SettleADebt — S_AZ PASS-08
Arizona credit-services and credit-repair classification, contracts, cancellation, security, and limited remedies
This pass establishes the rules in the primary bodies actually read and preserves specific application and currentness holds. It does not establish that an actual business is exempt, authorized, entitled to a fee, or liable for a particular refund or award.
The main findings are:
- Arizona’s credit-services definition reaches more than conventional credit repair. It includes compensated assistance obtaining credit from others, and “credit” includes a right to defer payment. That makes some forbearance arrangements relevant to classification, but I did not locate a responsive published Arizona holding deciding that a payment concession, by itself, constitutes “obtaining” credit. Principal reduction alone is not automatically a grant of deferred-payment rights. C001–C007.
- Arizona’s bond-conditioned advance-payment provision and the federal prohibitions must be tested separately. A compliant Arizona bond can satisfy the exception in A.R.S. § 44-1703(1); it does not override CROA or the TSR, establish completion, or turn customer money into earned fees. C016, C020–C027, C052, C068–C074.
- The cancellation language is not uniform. Arizona uses “third day” and a refund obligation measured from receipt of cancellation. CROA’s operative cancellation right uses “third business day,” while its prescribed detachable notice says “3rd day.” That federal discrepancy appears in the original enactment as well as the codification. I have preserved it instead of manufacturing one combined deadline. C035–C037, C056–C058, C084, C086–C087.
- For covered credit-repair telemarketing, two separate conditions must precede requesting or receiving payment: expiration of the represented performance timeframe, and provision of a qualifying consumer report issued more than six months after the promised results were achieved. Neither condition must occur first relative to the other. An early-issued report does not become qualifying merely by aging. C068–C071.
- The currentness evidence has limits. The complete readable OLRC CROA bodies displayed currency through October 7, 2026. A newer October 20 release was only partially recovered. The eCFR displayed Title 16 currency through October 23, 2026. Arizona’s posted statutes were checked against relevant 2023–2026 affected-statute tables, but the original 1988 Arizona enactment and a complete earlier amendment chain were not recovered. C081–C085.

| Actual research access |
October 27, 2026, Pacific, later than the baseline. |
| Clock information |
A research-session clock was logged at 12:34:27 UTC, equivalent to 05:34:27 Pacific; a later clock read was 13:03:43 UTC, equivalent to 06:03:43 Pacific. These are session observations, not timestamps for individual source openings. |
| Individual source-opening times |
Unknown unless expressly stated otherwise. Publication dates, source currency, and this report’s completion are not substituted for opening times. |
| Method |
Public search and actual webpage/PDF-body retrieval in this conversation. PDF reading was of returned paginated text; no assertion of visual authentication of signatures or seals. |
| Earlier-pass reliance |
No legal conclusion in this pass rests on unreviewed P03–P07. P02 licensing renewal/proration supplies no premise here. The P01 review descriptions are user-supplied provenance, not a newly opened coordinator file. |
| Actions |
No private records, actual credit reports, entity-status searches, applications, submissions, contacts, accounts, purchases, website changes, publication, new chats, or subagents were used for this pass. |
| Identifier convention |
Full source IDs are S_AZ-P08-S001–S034. Full claim IDs are S_AZ-P08-C001–C089. Short references such as “S001” and “C016” below mean those PASS-08 IDs only. |
| Confidence convention |
High-text means the stated proposition is supported by the body read, subject to that source’s version limits. Conditional means factual predicates remain unproved. Held means identified evidence or construction is missing. These labels do not constitute acceptance of the component. |
2. Substantive findings and atomic claim/evidence tables
2.1 Arizona classification and exclusions
The state inquiry starts with the actual services, consideration, credit purpose, and actor—not the company’s label. A credit-improvement representation can independently matter even if a program is described as education, monitoring, negotiations, or referrals. Conversely, a service does not become credit repair merely because it concerns someone who has debt.
The particularly unresolved boundary is a new payment concession. Arizona’s definition expressly includes a right to defer payment; that supports examining whether an arrangement creates such a right. It does not answer, without more, whether a particular negotiator has obtained an extension of credit, whether an existing right merely continued, or whether a principal reduction without new deferral falls within that branch.

Actor and predicate |
Rule, consequence, or hold |
Primary evidence and limits |
| S_AZ-P08-C001 |
Person solicited to purchase or purchasing covered services |
Arizona’s “buyer” is a natural person. Entity purchasers do not satisfy that definition merely because an owner is an individual. |
S001, A.R.S. § 44-1701(1), https://www.azleg.gov/ars/44/01701.htm. High-text; actual buyer identity held. |
| S_AZ-P08-C002 |
Person acting for money or other valuable consideration, concerning credit extended by others |
CSO coverage includes selling, providing, performing, or representing an ability to improve a buyer’s credit record/history/rating, obtain credit, or provide related advice or assistance. |
S001, § 44-1701(2)(a)–(c), https://www.azleg.gov/ars/44/01701.htm. High-text; consideration and representations are factual predicates. |
| S_AZ-P08-C003 |
Credit arrangement primarily for personal, family, or household purposes |
“Extension of credit” includes a right to defer debt payment or incur debt and defer payment. The Arizona definition contains a consumer-purpose limitation. |
S001, § 44-1701(3), https://www.azleg.gov/ars/44/01701.htm. High-text; mixed-purpose classification held. |
| S_AZ-P08-C004 |
Negotiator obtaining forbearance, a new payment schedule, or principal reduction |
A newly granted deferral right is textually relevant. Whether a concession alone is “obtaining” credit remains unresolved; no responsive published Arizona construction was located in the bounded search. Principal reduction alone does not establish a deferral right. |
S001, § 44-1701(2)(b), (3), same URL. Inference from text, not a judicial holding or actual classification. |
| S_AZ-P08-C005 |
Monitoring, education, “free” repair, referrals, or separately priced mixed services |
Labels and invoice separation do not displace the statutory predicates. Whether indirect consideration or an integrated package supplies those predicates requires actual facts; no assurance follows from charging through an affiliate or separating prices. |
S001, § 44-1701(2), same URL; S030, Stout, pp. 12–18, https://cdn.ca9.uscourts.gov/datastore/opinions/2014/02/21/10-56887.pdf. Conditional; Stout construes federal CROA. |
| S_AZ-P08-C006 |
Arizona-based conduct directed to nonresident buyers |
Sgrillo rejected nonresident-buyer immunity for the Arizona conduct before it. That decision supports the outbound Arizona situation it decided. |
S015, 176 Ariz. 148, 149, https://law.justia.com/cases/arizona/court-of-appeals/1993/176-ariz-148.html. Published majority reproduced by Justia; classification was conceded in the posture described below. |
| S_AZ-P08-C007 |
Remote seller outside Arizona contacting an Arizona buyer |
Section 44-1701 supplies no express residence-based safe harbor. Sgrillo does not itself decide the reverse, remote-to-Arizona situation. Territorial jurisdiction, choice of law, and particular contacts remain held. |
S001, § 44-1701; S015, p. 149, URLs in C001/C006. Text plus bounded holding; no universal nexus conclusion. |
| S_AZ-P08-C008 |
Lender or credit extender invoking § 44-1702(1) |
The person must have the specified Arizona/federal organization, charter, license, or authorization to lend/extend credit and be subject to Arizona/federal official regulation and supervision. A lending label alone is insufficient. |
S001, § 44-1702(1), https://www.azleg.gov/ars/44/01702.htm. High-text; actual credentials held. |
| S_AZ-P08-C009 |
Bank or savings-and-loan institution |
The state exclusion concerns an institution whose deposits/accounts are eligible for FDIC or the text’s historical FSLIC insurance. The obsolete institutional name is preserved as written, not silently modernized. |
S001, § 44-1702(2), same URL. High-text; institutional and insurance predicates held. |
| S_AZ-P08-C010 |
Arizona real-estate broker |
Exclusion applies while acting within the course and scope of the Arizona broker license. |
S001, § 44-1702(3), same URL. High-text; no blanket exclusion for an affiliated repair business. |
| S_AZ-P08-C011 |
Arizona-licensed attorney |
Exclusion applies to services within the course and scope of the attorney’s practice. Attorney ownership, referral, or connection alone does not prove that predicate. |
S001, § 44-1702(4), same URL. High-text; federal treatment differs, C048. |
| S_AZ-P08-C012 |
SEC- or CFTC-registered broker-dealer |
Exclusion requires acting within the course and scope of that regulation. |
S001, § 44-1702(5), same URL. High-text; actual registration/scope not queried. |
| S_AZ-P08-C013 |
Nonprofit invoking the Arizona exclusion |
The organization must be nonprofit and exempt under IRC § 501(c)(3). Incorporation as nonprofit or § 501(c)(4) status is not the specified predicate. |
S001, § 44-1702(6), same URL; S019, § 501(c)(3), (q), https://uscode.house.gov/us/usc/119-118/t26/s501/. Conditional tax-status inquiry. |
| S_AZ-P08-C014 |
Employee, affiliate, ordinary creditor, or agent |
The six listed state exclusions do not contain separate blanket employee, affiliate, or ordinary-own-creditor exemptions. An own-creditor transaction may instead fail the “credit by others” definition; that is a different analysis. |
S001, §§ 44-1701(2), 44-1702, https://www.azleg.gov/ars/44/01701.htm, https://www.azleg.gov/ars/44/01702.htm. Bounded textual conclusion. |
| S_AZ-P08-C015 |
Person asserting an Arizona article exemption |
The exemption claimant bears the burden of proving it. |
S001, § 44-1709(B), https://www.azleg.gov/ars/44/01709.htm. High-text. |
All six state exclusions were read in the operative body. None supplies a general federal exemption. Exemptions+3
2.2 Arizona payment restrictions, security, and public procedure
A bond is a conditional security requirement under this article, not a substitute for a license under another regime and not a customer trust account. The statutory bond base is fees charged under contracts entered during the preceding twelve months. It is not simply cash received, retained revenue, savings, or balances of debts being negotiated.

| S_AZ-P08-C016 |
CSO and its salespersons, agents, or representatives selling or attempting to sell services |
No charge or receipt of consideration before full and complete performance of all agreed services, unless the CSO has the required compliant surety bond. A bonded CSO’s individual salespersons/agents/representatives need not separately obtain that bond. |
S001, § 44-1703(1), https://www.azleg.gov/ars/44/01703.htm. State provision only; federal restrictions independently apply. |
| S_AZ-P08-C017 |
CSO charging solely for a referral |
A fee solely for referring a buyer to a retail seller offering credit on substantially the same terms available to the general public is prohibited. |
S001, § 44-1703(2), same URL. Does not authorize other referral arrangements. |
| S_AZ-P08-C018 |
CSO or covered representative making or counseling credit statements |
False or misleading credit statements to a CRA or existing/prospective creditor are prohibited where the actor knows or should know their falsity or misleading character. |
S001, § 44-1703(3), same URL. No “accurate information deletion” permission inferred. |
| S_AZ-P08-C019 |
Seller offering or selling CSO services |
Misleading service representations and fraudulent or deceptive acts or practices are prohibited. |
S001, § 44-1703(4), same URL. A contract disclaimer does not itself resolve a contrary sales representation. |
| S_AZ-P08-C020 |
CSO relying on the advance-payment bond condition |
The issuer must be a surety authorized to do business in Arizona; a copy of the required bond must be filed with the Corporation Commission. Filing a copy does not establish substantive compliance or an authorization grant. |
S001, §§ 44-1703(1), 44-1708(A)(1), https://www.azleg.gov/ars/44/01703.htm, https://www.azleg.gov/ars/44/01708.htm. Actual issuer status and instrument held. |
| S_AZ-P08-C021 |
Bond-required CSO |
Required face amount: B = min($25,000, max($5,000, 0.05 × F)), where F is the statutory preceding-twelve-month fees-charged measure. |
S001, § 44-1708(C), same bond URL. No CPI adjustment or refund-netting rule appears in this provision. |
| S_AZ-P08-C022 |
Bond-required CSO at annual adjustment |
Adjust the required amount once yearly, no later than the tenth day of the first month of its fiscal year. |
S001, § 44-1708(C), final paragraph, same URL. Actual fiscal year and measurement records held. |
| S_AZ-P08-C023 |
Person damaged by an article violation |
Bond runs in favor of the state for damaged persons and in favor of damaged persons; a claimant may bring an action at law against the CSO and surety. |
S001, § 44-1708(A)(2)–(3), same URL. This is not an automatic administrative payout. |
| S_AZ-P08-C024 |
Surety facing valid covered claims |
Surety liability is for actual damages, not § 44-1711 punitive damages, and aggregate liability to all damaged persons cannot exceed the bond amount. |
S001, § 44-1708(B), same URL. Coverage, remaining capacity, priority, defenses, and actual loss require evidence. |
| S_AZ-P08-C025 |
Person assessing the CSO article as a market-access system |
The read Article 7 does not establish a separate general CSO license or a trust-account alternative to its bond condition. That bounded finding is not a conclusion that no other law or rule can apply. |
S001, §§ 44-1701–1712; S010 partial rule inventory, https://apps.azsos.gov/public_services/Title_14/14-01.pdf. Broader rule/authorization inventory held. |

Person needing a current approved bond instrument or cancellation/claim rider |
Generic ACC form lists and a generic cover sheet were read; no current CSO-specific approved blank bond, cancellation rider, or claim form was authenticated. Those documents and their operative versions remain held. |

| S_AZ-P08-C028 |
CSO approaching contract execution or payment |
Give the required written information statement before execution or receipt of consideration, whichever occurs first. |
S001, § 44-1704(A), https://www.azleg.gov/ars/44/01704.htm. High-text. |
| S_AZ-P08-C029 |
CSO preparing that statement |
Include accurate file/dispute rights, approximate CRA file-copy charge, complete services, total payment/obligation, and, where a bond is required, bond rights and surety name/address. |
S001, § 44-1705(1)–(4), https://www.azleg.gov/ars/44/01705.htm. Linked Arizona reporting provisions were read. |
| S_AZ-P08-C030 |
Consumer exercising the incorporated Arizona reporting rights |
Section 44-1693 addresses identification, file/source/requestor access, assistance, and specified free-copy circumstances; § 44-1694 provides written-error investigation and correction rights. Its § 44-1694(D)(2) dispute statement is without charge. |
S001, §§ 44-1693(A)–(D), 44-1694(A)–(D), https://www.azleg.gov/ars/44/01693.htm, https://www.azleg.gov/ars/44/01694.htm. This is not a complete FCRA analysis. |
| S_AZ-P08-C031 |
CSO retaining acknowledgment |
Retain an exact copy of the information statement personally signed by the buyer acknowledging receipt, in file or microfilm, for two years. |
S001, § 44-1704(B), https://www.azleg.gov/ars/44/01704.htm. The state sentence does not expressly specify the starting event as the federal provision does. |
| S_AZ-P08-C032 |
CSO entering a buyer contract |
Contract must be written, dated, buyer-signed; state payments to the CSO or others; fully describe services, guarantees and refund promises; give estimated completion date/duration, principal address, and process-agent name/address. |
S001, § 44-1706(A)(2)–(4), https://www.azleg.gov/ars/44/01706.htm. A promise is not proof of performance. |
| S_AZ-P08-C033 |
CSO presenting the signature page |
Place the prescribed conspicuous cancellation statement in at least ten-point type, immediately near the buyer’s signature space. |
S001, § 44-1706(A)(1), same URL. No federal ten-point requirement is inferred from this state provision. |
| S_AZ-P08-C034 |
CSO providing cancellation documents and copies |
Attach an easily detachable, completed cancellation notice in duplicate, at least ten-point type and in the contract’s language. Give the completed contract and required signed documents when signed. |
S001, § 44-1706(B)–(C), same URL. Actual language, placement, completion, and delivery held. |
| S_AZ-P08-C035 |
Buyer invoking Arizona ordinary cancellation |
Signature-adjacent text refers to midnight of the third day after the transaction date; the attached notice refers to three days from contract signing. Neither says “business” days. |
S001, § 44-1706(A)(1), (B), same URL. Different transaction/signing dates and endpoint harmonization remain unresolved. |
| S_AZ-P08-C036 |
CSO receiving a qualifying cancellation notice |
Required notice states that any payment under the contract will be returned within 15 days after the CSO receives cancellation. |
S001, § 44-1706(B), same URL. This is a receipt-triggered state refund provision, not a general federal fifteen-day rule. |
| S_AZ-P08-C037 |
Buyer using the prescribed cancellation route |
Notice provides for mailing or delivering a signed, dated notice, or other written notice, to the CSO’s address before the specified date/time. Sending and receipt are separate events; electronic substitution and disputed endpoint cases remain held. |
S001, § 44-1706(B), same URL. No invented requirement that mailing and receipt occur simultaneously. |
| S_AZ-P08-C038 |
CSO breaching an obligation or contract |
Breach of a contract or obligation under the article is itself an article violation. |
S001, § 44-1707, https://www.azleg.gov/ars/44/01707.htm. Remedy still depends on its separate predicates. |
| S_AZ-P08-C039 |
Person obtaining a buyer waiver |
Waiver is void; attempting to obtain it violates the article. |
S001, § 44-1709(A), https://www.azleg.gov/ars/44/01709.htm. Do not confuse this with a universal arbitration prohibition. |
| S_AZ-P08-C040 |
Buyer injured by a violation or contract breach |
Buyer may sue; actual damages have a floor of the amount paid the CSO, with reasonable attorney fees/costs, and punitive damages if the court considers them proper. |
S001, § 44-1711, https://www.azleg.gov/ars/44/01711.htm. Injury, liability, proof, and judicial determination are necessary; no automatic award. |
| S_AZ-P08-C041 |
Violator or public enforcer |
Specified violations of §§ 44-1703–1706 and 44-1709(A) are class 1 misdemeanors; superior-court injunctive authority and AG/county/city enforcement are specified. Mere seller contract breach is expressly outside that misdemeanor provision. |
S001, § 44-1710(A)–(E), https://www.azleg.gov/ars/44/01710.htm. Full criminal/enforcement procedure deferred. |
| S_AZ-P08-C042 |
AG pursuing independently established consumer fraud |
A willful § 44-1522 violation can support a court-imposed civil penalty of up to $10,000 per violation for the state. A CSO violation is not automatically every required CFA predicate. |
S001, §§ 44-1521, 44-1522(A), 44-1531(A)–(B), https://www.azleg.gov/ars/44/01521.htm, https://www.azleg.gov/ars/44/01522.htm, https://www.azleg.gov/ars/44/01531.htm. No consumer entitlement to that public penalty. |
Arizona preserves other-law compliance and nonexclusive remedies in § 44-1712, https://www.azleg.gov/ars/44/01712.htm. That does not establish duplicate recovery for the same loss. azleg.gov+6
2.4 Federal CROA classification and incorporated exclusions
Arizona and CROA both use § 501(c)(3) for their nonprofit exclusions. Their other exclusions differ materially: Arizona lists an in-scope Arizona attorney and real-estate broker; CROA does not. CROA expressly addresses a qualifying creditor restructuring its own debt and specified institutional affiliates; the Arizona list is not identical.

Person using interstate instrumentalities or mails, for money/valuable consideration, with an express or implied credit-improvement purpose |
CROA includes providing or representing credit-record/history/rating improvement, or advice/assistance about it. A consumer is an individual. |
S016, 15 U.S.C. § 1679a(1), (3)(A), https://uscode.house.gov/us/usc/119-118/t15/s1679a/. Read body currency October 7. |
| S_AZ-P08-C044 |
Individual or mixed/business-purpose arrangement |
Section 1679a(2) defines consumer credit transactions as PFH; § 1679a(3)’s organization definition does not expressly use that defined phrase. Do not automatically import Arizona’s purpose limitation into every CROA case. Its printed § 1602(e) credit reference was redesignated § 1602(f), as the OLRC note explains. |
S016, § 1679a(2)–(4), editorial reference note; S020, § 1602(f), https://uscode.house.gov/us/usc/119-118/t15/s1602/. Mixed-purpose application held. |
| S_AZ-P08-C045 |
Nonprofit claiming CROA exclusion |
Must be nonprofit and tax-exempt under § 501(c)(3). A nonprofit label or § 501(c)(4) alone does not meet this wording. |
S016, § 1679a(3)(B)(i), definition URL above; S019, § 501(c)(3), (q). Actual status held. |
| S_AZ-P08-C046 |
Creditor restructuring a consumer’s debt |
Exclusion is limited to a creditor within § 1602’s definition, to the extent it assists restructuring debt owed by that consumer to that creditor. Not every assignee or unrelated repair vendor satisfies that test. |
S016, § 1679a(3)(B)(ii); S020, § 1602(g), URLs above. Regular-credit/initial-payee and special statutory branches require facts. |
| S_AZ-P08-C047 |
Depository institution, federal/state credit union, affiliate or subsidiary |
CROA excludes the specified institutions and their affiliates/subsidiaries. The incorporated bank/CU definitions were read to the extent identified in S021–S022; actual charter, control, and affiliate construction remain held. |
S016, § 1679a(3)(B)(iii); S021, https://uscode.house.gov/us/usc/119-118/t12/s1813/; S022, § 101, pp. 1–2, https://www.govinfo.gov/content/pkg/COMPS-264/pdf/COMPS-264.pdf. |
| S_AZ-P08-C048 |
Attorney, employee, or professional invoking an Arizona exclusion |
CROA supplies no general attorney or employee exclusion in § 1679a(3)(B). An Arizona professional exclusion therefore does not end the federal inquiry. |
S016, § 1679a(3)(B); S031, Gill, Discussion A, https://law.justia.com/cases/federal/appellate-courts/F3/265/944/632739/. |
| S_AZ-P08-C049 |
Organization whose substantial purpose includes credit counseling and which relies on qualifying tax exemption |
Section 501(q) requires tailored counseling, restricts lending/loan negotiation, permits repair only incidentally, prohibits a separately stated repair fee, and imposes inability-to-pay/fee-policy conditions. |
S019, § 501(q)(1)(A)–(C), (4), https://uscode.house.gov/us/usc/119-118/t26/s501/. These are tax-status conditions, not a new repair fee authorization. |
| S_AZ-P08-C050 |
Same organization |
Additional conditions include public-interest board control; specified 20%/49% voting limits; a 35% ownership restriction in listed nonexempt businesses; referral-compensation restrictions; and, for § 501(c)(3), contribution-solicitation restrictions and generally a 50% creditor-DMP revenue ceiling. Historical 80/70/60% transitions are not current general ceilings. |
S019, § 501(q)(1)(D)–(F), (2)–(3), same URL. Exact exceptions in the read clauses matter; no actual tax-status decision. |
The institutional exemption text does not require every depository institution to satisfy a universal FDIC-insured condition; that would improperly replace the incorporated definition. Conversely, an unaffiliated contractor does not inherit the institution’s exclusion by describing itself as its service provider. uscode.house.gov+4

Person engaging in the conduct specified by CROA |
Section 1679b(a) prohibits specified false credit statements, identity alteration to conceal accurate nonobsolete adverse information, service misrepresentations, and fraud/deception. Its opening formulation is “No person,” not simply a state-license rule. |
S016, § 1679b(a)(1)–(4), https://uscode.house.gov/us/usc/119-118/t15/s1679b/. Actual reporting/identity facts held. |
| S_AZ-P08-C052 |
Covered CRO charging for an agreed service |
It may not charge or receive consideration for an agreed service before that service is fully performed. CROA contains no Arizona-bond exception. |
S016, § 1679b(b), same URL; S031, Gill, Discussion A. Artificially calling initial work a completed package does not establish completion of all promises. |
| S_AZ-P08-C053 |
CRO before entering a consumer contract |
Give the prescribed written consumer-rights statement before the contract, in a document separate from other written material. It covers reporting/dispute rights, limits on removing accurate adverse information, cancellation, and legal rights. |
S016, § 1679c(a)–(b), https://uscode.house.gov/us/usc/119-118/t15/s1679c/. The notice is not an exhaustive modern FCRA treatise. |
| S_AZ-P08-C054 |
CRO retaining receipt evidence |
Retain the consumer-signed acknowledgment for two years from signature. |
S016, § 1679c(c), same URL. Distinct from other record-retention duties. |
| S_AZ-P08-C055 |
CRO entering a services agreement |
Written, dated, consumer-signed contract must contain total payments to it/others, detailed services, guarantees, estimated completion date/duration, name/address, and the prescribed bold signature-adjacent cancellation statement. |
S016, § 1679d(a)(1), (b), https://uscode.house.gov/us/usc/119-118/t15/s1679d/. Completion is not established by the estimate. |
| S_AZ-P08-C056 |
CRO starting services |
No services before the end of the three-business-day period beginning on the contract-signing date. This is separately worded from the cancellation right’s “begins after” formulation. |
S016, § 1679d(a)(2), same URL. Exact boundary-day harmonization held; models avoid it. |
| S_AZ-P08-C057 |
Consumer cancelling covered agreement |
Operative right permits cancellation without penalty/obligation before midnight of the third business day beginning after execution or the date it otherwise would become enforceable. |
S016, § 1679e(a), https://uscode.house.gov/us/usc/119-118/t15/s1679e/. No imported other-statute business-day definition. |
| S_AZ-P08-C058 |
CRO delivering cancellation form and signed documents |
Duplicate bold cancellation form uses “3rd day”, omitting “business”; it specifies mail/delivery of signed, dated written notice. Completed contract, disclosure, and other required signed documents are supplied when signed. |
S016, § 1679e(b)–(c), same URL; S018, original § 407, 110 Stat. 3009-459, PDF index 459. Discrepancy remains explicit; no general fifteen-day federal refund clock was found here. |
| S_AZ-P08-C059 |
Person obtaining a CROA waiver |
Waiver is void and unenforceable; attempting to obtain it violates CROA. |
S016, § 1679f(a)–(b), https://uscode.house.gov/us/usc/119-118/t15/s1679f/. Arbitration distinction in C079. |
| S_AZ-P08-C060 |
Noncompliant services contract |
Contract failing applicable CROA provisions is void and may not be enforced by federal/state courts or another person. |
S016, § 1679f(c), same URL. Actual defect and applicable provisions must be established. |
| S_AZ-P08-C061 |
Person with a successful CROA liability claim |
Statutory damages measure is the greater of actual damage or amount paid to the CRO; punitive damages are discretionary, with reasonable fees/costs for successful enforcement. |
S016, § 1679g(a)–(b), https://uscode.house.gov/us/usc/119-118/t15/s1679g/. Not an automatic payment or an instruction to add both alternatives. |
| S_AZ-P08-C062 |
FTC or authorized state enforcer |
CROA specifies FTC enforcement, including its special jurisdiction provision, and state enforcement subject to statutory notice/intervention and parallel-action restrictions. |
S016, § 1679h(a)–(c), https://uscode.house.gov/us/usc/119-118/t15/s1679h/. Full remedial procedure and available monetary mechanisms deferred. |
| S_AZ-P08-C063 |
Actor subject to both state and federal law |
CROA preserves state law except to the extent of inconsistency. An Arizona bond condition cannot remove an applicable federal prohibition. |
S016, § 1679j, https://uscode.house.gov/us/usc/119-118/t15/s1679j/; newer body also read at https://uscode.house.gov/us/usc/119-134/t15/s1679j/. |
The original federal enactment confirms that the cancellation wording discrepancy is not merely a recent website transcription issue. The statutory service-start restriction, cancellation right, required notice, payment restriction, and state refund duty remain separate tests. uscode.house.gov+6

Actor and predicate |
Rule or consequence |
Primary evidence and limits |
| S_AZ-P08-C064 |
Seller/telemarketer in a plan, program, or campaign inducing purchases by telephone |
The definition requires a campaign involving more than one interstate telephone call. The count concerns the campaign, not a requirement that each consumer receive multiple calls. Seller, telemarketer, customer, credit, and upsell definitions matter separately. |
S025, 16 C.F.R. §§ 310.1, 310.2(j), (n), (ee), (hh)–(jj), https://www.ecfr.gov/current/title-16/chapter-I/subchapter-C/part-310. |
| S_AZ-P08-C065 |
Institution, nonprofit, or contractor invoking a TSR jurisdiction exemption |
FTC Act jurisdiction and statutory sector exceptions must be tested; a tax label is not the complete analysis. A for-profit telemarketer does not automatically inherit a bank/nonprofit client’s exclusion. |
S024, 15 U.S.C. §§ 44, 45(a)(2), 6102(d)–(e), 6105, https://uscode.house.gov/us/usc/119-118/t15/s6105/; S029, https://www.ftc.gov/business-guidance/resources/complying-telemarketing-sales-rule. Deeper sector crossreferences held. |
| S_AZ-P08-C066 |
Consumer calling in response to advertising/direct mail |
Credit-repair calls described in § 310.4(a)(2) are excluded from the ordinary general-advertising and qualifying-direct-mail inbound exemptions. Truly unsolicited calls under § 310.6(b)(4) are a different branch; upsells are separately treated. |
S025, § 310.6(b)(4)–(6), same eCFR URL; S028, 89 FR 99075, PDF index 6, https://www.govinfo.gov/content/pkg/FR-2024-12-10/pdf/2024-28399.pdf. |
| S_AZ-P08-C067 |
Seller claiming face-to-face exemption |
The specified exemption requires sale and payment/authorization only after the qualifying face-to-face presentation. It preserves enumerated provisions; it is not blanket immunity for any business that sometimes meets customers. |
S025, § 310.6(b)(3), same eCFR URL. Actual sequence and presentation held. |
| S_AZ-P08-C068 |
Covered seller/telemarketer promising credit-history/record/rating improvement |
No request or receipt of payment until both represented performance time has expired and the required CRA report demonstrating promised results has been provided. |
S025, § 310.4(a)(2)(i)–(ii), same URL; S026, 60 FR 43853–43854 and 43866, https://www.govinfo.gov/content/pkg/FR-1995-08-23/pdf/95-20655.pdf. |
| S_AZ-P08-C069 |
Same seller relying on a results report |
Report must have been issued more than six months after results were achieved. Report provision and timeframe expiry each precede payment; the rule prescribes no order between those two events. Six months is not rewritten as 180 days. Holding an early-issued report does not cure its issuance date. |
S025, § 310.4(a)(2)(ii); S026, 60 FR 43853–43854, URLs above. High-text plus direct temporal application. |
| S_AZ-P08-C070 |
Seller making inconsistent oral/written timeframe representations |
The final-rule explanation uses the longest represented timeframe where representations differ. |
S026, 60 FR 43853 n.117, PDF index 11, original-rule URL above; S029, credit-repair discussion. Final agency explanation, not a newly invented averaging rule. |
| S_AZ-P08-C071 |
Seller obtaining/providing the required report |
It must be a CRA consumer report demonstrating promised results; the rule preserves permissible-purpose requirements. Written consumer instructions are one statutory permissible-purpose route, with further FCRA requirements still applicable. |
S025, § 310.4(a)(2)(ii); S023, 15 U.S.C. §§ 1681a(d), (f), 1681b(a)(2), (f), https://uscode.house.gov/us/usc/119-118/t15/s1681a/, https://uscode.house.gov/us/usc/119-118/t15/s1681b/. Section 1681e’s full body not read. |
| S_AZ-P08-C072 |
Telemarketer guaranteeing/highly assuring a loan or credit extension |
The distinct advance-fee loan restriction requires the customer first to obtain the represented loan/extension. It is not a substitute for the credit-repair test if both apply. |
S025, § 310.4(a)(4), eCFR URL above. Coverage and representations conditional. |
| S_AZ-P08-C073 |
Mixed repair/debt-relief program |
The debt-relief account/payment provision in § 310.4(a)(5) does not supply an account or fee exception to § 310.4(a)(2)’s credit-repair prohibition. |
S025, §§ 310.2(o), 310.4(a)(2), (5), same URL. Debt-relief body read for this distinction; full debt-relief regime deferred. |
| S_AZ-P08-C074 |
Attorney invoking an exception in another paragraph |
Section 310.4(a)(3)’s attorney provision concerns specified recovery services; it is not a general attorney exception to credit-repair paragraph (a)(2). |
S025, § 310.4(a)(2)–(3), same URL. No professional-label shortcut. |
| S_AZ-P08-C075 |
Covered seller before consent to pay |
Truthfully disclose material costs, restrictions and applicable refund/cancellation terms; do not misrepresent service efficacy, refund terms, costs or affiliation. A stated “no refund” policy cannot negate another applicable statutory cancellation right. |
S025, § 310.3(a)(1)(i)–(iii), (2)(i)–(iv), (vii), same URL. Other payment/marketing laws remain separate. |
| S_AZ-P08-C076 |
Covered seller/telemarketer keeping specified records |
Current § 310.5 uses five-year retention for the specified records, with particular triggers, including last use for advertising/scripts. It is not a universal statement that every document has the same starting date. |
S025, § 310.5(a)–(g); S027, 89 FR 26783–26786, https://www.govinfo.gov/content/pkg/FR-2024-04-16/pdf/2024-07180.pdf. |

CROA claimant opposing arbitration solely through CROA’s right-to-sue/nonwaiver language |
CompuCredit held those provisions do not categorically bar arbitration under the FAA. The Court did not decide the defendants’ CRO status in that case. |

Arizona credit-card-information business; cross-motions for summary judgment. The opinion describes the CSO violation as conceded except for the nonresident-buyer argument. |
At p. 149, rejected the claimed immunity for Arizona conduct affecting nonresident purchasers; affirmed the CSO portion and reversed/remanded the relevant CFA partial-summary-judgment disposition. |
Does not decide that every concession is credit, or reverse-direction remote nexus. Complete majority read from Justia reproduction; official-body discovery did not succeed. |
| Stout v. FreeScore, No. 10-56887, Ninth Circuit, February 21, 2014 — S030 |

Slip pp. 12–18, PDF indices 11–17: express/implied improvement representations supported CROA classification despite a disclaimer. Pp. 18–19: reversed and remanded; remaining allegations left to the district court. |
All 19 official PDF pages read. Does not hold all neutral monitoring is repair or finally establish every violation. |
| FTC v. Gill, 265 F.3d 944 (9th Cir. 2001), September 12, 2001 — S031 |
FTC summary judgment concerning a repair operation, attorney participation, advertising, agents, and deposits after preliminary work. |
Discussion A, especially the final paragraphs addressing advance fees: preliminary work did not complete promised services; affirmed liability findings. |
Complete majority read from Justia reproduction. Internal reporter page breaks are absent, so none are invented. AMG materially limits reliance on its older § 13(b) monetary-remedy reasoning. |
| CompuCredit Corp. v. Greenwood, 565 U.S. 95 (2012), January 10, 2012 — S032 |
CROA allegations involving a credit-card program; denial of arbitration, affirmed below. |
Pp. 100–105: CROA does not preclude FAA enforcement of the arbitration agreement on the asserted statutory ground; reversed/remanded. P. 98 n.1: actor classification not decided. |
Majority pp. 96–105 fully read. Separate concurrence/dissent not fully read and not used as holdings. No actual arbitration-clause decision here. |
| AMG Capital Management, LLC v. FTC, April 22, 2021 — S033 |
FTC deceptive-lending enforcement; § 13(b) monetary relief affirmed by Ninth Circuit. |
Unanimous majority, slip pp. 6–10: § 13(b) does not authorize equitable monetary relief; p. 15 reversed/remanded. |
Entire majority slip pp. 1–15 read. Other statutory remedies remain distinct; current § 53 retrieval failed, so later legislative currentness remains held. |

4.4 Failed and partial retrieval register
These entries remain attached to their source IDs. They are not additional independent sources, and an error establishes only the result of that retrieval route.
No failed URL was used as proof that the law, form, or service does not exist. The unresolved routes were not pursued through APIs, hidden endpoints, authentication, or security workarounds.
5. Sixteen fictional classification and workflow postures
These are hypothetical fact patterns, not findings about a real person or business. “Potentially covered” means the identified predicate warrants examination; it does not decide all exclusions, jurisdiction, or currentness.
| No. |
Fictional facts |
Positive or applicable branch |
Adverse branch / exact hold |
| P01 — Repair promise |
A seller charges for removing inaccurate entries and improving an individual’s credit rating. |
Arizona CSO and CROA predicates may both be met; test contracts, performance, cancellation, and federal interstate use. C002, C043. |
Actual representations, credit purpose, consideration, exclusions, and performance remain necessary. |
| P02 — Monitoring |
A paid dashboard initially advertises only alerts; another advertisement promises that using it will improve the user’s credit. |
The improvement representation makes Stout relevant. C005, C077. |
A neutral monitoring label or disclaimer does not resolve the full marketing record; genuinely neutral monitoring requires separate facts. |
| P03 — Education with indirect payment |
A budgeting class is called free, but enrollment requires a paid affiliate package. |
Valuable consideration and an integrated improvement purpose must be tested. C002, C005, C043. |
No holding here that every indirect arrangement is covered or that separating invoices defeats coverage. |
| P04 — New-credit referral |
Buyer pays solely for the address of a retail seller offering the same public credit terms. |
Arizona’s specific sole-referral prohibition applies if its predicates are met. C017. |
Calling the charge “education” does not establish a different service; a genuinely different program requires its actual terms. |
| P05 — Forbearance |
Negotiator obtains a new enforceable right to defer an existing consumer debt. |
Arizona’s deferral definition is relevant. C003–C004. |
Whether this is “obtaining” credit for CSO classification lacks the responsive published construction identified in this pass. |
| P06 — Principal reduction |
Creditor accepts a lower principal amount, with no new right to postpone payment. |
Evaluate any independent repair representation or other covered service. |
Reduction itself is not automatically an extension of credit; do not import the forbearance branch. C004. |
| P07 — Own creditor versus purchaser |
One actor originated a qualifying consumer obligation; another later bought it. Each offers restructuring. |
CROA’s defined-creditor/own-debt exclusion must be tested separately for each. C046. |
Ownership alone does not establish § 1602 creditor status; no actual assignment or contract examined. |
| P08 — Nonprofit |
Organization claims § 501(c)(4); another claims § 501(c)(3) while separately charging for repair. |
Only qualifying § 501(c)(3) matches the state/CROA nonprofit wording. C013, C045. |
For substantial counseling organizations, separately stated repair fees raise § 501(q) issues. Actual exemption status remains held. C049–C050. |
| P09 — Attorney |
Arizona lawyer provides in-scope legal services; a separate marketing company sells the program. |
Lawyer may meet Arizona’s professional exclusion. C011. |
Marketing company does not inherit it; CROA has no blanket attorney exclusion. C048, C078. |
| P10 — Real-estate broker |
Licensed broker provides services within licensed brokerage; also offers a separately marketed repair subscription. |
In-scope brokerage exclusion can be tested. C010. |
Separate repair activity is not automatically within the license’s course and scope. |
| P11 — Broker-dealer |
Registered broker-dealer claims its registration exempts all financial education products. |
Arizona exclusion requires the services to fall within the course and scope of the specified regulation. C012. |
Registration title alone does not establish scope or federal credit-repair exclusion. |
| P12 — Bank and affiliate |
A qualifying bank, a controlled affiliate, and an unaffiliated contractor offer similar services. |
CROA expressly addresses institutional affiliates/subsidiaries. C047. |
Arizona’s list differs; affiliation/control and TSR contractor jurisdiction require separate proof. C009, C014, C065. |
| P13 — Employee sideline |
A salaried employee sells personal repair services outside the employer’s program. |
Test that person’s own service/consideration/representation facts. |
No separate blanket employee exemption appears in the read state list or CROA list. C014, C048. |
| P14 — Interstate direction |
Arizona seller solicits nonresidents; another seller located elsewhere contacts Arizona buyers. |
Sgrillo supports the first direction on its facts. C006. |
It does not decide all jurisdiction/choice-of-law questions in the second. C007. |
| P15 — Bonded advance charge |
CSO holds a compliant state bond and asks for payment before promised repair is complete. |
Bond may satisfy the state exception, assuming all bond predicates. C016. |
Covered CROA still prohibits premature charging/receipt; covered TSR adds its own conditions. C052, C068. |
| P16 — Defective documents and cancellation |
Buyer receives no duplicate notice, is asked to waive cancellation, and promptly mails written cancellation. |
State document/nonwaiver rules and federal contract-voidness rules must be applied if covered. C034–C039, C058–C060. |
Refund entitlement, receipt, actual amounts, applicable law, and remedy predicates remain separate; no automatic damages award. |
6. Four fully worked conditional models
Model 1 — Classification, state bond condition, and federal payment timing
Fictional inputs
- Buyer: natural person seeking personal-purpose credit from someone other than the service seller.
- Proposed service charge: $600.
- Initial service: assistance obtaining new credit; assume it is not solely the prohibited same-public-terms retail referral.
- Seller’s statutory preceding-twelve-month fees-charged base: $80,000.
- No customer payment has yet occurred.
- No actual credit report or customer information is used.
State classification and security calculation
- If the service satisfies § 44-1701 and no exclusion applies, the Arizona CSO duties apply.
- Unbonded seller, all services incomplete: the proposed advance charge/receipt is prohibited under C016.
- Conditional bond calculation:Base F = $80,000.Percentage calculation = 0.05 × $80,000 = $4,000.Apply minimum: max($5,000, $4,000) = $5,000.Apply maximum: min($25,000, $5,000) = $5,000 required face amount.Units: U.S. dollars. No rounding required.
- A correctly issued and filed $5,000 bond would address this state advance-payment condition only. It would not establish fee earning, complete disclosure, an exemption, or permission under another law.
Federal classification branch
- If the actual package makes no express or implied credit-improvement representation and supplies no repair advice/assistance, CROA coverage is not established merely from the Arizona new-credit branch.
- If the package adds an express/implied promise to improve the buyer’s credit, and the interstate/mails and consideration predicates exist, CROA must be applied. A state bond does not permit charging or receiving the $600 while that agreed service remains incomplete.
- If the sale also falls within a qualifying TSR telephone campaign, its credit-repair conditions apply. An inbound response to a repair advertisement is not automatically exempt.
TSR event model
Stipulate that all promised results were achieved January 15, 2026.
- Six-month calendar anniversary: July 15, 2026.
- Qualifying candidate report issued: August 3, 2026.
- Report provided to consumer: August 4, 2026.
- Report demonstrates all promised results; CRA/permissible-purpose requirements are stipulated for this fictional branch.
- August 3 is later than the six-month anniversary. No 180-day conversion is used.
Branch A — Report provision first
- Longest represented performance timeframe expires September 30, 2026.
- All agreed services are stipulated fully performed by that date.
- At an illustrative assessment on October 5, 2026, both TSR events have occurred: report provision on August 4 and timeframe expiry on September 30.
- That removes the particular timing impediments only if every other applicable predicate is satisfied. It is not a payment authorization.
Branch B — Timeframe expiry first
- Alternative represented timeframe expires March 31, 2026.
- All services are stipulated fully performed by that date.
- Report remains issued August 3 and provided August 4.
- At an illustrative assessment on August 10, 2026, both events have occurred, in the opposite order.
Adverse report branch
A report issued March 1, 2026, or exactly July 15, 2026, does not satisfy “issued more than six months after” the January 15 results date. Keeping it until October does not change its issuance date.
Ledger
- Customer receipts: $0.
- Lawfully applied fee established by this model: $0.
- Creditor payments: $0.
- Principal reduction: $0.
- Bond face amount: $5,000, separately identified; it is not a customer expense.
Authority: C002–C004, C016, C020–C022, C043, C052, C064–C071; A.R.S. §§ 44-1701, 44-1703, 44-1708(C); 15 U.S.C. §§ 1679a–1679b; 16 C.F.R. § 310.4(a)(2). Actual classification, report, marketing, and performance remain held.
Model 2 — Completed preliminary work versus an integrated unfinished package
Fictional inputs
One agreement promises:
- Education session: separately listed $150.
- Dispute assistance and follow-through: separately listed $450.
- Total package: $600.
- The same sales presentation promises later monitoring/results.
- The education session is delivered on February 10, 2026.
- The dispute work and promised follow-through remain incomplete.
- The applicable federal waiting period is stipulated to have already elapsed; its boundary is not calculated.
- No payment has been made.
Analysis
- Arizona’s unbonded restriction addresses all agreed services. Delivering the session does not complete the integrated agreement.
- CROA speaks of full performance of the agreed service. Gill rejects treating consultation/some preliminary work as sufficient where substantial promised services remain.
- The $150 invoice line is evidence of pricing, not a binding legal determination that the promise is independent and complete.
- A genuinely separate generic budgeting service could present different classification facts. This model does not establish that branch simply by severing an invoice.
Arithmetic and ledger
- Proposed preliminary charge: $150.
- Total promised package: $150 + $450 = $600.
- Remaining priced work: $450, plus any integrated nonseparately-priced promises.
- Customer receipts: $0.
- Established lawful fee application: $0.
- Creditor payments: $0.
- Customer principal reduction: $0.
Positive branch
If every agreed promise is actually completed, all applicable document/waiting conditions are satisfied, and no covered TSR timing condition remains, the identified full-performance bar may cease to prohibit payment. That still does not prove the amount is otherwise lawful or nonrefundable.
Adverse branch
If $150 had already been collected, the historical receipt would not establish that it was earned. It would require separate treatment under the payment prohibition, cancellation, contract validity, and remedy provisions. No automatic “25% completion = 25% lawful fee” rule exists in the cited authorities.
Authority: C016, C032, C052, C055–C060, C078. Gill, Discussion A; A.R.S. § 44-1703(1); 15 U.S.C. § 1679b(b). No actual severability or earning determination.
Model 3 — Early written cancellation, actual receipt, and return of payment
This model deliberately uses nonboundary events.
Fictional events
- Monday, October 5, 2026: contract signed and transaction occurs on the same day.
- Tuesday, October 6: buyer mails a signed, dated written cancellation to the correct contractual address.
- Wednesday, October 7: CSO actually receives it.
- Tuesday, October 13: the full refund is actually credited back to the buyer.
- Historical amount paid under the contract: $480. Its original collection is not presumed lawful.
Trigger separation
- Cancellation transmission: October 6.
- Actual receipt, starting Arizona’s return obligation: October 7.
- Actual completed return: October 13.
Both transmission and receipt occur early enough that the example does not depend on resolving the third-day/business-day boundary or transaction-date/signature-date discrepancy.
Elapsed-time illustration
Counting elapsed calendar days after receipt:
- October 8 = day 1.
- October 9 = day 2.
- October 10 = day 3.
- October 11 = day 4.
- October 12 = day 5.
- October 13 = day 6.
This is an elapsed-time illustration, not a calculation of an actual legal last day. October 12’s holiday status does not need to decide this early-return example. No universal Saturday/Sunday exclusion is assumed.
Money reconciliation
- Receipt: $480.
- Actual return: $480.
- Remaining amount to return under the stipulated full-cancellation branch: $480 − $480 = $0.
- Creditor payments: $0.
- Principal reduction: $0.
- Rounding: none.
Adverse branches
- If only $180 was returned, the stipulated remaining amount is $480 − $180 = $300.
- Wrong address, unproved mailing, disputed receipt, a different signing/transaction date, or oral-only cancellation changes the evidentiary problem.
- CROA’s general notification wording and the prescribed written notice method are not silently collapsed into a universal rule invalidating every oral communication.
- The 15-day receipt-triggered return provision is Arizona’s; it is not imported into CROA as a federal general refund period.
Authority: C035–C037, C057–C058, C086–C087; A.R.S. § 44-1706(B); 15 U.S.C. § 1679e.
Model 4 — Customer money, disputed fee, creditor transfer, and provider security
Fictional customer ledger
Assume, for the first branch, all $1,000 was paid under the CSO contract:
| Entry |
Cash effect |
Treatment |
| Customer payment received |
+$1,000 |
Historical receipt; original legality not presumed. |
| Refund already completed |
−$250 |
Actual return to customer. |
| Actual transfer to creditor |
−$200 |
Distinct from provider fee and from proven principal reduction. |
| Cash remaining |
$550 |
$1,000 − $250 − $200. |
| Provider’s claimed fee |
$150 claimed |
Not deducted again. No lawful earning/application has been established. |
| Established lawful fee applied in this model |
$0 established |
Evidentiary hold, not a final adjudication that no fee could ever be due. |
Timely-cancellation branch
If § 44-1706(B)’s return obligation covers all $1,000:
- Required return base: $1,000.
- Return already made: $250.
- Remaining return obligation: $750.
- Cash remaining: $550.
- Difference requiring another source of funds: $200.
The actual creditor transfer does not automatically reduce the statutory return obligation. Its legal treatment requires the actual contract, allocation, applicable law, and authority resolving that issue.
Alternative allocation branch
If $200 were genuinely a separate payment outside the CSO contract’s payment base:
- Conditional contract-payment base: $800.
- Less actual refund: $250.
- Conditional remaining return: $550.
That alternative is not chosen merely because the seller calls $200 a pass-through. The missing legal/factual classification is explicit.
Principal accounting
- Creditor received: $200.
- Principal reduction proved: unknown.
- Let P be the portion lawfully allocated to principal. On the stipulated cash facts, 0 ≤ P ≤ $200.
- Interest, fees, and principal allocation are not invented.
- Provider receipts and its $150 fee claim do not themselves reduce the underlying debt.
Separate provider bond calculation
Stipulated statutory fees-charged base for contracts entered during the preceding twelve months:
- Nonoverlapping qualifying fee subtotal A: $300,000.
- Qualifying fee subtotal B: $100,000.
- F = $300,000 + $100,000 = $400,000.
- Cash receipts during that period: $350,000.
- Returns during that period: $10,000.
The statutory base is the stipulated fees charged, not automatically $350,000 or $340,000:
- 0.05 × $400,000 = $20,000.
- max($5,000, $20,000) = $20,000.
- min($25,000, $20,000) = $20,000 required bond face.
No CPI calculation or rounding is used. If the “fees charged” inputs actually contain customer creditor-payment money or wrongly classified charges, the calculation must be held and the base corrected.
Provider cost/security separation
- Public bond-copy filing charge described by the read guidance: $0 for that process.
- Actual surety premium: unknown variable Pₛ.
- Other government/business charges, if applicable: unknown G.
- Conditional expense expression: $0 + Pₛ + G.
- Bond penal sum: $20,000, not added as an expense.
- Collateral, if demanded by a surety: separate unknown asset/encumbrance K, not an assumed statutory customer charge.
Aggregate-claim boundary
If, solely hypothetically, $18,000 of the $20,000 aggregate surety capacity had already been validly exhausted:
- Remaining arithmetic capacity: $20,000 − $18,000 = $2,000.
- A later claimant with $3,000 of otherwise covered actual damages would face an arithmetic surety ceiling of min($3,000, $2,000) = $2,000.
- This does not establish priority, coverage, exhaustion, entitlement, payment, or the CSO’s separate liability.

Verification discipline
- Search results and indexes were used for discovery or bounded amendment checks, not substituted for operative bodies.
- The two unofficial opinion hosts are disclosed; the holdings are separated from arguments and headnotes.
- AMG was read before relying on the old Gill remedy discussion; that old monetary route is not presented as current authority.
- No comparison jurisdiction or unpublished opinion was used to fill the concession or cancellation gaps.
- The four models keep customer receipts, claimed fees, established applications, refunds, creditor transfers, principal allocation, private premium and bond face amount separate.
- No state bond, disclosure, contract, arithmetic result, or completed preliminary task is treated as permission to request or receive payment under a separately applicable federal prohibition.
- Nothing here rewrites prior reports or provides independent-review, actual-actor, full-state, parent, A066, A097, or A098 acceptance.
