S_AZ PASS-09 — Ordinary consumer money-debt court gateway
This pass establishes the principal Arizona court-entry, service, response, default, and relief pathways, subject to the specific source and application holds below. The three tracks must remain separate:
- Ordinary justice-court civil jurisdiction generally reaches $10,000, with the statutory exclusions identified below.
- Small claims now reaches $5,000, but amount alone does not establish eligibility: an assignee generally cannot commence a small-claims action, and representation restrictions apply.
- Superior Court supplies the ordinary money-claim route outside the justice court’s exclusive monetary jurisdiction, subject to the actual claim, parties, and other jurisdictional statutes.
The most consequential procedural findings are the 2026 Superior Court default-notice amendment, the 2025 justice-court electronic alternative-service amendment, the distinct small-claims proof-of-service and answer requirements, and the Arizona Supreme Court’s 2026 holding that a later appearance does not retroactively validate a default entered without personal jurisdiction. [Claims C001–C007, C024, C039, C044, C055–C056, C075.] Jurisdiction of civil actions+5
1. Scope, dates, and evidentiary conventions
Baseline requested: October 22, 2026, Pacific.
Actual public-source access: October 27, 2026, including an observed research clock of 13:52:06 UTC / 06:52:06 Pacific. That clock is not an individual source-opening timestamp. Exact opening times for individual sources are UNKNOWN.
This report uses fresh public browsing. Earlier passes and coordinator review statements supplied by the user are provenance, not legal premises. No private case, borrower, creditor, provider, address, property, military-status record, or entity-license record was queried.
Material currentness limitations
- The Legislature’s website says its compilation includes the 2026 second regular session, but also says it reflects the version effective on January 1 following the latest session. Consequently, a readable compilation is not by itself proof that every displayed amendment was operative on October 27, 2026. The material small-claims increase was checked against the enacted law and adopted court orders. Two potentially relevant 2026 enactments remained inaccessible, as recorded below.
- The official judiciary’s consolidated rule-host routes failed. Actual Arizona Supreme Court adoption and amendment orders supplied the operative text for the principal rules discussed here.
- The 2013 justice-rule amendment attachment was not readable through the available text rendering, including a different official emergency-order version. That leaves a specific currentness hold concerning amended portions, particularly Rule 115’s complete computation text. It does not erase the separately read Rule 114 response periods or the express counting language in Rule 140.
- The complete current primary text of Superior Court Rules of Appellate Procedure—Civil Rule 4(a) was not recovered. Official 2026 judicial education material quotes a 14-calendar-day justice-court appeal period, but that guidance is not substituted for a fully verified current promulgated rule.
- Posted forms contain conflicts. Their publication or revision dates do not elevate their instructions above statutes and court rules. [C082–C087.]
Identifier convention: In prose and coverage tables, “C001” means S_AZ-P09-C001, and “S001” means S_AZ-P09-S001. Full identifiers appear in the registers. All source records have the October 27 access date unless a different date is expressly identified as the document’s publication, filing, revision, or effective date.
Status key: R = fresh material primary body read; P = partial body read; G = official guidance/form; RP = disclosed reproduction of a primary opinion; I = index/discovery only; F = failed or unreadable material body. “High” confidence refers to the identified text or holding, not complete subsequent-history or statewide current-law certification.
2. Substantive findings
2.1 Court, amount, plaintiff, and representative
| Track |
Verified gateway |
Important conditions and boundaries |
| Superior Court |
Arizona Constitution art. VI, §14 supplies general civil jurisdiction where exclusive jurisdiction is not otherwise assigned. For an ordinary money claim, read that provision with A.R.S. §22-201(B), rather than treating the Constitution’s historical dollar language as a stand-alone court-selection threshold. |
A claim exceeding the justice court’s exclusive monetary jurisdiction ordinarily points here. Personal jurisdiction, venue, valid service, real-party status, and any special statutory allocation still require separate analysis. C001, C007. |
| Justice civil |
A.R.S. §22-201(B): exclusive original jurisdiction when the amount involved is $10,000 or less, excluding interest, costs, and awarded attorney fees when authorized by law. |
The text does not establish the truth of a balance or the right to fees. Section 22-201(G)’s over-limit counterclaim language separately excludes interest and costs; do not silently add an attorney-fee exclusion to that subsection. C001, C016. |
| Small claims |
A.R.S. §22-503: $5,000 or less, exclusive of interest and costs, within the designated small-claims categories. The increase from $3,500 was enacted in 2025 and implemented by court orders effective September 26, 2025. |
The small-claims amount clause does not expressly provide the same awarded-attorney-fee exclusion as §22-201(B). An assignee or other nonparticipant in the original transaction generally cannot commence the action; the duly appointed Title 14 personal-representative exception is explicit. C002–C004. |
| Transferred small claim |
A party can invoke transfer to ordinary justice civil proceedings; an over-limit counterclaim also triggers the statutory transfer framework. |
Section 22-504 says “at least ten days” before hearing; Small Claims Rule 11 says 10 business days. Both texts are preserved below; no separate authoritative reconciliation was established. C015–C016. |
| Federal or removed case |
Not established by these state response rules. |
Federal jurisdiction, removal, federal service and response periods, and federal relief rules remain separate required research. D14 below. |

Ownership and representation are different questions. Superior Rule 17(a) and Justice Rule 104 require the proper real party; Justice Rule 110(b)(2) additionally requires identification of the original owner in an assigned-debt complaint. Neither a collection license nor an allegation of assignment proves ownership.
For an entity in ordinary justice civil court, Supreme Court Rule 31.3(c)(3) provides a conditional officer/partner/member/manager/employee representation exception: authorization, incidental relationship to management duties, and compensation restrictions matter. That is not a universal employee exception in Superior Court. Small claims has its own §22-512 categories and attorney restrictions. The newer community-justice-worker/legal-advocate exception incorporates ACJA §7-211; its full authorization scope was not researched here and supplies no blanket permission. [C003–C007.]
For an actor actually qualifying as a collection agency under the independently read state predicate, A.A.C. R20-4-1509(E) requires an attorney without a personal or financial interest in the agency to file the collection lawsuit. State licensing exemptions and federal debt-collector status remain separate. No P06 conclusion was imported. [C006, C010–C012.] 0000663133-0011.DOC+5
2.2 Venue is not subject-matter jurisdiction, personal jurisdiction, or service
For Superior Court, A.R.S. §12-401 starts with the defendant’s county of residence, then provides actual exceptions, including specified written-performance, debt-and-move, multiple-defendant, nonresident, estate, and corporate circumstances. Justice venue uses precincts under §22-202, with its own listed exceptions.
A covered debt collector bringing an ordinary consumer-debt legal action must also satisfy 15 U.S.C. §1692i(a)(2): the judicial district or similar legal entity where the consumer signed the contract sued on or where the consumer resides when the action begins. A broader state performance-venue provision does not itself satisfy that independent federal predicate. The federal provision does not authorize an otherwise unauthorized action. [C008–C014.]
The Ninth Circuit’s published Fox majority treats Arizona counties as different judicial districts for §1692i despite Arizona’s unitary Superior Court organization. The opinion read does not resolve every justice-precinct application. That narrower federal precinct question remains held.
Wrong venue is not automatically equivalent to a void judgment. Section 12-404 expressly permits the court to retain jurisdiction if the statutory transfer objection is not timely made. Service-based personal-jurisdiction defects require a different inquiry. [C012–C014, C075.]

2.3 Commencement, service, and response are separate events
Filing the complaint commences the action. It does not establish service, personal jurisdiction, ownership, or timely prosecution under every separate statute.
The principal service windows differ:
- Superior: Rule 4(i), generally 90 days after filing. Good cause requires an appropriate extension; even without good cause, the court has discretion to extend rather than dismiss. Sholem rejects mechanically applying Rule 6(b)’s excusable-neglect requirement to the initial Rule 4(i) period.
- Justice civil: current Rule 113(j), as renumbered in the 2025 amendment, uses 90 days and at least 20 days’ notice before the specified dismissal process, with a good-reasons extension provision.
- Small claims: Rule 5(a) requires filing proof of service within 45 days after filing the complaint, or transferring out of small claims. Completing service without timely filing its required proof does not satisfy that rule. [C017–C024.]
The methods also differ. Superior Rule 4.1(d) allows personal delivery, qualifying abode delivery, or delivery to an authorized agent. A visitor at an address is not automatically a resident recipient, and an employee is not automatically an authorized agent. Out-of-state signed-receipt mail, small-claims certified mail, a waiver, and a filed acceptance have different predicates and completion events.
Justice Rule 113(f), effective January 1, 2025, adds a court-ordered electronic alternative after specified conventional methods are impracticable or unsuccessful. Its recent-use/actual-receipt predicates and required mailing must be satisfied. It is not permission to email every summons. Ordinary electronic filing and subsequent electronic service likewise do not constitute initial service. [C025–C041.]

2.4 Answer periods and default are not interchangeable clocks
| Track |
Ordinary initial response |
Material qualification |
| Superior |
Generally 20 days after in-state service; 30 days after completion of out-of-state service. |
A qualifying waiver changes the trigger and period: ordinarily 60 days from sending the request, or 90 days for the specified outside-United-States waiver branch. A qualifying Rule 12 motion changes the response sequence. C042, C048. |
| Justice civil |
Rule 114 states 20 days after in-state service, 30 after out-of-state service. |
File a permitted written response and provide required copies. The unreadable 2013 Rule 115 amendment prevents an unqualified certification of every current computation detail. C043, C046, C050–C051. |
| Small claims |
20 days after service in all cases under §22-514 and Rule 7. |
Do not import a 30-day out-of-state justice-civil instruction from a mixed packet. Current Rule 7 requires providing the answer under Rule 6; it is no longer accurately summarized as “mail only.” C044, C047, C082. |
A collection dispute, negotiation, demand for documents, administrative complaint, or appearance without the required pleading/defense is not inherently an answer. Current Superior Rule 4(f)(3)(A) expressly warns that a voluntarily appearing party must still plead or otherwise defend.
For Superior default, a compliant application starts a 10-day period excluding Saturdays, Sundays, and holidays, beginning the following day; no mailing days are added. A qualifying defense within that period prevents default from becoming effective. In 2026 the requesting party must make the specified notice efforts, including mail plus email where the email predicate is satisfied, and mail and email to known counsel in the action or a related matter. [C034, C055–C057.]
A default application is not a money judgment. The court still applies the appropriate sum-certain, affidavit, hearing, fee, cost, protected-person, and SCRA requirements. Justice Rule 140’s hearing-notice predicate is not identical to Superior Rule 55’s appearance-based hearing notice. [C058–C067.] azcourts.gov+5
2.5 Relief requires identifying what is being attacked
There are distinct routes for:
- Entry of default: Superior Rule 55(c), or the applicable justice/small-claims framework.
- Default judgment or another final judgment: Superior Rule 60; Justice Rule 141; Small Claims Rule 16.
- Clerical mistake: the separate correction provisions.
- A void judgment: jurisdictional and due-process principles, not merely a claim that the result was wrong.
- Appeal or stay: separate rules and triggers.
Superior Rule 60(b)(1)–(6) includes mistake/excusable neglect, newly discovered evidence, opposing-party fraud or misconduct, voidness, satisfaction/reversal/prospective inequity, and another justifying reason. Rule 60(c) generally requires a reasonable time, with the specified six-month ceiling for grounds (1)–(3), subject to the narrow Rule 6(b)(2) exception. A motion does not itself suspend the judgment.
Richas requires factual support for prompt action, an excusable basis, and a meritorious defense in its ordinary neglect-based default setting. Gonzalez explains that the meritorious-defense burden is minimal but exceeds speculation and may be met from the existing record. Neither is a universal requirement to prove a merits defense before obtaining relief from a truly void, unserved judgment. Peralta and the 2026 McMahan opinion address that distinction. [C068–C078.]
There is also an important correction to older rulebooks: current Superior Rule 62(a) ordinarily stays execution and enforcement for 15 days after entry, unless the court orders otherwise and subject to its enumerated exceptions. The pre-2019 “no automatic stay” language is superseded. A later relief motion does not automatically create an additional stay. A qualifying Rule 60 motion filed within 15 days can affect the Superior appeal clock under ARCAP 9(e); a motion filed later within a possible six-month relief period does not gain that effect merely because it is timely for relief. | McMahan, Arizona Supreme Court,July30,2026 — S051 |
Personal-injury action; attempted service through an unauthorized recipient connected with an Illinois statutory agent; actual notice reached the defendant; default preceded later answer/appearance. |
Later appearance/Rule12 waiver could not retroactively validate a default entered before personal jurisdiction existed. Court vacated the2025Court of Appeals opinion and reinstated trial relief. Entryofdefault belongs under55(c); ¶34n.2 expressly distinguishes60(b)(4). Not an actual debt-case result. |
| Sholem, Arizona Supreme Court,March30,2020 — S052 |
Medical-malpractice plaintiff made limited early service attempts and obtained a late extension; defendant challenged dismissal denial. |
Rule4(i)requires extension ongoodcause and allows discretion withoutgoodcause. Rule6(b)’sexcusable-neglect test doesnotgovern theinitial90-dayperiod. Record supported discretionary denial ofdismissal; affirmed. No universal extension entitlement. |

7. Four fully worked conditional event examples
Model 1 — Superior personal service and a 20-day response count
Stipulated facts
- Ordinary Superior money claim: $12,000 principal.
- Complaint filed Monday, January 5, 2026.
- An authorized server validly personally delivers the issued summons and complaint to the adult defendant in Arizona on Tuesday, January 6, 2026.
- No waiver, responsive motion, extension order, incapacity, military-service issue, or federal removal.
- Paper filing and required service of the response are assumed available.
- No exceptional closure affects the candidate endpoint. Actual court calendars are not supplied.
Rules: Superior12(a), as amended; Rule6(a); Rule4.1(d). C020,C025–C026,C042,C045.
Count
- TriggerdayJanuary6: excluded.
- January7–January26 inclusive: 20calendar days.
- Intermediateweekendsandholidayscountbecauseperiodisnotlessthan11days.
- Candidate20thday: Monday,January26,2026.
- Noinitial-servicefive-daymailaddition.
- Conditionalnextstep: fileandservetheproperresponsewithinthatverifiedsequence.
Adverse branches

- AqualifyingRule12motionwouldaltertheresponsesequence.

Money treatment: $12,000 is the stipulated principal, not an award. Interest, costs, fees, ownership, and defenses are unproved and unchanged. No payment is modeled. azcourts.gov+2
Model 2 — Small claims versus justice civil, including amount and proof filing
Stipulated facts
- Principal: $4,800.00.
- Separately stipulated legally allowable interest: $300.00.
- Separately stipulated allowable costs: $100.00.
- No attorney fee is requested.
- Complaint filed Monday,July20,2026.
- Validserviceoccurs Tuesday,August4,2026.
- Requiredprooffiled Friday,August7,2026.
- Noendpointclosure; noextension/motion/transferorderunlessspecified.
Amount calculation
- Requestedmoneycomposition:
$4,800.00 + $300.00 + $100.00 = $5,200.00.
- Smalljurisdictionalbaseunder§22-503,usingtheexpressinterest/costexclusions:
$5,200.00 − $300.00 − $100.00 = $4,800.00.
- $4,800.00 ≤ $5,000.00.
- Units: USD; exactcents; norounding.
This arithmetic does not establish that the claimed interest or costs are legally allowable in an actual case.

What remains open |
| Reviewed P01 remaining-category statement |
“Full agreements/funds/bonds/remedies and all other state categories stay open.” |
Supplies fresh ordinarycourt-entry/service/response/default/relief research within the still-open litigation area. |
Doesnotclosefullagreements,funds,bonds,remedies,orotherstatecategories. |
| Current unaccepted litigation/judgment dimension |
User identifies it as separately requiring service, venue, answer, default, relief, andforms. |
Addresses those specific gateways with source/claim/coverage records and explicit holds. |
No invented “exact P01 procedural row”; no dimension acceptance. |
| Authorized parent requirements |
User identifies additional parent requirements independently ofP01. |
Thiscomponentmayinformlaterreviewonly. |
No country/state/parent/A066/A097/A098acceptance. |

Renewal/proration review has separate limits. |
No legal or factual premise imported. |
Its operational/currentnessholdsareunchanged. |

User states saved/running outputs are unreviewed. |

The coordinator review date and prior review descriptions are user-supplied provenance, not evidence that I reopened a coordinator file, independently reviewed an earlier report, or verified a source at that earlier time.
10. Researcher self-check
Actually read: the material Arizona statute bodies identified in S001–S006; the operative collection-counsel clause and adoption support; the principal civil, justice, and small-claims adoption/amendment bodies identified above; current posted ACJA1-901 and its June2026 amendment; selected complete blankforms; current OLRC federal venue/actor and SCRA provisions; and the material majority bodies identified in S051–S059.
Not read or not fully established:
- Complete consolidated current rulebooks from the blocked host.
- The operative2013justice-rule amendment attachment.
- Complete current primary lower-court appealRule4(a).
- The inaccessible2026fee and reviser enactments.
- The underlyingSuperior2024feeorder.
- Complete currentholiday law and actualtrial-courtclosurecalendars.
- Every incorporatedprofessional/probate/certificationdefinition.
- Everylocalcourt’s rules,forms,fees,e-filingimplementation,orpractice.
- Fullsubsequenthistory/citatorcoverage.
- Any actualcase,party,serviceevent,contract,account,militarystatus,orjudgmentrecord.
Source hierarchy checks: officialforms andeducationmaterials were kept separate from statutes, rules, andmajorities. Historicalrulelanguage was compared with the specifically read later amendments. The2027order was kept future-effective. Failedfetches and partial bodies were not treated as absence oflaw or permission. No unpublished decision was used as substantiveauthority, so no unverified memorandum-citation rule was invoked.
Arithmetic checks: all four examples are fictional; triggers, units, exclusions, candidateendpoints, and adversebranches are visible. No unverifiedinterestrate or automaticfeeaward was supplied. Thedefaultledger accounts for the stipulatedcredit once. Date arithmetic does not validate service, jurisdiction, liability, filing, or enforcement.
Visible record counts: 74 source/access records; 88 atomic claims; 65 core/workflow/currentness/model coverage rows; 15 individual county holds; 18 deferred-family/territorial/private-fact rows; 5 provenance-crosswalk rows; 16 fictional postures; and 4 worked models. The opinion matrix is explanatory evidence analysis, not additional accepted coverage.
This is a researcher self-check, not independent review, publication readiness, an actual-case opinion, or acceptance of the broader Arizona dossier.
