S_AZ PASS-06 — Arizona collection-agency licensing, actor exemptions, security, and public procedure
Arizona has a collection-agency licensing regime whose coverage depends on the activity, the relationship to the debt, and any applicable exemption. The verified statutory charges are a $1,500 application fee and $600 annual assessment/renewal fee. The statutory minimum security tiers range from $10,000 to $35,000, measured by the licensee’s specified Arizona-connected gross annual income. Those security amounts are not license fees, surety premiums, or guaranteed payments to consumers. Current operational application/renewal checklists, the live public lookup workflow, the renewal late-fee amount, and several form-dependent calculations remain held. This pass contributes only to the collection-agency actor/license/security/public-procedure portion of the reviewed P01 deferred row. P02, P03, P04, and P05 are not legal premises for these findings. The review-file provenance supplied in the conversation is preserved as supplied; I did not open or modify that coordinator file.
1. Reading conventions and principal conclusions
In the tables, S001 means S_AZ-P06-S001, and C001 means S_AZ-P06-C001. The source register supplies the full literal URLs. Statutory compilation IDs are reused for their different sections; the individual section URLs are locators, not invented separate documents.
Confidence labels:
- H — high confidence in the identified text or holding actually read. This does not certify every subsequent legal development or an actual entity’s status.
- I — bounded inference from the identified primary text, expressly distinguished from an authoritative interpretation.
- P — partial: relevant evidence was read, but a consequential issue remains unresolved.
- Held: the necessary body, interpretation, operational instruction, or private fact was not established.
The most consequential distinctions are:
- State coverage is not limited to FDCPA consumer debt. Arizona’s operative “claim” and collection-agency definitions do not contain a general personal/family/household-purpose limitation. The commercial-financing exemption has its own narrower conditions. [C001–C005, C026.]
- An outright purchase is not interchangeable with an assignment for collection. Retained recourse, unpaid purchase consideration, and unpassed title are expressly material under Arizona law. A fully paid, nonrecourse purchase requires further classification; I did not establish a blanket Arizona debt-buyer exemption. [C002, C007.]
- Exemptions are conditional. Section 32-1004 requires the enumerated actor to be acting in the regular course of its respective business, and it preserves specified duties. Attorney ownership, nonprofit status, an affiliate label, and an insurance or financial-services label are not enough by themselves. [C013–C033.]
- A physical branch, a separate business name, and a control acquisition are different questions. The official published branch-policy notice says separate collection-agency branch applications and renewals are not required; the later fee amendment removed collection-agency branch charges. The rule still requires a separate license for each business name, and a qualifying control acquisition requires prior written consent. [C048, C053–C054, C101.]
- Submission is not issuance. The statute requires an application and an obtained license. NMLS is an authorized licensing channel, not the Arizona issuing regulator. [C034–C041.]
- The surety-bond route and the cash-deposit route have different operative language. The cash-deposit rule supplies a judgment-based administrative claim procedure and a proportional-payment formula. It is not a general surety-bond payout formula. [C068–C081.]
These distinctions follow from the freshly read statutes, rules, and the limited published interpretations identified below. H Ver of SB1463+4
2. Atomic claim/evidence matrix — actors, debts, nexus, and exemptions
For exemption rows, failure of a listed predicate defeats reliance on that exemption; it does not, by itself, decide every other classification or exemption. “Regular course” and the retained statutory duties in C013 apply throughout.

Required step, consequence, or boundary |
Primary pinpoint; confidence and hold |
| S_AZ-P06-C001 |
A person is employed to demand, collect, or enforce money owed, due, or asserted due to another. |
This is the core statutory “claim” relationship. An asserted obligation can qualify without an adjudication that the debt is valid. |
S001, §32-1001(1). H text; debt validity remains separate. |
| S_AZ-P06-C002 |
An obligation is sold or assigned, but final payment has not been tendered, title has not passed, or the purchaser/assignee has recourse against the seller/assignor. |
Any listed condition brings the obligation within the express purchased/assigned-claim inclusion. The contract’s title does not settle the issue. |
S001, §32-1001(1)(b)(i)–(iii). H. |
| S_AZ-P06-C003 |
A person directly or indirectly solicits claims for collection or collects claims owed, due, or asserted due. |
The activity falls within the collection-agency definition, subject to classification and exemption analysis. |
S001, §32-1001(2)(a); S007, R20-4-1501. H. |
| S_AZ-P06-C004 |
A business collects its own debts using another name that indicates a third person is collecting. |
The statute expressly includes that business in “collection agency.” Owning the debt does not avoid this limb. |
S001, §32-1001(2)(b). H. |
| S_AZ-P06-C005 |
Consumer or business obligations are collected. |
Arizona’s general definition is not confined to personal/family/household debt, nor does it impose a general default-at-acquisition threshold. |
S001, §32-1001(1)–(2); S007, R20-4-1501. H text; sector-specific exceptions remain separate. |
| S_AZ-P06-C006 |
An original creditor collects only its own originated obligations in its true name. |
That posture is distinguishable from employment to collect another’s claim and from the false-name limb. Treating it as outside those limbs is a textual inference, not a blanket exemption determination for every creditor activity. |
S001, §32-1001(1), (2)(b). I; actual activity and relationship held. |
| S_AZ-P06-C007 |
A purchaser asserts full payment, passed title, and no recourse. |
Those facts remove the express conditions in §32-1001(1)(b); they do not, without further analysis, establish that every other definitional limb is inapplicable. No current authoritative Arizona blanket debt-buyer exclusion was established. |
S001, §32-1001(1)–(2). P; transaction documents and responsive authoritative construction missing. |
| S_AZ-P06-C008 |
A person conducts a collection agency “in this state.” |
It must first apply for and obtain a Chapter 9 license unless an exemption applies. The statute does not make an application receipt a license. |
S001, §32-1055(A). H; precise outer territorial boundary held. |
| S_AZ-P06-C009 |
A licensee measures the bond base. |
Arizona-connected business includes collection from Arizona-resident debtors, collection from an Arizona office, and collection for Arizona-resident creditors, with the specified location-independence. This definition is expressly “for purposes of this section”; it is not silently converted into a complete territorial licensing test. |
S001, §32-1021(D)(1)–(3). H text; broader nexus inference limited. |
| S_AZ-P06-C010 |
An existing licensee’s employee works remotely. |
The general rule permits licensed activity at a remote work location under licensee supervision, written supervision policies, the information-security plan, and no physical records at that location. It does not license a separate remote business or independent contractor. |
S007, R20-4-102(29); S009, adopted text at 31 A.A.R. 539. H/P; actual employment and compliance held. |
| S_AZ-P06-C011 |
An Arizona-licensed agency receives claims as forwardee from an out-of-state agency or attorney. |
Section 32-1055(B) expressly preserves this arrangement despite its prohibition on aiding, abetting, or receiving compensation from an unlicensed person. It does not expressly authorize every direct Arizona collection activity of the forwarding actor. |
S001, §32-1055(B). H narrow savings clause. |
| S_AZ-P06-C012 |
An out-of-state agency seeks reciprocity. |
Arizona issuance requires a valid other-state license, substantially equal requirements when issued, reciprocal treatment, and Arizona application fees, financial requirements, and security. The other-state license alone is insufficient. |
S001, §32-1024(1)–(3); S007, R20-4-1502(B). H. |
| S_AZ-P06-C013 |
An actor invokes any §32-1004(A) exemption. |
It must act in the regular course of its respective business and retain compliance with §32-1051(2)–(6), §32-1055(C), and §32-1055(D)(1), (2), (3), (5). Exemption is not general immunity from Chapter 9 duties. |
S001, §32-1004(A); §§32-1051, 32-1055. H. |
| S_AZ-P06-C014 |
An attorney invokes the attorney exemption. |
The text exempts attorneys-at-law in the regular course of their business. An attorney’s ownership, affiliation, or letterhead does not itself establish an exemption for a separate collection company. |
S001, §32-1004(A)(1), introductory clause. H text; firm/entity application held. |
| S_AZ-P06-C015 |
A credit worker receives a regular wage or salary. |
The credit-person/similar-capacity exemption excludes an independent contractor. A compensation label alone does not establish employment. |
S001, §32-1004(A)(2); S007, R20-4-102(16). H. |
| S_AZ-P06-C016 |
A bank, bank trust department, fiduciary, or financing/lending institution invokes A(3). |
The enumerated institutional status and regular-course activity must be established. A generic “financial company” label is insufficient. |
S001, §32-1004(A)(3); §32-1001(5). H/P; particular institution and preemption facts held. |
| S_AZ-P06-C017 |
A common carrier invokes exemption. |
Common carriers are enumerated, subject to regular-course activity and retained duties. |
S001, §32-1004(A)(4). H; no carrier-status determination. |
| S_AZ-P06-C018 |
A title insurer, title agent, or abstract company invokes exemption. |
A(5) expressly requires it to be doing an escrow business. |
S001, §32-1004(A)(5). H. |
| S_AZ-P06-C019 |
A real-estate broker invokes exemption. |
The text requires a licensed real-estate broker acting in the regular course of business. A landlord or billing contractor is not automatically such a broker. |
S001, §32-1004(A)(6). H/P; broker-license and activity facts held. |
| S_AZ-P06-C020 |
An employee works for a Chapter 9 licensee. |

| S_AZ-P06-C021 |
A substation payment office invokes A(8). |
The posted wording is: “Substation payment offices employed by or serving as independent contractors or public utilities.” I preserve that wording; I do not rewrite “or” as “of” or resolve its ambiguous reach. |
S001, §32-1004(A)(8). H text; interpretation held. |
| S_AZ-P06-C022 |
A person actually holds a Title 6, Chapter 7 license. |
Section 32-1004(A)(9) supplies a conditional cross-exemption. It requires the specified license and regular-course activity; merely marketing debt-management services is insufficient. |
S001, §32-1004(A)(9). H; actual status held. |
| S_AZ-P06-C023 |
A Title 6, Chapter 7 licensee proposes creditor-side activity. |
The separately applicable §6-710 prohibits purchasing a creditor’s obligation and acting as both collection agent and debt-management provider on the same account. The cross-exemption does not erase those restrictions. |
S002, §6-710(3)–(4). H, narrow necessary cross-reference only. |
| S_AZ-P06-C024 |
A person actually holds a Title 6, Chapter 9 license. |
That statutory license category is enumerated, subject to C013. It is not an exemption for every business calling itself a mortgage or finance company. |
S001, §32-1004(A)(10). H; underlying licensing qualification deferred. |
| S_AZ-P06-C025 |
A person actually holds a Title 6, Chapter 14, Article 1 license. |
The specified premium-finance licensing category is enumerated, subject to C013. |
S001, §32-1004(A)(11); S002, §6-1401. H. |
| S_AZ-P06-C026 |
A finance transaction gives a lender rights in commercial claims due the borrower. |
Assignment, purchase, or security interest can qualify. The transaction’s primary purpose cannot be facilitating collection; commercial claims exclude purchases for personal/family/household use. |
S001, §32-1004(A)(12), (B)(1)–(2). H. |
| S_AZ-P06-C027 |
An accounting, bookkeeping, or billing vendor invokes A(13). |
All five conditions apply: accounts not contractually past due when received; only the initial written notice and one written follow-up initiated with individual debtors; no written payment request/demand; no receipt/access to debtor or insurer money; all communications in creditor’s name. |
S001, §32-1004(A)(13)(a)–(e). H. |
| S_AZ-P06-C028 |
The billing vendor sends the permitted notices. |
Content is confined to creditor contact details, amount/itemization, due date, payment place, and a past-due statement if applicable. This does not override C027’s no-demand and no-money-access conditions. |
S001, §32-1004(C)(1)–(5). H. |
| S_AZ-P06-C029 |
A corporate affiliate collects for a federally insured depository institution or its affiliates. |
A(14) requires the specified common ownership/corporate control and collection only for that institution or its affiliates. An ordinary group-company collector does not satisfy this paragraph merely because it is an affiliate. |
S001, §32-1004(A)(14), (D). H. |
| S_AZ-P06-C030 |
An insurance actor collects financed premiums. |
A(15) requires licensing under one of the listed Title 20, Chapter 2 articles and authority to collect premiums under the specified premium-finance arrangement. |
S001, §32-1004(A)(15); S002, §6-1401(5). H; actual license/agreement held. |
| S_AZ-P06-C031 |
An insurance administrator collects charges. |
A(16) requires the Title 20, Chapter 2, Article 9 license, qualifying administrator role, and collection under §20-485.09(B). A generic medical-billing vendor is not enough. |
S001, §32-1004(A)(16); S003, §§20-485, 20-485.09(B). H. |
| S_AZ-P06-C032 |
That administrator collects unpaid charges on an account inactive for more than twelve months. |
Section 20-485.09(B) prohibits that collection without a collection-agency license. The insurer agreement must prescribe permissible collection standards. |
S003, §20-485.09(B). H; inactivity and agreement facts held. |
| S_AZ-P06-C033 |
An actor relies only on nonprofit status, an ordinary affiliate relationship, or the labels “servicer,” “assignee,” or “debt buyer.” |
No blanket exemption for those labels was established from the enumerated text. Analyze the actual definition and a specific exemption instead. |
S001, §§32-1001, 32-1004. I/H textual comparison; no universal coverage determination. |
The exemption body was read in full, including its linked institutional and insurance predicates. Section 32-1004(D) still contains a reference to §32-1051 “paragraphs 2 through 7,” although current §32-1051 has six paragraphs. The 2022 amendment explains the renumbering and the incompletely updated reference; I do not invent a current paragraph 7. [C102.] Exemptions+5

Applicant, manager, officer, controlling individual, or other specified person is required to provide fingerprints. |
The Deputy Director may require fingerprints and fees; unreadable submissions can require paid resubmission. A temporary license is discretionary, may be terminated on stated grounds, and lasts no more than 180 days. |

DIFI reviews an initial collection-agency application. |
The current table supplies 60 days administrative completeness + 60 days substantive review = 120 days overall, subject to the rule’s suspensions/extensions. It is an initial-application timeframe. |

| S_AZ-P06-C039 |
DIFI identifies application deficiencies or requests additional substantive information. |
Written requests suspend specified review clocks. Failure adequately to respond within the rule’s 60-day response periods results in deemed withdrawal. The rule’s last-day provision addresses weekends/legal holidays for its notice periods. |
S007, R20-4-107(C)–(F); S004, §41-1075. H; no actual calendar computed. |
| S_AZ-P06-C040 |
DIFI misses an applicable overall licensing timeframe after an application is submitted for substantive review. |
Section 41-1077 requires the specified application-review fees to be refunded within 30 days after expiry of the timeframe; processing continues. This is not automatic license issuance and does not establish that every annual assessment is refundable under that section. |
S004, §41-1077(A)–(C); S007, R20-4-107(G). H/P. |
| S_AZ-P06-C041 |

S001, §32-1025(A); S007, R20-4-1502(C). H; actual portal cutoff/time zone held. |
| S_AZ-P06-C043 |
Renewal applicant cannot supply the financial statement when filing. |
It may request a written extension; if granted, the statement is due no later than March 1. This is not a blanket extension for the application or fee. |
S001, §32-1025(A), second sentence. H. |
| S_AZ-P06-C044 |
A license is not renewed by December 31. |
The specific statute states suspension by operation of law. Actual status still requires consideration of the timely-pending and military provisions described below. |
S001, §32-1025(B); S004, §41-1092.11. H/P. |
| S_AZ-P06-C045 |
A suspended licensee seeks renewal during January. |
Section 32-1025(B) permits submission of the application, statutory fees, and any applicable rule-based late fee “before January 31”; it separately says licenses not renewed “on or before January 31” expire. I preserve that endpoint difference rather than choose a real deadline. |
S001, §32-1025(B). H text; endpoint interpretation and actual processing held. |
| S_AZ-P06-C046 |
A licensee timely submits a sufficient renewal for continuing activity. |
Section 41-1092.11(A) says the existing license does not expire until final agency determination and the applicable review period/order. Its interaction with §32-1025’s automatic suspension language was not authoritatively resolved here. |
S004, §41-1092.11(A)–(B); S001, §32-1025(B). P; no actual pending-license status determination. |
| S_AZ-P06-C047 |
A qualifying military member holds the license and meets notice/evidence conditions. |
Guard/reserve federal-active-duty protection and 180 days after return differ from the regular-component 180 days from expiration; qualifying service injury has another statutory anchor. Timely protected renewal excludes late/delinquency charges. |

| S_AZ-P06-C054 |
An agency adds a physical branch under the same licensed business identity. |
The published 2020 policy notice says branch applications/renewals are not required; the 2021 fee amendment removed the collection-agency branch charges. This does not eliminate business-name, control, address, or other applicable duties. |

Section 32-1053 permits denial/suspension/revocation on its stated grounds. Its “controlling person” test is over 20% equity plus power actively to participate, distinct from C048’s voting-power test. |
S001, §32-1053(A)–(B); S006, §47-1201(B)(23). H; actual adjudication and bankruptcy-insolvency branch held. |
| S_AZ-P06-C057 |
A licensee describes its license or security to others. |
It may not imply state vouching, state affiliation, or that it is bonded by the state. A license and a statutory bond are not an endorsement or guarantee of collectibility. |
S001, §32-1051(6); S007, R20-4-1516. H. |
The December 31 renewal wording comes from the collection-agency amendment in 2023 chapter 152, not the separate debt-management renewal legislation. The timely-pending-license issue is a distinct unresolved reconciliation identified in this pass. azleg.gov+4

DIFI examines an enterprise. |
The statutory examination rate may not exceed $65 per examiner-hour; an out-of-state office examination may also involve actual travel/subsistence expense. The current rate actually set was not verified. |
S002, §6-125(B)(4), (C). H ceiling, held actual rate. |
| S_AZ-P06-C064 |
An examination assessment remains unpaid. |
Payment is due within 30 days after mailing of the assessment notice. The statutory $50/day, capped at the examination assessment, concerns this delinquency, subject to the specified timely written extension. It is not a renewal late-fee amount. |
S002, §6-125(D). H. |
| S_AZ-P06-C065 |
A suspended license is renewed late. |
Section 32-1025 authorizes any applicable late fee determined by rule. An exact current collection-agency renewal late-fee amount was not verified. |
S001, §32-1025(B); S007 and inaccessible S029–S032. Held amount. |
| S_AZ-P06-C066 |
NMLS processing, fingerprints, entity registration, control-change processing, or checkout extras may be involved. |
NMLS and fingerprint charges have statutory predicates, but exact amounts were not read. The $5,000 financial-institution control fee cannot be added merely by analogy to a collection-agency acquisition. |
S002, §§6-123(8), 6-123.01, 6-126(A)(11); S025–S035. P/Held; no checkout total. |
4.2 Bond, cash alternative, and the limited claim gateway
| Claim ID |
Actor / predicate |
Required act, amount, clock, or consequence |
Primary pinpoint; confidence and hold |
| S_AZ-P06-C067 |
Original/renewal applicant calculates required minimum bond. |
Base: licensee’s gross annual income from all specified Arizona-connected business during the preceding year. Tiers: not over $250,000 → $10,000; $250,001–$500,000 → $15,000; $500,001–$750,000 → $25,000; $750,001+ → $35,000. No CPI adjustment is stated here. |
S001, §32-1021(B)(2), (D). H; reporting-window/start-up/cents-gap treatment held. |
| S_AZ-P06-C068 |
Applicant supplies a surety bond. |
Applicant is principal; a corporation licensed in Arizona for fidelity/surety insurance is surety; bond runs to the people of the state and remains continuous while licensed. |
S001, §32-1022(B). H; current prescribed bond instrument not read. |
| S_AZ-P06-C069 |
Agency collects proceeds for a client. |
The bond condition requires accounting and remittance, less agreed client collection charges, within 30 days after collection-month end. If the amount due the client is less than $5, payment may be deferred another 30 days. |
S001, §§32-1022(B), 32-1055(D)(1). H; not authority to add a debtor charge. |
| S_AZ-P06-C070 |
Surety withdraws/cancels or licensee changes surety. |
Surety gives 60 days’ registered-mail notice to the Deputy Director and licensee. Without a replacement bond filed before termination, the license is void. A changed surety must meet statutory qualifications. |
S001, §32-1022(C). H; actual delivery/termination facts held. |
| S_AZ-P06-C071 |
Applicant uses cash or an approved cash alternative. |
Amount equals required security. Listed alternatives require the specified Arizona-doing-business institution, federal insurance, and payment/assignment to the State Treasurer. Acceptance is not established by the applicant merely owning a deposit account. |
S001, §32-1022(D)–(E). H. |
| S_AZ-P06-C072 |
State Treasurer holds cash/alternative security. |
Applicant is entitled to accrued interest from the alternatives. An administrative fee may be imposed, capped at $10 per deposit; neither a mandatory $10 nor an interest rate was verified. |
S001, §32-1022(E). H. |
| S_AZ-P06-C073 |
Deposited principal is proposed for release. |
Section 32-1022(F) requires written Deputy Director authorization or a competent-court order and states a three-year restriction from the first listed substitution/surrender/revocation/expiration event. Its interaction with claim payments under R105(H)–(I) was not authoritatively reconciled here. |
S001, §32-1022(F)(1)–(4); S007, R20-4-105(H)–(J). P; no immediate-release conclusion. |
| S_AZ-P06-C074 |
Suit is brought on bond, cash, or cash alternative. |
Section 32-1022(G) states a three-year period after the underlying act(s), with fraud/mistake measured under §12-543(3)’s discovery provision. This is distinct from the rule’s postjudgment administrative claim clock. |
S001, §32-1022(G); S005, §12-543(3). H text; actual accrual/tolling held. |
| S_AZ-P06-C075 |
A person seeks payment from a deposit in place of bond. |
R105 requires a final judgment of a competent court against the depositor for specified injury in licensed business, certified complaint/judgment, execution-stay statement, recovery statement, and sworn notarized claim verification. |
S007, R20-4-105(A)–(B). H; a complaint or alleged loss alone is insufficient. |
| S_AZ-P06-C076 |
Claimant files the R105 verified claim. |
File the claim and all supporting documents within six months after judgment entry. If execution is stayed during the first six months, the rule specifies filing only during the six months after the stay is lifted. |
S007, R20-4-105(C). H; no actual calendar or stay determination. |
| S_AZ-P06-C077 |
Claimant invokes the deposit claim process. |
Deliver copies to the depositor within 10 days after the original filing, make the depositor a party, and proceed as a contested case. R105 treats a timely claim as a hearing request under §41-1092.03(B). |
S007, R20-4-105(C)–(D); S004, §41-1092.03(B). H/P; full Article 12 hearing/appeal procedure deferred. |
| S_AZ-P06-C078 |
Agency considers a verified deposit claim after hearing. |
Denial grounds include wrong type of injury, default/stipulated/consent judgment without the required injury showing, stayed execution, fraud/collusion, satisfaction elsewhere, or an underlying action that was time-barred when commenced. A default judgment is not automatically payable. |
S007, R20-4-105(E)(1)–(6). H. |
| S_AZ-P06-C079 |
Agency grants the verified deposit claim. |
Award is based on compensatory damages, excluding attorney fees and amounts previously paid. Prior recoveries cannot be ignored or credited twice. |
S007, R20-4-105(F). H. |
| S_AZ-P06-C080 |
Deposit is insufficient and other civil actions were properly noticed. |
R105(I) uses: deposit × this award ÷ (this award + compensatory damages sought in other noticed actions against the same depositor). The denominator is not simply all final judgments. |
S007, R20-4-105(G)–(I). H formula; actual notices, amounts, availability, and C073 timing held. |
| S_AZ-P06-C081 |
Security is mistaken for guaranteed reimbursement. |
R105 concerns deposits in place of bond; receivership can use a different court-directed route. The statutory surety condition chiefly addresses client accounting/remittance. Neither establishes automatic consumer payment, unlimited recovery, or authority to collect a particular debt. |
S001, §32-1022(B), (D)–(G); S007, R20-4-105(J)–(K). H/P; full surety coverage/claim litigation deferred. |
The rule’s deposit procedure was read in its current compilation and in the 2025 final rulemaking. The statutory release restriction is preserved rather than silently rewritten as applying only to returns to the licensee. No authoritative decision resolving that particular interaction was opened in the bounded search. azleg.gov+4
5. Narrow federal comparison and published judicial interpretations
5.1 Atomic federal actor claims
Federal verification limitation: the current full body of 15 U.S.C. §1692a could not be retrieved through the two official routes recorded in S023. The comparison below rests on the freshly read CFPB reproduction of current Regulation F and the published judicial opinions actually read. It is not represented as a completed fresh verification of the entire current U.S. Code section.

Federal result and Arizona boundary |
Primary pinpoint; confidence and hold |
| S_AZ-P06-C082 |
Researcher attempts current §1692a verification. |
House U.S. Code route failed; GovInfo alternate failed. Full current statutory-body verification remains held. Quotations in cases do not substitute for opening that full current section. |
S023, both failed routes. Held. |
| S_AZ-P06-C083 |
Regulation F consumer/debt classification. |
Consumer is a natural person, living or deceased; debt must arise from a transaction primarily for personal/family/household purposes, including an obligation reduced to judgment. This is narrower than the general Arizona claim definition. |
S019, §1006.2(e), (h), comment 2(h)-1. H posted text; official-edition limitation. |
| S_AZ-P06-C084 |
Federal collector classification. |
Principal-purpose collection and regular collection of another’s debt are separate prongs; misleading use of another name by an own-debt creditor is included. Security-interest enforcement is additionally covered for the specified §1006.22(e) purpose. |
S019, §1006.2(i)(1), comment 2(i)-1. H; full secured regime deferred. |
| S_AZ-P06-C085 |
Federal creditor classification. |
A creditor includes one extending credit or to whom debt is owed, but excludes receipt of defaulted debt solely to facilitate collection for another. “Creditor” and “debt collector” are not necessarily mutually exclusive categories. |
S019, §1006.2(g); S021, majority pp. 14–16. H. |
| S_AZ-P06-C086 |
Officer/employee collects for creditor in creditor’s name. |
Regulation F supplies that conditional exclusion. It is not an exclusion for every outsourced vendor. |
S019, §1006.2(i)(2)(i). H. |
| S_AZ-P06-C087 |
Related-company collector invokes federal affiliate exclusion. |
It must collect only for related/controlled persons and its principal business must not be debt collection. This differs from Arizona A(14)’s federally insured institution predicate. |
S019, §1006.2(i)(2)(ii)(A)–(B); S001, §32-1004(A)(14). H. |
| S_AZ-P06-C088 |
Government officer/employee collects in official duties. |
The federal exclusion is limited to that official-duty activity. No broad private government-contractor exclusion is inferred. |
S019, §1006.2(i)(2)(iii). H. |
| S_AZ-P06-C089 |
Person serves legal process. |
The exclusion applies while serving/attempting to serve process in judicial enforcement; it does not classify all other collection conduct. |
S019, §1006.2(i)(2)(iv). H. |
| S_AZ-P06-C090 |
Nonprofit provides bona fide consumer credit counseling at consumers’ request and receives/distributes payments. |
Regulation F expressly excludes that specified activity. Nonprofit incorporation alone is insufficient, and this federal exclusion does not supply an Arizona Chapter 9 exemption. |
S019, §1006.2(i)(2)(v); S001, §32-1004. H. |
| S_AZ-P06-C091 |
Person collects another’s debt in a listed special relationship. |
Activity-specific exclusions cover incidental bona fide fiduciary/escrow duties, debt the person originated, debt not in default when obtained, or debt obtained as secured party in the specified commercial-credit transaction. |
S019, §1006.2(i)(2)(vi)(A)–(D). H; relationship/default facts held. |
| S_AZ-P06-C092 |
Special federal coverage exception is asserted. |
Private bad-check programs require compliance with FDCPA §818. Section 1006.1(c) also preserves its §5519(a) and state-exemption qualifications. Those linked special regimes were not fully read; no actor is cleared under them. |
S019, §§1006.2(i)(2)(vii), 1006.1(c), 1006.108. P/Held linked special predicates. |

Henson v. Santander Consumer USA Inc., U.S. Supreme Court, June 12, 2017; unanimous opinion. |
Alleged purchaser collected defaulted automobile debts it owned. In reviewing dismissal, the Court held that the “owed … another” regular-collection prong did not cover the purchaser merely because it acquired debts after default. Judgment affirmed. |
S020, opinion pp. 1–3, 7–8, 11; PDF indices 2–4, 8–9, 12. H holding; no Arizona licensing conclusion. |

McAdory v. M.N.S. & Associates, LLC / DNF Associates, Ninth Circuit, March 9, 2020, published majority. |
Allegations described a business buying defaulted consumer debts and outsourcing collection. The majority held that direct consumer interaction is not required by the principal-purpose prong; the allegations plausibly pleaded collector status. Dismissal reversed and remanded. |
S021, majority pp. 3–17, especially 10–16; PDF indices 2–16. H pleading-stage holding. |
| S_AZ-P06-C096 |
McAdory, issues left for remand. |
Collector classification did not decide all agency/vicarious-liability questions. The majority left the relevant relationship/liability issue for further proceedings. |
S021, pp. 16–17, PDF indices 15–16. H. Judge Bea dissented; the dissent is not the holding. |
| S_AZ-P06-C097 |
Cruz v. Lusk Collection Agency, Arizona Court of Appeals, June 6, 1978, published majority reproduced by CaseMine. |
Consolidated declaratory challenges concerned collection assignments and agency-filed actions through attorneys. On dismissal for failure to state a claim, the court treated a valid assignee as legal owner/real party in interest able to sue in its own name; dismissal affirmed. |
S018, unpaginated opinion paragraphs discussing a valid assignment and statutory collection-agency framework. H reproduced holding; not an unlicensed debt-buyer exemption. |
| S_AZ-P06-C098 |
Cruz and current lawsuit-related rule. |
The arrangement described in Cruz was not treated as unauthorized practice where attorneys handled litigation. Current R1509(E) separately requires the filing attorney to have no personal or financial interest in the collection agency. |
S018, final analysis and affirmance; S007, R20-4-1509(E). H/P; broader modern legal-practice/entity questions deferred. |
| S_AZ-P06-C099 |
Kaiser v. Cascade Capital, Ninth Circuit, March 9, 2021, limited later-treatment read. |
Footnote 7 cites McAdory for the proposition that a creditor can also be a collector and notes that collector status was not contested there. It is later published treatment, not a newly adjudicated actor-status finding in that case. |
S022, p. 9 n.7, PDF index 8. H limited passage; no whole-opinion or citator claim. |
| S_AZ-P06-C100 |
Comparison across the state and federal sources. |
State licensing classification, federal collector coverage, debt validity, and legal collectibility are separate inquiries. Neither a federal exclusion nor an Arizona license resolves the others. |
S001, §§32-1001, 32-1004, 32-1055; S019–S021. I/H reasoned comparison. |
Cruz’s underlying quoted authorities were not newly opened. McAdory’s majority was read; its dissent was not used as the holding. No unpublished memorandum decision is relied upon, so no unpublished-citation exception is claimed. The bounded later-treatment search is not full citator clearance. supremecourt.gov+5

8. Twenty new fictional postures
These are classification illustrations. None is an actual business, license, debtor, account, or authorization decision.
| No. |
Fictional posture |
Conditional result / adverse branch |
Claims |
| 1 |
A furniture merchant collects only receivables it originated, using its true name. |
Distinguish it from collecting another’s claim. The bounded own-creditor inference requires the facts to remain true. |
C001, C006 |
| 2 |
The same merchant sends demands under a name suggesting an unrelated collection company. |
The express own-debt/other-name limb is implicated even though the merchant owns the accounts. |
C004 |
| 3 |
A purchaser buys defaulted consumer accounts for a fully paid price, with passed title and no recourse. |
No blanket Arizona exemption established. Federal analysis separately tests principal purpose and regular collection for another. |
C007, C084, C093–C095 |
| 4 |
A purchase agreement lets the buyer return uncollected accounts to the seller. |
Recourse is expressly material to Arizona’s purchased-claim inclusion; the “sale” label is insufficient. |
C002 |
| 5 |
A contractor services accounts obtained before default and later sends collection demands. |
Nondefault acquisition can matter federally; Arizona has no general equivalent servicer/default exclusion in the read text. |
C005, C033, C091 |
| 6 |
A group company collects only for ordinary retail affiliates, but collection is its principal business. |
Neither Arizona’s insured-depository affiliate predicate nor the federal noncollection-principal-business condition is established. |
C029, C087 |
| 7 |
A sister company collects only for its commonly controlled federally insured bank and the bank’s affiliates. |
A(14) may apply if every institutional, relationship, exclusivity, and regular-course predicate is proved. Retained duties remain. |
C013, C029 |
| 8 |
An individual is a genuine salaried credit employee; another performs identical tasks through a separate contracting business. |
The first may invoke A(2). The independent contractor cannot invoke that exemption merely because compensation is described as salary. |
C015 |
| 9 |
A licensed collection agency uses a genuine employee from a remote residence. |
Employee and remote-work predicates must both be met, including supervision/security/no physical records. This does not license a separate contractor. |
C010, C020 |
| 10 |
An attorney handles collections within legal practice; a separate agency advertises that the attorney owns it. |
Analyze the attorney’s regular-course exemption separately from the company. Ownership does not automatically transmit the exemption. |
C014, C098 |
| 11 |
A medical-billing vendor accepts only current accounts, sends the two permitted creditor-name notices, makes no demand, and never accesses money. |
All A(13)/C conditions must remain satisfied. Receiving insurer payments or accepting already-past-due accounts defeats reliance on that paragraph. |
C027–C028 |
| 12 |
A licensed insurance administrator proposes to collect charges on an account inactive for thirteen months. |
The specific more-than-twelve-month restriction requires a collection-agency license for that collection. |
C031–C032 |
| 13 |
A landlord collects its own rent; a different property service collects for several landlords. |
Own-debt classification differs from collection for others. A licensed real-estate-broker exemption requires actual broker status and regular-course activity. |
C006, C019 |
| 14 |
A lender finances business receivables but also takes consumer receivables and purchases distressed claims primarily to collect them. |
A(12) must be separated transaction by transaction; consumer purpose and collection-primary-purpose branches do not satisfy its stated predicates. |
C026 |
| 15 |
A collector has no Arizona office but directly pursues Arizona residents. |
Physical absence does not establish exemption. The bond statute expressly counts that business; the complete territorial licensing boundary remains held pending authoritative construction and facts. |
C008–C009, C012 |
| 16 |
An out-of-state agency forwards an account to an Arizona-licensed agency and conducts no assumed additional activity. |
Section 32-1055(B)’s forwardee savings clause is relevant; it does not resolve a different direct-contact posture. |
C011 |
| 17 |
A licensee opens another physical office, adds a second trade name, and sells 25% voting control. |
These are three distinct events: branch policy, separate business-name license, and prior written control consent. |
C048, C052–C054 |
| 18 |
An agency’s active manager leaves, and management assumes the agency can continue indefinitely. |
The 10-day notice/90-day replacement conditions and any properly granted provisional route must be examined. |
C049–C050 |
| 19 |
A licensee files renewal late; another timely files a sufficient renewal still pending agency action. |
The first faces the statutory suspension/expiration sequence. The second raises the unresolved §41-1092.11 interaction; neither is cleared from a submission receipt. |
C042–C047 |
| 20 |
A surety gives cancellation notice; a consumer separately alleges loss and demands the full bond amount. |
Replacement must be filed before termination to avoid the stated license consequence. The alleged loss does not establish claimant status, covered injury, or entitlement to the penal sum. |
C068–C081 |
9. Four fully worked conditional models
All amounts below are fictional U.S. dollars. The government figures come from the identified text; private amounts are expressly stipulated. No actual filing, collection, exemption, license, or claim decision follows from the arithmetic.
Model 1 — Initial identified outlay, proration, and denial
Authority: C058–C062, C066, C068; S001 §32-1022; S002 §6-126(A)(15), (B), (D)(3).
Assumptions:
- One original collection-agency license application.
- For arithmetic only, the applicable official procedure is assumed to have established two quarters remaining. This pass did not verify how the current system assigns partial quarters.
- Required bond penal sum has separately been determined, for the hypothetical, as $10,000.
- Private surety premium is stipulated at $240; it is not a verified market quote.
- R = any separately applicable business-entity registration charge, if established.
- S = verified-applicable NMLS/system charges, presently unknown.
- F = verified-applicable fingerprint charges, presently unknown.
Plain-text calculation:
Plain text
Annual statutory amount = $600
Quarter fraction = 2 / 4
Initial prorated annual assessment = $600 × 2 / 4 = $300
Application fee = $1,500
Identified initial state subtotal = $1,500 + $300 = $1,800
Stipulated private premium = $240
Identified cash outlay with that premium = $1,800 + $240 = $2,040
Conditional total = $2,040 + R + S + F
Bond penal sum = $10,000, recorded separately
Units/rounding: dollars; the divisions produce exact whole dollars; no rounding rule is assumed.
Adverse branches:
- If the accepted quarter count is three rather than two: $600 × 3/4 = $450; identified state subtotal becomes $1,950; with the same stipulated premium, $2,190 + R + S + F.
- If the application is denied, the stipulated two-quarter annual assessment refund is $300. The ordinary statutory application-fee rule leaves $1,500 nonrefundable, subject to the separately applicable agency-delay rule if its predicates are actually met. Premium refundability depends on an unread private contract.
- A second business name cannot be treated as merely a free additional office. The separate-license requirement applies; the complete operational invoice treatment remains held.
- Do not add $10,000 to expenses merely because it is the bond’s penal sum. A cash alternative would involve separately restricted cash, not the stipulated $240 surety premium.
- No separate collection-agency “registration fee” beyond the verified application/assessment charges was established. R does not assert that such an extra fee is necessarily owed.
Model 2 — Arizona-connected gross income and a tier boundary
Authority: C009, C067, C109; S001 §32-1021(B)(2), (D).
Assumptions:
- This is an existing licensee’s hypothetical renewal.
- For this model only, the accepted preceding-year reporting window is January 1–December 31, 2025. That calendar-year choice is an assumption, not a verified current L-CAR instruction.
- Each amount below is stipulated to qualify as the licensee’s gross annual income, not client money merely passing through.
- Categories are mutually exclusive, so the same income is not counted twice.
Plain text
Income from Arizona-resident debtors = $120,000
Additional income from Arizona-office activity = $80,000
Additional income for Arizona-resident creditors = $50,000
Qualifying, nonduplicated base = $250,000
Operator = tier lookup
"Not over $250,000" minimum bond = $10,000
Alternative:
Plain text
Additional qualifying income = $1
Revised base = $250,001
"$250,001 to $500,000" minimum bond = $15,000
Increase in required minimum security = $5,000
Units/rounding: dollars; no rounding in either branch.
Adverse branches and holds:
- If a receipt is connected to both an Arizona debtor and an Arizona creditor, that does not justify entering the same income twice.
- Operating expenses are not subtracted merely because the operator would prefer a net-profit base.
- A base of $250,000.50 falls between the literal whole-dollar endpoints printed in the table. No current rounding instruction or authoritative interpretation was verified. Hold that exact tier result.
- The $5,000 increase is an increase in minimum security, not a $5,000 premium or government fee.
- Start-up projections, annualization, and the current reporting form’s accounting treatment remain held.
Model 3 — Collections, agreed client charge, remittance, and remaining loss
Authority: C069, C074, C081; S001 §§32-1022(B), 32-1055(D)(1); S007 R20-4-1518.
Assumptions:
- Gross receipts are $10,000.
- A $500 return/reversal is genuine, documented, and properly credited.
- The client agreement validly permits a stipulated $1,900 agency charge. No debtor charge is added.
- The agency has already remitted $6,000.
Plain text
Gross receipts = $10,000
Less documented return/reversal = $500
Net proceeds available for the stated allocation = $9,500
Less stipulated agreed client collection charge = $1,900
Amount due client = $7,600
Less remittance actually made = $6,000
Unremitted client balance = $1,600
If a further $1,000 is actually recovered and credited:
Plain text
Prior unremitted balance = $1,600
Less later recovery = $1,000
Remaining uncompensated balance = $600
Units/rounding: exact dollars; no percentage or rounding assumption.
Legal conditions and adverse branches:
- The ordinary statutory remittance clock is 30 days after the last day of the collection month. No actual calendar date is assigned here.
- A hypothetical client amount due of $4.50 qualifies for the text’s additional 30-day deferral; $5.00 does not satisfy “less than $5.”
- If the $500 reversal or $1,900 charge lacks a valid basis, it cannot simply be deducted in this model.
- The agency’s license fee, bond premium, or other operating cost cannot be inserted as an additional deduction merely because it exists.
- The $1,600 or $600 balance is not automatically payable by a surety. Covered claimant status, the bond instrument, timely action, prior recoveries, and other defenses remain separate.
- These client receipts are not automatically the gross-income figure used in Model 2.
Model 4 — Conditional cash-deposit claim and proportional allocation
Authority: C073–C080; S007 R20-4-105(B)–(I).
Assumptions, solely to illustrate the rule’s arithmetic:
- Available deposit in place of bond: $10,000.
- A qualifying final judgment awards $5,000 compensatory damages and separately $1,000 attorney fees.
- $1,000 has already been paid toward the judgment and is assumed properly credited against the relevant compensatory recovery.
- Other properly noticed civil actions seek a total of $16,000 compensatory damages against the same depositor.
- The agency has made the required determinations; required documents and notices are timely; execution is not stayed; and the statutory release conditions, including the unresolved timing issue in C073, have been resolved in favor of availability for this hypothetical.
Plain text
Compensatory damages = $5,000
Attorney-fee award counted in R105(F) base = $0
Less prior credited payment = $1,000
Conditional R105(F) award = $4,000
Other noticed compensatory damages sought = $16,000
Denominator = $4,000 + $16,000
= $20,000
Allocation fraction = $4,000 / $20,000
= 0.20
Conditional proportional deposit payment = $10,000 × 0.20
= $2,000
Unpaid portion of this $4,000 award after that payment = $2,000
Units/rounding: dollars and a dimensionless fraction; exact result, no rounding.
Adverse branches:
- A default/stipulated/consent judgment without the required injury showing can fail under R105(E).
- Stayed execution or satisfaction from another source can defeat the claim.
- The denominator uses the rule’s damages sought in other noticed actions, not an invented aggregation of only final judgments.
- The prior $1,000 is deducted once, not again after the proportional calculation.
- This model does not apply to a corporate surety bond and does not establish immediate disbursement under §32-1022(F).

11. Exact P01 deferred-row contribution crosswalk
| Original reviewed item and provenance |
Original disposition preserved |
PASS-06 contribution |
What remains |
| “Full collection, litigation, limitations, debtor-property exemptions, secured debt, sectors, local and tribal law, contract defenses/choice of law, broader case law.” User-supplied coordinator review: [internal evidence reference], 2026-10-23T05:19:34.171103Z; supplied description of the whole-report read and selected checks is provenance, not a fresh opening of that file. |
“Excluded from completion of this pass; all remain open.” Coordinator acceptance supplied as component_partial_not_accepted_remaining_required_work. Original next action: “Separate focused investigations are required. Nothing in this component supplies statewide or A066 acceptance.” |
Fresh collection-agency definitions, conditional exemptions, licensing/security/fee statutes and rules, selected enactments, bounded published interpretations, operational retrieval failures, and conditional models: C001–C110. |
The original row is not duplicated as an accepted item. Operational and interpretive holds in this report remain; all other original categories and the prior-pass review statuses remain unchanged. |
12. Researcher self-check
Actually read: the material Arizona Chapter 9 bodies; the listed necessary cross-references; current posted licensing/security rules; the material 2021, 2022, and 2023 enactments; 2023 and 2025 final-rule provisions; the official branch-policy notice; the relevant regular-session affected-section tables; the CFPB actor-definition bodies; the full Henson opinion; the full McAdory majority; the reproduced Cruz majority; the limited Kaiser later-treatment passage; and the official fifteen-county inventory.
Not read or not established: the current full §1692a body through an official codification route; a successfully retrieved official eCFR body; current full DIFI/NMLS application and renewal instructions; a working live lookup workflow; the current prescribed bond instrument; L-CAR reporting instructions; the full branch bulletin; the exact renewal late fee, actual examination rate, and system checkout extras; comprehensive later judicial treatment; local or tribal practice; and any real entity/account/claim facts.
Specific interpretive holds preserved: fully paid nonrecourse debt-buyer classification under Arizona’s full definition; the outer remote-activity licensing boundary; A(8)’s unusual substation wording; the residual §32-1004(D) paragraph-7 reference; timely pending renewal versus automatic suspension; the January 31 wording difference; reporting-period/start-up/cents treatment; and the statutory principal-release restriction’s interaction with the deposit-payment rule.
No unavailable body is treated as proof of absence or permission. No unpublished opinion, marketing statement, search snippet, staff case summary, or unreviewed earlier pass is used as a controlling holding. No actual provider was queried or cleared, no application or claim was filed, and no publication or local-file write is claimed.
This is a researcher self-check, not an independent review, an all-source/current-law certificate, or Arizona/parent-component acceptance.
