SettleADebt — S_AR PASS-11
Arkansas ordinary consumer money-debt merits, plaintiff identity, assignment, account proof, and business records
Research/access date: October 27, 2026. Exact source-opening times were not logged and are unknown. The October 22 baseline is not a fresh-verification date.
Provenance: Earlier raw answers remain unchanged. The supplied coordinator-review history is not an independent review or source-opening record. No conclusion from an unreviewed earlier pass was adopted as a merits premise. No private account, contract, assignment schedule, court record, or actual party status was examined.
Scope: Ordinary contract/account liability, the plaintiff’s right to enforce the particular obligation, admissibility and sufficiency of account evidence, and the amount proved. Procedural rules are addressed only where they change those pleading or proof burdens.
Principal findings
Arkansas law separates at least four questions: whether an obligation exists, whether this plaintiff may enforce it, whether the offered evidence is admissible, and whether the admissible evidence proves the amount demanded. A favorable answer to one does not automatically answer the others. C001–C004, C017–C025, C036–C045. Justia Law+2
Two 2026 rule changes are material. Effective January 29, 2026, Arkansas adopted Evidence Rule 902(11)–(13), adding certification routes for qualifying business records and copied electronic data. Effective June 4, 2026, the court adopted material discovery changes, including proportionality and specific-objection requirements. Neither a 2025 proposal nor a publisher’s update date substitutes for these final orders. C055–C059, C066–C069. Justia Law+1
A compliant account affidavit is not a universal substitute for the underlying case. Section 16-45-104 supplies a specific evidentiary route, subject to a sworn-denial provision. LVNV Funding v. Nardi nevertheless held that the statute did not excuse Rule 10(d)’s pleading attachment requirement. Harp separately required proof of credit-card authorization under the applicable federal statute. C006–C008, C032–C035, C075–C079. Justia Law+1
Predecessor records are neither automatically admissible nor automatically excluded. A qualified recipient-business witness can sometimes establish reliable incorporation and use. Mere possession of another company’s paper is not enough. The new certification provisions change the available method of foundation, not the need for an adequate foundation. C039–C045, C055–C062. Justia Law+2
Assignment proof is conditional, not a universal document checklist. Arkansas has a special statute relieving an assignee of certain proof unless a qualifying sworn forgery denial is made. But Beal Bank v. Thornton did not permit that statute to cure a missing assignment writing or missing chain link. A generic portfolio purchase does not, without connecting evidence, identify the particular account. C019–C029, C099 is not used; see C022–C025 below. Justia Law+1
The final registers use C001–C096 only. In this report, S001 means S_AR-P11-S001, and C001 means S_AR-P11-C001. Full literal URLs and reading limits appear in the source register.
A. Causes of action, elements, and proof burdens
A1. Merits matrix
| Theory or issue |
What must be established |
Who bears the pertinent burden |
What is not established merely by a statement or affidavit |
| Express contract |
Competent parties, subject matter, consideration, mutual agreement and obligation; sufficiently definite terms; plaintiff’s relevant right; breach; resulting loss. |
Plaintiff establishes its claim; particular defenses have separate pleading/proof requirements. |
A balance statement does not independently establish every contract term, assent, or legal charge. C002–C004. |
| Written-contract pleading |
Facts supporting the claim and the instrument on which the claim is based, unless the Rule 10(d) good-cause qualification applies. |
Pleader must satisfy the rule. |
An affidavit under § 16-45-104 does not categorically excuse the attachment. C006–C007. |
| Amended pleading |
A permissible amendment may supply a missing attachment, subject to the applicable prejudice/delay rules. |
The court applies Rule 15; merits remain for later determination. |
Gemini did not declare the debt proved merely because amendment was permitted. C008. |
| Open account |
An account arising from the actual transactions and terms, with unsettled or running-account characteristics shown by evidence. |
Claimant proves the transactions, applicable obligation, credits, and amount. |
“Open account” is not a label that eliminates contractual or transaction proof. C009. |
| Account stated |
Prior monetary transactions plus agreement that the account items and balance are correct, with an express or implied promise to pay that balance. |
Claimant must first establish the stated-account predicate. Once established, the account is prima facie evidence, subject to rebuttal for fraud, mistake or error. |
Mailing a statement or receiving no immediate response is not a universal adjudication of assent. C010–C012. |
| Unjust enrichment or related equitable alternative |
A benefit received and circumstances making retention inequitable, subject to the governing doctrine and the contract relationship. |
Party seeking restitution must establish its elements. |
An existing valid express contract ordinarily prevents using unjust enrichment to rewrite the same subject; recognized exceptions require facts. C014. |
| Credit-card authorization |
Under applicable 15 U.S.C. § 1643(b), authorization or the conditions supporting limited unauthorized-use liability. |
Card issuer bears the statutory burden; Harp applied it to the assignee’s claim. |
A statement bearing a name and address is not automatically sufficient authorization proof. C075–C079. |
| Choice of law |
Effective contractual choice, the issue involved, and relevant transaction contacts where no effective choice controls. |
The party asserting a legal result must supply the needed contractual and factual basis. |
Arkansas forum, debtor residence, or a generic form clause does not automatically settle every substantive issue. C015–C016. |
City of Dardanelle states the general formation requirements and the need for sufficiently definite obligations. Rabalaias addresses pleading a contract, obligation, breach and damages. Both must be used in their actual procedural settings rather than treated as proof that an unseen consumer agreement exists. Justia Law+1
A2. Account stated is not a universal silence rule
In Foscue v. McDaniel, the trial court’s finding that a particular letter constituted an account stated was not challenged on appeal. The Supreme Court therefore addressed whether the debtor had supplied specific evidence of error and whether the counterclaim had been properly disposed of.
The court rejected conclusory responses as insufficient, but ultimately reversed because the amended counterclaim and supporting accounting evidence raised unresolved issues involving additional loans. The opinion is not a holding that every creditor statement becomes an account stated after silence. C010–C012. FindLaw Caselaw+1
Likewise, Portfolio Recovery Associates v. Barnes was dismissed for lack of a final appealable order. It is not a merits holding approving account stated as a way to avoid contract attachment or proof. C013. Justia Law
A3. Terms that can be material to an ordinary debt claim
The particular theory may require proof of the applicable account agreement and version, identity of the contracting parties, acceptance or authorized use, transaction dates, payment duties, interest rate and calculation method, fee-trigger provisions, amendments and their applicability, credits, and the event constituting breach.
This is a functional evidence list, not a rule that every case requires every listed document. Admissions, stipulations, testimony, authenticated electronic records, duplicates, and applicable statutory proof provisions can affect what must be separately proved. No universal ink-signed-original requirement was established. C004–C005, C047–C054. Justia Law+1
B. Plaintiff identity, assignment, and the particular account
B1. Distinct questions
| Question |
Evidence that can matter |
Why the distinction matters |
| Real party in interest |
The asserted substantive right and any Rule 17 representative capacity. |
A person entitled to enforce is not determined solely by whose letterhead appears on a statement. |
| Capacity |
Entity existence, representative status, authority and a properly raised capacity issue. |
Capacity to litigate is not proof of ownership of this account. |
| Original creditor |
Origination agreement, account creation, transactions, and any transfer away. |
Original issuance does not prove continued ownership after a sale. |
| Assignee |
Actual assignment, scope, effective date and account inclusion. |
Purchase of a portfolio does not identify every account in it. |
| Successive buyer |
Each legally material link from the prior owner to the plaintiff. |
A sound final bill of sale does not repair an unproved earlier link. |
| Servicer or agent |
Servicing/agency agreement, scope, relevant time, and authority to receive, settle or enforce. |
Collection or payment-processing authority is not automatically beneficial ownership or the right to sue in one’s own name. |
Rule 17 permits specified representatives and provides a reasonable opportunity for ratification, joinder, or substitution after a real-party objection. That procedural provision does not manufacture a substantive right or erase every defect in a filed claim. C017–C018, C025. Court Rules Network
B2. Assignment evidence matrix
| Evidence category |
What it can establish |
Missing link or adverse branch |
| Master sale agreement |
Parties, eligible asset definition, conditions, exclusions, closing mechanics and warranties. |
It may contemplate a later sale rather than itself transfer this account. |
| Bill of sale |
Execution of a specified transfer at a specified closing. |
It may refer to an absent schedule or data file. |
| Account-level schedule/data |
A particular account’s inclusion when connected to the governing sale instrument. |
Similar names, truncated numbers, inconsistent identifiers, or excluded-account codes can create a material dispute. |
| Custodian or transaction witness |
How documents and data correspond; who created or received them; transfer process and authority. |
“We own it” without the underlying basis may be conclusory. |
| Assignment dates |
Whether the asserted plaintiff acquired the claimed right by the relevant event. |
A later transfer is not automatically proof of an earlier right; amendment and Rule 17 issues require separate analysis. |
| Redacted documents |
Relevant transfer terms and account data may be provable without exposing unrelated borrowers. |
Redaction cannot be presumed sufficient if it hides operative exclusions, identifiers or transfer conditions. |
| Credit report or branded statement |
May identify a reported creditor or source and support a limited evidentiary proposition. |
It is not automatically a legal conveyance or conclusive title proof. |
| Admissions or stipulations |
Can remove genuinely admitted matters from dispute under the applicable rules. |
Pleading allegations, a validation response, and evidentiary admissions have different effects. |
These are conditional proof relationships, not a prescribed mandatory package. No primary authority read requires disclosure of every unrelated account in a bulk portfolio merely to prove one account. Proportional discovery, completeness, protective orders, and the need to connect the particular obligation must be considered together. C020–C025, C066–C069.
B3. The special assignment-proof statute
Section 4-58-109 addresses an assignee of a written instrument made assignable by law. It states that the assignee need not prove the assignment unless the defendant appends the specified sworn denial, including a belief that one or more assignments on the writing were forged.
That is not the same oath as § 16-45-104’s sworn denial of an account’s correctness. Nor does it authorize a person to assert a forgery belief without a truthful basis.
In Beal Bank, the missing assignment link remained fatal to the plaintiff’s ownership showing. The court explained that § 4-58-109 did not apply where the pertinent assignment writing had not been produced. Thus, the statute cannot be summarized as “any debt buyer wins unless the debtor accuses it of forgery.” C020–C021. Justia Law+1
B4. Assignment does not automatically change the debt amount
Under the displayed § 4-58-105:
- A qualifying good-faith written assignment can be effective without notice to the debtor.
- A debtor’s qualifying good-faith payment without knowledge of the assignment can discharge the debt to that extent, with the recipient accountable to the prior assignee.
- Defenses against the assigned account remain available against the subsequent purchaser or assignee under the stated provision.
Section 4-58-106 separately limits an assignor’s release after assignment. Agency, notice, payment and release therefore must not be collapsed into one rule. UCC interaction, competing rights, and particular instruments remain outside the conclusions established here. C026–C029. Justia Law+1
The amount paid by a buyer for the portfolio is consideration for the transfer, not automatically a payment credited to the consumer. An assignment also does not itself create an additional debtor fee. C030–C031.
C. Evidence: authentication, hearsay, records, and sufficiency
C1. Evidence-gate matrix
| Gate |
Governing requirement |
Consequence and limit |
| Relevance and preliminary foundation |
Rule 104 addresses preliminary admissibility and qualification questions. |
The judge’s foundation determination is not a finding that the claimed balance is correct. |
| Authentication |
Rule 901 requires evidence sufficient to support that the item is what the proponent claims. |
A genuine copy can still contain inadmissible hearsay or fail to prove liability. |
| Personal knowledge |
Rule 602 requires the pertinent knowledge basis, subject to its stated qualification. |
A witness need not personally observe every transaction, but must be competent about the matters testified to. |
| Hearsay |
Rules 801–802 distinguish hearsay, nonhearsay uses and admissions; an exception must fit. |
A notarial seal does not itself make every factual assertion admissible. |
| Business records |
Rule 803(6) requires contemporaneous or near-contemporaneous information from a knowledgeable source, regular business keeping and practice, qualified foundation, and no disqualifying untrustworthiness. |
“Kept in our files” alone does not establish every element. |
| Missing entry |
Rule 803(7) has its own regular-recording and trustworthiness conditions. |
Absence from an incomplete file is not automatically proof that payment or a transaction never occurred. |
| Multiple hearsay |
Rule 805 requires a valid basis for each hearsay layer. |
A customer’s assertion copied into a collector’s log is not automatically proved by authenticating the log. |
| Operative legal document |
A contract or assignment may be offered to establish the legal act rather than the truth of every recital. |
Embedded factual recitals and account data can raise separate hearsay and foundation questions. |
| Electronic records |
Applicable UETA provisions and Rules 901/1001 recognize electronic records under their conditions. |
An IP address or stored name does not automatically prove who assented or which terms were accepted. |
| Original/duplicate |
Rules 1001–1004 address accurate electronic output, duplicates, and exceptions to original-content proof. |
Neither “only wet ink counts” nor “every photocopy must be accepted” is correct. |
| Summary |
Rule 1006 permits qualifying summaries of voluminous material, with underlying originals or duplicates available as required. |
A litigation spreadsheet is not automatically its own Rule 803(6) source record. |
| Objection and weight |
Rule 103 requires timely, specific preservation where applicable; Rule 52 preserves factfinder assessment of credibility and weight. |
Admission does not compel judgment; failure to preserve an objection can change appellate review. |
C036–C054, C063–C064, C073. Court Rules Network+2
C2. Predecessor records: the actual distinction
Beard permits a qualified recipient-business witness to support admission of records originating elsewhere where the evidence established reliable integration, use and circumstances. It does not require the witness to have been the predecessor’s employee.
Jones v. John B. Dozier Land Trust supplies the other boundary: merely retaining another person’s document does not establish the necessary foundation. Its discussion of an affidavit must also be read with its express observation that the § 16-46-108 route was not invoked. Neither case addressed the newly adopted 2026 Rule 902 certification provisions. C041–C043. Justia Law+1
Useful foundation facts can include how the successor received the data, understood the predecessor’s recording practices, checked mappings and balances, incorporated the records, relied on them in ordinary operations, corrected errors, and preserved source material. These are fact-sensitive foundation considerations, not a judicially mandated universal checklist.
C3. Three affidavit/certification mechanisms must not be confused
| Route |
What the text requires or permits |
What it does not establish |
| § 16-45-104 account affidavit |
The specified account affidavit, attached to the complaint, with statutory identities, assignment, authority, familiarity, amount and interest-source information. A sworn denial triggers proof by other evidence of the disputed part. |
Automatic compliance with Rule 10(d), every hearsay rule, card-authorization law, or every assignment gap. |
| § 16-46-108 business-record affidavit |
Qualifying records and an affidavit by a person who could otherwise establish admissibility; filing at least fourteen days before trial; prompt notice and access under the statute. |
That all documents attached to any affidavit qualify as business records. |
| Rule 902(11)–(13), effective January 29, 2026 |
Qualifying domestic or foreign certifications and copied-data authentication, with the stated notice and inspection opportunities. |
Conclusive proof of truth, consumer assent, ownership, lawful interest, or balance. |
The new Rule 902 route and the older § 16-46-108 route have different textual notice provisions. No controlling post-adoption decision harmonizing every possible overlap was obtained. This report does not declare the statute repealed or impose its fourteen-day filing requirement on every certification route without authority. C055–C062. Justia Law+1
Ozark Capital v. Pullen is correspondingly narrow: the majority rejected the unexpected exclusion on the notice ground in that record and remanded for weighing the affidavit and documents with the debtor’s testimony. It did not direct a creditor judgment or eliminate trustworthiness issues. C061. Justia Law
D. Proof changes with procedural stage
D1. Stage and burden matrix
| Stage |
What must occur |
What the stage does not decide |
| Pleading |
Facts supporting the claim; required instrument attachment; proper party and capacity allegations; applicable specific defenses. |
Allegations and exhibits do not automatically become conclusive trial proof. |
| Verified account |
Apply § 16-45-104’s particular affidavit and sworn-denial provisions. |
It does not replace all other elements or every evidentiary objection. |
| Assignment pleading |
Apply § 4-58-109 only when its written-instrument predicates are established. |
It is not a universal oath requirement for every title or account-inclusion dispute. |
| Discovery |
Relevant, nonprivileged, proportional information; specific requests and objections; identify responsive materials withheld. |
Discoverable material need not yet be admissible, and production is not an admission of truth. |
| Admissions |
Rule 36 can establish matters conclusively for the pending action unless withdrawal/amendment is permitted. |
An admission in one action is not automatically an admission for every other purpose. |
| Summary judgment |
Movant must establish entitlement without a genuine material factual issue. Rule 56(e) requires personal knowledge, admissible facts, competence and the specified supporting copies. |
A conclusory affidavit or unsupported denial does not resolve the motion; the court does not simply choose the more credible disputed account. |
| Contested trial |
Properly admitted evidence, admissions and stipulations are weighed under the applicable burdens. |
Records’ admissibility does not require the factfinder to accept every balance entry. |
| Default amount |
Rule 55(b) permits the court to require accounts, evidence of damages, truth of averments, or other necessary proof. |
No automatic award of every interest, fee, or total alleged; this pass does not rerun default-entry procedure. |
C032–C035, C065–C074.
D2. The 2026 discovery changes matter to account-level proof
The final June 4, 2026 order adopted material changes to Rules 26, 34 and 36. The pertinent points are:
- Discovery is relevant to a claim or defense and proportional to the case.
- Protective-order mechanisms address confidential commercial and personal information.
- Document objections must be specific and indicate whether responsive material is being withheld.
- A blanket objection does not satisfy the amended requirements.
- Admissions require the stated specific responses and reasonable inquiry.
This supports targeted account-level proof rather than either extreme: “produce every borrower’s entire portfolio file” or “confidentiality means no operative assignment evidence can be tested.” No actual discovery request is drafted here. C066–C069. Justia Law+1
D3. Credit-card authorization: no burden reversal
Under § 1643(b), the card issuer bears the pertinent authorization burden. The definitions in § 1602 distinguish an accepted card, cardholder, issuer and unauthorized use.
Harp held the statements in its record insufficient by themselves to prove authorization. Danner II rejected the opposite overstatement that only signed sales slips or other signed documents could ever prove authorized charges. Danner III then clarified that the factfinder still had to weigh the evidence; the prior remand did not command a creditor victory. C075–C079. Justia Law+2
The statute’s limited unauthorized-use-liability branch contains multiple predicates. The statutory monetary ceiling is not an automatic amount owed whenever unauthorized use is alleged. No actual authorization or statutory liability is determined.
E. Published-opinion and procedural-posture register
All listed bodies were freshly read for their material majority analysis and disposition. Official court-access routes failed as recorded in S046; the actual opinion republications were therefore used with explicit hosting and citator limits. Headnotes and unrelated case-merits sections were not substituted for the operative reasoning.
| Authority/source |
Court/date and posture |
Material holding and disposition |
Limits and separate writings |
| City of Dardanelle v. City of Russellville, S028 |
Arkansas Supreme Court, February 28, 2008; pleading dismissal. |
General contract elements and sufficiently definite obligations; affirmed because the resolution was too indefinite. |
Municipal facts, not consumer-account proof. Glaze did not participate. Underlying quoted cases not separately read. |
| Rabalaias v. Barnett, S029 |
Arkansas Supreme Court, February 11, 1985; dismissal of contract/tort pleadings. |
Contract pleading required facts showing agreement, obligation, breach and resulting damage; contract dismissal reversed. |
Pleading sufficiency, not proof of an actual consumer agreement. |
| Northwest Arkansas Recovery v. Davis, S030 |
Arkansas Court of Appeals, December 15, 2004; account and amount dispute. |
Discussed open account and account stated; actual account-stated theory had been withdrawn. |
Limitations/lien holdings not imported. No universal statement-silence holding. |
| Foscue v. McDaniel, S031 |
Arkansas Supreme Court, April 23, 2009; summary judgment and amended counterclaim. |
Account stated was unchallenged; conclusory error allegations insufficient, but intertwined additional-loan accounting issues required reversal/remand. |
Not a holding that all late affidavits must be considered or that every account statement is agreed. |
| Crisler v. Unum, S032 |
Arkansas Supreme Court, April 13, 2006; insurance summary judgment. |
No effective choice clause on the facts; significant-relationship analysis required Arkansas law; reversed/remanded. |
Used only for choice-of-law fact identification, not insurance or consumer-card substantive rules. |
| Davis v. Davis, S033 |
Arkansas Court of Appeals, January 20, 2016; dismissal. |
Unjust-enrichment discussion recognizes benefit/inequitable retention and express-contract limits. |
Securities/fraud merits and all exceptions not converted into debt rules. |
| Dyke Industries v. Waldrop, S034 |
Arkansas Court of Appeals, October 23, 1985; accord-and-satisfaction defense. |
Dispute and agreement were material; third-party paid-in-full notation did not settle the undisputed obligation on that record. |
Predates modern UCC full-payment-instrument provisions; no current check-tender advice. |
| Beal Bank v. Thornton, S035 |
Arkansas Court of Appeals, June 7, 2000; secured litigation with missing assignment link. |
Failure to connect the chain defeated the asserted ownership; § 4-58-109 did not cure absent assignment writing. |
Only general assignment/proof analysis used; secured-property and adverse-possession issues deferred. |
| LVNV Funding v. Nardi, S036 |
Arkansas Supreme Court, December 13, 2012; defendant’s summary judgment. |
§ 16-45-104 affidavit did not excuse Rule 10(d); affirmed. |
No universal original-signature rule. Agreement first supplied with the summary-judgment material was not a compliant complaint attachment on that record. |
| Gemini Capital v. McFarland, S037 |
Arkansas Court of Appeals, February 12, 2014; dismissal after amended complaint. |
Amendment supplied agreement; Nardi distinguished; reversed/remanded under amendment analysis. |
No ownership or balance judgment for plaintiff. |

| Harp v. Security Credit Services, S040 |
Arkansas Court of Appeals, March 27, 2013; jury verdict. |
Statement-only authorization proof insufficient; reversed/remanded. |
Other assignment, discovery and admissibility arguments were not decided. |

Signed slips are not the exclusive means of authorization proof; reversed/remanded. |
Did not order judgment for issuer. |
| Danner III, S042 |
Arkansas Court of Appeals, June 3, 2015; subsequent remand judgment. |
Factfinder misconstrued prior mandate; reversed/remanded to weigh all evidence. |
Actual later treatment of Danner II read; no automatic creditor result. |
| Jones v. John B. Dozier Land Trust, S043 |
Arkansas Court of Appeals, January 18, 2017; damages evidence. |
Mere possession of another business’s estimate did not supply foundation; reversed/remanded. |
Footnote 4 says § 16-46-108 was not invoked; predates new Rule 902. |
| Beard v. Ford Motor Credit, S044 |
Arkansas Court of Appeals, March 31, 1993; deficiency case. |
Qualified recipient witness and demonstrated reliance/integration supported records; affirmed. |

Arkansas Court of Appeals, May 7, 2003; tax audit proof. |
Rule 1006 summaries supported by methodology and accessible source records were admissible; affirmed. |
Tax amounts/rates and liability rules not imported. New certification/discovery notice rules remain separate. |
No old unpublished opinion is relied on as controlling. Rule 5-2’s publication/citation distinction was read. Complete subsequent-history review remains open. Court Rules Network
F. Four worked fictional models
All actors, account identifiers, records, dates, prices, transfers and payments below are fictional. No actual contract, account schedule, claimant, filing, or collectibility decision is made. All inputs are exact to cents; rates and allocation rules are stipulated for arithmetic only.
M01 — Original creditor, contract ledger, disputed interest and fee
Stipulated facts
An original creditor alleges a consumer account. The parties hypothetically agree, for this model only, that:
- Opening principal on March 1, 2026: $4,000.
- No balance-changing transactions occur during a defined thirty-day interest interval.
- A lawful, applicable 12% simple annual rate on an actual/360 basis is proved for that interval.
- At the end of the interval, $600 of authorized purchases and a $100 merchant credit post.
- A $500 actual payment posts, allocated first to the proved $40 interest, then principal.
- A separate $35 fee is claimed, but its contractual/legal authority is disputed.

On the stipulated interest and transaction facts, the nonfee arithmetic is $4,040. The additional $35 remains a legal-authorization and proof issue, not a mathematical error.
Adverse branch: If the interest term or its applicability is not proved, the $40 cannot simply be treated as lawful because software calculated it. Under a separately stipulated principal-only allocation in that branch:
4,000+600−100−500=4,0004,000+600-100-500=\boxed{4,000}4,000+600−100−500=4,000The plaintiff must establish the actual agreement/version, assent, transactions, rate period, allocation and fee trigger. An accurate $4,075 statement alone does not do so. C004, C031–C035, C075–C079, C093.

Agreement and bill of sale effective June 1, 2026 |
Schedule is asserted to include Q-731. |
If it actually lists Q-713, the mismatch is not cured by the generic portfolio title. |
| Buyer B appoints Servicer S |

Authorized receipt and full consumer credit are stipulated. |
If authority, receipt or allocation is disputed, evidence is required. |

Assume O→A allocated purchase consideration of $340 and A→B consideration of $510. These are payments between buyers and sellers, not consumer payments.
They do not reduce the consumer balance merely because they are below face value.

Opening assigned balance:
- Principal: $3,200.
- Stipulated lawful accrued interest: $160.
- Stipulated lawful fees: $40.
3,200+160+40=$3,4003,200+160+40=$3,4003,200+160+40=$3,400The actual $400 consumer payment is allocated, by the stipulated lawful rule:
$160 interest+$40 fee+$200 principal=$400$160\text{ interest}+$40\text{ fee}+$200\text{ principal}=$400$160 interest+$40 fee+$200 principal=$400Closing debt:
3,400−400=$3,000 principal3,400-400=\boxed{$3,000\text{ principal}}3,400−400=$3,000 principalAssume S remits $390 to B and retains $10 under its contract with B, not as an added debtor fee:
$400 received−$390 remitted−$10 retained=$0 agency cash$400\text{ received}-$390\text{ remitted}-$10\text{ retained}=$0\text{ agency cash}$400 received−$390 remitted−$10 retained=$0 agency cashThe debtor receives one $400 credit—not $390, and not $790. No extra $10 is added to the debt.
Held conclusion
If the second assignment omits or mismatches Q-731, the $3,000 arithmetic does not prove B’s right to enforce it. Likewise, a sound chain does not prove the interest or fee assumptions. C020–C031, C094.
M03 — Foundation at summary judgment versus contested trial
Fictional records and amount
An account shows:
- Opening principal: $1,200.
- Authorized new advance: $200.
- Stipulated lawful interest: $18.
- Stipulated lawful fee: $12.
- Actual payment: $130, allocated $18 interest, $12 fee and $100 principal.
- Merchant credit: $50.
1,200+200+18+12−130−50=$1,2501,200+200+18+12-130-50=\boxed{$1,250}1,200+200+18+12−130−50=$1,250| Component | Closing amount |
| --- | --- |
| Principal: $1,200 + $200 − $100 − $50 | $1,250.00 |
| Interest: $18 − $18 | $0.00 |
| Fee: $12 − $12 | $0.00 |
A litigation spreadsheet omits the $50 merchant credit and claims $1,300.
Foundation matrix
| Record/witness |
Known fictional facts |
Summary-judgment treatment |
Trial treatment |
| Predecessor transaction file |
Successor received and integrated it; source mapping and checks documented. |
Affidavit must establish personal knowledge of the asserted foundation and attach/serve required supporting records. |
Qualified testimony or applicable certification route; cross-examination and weight remain. |
| Successor witness |
Knows boarding, reconciliation and regular use, but did not work for predecessor. |
Lack of predecessor employment is not automatically fatal. |
Actual knowledge of relevant processes and trustworthy sources must still be established. |
| Certification under new Rule 902 |
Assume a competent custodian certifies the actual Rule 803(6) predicates and reasonable notice/access is provided after January 29, 2026. |
Authentication/foundation route potentially available; it does not remove the $50 dispute. |
Court still determines other objections and weight. |
| Litigation spreadsheet |
Prepared for this suit from the records. |
Does not become a regular business record merely by being attached to an affidavit. |
Rule 1006 route requires its own predicates and accessible sources. |
| Merchant credit |
Actual source record exists and conflicts with claimed total. |
A material $50 issue must be confronted, not ignored. |
Factfinder determines disputed factual issues from admissible proof. |
Adverse missing-record branch
If the witness knows only that “the system says $1,300,” cannot identify the predecessor source or mapping, and the source records are absent, neither a title “custodian” nor a signature establishes all Rule 803(6), Rule 56, or assignment predicates.
A Rule 56(f) request for necessary evidence has its own required showing. A bare assertion “more discovery is needed” is not declared sufficient. No motion or legal deadline is supplied. C036–C073, C095.
M04 — Conditional settlement, provisional payment reversal, and residual balance
Stipulated legal assumptions
Assume a legally valid written settlement—not merely a “paid in full” notation—requires two cleared $1,600 payments and releases the remaining balance only when its stated conditions are satisfied. The authorized creditor validly accepts the replacement payment within an agreed extension. No additional interest or fees accrue in the model.
Initial obligation:

Adverse branch
Before the replacement clears, the book balance of $3,650 and the remaining settlement payment of $1,600 are different concepts. Whether the creditor may enforce the original balance, only the settlement, or neither depends on the actual agreement, authority, conditions, waiver and governing law. No automatic result is supplied.
Rule 408’s restriction on using compromise evidence to prove the disputed original liability does not justify treating every settlement document as inadmissible for every other purpose. Modern full-payment-check law, bankruptcy discharge and limitation consequences remain deferred. C081–C085, C096.
G. Sixteen additional fictional merits and proof postures
| Posture |
Fictional situation |
Rule/holding, evidence, consequence and uncertainty |
| P01 — Original creditor |
Issuer has statements but no proof tying the disputed rate version to the consumer. |
Contract and amount proof remain open; a correct total does not establish applicable terms. C002–C007, C031. |
| P02 — One assignment |
Bill of sale refers to an account file that is absent. |
Require evidence connecting this obligation; no mandatory single-format rule, but generic sale alone may not supply the link. C020–C024. |
| P03 — Two assignments |
Final buyer proves B→C but not A→B. |
Beal’s missing-link problem; last transfer does not cure the earlier gap. C020–C021. |
| P04 — Schedule mismatch |
Name matches, but account number and closing balance do not. |
Authentication, data mapping and actual inclusion are disputed; similarity is not conclusive. C022–C024. |
| P05 — Servicing agent |
Servicer can process payments but agreement is silent about suing in its own name. |
Rule 17 and actual enforcement authority must be established separately. C017, C025. |
| P06 — Account stated |
Consumer received statements but disputed the account promptly. |
Claimant must establish assent; no universal silence rule. C010–C012. |
| P07 — Signed original demanded |
Electronic acceptance and transaction logs exist, but no ink-signed application. |
No automatic defeat; UETA, authentication, originals/duplicates and actual assent still require proof. C005, C047–C054. |
| P08 — Incorporated records |
Successor witness explains source, checks and ordinary reliance. |
Beard supports a possible foundation, not automatic ownership or balance accuracy. C041. |
| P09 — Mere possession |
Witness says only that an old estimate was placed in the file. |
Jones distinguishes possession from business-record foundation. C042–C043. |
| P10 — Multiple hearsay |
Collector log quotes an unidentified merchant’s email about authorization. |
Each hearsay layer and attribution need a basis; logging the email does not prove the merchant statement. C045–C046. |
| P11 — Summary |
Spreadsheet total is offered but underlying transactions are unavailable to the opponent. |
Rule 1006 conditions and accuracy remain unmet or disputed; no automatic admission. C050–C051. |
| P12 — Qualified-certificate gap |
Affiant calls itself custodian but gives no knowledge of recording practices or data extraction. |
New Rule 902 does not excuse missing qualification and predicates. C055–C059. |
| P13 — Paid account |
Consumer produces a cleared payment missing from plaintiff’s ledger. |
Payment is a substantive credit/defense issue; actual receipt, authority and allocation must be tested. C027, C081. |
| P14 — Release |
Former owner issues a release after assignment without shown authority. |
§ 4-58-106 and any genuine agency/notice/payment facts must be reconciled. C028. |
| P15 — Discharge or mistaken person |
Account matches a name, but identity or discharge scope is contested. |
Identity and actual legal obligation remain separate; full bankruptcy merits are deferred. C075–C080, C085. |
| P16 — Disputed fee |
Buyer adds its acquisition/servicing cost to the account. |
Sale price or servicing expense does not itself authorize a debtor charge. C030–C031. |

The material current-law development is the January 29, 2026 certification amendment, considered alongside the older statutory affidavit route rather than used to erase it. The June 4, 2026 discovery changes were also read as final adopted text.
The principal substantive boundaries remain: an account affidavit does not cure every pleading defect; a portfolio purchase does not identify every account; authentication does not settle hearsay or amount; predecessor employment is not universally required; mere possession of predecessor records is not enough; and neither a validation response nor correct arithmetic adjudicates liability.
Counts: 46 source/access groups; 96 atomic claims; 18 published-case entries; 2 final 2026 rule-adoption orders and 1 proposal separately identified; 4 worked models; 16 additional fictional postures; 30 core-coverage rows; 8 workflow rows; 8 currentness rows; 4 model rows; 8 additional holds; 6 territorial/actual-record rows; 9 deferred-family rows; and 3 separate crosswalk rows. These categories are not summed as independently accepted legal propositions.
No independent review, full current-law certificate, local write, unseen model claim, actual eligibility, collection or filing permission, compliant-template approval, or publication readiness is asserted.
