SettleADebt — S_WA PASS-06
Washington non-earnings bank/deposit garnishment, account protections, and exemption process
Actual public-source access: October 28, 2026, America/Los_Angeles.
The newly read authorities establish three distinct protections:
- Washington’s aggregate deposit exemptions, including automatic protection specified in RCW 6.15.010 and the statutory bank-writ language.
- Federal financial-institution processing protection under 31 CFR part 212, calculated separately for each qualifying account.
- Additional source-based exemptions, which can extend beyond the federal protected amount but require the applicable benefit statute, exceptions, and any necessary tracing to be established.
The Washington amounts, federal symbolic relation, and procedural periods are recorded in the quantity register below. They do not establish a combined state-plus-federal exemption formula or an actual amount subject to restraint. Ownership, jurisdiction, a valid enforceable judgment, correct debt classification, source qualification, and the unresolved interactions identified below remain predicates. RCW 6.15.010, RCW 6.27.100, and 31 CFR 212.5–212.9 supply different rules that must be applied within their own scopes. app.leg.wa.gov+5
This component uses no substantive finding from PASS-01 through PASS-05. The supplied earlier coverage records establish scope exclusions only. Their findings, provenance, and holds remain unchanged.
Reading and citation conventions
- Each full source ID begins S_WA-P6-S; each full claim ID begins S_WA-P6-C. Short references such as S003, C069, Q021, B015 refer exclusively to this pass.
- A repeated source ID identifies additional sections or formats of the same registered instrument, not independent corroboration.
- All source-register entries were accessed on the date above. “Current” means the displayed codified text, subject to its stated currency and the limitations recorded below.
- “Complete” describes the specified section or subsection, not an entire title, chapter, enactment, or linked body of law.
- PDF readings were parsed text, not page-pixel inspections. Page references give printed pages and zero-based PDF indices.
- Historical credits are distinguished from verified effective dates. A leading amendment credit is not itself proof of a clause’s effective date.
1. Substantive findings and category boundaries
1.1 What each authority governs
| Category |
Newly established public-text framework |
Boundary retained |
Claims |
| Ordinary Washington judgment garnishment |
Chapter 6.27 RCW provides issuance, financial-institution service, restraint, answer, exemption, adjudication, and release provisions. |
No actual enforceable judgment, territorial reach, ownership, or entitlement established. |
C001–C012 |
| Prejudgment garnishment |
RCW 6.27.020(3) expressly refers to chapter 6.26 RCW and exceptions. CR 64 leaves seizure remedies dependent on governing law. |
Complete prejudgment prerequisites were not investigated; ordinary postjudgment conclusions are not transferred to that branch. |
C003, C091 |
| Financial institution named as garnishee |
RCW 6.27.080 distinguishes an institution from a particular branch and gives each a different statutory reach. |
Naming an institution does not establish control of all property everywhere or personal jurisdiction. |
C008–C010 |
| Compensation still owed |
“Earnings” includes compensation paid or payable for personal services and specified periodic pension or retirement payments. |
Wage ceilings and continuing-writ quantities remain outside this pass. |
C006–C007 |
| Compensation deposited into an account |
Deposit protections and source-based protections require classification under the relevant text. |
The read statutes do not justify a categorical conclusion that every deposited wage either retains or loses earnings protection. |
C007, B006 |
| State deposit exemption |
The debt-specific limits operate within an aggregate statutory category; automatic protection differs for private student debt. |
No multiplication by the number of accounts or institutions; cross-institution implementation remains unresolved. |
C015–C020, C026 |
| Federal account review |
Part 212 applies to defined accounts, holders, institutions, orders, and qualifying direct-deposit benefit payments. |
It is neither an all-benefits rule nor a general ownership adjudication. |
C027–C043 |
| Additional benefit exemption |
Federal and state benefit statutes may protect funds beyond the part 212 protected amount. |
Each statute’s exceptions and post-deposit/tracing questions remain distinct. |
C048–C062 |
| Administrative, tax, support, or government process |
Some such orders fall within part 212’s broad order definition or its special notice branch. |
Inclusion in a processing rule does not establish substantive authority to attach every benefit. |
C029, C032, C055 |
| Release, discharge, and satisfaction |
Separate statutory provisions address release of exempt funds, discharge of a garnishee, and satisfaction of the underlying obligation. |
These events are not interchangeable. |
C072, C076–C085 |
Material findings requiring particular care
Automatic protection and a claimed exemption are different. The current state statute automatically protects the full ordinary-other-debt and consumer-debt deposit limits, but specifies a smaller automatic amount within the private-student-loan exemption. The statutory writ’s combined private-student/consumer blank therefore needs careful reconciliation with those separate amounts; this pass does not select a favorable blank value. C016–C018, C026; Q002–Q004; B003. app.leg.wa.gov+2
The federal protected amount is a processing protection, not a universal ceiling on exempt funds. A qualifying review produces the lesser-of relation in Q012. Additional federal exemptions remain assertable above that amount, and compatible greater state protection is preserved. C031, C036–C044. ecfr.gov+3
The federal rule does not require inter-account tracing during the automated review. It directs separate reviews and disregards commingling and co-ownership for that review. That does not decide ultimate ownership or the availability of an additional traced exemption. C034–C035, C043. ecfr.gov
The state exemption-claim process and a challenge to the garnishee’s answer have different triggers. The former principally uses the writ date, a delayed-service alternative, and receipt of the exemption claim; the latter uses filing of the answer. Prejudgment tender introduces additional wording that cannot safely be flattened into a single universal clock. C069–C079. app.leg.wa.gov+2

10. Researcher self-check and exact continuation boundary
Actual reading versus remaining holds
The research newly read the operative Washington deposit-exemption provisions, their material 2025 amendment and sunset repeal, the bank-specific portions of chapter 6.27, the complete relied-on federal part 212 provisions, original material federal amendments, and the listed benefit statutes and generic court rules. The source register identifies partial reads expressly.
The principal unresolved legal questions are:
- deposited-wage classification;
- cross-institution state aggregation and coordination;
- private-student-loan writ blanks;
- state/federal overlap and nonduplication;
- automatic protection versus state claim-waiver language;
- tracing beyond the federal automated review;
- bank-mail service effect and particular time-computation interactions;
- tender-related claim/controversion timing;
- enumerated special-benefit, pension-qualification, tax/support, and public-plan incorporations;
- the specific reviser-note discrepancy and enactment-status limitations.
These are substantive holds, not presumed favorable outcomes.
Currentness and method limits
The Washington operative bodies and material session laws were accessed on October 28, 2026 Pacific. The eCFR text displayed currency through October 26, 2026; the United States Code pages displayed the individual dates recorded in the register. Those publication intervals remain explicit. Original court adoption orders and the original 1994 pension application enactment were not separately authenticated.
No judicial opinions, dockets, actual parties, banks, accounts, benefits, transactions, issued instruments, completed forms, or private policies were investigated. Incidental opinion search results were not opened or used. No numerical balance, benefit, payment, or calendar scenario was constructed. No supplied earlier review was relabeled as fresh reading.
This is a researcher self-check, not an independent review. It does not close other Washington categories, the rest of registry dimension 5, earlier pass holds, or any state/A066/parent/publication/operational acceptance condition.
