S_AZ PASS-11 — Arizona residential homestead and ordinary judgment enforcement
Research access: October 27, 2026. This report addresses residential homestead protection, ordinary civil judgment liens, execution against a claimed homestead, and the resulting property and proceeds boundaries. It uses freshly retrieved public sources; the October 22 baseline and earlier unreviewed passes supply no legal premises.
The central distinction is between a protected amount of equity, attachment of a judgment lien, and authority to complete a sale. Those are separate questions under the statutes read here. Recording a qualifying judgment can affect homestead real property, but an ordinary judgment creditor’s sale must satisfy the particular equity, priority, bid, notice, and distribution requirements. A recorded lien, an accepted bid, money in escrow, and an actual payment credited to the judgment are also separate events. C032–C059, C090. azleg.gov+2
Three material questions remain expressly held:
- The exact 2026 indexed homestead amount. The adjustment formula was read, but an authoritative 2026 amount was not verified. This report uses H2026, not an invented CPI result.
- The title-insurer release provision above eighty percent. The displayed statute says “is eighty percent” in its notice branch. It does not say “at least eighty percent.” The report preserves that wording.
- A complete current ordinary-civil challenge procedure. Relevant statutes, adopted rules, published litigation, and generic forms were read, but the current consolidated rule text, local motion requirements, ordinary-civil burden allocation, and hearing calendar were not all established.
The four models therefore use the verified 2023 $400,000 amount for expressly historical examples and a symbolic amount for 2026. They do not determine an actual exemption, title interest, sale right, or collection permission.

Actual facts and posture |
Holding/disposition used |
Version and limits |
| McLauchlan — S018 |
Bankruptcy certified question involving a2019 petition and2020 voluntary sale producing equity above the then-applicable exemption. |
Under the2007 statutory arrangement, judgment lien reached excess proceeds; voluntary sale did not eliminate that result. Certified question answered yes. ¶¶11–20. |
Historical text. ¶19 did not retroactively apply2021 legislation. ¶¶15–16 rejected/disapproved contrary readings of earlier cases, which were not separately opened. azcourts.gov |
| Reilly — S019 |
2016 business-dispute judgment and recorded lien; no homestead-sale enforcement before Dec5,2022; first writ sought March2023. Homestead status uncontested. |
Affirmed application of the$400,000 exemption. Earlier judgment/lien alone did not mature the contingent forced-sale right. ¶¶11–22. |
Does not decide every earlier writ, completed sale, contract, or matured-right configuration. The underlying debt was not a consumer account; the homestead statutory reasoning is the relevant part. cases.justia.com |
| Rogone — S020 |
Fraudulent-transfer litigation arising from mishandling unrelated trust assets; trial court denied homestead on equitable grounds. |
Reversed homestead denial: statute supplied eligibility conditions, and postjudgment establishment was not alone disqualifying. ¶¶18–20; disposition¶¶33–34. |
Distinguished wrongdoing involving the residence itself. Old amount/lien language cannot be treated as current. Material majority only read. 1CA-CV13-0375 |
| Arizona Creditors Bar — S021 |
Facial constitutional challenge to Proposition209’s saving clause. |
Rejected facial vagueness challenge and affirmed. ¶¶24–36 explain why unresolved applications did not invalidate the measure facially. |
Not a declaratory ruling on all old contracts or all enforcement events. cases.justia.com |
| Drummond — S022 |
Certified question from a2022 bankruptcy concerning a self-propelled motor home under former “mobile home” text. |
Majority answered that the vehicle did not qualify under that former provision. ¶35. |
2025 legislation expressly added motor homes and other shelters. The old categorical result cannot be carried forward unchanged. Dissent not used as holding. azcourts.gov |
| Calderon — S023 |
Debtor had lived in residence, then moved and rented it out less than two years before bankruptcy; denial rested on insufficiently definite return intent. |
Vacated/remanded. Material discussion distinguishes permanent intent from temporary absence and treats the two-year period differently on either side. Official pp14–16. |
Published BAP interpretation in bankruptcy; not a state-court allocation of every proof burden and not an exemption award on remand. cdn.ca9.uscourts.gov |
| Gebhart — S024 |
Consolidated bankruptcy cases, including an Arizona petition under an older dollar-limited exemption. |
Exempting the allowed dollar interest did not remove the entire property/appreciation from the estate. Affirmed. Printed pp14070–14075. |
New2025 §33-1101(F) changes a state statutory premise. Its federal reconciliation was not decided by this2010 opinion. cdn.ca9.uscourts.gov |
| Ironwood — S025 |
Justice judgment, Superior Court transcript, later enforcement dispute. |
¶8 recites the §22-246 real-property execution route; disposition otherwise concerns renewal/garnishment and fees. |
Used only as procedural context corroborating the separately read statute, not as a homestead-sale or renewal holding for this pass. azcourts.gov |
No nonprecedential memorandum decision is relied upon. No claim is made that a quoted but unopened precedent was independently read.

6. Four fully worked fictional models
Common assumptions
These are invented transactions and records. No actual court, parcel, debtor, creditor, deed, account, or title record was examined.
For each positive sale branch, assume an enforceable judgment, a lawfully issued writ where required, any necessary lawful orders, valid priority instruments, lawful notice and sale procedure, allowable costs, actual receipt of sale funds, and actual remittance in the stated amount. Those assumptions are not findings produced by the arithmetic.
Amounts are U.S. dollars. Inputs are whole dollars; no monetary rounding is needed. Stipulated interest additions are assumed already lawfully established for the fictional ledger. No statutory interest rate, fee rate, or government fee schedule is inferred.
M01 — Rural versus urban parcel; value, equity and a strict bid threshold
Dates and documents: a consumer obligation dated January12,2023; judgment July10,2023; recording July12; fictional execution sale November15,2023. Fictional deed, residence evidence, priority payoff, cost statement and officer’s return are assumed consistent.
Alternative parcels: one compact20-acre rural residential parcel, or one compact0.2-acre urban residential parcel. In either branch the debtor owns the entire relevant interest and actually resides there. These acreage inputs do not change the dollar calculation under the homestead clauses read.
Applicable historical amount: H2023=$400,000. C004, C021, C051–C053, C086.

False; bid insufficient |
**Completed-sale distribution:**400,000 debtor exemption +240,000 lien payoff +40,000 costs +40,000 judgment payment =720,000.
Judgment ledger: opening50,000 + stipulated lawful interest2,000 − actual credited remittance40,000 = 12,000 remaining.
Adverse branches:
- If the sale does not complete or money remains held, the judgment remains52,000 on these assumptions.
- If no sufficient bid occurs, the failed-sale costs/attorney fees cannot simply be added to the judgment under§33-1105.
- If the rural tract is disconnected, partly outside the claimed estate, or not one compact residential body, the whole720,000 cannot be treated as a qualifying homestead value without resolving that classification and allocating the relevant interests. No acreage partition formula was invented.
Authority: S004§2(A),(D); S001.A01(A)(1), A05, A25. The actual estate, classification, costs, priorities and sale validity remain factual holds.
M02 — Spousal residence; ordinary judgment versus a valid consensual lien
Dates and records: fictional obligation February3,2023; community judgment August4; sale November16. Assume both spouses are properly joined for the stipulated community debt, both validly executed/acknowledged the senior community-property mortgage, and both own the entire community estate.
Documents: fictional community deed, signed mortgage, payoff statement, judgment, lawful sale record and officer’s remittance.
Rules: one shared homestead amount; separate mortgage exception; estate/joinder and debt liability remain separate questions. C005, C015–C017, C037, C051–C053, C087.

The350,000 mortgage payoff satisfies a different secured obligation. It is not a second credit against the ordinary judgment.
Exception branch: a valid consensual mortgage is not defeated by the homestead claim. That proposition does not establish the mortgagee’s foreclosure procedure or remedy, which is outside this model.
Adverse branches:
- One spouse’s missing signature, separate-property ownership, a judgment against only one spouse, or a third-party coowner makes the assumed whole-estate calculation unavailable.
- The report does not replace those facts with an automatic50/50 allocation.
- Until the60,000 is actually remitted and credited, the ordinary judgment balance remains105,000.
Authority: S001.A01(B), A03(A)(1), A04(C)–(D), A12, A33–A34, A05, A25.
M03 — Voluntary sale, held excess and establishment of a new homestead
Chronology: fictional debt December20,2022; judgment March10,2023; voluntary sale May16,2023; excess remitted June1; new homestead established October10,2023.
Records: fictional closing disclosure, priority payoff, sale-cost statement, segregated proceeds ledger, actual remittance receipt and new-home closing/residence evidence.

- Old proceeds cash remaining:400,000 −250,000 = 150,000.
- New-home equity on these inputs:350,000 −100,000 = 250,000.
- The new purchase is not a payment on the ordinary judgment: its balance remains22,000.
The simple18-month calendar anniversary of the May16,2023 sale is November16,2024. That is not a computed court-filing deadline or a conclusion about weekend extensions. The stipulated October10,2023 establishment of a new homestead with the proceeds occurs earlier, so it controls the subsectionC proceeds branch in this model. The remaining150,000 does not retain the former home’s subsectionC protection merely because it originated in the sale.
Adverse branches: loss of identifiability, disputed establishment of the new homestead, other cash exemptions, bankruptcy, and an uncompleted remittance require separate analysis. If the20,000 was never credited, the judgment is42,000, not22,000.
Authority: S004§2(C); S001.A01(C), A08(B), A25; C060, C068, C088, C090.
M04 — Current symbolic exemption and contested excess execution
Dates: fictional post2022 obligation; judgment June15,2026; recording June16; writ September15; contested enforcement reviewed as of October27. No real calendar is calculated.
Let H = the legally applicable2026 indexed homestead amount, which remains unverified.
Fictional records: deed and residence proof, valuation, senior-lien payoff, proposed notice, cost estimate, disputed motion papers and potential officer return. Their legal sufficiency is stipulated only in the positive branch.

- If funds are only held or the sale is blocked: 83,000 remains.
- If a lawful completed sale actually produces and credits50,000:83,000 −50,000 = 33,000 remains.
The statutory notice components include the15-successive-day posting and three-week newspaper requirements, required content and homestead warning. This model does not assume those public notices exhaust due process, that an objection automatically stays execution, or that a bid completes redemption/title issues.
Contested branch: valuation, extent of the debtor’s estate, lien priority, allowable costs, current motion rules, burden allocation, service, stay and hearing availability remain held. No sale outcome follows until those predicates are resolved.

7. Twenty distinct fictional postures
These are separate from the eight published case records and the four worked models.
| Posture |
Fictional facts and evidence |
Rule/claim; conditional consequence and uncertainty |
| P01 — Urban resident |
Adult occupies a city house; deed interest and Arizona residence are stipulated. |
C002–C005: possible statutory category; actual equity, applicable H and liens still determine protection. |
| P02 — Large rural parcel |
Adult occupies a house on one compact20-acre parcel. |
C004/M01: acreage alone does not invoke a rural cap in the read homestead provisions; estate/use still require proof. |
| P03 — Detached acreage |
Residence tract and distant agricultural tract are presented as one “homestead.” |
C003–C004: compact-body predicate disputed; no automatic inclusion of detached value or invented division ratio. |
| P04 — Future residence |
Owner receives mail at unfinished property but lives elsewhere and intends future occupancy. |
C002–C003: mailing/future intent alone does not establish the statutory residence facts; constructive-occupation construction held. |
| P05 — Unproved interest |
Occupant pays rent; no deed, leasehold scope, equitable interest or shelter classification is established. |
C003,C016: occupancy alone does not prove the relevant estate; renter/leasehold application held rather than categorically denied. |
| P06 — Fifteen-month absence |
Former occupant temporarily relocates; return evidence conflicts with rental evidence. |
C011–C012: intent matters; Calderon is informative but does not award an ordinary-civil exemption. |
| P07 — Longer absence |
Residence has been leased for more than two years; claimant asserts a specific temporary assignment. |
C012: evidence and applicable burden needed; no automatic rule based solely on elapsed time or address. |
| P08 — Married community owners |
Both spouses own and occupy the residence. |
C005,C015–C017/M02: one shared amount; community-debt and joinder predicates remain separate. |
| P09 — Unmarried coowners |
Judgment debtor owns an undivided interest with a nondebtor. |
C016,C056: determine debtor’s actual interest; no assumption that entire property or precisely half is executable. |
| P10 — Divorced former home |
Both former spouses claim exemptions against the same formerly shared residence. |
C006: statutory combined limit applies; title, residence and allocation remain disputed facts. |
| P11 — Surviving spouse |
Spouse claims both residence ownership and probate allowance. |
C018–C020: survivorship/title, civil exemption and probate allowance are distinct; instruments and probate waiver held. |
| P12 — Revocable trust |
Deed transferred into trust; claimant retains administration and revocation. |
C014: stated transfer is not abandonment; actual retained powers and qualifying trust must be proved. |
| P13 — Unrecorded waiver |
Creditor possesses signed but unrecorded “homestead waiver.” |
C013: statutory recording predicate absent; other instruments, consent and federal bankruptcy restrictions remain separate. |
| P14 — Old judgment, new writ |
2016 lien; no pre-Dec2022 homestead enforcement;2023 writ. |
C025: resembles Reilly; materially earlier sale steps or matured rights could change the analysis. |
| P15 — Mortgage consent dispute |
Claimed senior mortgage lacks one asserted community owner’s signature. |
C015,C037/M02: lien validity/priority cannot be assumed merely from a payoff demand. |
| P16 — Contractor lien |
Supplier claims labor/material lien against an asserted owner-occupied dwelling but lacks direct owner contract. |
C038: §33-1002 predicates matter; full notice, licensing, agency and perfection record held. |
| P17 — Exact-threshold bid |
Bid equals H plus qualifying senior liens and allowable costs. |
C051–C053: equality fails; unsuccessful-sale costs are not automatically added to debtor’s judgment. |
| P18 — Two possible homes |
Certified selection demand received; claimant does not answer within statutory period. |
C008–C009: later assertion requires recorded claim; not permanent automatic forfeiture. |
| P19 — Sale versus refinance |
One transaction sells the home; another merely extracts refinance cash. |
C060–C062: distinct proceeds rules; tracing, lien priorities and actual cash movement must be identified. |
| P20 — Bankruptcy date branch |
Otherwise similar petitions filed Sept25 and Sept27,2025; no Sept26 assumption. |
C027,C078–C084: new stateF applicability and federal limits require separate branches; no civil-sale or bankruptcy outcome inferred. |

12. Researcher self-check and count reconciliation
This is a researcher self-check, not independent review.
- 36 source identifiers: S001–S036. S001 contains50 separately identified statutory/compilation access rows; S002 contains3 constitutional access rows. Multiple sections or URLs under one document are not independent corroboration.
- 90 atomic claims: C001–C090, all visible.
- 8 published judicial records: materially relevant majority passages and dispositions identified. Full versus partial reads and reproduction hosts are disclosed.
- 20 fictional postures: P01–P20, separate from the case register.
- 4 worked models: M01–M04, with actual-remittance and adverse branches.
- **74 coverage rows:**32 core,14 workflow,10 currentness,4 models,4 territory/private-fact and10 deferred.
