Arkansas collection-agency classification, licensing, exemptions, security, and public procedure
Public-source access date: October 27, 2026. Exact source-opening times were not logged and are unknown.
Provenance: The original passes remain unchanged. The supplied coordinator-review history is not an independent review or a source-opening record. PASS-04 and PASS-05 were not used as legal premises. No local coordinator files were accessed or written.
Scope: The ordinary collection-agency licensing gateway: covered actors and activities, exclusions, remote activity, licensing and renewal, regulatory charges, required security, and the limited public procedures needed to understand those requirements. No actual business’s authorization or exemption is determined.
Principal findings
Arkansas’s licensing definition expressly reaches a purchaser that buys delinquent accounts and attempts to collect them. Hiring another collector or an attorney does not, by itself, remove the purchaser from that definition. The Arkansas Supreme Court decided that issue in Simpson v. Cavalry SPV I, LLC and rejected the contrary 2012 Board clarification presented in that case. C002–C009, C021. Justia Law+1
The licensing provisions do not contain the federal FDCPA’s general personal, family, or household-purpose limitation. Arkansas’s separate consumer-debt definitions in § 17-24-502 expressly operate within that subchapter. They should not silently narrow the licensing provisions in §§ 17-24-101 and 301. C004, C076–C085. Justia Law+2
The verified ordinary regulatory charges are $125 for the agency license and $20 for each covered employee’s registration, with the same charges at renewal. The required surety bond is separate: the official rules prescribe $10,000, $20,000, or $25,000 according to collector count. The statute authorizes a $10,000–$50,000 range for each location. A penal sum is not the premium, collateral, a consumer charge, or each claimant’s guaranteed recovery. C030–C034, C057–C070. Code of Arkansas Rules+2
A timely, sufficient renewal application can preserve an existing license under the Administrative Procedure Act. The Board’s renewal rule cannot be read in isolation as proving that every application still pending after June 30 has lapsed. Conversely, an initial application, incomplete renewal, or merely paying a fee is not itself a license grant. C037–C042. Justia Law+1
Public form access remains incomplete. The Board’s forms, blank bond, retroactive application, and public lookup routes returned access errors. The official codified rules and official legislative materials were readable. Requirements stated below come from those bodies—not invented contents of an inaccessible application. C056, C088–C090.
In the tables, S001 means S_AR-P06-S001, and C001 means S_AR-P06-C001.
A. Actor, activity, nexus, and exemption matrix
A1. The four statutory activity branches
The displayed § 17-24-101, corroborated by Act 360 of 2023, identifies four collection-agency branches:
- Collecting delinquent accounts, bills, or indebtedness owed or asserted to be owed to another.
- Using a fictitious or other name to collect one’s own receivables.
- Soliciting claims for collection.
- Purchasing and attempting to collect delinquent accounts or bills.
Section 17-24-301 supplies the corresponding licensing prohibition. The inquiry is functional: ownership, delinquency, collection attempts, solicitation, names used, and applicable exclusions—not a business’s preferred label. C002–C006. Arkansas Legislature+1
| Actor or model |
Supported Arkansas licensing analysis |
Conditions, adverse branch, and claim IDs |
| Original creditor collecting a debt it originated, in its true own name |
Generally outside the “another’s debt” and purchased-delinquent-account branches on those assumed facts. |
This is a bounded textual classification, not a blanket express original-creditor exemption. Other-name collection or another covered activity changes the analysis. C005–C006. |
| Creditor collecting its own receivables under another or fictitious name |
Expressly addressed by the definition and license requirement. |
Actual names and representations matter; ownership alone does not establish exclusion. C006. |
| Purchaser of accounts already delinquent or in default |
Purchase plus collection attempts falls within the statutory branch. |
A purchase alone, with genuinely no collection attempt, presents a narrower unresolved posture. C008–C009. |
| Purchaser of defaulted accounts that hires a licensed collector or law firm |
Simpson holds that outsourcing does not eliminate the purchaser’s licensing obligation on that model. |
The retained actor’s exemption or license is not automatically the purchaser’s exemption or license. C008, C014, C021. |
| Purchaser of performing accounts |
Section 102(a)(10) provides a conditional exclusion. |
Valuable consideration; accounts not in default or delinquent at acquisition; subsequent collection in purchaser’s own name. Each predicate matters. C007. |
| Passive investment owner with no collection activity or collection arrangement |
Not resolved merely by calling it “passive.” |
Hiring someone to collect was enough in Simpson. A genuinely inert ownership posture requires separate facts and authority. C009. |
| Assignee without a genuine purchase |
Assignment form alone does not establish the purchaser exclusion. |
Determine beneficial ownership, consideration, default status, and whose debt is being collected. C007–C010. |
| Servicing business |
No general Arkansas licensing exclusion equivalent to the federal predefault-servicing exclusion was established. |
Solicitation, delinquency, collection for another, and actual acquisition rights matter. C010. |
| Affiliate collecting a related company’s accounts |
No blanket affiliate exclusion appears in the licensing exclusions read. |
A separate entity is not automatically a “regular employee of a single creditor.” Federal affiliate rules are different. C011–C012. |
| Regular employee of one creditor |
Express exclusion under § 102(a)(1). |
The statutory wording is “regular employees of a single creditor”; a salary label alone does not establish employee status or the single-creditor condition. C012. |
| Employee of a collection agency |
Generally subject to the agency’s registration requirements when involved in collection activities. |
Collectors, solicitors, and managers are expressly included. This is not the same as the single-creditor employee exclusion. C031–C033. |
| Attorney collecting fees owed personally or to the firm |
Express exclusion when using the attorney’s own name or firm name. |
Does not automatically extend to a separate collection company. C013. |
| Arkansas-licensed attorney rendering legal services for a client |
Section 102(b) supplies a licensing-related exclusion on those conditions. |
Attorney connection, branding, ownership, or nominal supervision is not enough by itself. C014. |
| Fiduciary or escrow actor |
No universal fiduciary licensing exemption was established. |
A trust company, abstract company doing escrow business, or court-order handler may satisfy a specific exclusion. C015–C018. |
| Business-only collector |
Not excluded simply because debts are commercial. |
State licensing text is broader than the federal consumer-debt definition. C004. |
| Mixed consumer/business portfolio |
Analyze state licensing and federal status separately. |
Federal coverage can vary by debt; state licensing does not automatically disappear for the commercial portion. C004, C076–C085. |
| Remote actor contacting or collecting Arkansas accounts |
An out-of-state office is not a categorical safe harbor. |
Section 401 and Simpson are material; exact digital, minimum-contact, and constitutional boundaries remain held. C020–C022. |
| Debtor-side negotiator |
A collection-agency license does not establish authority for debtor-side adjusting. |
This pass supplies no debt-adjustment permission and does not reopen that separate dossier. C085. |
The original-creditor, servicing, affiliate, and inert-investment rows are intentionally narrower than an assertion that every such actor is either licensed or exempt.
A2. Complete responsive § 17-24-102 exclusion inventory
| Provision |
Excluded actor/activity stated in the text read |
Required boundary |
| (a)(1) |
Regular employees of a single creditor |
Actual employment and single-creditor relationship. |
| (a)(2) |
Banks |
Actual institutional status; do not extend by analogy to every financial company. |
| (a)(3) |
Trust companies |
Actual trust-company status. |
| (a)(4) |
Savings and loan associations |
Actual institutional status. |
| (a)(5) |
Abstract companies doing an escrow business |
Both actor and activity conditions. |
| (a)(6) |
Licensed real-estate brokers and agents |
Claims must relate to their regular real-estate business. |
| (a)(7) |
Express and telegraph companies subject to public regulation and supervision |
The stated regulated-entity condition. |
| (a)(8) |
Attorneys collecting amounts owed to themselves or their firms |
Own name or firm name; not every attorney-associated entity. |
| (a)(9)(A) |
Persons and entities handling claims, accounts, or collections under a court order |
An actual qualifying court order, not merely litigation involvement. |
| (a)(9)(B) |
Exception to the foregoing exclusion |
Private child-support collection agencies outside Title IV-D are expressly subject to licensing. |
| (a)(10) |
Purchasers for value of accounts not delinquent/defaulted at acquisition |
Collection in purchaser’s own name and acquisition-time status must be proved. |
| (b) |
Arkansas-licensed attorneys rendering legal services for clients |
The exclusion concerns the enumerated licensing/fee provisions; it is not universal immunity. |
| (c) |
Specified real-property foreclosure activity |
Foreclosure is outside this pass. The state provision’s reference to the federal definition as of January 1, 2005 is not a controlling declaration of all current federal law. |
There is no general nonprofit, affiliate, ordinary servicer, or generic fiduciary exclusion in this list. Nor was a blanket credit-union exemption established merely from the word “banks.” The precise scope of any other governing statute or federal preemption remains a separate question. C012–C019. Justia Law
Currentness qualification: The full displayed 2025 § 102 was read. Act 1455 of 2009 supplies primary support for material language, but the later Act 386 of 2019, § 9, could not be retrieved through either official route attempted. The current mirror’s “this subchapter” wording in subsection (b) is therefore not represented as a fully reconstructed primary amendment chain.
A3. Remote activity and nonresident procedures
Section 17-24-401 addresses an out-of-state collection agency’s solicitation or acceptance of collection business connected with Arkansas through mail, telephone, or similar means. Its consequences include the stated jurisdiction, licensing-fee, and service-agent provisions. It is not a reciprocal-license exemption. The related §§ 402–404 preserve jurisdictional objections and establish particular service and litigation-security mechanisms. C020, C070. Justia Law+2
Simpson is particularly important because the court rejected the 2012 Board clarification that had treated certain out-of-state debt buyers using third-party collectors as exempt. The clarification was reproduced and rejected in the judicial body; its original administrative record was not separately obtained. C021. law.justia.com
The exact treatment of a national website, isolated communication, remote home worker, out-of-state debtor who later moves, or an entity with no Arkansas-directed activity remains fact-dependent. No universal “one call always establishes jurisdiction” rule is supplied.
A4. Reciprocity is not automatic permission
Section 17-1-108 applies its definition of “individual” to persons and entities. It directs licensing bodies to adopt least-restrictive reciprocity or endorsement procedures for qualifying holders of substantially similar, good-standing credentials, including a temporary/provisional license procedure of at least ninety days. It preserves generally applicable bond and financial requirements. C023–C024. Justia Law
The Board’s actual rule is narrower in one important respect: § 280-201(b)(3) permits a qualifying out-of-state license to support waiver of the manager credit-report requirement. That waiver is not itself the Arkansas agency license, a bond waiver, or proof that every § 17-1-108 procedure has been implemented in a readable public form. C025. Arkansas General Assembly
B. Licensing, charges, renewal, and public-procedure matrix
B1. Agency, manager, employee, and location requirements
The responsible regulator is the State Board of Collection Agencies, within the Arkansas Department of Labor and Licensing. The official codified rules identify the Board’s organizational placement and rulemaking authority. C001. Code of Arkansas Rules
| Requirement |
Verified rule or statute |
Limits |
| Applicant qualifications |
Section 302 specifies age conditions for individual applicants, partners, and the stated corporate manager/ownership alternatives. |
Do not replace the statutory alternatives with an invented universal owner test. |
| Law-enforcement restriction |
Listed law-enforcement officers cannot be licensed to operate an agency or act as its collector. |
Actual role must be established. |
| Application |
Written application containing Board-required information; the rule requires the director’s form and actual officer street addresses. |
Inaccessible form fields and attachments are not reconstructed from the landing page. |
| Manager |
At least one registered manager; acceptable credit reputation and specified financial-history requirements. |
Credit-report waiver is conditional; no private credit record was examined. |
| Employees |
Names, aliases, and hire dates; $20 registration for covered collection employees, including collectors, solicitors, and managers. |
Registration within ninety days of hire and for each licensing period. |
| Additional locations |
Separate license and surety bond for each office or location. |
Whether a particular remote home workspace is a separate location was not resolved. |
| Ownership |
License is nontransferable; transfer/sale of 50% or more of assets, stock, or equity requires prompt written notice. |
Rule 203 also addresses termination on ownership transfer; 49% is not declared a universal safe harbor. |
| Address |
Timely notice of physical/mailing changes; bond must carry current physical address. |
An unchanged old-address bond is not treated as automatically sufficient. |
C026–C036. Justia Law+2
The manager criteria include specified five-year adverse-credit categories, more than three sixty-day-late payments during that period, and the rule’s broader financial-responsibility provision. Those criteria were read as rules; this report makes no judgment about an actual person’s eligibility.
B2. Regulatory charges and security amounts
| Item |
Verified amount or formula |
Basis and qualification |
| Agency licensing charge |
$125 |
Section 305 supplies a ceiling; official Rule 201 fixes the required charge at $125. |
| Renewal agency charge |
$125 |
Rule 204 requires the same licensing charge. |
| Covered employee registration |
$20 per employee per licensing period |
Includes covered managers and solicitors; annual registration requirement. |
| Historical employee amount |
Not the current $15 amount |
Act 1023 expressly made the $20 amount effective September 1, 2013. |
| Additional location |
Separate license and bond |
No separate additional “branch surcharge” was verified beyond those requirements. |
| Investigation charge |
Exact additional charge not established |
Investigation authority does not itself establish a fixed fee. |
| Late charge |
No fixed ordinary late-renewal charge verified |
Lapse, new-application treatment, and possible penalties are different from a verified late fee. |
| Retroactive licensing |
$10,000 civil penalty, plus satisfaction of other licensing requirements |
Not the ordinary application charge and not prospective permission to operate unlicensed. |
| Bond: up to five collectors |
$10,000 penal sum |
Rule 201(a)(2). |
| Bond: six through twelve collectors |
$20,000 penal sum |
Same rule. |
| Bond: more than twelve collectors |
$25,000 penal sum |
Same rule. |
| Statutory bond range |
$10,000–$50,000 for each location |
Section 306; security subject to Board approval. |
| Premium/collateral |
Not fixed by the reviewed government amounts |
Private surety pricing and collateral are separate. |
| Indexing |
No CPI/indexing formula verified |
No inflation calculation is supplied. |
The 2025 Board report independently lists $125 annual licensing and $20 employee/manager charges, but that report supports administrative practice; it does not replace the statute or final rule. C030–C034, C049, C057–C062. Arkansas Legislature+2
Collector-count limitations
The rule uses collector count, not annual receipts, purchased face value, collections volume, or number of accounts. It defines “collector,” “manager,” and “solicitor” separately.
The materials read do not expressly settle every counting question: full-time equivalents versus persons, part-time staff, counting across locations, Arkansas-only versus total agency staff, a lookback period, a measurement date, or when a manager also counts as a collector. The models below therefore stipulate that the count has been correctly established. C059–C060.
B3. Grant, pending application, renewal, and lapse are different states
The renewal rule uses a March/January distinction:
- Licenses issued March 1–December 31 expire June 30 of the following year.
- Licenses issued in January or February expire June 30 of that year.
- Renewal requires updated application materials and the same licensing/employee charges.
- The rule says failure to complete renewal by June 30 permits expiration treatment; a later licensing request is treated as a new application. Lack of a reminder is not an excuse. C037–C040. Arkansas General Assembly
Two qualifications prevent overstatement:
Pending-renewal protection. Section 25-15-211(b) preserves an existing license where a timely and sufficient renewal—or qualifying continuing-activity license application—has been made, through the agency determination and specified review period. This is not permission for an unlicensed first-time applicant. C041–C042. Justia Law
Appeal-related continuation. Section 17-24-308(c) contains a specific continuation provision for a license holder appealing specified adverse licensing action. The general APA judicial-review provision says filing a petition does not itself stay enforcement. Their exact application must be reconciled for the particular order and appeal; neither “all appeals preserve operation” nor “no appeal can preserve operation” is justified here. C053–C055. Justia Law+1
No actual expiration, renewal sufficiency, appeal deadline, or operating authorization is determined.

C. Security: what the bond does and does not establish
C1. Penal sum, aggregate exposure, and cancellation
Section 17-24-306 requires a Board-payable surety bond. The surety’s aggregate liability for breaches cannot exceed the bond amount. The surety may cancel upon thirty days’ notice to the Board, with the stated protection against liability for breaches occurring after effective cancellation. That does not automatically erase liability for an earlier breach. C058–C065. Justia Law
The license rule separately treats bond cancellation or nonrenewal as a termination event. The actual cancellation date, replacement security, Board action, and any qualifying statutory continuation must therefore be established rather than inferred from a premium invoice. C048, C065.
The inaccessible blank bond leaves additional form-level matters unresolved: execution and acknowledgment requirements, precise surety-qualification language, power-of-attorney attachments, and any approved endorsements. The statute’s requirement for Board-approved security was read; those unseen form terms were not invented.
C2. Limited claim procedure
Rule 280-403 begins with a Board finding that the licensee failed to pay its client or clients. It then provides notice, a ninety-day claim period, supporting documentation, a hearing after that period, claim approval or denial, and pro-rata distribution if approved claims exceed available bond proceeds. Notice may use certified mail and/or the specified statewide publication. C066–C069. Arkansas General Assembly
This establishes an administrative security pathway. It does not establish:
- That every debtor is entitled to the full penal sum.
- That an allegation automatically produces payment.
- That every asserted statutory violation is covered by the bond.
- That the bond amount is available separately for each claimant.
- That a payment to a creditor-client is a second credit against the debtor’s already credited payment.
Full surety litigation, other claimant classes, defenses, limitations, and private causes of action remain deferred.
C3. A different security requirement for nonresident litigation
Section 17-24-404 addresses security in specified litigation against a nonresident collector served under the associated provisions. The court may require cash, securities, or a bond with sufficient surety in a court-fixed amount, subject to the statutory waiver and postponement provisions.
That is not the § 306 licensing bond, not the Rule 201 tier schedule, and not an ordinary annual license charge. The associated service charge likewise should not be placed in every agency’s licensing-cost model. C070. Justia Law+1
C4. Retroactive licensing and remedies: a retained conflict
Act 1249 of 2015 and Rule 202 supply a retroactive-licensing mechanism. The rule describes its period as beginning with the agency’s initial Arkansas collection activity and ending when the retroactive license is issued; future collection requires regular licensure. C049–C050. Arkansas Legislature+1
But the legal effect on other claims cannot be assumed:
- Section 103 contains limiting language about the consequences/remedies of failure to obtain a license and Board jurisdiction.
- Rule 402(a)(2) says its penalties do not preclude private causes concerning unlicensed collection.
- CACH v. Echols treated the claimed effect of retroactive licensing as a merits issue, not something resolved by that class-certification appeal.
This report does not resolve the full statutory/rule/remedies interaction as either universal immunity or unrestricted private recovery. C051–C052. Justia Law+2
D. Narrow federal comparison and published authorities
D1. Four separate legal questions
| Question |
Governing inquiry |
| Arkansas collection-agency license |
State activity definition, exclusions, nexus, and licensing requirements. |
| Federal FDCPA/Regulation F collector status |
Consumer-debt predicate, principal-purpose or regular-collection branch, and federal exclusions. |
| Debtor-side adjusting permission |
Separate Arkansas and federal framework, not decided here. |
| Validity and timeliness of the particular debt |
Separate contract, payment, limitation, judgment, and other defenses. |
A favorable result under one row does not establish the others. C076–C085.
Federal law defines covered debt around personal, family, or household transactions. Its collector definition contains separate principal-purpose and regular collection of another’s debt branches. It also addresses false-name collection and specific exclusions for employees, qualifying affiliates, certain government and process-service acts, bona fide nonprofit counseling, and specified fiduciary/originated/predefault/secured-commercial-credit situations. Those exclusions have their own predicates. C076–C083. Legal Information Institute+1
D2. Published-opinion ledger
| Authority |
Court/date, posture, and holding actually read |
Limits, separate writing, and later treatment |
| Simpson v. Cavalry SPV I, LLC, 2014 Ark. 363 — S029 |
Arkansas Supreme Court, September 11, 2014; certified questions. A purchaser of delinquent debts that hired a licensed collector or attorney remained a collection agency required to obtain its own license. |
Rejected the 2012 Board clarification presented to it. Material majority body read; no separate writing shown. Applied the then-existing statute; 2023 enacted definition also read. No complete citator. |
| CACH, LLC v. Echols, 2016 Ark. 446 — S030 |
Arkansas Supreme Court, December 8, 2016; class-certification appeal. Affirmed certification; retroactive-license merits defense did not dispose of the appeal. |
Does not decide every claim was cured, every consumer wins, or every retroactive license is invalid. Relevant majority portions read; no separate writing shown. |
| Henson v. Santander Consumer USA Inc., 582 U.S. 79 — S033 |
U.S. Supreme Court, June 12, 2017; unanimous. A purchaser collecting debts it owned did not satisfy the particular “owed another” branch adjudicated. |
The principal-purpose branch was expressly not decided. Material majority body read, not used as a blanket debt-buyer exemption. |
| Reygadas v. DNF Associates, LLC, 982 F.3d 1119 — S034 |
Eighth Circuit, December 14, 2020; published. Principal-purpose status can encompass a business purchasing defaulted debts and employing outside collectors. |
Status was not defeated merely by outsourcing. The court vacated/remanded the liability judgment on a separate agency/knowledge issue. No universal vicarious-liability holding. Full material majority read; no separate writing shown. |
| Heintz v. Jenkins, 514 U.S. 291 — S035 |
U.S. Supreme Court, April 18, 1995; unanimous. Lawyers regularly collecting consumer debt through litigation can be FDCPA debt collectors. |
Arkansas attorney licensing exclusion is not a federal blanket attorney exemption. Material majority and statutory-history passages read. |
The principal-purpose holding in Reygadas complements the question left open in Henson; it does not overrule Henson. State Simpson classification is a separate statutory analysis. Justia Law+3
No nonprecedential opinion is relied on as controlling. No complete current citator or universal absence-of-authority conclusion is claimed. No responsive published collection-agency bond decision was adopted by analogy from unrelated payday-lender security cases.
E. Seventeen fictional postures and three worked models
All entities, dates, staff counts, premiums, collateral, accounts, payments, and decisions below are fictional. These are conditional calculations and boundaries—not licensing decisions, filing instructions, or actual bond claims.
Model 1 / P01 — Regulatory cost, premium, and collateral
Assumptions: One location; an ordinary licensing period of July 1, 2026–June 30, 2027; four collectors and one manager, five covered employee registrations total. The manager’s collector-count treatment does not change the lowest bond tier because the maximum count under these facts is five. No extra person or location is assumed.
Verified government charges

- Premium: $450.
- Refundable collateral deposit: $2,000.
- Required penal sum on the assumed count: $10,000.
Charges plus premium=225+450=$675\text{Charges plus premium}=225+450=\boxed{$675}Charges plus premium=225+450=$675Total initial cash outflow=675+2,000=$2,675\text{Total initial cash outflow}=675+2{,}000=\boxed{$2{,}675}Total initial cash outflow=675+2,000=$2,675For this simplified model, $2,000 remains a collateral asset rather than an expense. The $10,000 penal sum is not an additional cash expense. Accounting recognition in an actual business depends on the real contract and accounting rules.
Adverse branches: Another location requires separate licensing and security. Additional covered employees change registration charges. A different surety premium or collateral demand changes cash outflow, not the government fee. None of these costs is automatically chargeable to a debtor. C030–C034, C058–C062, C075.
Model 2 / P02 — Verified bond tiers, with metric uncertainty isolated
Assume the Board-applicable collector count NNN has been correctly established for the location/model under consideration.
B(N)={$10,000,N≤5$20,000,6≤N≤12$25,000,N>12B(N)=

| 12 | $20,000 | $0 from the six-person tier |
| 13 | $25,000 | +$5,000 |
The unit is dollars of bond penal coverage, not dollars of premium. No annual-receipts denominator or percentage is used. The statutory $50,000 maximum does not automatically become the required amount at thirteen collectors.
Let P(N)P(N)P(N) be the actual quoted premium. Without a quote:
Premium cost=P(N),not B(N)\text{Premium cost}=P(N),\quad\text{not }B(N)Premium cost=P(N),not B(N)Adverse branches: A dispute about headcount, multiple locations, part-time staff, or manager classification cannot be solved by this arithmetic. The rules do not supply a fully explicit measurement period or all counting conventions. C058–C062.

Net debtor payment credited=2,400−150=$2,250\text{Net debtor payment credited}=2{,}400-150=$2{,}250Net debtor payment credited=2,400−150=$2,250The debtor’s separate account has:
- Original principal: $8,000.
- Stipulated lawful interest: $120.
- Net actual payment credits: $2,250.
- Additional creditor-granted, noncash credit: $100.
8,000+120−2,250−100=$5,7708{,}000+120-2{,}250-100=\boxed{$5{,}770}8,000+120−2,250−100=$5,770The $2,000 remittance is not another debtor payment; it transfers money already credited. The $100 noncash credit reduces the debt but does not change the agency’s cash.
On the rule’s calendar-month formulation, September collections are to be remitted by the end of October. No actual filing calendar or claim eligibility is calculated. If the remaining $250 is not properly remitted or otherwise lawfully disposed of, the separate statutory consequences require analysis.
Bond accounting: Assumed bond award = $0. Neither the $250 client balance nor the $10,000 penal sum is treated as an automatic award. C066–C075.
Fourteen additional postures
| Posture |
Fictional facts |
Bounded result / adverse branch |
| P04 — Self-creditor |
A merchant collects its own originated invoice using its true name. |
No another-debt or purchased-default predicate established; still test other covered activities. |
| P05 — Other name |
Same merchant uses a separate collection-style name. |
Express other-name branch becomes material; ownership alone is insufficient. |
| P06 — Performing purchase |
Accounts are bought for value while current, then become delinquent. |
Acquisition-time facts and own-name collection are central to § 102(a)(10). |
| P07 — Defaulted purchase outsourced |
Buyer acquires defaulted accounts and hires a licensed agency. |
Simpson defeats a blanket outsourcing exemption. |
| P08 — Inert investment |
Investor holds an economic interest but takes no collection action or collection arrangement. |
Exact beneficial ownership and activities remain held; “passive” label is not dispositive. |
| P09 — Remote collector |
Out-of-state agency solicits Arkansas collection business by telephone. |
Section 401 is material; absence of an Arkansas office is not a categorical exemption. |
| P10 — Servicer |
Servicer begins before default and later collects delinquent payments for the owner. |
Federal predefault exclusion and Arkansas licensing are separate; no automatic state servicer exemption. |
| P11 — Affiliate/employee |
One employee works for a single creditor; another company collects for three affiliates. |
The employee exclusion does not automatically encompass the separate affiliate company. |
| P12 — Attorney |
Arkansas lawyer renders actual collection legal services; a nonlawyer vendor uses the lawyer’s branding. |
Lawyer’s statutory conditions must be established; vendor does not automatically inherit them. |
| P13 — Mixed debts |
Agency collects household medical bills and commercial supply invoices. |
Federal debt coverage differs by transaction; state licensing is not automatically limited to the household accounts. |
| P14 — New location/ownership |
Agency opens a second office and sells 60% of its equity. |
Separate location requirements, nontransferability, ownership notice, and termination provisions all matter. |
| P15 — Renewal pending versus late |
Existing licensee submits a sufficient timely renewal; another sends incomplete papers after expiration. |
APA continuation may protect the first; it is not established for the second. |
| P16 — Bond cancellation |
Surety sends notice to the Board; an alleged breach predates effective cancellation. |
Cancellation and license effects must be separated from possible earlier-breach liability. No payment promised. |
| P17 — Retroactive license |
Previously unlicensed actor seeks retroactive approval and then wants to continue collecting. |
Other conditions and civil penalty apply; prospective activity requires regular licensure; private-remedy effect remains held. |

Actually established through fresh reading: the official collection-agency definition enactment; the material licensing, fee, bond and retroactive amendments; official codified Board rules; the listed Code reproductions; responsive Arkansas and federal opinion bodies; federal actor definitions; and the seventy-five-name county inventory.

The most consequential remaining holds are the renewal/appeal continuation interaction, collector counting and multi-location application, form-level surety requirements, and retroactive-license/private-remedy consequences. None is converted into permission or nonexistence.
Register counts: 40 source/access records; 90 atomic claims; 5 published-opinion entries; 17 fictional postures including 3 worked models; 16 workflow rows; 28 core-coverage rows; 8 currentness rows; 3 model rows; 11 deferred-family rows; 75 individual county holds plus 4 additional territorial/routing holds; and 1 P01 crosswalk.
