A validation notice is not proof that a debt is legally enforceable. A verification response can satisfy the narrow federal dispute procedure without deciding liability, standing, limitations, admissibility, identity theft, bankruptcy, or the evidence needed to win a lawsuit. [C048–C049.] ecf.ca8.uscourts.gov
A timely written dispute creates a collection pause, not a 30-day response deadline. The collector must satisfy the applicable verification or original-creditor response condition before resuming the affected collection activity. The cited provisions do not require a response within 30 days or extinguish the debt if no response arrives. [C044–C047.] Consumer Financial Protection Bureau+1
Minnesota adds requirements that federal labels do not erase. These include licensed-business-name identification, the specified initial-mail licensing disclosure, a counseling-resource document, and particular callback and recorded-message restrictions. Federal model-form or limited-content-message treatment is not blanket Minnesota approval. [C015–C020.] MN Revisor+1
Seven calls is not general permission to harass. Regulation F establishes rebuttable telephone-frequency presumptions, subject to definitions and exclusions. Other harassment, inconvenience, representation, privacy, workplace, cease-contact, and state rules continue to apply. [C024–C038.] Consumer Financial Protection Bureau+1
| Actor or circumstance | Minnesota conduct inquiry | Federal FDCPA/Regulation F inquiry |
|---|---|---|
| Genuine original creditor collecting its own debt in its own name | The ordinary “for others” agency limb is not established solely by those facts. State anti-evasion, false-name, sector-specific, and other applicable laws remain separate. | Ordinarily distinguish creditor collection from statutory debt collection; the false-third-party-name provision and actual principal-purpose facts still matter. |
| Third-party collection agency | Test §332.31’s collection-for-others definition and actual exclusions. | Test regular collection of another’s consumer debt or the principal-purpose definition. |
| Charged-off debt buyer | The state definition expressly includes purchasing charged-off debt for collection, including outsourcing. | Ownership does not automatically eliminate principal-purpose coverage; neither does every purchase automatically establish it. |
| Servicer | Actual services and exclusions matter. The 2026 amendment adds a scope-limited exclusion for specified licensed mortgage and student-loan servicers. | The nondefault-at-acquisition exclusion and other definitions must be applied separately. |
| Employee or affiliate | Actual authority, activity, exclusion, and anti-evasion facts matter; no general exemption is assumed from the label. | The own-creditor employee and common-control affiliate exclusions have specific predicates. The affiliate exclusion is not simply “same corporate group.” |
| Attorney | A state collection-agency exclusion does not resolve every applicable professional or conduct law. | There is no current blanket attorney exemption from the FDCPA debt-collector definition. |
| Security-interest actor | No universal state secured-activity conclusion is supplied here. | The special definition for §1692f(6) is distinct from full debt-collector coverage; additional monetary collection may change the analysis. |
| Mistakenly targeted person | Actual state actor and conduct provisions still require analysis. | “Consumer” includes a natural person allegedly obligated; a collector’s mistake does not remove that person from the definition. |
| Remote actor | Physical absence is not itself a conduct exemption; actual Minnesota connections and applicable exclusions must be established. | Federal actor, debt, and communication predicates remain necessary. |
| Business-purpose obligation | Minnesota’s collection definition is not generally limited to consumer-purpose debt. | The FDCPA’s “debt” definition requires the specified personal, family, or household transaction purpose. |

Laws 2026, chapter 124, article 1, §57 adds the licensed mortgage-servicer and student-loan-servicer exclusion only for activities subject to the applicable licensure. It became effective August 1, 2026, at 12:01 a.m., under the section, official chapter chronology, and general date rule, with the previously reviewed act-level classification retained as dated context.
The amendment is not a federal contact exemption, and no actor’s actual license or scope was checked here. The displayed §332.32 page remains a 2025 compilation with an amendment warning. [C005.] MN Revisor+2
In Reygadas v. DNF Associates, LLC, the Eighth Circuit upheld debt-collector classification on the particular principal-purpose record even though collection was outsourced. It expressly declined a universal rule covering every purchaser.
The court separately vacated the liability judgment. The buyer’s knowledge of representation did not automatically establish the independent collector’s knowledge or the necessary agency basis for imputing its conduct. Actor status, knowledge, agency, and a prohibited communication remain separate questions. [C012.] U.S. Court of Appeals+1
| Term | Governing distinction | Consequence |
|---|---|---|
| Communication | Conveying information about a debt directly or indirectly to a person | Can trigger disclosure, privacy, initial-communication and other duties. |
| Attempt to communicate | An act to initiate a communication or contact about a debt, including a qualifying limited-content message | Rules expressly covering attempts still apply even when no debt information is conveyed. |
| Limited-content message—LCM | A narrowly specified voicemail to a consumer, containing only required and permitted optional information | Not a federal “communication,” but still an attempt. It is not an email or text-message category. |
| Initial communication | First communication about the debt to the consumer, with specified exclusions for validation purposes | Starts the relevant initial-disclosure/validation analysis; an LCM alone does not. |
| Formal pleading | Excluded for specified initial-validation and collection-disclosure purposes | Not a blanket exemption from every FDCPA prohibition. |
| Required tax/privacy notice | Certain notices unrelated to collecting the debt are excluded from the initial-communication definition | An ordinary demand cannot become excluded merely by including a required notice. |
For an LCM, the business name must not indicate debt collection, and the required callback information and permitted optional elements must fit §1006.2(j). Additional debt content defeats that treatment. A message knowingly left for a third party is not the specified consumer voicemail. [C013–C014.] Consumer Financial Protection Bureau+1
Minnesota hold: Section 332.37(a)(16) requires the full licensed agency/debt-buyer name or Commerce-registered DBA when attempting collection. A federal LCM using a shortened or different name does not automatically satisfy that state requirement. Whether a particular neutral registered DBA and message satisfy all requirements needs actual records and content. No universal harmonized LCM was approved. [C015.]
| State provision | Actor, trigger, medium or recipient | Required conduct or restriction |
|---|---|---|
| §332.37(a)(16) | Agency, buyer or collector attempting collection | Provide the business’s full licensed name or registered DBA. |
| §332.37(a)(23) | Initial contact with a Minnesota debtor by mail | Include the prescribed agency-or-buyer licensing statement, in the required relative type size/font. |
| §332.365(2) | Covered collection agency’s initial written communication through the specified mail/email/text media | Include the commissioner’s counseling-resource document. |
| §332.37(a)(1) | Threat involving a particular lawyer | The lawyer-retention predicate must actually exist; other legality and intent restrictions remain. |
| §332.37(a)(2), (4)–(6), (9) | Public-officer, legal-service, lawyer-document or government-impression conduct | No false governmental/legal authority, misleading judicial appearance, or unauthorized legal conduct. |
| §332.37(a)(7), (22) | Public shaming or fabricated collection material | The stated intimidation and deceptive-document conduct is prohibited. |
| §332.37(a)(13) | Recorded message using an automatic dialing-announcing device after express stop instruction | The specified method must cease. No universal robocall permission is supplied. |
| §332.37(a)(15) | Debtor has a listed number; neighbor/third party is asked to relay a callback request | Prohibited except the specified co-resident/authorized-person conditions; narrow workplace callback language is separately stated. |
| §332.37(a)(20) | Amount incidental to the charge-off obligation | Agreement or legal authorization is required; an itemization does not itself establish it. |
| §332.37(a)(12) | Covered state actors collecting an account, bill or indebtedness | Prohibits violating the incorporated FDCPA provisions. This pass does not assume that every later regulation is automatically incorporated without further construction. |
The buyer exceptions in §332.37(b) are limited to enumerated client/funds-related clauses; they do not create a general communications exemption merely because the buyer owns the debt. [C015–C020.] MN Revisor+1
Minnesota’s callback clause does not override federal restrictions based on known employer prohibitions, inconvenience, third-party disclosure, representation, or a cease request. A callback message can satisfy one narrow state clause and still be impermissible under another applicable rule.

The statute permits updates no more than annually. No later update-notification history was established. [C003–C004.] MN Revisor
Interpretive limit: The statute’s reference to “initial written communication” and its following “if the initial communication” condition should not be silently rewritten. No controlling interpretation was located resolving every oral-first sequence. The examples include the sheet with the first mailed notice without purporting to adjudicate that wording issue.
No text-message attachment implementation, combined notice layout, or current notification recipient list was certified.
Three provisions must not be converted into a universal debtor-file right:
| Provision | Actual beneficiary/purpose | What it does not establish |
|---|---|---|
| §332.37(a)(8) | Client/claimant/forwarder return of claims, accounting, and reports | A debtor’s general right to a complete free file within those client-accounting clocks |
| §332.40 | Commissioner’s examination, investigation and access to books/records | A debtor’s equivalent free inspection right |
| §332.42 | Regulatory financial information and record preservation | A universal debtor-requested document checklist or a separate 30-day validation regime |
No responsive body read here establishes a general Minnesota requirement to supply every original contract, assignment, creditor ledger and investigation record on any debtor request. The federal triggered verification duties remain, and stronger contractual, sector-specific, FCRA, litigation or other legal rights may apply. Those must be established under their own authority. [C021–C022.] MN Revisor+2
| Issue | Governing predicate and effect | Exceptions or limits |
|---|---|---|
| Time | Absent contrary circumstances, before 8 a.m. and after 9 p.m. at the consumer’s location are inconvenient. Known inconvenient times can be narrower. | The ordinary hours are not a permission window overriding other restrictions. |
| Electronic timing | Commentary uses the time the collector sends the email/text, not when opened. | Ambiguous locations require the rule’s location analysis. |
| Inconvenient place | No communication or attempt at a place known or reasonably known to be inconvenient. | A mobile address/number is not inherently tied to a place; actual knowledge matters. |
| Employment | No covered contact at work when the collector knows or has reason to know the employer prohibits it. | A statement that personal calls are prohibited can provide the necessary information. |
| Known representation | When the collector knows the consumer has counsel for the debt and knows or can readily ascertain counsel’s name/address, direct contact is restricted. | Specified nonresponse, attorney-consent, direct prior consumer-consent or court-permission predicates must actually fit. |
| Consumer-initiated response | A narrowly responsive interaction can be permitted under the commentary’s conditions. | It does not erase knowledge of representation or permanently waive an inconvenient-time/place restriction. |
No magic word is required to establish inconvenience. Consent for these exceptions must satisfy the rule’s direct-to-this-collector requirement; an original creditor’s generic contract is not automatically enough. [C024–C026.] U.S. Code+1
For §1006.6’s communications rules, “consumer” includes the specified spouse, parent of a minor, guardian, executor/administrator or authorized estate representative, and confirmed successor-in-interest categories. This communications classification does not establish personal liability for the debt.
Other permitted recipients include the consumer’s attorney, a consumer reporting agency when otherwise permitted, the creditor, and the specified creditor/collector attorneys. Location-information contacts have their own narrower rules. [C027–C029.] U.S. Code+2
The collector must use the prescribed identification and location-confirmation approach, generally not disclose the debt, and ordinarily not contact the same third party more than once unless a specified reason permits another contact. Employer identity is disclosed only if expressly requested under the location rule. Postcards and revealing envelopes are restricted.
A request that a neighbor make the consumer call the collector is not automatically a lawful location inquiry. Minnesota’s listed-number callback restriction must also be applied.
For deceased consumers, identifying the authorized estate representative is different from demanding payment from an unverified relative. [C029, C065.]
| Request/event | Trigger | Effect |
|---|---|---|
| Written refusal to pay or request to cease further communication | Collector receives it; accepted electronic channels can qualify | No further covered communication about the debt except the three statutory categories: termination of efforts, specified ordinary remedies, or intended specified remedy |
| Oral request to stop a particular medium/number/address | The request meets §1006.14(h)’s scope | Stop using that medium/destination, subject to the narrow exceptions |
| Email/text opt-out | Electronic communications/attempts require a reasonable, simple opt-out method | Opt-out must be honored; no demand for unrelated information |
| Consumer later initiates a communication | Apply the particular rule’s response exception and the facts | A one-response or narrowly responsive interaction is not general reauthorization |
| Timely written dispute | Separate verification-pause rule | It is not the same thing as a whole-debt cease request |
| Both cease request and dispute | Both applicable conditions must be reconciled | Sending verification does not automatically erase the separate cease-contact protection |
The full cease/refusal notification is complete on receipt—not when placed in the mail. The limited exceptions do not extinguish the debt or authorize otherwise unlawful remedies. [C030–C031, C053.] U.S. Code+2
| Rule | Exact distinction |
|---|---|
| Seven-call framework | More than seven placed calls to a particular person about a particular debt within seven consecutive days creates the stated presumption. |
| After a conversation | Calls within the seven-consecutive-day period following the relevant telephone conversation create the separate presumption; commentary counts the conversation date as day one. |
| Calls that ring or reach voicemail | Count unless an actual exclusion applies. |
| Calls that do not connect | The rule excludes the specified nonconnecting calls; an unanswered ringing call is not automatically excluded. |
| Direct voluntary prior consent | The limited exclusion has a maximum seven-day duration and can end earlier through revocation, a shorter instruction, or the relevant conversation. |
| Certain professional recipients | Specified calls are excluded from this numerical calculation. |
| Other media | Email/text volume is not added mechanically to the telephone count, but combined conduct can still be harassing. |
| Presumptions | Neither seven calls nor an excluded call establishes compliance with all other law. |
A single abusive call can violate the general prohibition. Closely clustered calls can rebut a presumed-compliant pattern. [C032–C034.] Consumer Financial Protection Bureau+2
| Route or event | Conditions actually established |
|---|---|
| Consumer uses an email address with this collector about the debt | Relevant route requires the stated facts and absence of opt-out; it does not waive other restrictions. |
| Consumer supplies an optional email field | Direct consent can depend on clear, conspicuous disclosure that it will be used for debt communications. The blank field alone is not universal consent. |
| Creditor supplies an email address | The prescribed route requires prior use, a specific transfer/opt-out notice, at least a 35-day response period, waiting/no opt-out, and domain/employer-address conditions. |
| Prior collector supplies an address | The prior and current procedural predicates must actually be met. |
| Text messages | Apply the specified consumer-use/direct-consent route and its 60-day use, renewed-consent or qualifying reassignment-check conditions. A telephone conversation is not automatically texting consent. |
| Employer-provided email | Generally restricted, with the specified consumer-use/direct-consent or qualifying prior-collector routes. |
| Wrong-party notification | Actual notice of a prohibited disclosure defeats reliance on lack of knowledge under the identified procedures. |
| Public social-media message | Prohibited when visible to the public or the person’s social-media contacts. A private message still requires the other rules. |
| Required disclosure after opt-out | An opted-out address/number cannot be used merely because the communication is mandatory. |
The email/text procedures are relevant to the specified bona-fide-error treatment for unintentional third-party disclosure. They are not general immunity or a universal consent rule. [C035–C038, C050.] Consumer Financial Protection Bureau+3
The FDCPA requires the full collection-purpose/use-of-information disclosure in the initial written communication and, when initial contact is oral, the initial oral disclosure plus the first written disclosure. Subsequent communications require the specified debt-collector identification. Formal pleadings have the stated exception. Accurate translations must satisfy the applicable rule rather than substitute incomplete wording. [C023.] U.S. Code+1
These federal duties coexist with Minnesota’s licensed-name and initial-mail requirements. This report supplies no personalized script or approved combined form.
Under §1006.34, validation information is supplied in the initial communication, within five days afterward, or orally in the initial communication as the rule permits. The paid-before-follow-up exception is limited to its stated facts.
The five-day follow-up requirement is not the same clock as the five-day assumed-receipt calculation. No weekend/holiday extension for the follow-up deadline is assumed in the examples, which send the notice the next day. [C039.] U.S. Code+1
| Content category | Required information, subject to the precise rule |
|---|---|
| Collector and consumer | Collector name/mailing address for disputes and original-creditor requests; consumer name/address |
| Debt identity | Current creditor; creditor at itemization where the consumer-financial-product provision applies; account number or permitted truncation |
| Itemization reference | One permissible reference date: last statement, charge-off, last payment, transaction, or judgment date |
| Amounts | Itemization-date amount; itemized interest, fees, payments and credits since that date; current amount |
| Rights | End date of the validation period; dispute, verification and original-creditor rights; required consumer-protection statement |
| Response portion | Required response prompts, dispute reasons and original-creditor-request option; applicable electronic contact information |
The selected itemization date must be used consistently for that collector’s disclosures for that debt. Another collector may select a different permitted date. Zero-valued required itemization categories are not silently omitted. [C040.] Consumer Financial Protection Bureau+1
The period begins when validation information is provided and ends 30 days after actual or permitted assumed receipt. For the assumption, the collector may use a date at least five days after providing the notice, excluding Saturdays, Sundays and the legal public holidays identified in 5 USC 6103(a).
The 30-day interval is not converted into 30 business days. A failed delivery cannot simply be treated as successful notice; the commentary addresses replacement notice and the ensuing period. [C041.] Consumer Financial Protection Bureau+2
Model-form treatment under §1006.34 is limited to the specified information and format requirements. It does not establish debt validity, all communications compliance, or Minnesota compliance.
State-required disclosures can be accommodated only under the applicable additional-information placement rules and state requirements. The Minnesota relative-font requirement and resource sheet must not be omitted merely because a federal model was used. No finished form or layout was tested here. [C042.] Consumer Financial Protection Bureau+1
| Event | Legal effect | What it does not establish |
|---|---|---|
| Oral dispute | Can dispute the debt; relevant to accuracy and known-dispute representations | Does not by itself trigger the written-dispute verification pause |
| Written dispute submitted within validation period | Upon receipt, cease collection of the debt or disputed portion until the applicable written/electronic verification or judgment response is sent | No automatic 30-day response deadline |
| Accepted email/portal dispute | Can satisfy “in writing” under the official commentary | A consumer need not obtain the seller-style E-SIGN consent used for certain outgoing disclosures |
| Timely written original-creditor request | Upon receipt, cease collection until the required name/address response, or the specific same-creditor notification route, is completed | Current-creditor information alone does not justify ignoring the request |
| Partial dispute | Pause applies to the disputed portion, unless another request or restriction requires a broader pause | Amount and other contact restrictions still matter for the remainder |
| Duplicate dispute | Narrow definition requires a previously answered dispute without material new information; the rule supplies a response route | No license to ignore every repeated communication |
| Material new information | Not automatically a duplicate; requires the applicable treatment | The collector cannot make it duplicate merely by labeling it repetitive |
| Late dispute | The specific timely-written pause is not automatically established | False amounts, known errors, privacy, cease requests and other duties do not disappear |
| No dispute | Statutory non-admission protection remains | Silence is not a judicial admission of liability |
| No verification response | Affected collection cannot resume under the pause rule | Debt is not automatically paid, extinguished or adjudicated invalid |
Authorities: §1692g; §1006.38 and comments 38-1 through -3, 38(c), 38(d)(2). [C043–C049, C065.] Consumer Financial Protection Bureau+3
Timeliness and receipt are different: the rule addresses a dispute or request submitted within the validation period, while the pause obligation begins on the collector’s receipt. The examples use same-day accepted email so they do not depend on an unresolved postal-boundary fact.
Dunham v. Portfolio Recovery Associates, LLC, 663 F.3d 997, 1002–04 (8th Cir. 2011) affirmed judgment on the particular verification record while rejecting the lower court’s conclusion that a mistakenly targeted person was not a consumer.
The identifying and account information in that case demonstrated that the collector had the wrong person. The court rejected the asserted need for more original-creditor material on those facts and expressly recognized that different facts might require more. It did not announce that any balance statement always suffices or that a collector may continue pursuing a person known not to owe the debt. [C048.] ecf.ca8.uscourts.gov
Therefore, this pass does not impose—or reject for every circumstance—a universal checklist consisting of an original signed contract, every assignment, complete payment history and litigation-ready evidence. The response must be evaluated against the actual dispute and controlling law.
It is not automatically:
Those separate legal questions remain deferred except for the necessary distinction.
Section 1692e(8) addresses communicating credit information known or reasonably known to be false, including failure to communicate that a debt is disputed.
Wilhelm v. Credico, Inc., 519 F.3d 416 (8th Cir. 2008) rejected the reporting theory on its particular record but reversed summary judgment on a threat claim. This pass does not turn that decision into a complete current FCRA furnishing/update rule. If the collector communicates credit information, the known-dispute rule must be tested; the full reporting regime remains separate. [C052.] U.S. Code+1
Section 1006.42 requires required disclosures to be sent in a manner reasonably expected to provide actual notice and in a form the consumer can retain and access.
Its express E-SIGN requirement covers the specified follow-up validation notice, original-creditor response, and verification response. An initial electronic validation notice is not simply treated as identical to every later electronic disclosure. An email opt-out or known delivery failure matters independently. [C050–C051.] Consumer Financial Protection Bureau
The underlying E-SIGN consumer-consent provision was read in an official 2024 edition after the attempted updated routes failed. It requires more than a generic contract checkbox: affirmative consent, disclosures about paper/withdrawal/scope, access requirements, and the specified demonstration of electronic access. No actual consent or 2026-complete E-SIGN source chain is certified. GovInfo

|---|---|---|
| Dunham, 663 F.3d 997 (8th Cir. Dec. 15, 2011) | Wrongly targeted natural person can be a consumer; verification sufficient on that record; judgment affirmed on alternative reasoning. | No universal document minimum or maximum; the court did not resolve every “debt” predicate. |
| Wilhelm, 519 F.3d 416 (8th Cir. Mar. 3, 2008) | Reporting claim rejected on its record; threat claim remanded; fact-specific clerical-error defense discussed. | No current complete FCRA rule or universal bona-fide-error defense. |
| Scheffler v. Gurstel Chargo, P.A., 902 F.3d 757 (8th Cir. Aug. 27, 2018) | Affirmed summary judgment where specified remedy communication and a narrow response to the consumer’s initiated question did not violate the cease provision. | The waiver was for answering that question—not blanket future contact permission. No garnishment-procedure analysis imported. |
| Reygadas v. DNF Associates, LLC, 982 F.3d 1119 (8th Cir. Dec. 14, 2020) | Principal-purpose classification upheld on the record; judgment vacated because the necessary liability/agency analysis was not established. | Not all purchasers are covered; no automatic imputation of every actor’s knowledge. |

Section 1692l(d) supplies rulemaking authority; §§1692k and 1692l address liability and enforcement separately. Section 1692n and §1006.104 preserve state law except to the extent of inconsistency and do not treat greater state consumer protection as inconsistent merely for being greater.
This does not establish that every provision of Regulation F is automatically a Minnesota licensing rule, nor that a federal safe harbor resolves every independent state obligation. Full remedies, defenses, and enforcement proceedings remain deferred. [C055, C064.] U.S. Code+3

| P09 — Work restriction | Consumer says employer prohibits personal collection calls | Do not rely on ordinary calling hours or a callback exception to continue. |
| P10 — Representation | Collector knows counsel and can ascertain counsel’s address | Direct consumer contact requires an actual exception; a later inbound question is not blanket waiver. |
| P11 — Oral dispute | Consumer orally contests $120 | Accuracy and disputed-status duties matter; written-verification pause is not automatic. |
| P12 — Written partial dispute plus original-creditor request | Accepted email timely raises both | Original-creditor request can require broader pause than the $120 portion alone. |
| P13 — Repeated dispute/new proof | Consumer repeats request but adds a material payment record | Not automatically a duplicate dispute. |
| P14 — Email opt-out | Consumer stops one email address | Stop that destination; do not equate it automatically with debt-wide cessation. |
| P15 — Wrong-number text | Recipient reports that the number belongs to someone else | Actual knowledge affects privacy procedures; a voice-call history is not texting consent. |
| P16 — Estate relative | Adult child is contacted after death but has no established authority | Do not equate family relationship with authorized estate representative or personal liability. |
These are conditional applications, not actual actor findings. [C061, C065.]
Each example assumes an ordinary unsecured consumer debt, an actor subject to the identified federal provisions, and applicable Minnesota agency/buyer conduct duties unless a branch expressly changes that fact.
No legal validity, license status, actual authorization, or consumer identity is established. Dates are fictional 2026 dates. No script, contact, submission or real deadline is produced.
Plain text
$1,000 + $20 + $0 − $100 − $0 = $920 current balance.
The itemization does not prove the interest is lawful; that is an express model assumption.
| Event | Rule/trigger | Result |
|---|---|---|
| September 8 phone communication | §§1692e(11), 1692g; §§1006.18(e), .34(a) | Initial oral disclosure applies; follow-up validation obligation remains. |
| September 9 mailing | Next day, well within the five-day follow-up requirement | No weekend-extension rule is needed. |
| First mailed Minnesota contact | §332.37(a)(23) | Prescribed licensing statement and relative-font requirement included. |
| Counseling document | §332.365 | Model includes the currently linked sheet; oral-first wording ambiguity is not used to omit it. |
| Written disclosure | Operative §1006.18(e)(1) | Model includes the full initial written disclosure; no abbreviated-form conclusion. |
| Amount fields | §1006.34(c) | Required itemization categories and rights/response information supplied, including zeros. |
The model uses the permitted five-day minimum assumption, excluding Saturdays, Sundays and §6103(a) holidays:
| Count | Date |
|---|---|
| 1 | Thursday, September 10 |
| 2 | Friday, September 11 |
| — | September 12–13 excluded |
| 3 | Monday, September 14 |
| 4 | Tuesday, September 15 |
| 5 | Wednesday, September 16 |
No listed federal holiday falls in that counting interval.
The 30 days after September 16 are:
Plain text
September 17–30: 14 days
October 1–16: 16 days
Total: 30 days
Stated validation end date: October 16. Weekends and October 12 are not removed from this separate 30-day interval.
If the notice is returned undeliverable, this model’s successful-notice assumption fails; replacement delivery and a new period require analysis. There is no automatic 30-day blanket collection moratorium merely because this notice was sent, but no activity may overshadow the rights or violate another restriction. [C057; S025, S031, S033, S035, S044.]
Use Example 1’s $920 balance and October 16 validation end date. No later payment, interest or fee occurs.
| Date/event | Trigger and consequence |
|---|---|
| September 18: consumer orally disputes $120 | No automatic written-dispute pause; collector must still avoid false statements and apply known-dispute duties. |
| September 21: collector receives accepted email disputing $120 and requesting the original creditor’s name/address | Timely written/electronic submission. The original-creditor request requires the applicable whole-debt pause; the partial dispute alone would concern $120. |
| September 22: collector acknowledges receipt | An acknowledgment is not verification or the required creditor-information response. |
| September 25: assumed factually adequate verification of the $120 issue is mailed, but original-creditor information is omitted | The original-creditor-request pause remains. |
| September 28: proper original-creditor information is mailed | That response condition can be satisfied by sending the required response; no receipt assumption is substituted for the sending requirement. Other contact and substantive restrictions still apply. |
| September 30: consumer provides materially new payment evidence | Do not dismiss it as duplicative merely because a response was previously sent. Apply the actual dispute and timing facts. |
Plain text
Disputed portion: $120
Other portion: $800
Total: $920
Payments during example: $0
Balance change caused by dispute: $0
Model balance remains: $920, subject to actual substantive correction.
The $120 is not subtracted merely because disputed. Nor does the model establish that it is owed.
[C058; S025, S034–S035, S042–S043.]
Assume one particular person, one debt, no excluded calls, no actual conversation, and each call rings or reaches voicemail:
| Date | Calls placed that day | Calls in October 1–7 |
|---|---|---|
| October 1 | 1 | 1 |
| October 2 | 1 | 2 |
| October 3 | 1 | 3 |
| October 4 | 1 | 4 |
| October 5 | 1 | 5 |
| October 6 | 1 | 6 |
| October 7 | 1 | 7 |
| October 7, additional call | 1 | 8 |
The eighth call creates the applicable presumption. The first seven are not blanket approval: concentration, known inconvenience, harassment, representation or cessation could independently prohibit them.
Assume instead a telephone conversation occurs October 7:
Plain text
Day 1: October 7
Day 2: October 8
Day 3: October 9
Day 4: October 10
Day 5: October 11
Day 6: October 12
Day 7: October 13
A collector-placed call during the restricted interval requires the relevant exclusion or faces the presumption. October 14 clears only this numerical interval, not every contact restriction.
A specific voluntary request during the October 7 conversation for an October 9 callback may fit the direct-consent exclusion. It does not authorize unlimited calls, survive revocation, or override other restrictions.
| Additional fact | Consequence |
|---|---|
| Consumer says morning calls interrupt a night-shift sleep schedule | A 9 a.m. call is not saved by falling inside ordinary hours. |
| Employer prohibits collection calls | Do not use Minnesota’s narrow workplace callback wording as permission to ignore that prohibition. |
| Debtor has a listed number; collector asks neighbor to relay a callback | Apply Minnesota’s restriction and federal location/privacy rules. No debt disclosure is justified. |
| Consumer’s spouse answers | Special communications definition may apply; personal liability is not established. |
| Adult child answers without authority | Family relationship alone does not establish an authorized estate/consumer role. |
| Known attorney representation | Call-count compliance does not supply a representation exception. |
No payment occurs and no balance changes in this example. [C059; S003, S021–S022, S028–S030.]
| Date/event | Governing treatment |
|---|---|
| October 5: collector leaves a voicemail using a stipulated neutral, Commerce-registered DBA and only the federal LCM elements | Conditional LCM: federal attempt, not communication; no federal validation clock yet. The state full-name/DBA assumption is essential. |
| October 6: consumer emails a debt question from a personal address | Actual consumer use can satisfy a relevant email-address procedure; it is not universal E-SIGN consent for every required disclosure. |
| October 6: collector sends a substantive first email response | This is a communication; initial federal collection disclosure applies. Simple opt-out and applicable privacy duties remain. The model includes the state counseling sheet rather than relying on a disputed exemption. |
| October 7: printed validation notice is mailed to the actual current mailing address | Within the follow-up period. Required fields, first-written disclosure treatment and Minnesota initial-mail statement are separately included. |
| October 8: consumer opts out of that email address | Stop using that destination. A mandatory disclosure does not authorize reuse of the opted-out address. |
| Later consumer-initiated email | A permitted response, if any, is limited by the applicable commentary; it is not automatic reinstatement of general email campaigns. |
No endpoint is calculated here because the example concerns channel control, not a second assumed-receipt exercise.
A separate text is proposed to a number obtained from an old file. The only known event is a previous voice conversation.
If an electronic required disclosure is returned undeliverable, §1006.42’s reasonable-expectation condition is not satisfied for that attempt. A later printed notice must be evaluated as the actual notice; an unsuccessful email is not used to shorten the validation period.
No consumer data is requested, and no live message or template is produced. [C060; S003–S004, S027–S028, S030–S035, S043.]

The bounded state search used exact combinations of 332.37, 332.365, dispute, verification, written explanation, records, and official court/Commerce/Revisor domains. No responsive Minnesota published majority or binding final administrative construction was located and opened resolving the LCM/state-name interaction, oral-first resource-sheet wording, or universal free-file/verification checklist.
That is not proof that no such authority exists. The four cited appellate opinions were recovered from official court PDFs; no primary-opinion republication is relied upon in this pass.
“High—text” means the opened wording supports the claim within the stated version. “Conditional” requires actual facts. “Held” identifies missing interpretation or evidence.

Actually read: The identified Minnesota conduct, document and record provisions; necessary actor definitions; selected enacted changes; the linked counseling sheet; relevant FDCPA bodies; operative Regulation F provisions and actual official commentary; selected adoption/correction documents; and four published Eighth Circuit majority opinions and dispositions. Relevant PDF pages were visually inspected.
Not established: A particular actor’s coverage or status, a compliant finished notice or LCM, actual consent, actual verification sufficiency, a universal state free-file right, a universal original-contract packet, complete later-law/citator coverage, or any actual debt’s validity.
The examples distinguish notice, receipt, submission, pause, response, contact permission and debt balance. A dispute is not payment; verification is not adjudication; sending information is not always receipt; and a numerical call presumption is not blanket permission.
Bottom line: Minnesota adds meaningful identification, disclosure and contact duties to the federal framework. Federal validation provides notice and conditional pauses, while known representation, inconvenience, privacy, cessation and electronic-channel rules continue independently. The unresolved state/form and fact-specific verification questions remain explicit.
No actual permission, independent review, full-state or parent acceptance, A066, A097 or A098 completion is claimed.

| FDCPA official text | OLRC through Public Law 119-120, October 7, 2026 | No later-enactment certificate |
| Regulation F | eCFR through October 23, 2026; actual CFPB rule/commentary bodies read | Title update date is not asserted as each section’s amendment date |
| 2020 and 2021 final rules | Both relevant sets effective November 30, 2021 | Proposed January 29, 2022 delay was withdrawn |
| 2022 correction | Effective November 1, 2022; restored omitted commentary, including electronic written disputes and estate treatment | Not a new universal substantive debt-validation clock |
| Counseling PDF | Currently linked document printed August 2023 | “Currently linked” is not a claim of a 2026 revision |
| E-SIGN | Official 2024 operative consumer-consent text recovered | Updated route failed; currentness hold retained |
| Federal form versus state notice | Federal safe harbor and state font/document requirements differ | No completed combined notice approved |
| LCM versus state identification | Different definitions and triggers | No automatic state exemption |
| Follow-up disclosure wording | Operative first-written disclosure rule and validation-form commentary must be read together | Examples use the full initial written disclosure; no abbreviated-template approval |
| State record provisions | Regulator/client rights differ from consumer validation rights | No invented universal free-copy right |

| Posture | Fictional facts | Next step or hold |
|---|---|---|
| P01 — Original creditor | Retailer pursues its own consumer invoice under its genuine name | Do not assume federal collector coverage; do not assume all state/sector law disappears. |
| P02 — False outside name | Same retailer uses a name suggesting an independent collector | Reassess both federal false-name and state anti-evasion provisions. |
| P03 — Principal-purpose buyer | Buyer’s business purpose is collecting purchased debts through vendors | Apply the actual principal-purpose facts; outsourcing is not dispositive. |
| P04 — Servicer timing | Servicer obtained the account before default | Federal exclusion may matter; state exclusion requires its own facts. |
| P05 — Attorney collector | Lawyer regularly collects consumer debts | State actor exclusion does not establish FDCPA exemption. |
| P06 — Wrong person | Notice reaches a same-name person who denies the debt | Do not deny consumer status solely because the person does not actually owe it. |
| P07 — LCM | Neutral-business-name voicemail contains only permitted fields | Federal LCM classification remains conditional; state full-name/DBA rule must also fit. |
| P08 — Listed number/neighbor | Collector asks a neighbor to have debtor call | State callback rule and federal location/privacy limits apply independently. |
