The authenticated statutory category is the “small loan” under chapter 31.45 RCW, “Check Cashers and Sellers.” Within its implementing rules, “payday advance loan,” “payday loan,” and “deferred deposit loan” mean that small loan. Those definitions do not make every product marketed as an advance, installment loan, earned-wage product, or short-term credit a chapter 31.45 transaction. The statute separately addresses exempt institutions, check-cashing and check-selling activities, lending endorsements, and agents. app.leg.wa.gov+2
The central debt protections are the aggregate principal/income limit, the fee tiers, the rolling loan-count restriction, payment-date requirements, restrictions on refinancing, a no-additional-charge installment-plan structure, instrument and collection protections, and transaction registration. The database charge previously encountered as a proposal was adopted: the opened permanent rule makes it $2 per registered loan, charged to the licensee, effective March 1, 2025, with the rescission exception retained. This is not a finding that the charge may be passed through to a borrower. app.leg.wa.gov+4
Several boundaries remain material. The statute and a rule differ at the net-worth equality threshold; the installment-plan texts use different amount terminology and contain overlapping payment-structure language; and the database rule contains an internally inconsistent default-counting illustration. The report preserves those conflicts. It also distinguishes the express transaction consequence in RCW 31.45.105(3) from administrative sanctions, bond recovery, and Consumer Protection Act remedies, each of which has separate predicates. app.leg.wa.gov+5

The relevant statutory chapter is chapter 31.45 RCW, Check Cashers and Sellers; the implementing chapter is chapter 208-630 WAC, Regulation of Check Cashers and Sellers and Small Loans (Payday Lenders).
WAC 208-630-110 equates payday advance, payday, and deferred-deposit loans with the chapter’s small loan. This is an in-chapter definition, not a universal classification of marketed products.
A chapter 31.45 borrower is a natural person receiving a small loan. The definition does not itself impose the consumer-purpose formulation used in other chapters.
“Licensee” includes a check casher or seller, inside or outside Washington, that failed to obtain a required license or endorsement. The definition does not itself establish that a particular activity required one.
“Check” incorporates RCW 62A.3-104(f) and, for small-loan business, adds electronic forms of payment. The rule’s “postdated check” definition excludes an electronically submitted promise or order. These are distinct definitions; full UCC instrument consequences remain held.
Chapter 31.45 does not apply to a financial institution or trust company authorized to do business in Washington. “Financial institution” includes the specified bank, savings, and credit-union categories.
The incidental check-cashing exemption requires all three conditions: customer convenience, a minor part of customary business, and no profit from the activity.
The audited-net-worth exemption concerns issuance or sale of instruments by the specified entities, and a separate paragraph covers their issuance/sale agents. It is not textually a general small-loan exemption.
A discretionary exemption requires an application and a director finding that the applicant is not primarily a check-cashing/selling business and that the exemption would not harm the public. Filing is not the exemption.
A person making small loans as agent for a licensee or exempt entity is subject to RCW 31.45.079’s license-and-endorsement requirement. Its federal-preemption qualification reaches only the provisions actually preempted; preemption is not established here.
RCW 31.45.105(1)(d) expressly reaches making a small loan to a person physically in Washington through internet, telephone, facsimile, kiosk, or other means without the endorsement.
The physical-location clause and outside-state licensee definition do not complete residence-only, choice-of-law, tribal-jurisdiction, sovereign-immunity, or federal-preemption questions.
S003(13), S012, S022(1)(d); gaps G019–G020.
S_WA-P17-C013
A
RCW 31.04.025(4)(d) separately excludes persons making loans under chapter 31.45 from the Consumer Loan Act. Ordinary CLA credit therefore cannot be merged into this sector solely because it is small or short term.
The CLA’s business-purpose exclusion and its residential-dwelling qualification are chapter-specific. Neither that exclusion nor the supplied chapter 18.28 finding establishes a chapter 31.45 business-purpose exemption.
Retail installment sales have separate definitions in RCW 63.14.010. RCW 31.45.105(1)(e) additionally prohibits the specified retail installment sale of open-loop prepaid access. The incorporated federal prepaid definitions were not authenticated because the official route was blocked.
RCW 31.45.070(2)’s government/employer payroll-check exception concerns a check payable on the first banking day after cashing. It is not a general employer wage-advance or earned-wage-access exemption.
Classification of earned-wage advances, tips, subscriptions, expedited-access charges, and nonrecourse arrangements is not settled by a marketed label or the payroll-check exception. The opened EWA bill histories do not authenticate an enacted alternative framework.
A chapter 31.45 small loan cannot take other property, title, or ownership evidence as collateral. Pawnbroking is separately defined and recognized in the same-premises provision; complete pawn/title/secured-credit law is outside this pass.
The complete current chapter reviewed does not establish the separate “small consumer installment loan” framework proposed in the opened 2015 bill history. That history supplies proposal status, not an adopted product or a universal absence finding.
RCW 31.45.210 supplies its own military-borrower definition and protections. WAC 208-630-5401 separately incorporates federal military-credit law; the full federal coverage, exclusions, and consequences remain held.
The endorsement application is a written application supported by required security and financial information. The rule requires current-quarter GAAP information and specified background information; these are application predicates, not an approval.
Issuance depends on the director’s investigation and findings concerning statutory compliance, financial responsibility, fitness, and security; discretionary and mandatory disqualifications differ.
The license is nontransferable/nonassignable and must be posted. Continuing status is subject to annual-assessment and expiration provisions; it is not a permanent authorization unaffected by later duties.
RCW 31.45.043 authorizes a multistate application/administration system, and .045 concerns condition reports. A system submission is distinct from issuance of a license or endorsement.
The rules recognize branches and treat staffed or unstaffed terminals/kiosks as locations; placement on an exempt entity’s premises does not itself supply the required authorization.
Small-loan agent services have a limited-agent licensing structure under -135–138. The current service list covers marketing, information gathering, documentation, disclosures, and collection subject to the collection qualification.
Endorsed persons and specified persons licensed, exempt, or otherwise authorized to collect under Washington law are excluded from the rule’s agent-services definition. Full chapter 19.16 collector status is not determined.
Limited agents have public-facing nonlender/complaint/privacy disclosures and restrictions on selling nonpublic information to unlicensed recipients; consent concerning uses outside the represented scope is separately required.
The small-loan bond secures borrower loss caused by chapter/rule violations, subject to express exclusions for interest, consequential damages, and specified tort liabilities. It is not general liability insurance.
The adopted small-loan bond amount is the base plus the increment for endorsed branches beyond one branch. Whether a headquarters is counted as a branch is not resolved by inventing a counting rule.
RCW 31.45.030 and WAC -130 use net worth in excess of three times the bond; WAC -260 uses at least three times. Equality is held; the inclusive rule wording is not treated as overriding the statute.
A permitted bond alternative requires director approval and continuing financial reporting, asset exclusions, and corrective security duties. Accounting charge-off under that rule does not itself discharge a borrower’s debt.
A borrower damaged by a chapter/rule violation may have a bond/deposit action, subject to exclusive superior-court jurisdiction, the literal dishonor-based period, valid-claim requirements, and proportional sharing if insufficient. The clock for loan injury without a relevant dishonor is held.
RCW 31.45.080’s trust-fund structure concerns funds from sales of checks and similar instruments. It is not authority for treating all small-loan proceeds or repayments as the same trust fund or imposing a universal loan liquidity reserve.
Application, examination, annual-assessment, bond, and database amounts are licensee-side obligations. They are distinct from the borrower-facing fee permissions in .073 and the default rules.

The principal limit applies both to an individual small loan and to outstanding principal across all licensees at one time, using the lower of the dollar and gross-income limits.
Gross monthly income is total personal income earned during a month before taxes/deductions. The text does not provide a complete irregular-income annualization or rounding algorithm.
The rule requires income substantiation by enumerated or approved methods, periodic independent verification, and written change/no-change information between verifications.
A new small loan cannot pay an existing small loan of the same lender or affiliate, and proceeds cannot be applied to another loan of that lender or affiliate.
Due-date and maximum-term rules operate together, with a no-additional-cost extension exception. The precise seventh-day issue and interaction of a closed-day extension with the maximum term remain held.
For the due-date rule, the relevant pay date is the later of scheduled pay and electronic credit to the account. This is a statutory/rule reference event, not an actual account finding.
The charge ceiling aggregates interest and fees, using the statutory principal tiers; it is not an independently authenticated annual rate or APR ceiling.
The director has rulemaking authority to identify fees outside .073’s limit. That delegation does not itself establish any unlisted fee, insurance charge, subscription, tip, or database-fee pass-through permission.
The default-related new-loan bar ends at the earlier statutory event: full payment or passage of the specified period from loan origination. It is not a debt-discharge or general limitations rule.
No additional universal post-payment cooling-off interval was authenticated in the complete current core text. The former successive-loan structure cannot be imported as a current waiting period.

Each endorsed small loan must have a written note/agreement containing origination, principal, repayment method and cash-redemption cutoff if applicable, termination, fee amount/method, APR, and borrower signature or electronic signature.
State law requires charge/term information, APR treatment in relevant advertisements, and delivery of applicable disclosures. Its TILA/Regulation Z references do not complete federal coverage, calculation, timing, or remedies.
The application-front warning has a minimum type-size requirement. Its required substance is recorded without reproducing a consumer notice or template.
Rights disclosures must be clear and conspicuous; location and internet posting duties are separate. The website rule’s self-reference to subsections “(1) and (2)” is preserved as a drafting issue.
WAC -601’s Spanish-language notice provision is explicitly part of the 2010 transition notice. It does not authenticate a general current duty to translate every agreement.
The statutory rescission right is conditional on timely return of principal in the permitted form and carries no charge. The statute/rule wording and electronic-receipt reference events must be reconciled before any actual deadline conclusion.
Rescission requires return of the security/electronic equivalent; the rule provides return or requested destruction and voiding of an ACH authorization that cannot be destroyed. This concerns authorization as well as contract rescission.
The ordinary loan can be paid before its due date without an additional charge; the plan can be paid off at any time without a prepayment penalty, fee, or charge.
Those provisions do not supply a universal partial-payment allocation rule or a general unearned-origination-fee rebate formula. Neither is imported from the CLA or student-servicing law.
S041(5), S015(1), S044(5); gap G011.
S_WA-P17-C063
A
Cash payoff and cash plan payments require an authenticated receipt identifying the payment and whether it relates to the loan or plan. No receipt is generated here.
Conversion is required upon the borrower’s request under the governing provisions. Notice of inability, disclosure of a right, an actual request, and an acknowledged plan are separate events.
The request rule permits a request on or before the due date, with a due-day cutoff and an extension when the loan due date extends. The prohibition rule’s shorter “before” wording is not used to erase the express same-day provision.
The minimum plan periods depend on the amount threshold, but .084 changes from “loan amount” to “loaned amount,” while the rules use other formulations. The fee-inclusive threshold boundary is held.
Substantial equality, pay-date positioning, spacing, monthly distribution, and the minimum-payment-count language must be read together. The rule allowing mutually agreed fewer payments is not silently treated as eliminating the other rule’s minimum.
The rule states division of plan balance by payment count, subject to reasonable rounding. It supplies no precise rounding algorithm or residual-allocation method.
On plan initiation, the original postdated check must be returned or, under the rule at the borrower’s request, destroyed; the original ACH authorization becomes unusable/void under the stated conditions.
The plan may have installment checks limited to the corresponding installment amount, and a new ACH authorization consistent with plan terms may be accepted. An installment-check dishonor alone cannot generate a separate dishonor fee.
Failure to honor a plan entered through the specified accredited third party with certified credit counselors violates the chapter. This does not establish that such an agreement exists.

Ordinary-loan default follows the agreement’s payment terms; the database rule separately addresses a stated cutoff time and the absence of one. The plan’s grace provision is not automatically imported into ordinary-loan default.
Plan default uses the statutory ten-day condition. The database rule’s “11th day” with due date zero conflicts with its embedded calendar illustration. No actual default date is derived.
“Paid” is conditionally defined around full payment of a valid loan; returned checks and denied ACH authorizations defeat the specified paid status. Initiating a payment is not a determination of debt validity or final banking consequences.
The ordinary small-loan security permission is one postdated check, with the statutory prohibition on other collateral; permitted disbursement forms are separately stated.
The rule limits checks held from a borrower by the principal/income ceiling plus allowable fees; a returned deposited check is not treated as still “held” for that rule.
A small-loan monetary instrument cannot be deposited before the governing due/disclosed date. The check-cashing deposit rule expressly excepts small-loan transactions.
The returned-item charge is bounded by the sector’s one-time rule and statutory default/returned-check predicate; repeated presentments do not create repeated charges.
Harassing, intimidating, abusive, or embarrassing communications are prohibited independently of the numerical presumptions. Staying below a presumption threshold is not a safe-harbor finding.
Separate presumptions address frequency, employment contact, residence hours, and third-party contact. Their exact counts, recipients, week definition, and unresolved hour endpoints appear in Q026–Q028.
The statutory communication exclusions cover in-store contact, specified unanswered calls, and an initial FDCPA-disclosure letter. Initiation controls timing; reasonably believed cell-phone calls have the stated workplace-count qualification.
Initiated telephone/written collection communications require a reviewable log. A response to borrower-initiated contact is treated differently for logging but remains subject to substantive conduct restrictions.
Assignment of a dishonored check to a third party carries .082’s restrictions to that collection. This does not decide debt ownership, general assignment authority, servicing capacity, or holder-in-due-course status.
For the specified civil dishonored-check action, .082 allows collection costs as permitted by .515 but excludes that section’s attorneys’ fees, interest, and other damages.
The incorporated check-cost mechanism has notice and mailing-affidavit predicates and consequences for prohibited demands. Its general notice language cannot be transplanted as permission to threaten criminal prosecution in this sector.
RCW 62A.3-515 excludes a check dishonored because of a justifiable stop-payment order. Determining justification, enforcement standing, missing-instrument rights, or a particular fee combination requires additional law/application and remains held.

The ordinary rule requires transaction registration and an authorization number before making the loan; an initial eligibility response is distinct from registered transaction authorization.
An ineligibility determination requires delivery of the printable reason message with the specified database-support information. This is a disclosure duty, not proof of any actual database result.
The rule refers data-entry mistakes to the system’s administrative-void process. It does not itself supply a complete borrower inspection, correction, or dispute procedure; private vendor instructions were not inspected.
The system has confidentiality/security requirements and restricted public disclosure; these duties do not establish a particular financial record or authorize its retrieval.
Outage treatment is conditional on the specified temporary or written authorization process and later registration. Exact legal timing is recorded in Q031–Q033; fractional additional outage periods are unresolved.
A rescinded loan is closed as soon as practicable, does not count toward the eight-loan limit, and does not incur the licensee’s database transaction fee.
Paid/default status must be updated as soon as practicable; the rule separately defines payment of a defaulted loan as payment of loaned amount plus the default fee.
Receipt of formal bankruptcy-discharge notice triggers the rule’s specified paid-status/comment treatment and retention in the loan count. This is only a state database duty; no bankruptcy discharge, stay, or liability conclusion is made.
The adopted database charge is a licensee-side per-registration charge, with the rescission exception; nonpayment and training requirements concern database access, not issuance of a lending license.
Ceasing lending or losing the license does not remove the statutory duty to update outstanding loans. The statute and closure rule impose distinct plan/notice events.
Retained records include transaction history, reconciliation, payment receipts, agent agreements, and the specified loan-file materials. Retention is distinct from a general borrower right to inspect the entire file.
Electronic retention must remain accessible to DFI; previous-day records, ledger posting, and consolidated-location accounting have separate requirements.
Written resumption, disposal, and information-security requirements protect retained information. Federal disposal/safeguards incorporations remain held beyond the state text actually read.
Privacy notices, conditional opt-out treatment, and possible breach notices are expressly addressed, but full Regulation P and chapter 19.255 requirements are not completed.
Annual financial, assessment, and consolidated reports are continuing duties; expanded loan reporting has its own volume trigger. Reporting bins do not authorize otherwise prohibited loan terms.
Closing reporting differs for check sellers and other licensees. The statute’s suspension/surrender wording and the rule’s accountant treatment leave a precise reconciliation hold.

The chapter prohibits the specified fraudulent/unfair conduct, misleading advertising, unendorsed remote lending, prohibited prepaid-access sale, and failures to pay regulatory obligations. These prohibitions occupy different statutory subsections.
The rule additionally prohibits over-limit structuring/referrals, specified pressure to decline a plan or borrow more, unauthorized database use, refusal of qualifying plan requests, and evasion. Verification of agent licensing is separately required before accepting/paying referrals.
Any transaction violating RCW 31.45.105(1) is uncollectible and unenforceable under (3). The rule’s express treatment of its remote-lending paragraph does not narrow the statute. No other defect is automatically assigned this consequence.
The director may impose the listed licensing, cease-and-desist, daily-fine, restitution/refund, affirmative-action, and participation-ban sanctions through the statutory process.
Charges require the stated grounds, including unsafe practices, violations/conditions, specified falsehoods, nonpayment/security failures, misconduct, nonproduction, and other applicable-law violations. APA procedure and particular adjudication are not completed.
The chapter’s five-year period is for director actions not subject to RCW 4.16.160. It is not a general borrower limitation or a limitation on every state action.
Temporary cease-and-desist relief has insolvency/substantial-injury predicates and operates upon service unless judicially set aside; the licensee’s review period is separate.

Violation or participation in violation of the chapter/rules/orders is designated a misdemeanor. The general default punishment statute is conditional; no crime, prosecution, or culpability is determined.
RCW 31.45.190 declares chapter violations to affect the public interest and to be CPA unfair/deceptive acts or unfair methods of competition; it preserves other remedies.
A private CPA damages claim requires injury to business or property by a covered violation. The statute supplies possible injunction, actual damages, costs, and reasonable attorney fees; an actual award or causal connection is not established.

CPA enhancement is discretionary and subject to its statutory multiplier/cap language. The exact treatment of the cap relative to an actual award and district-court jurisdiction remains held.
RCW 19.86.170’s permitted-transaction exemption is qualified. Merely holding a regulatory license is not textually the same as establishing that the challenged transaction was permitted.
The attorney general’s injunction/restoration authority and civil-penalty structure are public remedies, separate from a borrower’s private damages claim.
The CPA penalty provisions distinguish an injunction violation, each .020 violation, and an enhanced demographic-targeting/impact penalty; the advertising-medium exception and federal armed-forces definition remain material.
The CPA private-damages period is four years from accrual, with the specified AG-action suspension and exclusions. Accrual, other tolling, and actual timeliness are not determined.
The director may informally settle complaints/enforcement matters except where another statute forbids it; required complaint-contact disclosures do not establish that a complaint was made or that relief follows.
No standalone general nonwaiver clause was identified in the complete core chapters. Express anti-pressure/evasion rules and the no-less-favorable plan condition remain operative. Arbitration, waiver, severability, and contract construction are held.

The 2009 reform replaced the former successive-loan plan structure with the present inability/request structure and added the major aggregate, count, database, and plan protections, effective January 1, 2010.
The opened 2014 statutory amendments address sanctions/settlement, confidentiality, and condition reporting; they do not establish a separate small-loan product.
The 2016 permanent rule amended the relevant definitions, plan distribution, due-date/prepayment, database, security/privacy, and closure provisions, effective June 1, 2016.
WSR 25-04-038 adopted the database fee amendment effective March 1, 2025. A purpose recital mentioning the earlier fee does not displace the amended operative text.
The 2010 notice and reporting provisions have express historical reference periods. Their continued appearance in codification does not turn them into an evergreen new-loan notice requirement.
Current codification, a 2026 agency index, and the 2026 agenda were checked. The returned index horizon and the agenda’s chapter-number mismatch prevent an unqualified assertion that all later filings or future-effective changes were exhausted.

The relevant statutory chapter is chapter 31.45 RCW, Check Cashers and Sellers; the implementing chapter is chapter 208-630 WAC, Regulation of Check Cashers and Sellers and Small Loans (Payday Lenders).
Recorded check status: whole row read traced original source attribution unreopened
WAC 208-630-110 equates payday advance, payday, and deferred-deposit loans with the chapter’s small loan. This is an in-chapter definition, not a universal classification of marketed products.
Recorded check status: whole row read traced original source attribution unreopened
A chapter 31.45 borrower is a natural person receiving a small loan. The definition does not itself impose the consumer-purpose formulation used in other chapters.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
“Licensee” includes a check casher or seller, inside or outside Washington, that failed to obtain a required license or endorsement. The definition does not itself establish that a particular activity required one.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
“Check” incorporates RCW 62A.3-104(f) and, for small-loan business, adds electronic forms of payment. The rule’s “postdated check” definition excludes an electronically submitted promise or order. These are distinct definitions; full UCC instrument consequences remain held.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Chapter 31.45 does not apply to a financial institution or trust company authorized to do business in Washington. “Financial institution” includes the specified bank, savings, and credit-union categories.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The incidental check-cashing exemption requires all three conditions: customer convenience, a minor part of customary business, and no profit from the activity.
Recorded check status: whole row read traced original source attribution unreopened
The audited-net-worth exemption concerns issuance or sale of instruments by the specified entities, and a separate paragraph covers their issuance/sale agents. It is not textually a general small-loan exemption.
Recorded check status: whole row read traced original source attribution unreopened
A discretionary exemption requires an application and a director finding that the applicant is not primarily a check-cashing/selling business and that the exemption would not harm the public. Filing is not the exemption.
Recorded check status: whole row read traced original source attribution unreopened
A person making small loans as agent for a licensee or exempt entity is subject to RCW 31.45.079’s license-and-endorsement requirement. Its federal-preemption qualification reaches only the provisions actually preempted; preemption is not established here.
Recorded check status: whole row read traced original source attribution unreopened
RCW 31.45.105(1)(d) expressly reaches making a small loan to a person physically in Washington through internet, telephone, facsimile, kiosk, or other means without the endorsement.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The physical-location clause and outside-state licensee definition do not complete residence-only, choice-of-law, tribal-jurisdiction, sovereign-immunity, or federal-preemption questions.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
RCW 31.04.025(4)(d) separately excludes persons making loans under chapter 31.45 from the Consumer Loan Act. Ordinary CLA credit therefore cannot be merged into this sector solely because it is small or short term.
Recorded check status: whole row read traced original source attribution unreopened
The CLA’s business-purpose exclusion and its residential-dwelling qualification are chapter-specific. Neither that exclusion nor the supplied chapter 18.28 finding establishes a chapter 31.45 business-purpose exemption.
Recorded check status: whole row read traced original source attribution unreopened
Retail installment sales have separate definitions in RCW 63.14.010. RCW 31.45.105(1)(e) additionally prohibits the specified retail installment sale of open-loop prepaid access. The incorporated federal prepaid definitions were not authenticated because the official route was blocked.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
RCW 31.45.070(2)’s government/employer payroll-check exception concerns a check payable on the first banking day after cashing. It is not a general employer wage-advance or earned-wage-access exemption.
Recorded check status: whole row read traced original source attribution unreopened
Classification of earned-wage advances, tips, subscriptions, expedited-access charges, and nonrecourse arrangements is not settled by a marketed label or the payroll-check exception. The opened EWA bill histories do not authenticate an enacted alternative framework.
Recorded check status: whole row read traced original source attribution unreopened
A chapter 31.45 small loan cannot take other property, title, or ownership evidence as collateral. Pawnbroking is separately defined and recognized in the same-premises provision; complete pawn/title/secured-credit law is outside this pass.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The complete current chapter reviewed does not establish the separate “small consumer installment loan” framework proposed in the opened 2015 bill history. That history supplies proposal status, not an adopted product or a universal absence finding.
Recorded check status: whole row read traced original source attribution unreopened
RCW 31.45.210 supplies its own military-borrower definition and protections. WAC 208-630-5401 separately incorporates federal military-credit law; the full federal coverage, exclusions, and consequences remain held.
Recorded check status: whole row read traced original source attribution unreopened
The endorsement application is a written application supported by required security and financial information. The rule requires current-quarter GAAP information and specified background information; these are application predicates, not an approval.
Recorded check status: whole row read traced original source attribution unreopened
Issuance depends on the director’s investigation and findings concerning statutory compliance, financial responsibility, fitness, and security; discretionary and mandatory disqualifications differ.
Recorded check status: whole row read traced original source attribution unreopened
The license is nontransferable/nonassignable and must be posted. Continuing status is subject to annual-assessment and expiration provisions; it is not a permanent authorization unaffected by later duties.
Recorded check status: whole row read traced original source attribution unreopened
RCW 31.45.043 authorizes a multistate application/administration system, and .045 concerns condition reports. A system submission is distinct from issuance of a license or endorsement.
Recorded check status: whole row read traced original source attribution unreopened
The rules recognize branches and treat staffed or unstaffed terminals/kiosks as locations; placement on an exempt entity’s premises does not itself supply the required authorization.
Recorded check status: whole row read traced original source attribution unreopened
Small-loan agent services have a limited-agent licensing structure under -135–138. The current service list covers marketing, information gathering, documentation, disclosures, and collection subject to the collection qualification.
Recorded check status: whole row read traced original source attribution unreopened
Endorsed persons and specified persons licensed, exempt, or otherwise authorized to collect under Washington law are excluded from the rule’s agent-services definition. Full chapter 19.16 collector status is not determined.
Recorded check status: whole row read traced original source attribution unreopened
Limited agents have public-facing nonlender/complaint/privacy disclosures and restrictions on selling nonpublic information to unlicensed recipients; consent concerning uses outside the represented scope is separately required.
Recorded check status: whole row read traced original source attribution unreopened
The small-loan bond secures borrower loss caused by chapter/rule violations, subject to express exclusions for interest, consequential damages, and specified tort liabilities. It is not general liability insurance.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The adopted small-loan bond amount is the base plus the increment for endorsed branches beyond one branch. Whether a headquarters is counted as a branch is not resolved by inventing a counting rule.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
RCW 31.45.030 and WAC -130 use net worth in excess of three times the bond; WAC -260 uses at least three times. Equality is held; the inclusive rule wording is not treated as overriding the statute.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
A permitted bond alternative requires director approval and continuing financial reporting, asset exclusions, and corrective security duties. Accounting charge-off under that rule does not itself discharge a borrower’s debt.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
A borrower damaged by a chapter/rule violation may have a bond/deposit action, subject to exclusive superior-court jurisdiction, the literal dishonor-based period, valid-claim requirements, and proportional sharing if insufficient. The clock for loan injury without a relevant dishonor is held.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
RCW 31.45.080’s trust-fund structure concerns funds from sales of checks and similar instruments. It is not authority for treating all small-loan proceeds or repayments as the same trust fund or imposing a universal loan liquidity reserve.
Recorded check status: whole row read traced original source attribution unreopened
Application, examination, annual-assessment, bond, and database amounts are licensee-side obligations. They are distinct from the borrower-facing fee permissions in .073 and the default rules.
Recorded check status: whole row read traced original source attribution unreopened
The principal limit applies both to an individual small loan and to outstanding principal across all licensees at one time, using the lower of the dollar and gross-income limits.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Gross monthly income is total personal income earned during a month before taxes/deductions. The text does not provide a complete irregular-income annualization or rounding algorithm.
Recorded check status: whole row read traced original source attribution unreopened
The rule requires income substantiation by enumerated or approved methods, periodic independent verification, and written change/no-change information between verifications.
Recorded check status: whole row read traced original source attribution unreopened
A new small loan cannot pay an existing small loan of the same lender or affiliate, and proceeds cannot be applied to another loan of that lender or affiliate.
Recorded check status: whole row read traced original source attribution unreopened
Due-date and maximum-term rules operate together, with a no-additional-cost extension exception. The precise seventh-day issue and interaction of a closed-day extension with the maximum term remain held.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
For the due-date rule, the relevant pay date is the later of scheduled pay and electronic credit to the account. This is a statutory/rule reference event, not an actual account finding.
Recorded check status: whole row read traced original source attribution unreopened
The charge ceiling aggregates interest and fees, using the statutory principal tiers; it is not an independently authenticated annual rate or APR ceiling.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The director has rulemaking authority to identify fees outside .073’s limit. That delegation does not itself establish any unlisted fee, insurance charge, subscription, tip, or database-fee pass-through permission.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The default-related new-loan bar ends at the earlier statutory event: full payment or passage of the specified period from loan origination. It is not a debt-discharge or general limitations rule.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
No additional universal post-payment cooling-off interval was authenticated in the complete current core text. The former successive-loan structure cannot be imported as a current waiting period.
Recorded check status: whole row read traced original source attribution unreopened
Each endorsed small loan must have a written note/agreement containing origination, principal, repayment method and cash-redemption cutoff if applicable, termination, fee amount/method, APR, and borrower signature or electronic signature.
Recorded check status: whole row read traced original source attribution unreopened
State law requires charge/term information, APR treatment in relevant advertisements, and delivery of applicable disclosures. Its TILA/Regulation Z references do not complete federal coverage, calculation, timing, or remedies.
Recorded check status: whole row read traced original source attribution unreopened
The application-front warning has a minimum type-size requirement. Its required substance is recorded without reproducing a consumer notice or template.
Recorded check status: whole row read traced original source attribution unreopened
Rights disclosures must be clear and conspicuous; location and internet posting duties are separate. The website rule’s self-reference to subsections “(1) and (2)” is preserved as a drafting issue.
Recorded check status: whole row read traced original source attribution unreopened
WAC -601’s Spanish-language notice provision is explicitly part of the 2010 transition notice. It does not authenticate a general current duty to translate every agreement.
Recorded check status: whole row read traced original source attribution unreopened
The statutory rescission right is conditional on timely return of principal in the permitted form and carries no charge. The statute/rule wording and electronic-receipt reference events must be reconciled before any actual deadline conclusion.
Recorded check status: whole row read traced original source attribution unreopened
Rescission requires return of the security/electronic equivalent; the rule provides return or requested destruction and voiding of an ACH authorization that cannot be destroyed. This concerns authorization as well as contract rescission.
Recorded check status: whole row read traced original source attribution unreopened

Recorded check status: selected primary clause comparison only nested otherlaw history application held
The request rule permits a request on or before the due date, with a due-day cutoff and an extension when the loan due date extends. The prohibition rule’s shorter “before” wording is not used to erase the express same-day provision.
Recorded check status: whole row read traced original source attribution unreopened
The minimum plan periods depend on the amount threshold, but .084 changes from “loan amount” to “loaned amount,” while the rules use other formulations. The fee-inclusive threshold boundary is held.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Substantial equality, pay-date positioning, spacing, monthly distribution, and the minimum-payment-count language must be read together. The rule allowing mutually agreed fewer payments is not silently treated as eliminating the other rule’s minimum.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The rule states division of plan balance by payment count, subject to reasonable rounding. It supplies no precise rounding algorithm or residual-allocation method.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
On plan initiation, the original postdated check must be returned or, under the rule at the borrower’s request, destroyed; the original ACH authorization becomes unusable/void under the stated conditions.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The plan may have installment checks limited to the corresponding installment amount, and a new ACH authorization consistent with plan terms may be accepted. An installment-check dishonor alone cannot generate a separate dishonor fee.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Failure to honor a plan entered through the specified accredited third party with certified credit counselors violates the chapter. This does not establish that such an agreement exists.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Ordinary-loan default follows the agreement’s payment terms; the database rule separately addresses a stated cutoff time and the absence of one. The plan’s grace provision is not automatically imported into ordinary-loan default.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Plan default uses the statutory ten-day condition. The database rule’s “11th day” with due date zero conflicts with its embedded calendar illustration. No actual default date is derived.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
“Paid” is conditionally defined around full payment of a valid loan; returned checks and denied ACH authorizations defeat the specified paid status. Initiating a payment is not a determination of debt validity or final banking consequences.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The ordinary small-loan security permission is one postdated check, with the statutory prohibition on other collateral; permitted disbursement forms are separately stated.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The rule limits checks held from a borrower by the principal/income ceiling plus allowable fees; a returned deposited check is not treated as still “held” for that rule.
Recorded check status: whole row read traced original source attribution unreopened

Recorded check status: selected primary clause comparison only nested otherlaw history application held
Separate presumptions address frequency, employment contact, residence hours, and third-party contact. Their exact counts, recipients, week definition, and unresolved hour endpoints appear in Q026–Q028.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The statutory communication exclusions cover in-store contact, specified unanswered calls, and an initial FDCPA-disclosure letter. Initiation controls timing; reasonably believed cell-phone calls have the stated workplace-count qualification.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Initiated telephone/written collection communications require a reviewable log. A response to borrower-initiated contact is treated differently for logging but remains subject to substantive conduct restrictions.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Assignment of a dishonored check to a third party carries .082’s restrictions to that collection. This does not decide debt ownership, general assignment authority, servicing capacity, or holder-in-due-course status.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
For the specified civil dishonored-check action, .082 allows collection costs as permitted by .515 but excludes that section’s attorneys’ fees, interest, and other damages.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The incorporated check-cost mechanism has notice and mailing-affidavit predicates and consequences for prohibited demands. Its general notice language cannot be transplanted as permission to threaten criminal prosecution in this sector.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
RCW 62A.3-515 excludes a check dishonored because of a justifiable stop-payment order. Determining justification, enforcement standing, missing-instrument rights, or a particular fee combination requires additional law/application and remains held.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The ordinary rule requires transaction registration and an authorization number before making the loan; an initial eligibility response is distinct from registered transaction authorization.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
An ineligibility determination requires delivery of the printable reason message with the specified database-support information. This is a disclosure duty, not proof of any actual database result.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The rule refers data-entry mistakes to the system’s administrative-void process. It does not itself supply a complete borrower inspection, correction, or dispute procedure; private vendor instructions were not inspected.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The system has confidentiality/security requirements and restricted public disclosure; these duties do not establish a particular financial record or authorize its retrieval.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Outage treatment is conditional on the specified temporary or written authorization process and later registration. Exact legal timing is recorded in Q031–Q033; fractional additional outage periods are unresolved.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
A rescinded loan is closed as soon as practicable, does not count toward the eight-loan limit, and does not incur the licensee’s database transaction fee.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Paid/default status must be updated as soon as practicable; the rule separately defines payment of a defaulted loan as payment of loaned amount plus the default fee.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
Receipt of formal bankruptcy-discharge notice triggers the rule’s specified paid-status/comment treatment and retention in the loan count. This is only a state database duty; no bankruptcy discharge, stay, or liability conclusion is made.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
The adopted database charge is a licensee-side per-registration charge, with the rescission exception; nonpayment and training requirements concern database access, not issuance of a lending license.
Recorded check status: selected primary clause comparison only nested otherlaw history application held

Recorded check status: whole row read traced original source attribution unreopened

Recorded check status: whole row read traced original source attribution unreopened
Closing reporting differs for check sellers and other licensees. The statute’s suspension/surrender wording and the rule’s accountant treatment leave a precise reconciliation hold.

The chapter prohibits the specified fraudulent/unfair conduct, misleading advertising, unendorsed remote lending, prohibited prepaid-access sale, and failures to pay regulatory obligations. These prohibitions occupy different statutory subsections.
Recorded check status: selected primary clause comparison only nested otherlaw history application held
