-specific response/release rules—are not automatically wage-employer requirements. [C039, C046–C047.]
| Kind of clock | Treatment used here |
|---|---|
| Ordinary days | Rule 6 generally excludes the triggering day and counts intervening days; applicable endpoint weekend/holiday rules still matter. |
| Express business days | Do not convert to calendar days. |
| Actual receipt | The six-business-day creditor objection clock uses receipt; no three-mailing-day addition is automatically attached. |
| Service by mail | Rule 6.01(e)’s additional-time provision may matter when the period is triggered by that service; analyze the actual statutory trigger. |
| Nonmail service after 5 p.m. | Rule 6.01(e) contains an additional-day provision; the examples avoid it. |
| Statutory general counting | §§645.15 and 645.44 supply additional date/holiday context. |
| Court-order dates | Follow the actual order and applicable rule; no model overrides it. |
The examples use personal service or acknowledged actual receipt before 5 p.m. and avoid disputed endpoint holidays. No real deadline is calculated. [C040.] MN Revisor+2

The direct-execution subdivisions still display a 25% percentage clause, while their attachability provisions incorporate the tiered exemptions and the current forms reflect tiers. | JGM803/statutory screening question refers to earning more than the current minimum wage “per week,” without the 40 multiplier appearing in the controlling floor | Do not replace the operative formula with that screening sentence. No corrected official form is invented. |
| Form directs remittance after 90 days; general statutes separately govern retention/remittance | Both texts preserved; M04 uses an express order. |
| Execution text retains 25% wording while expressly incorporating §571.922 | No route-shopping around the incorporated exemption. Exact application to older actions remains held. |
| Benefit form shorthand says benefits/inmate status in preceding six months | Actual return-to-work and assistance-termination predicates remain necessary. |
| Hearing form includes bank-retention language | Do not extend the financial-institution clause wholesale to employers. |
| Federal regulation prints older minimum-wage examples | Use the operative formula with current §206 rate, not historical dollar examples. |
| “2025 Statutes” label | Read with actual enacted amendments; not a consolidated-currentness certificate. |
An employer’s failure to disclose can support a court motion for the statutory garnishee judgment; it is not automatically a debt-validity ruling against the worker. Good-cause relief and the actual procedural predicates matter.
Bad-faith exemption claims or bad-faith disregard of an upheld exemption can produce the specified damages, fees/costs and limited penalty. Losing an exemption dispute alone is not a bad-faith finding. [C043–C044.] MN Revisor+1
Minnesota §571.927 prohibits discharge or other discipline of an employee or independent contractor because of covered earnings garnishment. It provides a 90-day action period, possible reinstatement/appropriate relief, and twice the lost earnings under the stated prior-relationship condition. The rights are nonwaivable.
Federal §1674 separately prohibits discharge because earnings were garnished for one indebtedness. Its scope is not silently expanded to every multiple-debt situation, and it does not narrow the stronger applicable Minnesota protection. [C045.] MN Revisor+2

| Kokoszka v. Belford, 417 U.S. 642, 648–52 (June 19, 1974) | CCPA earnings protection did not apply to the tax refund at issue; the Court affirmed the bankruptcy result. | Official U.S. Reports majority read. It does not make every wage-traceable asset “earnings,” but is not used to exclude every bonus or lump-sum personal-service payment. Old Bankruptcy Act context preserved. |
| Investors Savings Bank, F.S.B. v. Miller, 440 N.W.2d 168, 169–70 (Minn. App. May 23, 1989) | Affirmed an exemption hearing and return of exempt funds despite the procedural delay and prior bank disbursement on that record. | Published majority read through a disclosed republication. It applied former §571.41 and bank facts—not current employer clocks or the 2025 tier. Bank tracing was not rerun. |

| Posture | Fictional facts | Result or hold |
|---|---|---|
| P01 — Low disposable pay | Gross earnings reach a tier, but required withholding leaves disposable pay below the floor | Percentage alone does not authorize withholding. |
| P02 — Tier boundary | Weekly gross is exactly $684.60 | The “through 60 times” branch is 10%, not 15%; the floor test still applies. |
| P03 — High gross, heavy required withholding | Gross exceeds the highest threshold, but disposable earnings are modest | Apply 25% and the floor; gross does not replace disposable earnings in those calculations. |
| P04 — Elective deductions | Payroll deducts insurance and retirement contributions | Do not automatically subtract them when defining disposable earnings. |
| P05 — Two equal workweeks | Each week has known equal earnings in a biweekly payment | A transparent equivalent-period calculation is possible; M02 uses it. |
| P06 — Fractional or irregular period | Two weeks plus two normal workdays, or a bonus spanning several periods | Fractional floor rule is known; allocation of unusual gross earnings to tiers remains fact-dependent. |
| P07 — Independent contractor | Natural person receives periodic personal-service fees | Chapter 571 expressly includes the category; no fictional estimated-tax withholding. |
| P08 — Tips | Compensation includes direct tips and employer-processed service charges | Classification is held pending responsive authority and actual payment structure. |
| P09 — Pension | Debtor receives periodic retirement payments | Earnings definition is only the first step; separate benefit exemptions may control. |
| P10 — Current SNAP recipient | Eligibility and receipt are established | Full earnings exemption can replace the percentage result. |
| P11 — Return to work | Assistance terminated and debtor returned to private work within the statutory period | Apply both actual predicates; do not use a bare “last six months” label. |
| P12 — Unemployment then work | Worker received ordinary unemployment benefits before a new job | Protect the benefits under their statute; no automatic six-month wage exemption established. |
| P13 — Missed prenotice response | Debtor did not return the claim during the initial ten days | Exemption is not automatically waived. |
| P14 — Two ordinary orders | Employer receives a second order for the same pay period | Apply priority and aggregate limit; do not double the percentage. |
| P15 — Deposited wages | Employer has paid wages into a bank account | Bank seizure and tracing are different and deferred. |
| P16 — Wrong route or retaliation | Creditor uses execution documents but Chapter 571 clocks, or employer disciplines an IC after garnishment | Route-specific rules and the particular employment-protection provision must be tested. |
These are not actual eligibility, employer, creditor, or exemption determinations. [C055.]

$500.00 = $25.00 + $475.00.
Weekly gross $500 is above $456.40 and no more than $684.60, so the state percentage branch is 10%.
Plain text
State percentage amount:
10% × $475.00 = $47.50.
State floor:
40 × $11.41 = $456.40.
Amount above state floor:
$475.00 − $456.40 = $18.60.
State limit:
min($47.50, $18.60) = $18.60.
Federal comparison:
Plain text
25% × $475.00 = $118.75.
Federal floor = 30 × $7.25 = $217.50.
$475.00 − $217.50 = $257.50.
Federal limit = min($118.75, $257.50) = $118.75.
Selected applicable limit:
Plain text
min($18.60 state, $118.75 federal) = $18.60.
Disposable reconciliation:
$475.00 = $18.60 withheld + $456.40 remaining protected pay.
Assume a $4,000 principal balance and no actual creditor remittance:
Plain text
Withheld $18.60 = released $0 + remitted $0 + still held $18.60.
Creditor principal remains $4,000.
The protected state and federal floors are not added together. [C051.]
Two known, equal workweeks:
| Item | Each week | Two-week payment |
|---|---|---|
| Gross | $800.00 | $1,600.00 |
| Required withholding | $100.00 | $200.00 |
| Disposable | $700.00 | $1,400.00 |
Each week’s gross falls in the 15% state branch.
Plain text
State percentage:
15% × $1,400 = $210.00.
State two-week floor:
2 × 40 × $11.41 = $912.80.
Above floor:
$1,400 − $912.80 = $487.20.
State limit = min($210, $487.20) = $210.00.
Federal comparison:
Plain text
25% × $1,400 = $350.00.
Federal two-week floor = 60 × $7.25 = $435.00.
Above floor = $1,400 − $435 = $965.00.
Federal limit = $350.00.
Selected lower limit = $210.00.
The employee also elected $100 insurance and $100 retirement deductions:
Plain text
Statutory disposable:
$1,600 − $200 required = $1,400.
Remaining disposable after modeled withholding:
$1,400 − $210 = $1,190.
Actual cash after elective deductions:
$1,190 − $200 = $990.
Full reconciliation:
$1,600 = $200 required + $200 elective
+ $210 withheld + $990 paid in cash.
Subtracting the elective $200 before calculating statutory disposable earnings would produce $1,200 and a $180 percentage amount. That is not the modeled lawful deduction definition.
No creditor transfer occurs:
Plain text
$210 withheld = $0 released + $0 remitted + $210 still held.
The creditor’s $7,000 principal remains $7,000. [C052.]
Plain text
$900 gross − $120 required = $780 disposable.
State percentage:
15% × $780 = $117.
State floor excess:
$780 − $456.40 = $323.60.
Ordinary state limit = $117.
Federal:
25% × $780 = $195.
$780 − $217.50 = $562.50.
Federal limit = $195.
The stipulated current need-based-assistance status invokes the full earnings exemption:
Plain text
Modeled withholding = $0.
Protected disposable pay = $780.
$900 = $120 required + $780 disposable.
$780 = $0 withheld + $780 remaining pay.
Withheld $0 = released $0 + remitted $0 + still held $0.
The creditor’s $6,000 principal is unchanged. The $240 SNAP benefit is separately protected on the stipulated facts; it is not a second deduction from the $780.
If qualifying assistance terminated June 30 and return to private employment occurred July 1, an October payday can be analyzed within the statutory six-month conditions. This example does not calculate the exact end-day or decide a case where assistance continues, dates differ, or the return-to-employment condition is absent.
Ordinary unemployment benefits alone would require their separate statute; this example does not convert them into the same six-month wage protection. [C053.]
The dates are deliberately away from the ten-day prenotice boundary.
Plain text
Gross = $650.
Required deductions = $50.
Disposable = $600.
State gross tier = 10%.
10% × $600 = $60.
$600 − $456.40 = $143.60.
State limit = $60.
Federal limit:
min(25% × $600 = $150,
$600 − $217.50 = $382.50)
= $150.
Applicable lower limit = $60.
Employer mistakenly withholds $150 each payday:
| Period | Gross | Required deductions | Disposable | Actually withheld | Initially paid |
|---|---|---|---|---|---|
| Sept. 25 | $650 | $50 | $600 | $150 | $450 |
| Oct. 2 | $650 | $50 | $600 | $150 | $450 |
| Oct. 9 | $650 | $50 | $600 | $150 | $450 |
| Total | $1,950 | $150 | $1,800 | $450 | $1,350 |
Correct total withholding is $180. The error is $270.
| Date | Event and rule |
|---|---|
| Tuesday, Oct. 13, before 5 p.m. | Creditor actually receives debtor’s supported calculation/exemption claim; employer gets a copy. No false benefit box is used. |
| Thursday, Oct. 15 | Creditor files objection and requests hearing in the judgment court; copies delivered to debtor and employer. |
| Thursday, Oct. 22 | Hearing occurs. |
| Friday, Oct. 23 | Court issues the stipulated order: release $270 and authorize remittance of $180 for these three paydays. |
| Monday, Oct. 26 | Employer returns $270 and remits $180 under the order. |
| Tuesday, Oct. 27 | Creditor actually credits $180 to principal. |
Six-business-day objection count from actual October 13 receipt:
Plain text
Oct. 14 = 1
Oct. 15 = 2
Oct. 16 = 3
Oct. 19 = 4
Oct. 20 = 5
Oct. 21 = 6
The October 15 objection is timely under the stated assumption.
Five-to-seven-business-day hearing window from October 15 filing:
Plain text
Oct. 16 = 1
Oct. 19 = 2
Oct. 20 = 3
Oct. 21 = 4
Oct. 22 = 5
Oct. 23 = 6
Oct. 26 = 7
October 22 falls within that window. The next-day order avoids the three-day endpoint issue. No relevant holiday falls inside these counting intervals; October 12 precedes the triggering receipt.
Plain text
Gross:
$1,950 = $150 required deductions + $1,800 disposable.
Initially:
$1,800 = $450 withheld + $1,350 paid.
Disposition of withholding:
$450 = $270 released + $180 lawfully remitted + $0 still held.
Final debtor pay:
$1,350 + $270 = $1,620.
Final disposable allocation:
$1,800 = $1,620 debtor pay + $180 remittance.
Creditor principal:
$5,000 until actual credit.
$5,000 − $180 = $4,820 after Oct. 27 credit.
The order concerns these three paydays; it is not assumed to satisfy the judgment or terminate every future withholding obligation. No bad-faith damages, attorney-fee award or employer-retaliation finding is assumed. [C054.]

Actually read: The identified Minnesota wage, exemption, process and counting provisions; selected enacted amendments and effective clauses; official rate publication; current judiciary forms and instructions; operative federal CCPA text and Part 870; necessary benefit provisions; and the two published majority opinions described above. Relevant PDF pages were visually inspected.
Not established: An actual judgment’s applicability, employer/worker status, exemption eligibility, particular deduction’s legal mandate, a complete irregular-pay allocation rule, universal tips treatment, an automatic employer release clock borrowed from bank rules, or a definitive resolution of the form/general-remittance tension. No actual account, payroll record, filing or order was queried.
The calculations were checked. Their assumptions remain explicit. They distinguish gross pay, legally required deductions, disposable earnings, protected pay, employer-held money, debtor releases, creditor remittances and actual debt credits.
Bottom line: For the modeled post-transition ordinary consumer cases, Minnesota’s tiered formula and indexed floor can protect substantially more than the federal baseline, and a qualifying categorical exemption can protect all earnings. Those amount rules do not replace notice, service, claim, objection, hearing and lawful-disbursement requirements. The three collection routes must remain distinct.
No actual permission, eligibility, independent review, full-state or parent acceptance, A066, A097 or A098 completion is claimed.

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
These components repair their stated scope. They do not replace every other finding in this research series.
