SettleADebt — S_AR PASS-12
Arkansas residential homestead, ordinary judgment liens, execution, estates, and proceeds
Research/access date: October 27, 2026. Exact source-opening times were not logged and are unknown. The October 22 baseline is not fresh verification.
Provenance: Earlier raw answers remain unchanged. The reviewed PASS-03 earnings/property-selection distinction is used only as supplied scope context. No substantive conclusion from PASS-04–PASS-06 or PASS-08–PASS-11 was imported. No private title, property, account, court-record, or status search was performed.
Scope: Ordinary unsecured civil money-judgment enforcement against a claimed residential homestead. Special liens, probate, transfers, proceeds, and bankruptcy are addressed only where necessary to identify the homestead boundary.
Principal findings
Arkansas’s homestead protection is not a flat $2,500 equity exemption. The constitutional rural and urban provisions combine maximum acreage, a value condition for the larger area, and minimum-area protection without regard to value. The minimums do not create acreage the debtor does not own or establish that every part of a parcel is actually used as homestead. C001–C021. Arkansas Secretary of State+1
The survivor provisions require a major constitutional qualification. In Welch v. Gipson, the Arkansas Supreme Court declared the remaining gender-based portion of Article 9, § 6 unconstitutional and applied § 28-39-201. The court enforced the statute’s more-than-one-year continuous-marriage condition against the claiming spouse. The official 2025 Constitution still prints the historical language; printing does not restore its validity. C037–C042. Justia Law
A 2025 enactment adds a limited LLC-owned-homestead provision. Act 679 covers the specified married-couple or single-natural-person membership structures. It does not make every company-owned residence exempt. Approval and enacted text were verified; the precise commencement and complete subsequent-law chain remain qualified. C025–C026. arkleg.state.ar.us
The execution-claim statutes cannot safely be reduced to one universal forfeiture date. Act 389 of 1991 created the twenty-day receipt-based execution claim procedure and expressly repealed inconsistent execution-claim portions of § 16-66-211. Section 16-66-212 separately preserves certain homestead claims before or after sale, with a material pre-sale selection exception for a nonresident-on-the-property claimant holding excess land. Their complete current integration remains held. C053–C064. Arkansas Legislature+1
Land, sale proceeds, and creditor payment are different things. Hayes addresses conveyance of protected land; Obenshain rejects automatic homestead protection for voluntary-sale proceeds; Sims addresses forced-sale proceeds intended for another homestead and a reasonable reinvestment period. Money held in escrow is not automatically exempt and is not automatically a payment on a judgment. C070–C076. Justia Law+2
Currentness is partially authenticated, not completely certified. Selected official constitutional text, enactments, federal statutes, adjustment notices, and published judicial bodies were read. Several integrated Arkansas statutes and rules remain available here only as dated reproductions.

A. Constitutional and statutory architecture
A1. Clause-by-clause matrix
| Provision |
Operative rule for this scope |
Necessary conditions and limits |
| Ark. Const. art. 9, § 3 |
A qualifying Arkansas resident’s homestead is protected from ordinary judgment/decree liens and execution, subject to listed exceptions. |
Resident; married or head of a family; an actual homestead interest. A residential address alone is insufficient. C001–C004. |
| Art. 9, § 4 |
Rural homestead: no more than 160 acres, with improvements, subject to the stated $2,500 value condition; protection is not reduced below 80 acres because of value. |
Actual ownership, occupation, qualifying rural classification, selection, and use remain necessary. C012–C013. |
| Art. 9, § 5 |
Urban homestead: no more than one acre, with improvements, subject to the stated $2,500 value condition; protection is not reduced below one-quarter acre because of value. |
This is not an unlimited-value exemption for a full urban acre. C014–C015. |
| Art. 9, § 6 |
Historical survivor language remains printed in the Constitution. |
Welch invalidated the remaining gender-based portion. The statutory survivor framework must be used with that holding. C037. |
| Art. 9, § 10 |
Addresses the homestead’s benefit to minor children after the parents’ death. |
Actual parent, ownership, minority, estate, and statutory conditions remain necessary. No universal vested-fee conclusion. C042. |
| § 16-66-210(b)–(c) |
Reproduces the principal homestead protection and rural/urban structure. |
The 2025 Code page is secondary; selected enacted amendments were independently read. |
| § 16-66-210(d) |
Annexation does not alone eliminate rural acreage protection while the statutory rural-character and significant-agricultural-use conditions continue. |
Both conditions matter; not every annexed property remains rural indefinitely. C018. |
| § 16-66-210(e), Act 679 of 2025 |
Adds homesteads owned by an LLC with the specified membership composition. |
Two members who are a married couple, or one natural-person member who is married or head of a family. Actual ownership, membership, residence, and other requirements remain open. C025–C026. |
| § 18-12-403 |
Restricts conveyances, mortgages, and other instruments affecting a married person’s homestead unless the spouse participates as prescribed, subject to stated exceptions. |
Current text permits joinder or conveyance by separate document, with acknowledgment. C027–C029. |
| §§ 28-39-201–205; § 28-51-104 |
Supply survivor, reservation, appraisal, contest, and estate-sale provisions. |
Must be read with Welch, constitutional area protection, and Price; not as a blanket $2,500 cash-out rule. C037–C047. |
The constitutional language speaks of property value and area. The sources examined do not justify replacing that language with a universal “net equity after every mortgage and selling cost” formula. Equity calculations are useful for accounting, but they do not themselves determine the constitutional area/value question. C016.
A2. Rural, urban, and minimum-area selection
Three distinctions are important.
Classification is factual. In Farmers Cooperative Association v. Stevens, incorporation into a town was not conclusive where the property’s use and surrounding characteristics supported rural treatment. That case does not make every parcel inside municipal limits rural merely because it contains a garden or outbuilding. C017. CaseMine
The constitutional minimum matters. Rowe v. Gose rejected total denial of an established home claim merely because the owners had not proved that the entire lot was within one-quarter acre. The owners had made a prima facie showing sufficient to require examination of the protected minimum and any excess. This was not a universal reversal of the claimant’s burden. C003, C019. Justia Law
Selection is not arbitrary. Price v. Price held that the survivor had not proved entitlement to the claimed urban acre above the value threshold, but preserved the quarter acre containing the dwelling. It also rejected the idea that a clerk’s reservation conclusively vested the entire selected acre without the available contest. C020–C021, C044–C047. Justia Law+1
No square-foot conversion is needed for these conclusions. A survey, legal description, permitted division, access, and actual use can be material without transforming this report into a title or land-use determination.
B. Claimants, estates, occupancy, and abandonment
B1. Actor and property-interest matrix
| Actor or estate |
Supported treatment |
Missing facts or adverse branch |
| Owner occupying the residence |
Initial protection requires the actual homestead predicates, not a label. |
Ownership, qualifying status, Arkansas residence, actual use, and relevant dates. |
| Owner intending future occupancy |
Middleton distinguishes actual occupancy from an intention to occupy later. |
Plans, utilities, a mailing address, or future construction alone do not establish the required occupancy. C004. |
| Owner temporarily absent |
An established homestead may continue where the facts show a fixed intention to return rather than abandonment. |
Duration alone is not a universal test. Actual conduct and intention matter. C006–C009. |
| Divorced or formerly qualifying owner |
Tri-State Delta confirms that qualifying status need not have existed at acquisition and that later family changes do not automatically destroy an already established homestead. |
Continued possession/use and abandonment remain material. C005. |
| Co-owner |
Tenancy in common or divided ownership is not automatically fatal to a homestead claim. |
The claimant’s actual estate and rights of others must be identified; no automatic fifty-percent exemption calculation. C023. |
| Life tenant/remainderman |
A present possessory estate can support a different analysis from a future remainder. Middleton required attention to the deed’s actual reservation. |
A reserved right to occupy the house was not treated as a life estate in every acre. No title conclusion from a deed label. C024. |
| Revocable-trust resident |
Fitton recognized the claim of a settlor, trustee, and beneficiary using the property as a principal residence on its facts. |
Not every trust beneficiary, irrevocable trust, or nonresident beneficial interest is equivalent. C022. |
| LLC-owned residence |
Act 679 adds the specified membership categories. |
A corporation, multi-member investment LLC, or ownership change is not covered merely by analogy. C025–C026. |
| Spouse claiming where debtor does not |
Section 16-66-212(c) and Hayes recognize the other spouse’s ability to intervene in the stated setting. |
The spouse’s actual homestead interest and procedural posture must be established. C030. |
| Surviving spouse |
Section 28-39-201 and Welch govern the material survivor conditions. |
Continuous marriage exceeding one year, separate-home and child-related provisions, and actual estate facts. C038–C041. |
| Minor children |
Constitutional and statutory survivor provisions address their interests. |
Age, parentage, estate, surviving-spouse rights, and the particular vesting question remain necessary. C040–C042. |
B2. Burden and abandonment
The claimant must establish the homestead’s initial predicates. Once established, the cases recognize a presumption of continuation; the party asserting abandonment bears the pertinent burden. Those propositions do not eliminate the need to prove the claimed area, ownership, status, or use.
In Parker v. Johnson, departure, an unconditional agreement to sell, completed transfers, and failure to return supported abandonment despite retained keys and maintenance. In Gerrald, the Eighth Circuit emphasized the debtor’s intended sale and division of proceeds—not involuntary removal alone. C006–C009. Justia Law+1
Sims also demonstrates partial abandonment: the court treated the commercial portion committed to a partnership differently from the dwelling and curtilage. It did not establish that every business use of a home automatically abandons the entire property. C010.
Acquisition and lien dates matter. Kopaska did not permit a later marriage to defeat the previously attached lien on its record. That is not a holding that an unmarried person can never qualify as head of a family. C011, C050.
B3. Survivor rights after Welch
The current statutory text provides, in the specified circumstances:
- A surviving spouse without the stated separate-homestead problem may receive the prescribed lifetime rents-and-profits benefit when there are no children.
- Where children survive, the statute describes their share and its age-related progression.
- The spouse or children may reside on the homestead or not under the text.
- The claiming spouse’s rights are subject to the more-than-one-year continuous-marriage condition applied in Welch.
These interests are not automatically a new fee-simple estate, nor do they determine every dower, curtesy, partition, or inheritance issue. C038–C042. Justia Law+1
The precise application of every child-vesting provision, particularly when no spouse qualifies, was not resolved by treating Welch’s spouse holding as a universal answer.
C. Exceptions, consent, and the effect of a valid exceptional claim
C1. Exception and consent matrix
| Claim or event |
Supported boundary |
What is not established |
| Ordinary unsecured money judgment |
Qualifying homestead is protected from the ordinary judgment lien and forced execution. |
No conclusion about actual qualification or a previously attached lien. |
| Purchase money |
Express constitutional exception. |
A label “purchase money” does not prove tracing, validity, amount, priority, or foreclosure procedure. |
| Taxes |
Express constitutional exception. |
Not a complete state/federal tax-lien or sale dossier. |
| Mechanics/laborers for improvements |
Express constitutional language addresses the stated class. |
No automatic lien from an unpaid invoice; separate perfection and enforcement remain required. |
| Other specific liens |
Constitutional text distinguishes them from ordinary judgment liens. |
A generic judgment is not converted into a specific lien merely by recording it. |
| Specified fiduciary obligations |
The text names executors, administrators, guardians, receivers, attorneys for collected money, and trustees of express trusts for the stated fiduciary sums. |
“Trustee,” “fraud,” or “fiduciary” used loosely does not establish the exception. |
| Consensual encumbrance |
Section 18-12-403’s spouse-participation rule and exceptions must be applied. |
Homestead does not automatically invalidate every mortgage; nor does one spouse’s signature automatically suffice. |
| Separate spouse document |
Act 1164 permits the prescribed separate-document route and contains a retrospective validation clause limited to the same-document defect. |
No general cure of fraud, lack of authority, missing acknowledgment, or other defects. |
| Abandonment |
Can remove or limit the relevant homestead protection on proved facts. |
Not every absence, conveyance into a qualifying trust, or procedural omission is abandonment. |
| Support/restitution/special claims |
No universal exception is adopted here. |
Their own constitutional, statutory, federal and procedural rules require separate investigation. |
| Killing the spouse through whom the claim arises |
Middleton recognizes a narrow forfeiture principle for the killer’s marriage-derived claim. |
It did not erase innocent dependents’ rights or create a general ordinary-debt exception. |
C027–C036, C093. The constitutional exceptions and spouse-consent exceptions are not word-for-word identical lists and should not be merged. Arkansas Secretary of State+1
C2. Historical spouse-signature cases require amendment comparison
Blackford v. Dickey applied the pre-1993 spouse-instrument rule. Act 1164 later authorized the specified separate document and expressly addressed earlier instruments invalid only because spouses did not execute the same document.
Therefore, Blackford remains useful for its actual abandonment, title, and lien posture, but its former same-document analysis cannot be presented as the unqualified current rule. C028–C029.
C3. One exceptional creditor does not necessarily open the property to all creditors
In the 1979 Northwestern National Insurance Co. v. Sulcer appeal, the court rejected the premise that a surety’s qualifying claim against the widow’s dower interest destroyed the barrier for the estate’s ordinary creditors. It reversed the broader distribution ordered below.
The opinion’s gendered constitutional discussion is historical and must be read with Welch. Its narrower distinction remains important: a successful exceptional claim is not automatically a license for unrelated ordinary creditors to share all homestead value. C033–C034. CaseMine
D. Judgment lien, execution, claim, and contested excess
D1. Attachment is not the same as sale or payment
Section 16-65-117 supplies general judgment-lien rules, including filing/indexing and particular district-court and other-county conditions. It does not override Article 9.
The constitutional protection and cases distinguish:
- A judgment appearing in public records.
- A lien legally attaching to a particular interest.
- A valid levy against reachable property.
- Authority to sell a defined nonexempt interest.
- Actual proceeds received.
- Actual credit to the judgment.
No title search was performed. A recorded judgment is not assumed to attach to an established exempt homestead, and homestead status acquired only after a lien has attached does not automatically erase that lien. C048–C050. Justia Law+1
The displayed § 16-66-417 also contains a special route for land following an unsatisfied execution from a justice-of-the-peace-type court: certified materials are filed with the circuit clerk before the described circuit execution. Its modern district-court and administrative-rule integration remains held. C051. Justia Law

Actual accounting, order and competing rights. C076, C089–C092. |
D3. The critical Act 389 qualification
Act 389 § 4 expressly repealed portions of § 16-66-211 concerning execution-exemption claims to the extent inconsistent with the act. Its emergency clause made it effective upon approval, March 7, 1991.
Consequently, the older five-day schedule procedure cannot be presented without this qualification. But that enactment does not itself provide a complete judicial reconciliation with § 16-66-212’s homestead-specific protection or the later § 221 schedule. C055–C064. Arkansas Legislature+1
The correct retained hold is not “there is no claim deadline.” It is: the material statutes contain different predicates and consequences, and no current controlling body resolving every ordinary homestead posture was obtained.
D4. Excess and sale mechanics
The examined provisions include:
- Section 16-66-402’s levy-certificate and recording requirements.
- Section 408’s real-property sale posting/publication requirements.
- Section 410’s tract-sale provisions for qualifying larger parcels, including stopping when the execution is satisfied.
- Section 411’s rule that sale under a junior judgment is subject to prior judgments and decrees.
These do not authorize selling the protected minimum merely because selling the entire parcel would be easier. Nor do they create a general state execution sale free and clear of all prior interests. C052, C065–C067. Justia Law+3
A Rule 62 reproduction was read for the limited stay distinction. Current full service/computation/special-procedure rules and adopted local homestead packets were not authenticated. No executable calendar or actual filing instruction is supplied.
E. Estate reservation, excess property, transfer, and proceeds
E1. Estate-specific procedure is not a general $2,500 buyout
Sections 28-39-202–205 describe reservation, appraisal and contest mechanisms. The displayed § 204 contains old language about sale of a lot exceeding $2,500 and retaining that amount for another home.
That language cannot be applied in isolation. Price rejected a sale on the defective appraisal basis before it and held that the quarter acre containing the dwelling remained exempt from sale. The claimant’s proof could limit the protected area without reducing the constitutional minimum to $2,500 cash. C044–C047. law.justia.com
Price measured value in the survivor-versus-heirs posture at the decedent’s death. This report does not extend that valuation date to every living debtor’s execution dispute. The valuation date and whether a particular measure uses gross property value, estate value or another basis must be established for the actual posture. C020–C021.
Section 28-51-104 separately bars a personal representative’s sale for payment of the decedent’s debts while the property remains the homestead of the qualifying surviving spouse or minor children. It does not resolve every partition, mortgage, tax, or exceptional creditor proceeding. C043. Justia Law
E2. Transfer and proceeds matrix
| Event |
Supported rule |
Important limit |
| Conveyance of established protected land |
Hayes protected the conveyed land through the spouse’s asserted homestead right on its facts. |
The purchaser did not acquire a new personal right to invent the seller’s claim. |
| Deposit substituted for land in Hayes |
The parties stipulated that the deposited amount would be treated as real estate for the litigation. |
Not a general rule that every escrow preserves homestead status. |
| Voluntary sale |
Obenshain held the voluntary-sale proceeds before it unprotected as homestead. |
Traceability alone does not create a new proceeds exemption. |
| Forced sale |
Sims and Obenshain recognize the stated intent-to-acquire-another-homestead principle. |
A reasonable time is factual; no universal thirty-, ninety-, or 180-day period was established. |
| Divorce-related sale |
A voluntary agreement approved in a decree is not automatically a forced sale. |
Obenshain reserved whether another kind of court-ordered sale could be forced. |
| Mortgage satisfied at sale |
Payment of the mortgage and status of an ordinary judgment lien are separate. |
Parker did not treat lack of net sale proceeds as automatically erasing the lien on land. |
| Funds commingled, spent or transferred |
Actual tracing and continued protection require evidence. |
No universal tracing algorithm or automatic replacement-home exemption was established. |
| Creditor receives money |
Actual lawful remittance can reduce the judgment. |
Recording, attachment, a reserve or escrow alone does not. |

F. Bankruptcy boundary only
| Question |
Verified narrow boundary |
Remaining work |
| State or federal election |
Act 345 of 1991 and § 16-66-217 permit the stated election. The act became effective March 5, 1991. |
Actual eligibility, domicile and joint-case election conditions. |
| Applicable state law |
§ 522(b)(3)(A) uses its federal domicile test. |
Moving to Arkansas does not automatically supply Arkansas exemptions. |
| Valuation |
§ 522(a)(2) uses petition-related fair-market value. |
Do not substitute it for every state execution valuation date. |
| Judicial-lien avoidance |
§ 522(f) provides a conditional impairment/avoidance mechanism. |
No automatic avoidance from a state exemption claim alone. |
| Current adjusted federal amounts |
For cases commenced on or after April 1, 2025, the verified notice gives $31,575 for § 522(d)(1) and $214,000 for the referenced § 522(p)/(q) limits. |
These are not Arkansas’s ordinary civil homestead limits. Earlier cases use their applicable values. |
| Anti-abuse and special liabilities |
§§ 522(o)–(q) and (c) can limit protection under their own predicates. |
Full cross-referenced debt, avoidance, intent, acquisition-period and support exceptions are deferred. |
| Trustee sale powers |
Bankruptcy uses its own estate and sale framework. |
No trustee power is imported as authority for an Arkansas sheriff to sell an indivisible minimum-area homestead. |
C077–C084. The official adjustment notice—not an invented CPI calculation—supports the figures. Its February 25, 2025 correction concerns other table entries, not the homestead figures used here. Arkansas Legislature+4

| In re Gerrald, 57 F.3d 652 — S039 |
Eighth Circuit, June 9, 1995. Arkansas exemption in bankruptcy; involuntary departure versus intended voluntary sale. |
Affirmed abandonment finding; voluntary sale intention, not expulsion alone, mattered. No trustee-sale powers generalized. |

Assume the entire twenty acres is actually a qualifying rural homestead, with no abandoned or unrelated portion and no exceptional debt.
The acreage is below the rural eighty-acre minimum protection. The $500,000 value does not by itself reduce that qualifying area to a $2,500 exemption.
- Actual creditor payment: $0.
- Remaining judgment: $70,000.
- No sale authority follows from this model.
Adverse urban branch
Assume instead that the parcel is legally urban and a valid selection identifies a quarter-acre residential core, including the dwelling:

The encumbrance and cost allocation is stipulated, not an Arkansas statutory pro-rata formula. It would require actual instruments, releases or orders in a real case.
The $172,000 remainder is not automatically payable to the judgment creditor. Boundaries, divisibility, other estates, priority and a lawful sale/distribution remain necessary. C012–C021, C065–C076, C089.
M02 — Spouses, coownership, and an exceptional claim
Stipulated facts
- Married occupants own and occupy a qualifying 0.20-acre urban home.
- Value: $400,000.
- Valid purchase-money encumbrance: $220,000.
- Separately authorized sale costs in the exceptional-sale branch: $20,000.
- Ordinary unsecured judgment against one spouse: $45,000 plus $500 stipulated lawful additions.
- No other additions.
400,000−220,000−20,000=160,000400,000-220,000-20,000=\boxed{160,000}400,000−220,000−20,000=160,000### Ordinary-judgment branch
On the assumed homestead predicates, the ordinary creditor cannot convert the one-spouse debt into an automatic sale of “that spouse’s half.”
45,000+500−0=45,500 remaining ordinary judgment45,000+500-0=\boxed{45,500\text{ remaining ordinary judgment}}45,000+500−0=45,500 remaining ordinary judgmentNo actual payment occurs.
Purchase-money exception branch
Assume, independently, a valid final order under the appropriate exceptional-enforcement law authorizes sale, the stated costs, and payment of the purchase-money claim. The full foreclosure procedure is not modeled.

−$220,000 |
| Actual authorized costs |
−$20,000 |

$160,000 |
The ordinary creditor receives $0, unless a separate lawful basis and distribution are established. The $160,000 is not automatically split equally, automatically exempt forever, or automatically available to ordinary creditors. Actual estates, forced-sale/reinvestment law and the order govern.
The purchase-money exception is not a declaration that every signature, notice, priority or procedural requirement disappears. C023, C027–C034, C072, C090.
M03 — Voluntary versus forced sale and reinvestment
Common fictional ledger
Assume a sale on September 1, 2026:
- Price: $300,000.
- Valid encumbrance actually paid: $180,000.
- Lawful, actually paid sale costs: $15,000.
300,000−180,000−15,000=105,000 net proceeds300,000-180,000-15,000=\boxed{105,000\text{ net proceeds}}300,000−180,000−15,000=105,000 net proceedsOrdinary judgment:

Under Obenshain, proceeds do not automatically retain the homestead exemption merely because they came from a home.
Initially:
- Proceeds held: $105,000.
- Creditor actually paid: $0.
- Judgment still $50,500.
Assume a later, separately lawful order authorizes and an actual remittance pays $20,000:
105,000−20,000=85,000 remaining cash105,000-20,000=\boxed{85,000\text{ remaining cash}}105,000−20,000=85,000 remaining cash50,500−20,000=30,500 remaining judgment50,500-20,000=\boxed{30,500\text{ remaining judgment}}50,500−20,000=30,500 remaining judgmentThe credit occurs upon the stipulated actual lawful payment—not merely because funds entered escrow.
Forced-sale/reinvestment branch
Instead assume the sale was legally forced, the debtor had the requisite intent to obtain another homestead, and the proceeds remained identifiable. On October 20, the debtor purchases a replacement for $130,000 using $100,000 of the proceeds and a new $30,000 loan.

The forty-nine elapsed days are a fictional chronology, not a judicial finding of reasonable time. Protection of the $5,000 remainder and replacement estate still requires the actual law and facts. C070–C076, C091.
M04 — Claimed quarter acre, contested excess, sale, and actual credit
Property and judgment assumptions
- Urban parcel: 0.50 acre.
- Residential quarter-acre core value: $240,000.
- Separate excess quarter-acre value: $60,000.
- Valid encumbrance: $120,000, stipulated to burden the core only.
- Excess-sale costs: $6,000, but only if lawfully authorized and paid.
- Ordinary judgment: $40,000 plus $1,000 stipulated lawful additions.
Initial property equity:

I. Sixteen additional fictional postures
| Posture |
Fictional facts |
Rule, evidence, consequence, and uncertainty |
| P01 — Mailing address only |
Debtor receives mail at a house but lives elsewhere and has not occupied it as home. |
Address alone does not establish actual homestead occupancy. Deed, use and intent evidence required. C002–C004. |
| P02 — Later family status |
Owner bought while unmarried, later established a family home there. |
Acquisition while unmarried is not necessarily fatal; relevant status and establishment dates matter. C005. |
| P03 — Temporary medical absence |
Established occupant leaves for treatment but maintains a fixed return plan. |
Temporary absence may preserve protection; actual conduct and intent remain disputed. C006–C009. |
| P04 — Future construction |
Owner plans to build but has never actually occupied the tract as home. |
Future intent is not automatically current homestead. C004. |
| P05 — Annexed farm |
Long-used rural property is annexed and continues significant agricultural use. |
Act 282 conditions must be proved; annexation alone is not decisive. C018. |
| P06 — Urban high value |
Qualifying home occupies 0.20 acre and is worth far above $2,500. |
Value alone does not defeat the minimum-area principle; ownership/use still required. C014–C016. |
| P07 — Oversized rural parcel |
Debtor claims 200 acres as one homestead. |
The 160-acre maximum and selection requirements matter; no claim to all land from “farm” label. C012–C013, C021. |
| P08 — Nonoccupant with excess land |
Debtor does not reside on claimed land and has more land than the exempt area. |
§ 212(d)’s pre-sale selection qualification is material. C060. |
| P09 — Revocable trust |
Settlor/trustee/beneficiary actually lives in the trust-owned residence. |
Fitton is relevant; other trust structures are not automatically equivalent. C022. |
| P10 — LLC residence |
Two members are married spouses and the LLC owns their claimed home. |
Act 679’s enacted category is relevant; currentness and all other homestead facts still required. C025–C026. |
| P11 — Remainder only |
Claimant holds only a future remainder behind another person’s actual life estate. |
Present possessory rights differ; exact deed and scope control. C024. |
| P12 — Separate spouse instrument |
Spouse acknowledges a separate conveyance document. |
Current § 403 permits the stated route; no automatic cure of unrelated defects. C027–C029. |
| P13 — Short marriage at death |
Surviving spouse married decedent for three months. |
Welch applies the statutory more-than-one-year condition to the spouse claim; children’s rights require separate analysis. C037–C042. |
| P14 — Survivor with children |
Qualifying spouse and two minor children survive. |
Statutory rents/profits, ages and estate conditions matter; no automatic fee-title division. C039–C042. |
| P15 — Exceptional creditor |
Estate surety establishes a qualifying fiduciary claim. |
That does not automatically permit all ordinary estate creditors to reach the protected value. C033–C034. |
| P16 — Bankruptcy filing alleged |
Debtor says a future bankruptcy will protect all home equity. |
Election, domicile, acquisition, anti-abuse, lien and procedural requirements remain; no automatic result. C077–C084. |

PASS-12 contribution |
What is not accepted |
| Reviewed P03 scope context |
Preserves the distinction between earnings/personal-property selection and this residential-homestead inquiry. |
No wage or personal-property amount becomes a homestead rule; no P03 legal finding supplies an unread authority here. |
| Reviewed P01 broad remaining categories / current unaccepted property-enforcement dimension |
Adds constitutional/statutory homestead, estate, exception, lien, execution and proceeds analysis with explicit holds. |
No invented exact P01 homestead row and no acceptance of the whole property/enforcement dimension. |
| Authorized parent requirement |
Supplies clause, actor, evidence, case, model and source registers for this narrow gateway. |
No full Arkansas, parent, A066, A097 or A098 acceptance. |

The principal newly verified qualifications are:
- The remaining Article 9 § 6 invalidation in Welch, despite continued printing of the historical text.
- The 2025 LLC amendment, limited to its enacted membership categories.
- The 1993 spouse-document amendment and express retrospective clause.
- The 1991 execution notice/claim act’s express inconsistent-provisions repeal.
- The difference between minimum-area protection, excess land, voluntary-sale cash, forced-sale reinvestment, and actual judgment payment.
The remaining gaps are substantive: complete current official Code/rule chains, the original 1981 act, modern claim-clock harmonization, exact local procedures, current citator treatment, and all actual title, estate, occupancy, consent, notice, valuation, proceeds and creditor facts.
Counts: 40 source/access groups; 94 atomic claims; 15 published-case entries; 4 worked models; 16 additional fictional postures; 12 workflow rows; 30 core-coverage rows; 8 currentness rows; 8 additional holds; 4 model-coverage rows; 6 territorial/actual-record rows; 9 deferred-family rows; and 3 separate crosswalk rows. Grouped statutes and repeated URLs are not independent corroborating authorities.
No independent review, local write, unseen model claim, actual eligibility, sale or collection permission, approved form, publication readiness, or full-state/parent acceptance is asserted.
