SettleADebt — Washington PASS-03
Generic limitation periods, accrual, acknowledgment, payment and revival
Actual research access: October 28, 2026, America/Los_Angeles (PDT).
This pass establishes the public-text framework for Washington’s previously excluded registry dimension 3. It leaves the PASS-01 and PASS-02 fee, fair-share, nonprofit, cancellation and funds findings unchanged. The supplied exclusion records are scope context only; they are not substantive evidence for this report.
The principal findings are:
- Washington’s ordinary written-contract, unwritten-liability and account-receivable provisions require separate classification. Sales of goods, leases of goods, negotiable instruments and judgments have additional rules.
- Current RCW 4.16.270 and .280 expressly prevent post-expiration payment or acknowledgment/promise from restarting, reviving or extending the limitation period. A qualifying payment before expiration has a different statutory treatment. The 2019 enactment was read; its application to earlier conduct remains a distinct question.
- The ordinary contract statutes do not themselves supply a complete rule for breach accrual, separate installments or effective acceleration. Article 3 of the UCC expressly identifies several due-date, demand, acceptance and dishonor triggers.
- Regulation F prohibits a covered debt collector from suing or threatening suit to collect a time-barred consumer debt, subject to its express bankruptcy-proof-of-claim exception. That federal conduct rule does not determine the underlying state limitation period. app.leg.wa.gov+4
No actual claim, obligation, filing deadline, legal outcome or individual eligibility is determined here. All conditional relations below use statutory categories and events.
How to read the registers
The full identifiers appear in the source and claim registers. Elsewhere, S001, C001, B001 and Q001 mean the corresponding S_WA-P3- identifier.
“Text established” means the stated proposition is supported by the passages actually read, within the source’s stated currency. It does not mean that a claim has been classified, that predicates have been proved, or that judicial construction has been completed.
“Held” identifies a missing legal predicate, incorporation, historical application question or judicial interpretation. The branch register identifies the exact remaining inquiry.

Precise public-text proposition |
Authority, conditions and limits |
| S_WA-P3-C001 |
Chapter 4.16 generally measures its periods after accrual, while preserving exceptions within the chapter and special limitations prescribed elsewhere. |
S001, RCW 4.16.005. Text established. It supplies no universal execution, maturity, default or discovery event. B001, B005, B021. |
| S_WA-P3-C002 |
An action on a written contract, or an express or implied liability arising from a written agreement, has a six-year period, subject to the express mortgage-release exception. |
S001, .040(1); S007, 64.04.007(2). Classification and accrual remain separate. B001, B005. |
| S_WA-P3-C003 |
An action on an account receivable has a six-year period. The definition concerns a payment obligation incurred in the ordinary course of the claimant’s business or profession, arising from one or more transactions, whether or not earned by performance. |
S001, .040(2). A written agreement is not stated as a prerequisite to this category. Assignment and the claimant-business language require care. B001. |
| S_WA-P3-C004 |
An action on an express or implied contract or liability that is not in writing and does not arise from a written instrument has a three-year period, except an account receivable under .040(2). |
S001, .080(3). “Unwritten” alone does not establish the three-year branch. B001. |
| S_WA-P3-C005 |
The general provision for rents, profits, and use or occupation of real estate states six years. |
S001, .040(3). This is not a completed landlord-tenant or other real-property sector analysis; special statutes remain reserved by .005. B021. |
| S_WA-P3-C006 |
Relief not otherwise provided for has a residual two-year period after accrual. |
S001, .130. Uncertainty about classification does not establish that the residual category applies. B001. |
| S_WA-P3-C007 |
For a mutual, open and current account involving reciprocal demands, the statutory accrual event is the last item proved on either side. |
S001, .150, first sentence. This is an accrual rule, not a freestanding period or a definition covering every revolving or unpaid account. B002. |
| S_WA-P3-C008 |
A lapse of more than one year between a series of account items excludes those items from the statutory mutual-account treatment. |
S001, .150, second sentence. The text uses a strict “more than” boundary; reciprocity and account classification are still necessary. B002. |
| S_WA-P3-C009 |
An action for breach of a contract for the sale of goods has a four-year period after accrual. |
S003, 62A.2-725(1), with 2-102, 2-105 and 2-106. Goods, hybrid-transaction and special-law qualifications matter. B004. |
| S_WA-P3-C010 |
Under the sales provision, a breach claim accrues when the breach occurs, irrespective of the aggrieved party’s lack of knowledge. |
S003, 2-725(2), first sentence. What constitutes the relevant breach remains a separate issue. B004, B006. |
| S_WA-P3-C011 |
A sales warranty ordinarily is breached at tender of delivery. An expressly future-performance warranty has the statutory discovery exception only when discovery of the breach must await that future performance. |
S003, 2-725(2), remaining sentences. The exception is not a general discovery rule for unpaid debts. B004, B006. |
| S_WA-P3-C012 |
The original sales agreement may shorten the four-year period to not less than one year, but may not extend it. |
S003, 2-725(1). No agreement was examined and no contractual modification is assumed. B004. |
| S_WA-P3-C013 |
The sales statute permits a qualifying second action within six months after termination of a timely first action, when another action remains available; voluntary discontinuance and dismissal for failure or neglect to prosecute are excluded. |
S003, 2-725(3)–(4). It preserves tolling law and excludes pre-effective accruals. It is not a general Washington refiling rule. B017, B026. |
| S_WA-P3-C014 |
An action for default under a lease contract governed by Article 2A, including warranty or indemnity, has a four-year period after accrual. |
S003, 2A-506(1), with 2A-102 and 2A-103. This concerns qualifying leases of goods, not every arrangement described as a lease. B004. |
| S_WA-P3-C015 |
For an Article 2A default or warranty claim, accrual is the later of the specified actual/constructive discovery event or occurrence of the default. |
S003, 2A-506(2), first sentence. The underlying default and discovery predicates are not supplied here. B004, B006. |
| S_WA-P3-C016 |
The lease indemnity sentence refers to discovery of the act or omission and ends with “whichever is later,” without supplying a clear second comparator in that sentence. |
S003, 2A-506(2), second sentence. Held: no corrective wording or completed accrual formula is invented. B004. |
| S_WA-P3-C017 |
The original lease contract may reduce the Article 2A period to not less than one year. |
S003, 2A-506(1). Unlike 2-725(1), this subsection does not expressly state the same prohibition on extension; no conclusion about permitted extension is supplied. B004, B006. |
| S_WA-P3-C018 |
Article 2A has a conditional six-month second-action provision, with voluntary-discontinuance and failure-to-prosecute exclusions, while preserving tolling law and excluding pre-effective accruals. |
S003, 2A-506(3)–(4). B017, B026. |
The ordinary-contract and account distinctions come from the actual statutory bodies, including the express account-receivable exception to the unwritten-liability provision. The sales and lease discovery rules are materially different from each other. app.leg.wa.gov+4
1.2 Promissory notes and other negotiable instruments
Classification precedes the clock. Article 3 applies to qualifying negotiable instruments. Its scope excludes money, Article 4A payment orders and Article 8 securities; specified conflicts with Articles 4 and 9A and applicable Federal Reserve provisions also matter. A document’s title does not establish negotiability. app.leg.wa.gov+1
| Claim ID |
Category and precise period/trigger |
Authority, exceptions and limits |
| S_WA-P3-C019 |
The Article 3 branch requires the statutory negotiability conditions: an unconditional promise/order, fixed money amount, the required bearer/order status, demand or definite-time payment, and permitted additional undertakings only, subject to the statutory check exception and nonnegotiability exclusion. |
S003, 3-102; 3-103; 3-104(a)–(j); 3-106. A promise requires a signed written undertaking; an acknowledgment alone is not necessarily that undertaking. B003. |
| S_WA-P3-C020 |
A definite-time note generally has six years after the stated due date or dates. |
S003, 3-118(a). Certificate-of-deposit subsection (e) is excepted. The plural “dates” is express; it does not decide every non-UCC installment issue. B005, B008. |
| S_WA-P3-C021 |
If the definite-time note’s due date is accelerated, the stated period is six years after the accelerated due date. |
S003, 3-118(a). The section does not itself establish whether acceleration occurred effectively, its notice prerequisites, or later reversal of acceleration. B005. |
| S_WA-P3-C022 |
For a demand note, when demand for payment is made to the maker, the period is six years after demand. |
S003, 3-118(b), subject to (d) and (e). A qualifying demand must be established. B008. |
| S_WA-P3-C023 |
If no demand is made, enforcement of a demand note is barred when neither principal nor interest has been paid for a continuous ten-year period. |
S003, 3-118(b). This is a special no-demand/nonpayment branch, not a general ten-year loan period. Its interaction with .270 remains held. B008, B012. |
| S_WA-P3-C024 |
For an unaccepted draft, the statute uses six years after dishonor or ten years after the draft’s date, whichever expires first. |
S003, 3-118(c), except (d). Washington’s six-year dishonor limb was verified in the 1995 enactment. Actual statutory dishonor is a necessary predicate. B008, B009. |
| S_WA-P3-C025 |
Enforcement against the acceptor of a certified check or the issuer of a cashier’s, teller’s or traveler’s check has three years after demand for payment to the specified obligor. |
S003, 3-118(d); definitions in 3-104 and 3-409. These categories must not be folded into the ordinary demand-note rule. B008. |
| S_WA-P3-C026 |
A certificate of deposit generally has six years after demand. If it states a due date and earlier payment is not required, the period begins when a demand is in effect and the due date has passed. |
S003, 3-118(e); 3-104(j). Both predicates matter in the dated-CD branch. B008. |
| S_WA-P3-C027 |
For an accepted draft other than a certified check, the period is six years after the stated date/dates if payable at a definite time, or six years after acceptance if payable on demand. |
S003, 3-118(f); 3-409. Acceptance is a defined event, not simply receipt or an informal promise. B008. |
| S_WA-P3-C028 |
Article 3’s listed conversion, warranty and other-obligation actions generally have three years after accrual, unless another law governs indemnity or contribution. |
S003, 3-118(g). The subsection does not define every such accrual event or cover all Article 4 banking claims. B003, B009. |
| S_WA-P3-C029 |
Article 3 treats a note with no stated payment time as payable on demand. A fixed-date instrument also payable on earlier demand follows the demand branch if an earlier demand is made; otherwise the fixed date governs. |
S003, 3-108(a)–(c). Acceleration rights do not alone prevent definite-time classification. B008. |
| S_WA-P3-C030 |
Presentment, acceptance and dishonor have distinct statutory conditions. Nonpayment, refusal to certify, receipt of a communication and dishonor are not interchangeable events. |
S003, 3-409; 3-501; 3-502(a)–(f); 3-504; 4-104; 4-301; 4-302. Presentment can be excused; specified bank-return and accountability rules apply to checks; refusal to certify is not itself dishonor. Full specialized banking application remains held. B009. |
All seven limitation subsections of RCW 62A.3-118 were read. The presentment/dishonor cross-references were also read, rather than assuming that a colloquial “default” established the statutory trigger. app.leg.wa.gov+8
1.3 Mortgage-release exception, judgments and expressly separate liabilities
| Claim ID |
Precise proposition |
Authority, conditions and limits |
| S_WA-P3-C031 |
Under the specified owner-occupied mortgage/deed-of-trust release provision, a remaining-debt action must be commenced within three years after release; failure results in forfeiture of the right to collect the remaining debt. |
S007, 64.04.007(1)–(4); S001, .040(1). Applies to the defined individual personal/family/household situation, excludes business/commercial/agricultural obligations, and includes the statutory release/notice conditions. This is a narrow express forfeiture provision, not the general contract rule. B021, B027. |
| S_WA-P3-C032 |
An action upon a judgment or decree of the courts listed in .020(2) has a ten-year period, subject to extension under 6.17.020 or a similar provision elsewhere. |
S001, .020(2). This subsection does not itself state an entry-date accrual rule; .005 and any necessary construction remain relevant. B020. |
| S_WA-P3-C033 |
Ordinary execution, garnishment or other process under 6.17.020(1) is available within ten years from entry or filing of the judgment in Washington, subject to the section’s exceptions. |
S004, 6.17.020(1)–(4). This is an enforcement provision, separate from C032. No actual enforcement permission is determined. B020. |
| S_WA-P3-C034 |
A qualifying judgment extension may be sought within the ninety days before expiration of the original ten-year term, for an additional ten years. |
S004, .020(3). Includes forum, fee, updated-summary and review conditions. A transcribed district-court judgment has a specified superior-court route and transcript-based reference event. Full procedural incorporation of 4.64.030 remains held. B020. |
| S_WA-P3-C035 |
Section .020(7) contains a twenty-year enforcement ceiling from entry in the originating court, but expressly excepts .020(2)/(3) of chapter 4.16 and specified criminal/juvenile chapters. It does not extend a foreign judgment beyond its originating jurisdiction’s expiration. |
S004, .020(7). A universal twenty-year rule would omit express exceptions. B020, B021. |
| S_WA-P3-C036 |
The ordinary Washington judgment lien/charge terminates after ten years from entry, subject to the support and statutory-extension provisions. |
S005, 4.56.210(1)–(3); S004, .020(6). Lien perfection, priority and collateral enforcement are not completed here. B020, B027. |
| S_WA-P3-C037 |
For Title 6 and the identified judgment-lien provisions, superior-court entry occurs upon delivery to the clerk for filing; district/small-claims entry occurs upon docket entry. |
S006, 6.01.020. This definition is limited to the provisions specified in its text. B020. |
| S_WA-P3-C038 |
Qualifying past-due child-support orders use a separate ten years from the youngest supported child’s eighteenth birthday framework, with the statutory after July 23, 1989 conditions. |
S001, .020(3); S004, .020(2); S020, 74.20A.020(6). Administrative-order and full support-regime incorporations remain incomplete. No ordinary-contract default is assigned. B021. |
| S_WA-P3-C039 |
Chapter 4.16 generally does not limit actions in the State’s name or for its benefit, subject to the express .310 exception. |
S001, .160. It is not a conclusion about all federal, local, tax or publicly held obligations. B021. |
| S_WA-P3-C040 |
Counties, municipalities and quasi-municipalities are generally subject to the same chapter limitations as private parties. |
S001, .160. Special statutory periods and classifications remain possible. B021. |
| S_WA-P3-C041 |
Special assessments, specified public instruments, taxes, support, criminal financial obligations, probate claims and construction-related liabilities cannot safely be assigned an ordinary-contract period solely because money is sought. |
S001, .005, .020, .030, .050–.070, .160, .200, .300–.310; S004, .020(4); S011. This is a bounded classification warning from the statutory structure, not completion of those separate regimes. B021. |
The release statute expressly addresses forfeiture of collection rights, while the judgment statutes separately address actions, process, duration and liens. Those consequences should not be merged. app.leg.wa.gov+6
1.4 Accrual, borrowing, tolling, commencement and counting
| Claim ID |
Precise proposition |
Authority, conditions and limits |
| S_WA-P3-C042 |
If a claim is substantively based on one other state’s law, that state’s limitation applies; if based on more than one state’s law, Washington conflicts law selects among them; other claims use Washington’s limitation, subject to the unfairness exception. |
S002, 4.18.010–.020, .040. “State” includes a foreign country and specified subdivisions. No governing-law determination is made. B007. |
| S_WA-P3-C043 |
When another state’s limitation applies under chapter 4.18, that state’s accrual and tolling law also applies, but not its conflicts rules. |
S002, .030. A foreign period cannot be imported while automatically retaining Washington accrual/tolling. B007. |
| S_WA-P3-C044 |
A court may substitute Washington’s period under the statutory unfairness test involving a substantially different foreign period and the stated unfair opportunity/burden condition. |
S002, .040. Requires the specified court determination; no automatic preference for the longer or shorter period. B007. |
| S_WA-P3-C045 |
RCW 4.16.290 separately bars a Washington action where a cause arose elsewhere between Washington nonresidents and is barred there by lapse of time. |
S001, .290. Its reconciliation with chapter 4.18 and the relevant residence/time predicates remains held. B007. |
| S_WA-P3-C046 |
Section .180 addresses absence/nonresidence/concealment at accrual and later departure/residence outside Washington or concealment. |
S001, .180. Its text was read, but out-of-state service is also authorized in specified circumstances by S010, 4.28.180. No automatic toll for every period outside Washington is inferred. B014. |
| S_WA-P3-C047 |
Section .190 excludes qualifying disability time when the person entitled to sue had the specified status at accrual: under eighteen; the stated inability to understand proceedings, determined according to chapter 11.130; or imprisonment on a criminal charge before sentencing. |
S001, .190. Express penalty/forfeiture and officer-escape exclusions apply. This is not a general debtor-disability immunity or a rule for all incarceration. S012 resolves only part of the guardianship incorporation. B015. |
| S_WA-P3-C048 |
Disability must exist at accrual; where qualifying disabilities coexist then, the statutory limitation does not attach until all are removed. |
S001, .250–.260. A later-arising disability is not automatically added under these provisions. B015. |
| S_WA-P3-C049 |
Section .210 excludes the specified wartime period for a person entitled to sue who is not a U.S. citizen/national and is a subject or citizen of a country at war with the United States. |
S001, .210; S040, §3. No nationality, war status or qualifying period is assumed. B021, B026. |
| S_WA-P3-C050 |
Time during which commencement is stayed by an injunction or statutory prohibition is excluded under .230. |
S001, .230. This does not establish a universal bankruptcy extension or equate every pause in proceedings with a bar to commencement. B017. |
| S_WA-P3-C051 |
Section .220 excludes a period when enforcement of civil liabilities against a person in U.S. military service is suspended by law. |
S001, .220. The suspending law and its scope must be identified; the state and federal military provisions below provide separate texts. B018–B019. |
| S_WA-P3-C052 |
If the person entitled to sue dies before expiration and the cause survives, .200 provides a conditional representative-action saving period after ordinary expiration and within one year after death, subject to chapter 11.40. |
S001, .200. Survival and probate qualifications prevent treating this as an automatic one-year extension. B016. |
| S_WA-P3-C053 |
Claims against a person who dies before expiration are directed to chapter 11.40; that chapter has independent presentation/nonclaim rules and a limited insurance exception. |
S001, .200; S011, 11.40.010, .051, .060. Notice, ascertainability, presentation, survival and other incorporations remain held. B016. |
| S_WA-P3-C054 |
A timely action followed by a judgment for the plaintiff that is reversed on appeal/error has a conditional one-year-from-reversal saving provision. |
S001, .240. It is not a general rule for all dismissals or abandoned actions; survival conditions remain. B017. |
| S_WA-P3-C055 |
For limitation tolling, .170 uses filing or service, whichever occurs first, with the specified companion step within ninety days; failure of that step defeats the statutory commencement treatment. |
S001, .170. The filing-first branch requires timely personal service on one or more defendants or commencement of publication. This text is not independent permission to use service first in every debt action. B022. |
| S_WA-P3-C056 |
CR 3(e) requires the summons and complaint to be filed and bear a case number before service on a debtor. CR 3(a) separately directs limitation tolling to .170; CRLJ 3 specifies commencement by filing. |
S017, CR 3(a), (e); S018, CRLJ 3; S019, 19.16.250(27). Forum, service and signature incorporations remain necessary. B022. |
| S_WA-P3-C057 |
RCW 1.12.040 and CR/CRLJ 6 contain first-day exclusion and last-day/holiday rules; the court rules additionally exclude intermediate weekends/holidays for periods shorter than seven days and provide a conditional mail-service addition. |
S015–S018. Their applicability must be established. No universal calendar convention, automatic mail addition to a limitation period, or calculated deadline is supplied. B022. |
| S_WA-P3-C080 |
The ordinary-contract provisions read here do not expressly settle accrual at execution, each missed installment, final maturity, demand, effective acceleration or de-acceleration. |
S001, .005, .040, .080. This is a bounded observation about those texts; judicial construction is deliberately held. Article 3’s express triggers remain distinct. B005, B028. |
| S_WA-P3-C081 |
The fraud provision has a three-year period with accrual postponed until discovery of the facts constituting fraud by the aggrieved party. |
S001, .080(4). This is a specific fraud provision, not an established discovery rule for every contract claim. B006. |
| S_WA-P3-C098 |
UCC choice of law permits an agreement where the transaction has the stated reasonable relationship; absent an effective agreement, an appropriate Washington relationship is required, subject to the enumerated specialized choice rules. |
S003, 1-301(a)–(c). The listed Article 2, 2A, 4, 4A, 5, 8, 9A and 12 exceptions were identified, not fully investigated. B007. |
The borrowing rules, disability clauses and procedural rules were read as separate provisions. In particular, the ninety-day tolling provision does not erase the debt-collection filing-first text in CR 3(e). app.leg.wa.gov+8
1.5 Acknowledgment, promise, payment and revival
| Claim ID |
Actor/action/object/timing and effect |
Authority and limits |
| S_WA-P3-C058 |
A payment upon an existing contract, including the listed bills, notes, bonds or other indebtedness evidence, before its applicable period expires, restarts the period from the most recent payment if made after it is due. |
S001, .270, first sentence. The text does not itself resolve payor authority, allocation among obligations/installments, or the meaning of “due” in every structure. B010, B012. |
| S_WA-P3-C059 |
A payment made after expiration does not restart, revive or extend the limitation period under the current provision. |
S001, .270, second sentence; S031, §1. Historical application and UCC reconciliation are separately held; no favorable revival inference is made. B012. |
| S_WA-P3-C060 |
An acknowledgment or promise is insufficient evidence of a new or continuing contract for taking the matter outside chapter 4.16 unless contained in a writing signed by the party to be charged. |
S001, .280, first clause. Writing/signature is a necessary condition in the text; the section does not declare every signed reference sufficient or specify a universal new accrual date. B011, B013. |
| S_WA-P3-C061 |
An acknowledgment or promise made after expiration does not restart, revive or extend the period. Section .280 separately preserves the effect of principal or interest payments. |
S001, .280; S031, §2. The payment provision must be considered separately; the preservation sentence does not negate .270’s post-expiration prohibition. B012. |
| S_WA-P3-C062 |
An oral statement, mere contact or an unperformed offer is not automatically a qualifying payment or a signed written acknowledgment/promise. |
Inference limited to S001, .270–.280. A particular writing could require analysis under .280 even without payment; no communication is classified here. B010–B011. |
| S_WA-P3-C063 |
Written assignment authorizes the assignee’s action subject to the statute’s preservation of defenses, counterclaims and offsets, with its specified negotiable-paper counterclaim/offset exception. The assignment provision states no assignment-based limitation restart. |
S008, 4.08.080. A creditor’s assignment is distinct from the charged party’s acknowledgment or a qualifying payment. Negotiable-instrument defense law is not completed. B001, B012. |
| S_WA-P3-C064 |
UETA can satisfy writing/signature requirements electronically within its scope, subject to agreement to transact electronically, attribution, intent and other applicable substantive law. |
S009, 1.80.010–.080. Its UCC exclusion, exceptions for Article 2/2A and 1-306, and other-law qualification prevent a blanket electronic-writing conclusion. It does not override the post-expiration prohibition. B013. |
| S_WA-P3-C065 |
Section .270 expressly names notes and bills, but the reviewed texts do not expressly reconcile all of its restart language with every clock in 3-118, particularly the continuous no-payment demand-note branch. |
S001, .270; S003, 1-103(b), 3-118. Held: neither a categorical negotiable-instrument carveout nor universal identical restarting is assumed. B012. |
| S_WA-P3-C066 |
The 2019 act added the express post-expiration prohibitions and the pre-expiration payment qualification; its certified effective date is July 28, 2019. The act contains two operative sections and no express retroactivity/application section. |
S031, cover and §§1–2. Conduct or claimed effects predating that enactment remain a historical-construction branch. B012, B026. |
The decisive distinction is the statutory combination of what occurred, whose act or signature is legally attributable, what obligation it concerns, whether it was due, and whether the applicable period had already expired. No payment, contact, sale or new promise is assumed. app.leg.wa.gov+5

Authority, conditions and limits |
| S_WA-P3-C067 |
Regulation F’s relevant debt definition concerns a consumer’s actual or alleged money obligation arising from a transaction primarily for personal, family or household purposes, whether reduced to judgment or not. |
S023, 1006.2(e), (h); S022, 1692a(3), (5). Business-purpose obligations are not automatically included. B023. |
| S_WA-P3-C068 |
Covered collector status includes the principal-purpose and regular-collection-for-another tests, plus the specified false-name own-creditor rule. |
S023, 1006.2(i)(1); S022, 1692a(6). The security-interest-enforcement addition is expressly for 1006.22(e); it does not by itself establish coverage under .26, although another collector test may apply. B023. |
| S_WA-P3-C069 |
The collector definition contains activity-specific exclusions for own-name creditor employees; qualifying affiliated collection; government officials performing duties; process servers; qualifying nonprofit counseling/distribution; and the specified fiduciary, originator, nondefault-at-acquisition and commercial-secured-party activities. |
S023, 1006.2(i)(2)(i)–(vi); S022, 1692a(6)(A)–(F). These are conditional federal exclusions, not conclusions about Washington provider exemptions or any entity. B023. |
| S_WA-P3-C070 |
Regulation F’s scope incorporates the motor-vehicle-dealer exclusion in 12 U.S.C. 5519(a), subject to that statute’s exceptions and defined dealer/vehicle conditions. |
S023, 1006.1(b); S025, 5519(a)–(f); S044. Mortgage activities, specified retained direct retail credit/leases, and unrelated financial products are exceptions. Other federal agency authority is preserved. Incorporated-definition currentness remains partly held. B024. |
| S_WA-P3-C071 |
A covered debt collector must not sue or threaten legal action against a consumer to collect a debt whose applicable limitation period has expired. |
S023, 1006.26(a)(1)–(2), (b); S024, adopted §1006.26. State/other applicable law must first establish expiration. B023, B027. |
| S_WA-P3-C072 |
The .26(b) prohibition expressly excludes proofs of claim filed in connection with bankruptcy. |
S023–S024, .26(b), second sentence. This is not a determination that any proof of claim is allowable or that other bankruptcy law permits it. B017, B027. |
| S_WA-P3-C073 |
FDCPA §1692e separately prohibits false representations about a debt’s legal status and threats to take action that cannot legally be taken or is not intended. |
S022, 1692e introductory text, (2)(A), (5). Full enforcement, remedies and judicial construction are outside this pass. B023, B028. |
| S_WA-P3-C074 |
FDCPA §1692e(6) prohibits falsely representing that sale, referral or transfer will cause loss of a claim or defense, or exposure to prohibited practices. |
S022, 1692e(6). This supports keeping assignment separate from automatic loss of limitation defenses. B023. |
| S_WA-P3-C075 |
Federal SCRA excludes the qualifying military-service period when computing covered action/proceeding limitations by or against the servicemember or the listed heirs, representatives or assigns. |
S026, 50 U.S.C. 3936(a). Subsection (b) separately addresses real-property redemption; (c) excludes federal internal-revenue limitation periods. Dependents’ own claims are not added to subsection (a)’s list by assumption. B019. |
| S_WA-P3-C076 |
Federal military-service classification requires the definitions and scope provisions, including the active-duty and specified National Guard branches; pre-service orders and waiver provisions require separate attention. |
S026, 3911, 3912, 3917, 3918; S027, 10 U.S.C. 101(a)(4)–(5), (d)(1); S028, 32 U.S.C. 502(f). Criminal proceedings are excluded from SCRA scope. Some definition currency and historical application remain held. B019. |
| S_WA-P3-C077 |
Washington .090 excludes qualifying military-service time for covered actions by or against the member or the listed dependents, heirs, representatives or assigns; it separately addresses redemption and excludes federal internal-revenue limitation periods. |
S013, 38.42.090(1)–(3), with .010, .020, .040, .100, .120; S014. State definitions and qualifications must be satisfied independently. B018. |
| S_WA-P3-C078 |
Washington’s chapter-level protection window begins with receipt of orders and extends through 180 days after termination/release, while .090 identifies the period of military service for exclusion from limitation computation. |
S013, .020(1), .090(1). The texts do not justify automatically adding the entire 180-day protection window to every limitation period. B018. |
| S_WA-P3-C079 |
A suit limitation, express forfeiture/nonclaim consequence, judgment-enforcement period, lien duration, reporting-obsolescence rule and bankruptcy discharge are different legal questions. |
S001, .005; S007, 64.04.007(2); S004–S005; S011; S023, .26. No reporting period, discharge conclusion, universal collection permission or universal revival-disclosure duty is derived from these provisions. B027. |
| S_WA-P3-C096 |
The private bad-check-program exclusion requires the prosecutor-established voluntary diversion framework, controlled contractual operation, statutory conduct/disclosure safeguards and the exclusions in §1692p(b). |
S022, 1692p(a)–(c); S029–S030, S045. Excluded checks include the specified payday/postdated, justified stop-payment, unnotified bank-adjustment, previously accepted partial-payment, incapacity/age and illegal-transaction categories. The written-dispute safeguard has a thirty-day condition. Remaining definition/regulatory currency limits are B025. |
| S_WA-P3-C097 |
A state exemption from FDCPA/Regulation F requirements requires the prescribed federal determination/regulatory process; it is not automatic because state law regulates collection. |
S022, 1692o; S023, 1006.108(a)–(b). No Washington-specific exemption determination was established. Appendix A procedures and any applicable exemption instrument remain held. B025. |
The federal prohibition and its definitions were read from the current eCFR display and compared with the adopted rule text. The military tolling provisions were read separately; no service status or waiver was assumed. ecfr.gov+9

The 2007 account-receivable amendment was effective July 22, 2007; §2 applies it to all account-receivable causes, whether commenced before or after that date. |
S032, cover, §§1–2. Treatment of an already-barred claim is not inferred merely from that language. B026. |
| S_WA-P3-C083 |
The 1995 Article 3 amendment changed the unaccepted-draft dishonor limb from three to six years, effective July 23, 1995. |
S035, cover, §1(c). The draft-date ten-year alternative remained. Earlier-version applications are held. |
| S_WA-P3-C084 |
The 2023 UCC act became effective January 1, 2024. Its general saving clause preserves specified pre-effective transactions under prior law, subject to enumerated transition exceptions. It amended hybrid-transaction scope and permitted specified governing-law/forum terms within negotiability. |
S036, §§201, 301, 401, 1103–1109, 1204. Specialized collateral/digital-asset transitions are not adjudicated. B026. |
| S_WA-P3-C085 |
UETA’s enactment was effective June 11, 2020, with prospective application to electronic records/signatures created, generated, sent, communicated, received or stored on or after its effective date. |
S042, cover, §4; S009, .030. Earlier electronic-writing law and Article 3 transferable-record issues remain held. B013, B026. |
| S_WA-P3-C086 |
The 2020 amendment changing .190’s guardianship reference to chapter 11.130 was assigned January 1, 2022 effectiveness by §907(1). |
S043, §§702, 907. This recovers that enactment’s date, not the complete current guardianship regime. |
| S_WA-P3-C087 |
The current .190 wording was re-enacted in 2023, with the former subsection concerning the medical-injury minor exception removed; the act’s certified effective date is July 23, 2023. |
S039, cover, §4. No medical-liability regime is analyzed here. |
| S_WA-P3-C088 |
The 2026 state military-definition amendment added the specified PHS/NOAA commissioned-service categories, effective June 11, 2026. |
S037, cover, §3. The military-service-call conditions remain separate. |
| S_WA-P3-C089 |
The 2025 amendment expressly including civil asset forfeiture in .020 became effective January 1, 2026; its enactment includes a seizure-based application clause. |
S038, §§14, 16–17. This does not complete forfeiture law or add a limitation interval to .090. |
| S_WA-P3-C090 |
The 2026 terminology amendment to .210 was effective June 11, 2026. The act’s specified 2027 delayed/expiration clauses concern other sections, not §3. |
S040, cover, §3, §§44–45. May 1 and June 30, 2027 are future dates in that act, not the operative date of .210’s amendment. |
| S_WA-P3-C091 |
The 2002 judgment amendment applies to the categories stated in .020(8): judgments in effect June 13, 2002; specified judgments extended after June 9, 1994, excluding satisfied/vacated/quashed judgments; and later filed/rendered judgments. |
S041, cover, §1(8); S004, .020(8). No automatic revival of an expired judgment is inferred. |
| S_WA-P3-C092 |
The enactment creating the mortgage-release rule and the .040(1) cross-reference was effective June 7, 2012, apart from an unrelated emergency-effective section. |
S033, cover, §§1, 3, 15. The unrelated section’s March 29, 2012 date is not assigned to this limitation rule. |
| S_WA-P3-C093 |
Chapter 4.18 applies to claims accruing after July 24, 1983, or asserted more than one year after that date, and does not revive a claim barred before that date. |
S002, .901; S034, §5. The original uses “effective date”; the codification supplies July 24. No separate constitutional calendar reconstruction was performed. |
| S_WA-P3-C094 |
The adopted Regulation F rule adding .26 stated November 30, 2021 as its effective date. |
S024, printed p.5766 [PDF index 0], adopted .26 at p.5854 [88]. Current codified text was also read. No litigation-status conclusion is supplied. |
| S_WA-P3-C095 |
Some older transition dates and procedural amendment dates were read only in codified notes/rule footers, not fully traced through their original enactments/orders. |
S003 includes the 1967, 1994 and 2012 transition materials; S017–S018 contain rule-history footers; S021 contains the 2022 criminal-financial-obligation effective-date note. These are expressly held historical branches, not independently authenticated original-adoption conclusions. B026. |
The 2019 nonrevival change is separately recorded in C066. Its complete two-section act was read, not reconstructed from an undated debt chart. lawfilesext.leg.wa.gov+16
2. Period, quantity, reference-event and boundary register
Counting key
- W — “Within” rule: the statute supplies a period and event; whether a terminal date is timely still requires the applicable computation and commencement rules. No calendar deadline is calculated.
- E — Event relation: the source specifies an event or ordering relation, not a universal day-count convention.
- X — Excluded interval: the qualifying interval is excluded; its factual duration and legal applicability are not supplied.
- K — Procedural computation: source-specific counting rule, subject to forum and applicability.
- V — Version boundary: the effective/application dates and inclusive/exclusive wording are in §1.7 and C066.
No year is converted into a fixed number of days. No period is rounded.

Adverse inference blocked |
Exact next generic inquiry |
| B001 |
Written-agreement, unwritten-liability, account-receivable or residual classification; treatment of assigned receivables under “claimant’s business.” |
Selecting a period from a product label, absence of a signed paper, or uncertainty alone. |
Resolve the generic classification boundaries under .040(1)–(2), .080(3), .130 and 4.08.080. Judicial construction remains outside this pass. C001–C006, C063. |
| B002 |
Reciprocal demands, qualifying account continuity and effect of the statutory item gap. |
Treating every running balance or sequence of bills as a mutual account; using a “last activity” label as accrual. |
Resolve the statutory meaning and interaction of .150 with .040(2)/.080(3). C007–C008. |
| B003 |
Article 3 negotiability and the exclusion/override branches in 3-102. |
Assigning 3-118 to every promissory document; treating nonnegotiability as proof of a particular fallback period. |
Follow the applicable Article 4/4A/8/9A branch and general contract classification; examine 4-111 if a bank-collection claim is the category. C019–C028. |
| B004 |

| B005 |
Generic breach accrual, separate installment accrual, demand prerequisites, effective acceleration and de-acceleration. |
Starting at signature, first missed payment, final maturity or a label without authority; resetting all installments together. |
Judicial construction of .005/.040/.080 and effective acceleration remains held; compare only with the express 3-118(a) rule. C001, C020–C021, C080. |
| B006 |

Automatically selecting Washington law from forum/residence or a contract label; importing a foreign period without its accrual/tolling. |

Using one note period for all instruments or treating ordinary contact as demand/acceptance. |

| B010 |
Who legally made a payment, authority/agency, allocation, installment versus whole obligation, and “after it is due.” |
Every transfer or third-party payment restarts every balance; a nominal/unallocated amount necessarily qualifies. |

Diagnosis, guardianship status, age of a defendant, or any incarceration alone establishes tolling. |
Verify the complete current statutory determination framework, then its .190/.250/.260 relationship. S012 is only a 2024-certified section; S043 resolves only the 2020 amendment date. C047–C048. |

Every dismissal permits refiling; every bankruptcy stay simply adds its duration; .26 permits a bankruptcy claim. |

| B019 |
Current incorporated military definitions, qualifying Guard duty, pre-service orders, waiver and historic application. |
All military affiliation qualifies; all dependents receive federal §3936(a) tolling; protected-order time automatically equals service time. |

| B020 |
Judgment type, relevant entry/filing/transcript event, extension conditions, foreign expiration and action-versus-enforcement classification. |
All judgments last twenty years; a new Washington filing necessarily defeats the originating jurisdiction’s expiration; lien and suit clocks are identical. |

Ordinary six/three-year rules govern every money liability; state-benefit immunity applies to every public creditor. |
Separate generic sector passes, including relevant support definitions/procedure and .300–.320/64.50 if construction is implicated. C031, C038–C041, C049. |
| B022 |
Forum, applicable commencement/service rules, publication, special proceedings, calendar and rule-version history. |
Filing or service alone is always enough; service-first is universally allowed; mailing adds three days to all limitation periods. |
Complete the particular generic CR/CRLJ/service incorporation and authenticate an original rule order if historical timing matters. C055–C057. |
| B023 |
Consumer-purpose transaction and covered collector status, including exclusions and security-interest-only scope. |
Federal .26 covers every creditor, business debt or foreclosure activity—or excludes every secured obligation. |
Apply only the complete generic statutory definition/exclusion tests; no entity or obligation investigation. C067–C074. |
| B024 |
Current incorporated motor-vehicle definitions and all §5519 conditions/exceptions. |
A vehicle-related activity automatically has a federal collection exemption. |
Obtain a current ordinary official rendition of 49 CFR 571.3 or verify changes after the October 1, 2025 edition; retain §5519(b)/(c) limits. C070; S044. |
| B025 |
Complete bad-check incorporated definitions/regulatory classifications; any actual federal state-exemption instrument. |
A prosecutor connection or state regulation alone creates an exclusion; the special thirty-day safeguard is a universal revival disclosure. |
Verify current 12 U.S.C. 5002/4001 definitions and necessary Board rules; separately read Appendix A and any applicable exemption regulation. C096–C097. |
| B026 |
Older original enactments/orders, pre-effective rights, and post-snapshot federal updates. |
Current wording automatically governs every historical event; a page update equals legal effectiveness; an unverified edition is current. |
Close the specific version gaps identified in C066/C082–C095 and the source register. No indiscriminate historical rerun. |
| B027 |
Legal effect beyond the particular action bar: extinguishment, collateral, reporting, discharge or other collection conduct. |
Time-barred means discharged; expired reporting means expired suit; a remaining debt authorizes any collection method. |
Separate the precise statutory consequence and conduct regime. FCRA, full bankruptcy and collateral law remain unexamined. C031–C036, C071–C072, C079. |
| B028 |
Judicial construction, contrary authority and subsequent judicial history. |
Absence of researched cases proves absence of contrary authority or validates every literal-text application. |
This dependency remains expressly outside the owner’s no-case/opinion boundary. No named case/opinion/docket inquiry was performed. |

7. Read, search and failure log
7.1 Actual read log
The actual-read-bounds column in S001–S045 is the document-level read log. It distinguishes complete selected sections from partial documents and identifies the parts not read.
| Read group |
What was actually done |
What is not claimed |
| Core Washington law |
Read official chapter/section bodies, relevant definitions, operative exceptions and displayed source/application notes. |
A search result, index entry or heading was not counted as statutory evidence. |
| UCC |
Read complete selected limitation subsections and the listed scope, instrument, presentment, dishonor and transition provisions. |
The whole UCC, all banking rules, collateral priorities or all specialized choice rules were not read. |
| Judgment/procedure |
Read the full selected judgment sections and posted CR/CRLJ PDFs listed in the register. |
Full renewal filing procedure, valid service, jurisdiction or an actual calendar was not established. |
| Revival/version work |
Read the complete 2019 two-section act, the complete selected 2007 and 1995 acts, and bounded operative/effective clauses in the larger acts. |
Retrieval of a large PDF was not treated as reading every page. |
| Federal collection law |
Read operative FDCPA definitions/exclusions/prohibitions and Regulation F scope, definitions, .26 and .108; read the original adopted .26. |
Full FDCPA remedies, disclosure rules, bankruptcy law or judicial validity/subsequent history was not researched. |
| Military/disability incorporations |
Read the selected current codification, recovered original effective clauses, and the specific incorporated definition passages. |
A readable historical/edition-uncertain definition was not promoted to fully current law. |
| PDF method |
Read parsed statutory/rule text with printed-page and zero-based page indices. |
No claim of visual page-pixel inspection. |
| Duplication control |
Reused document IDs across chapter sections and multiple renditions. |
HTML/PDF/current-code/original-act versions were not treated as independent witnesses. |
7.2 Public web-search log
These were the general public-web queries used; direct official URL openings and statutory cross-reference navigation supplied most of the research.
| Search |
Exact query |
Result/use |
| Search 1 |
site:uscode.house.gov "1692a" "Definitions" "2026" |
Located the working OLRC route; operative text was then opened and read. |
| Search 2 |
site:uscode.house.gov "3936" "Statute of limitations" |
Discovery route for the federal tolling provision; actual official body subsequently read. |
| Search 3 |
site:courts.wa.gov court_rules CR 6 computation time CR 3 commencement |
Generic court-rule discovery; official rule PDFs subsequently opened directly. |
| Search 4 |
site:app.leg.wa.gov "11.130.265" "Basis" |
Located the official section PDF after HTML routes failed. It resolved only the section-text route and retained its 2024 certification limit. |
Document-internal searches located statutory sections, effective-date headings, amendment clauses and defined terms. Located passages were opened/read in context. Searches that produced no exact match—such as a guessed section number or “Recreational vehicle” where the printed term was “Recreation vehicle trailer”—were followed by a different term or actual passage, not treated as evidence of legal absence.
No named case, opinion, party, docket, provider, account, contract or transaction search was performed.
7.3 Discovery, duplicate-format and nonrelied routes — not the source register
| Route/material |
Actual treatment |
| Search results for archived/title-level guardianship PDFs and chapter indexes |
Discovery only unless specifically registered as read. No claim that the whole guardianship chapter became available/current. |
| https://www.govinfo.gov/link/uscode/12/5519 |
Duplicate PDF route retrieved; operative reliance is on the complete OLRC text in S025. Not independent corroboration. |
| FederalRegister.gov HTML version of the 2021 final rule |
Header/DATES read; full operative reliance is on S024’s official PDF and S023’s current text. A linked later correction was not fully investigated. |
| https://uscode.house.gov/us/usc/119-120/t50/s3937/ |
Adjacent interest provision partially encountered; discarded as limitation authority. No interest-rate finding made. |
| https://app.leg.wa.gov/rcw/default.aspx?cite=73.16.070 |
Read after following a note; current subject is USERRA-related. It was not used as the SCRA limitation source. |
| Incidental sector provisions and adjacent PDF pages |
Not used to claim complete tax, support, construction, criminal, banking, forfeiture, healthcare or secured-debt coverage. |
| Prior P1/P2 exclusion records supplied in the prompt |
Scope context only. No substantive findings or prior access were attributed to this research. |
7.4 Bounded failed-route log
All attempts below occurred on October 28, 2026 PDT. A recovered route resolves only the exact gap described.
| Failure ID |

GPO dynamic PDF read for (14), S045; edition and additional Board-rule branch remain qualified. |
| F014 |
https://www.ecfr.gov/current/title-49/subtitle-B/chapter-V/part-571/subpart-A/section-571.3 — redirected to an access-challenge page |
No challenge interaction or bypass. Separate GPO October 1, 2025 edition read, S044. Current 2026 definition gap remains. |
The successful Washington legislative-body reads are independent of these narrow route failures. An inaccessible eCFR or guardianship URL is not evidence that chapter 4.16’s statutory bodies were inaccessible.
8. Researcher self-check and continuation boundary
Actual reading versus nonreading. The findings rest on the operative passages and bounded original enactments identified in the source register. Complete selected subsections were distinguished from partial large documents. Search snippets, indexes, page titles, provider claims and unreturned text were not treated as substantive proof. Parsed PDF text was not represented as page-pixel inspection.
Currentness. The Washington sources are the official text displayed on access, with selected amendment verification. The federal OLRC and eCFR currency dates are reported separately. The 2024-certified guardianship PDF, 2025 CFR edition and edition-uncertain GPO extracts retain their limitations. A source becoming readable resolved its exact access gap only.
Scope control. This pass did not investigate named cases/opinions/dockets or identifying persons, entities, obligations, records, contracts or transactions. It did not infer an actual accrual date, acceleration, governing law, residence, qualifying service status, filing deadline or outcome. The blank worksheet has no populated values. P1/P2 disputes remain unchanged.
Interpretive limits. The report preserves the differences between direct statutory language, bounded textual inference and unresolved judicial construction. In particular, it does not turn the current post-expiration prohibition into revival permission, assignment into a reset, a state period into federal collection permission, or a limitation defense into a discharge/reporting/collateral conclusion.
This is a researcher self-check, not independent review. The complete visible deliverable for this pass is above. The continuation boundary is the specific B001–B028 dependencies and the other state categories expressly left open; no broader Washington, registry-dimension or A066 acceptance follows.
END S_WA PASS-03.
