Arkansas ordinary money-judgment bank garnishment, ownership, protected funds, and exemption claims
Research access date: October 27, 2026. Exact source-opening times were not logged and are unknown.
Provenance: PASS-01 through PASS-03 remain unchanged. The coordinator’s October 27, 2026, 09:51:35.803435Z review is supplied review history—not an independent review, source-opening timestamp, or current-law certificate. Precisely identified reuse is distinguished below from fresh reading.
Scope: Ordinary postjudgment process against bank-held money and other non-earnings money, with the necessary ownership, personal-property selection, exemption-claim, contest, payment, and release pathways. Payroll calculations, underlying judgment merits, provider regulation, and the other deferred families are not reopened.
Principal conclusions
A bank balance is not one undifferentiated garnishable asset. The analysis must separate the bank’s automatic federal review, additional source-based exemptions, actual ownership, Arkansas property selection, the amount authorized by the order, and the remaining judgment. A freeze is not a payment to the creditor, and service does not itself adjudicate beneficial ownership. C014–C022, C035–C060. Justia Law+2
For a qualifying account, 31 C.F.R. Part 212 requires the bank to protect an amount without a debtor’s exemption claim or tracing demand. Money above that automatic amount may nevertheless remain exempt under federal benefit law or Arkansas law. Conversely, a deposit that fails Part 212’s identification or lookback conditions is not thereby declared nonexempt. C025–C046. eCFR+2
Arkansas’s bank-default provision, § 16-110-406, is materially different from the employer-default analysis in PASS-03. Its stated predicates include specified financial institutions domiciled in Arkansas, service at least ten days before the return day, and failure to answer by that return day. Its monetary measure includes debtor property held at service and afterward through the return day. That “ten days” is not a universal ten-day bank-answer deadline. C011–C018. Justia Law+1
Currentness remains partial. Fresh primary enactments, current federal regulatory text, published judicial bodies, and two June 2026 rule-adoption orders were obtained. A complete current official Arkansas Code and court-rule compilation, a full citator, and current local bank packets were not. No conclusion below silently removes those limitations.
In the following tables, S001 means S_AR-P04-S001, and C001 means S_AR-P04-C001.
A. Substantive analysis
A1. The Arkansas bank process is not the payroll process
Sections 16-110-401–405 supply the ordinary application, writ, notice, interrogatory, answer, and answer-contest framework. Section 406 adds a specific bank-default rule. Sections 409–411 address surrender, adjudication, discharge, and responsibility for the property covered by a garnishment judgment. Sections 415–416 concern employers and wage process; they do not establish a continuing-bank-account formula. C001–C023, C096. Sources S009–S021.
Three distinctions matter.
First, an answer is not an ownership judgment. A garnishee’s sworn response supplies information about what it holds or owes. The creditor may dispute an insufficient or untrue answer. A third party’s ownership and the debtor’s exemption rights require their own applicable procedures and evidence. C011, C019–C022, C056–C058. Justia Law+2
Second, holding money is not paying it. In Eagle Bank & Trust Co. v. Raynor Manufacturing Co., the Court of Appeals rejected a bank’s reliance on a general UCC “reasonable time” theory to avoid its specific garnishment obligations. The case involved a corporate debtor and nonexempt funds deposited after service and then transferred away. It did not decide that Part 212’s natural-person benefit review can be bypassed. C017–C018. Justia Law
Third, default liability is bounded and statute-specific. Section 406 does not simply award the entire consumer judgment regardless of what the bank held. Section 407’s more general nonanswer procedure must not be substituted for § 406 without establishing the institution, procedural posture, and governing authority. The exact modern reconciliation of all return-day, answer-period, and default provisions remains partially held. C012–C016. Justia Law+1
The published Woodcock opinion potentially bears on the duration of a bank’s exposure, but its full underlying body was not obtained in this pass. Eagle Bank’s quotation of it was read; that is not a fresh reading of Woodcock itself.
A2. Part 212: automatic protection before further exemption litigation
Coverage and identification
Part 212’s account-holder definition concerns a natural person named in the order and shown in the financial institution’s records as a direct or beneficial account owner. Its financial-institution definition includes banks, savings associations, credit unions, and other qualifying chartered banking entities. That federal definition is broader than § 16-110-406’s particular Arkansas bank-default wording. C024. eCFR
A qualifying “benefit payment” is not established merely by a consumer’s statement that a deposit was “government money.” The regulation identifies covered programs and requires the specified direct-deposit coding: “XX” in positions 54–55 of the Company Entry Description and “2” in the Originator Status Code field of the Batch Header Record. C025–C026. eCFR
Initial review, lookback, and protected amount
The institution first checks whether the order carries the prescribed federal-government or state-child-support Notice of Right to Garnish Federal Benefits. Without that exception notice, the ordinary review generally must occur within two business days after receipt of both the order and sufficient identifying information, subject to the regulation’s stated qualifications. C027–C031. eCFR+1
For each account separately:
P=min(Q,B)P=\min(Q,B)P=min(Q,B)where:
- QQQ is the sum of qualifying benefit payments posted during the regulatory lookback;
- BBB is the account balance when the review is performed;
- PPP is the automatic protected amount.
The lookback is a two-calendar-month period defined by § 212.3—not a generic 60-day period. Intraday transactions can affect BBB. A deposit made on the review date is outside the lookback even though it may be included in the reviewed balance. C033–C035. eCFR+1
The review is performed despite commingling, multiple beneficiaries, multiple covered programs, or joint owners. The bank must not require inter-account tracing to calculate the automatic amount. C032–C033. eCFR
What the bank must—and must not—do afterward
The holder must retain customary access to PPP, without first filing an exemption claim. The regulation treats properly established PPP as conclusively exempt. Excess money follows otherwise applicable procedures, but “excess” does not mean “finally adjudicated nonexempt.” C036–C038. eCFR
In the qualifying-review branch, the same order does not authorize a continuing freeze of later deposits. Re-service of the same order does not trigger another review; a genuinely new or different order does. This does not create stacked protected balances simply because several writs exist. C039–C040. eCFR
A garnishment fee cannot be charged against PPP. The regulation separately permits a limited later-fee branch involving new non-benefit deposits within five business days, bounded by those deposits. This is not a general Arkansas fee schedule or authorization for an otherwise unlawful charge. C041–C042. GovInfo
When qualifying benefits, a positive protected amount, and excess funds coexist, the bank must send the prescribed notice within three business days after review. The optional Appendix A model and Appendix B exception notice serve different purposes. C043–C045. eCFR+1
A3. Protection beyond the automatic amount
Social Security: Section 407 protects covered money paid or payable, subject to statutory exceptions. Philpott held that the deposited retroactive benefits at issue retained their protected character as readily withdrawable money. Thus, a check deposit’s failure to satisfy Part 212’s automatic-direct-deposit test is not the end of the statutory analysis. C051–C052. Social Security+1
Veterans’ benefits: Section 5301 and Porter supply a distinct protection. Porter concerned benefits kept available for support and maintenance rather than converted into permanent investments. It is not a universal rule protecting every asset purchased with benefits. C053–C054. Legal Information Institute+1
Arkansas state claims: Bennett v. Arkansas rejected an implied exception allowing the State to take Social Security money for prison costs. The Court’s decision addressed Social Security; it did not decide every veterans-benefit question mentioned in the litigation history. C055. Justia Law
No universal commingling algorithm—such as first-in-first-out, proportional allocation, or lowest-intermediate-balance accounting—was established for all benefit and ownership claims in Arkansas. Outside the automatic Part 212 calculation, the necessary source identification, legal exemption, remaining interest in the funds, and procedural remedy must be established. C059.
A4. Joint accounts: title is evidence, not the final answer
Hayden v. Gardner adopted a rebuttable approach: joint funds are prima facie reachable, but the actual debtor-owned portion controls after proof. Each depositor bears the burden of establishing that depositor’s share; contributions and intended gifts may matter. The court did not create an automatic half-exemption. C056. CaseMine
Maloy applied that framework adversely to the debtor on its record. Its majority did not require the creditor first to prove a completed gift. Its treatment of the mother’s participation and joinder was fact-specific; the dissent took a different view. C057–C058. Justia Law
These ownership questions are separate from Part 212’s automatic review. A bank calculating PPP does not first conduct a trial of each co-owner’s contributions. Conversely, proving that money belongs to a nondebtor is not merely claiming the debtor’s $200/$500 personal-property allowance.
A5. Arkansas selection and claim clocks
The supplied reviewed constitutional text is reused with its original limits: resident status, marital/head-of-family conditions, contract-debt character, selection of particular property, apparel treatment, and the purchase-money proviso. The $200/$500 figures are not recurring account, paycheck, or writ allowances. C061–C063.
The fresh § 16-66-211 reproduction requires a verified inventory that includes money and credits held by others, with selected property identified. Its notice procedure differs from § 16-110-402. Act 740 of 2023 independently confirms the 45-day final-judgment schedule requirement and removal of the residency restriction from that schedule duty; it does not remove residency conditions from Article 9. C064–C067. Justia Law+1
Act 932 of 2015 confirms a post-service claim under § 402, claimant notice within five days by fax plus concurrent mailing, and a creditor contest measured from the claim’s filing. The deleted eight-working-day hearing provision was freshly checked in the page image. C068–C072. Arkansas Legislature
The complete modern integration of §§ 208, 211, 221, and 402 remains held. Neither a universal day-46 forfeiture nor unlimited recovery after a payment order is established. Importantly, this state-clock uncertainty does not erase the bank’s independent automatic duties under Part 212. C036, C074–C076.
A6. Preventing double counting
The analytical sequence is:
- Establish the actual account balance and order.
- Establish automatic PPP, where Part 212 applies.
- Identify additional legally protected money not already counted in PPP.
- Establish nondebtor ownership, avoiding overlap with protected money already counted.
- Determine any remaining valid Arkansas selection.
- Limit any creditor payment to the adjudicated reachable amount and remaining judgment.
This is an accounting framework, not a newly discovered statutory priority rule. Where categories overlap, subtract their union, not the sum of overlapping labels:
Potentially reachable balance=max (0, B−∣P∪F∪O∪S∣)\text{Potentially reachable balance}
\max!\left(0,\ B-\left|P\cup F\cup O\cup S\right|\right)Potentially reachable balance=max(0, B−∣P∪F∪O∪S∣)Here FFF means further established statutory protection, OOO proven nondebtor ownership, and SSS an applicable selected-property exemption. The exact treatment of federally protected property within Arkansas’s inventory/selection process remains a harmonization hold. C060, C064, C074.
B. Actor, event, notice, deadline, and effect decision table

Identify payable, retained, and released sums; apply the actual order. |
C020–C022, C060; no private order assumed. |
| W17 |
Judgment paid |
Record satisfaction and release under applicable procedure; partial payment reduces debt but is not full satisfaction. |
C023; current primary chain and ledger absent. |
| W18 |
Later deposit or another order |
In qualifying Part 212 branch, same order does not freeze future deposits; a new order requires a new review. |
C039–C042; outside that branch, state duration/priority issues remain held. |
The state notice and federal review clocks arise from different actors and events. Combining them into one generic “ten-day garnishment deadline” would be inaccurate. Arkansas Legislature+3
C. Judicial bodies and rule-adoption orders actually examined
| Authority |
Court/date; posture and material facts |
Operative holding/order; separate writing and limits |
| Hayden v. Gardner, 238 Ark. 351, 381 S.W.2d 752 — S027 |
Arkansas Supreme Court, September 14, 1964. Tort judgment; joint spousal account; trial court assumed divided ownership and quashed. |
Reversed/remanded. Joint funds prima facie reachable; depositors prove actual shares. Wife to be joined on remand. No separate writing shown. Maloy’s later treatment was freshly read; complete citator not obtained. |
| Maloy v. Stuttgart Memorial Hospital, 316 Ark. 447, 872 S.W.2d 401 — S028 |
Arkansas Supreme Court, March 28, 1994. Mother/daughter certificates of deposit; disputed contributions and gift intent. |
Affirmed under Hayden. Majority rejected automatic creditor burden to prove gift and found no reversible joinder defect on this participation record. Corbin dissented concerning ownership/joinder. No universal no-joinder rule. |
| Eagle Bank & Trust v. Raynor Manufacturing, 2019 Ark. App. 168 — S029 |
Arkansas Court of Appeals, March 13, 2019. Corporate debtor’s closed account reopened after service, received funds, then transferred them out. |
Affirmed bank liability; specific garnishment law controlled over asserted UCC processing time. Proper answer assumed without deciding. No separate opinion. Does not adjudicate Part 212 protection for natural-person beneficiaries. |
| Duhon v. Gravett, 302 Ark. 358, 790 S.W.2d 155 — S030 |
Arkansas Supreme Court, May 29, 1990. Household-property execution; redemption; public-interest exception to mootness. |
Reversed/remanded because the old process failed to notify debtor of possible exemptions. Not a holding invalidating modern § 402 bank procedure. Underlying Davis quotation was not a fresh Davis read here. |
| Philpott v. Essex County Welfare Board, 409 U.S. 413 — S031 |
U.S. Supreme Court, January 10, 1973. Retroactive Social Security check deposited in trustee account; state sought welfare reimbursement. |
Reversed. Readily withdrawable funds retained protected monetary character; no implied state-reimbursement exception. Full majority and material footnotes read. Later Bennett treatment read. |
| Porter v. Aetna, 370 U.S. 159 — S032 |
U.S. Supreme Court, June 11, 1962. Veterans’ benefits held in savings-and-loan accounts for support. |
Reversed. Available benefit money not converted into permanent investment remained protected. Douglas separately emphasized liquidity. Chief Justice and Frankfurter did not participate. Later Philpott treatment read. |
| Bennett v. Arkansas, 485 U.S. 395 — S033 |
U.S. Supreme Court, March 29, 1988. Arkansas sought Social Security money for incarceration costs. |
Per curiam reversal; no implied care-and-maintenance exception. Footnote limits the petition before the Court to the Social Security claimant. No separate writing shown. |
| Sanford v. Otasco, 268 Ark. 100, 590 S.W.2d 285 — S034 |
Dated reuse: coordinator’s October 27, 09:51:35.803435Z review of majority and separate writings. |
Constitutional selection despite excess other inventory; majority did not invalidate wage statute. Not freshly reopened and not converted into a bank tracing rule. |
| In re James, 257 B.R. 673, 678–79 — S035 |
Dated reuse: same supplied review; Eighth Circuit BAP, 2001, payment-order/property-interest posture. |
Historical adverse timeliness/property-interest discussion. Predates 2015/2023 amendments; no universal modern day-46 forfeiture inferred. |
| Woodcock v. First Commercial Bank, 284 Ark. 490, 683 S.W.2d 605 — S049 |
Arkansas Supreme Court, February 4, 1985. Opening portion obtained; full body inaccessible. |
Held. Eagle Bank’s quotations were read, but underlying holding, complete facts, and current treatment were not independently established. |
| 2026 Ark. 109 — S050 |
Arkansas Supreme Court per curiam, June 4, 2026. Rule 6(d) amendment. |
Final adoption, effective that day, not proposal. Adds/clarifies electronic-filing service within the three-business-day service extension. Webb did not participate. Does not by itself extend filing-triggered § 402 contests. |
| 2026 Ark. 105 — S051 |
Arkansas Supreme Court per curiam, June 4, 2026. Rule 4(f)(4), incarcerated-person service. |
Final adoption, effective that day. Does not authenticate every corporate-bank service subsection. Webb did not participate. |
The actual majority/order bodies—not publisher headnotes—support this ledger. CaseMine+8
Court-route qualifications
Readable rule reproductions were obtained for Rules 4, 5, 6, 62, 69, 81, District Court Rules 1, 2, 10, Administrative Order 18, and appellate Rule 5-2. They are not an official consolidated October 2026 rule certificate.
The reproduced provisions distinguish summons service from subsequent-paper service; initial enforcement restrictions from discretionary stays; district-court nonjury procedure; small-claims enforcement discovery; and administrative routing when counsel appears. Small Claims Rule 10’s restriction on intervention creates a particular integration question when a nondebtor co-owner needs participation. That cannot be solved by simply importing circuit-court joinder practice. C077–C088, C097. Court Rules Network+4
The Rule 6(d) adoption order is stronger evidence than the private publisher’s update date. But the complete current chain for Rule 6(a), other relevant subsections, and their application to each statutory clock remains incomplete. No actual deadline is calculated here. Justia Law+1
D. Fifteen fictional postures, including three fully worked money models
All persons, accounts, orders, dates, and transactions below are invented. They are conditional accounting demonstrations, not findings of eligibility, lawful service, actual deadline compliance, or instructions to withhold or distribute money.
Unless stated otherwise: dollars are U.S. dollars; inputs are exact to cents; no interest, costs, garnishment fees, or other adjustments accrue during the illustrated interval. Those assumptions do not waive legally applicable amounts in a real case.
Model 1 / P01 — Lookback, transactions, protected amount, and later deposit
Assumed predicates: Natural-person holder; ordinary private-creditor order; no Appendix B exception notice; sufficient identifying information; the two Social Security deposits have the exact qualifying coding. Order received October 13, 2026; review performed October 15. Federal review timing is assumed satisfied.
The lookback runs backward from October 14 to August 14, applying § 212.3’s posting boundaries. None of these fictional benefit transactions falls on a disputed boundary date.

- Book balance: $4,600.
- Automatically protected and accessible: $2,800.
- Provisionally held excess: $1,800.
- Creditor payment: $0.
- Outstanding judgment: $5,000, unchanged.
Later event: On October 16 another $1,400 benefit deposit arrives.
4,600+1,400=6,0004{,}600+1{,}400=6{,}0004,600+1,400=6,000Under the qualifying same-order branch, that later deposit is not added to the freeze. The original PPP is not recalculated merely because this deposit arrives.
- Book balance: $6,000.
- Existing hold: $1,800.
- Available balance: $4,200.
- Judgment: still $5,000.
Adverse branches: A missing qualifying code or check deposit changes the automatic-review analysis, not necessarily the underlying benefit exemption. A fee cannot be taken from PPP. A new $40 non-benefit deposit within the regulatory five-business-day branch could support at most $40 from that new deposit, assuming the fee is otherwise lawful; that is not a universal $40 fee cap. - Additional benefit protection, if proved: $600, not $2,200 more.
- A co-owner proves $1,200 of separate ownership, with no overlap with the $2,200 benefit category.
- AAA is the remaining lawful Arkansas selection amount actually established after all applicable inventory and selection rules. It is symbolic because current applicability and the relevant facts are not established.

If the co-owner’s $1,200 instead overlaps money already counted as protected, it cannot be subtracted again. The union calculation governs the accounting. C056–C060, C064.
Model 3 / P03 — Claim, contest, adjudication, release, and debt reduction
Fictional events: Final judgment June 1; bank service and qualifying review June 16; claim June 18; fax and concurrent mailing June 19; written contest June 24; hearing July 15; order July 20; authorized transactions July 21. These dates are stipulated events, not a computed legal calendar.

- Bank balance B=$4,000B=$4,000B=$4,000.
- Automatic P=$1,000P=$1,000P=$1,000.
- Provisional excess hold: $3,000.
- No payment has yet reduced the judgment.
Assume the court later determines:
- Another $800 is exempt benefit money beyond PPP.
- $700 belongs to a nondebtor.
- The remaining $1,500 is payable to the creditor.

Adverse branches: No timely contest invokes the statutory uncontested-claim pathway, not an assumed instantaneous stay upon filing. A claim first raised after a payment order presents a different property-interest/remedy problem; the historical James discussion does not establish either universal forfeiture or automatic recovery. Automatic Part 212 protection remains analytically separate. C020–C023, C068–C074.
Twelve additional fresh boundary postures
| Posture |
Fictional facts |
Bounded result / adverse branch |
| P04 |
A Social Security check is deposited manually. |
May fail automatic direct-deposit identification; § 407/Philpott protection still requires consideration. C025, C051–C052. |
| P05 |
Benefit money is moved from Account A to Account B. |
Automatic review is account-specific and does not trace transfers between accounts. Separate source-based protection in B remains a proof question. C033, C046, C059. |
| P06 |
No qualifying benefit deposit appears in the lookback. |
Bank follows the nonqualifying-review branch; this does not establish that all funds are nonexempt. C030. |
| P07 |
Two joint owners receive qualifying benefits into one account. |
Review counts qualifying deposits without first allocating ownership between beneficiaries. Later ownership litigation is separate. C032, C056. |
| P08 |
Creditor serves the identical order again, then later serves a genuinely new order. |
Same-order repetition and new-order review differ; no stacked automatic exemption arithmetic. C039. |
| P09 |
Ordinary money arrives after a qualifying review. |
Same-order continuing freeze is barred by § 212.6(g); a new order changes the review event. C040. |
| P10 |
Order includes an Appendix B government/child-support notice. |
Automatic branch changes; substantive authority and benefit-specific exceptions still must be established. C028, C045. |
| P11 |
Garnishee is an out-of-state credit union. |
Federal Part 212 financial-institution coverage does not establish Arkansas § 406 domicile/type predicates. C013, C024. |
| P12 |
Creditor says a joint account is automatically half protected. |
Hayden does not create a 50% rule. Evidence of actual shares and applicable procedure matter. C056–C058. |
| P13 |
Debtor receives bank notice but no Arkansas debtor notice. |
The notices are not substitutes; defect and remedy require analysis. C005–C010, C043–C045, C073. |
| P14 |
Claimant is unmarried, household status disputed, and debt character unclear. |
No $500 selection assumed; residency, family status, contract character, inventory, and prior selections remain material. C061–C067. |
| P15 |
Money was already paid before a late claim; debtor also alleges bankruptcy or waiver invalidity. |
No automatic clawback, forfeiture, bankruptcy applicability, or waiver ruling. Actual orders and controlling procedural authority are required. C074, C095, C098. |

Unchanged remainder |
| P01: “Civil remedies, collection, litigation, limitations” later-pass row, plus registry property-enforcement dimension |
Adds bank/non-earnings-money ownership, federal automatic benefit review, selected-property claims, contest, adjudication and release analysis. |
Full remedies, limitations, underlying litigation, sectors, provider obligations and full state investigation remain open. |
| P03 excluded D06: bank accounts/cash balances/tracing |
Separately investigates that excluded component; does not treat payroll formulas or employer default as bank law. |
P03’s wage findings and all retained Code/rule/calendar/citator/local holds remain unchanged. |
H. Researcher self-check and remaining decision holds
Fresh bodies read: complete operative Part 212 material and appendices; relevant 2013 federal final-rule provisions; § 407 and the § 5301 reproduction; Acts 229, 932 and 740; the listed Arkansas Code reproductions; seven substantive published judicial decisions; the listed rule reproductions; and two final June 4, 2026 rule-adoption orders.
Precisely dated reuse: Article 9 §§ 1–2, Sanford, and the bounded James discussion supplied from the coordinator’s October 27 review. They were not described as fresh openings.
Not obtained: complete current official Arkansas Code/rules, original bank-specific 1913/1923 enactments, full Woodcock, complete later judicial treatment, a controlling universal tracing rule, full claim-clock harmonization, current local bank packets, or any actual account/judgment/service/ownership facts.
The following remain substantive holds, not merely formatting gaps:
- The exact present interaction of § 406’s return-day formulation, the enacted thirty-day notice, § 407, and timely versus defaulted bank answers.
- Additional-funds tracing and overlapping federal/state selection treatment beyond Part 212’s automatic calculation.
- Modern integration of the forty-five-day schedule, post-service exemption claim, advance-notice schedules, hearing, supersedeas, and post-payment remedies.
- Court-route-specific participation of a nondebtor co-owner.
- Current local implementation and the full official Code/rule/citator chain.
Register counts: 51 source/access records; 98 atomic claims; 18 workflow rows; 30 core rows; 10 currentness rows; 3 model rows; 12 deferred-family rows; 75 county rows plus 5 additional territorial/institutional holds; and 2 crosswalk rows. No state, provider, component, parent, A066, A097 or A098 acceptance is implied. No independent review, local write, filing, private-record lookup, or publication-readiness claim is made.
