Arizona ordinary consumer-debt limitations, accrual, acknowledgment, and money-judgment enforcement and renewal
Access date: October 27, 2026, Pacific, later than the requested October 22 baseline. Individual source-opening times were not logged and are UNKNOWN. The review timestamps supplied in the prompt are provenance for the earlier work; they are not source-access timestamps for this pass.
Principal findings
Arizona does not have one limitations period for every consumer debt. The current posted statutes distinguish, among other classifications, qualifying Arizona written contracts and credit-card debt, nonwritten debt, stated or open accounts, written instruments executed elsewhere, sales of goods, and negotiable instruments. The classification and accrual event must both be established before calculating a period. C001–C030 below preserve those distinctions. azleg.gov+4
For a credit-card contract with an optional acceleration clause, Mertola identifies the first uncured failure to make the required minimum payment as the accrual event. A later partial payment is not automatically a new starting date. Fixed-maturity installment obligations require a different analysis: matured installments and valid acceleration of future installments can produce different clocks. C009–C016. azcourts.gov+3
A money judgment has a separate statutory enforcement and renewal regime. The current ordinary period is ten years, subject to the express historical transition. Renewal by an independent action differs from renewal by affidavit; ordinary collection activity does not itself accomplish either. An affidavit requires the proper filing location, timing, verification, and accounting. C031–C059. azleg.gov+3
The principal remaining evidence holds are the enacted 2011 credit-card amendment body and its exact transition language, portions of the current consolidated court rules, specified inaccessible case bodies, and the application of these rules to any actual contract, judgment, filing, service, stay, or local court calendar. These holds are not replaced by summaries or assumptions.
1. Reading conventions and record boundaries
Every shortened source reference S001, for example, means S_AZ-P05-S001. Every shortened claim reference C001 means S_AZ-P05-C001. These are new PASS-05 identifiers; no unavailable earlier identifier is inferred.
Confidence and status labels used below:
- H — High for the identified text or holding: the material body was read. Application still depends on the stated predicates.
- B — Bounded: historical text, a limited factual holding, an inference, or incomplete currentness prevents a broader conclusion.
- U — Unresolved: the required body or fact was not established.
- F — Failed retrieval: no usable body from the identified route.
- G — Guidance/form: official operational or educational material, not a substitute for legislation or a holding.
- I — Index: useful for discovery or inventory, not proof of an unexamined underlying enactment or rule.
All examples are fictional. No private contract, account, payment history, judgment, docket, filing receipt, service record, bankruptcy record, or court calendar was examined.
2. Cause-of-action clock matrix
This is the substantive debt-limitations analysis. A collector’s system date, account label, charge-off date, or ownership change does not supply the missing contractual and legal predicates.

Actor and predicate |
Required analysis, clock, and consequence |
Evidence and exact pinpoint |
Conditions, exceptions, currentness |
| S_AZ-P05-C001 |
Claimant asserting debt evidenced by a written contract executed in Arizona |
Commence and prosecute the action within six years after accrual. |
S001, §12-548(A)(1) |
H. Actual writing, execution location, and accrual remain facts to establish; a document’s existence alone does not settle classification. |
| S_AZ-P05-C002 |
Claimant asserting statutory credit-card debt |
Six years applies to debt on a credit card defined by §13-2101(3)(a). |
S001, §§12-548(A)(2), 13-2101(3)(a) |
H. The incorporated branch concerns obtaining value on a promise of future payment. Do not substitute the statute’s separate debit/stored-value branches. |
| S_AZ-P05-C003 |
Claimant asserting indebtedness not evidenced by a written contract |
The stated period is three years after accrual. |
S001, §12-543(1) |
H. Whether the obligation actually lacks a qualifying written contract is unresolved without its instruments and formation facts. |
| S_AZ-P05-C004 |
Claimant asserting a genuinely applicable stated or open account |
Three years; the statute also preserves account items while an item was incurred within the three years preceding suit. |
S001, §12-543(2) |
H text; B classification. Mutual merchant-merchandise accounts are excluded. A payment, assignment, or collector entry is not assumed to be a newly incurred account item. |
| S_AZ-P05-C005 |
Claimant relying on a written instrument executed outside Arizona |
§12-544(3) states a four-year period. |
S001, §12-544(3) |
H text; B application. Must reconcile the instrument’s location/classification and §12-548(B), especially for statutory credit-card debt. Foreign-judgment registration is separately held. |
| S_AZ-P05-C006 |
Claimant asserting breach of a sale-of-goods contract |
Article 2 generally supplies four years; the original agreement may reduce it to at least one year, but may not extend it. |
S001, §§12-544(4), 47-2102, 47-2105(A), 47-2725(A)–(D) |
H. Breach ordinarily accrues regardless of knowledge; warranty and saving provisions have specific conditions. This is not a generic loan rule. |
| S_AZ-P05-C007 |
Holder of a qualifying negotiable note |
A definite-time note generally has six years from due or accelerated due dates; a demand note has separate demand and ten-year nonpayment rules. |
S001, §§47-3102, 47-3104(A), (D)–(E), 47-3108, 47-3118(A)–(B) |
H text; B classification. Instrument status and the listed exceptions must be tested. Do not apply this merely because someone calls a contract a “note.” |
| S_AZ-P05-C008 |
Claimant whose action has no otherwise prescribed limitation |
Residual four years after accrual. |
S001, §12-550 |
H. Excludes recovery of real property and yields to a genuinely applicable specific period. |
| S_AZ-P05-C009 |
Creditor under the optional-acceleration credit-card contract addressed in Mertola |
Accrual occurs at the first uncured missed minimum payment, for the card debt as addressed there. |
S012, ¶¶19–23 |
H holding. The court expressly distinguished other debt structures. |
| S_AZ-P05-C010 |
Card debtor making later payments |
Accepted payment of all arrearages bringing the account current can end the existing default; a later default can begin another clock. A partial payment does not necessarily cure. |
S012, ¶¶21–22 |
H holding. Requires contract terms and actual cure/acceptance facts, not “last payment” shorthand. |
| S_AZ-P05-C011 |
Assignee or collector using a later transfer, charge-off, or system date |
Those dates do not, by themselves, establish a replacement accrual event under the rules read. |
S012, ¶¶19–23; S013, installment holding; S048, §1006.18(b)(1)(v) |
B, identified inference. A legally effective new agreement, cure, or acknowledgment would require its own analysis. |
| S_AZ-P05-C012 |
Creditor under a fixed-maturity installment obligation |
Each matured, unpaid installment has its own accrual date. |
S013, 187 Ariz. at 494–496; S014, ¶¶7–14 |
H holdings. Earlier installments may be barred while later obligations remain timely. |
| S_AZ-P05-C013 |
Creditor invoking optional acceleration of future installments |
Future installments accrue upon an effective exercise of acceleration, not merely the existence of an acceleration option. |
S013, 187 Ariz. at 494–496; S015, ¶¶10–13 |
H/B. Required notices, contractual conditions, and the affirmative act must be proved. |
| S_AZ-P05-C014 |
Creditor on the fixed-maturity home-equity line considered in Webster |
The court applied installment/acceleration analysis rather than automatically importing the credit-card rule. |
S014, ¶¶7–15 |
H, fact-bound. The case involved a specified final maturity and a money-judgment action; it does not complete secured-debt law. |
| S_AZ-P05-C015 |
Creditor relying on a recorded trustee-sale notice |
Bridges held that recording the notice alone did not accelerate the debt under the documents before the court. |
S015, ¶¶10–17, 22–25 |
H, secured-context boundary. The notice and contractual prerequisites matter; no foreclosure permission is inferred. |
| S_AZ-P05-C016 |
Creditor asserting revocation of acceleration |
Miller required an affirmative communication of revocation; its express recorded revocations affected future obligations, not already defaulted installments. |
S016, ¶¶19–22 & n.2; S015, ¶17 n.2 |
B. Bridges disapproved Miller to the extent inconsistent concerning acceleration by a sale notice alone. Transfer to ordinary unsecured contracts remains conditional. |
| S_AZ-P05-C017 |
Creditor relying on acknowledgment after a claim became due |
To defeat a limitations plea on that basis, §12-508 requires a writing signed by the party to be charged. |
S001, §12-508 |
H. A payment ledger or an unsigned collector record does not establish that predicate. |
| S_AZ-P05-C018 |
Creditor relying on a signed acknowledgment/new promise |
The writing must sufficiently identify the obligation and express or imply a promise to pay and recognition of its justness. |
S017, 107 Ariz. at 275–276 |
H holding. Exact amount need not always appear if ascertainable; the entire writing and circumstances matter. |
| S_AZ-P05-C019 |
Creditor relying on a writing sent elsewhere |
Acknowledgment must be communicated to the creditor/agent or intended to reach the creditor. |
S019, acknowledgment discussion and final holding |
H for holding; B hosting/date. Divorce correspondence unknown to the creditor until litigation did not suffice. Attorney-signature authority was not decided. |
| S_AZ-P05-C020 |
Creditor relying only on partial payments |
Cheatham rejected partial payment alone as sufficient acknowledgment in its case. |
S018, 118 Ariz. at 454–455 |
H, limited. The court expressly did not resolve the unargued pre-bar payment theory or whether a particular signed check met the writing test. |
| S_AZ-P05-C021 |
Creditor suing on an effective new promise |
The new promise can supply a new cause and clock; its applicable period still requires classification. |
S020, 47 Ariz. at 131–133; S017 |
B. Moore applied historical statutes and a four-year residual period to its letter. It does not establish six years for every modern acknowledgment. |
| S_AZ-P05-C022 |
Court resolving competing limitations laws for a §12-548(A) debt |
§12-548(B) directs use of that section’s period when its stated conflict predicate is met. |
S001, §12-548(B) |
H text. This is not a complete ruling on contract choice clauses, accrual law, jurisdiction, or §§12-506–507 interactions. |
| S_AZ-P05-C023 |
Court facing a limitations conflict outside a controlling statutory directive |
DeLoach adopted Restatement §142’s approach, including its conditions for using another state’s bar. |
S023, ¶¶7–9, 15–21 & n.4 |
H, bounded. The case was a tort dispute; its footnote recognizes statutory directives. Contractual §187 issues were not completed here. |
| S_AZ-P05-C024 |
Claimant seeking absence tolling |
Although §12-501 speaks of absence, Selby construes it in terms of inability to obtain personal jurisdiction through authorized service. |
S001, §12-501; S021, 110 Ariz. at 524 |
H holding. Travel days alone are not an automatic addition. Actual service/jurisdiction facts and current service rules remain held. |
| S_AZ-P05-C025 |
Claimant suing a person who migrated to Arizona |
A claim already barred in the place of migration is barred under §12-506; the section also addresses specified foreign bankruptcy/insolvency releases. |
S001, §12-506 |
H text; B interaction. Application alongside later §12-548(B), foreign law, and federal discharge rules is unresolved. |
| S_AZ-P05-C026 |
Claimant on a demand incurred before a defendant moved to Arizona |
§12-507 prevents the demand from becoming barred until one year of Arizona residence, unless already barred at migration. |
S001, §12-507; S022 |
H text/holding. Monroe applied this in a tort posture. Do not import its superseded general choice-of-limitations approach over DeLoach or §12-548(B). |
| S_AZ-P05-C027 |
Court applying an amendment changing a limitation period |
§12-505 distinguishes already-barred claims, unbarred claims, and a newly shortened period. |
S001, §12-505(A)–(C) |
H. Enlargement does not automatically revive an already-barred claim; a specific transition provision must also be examined. |
| S_AZ-P05-C028 |
Person entitled to bring an action who was under eighteen or of unsound mind at accrual |
§12-502 excludes the qualifying disability period, subject to its stated exception. |
S001, §12-502 |
H text. This concerns the person entitled to sue; a debtor’s minority or disability does not automatically toll the creditor’s claim. |
| S_AZ-P05-C029 |
Claimant seeking relief on fraud or mistake |
§12-543(3) uses discovery of the constituting facts. |
S001, §12-543(3) |
H. It is not a universal discovery rule for an ordinary unpaid contract. Fraudulent concealment and equitable estoppel require separate predicates. |
| S_AZ-P05-C030 |
Plaintiff seeking to refile a timely action after termination |
§12-504 supplies specified six-month saving treatment; certain dismissals require judicial discretion and others are excluded. |
S001, §12-504(A)–(E) |
H text; B application. Appeal mandate and termination type matter. No rule saving an untimely renewal affidavit was established from this provision. |
What the acknowledgment authorities do—and do not—establish
The read opinions require examination of the actual communication. A balance entry, an attempted payment, a letter to someone else, a disputed signature, and an unconditional promise to an identified creditor are materially different postures. Cheatham also leaves a specific unargued pre-bar payment question unresolved; it should not be converted into a universal rule that every payment either does or does not restart every debt. 3. Money-judgment enforcement and renewal matrix
The operative question here is the judgment’s entry and renewal history, not the underlying account’s charge-off or last-payment date.
| Claim ID |
Actor and predicate |
Required act, clock, and consequence |
Evidence and exact pinpoint |
Conditions, exceptions, currentness |
| S_AZ-P05-C031 |
Holder of an ordinary judgment within §12-1551 |
Enforcement process ordinarily may issue within ten years after entry, and within ten years after renewal. |
S001, §12-1551(A)–(B) |
H. Subject to transition, satisfaction, stays, and statutory exclusions. |
| S_AZ-P05-C032 |
Holder of an older judgment |
Current law covers judgments entered on/after August 3, 2013, and earlier judgments renewed on/before August 2, 2018; the specified unrenewed older judgments are excluded. |
S001, §§12-1551(D), 12-1611, 12-1612(A); S003 |
H. “Renewed” is not treated as any paper purporting to renew an already-expired judgment. |
| S_AZ-P05-C033 |
Court identifying the historical-to-current regime |
The 2018 act changed five years to ten; the 2019 act added the express older-judgment boundaries and clarified that a judge’s order is unnecessary for completed affidavit renewal. |
S002, §§1–4; S003, §§1–4; S007 |
H. General effective dates: August 3, 2018, and August 27, 2019, respectively; approval dates differ. |
| S_AZ-P05-C034 |
Judgment creditor choosing renewal by action |
Bring the qualifying independent action within the statutory period; the action seeks a replacement judgment for the unpaid balance. |
S001, §12-1611; S024, ¶¶12–24 |
H. This is not merely filing an enforcement request in the existing case. |
| S_AZ-P05-C035 |
Creditor relying on collection activity or collateral litigation |
Garnishment, examinations, or a collateral claim do not automatically constitute the required action on the judgment. |
S024, ¶¶25–26; S025, ¶¶15–19 |
H. Specialty reaffirmed the narrow meaning in a derivative-liability dispute. |
| S_AZ-P05-C036 |
Creditor choosing initial affidavit renewal |
Make and file within the ninety days preceding expiration of ten years from judgment entry. |
S001, §12-1612(B); S002, §3 |
H text. An actual endpoint, filing-day issue, or extension requires the applicable computation and court facts. |
| S_AZ-P05-C037 |
Judgment creditor, personal representative, or assignee |
File with the proper court’s clerk; establish the affiant’s qualifying relationship and ownership succession. |
S001, §12-1612(A), (B)(1), (D) |
H. An assignment does not itself renew the judgment. |
| S_AZ-P05-C038 |
Renewal affiant |
Identify parties, court, judgment date/amount, recording details where applicable, ownership chain, and outstanding/unreturned executions. |
S001, §12-1612(B)(1)–(2) |
H. A generic form does not excuse omitted statutory facts. |
| S_AZ-P05-C039 |
Renewal affiant |
Disclose payment dates and amounts, credit them, address setoffs/counterclaims, and state the exact remaining amount. |
S001, §12-1612(B)(3)–(5) |
H. Unresolved setoffs require the statutory treatment; unverified interest cannot simply be inserted. |
| S_AZ-P05-C040 |
Renewal affiant with transcribed/recorded judgments |
Supply required county information and verify positively, rather than merely on information and belief. |
S001, §12-1612(C) |
H. Actual transcript and recording history remains necessary. |
| S_AZ-P05-C041 |
Creditor who properly completes affidavit filing |
Filing renews the shown balance; a judicial renewal order is not required. |
S001, §12-1612(D); S003, §3 |
H. The provision does not validate an otherwise untimely or misfiled affidavit. |
| S_AZ-P05-C042 |
Creditor seeking successive renewal |
§12-1612(E) measures the next period from filing of the prior renewal affidavit. |
S001, §12-1612(E)–(F) |
H. Prior renewal validity remains essential; no unlimited cure of broken renewal chains is inferred. |
| S_AZ-P05-C043 |
Clerk and creditor after filing |
§12-1613 requires prompt docketing and describes ten years from docketing. |
S001, §12-1613(A)–(B) |
H texts; U mismatch application. Where filing and docketing dates differ, this pass does not invent a reconciliation with §12-1612(E). |
| S_AZ-P05-C044 |
Creditor seeking continuation of a recorded real-property lien |
A certified renewal affidavit must be recorded; court renewal and county recording are distinct acts. |
S001, §12-1613(C)–(E), §33-962(B) |
H boundary. Full lien, priority, homestead, and execution effects remain deferred. |
| S_AZ-P05-C045 |
Creditor who timely files in an unrelated county’s court |
J.C. Penney treated filing outside the court where the judgment was docketed as ineffective and not a correctable technical error. |
S030, ¶¶27–31, 33 |
H holding. Its delayed-appeal relief did not validate the wrong-court renewal. |
| S_AZ-P05-C046 |
Holder of a Justice Court judgment properly transcribed into Superior Court |
Ironwood upheld renewal in the Superior Court where the transcript was docketed, although different from the originating Justice Court’s county. |
S029, ¶¶8–15; S001, §33-962(A)(1) |
H, narrow. The separate same-county real-property execution provision was not treated as controlling the renewal location. |
| S_AZ-P05-C047 |
Creditor and debtor disputing renewal notice |
Ironwood found no statutory requirement of actual notice to the debtor for affidavit renewal. |
S029, ¶15 |
H holding. This does not eliminate applicable filing-service rules, form certificates, or local rules. |
| S_AZ-P05-C048 |
Creditor filing before the statutory renewal window |
The statute specifies a limited window; Galloway called its sixteen-month-premature affidavit ineffective. |
S001, §12-1612(B); S026, ¶17 n.5 |
H text; B case transfer. Galloway involved a special eight-year administrative judgment, not an ordinary ten-year judgment. |
| S_AZ-P05-C049 |
Creditor after lapse or a defective prior renewal |
No universal relation-back or revival through a later affidavit or renewal order was established. |
S001, §§12-1551(B), 12-1612(A), (E); S030; S031 |
H/B. A valid independent route, applicable extension, or proved clerical correction must be separately established. |
| S_AZ-P05-C050 |
Party asserting that a clerk lost a timely delivered affidavit |
Crye permitted correction on evidence that the required filing actually occurred. |
S031, clerical-error discussion and disposition; S037, Rule60(a) |
H, fact-bound; B current procedural text. This is not permission to fabricate or excuse a filing that never occurred. |
| S_AZ-P05-C051 |
Judgment creditor during a stay |
In re Smith held that inability to enforce does not, under Arizona law, extend the affidavit-renewal deadline. |
S027, ¶¶9–15 |
H. Historical five-year numbers must be replaced only through the applicable current statute, not by changing the holding’s distinction. |
| S_AZ-P05-C052 |
Creditor invoking bankruptcy extension |
§108(c) uses the later of the qualifying period, including an independently applicable suspension, or thirty days after notice of stay termination/expiration. |
S050, §108(c); S028, pp.7–10/PDF6–9 |
H dated text; B current application. The later BAP decision rejected an assumed automatic day-for-day affidavit extension. |
| S_AZ-P05-C053 |
Creditor claiming an enforcement period was suspended |
Smith separately recognized enforcement tolling while a bankruptcy stay or supersedeas restriction actually prevented enforcement. |
S027, ¶¶12–14 |
H distinction. A pending appeal alone is not assumed to establish the relevant prohibition or its duration. |
| S_AZ-P05-C054 |
Holder of a judgment outside the ordinary regime, or against a deceased debtor |
§12-1551 has death-related restrictions and exclusions for specified restitution, support, state civil judgments, and tax-sale judgments. |
S001, §12-1551(C), (E) |
H boundary. Their full regimes are not resolved here. |
| S_AZ-P05-C055 |
Court considering later amendments |
The read 2023 and 2024 amendments changed excluded categories; they did not replace the ordinary ten-year text or its 2013/2018 boundary. |
S004, §26; S005, §§1, 8 |
H, limited to read provisions. The 2024 foreclosure applicability clause concerns that separate branch. |
| S_AZ-P05-C056 |
Superior Court judgment creditor receiving full payment |
File satisfaction within forty days. |
S001, §12-1567(A); S006, §1 |
H. The new eviction-specific branch is excluded from this ordinary-debt conclusion. |
| S_AZ-P05-C057 |
Justice Court judgment creditor receiving full payment |
File satisfaction within forty days. |
S001, §22-247(A); S006, §2 |
H. Do not substitute the Small Claims thirty-day provision. |
| S_AZ-P05-C058 |
Debtor seeking satisfaction when the creditor has not supplied it |
The ordinary statutes provide an application supported by payment evidence and diligent-effort information; the court may require a hearing or bond. |
S001, §§12-1567(B)–(D), 22-247(B)–(D); S006 |
H. No actual payment, sufficiency, or court order is determined. |
| S_AZ-P05-C059 |
Small Claims creditor or debtor after full payment |
Creditor has thirty days; a motion to compel satisfaction triggers transfer to the Justice Court civil division under §22-525. |
S001, §§22-525, 22-505 |
H. This is a distinct statutory procedure, not an ordinary forty-day branch. |
The two stay questions must remain separate
The state Supreme Court’s discussion of an enforcement extension does not authorize adding the same number of days to an affidavit-renewal deadline. Its second certified answer rested on a federal-extension premise; the later BAP opinion revisited that premise and held the renewal there untimely. The later opinion also declined to decide whether the filing itself violated the automatic stay. This pass therefore gives no instruction to file during a stay or to collect after discharge. | S_AZ-P05-C064 |
Party seeking an ordinary procedural extension |
The read Rule6(b) provides qualified extension authority. |
S037, Rule6(b); S030–S031 |

The electronic-filing rule is especially important to keep conditional. Receipt by a service provider, later clerk rejection, an excluded transcript case, and a motion asking for relief are different events. A rule permitting relief on good cause does not establish that relief has been granted. azcourts.gov+3

| Posture |
Fictional facts |
Bounded result and adverse branch |
Claims |
| P01 — First uncured card default |
A required minimum is missed; later payments never restore the account to current status. |
Start with the first uncured default, not the latest payment. The contract and cure ledger are essential. |
C009–C010 |
| P02 — Accepted complete cure |
All arrearages are accepted; a later separate default occurs. |
A new default can produce a different accrual date. A merely reduced balance does not establish cure. |
C010 |
| P03 — Installment acceleration |
Several installments are overdue; an affirmative acceleration occurs later. |
Separate matured installments from future amounts. Invalid notice can defeat the proposed acceleration date. |
C012–C016 |
| P04 — Changed creditor |
The same obligation is charged off and then assigned twice. |
Those events do not themselves establish a new limitations clock or remove defenses. |
C011, C081 |
| P05 — Disputed partial payment |
A collector reports a small payment; debtor disputes authorization and there is no proved signed acknowledgment. |
Neither the payment fact nor a qualifying new promise is established. Cheatham’s reserved pre-bar issue is not silently answered. |
C017–C020 |
| P06 — Writing to someone else |
A debtor discusses an old debt in correspondence never intended for the creditor. |
Communication and intended-recipient requirements can defeat acknowledgment reliance. |
C019 |
| P07 — Purported signed email |
An email names an account and offers payment, but signature, agency, terms, and intended recipient are disputed. |
Test each acknowledgment predicate; do not declare automatic revival or a universal six-year replacement period. |
C017–C021 |
| P08 — Out-of-state contract and move |
A contract was formed elsewhere; the debtor later moves to Arizona; a foreign-law clause appears. |
Determine execution, classification, competing law, residence dates, and whether already barred. No selected period is supplied. |
C005, C022–C026 |
| P09 — Travel claimed as tolling |
A defendant spent several months outside Arizona but remained amenable to authorized service. |
Travel alone does not establish §12-501 tolling under Selby. |
C024 |
| P10 — Old judgment |
A judgment predates August 3, 2013, with no proved timely renewal by August 2, 2018. |
The express transition prevents assuming an automatic ten-year revival. |
C032–C033 |
| P11 — Timely affidavit |
A qualifying creditor files a complete affidavit in the proper court comfortably inside the window. |
No separate judge’s renewal order is ordinarily needed. Filing/docketing and the accounting still require proof. |
C036–C043 |
| P12 — Early, late, or wrong court |
The paper is filed too early, after expiration, or in a court with no docketed judgment. |
These are distinct defects; no universal relation-back follows from a later order. |
C045, C048–C050 |
| P13 — Successive-renewal defect |
A new affidavit omits credits, or relies on an earlier renewal whose validity is disputed. |
Exact balance and an intact renewal chain remain unresolved; another affidavit does not automatically repair either. |
C039, C042, C049 |
| P14 — Lost clerk filing |
A contemporaneous receipt supports timely delivery, but the court’s file lacks the affidavit. |
Crye supplies a fact-specific clerical-correction route; proof of actual timely filing is crucial. |
C050 |
| P15 — Claimed stay or discharge |
Someone reports an appeal stay or bankruptcy discharge without producing the order or dates. |
Separate enforcement suspension, affidavit timing, §108(c), and discharge. No collection or filing permission follows. |
C051–C054 |
| P16 — Time-barred suit threat |
A qualifying collector threatens suit on a consumer claim whose period has expired; alternatively, the actor is an ordinary original creditor or the transaction is business-purpose. |
The covered branch invokes §1006.26. The alternatives require independent coverage analysis and remain subject to other law. |
C075–C082 |
7. Four worked conditional chronology and balance models
Model M1 — Credit-card default, partial payment, and complete-cure alternative
Assumptions: A qualifying credit-card contract has an optional acceleration clause. Contractual default occurs on the stated date. No tolling, saving statute, effective new promise, or other defense-changing event is assumed. Fees are zero for this illustration. I is only legally supported interest through the comparison date, in dollars; no rate is assumed.
Plain text
Branch A — uncured default
Default: January 15, 2019
Later partial payment: May 15, 2020 — $50
Comparison date: October 27, 2026
Selected trigger: January 15, 2019
Period: 6 calendar years
Anniversary candidate: January 15, 2025
Elapsed to that anniversary: 2,192 days
Elapsed to comparison date: 7 years, 9 months, 12 days
Starting principal: $6,000
Conditional ledger balance: $6,000 + I − $50
Result: $5,950 + I dollars
Under the selected Mertola hypothesis, the partial payment does not move the trigger merely because it is later. An intervening charge-off or assignment also supplies no replacement trigger by itself. The model’s comparison date is well after the candidate anniversary. C009–C011.
Plain text
Branch B — different proved facts
Accepted payment of all arrears: May 15, 2020 — $600 total,
replacing Branch A's $50 payment
Account actually made current: assumed proved
New contractual default: September 15, 2020
Selected trigger: September 15, 2020
Period: 6 calendar years
Anniversary candidate: September 15, 2026
Elapsed to that anniversary: 2,191 days
Elapsed to comparison date: 6 years, 1 month, 12 days
Conditional ledger balance: $6,000 + I − $600
Result: $5,400 + I dollars
Counting and limits: No intermediate weekend or holiday days are deducted from these six-year calendar illustrations. No actual filing deadline is certified. The adverse branch is failure to prove complete cure: Branch B then loses its assumed trigger. The two payment amounts are alternatives, not cumulative credits. Interest remains unquantified, and a positive ledger balance does not itself establish a timely remedy.
Model M2 — Matured installments and a separately accelerated future balance
Assumptions: An Arizona written, fixed-maturity consumer loan is neither an Article2 goods-sale claim nor a negotiable-instrument claim. Three unpaid principal installments are $1,000 each. The remaining $9,000 was originally due April10,2030. Valid optional acceleration of that future balance occurs August10,2021. The contract and allocation evidence are assumed solely for this illustration.
Plain text
Installment 1 due: April 10, 2018
Six-year anniversary candidate: April 10, 2024
Installment 2 due: April 10, 2019
Six-year anniversary candidate: April 10, 2025
Installment 3 due: April 10, 2020
Six-year anniversary candidate: April 10, 2026
Valid acceleration: August 10, 2021
Future-balance anniversary: August 10, 2027
Comparison date: April 11, 2025
Elapsed since installment 1: 7 years, 1 day
Elapsed since installment 2: 6 years, 1 day
Elapsed since installment 3: 5 years, 1 day
Elapsed since acceleration: 3 years, 8 months, 1 day
On these assumptions, the first two installment candidates have passed, while the third and accelerated-future-balance candidates have not. This is not a conclusion that the entire loan is timely or entirely barred. C012–C014.
Plain text
Original principal: $12,000
Payment on August 11, 2022: $500
Recognized setoff August 12, 2022:$250
Assumed allocation:
Both credits reduce the future-balance component.
Future principal remaining: $9,000 − $500 − $250 = $8,250
All principal remaining: $3,000 + $8,250 = $11,250
Total conditional ledger:
$12,000 + I_total − $500 − $250 = $11,250 + I_total
Potentially timely principal under the selected clock:
$1,000 + $8,250 = $9,250
Older principal under the selected clock:
$1,000 + $1,000 = $2,000
Adverse branches: If acceleration was ineffective, the assumed August2027 candidate does not follow; the original maturity and any other valid acceleration must be examined. If credits were allocated differently, both component balances change. Interest attributable to older components cannot simply be placed in the timely component. No signed acknowledgment, cure, or lawful allocation is inferred from the payment alone.
Units/rounding: Whole US dollars for the fixed inputs; no rounding. I_total and the interest allocable to each component remain symbolic. Intermediate weekends/holidays are not excluded from the six-year calendar illustrations; actual endpoint and filing rules remain separate.
Model M3 — Current ordinary judgment, initial affidavit, and successive renewal
Assumptions: A valid ordinary money judgment was entered September30,2016. It falls within the current statutory transition. There are no stays or earlier renewals. The proper court receives and dockets a complete affidavit on the same day.
Plain text
Judgment entry: September 30, 2016
Ten-year anniversary candidate: September 30, 2026
90-day subtraction boundary: July 2, 2026
Subtraction check:
July 2 to July 31: 29 elapsed days
August: 31 days
September 1 to September 30: 30 days
Total: 90 days
Selected interior filing date: August 3, 2026
Distance to anniversary: 58 days
Assumed docketing date: August 3, 2026
The selected filing is comfortably inside the interval, so the illustration does not depend on resolving inclusion of the precise outer boundary. C031–C043.
Plain text
Original judgment principal: $5,000
Payment January 15, 2020: $500
Payment January 15, 2021: $500
Recognized setoff July 15, 2026: $250
Supported accrued interest: I
Conditional renewal balance:
$5,000 + I − $500 − $500 − $250 = $3,750 + I
Successive anniversary candidate,
using the assumed common filing/docketing date:
August 3, 2036
90-day subtraction boundary: May 5, 2036
Example interior future date: July 1, 2036
If an additional $300 is credited January 15, 2030,
and J is separately supported later interest:
$3,750 + I + J − $300 = $3,450 + I + J
Calendar and adverse branches:
- August3,2036 is a Sunday by calendar arithmetic. Whether a particular statutory boundary would shift, and whether the law and court calendar will remain the same, are held. The example uses an interior date.
- No five-day service addition is included.
- A June1,2026 filing is outside the stated ninety-day interval; an October1,2026 filing is beyond the anniversary candidate. Neither is assumed effective.
- Filing in the wrong court invokes the J.C. Penney problem.
- If filing and docketing occur on different days, the §12-1612(E)/§12-1613(B) distinction remains unresolved here.
- A symbolic balance is sufficient for this illustration but would not satisfy the statute’s demand for an exact affidavit balance until the interest and credits are verified.
- J is not assumed to include unauthorized interest on interest. No fee or rate is invented.
Model M4 — The older-judgment transition
Assumptions: Valid entry, no stay, ordinary judgment, and no special statutory exception. The first branch has no qualifying renewal; the second has a properly completed timely renewal under the then-applicable law.
Plain text
Original entry: August 2, 2013
Original five-year anniversary: August 2, 2018
Branch A:
No valid renewal on or before August 2, 2018.
Current transition does not authorize treating the judgment
as automatically revived for ten years.
Branch B:
Valid renewal filed and docketed August 1, 2018.
Current transition includes the qualifying renewed judgment.
Ten-year anniversary from that renewal:
August 1, 2028
90-day subtraction boundary: May 3, 2028
Subtraction check:
May 3 to May 31: 28 elapsed days
June: 30 days
July: 31 days
August 1: 1 day
Total: 90 days
The original five-year arithmetic is historical; the ten-year result in Branch B depends on the subsequently enacted regime and express transition. It is not obtained by adding ten years indiscriminately to every old entry date. C032–C033.
Plain text
Original judgment principal: $2,000
Payment January 15, 2017: $300
Supported interest variable: K
Conditional remaining ledger:
$2,000 + K − $300 = $1,700 + K
The same ledger can accompany different enforcement outcomes in Branch A and Branch B. The payment is not itself one of the statutory renewal methods. An attempted October27,2026 renewal does not cure Branch A by assumption; in Branch B that date is earlier than the illustrated next renewal interval.
Excluded days/rounding: No stay days or service extensions are added; no intermediate weekend exclusions; whole-dollar fixed inputs with symbolic interest. Actual prior filing validity, entry/docketing dates, and future law remain necessary. A reported bankruptcy would require a separate §108(c), enforcement-stay, and discharge analysis rather than insertion of an assumed pause.

PASS-05 work mapped to it |
What remains open |
| X01 |
Supplied review: [internal evidence reference], 2026-10-23T05:19:34.171103Z. Topic: “Full collection, litigation, limitations, debtor-property exemptions, secured debt, sectors, local and tribal law, contract defenses/choice of law, broader case law.” Original disposition: “Excluded from completion of this pass; all remain open.” Original next action: “Separate focused investigations are required. Nothing in this component supplies statewide or A066 acceptance.” |
This pass investigates the ordinary consumer-debt limitations/accrual/acknowledgment and ordinary judgment enforcement-renewal gateway portions: C001–C074; necessary narrow federal context C075–C082; provenance/currentness C083–C086. |
All original categories outside that narrow mapping remain open, together with every explicit PASS-05 hold. The supplied coordinator status remains component_partial_not_accepted_remaining_required_work. No P01 claim ID was supplied for this deferred row, and none is invented. |
P02’s licensing review provides no limitations premise. P03 and P04 remain unreviewed reports, not accepted wage, bank, limitations, or renewal premises for this pass.
11. Researcher self-check
This is a researcher self-check, not an independent review.
- Actual reading: Current posted statutory bodies; the identified 2018, 2019, 2023, 2024 and 2026 enactment provisions; selected official adoption orders; current posted ACJA text; published opinion bodies or disclosed reproductions; RegulationF text and final-rule passages; dated official §108 text; complete identified Maricopa form; and the county inventory.
- Not converted into law: Search snippets, legislative summaries, rule indexes, study-guide reproductions, form fields, and quoted underlying cases were kept at their actual evidentiary level.
- Historical numbers controlled: Five-year judgment references in older opinions were not silently treated as current. The current ten-year period was tied to the read amendment and transition chain.
- Later treatment controlled: Bridges’ treatment of Miller, Specialty’s treatment of the judgment-action concept, Ironwood’s treatment of court location/notice, and the later BAP treatment of the Smith extension premise were actually read.
- Unavailable evidence preserved: S010, S032, S033, S035, S036 and S051 remain failed/unresolved records. The relevant alternative routes and next evidence are visible above. Their unavailability does not establish absence of a rule or permission to act.
- No unpublished holding used: S034 is recorded but excluded. Current Rule111 was not assumed from its notice.
- Private facts remain private-fact holds: No actual debt, contract, signature, payment allocation, judgment, renewal, stay, discharge, service, filing receipt, court selection, legal deadline or eligibility result was determined.
- No file or publication claim: This answer is the deliverable. No local coordinator file write, website change, filing, contact, publication, or independent acceptance is claimed.
