Arkansas consumer-debt communications, initial validation, and dispute/verification gateway

Research access date: October 27, 2026. Exact source-opening times were not logged and are unknown. The supplied October 22 baseline is not a current-verification date.

Provenance: Earlier outputs remain unchanged. The supplied coordinator review of PASS-01 is not an independent review or a source-opening record. PASS-04, PASS-05, and PASS-06 were not used as legal premises. No local coordinator files were accessed or written.

Scope: Ordinary personal, family, or household debt; covered collection communications; initial validation information; disputes and original-creditor requests; and the conditions for pausing and resuming collection. Licensing, security, litigation procedure, limitation periods, judgment enforcement, damages, and the other deferred families are not resolved here.

Principal findings

Arkansas and federal requirements must be tested separately. Arkansas has additional workplace-contact and agency-identification provisions. Its validation statute expressly requires a written notice and does not reproduce every federal exception or Regulation F procedure. Federal compliance therefore does not, without further analysis, establish compliance with every applicable Arkansas requirement. C012–C014, C021, C039, C051–C053, C072. Arkansas General Assembly+1

There are three different validation events: providing the initial information, determining the actual or assumed receipt date, and receiving a timely written dispute or original-creditor request. The five-day notice requirement is not the five-excluded-day receipt assumption. A known delivery failure is not cured by assuming receipt. C050–C063. U.S. Code+2

An oral dispute and a timely written dispute have different consequences. An oral dispute can be relevant to disputed-debt reporting and whether a collector may assume validity. The statutory verification pause has a writing-and-timing predicate. A qualifying electronic submission can satisfy the federal writing requirement, but that is different from the collector satisfying E-SIGN requirements when delivering certain disclosures electronically. C035–C036, C063–C069. Consumer Financial Protection Bureau+1

Verification is not a judgment on ownership or liability. The Eighth Circuit’s Dunham decision approved verification sufficient for the particular mistaken-identity dispute before it. It did not impose—or abolish for every conceivable dispute—a universal requirement for a signed original contract, notarized affidavit, or complete trial-evidence package. C075–C078. U.S. Court of Appeals+1

Currentness is partially authenticated, not comprehensively certified. Official enactments, official federal text, official codified Arkansas rules, and published judicial bodies were read. The complete current Arkansas Code/adoption chain, state–federal harmonization decisions, and a full citator remain open.

A. Actors, debts, and jurisdictional boundaries

A1. Actor and debt matrix

Actor or obligation Supported classification inquiry Conditions and unresolved application
Ordinary consumer obligation Both the federal definition and Arkansas’s consumer-conduct subchapter address obligations arising primarily from personal, family, or household transactions. A natural-person obligor alone does not make a business obligation a consumer debt. Mixed-purpose transactions require actual facts. C001.
Person wrongly pursued “Consumer” includes an allegedly obligated person. Dunham rejected the proposition that mistaken identity necessarily removes the person from the Act’s protections. C002.
Original creditor collecting in its own name Ordinarily requires analysis distinct from a collector regularly collecting another’s debt. The false-name provision and other statutory predicates can change the result. No universal original-creditor immunity is declared. C003–C004.
Purchaser of defaulted debt Ownership does not settle every federal collector-status question. Henson addressed the “owed another” branch; the principal-purpose branch remained open there. C008.
Debt buyer using outside collectors Principal-purpose status can exist despite outsourcing. Reygadas applied that branch on its record; it did not declare every investment owner a collector or resolve every agency-liability question. C009.
Servicer Acquisition before or after default matters to the specified exclusion. Actual acquisition, default status, role, and statutory branch must be established. Default timing is not a universal standalone status test. C005.
Employee or affiliate The employee and affiliate exclusions contain separate conditions. A common owner, salary, or corporate label does not automatically establish either exclusion. C006.
Fiduciary, government actor, process server, nonprofit counselor Apply the particular statutory exclusion and its activity conditions. No generic fiduciary, nonprofit, or government-connected exemption is presumed. C007.
Attorney or law firm Regular consumer-debt collection through litigation can be covered. Heintz rejects a blanket federal attorney exemption. Particular formal-pleading exceptions do not exempt all attorney communications. C010.
Security-interest enforcer Enforcement-only activity can have limited-purpose treatment under the federal definition. Obduskey did not decide all judicial foreclosures, deficiency demands, or conduct beyond security enforcement. Ordinary money demands require separate analysis. C011.
State-license-exempt actor State credential treatment and consumer-conduct coverage are different inquiries. No conclusion from PASS-06 is adopted. C012.
Remote actor contacting Arkansas The actual activity, consumer connection, applicable definition, and jurisdictional predicates matter. Interstate-commerce/mails language is not a complete personal-jurisdiction or choice-of-law holding. An out-of-state office alone supplies no categorical federal exemption. C013.

The Arkansas consumer-conduct definitions are in § 17-24-502. They are not interchangeable with every definition elsewhere in Chapter 24. The federal definitions are in 15 U.S.C. § 1692a and 12 C.F.R. § 1006.2. Justia Law+2

A2. Federal interpretation is not automatic incorporation into Arkansas law

The Arkansas provisions often resemble the FDCPA, but resemblance does not establish that every later federal regulation, safe harbor, exception, or judicial gloss has become Arkansas law.

The reviewed § 17-24-512 contains a specified federal-advisory-opinion provision; it does not establish wholesale incorporation of all federal decisions or Regulation F. In Reygadas, the parties agreed that the state claims tracked the federal claims for that case. That procedural agreement is not a universal Arkansas statutory interpretation. C012, C072, C079, C082.

Federal law preserves compatible state protection, including greater protection. The result is not “federal law always replaces Arkansas law,” nor “every textual difference conclusively creates a separate violation.” The actual conflict and state-law interpretation must be established. C014. Justia Law+3

B. Communications and conduct

B1. State and federal conduct matrix

Issue Federal requirement Arkansas requirement or additional condition Application boundary
Time and place Default convenient hours are after 8 a.m. and before 9 p.m. at the consumer’s location, absent contrary knowledge. § 17-24-504 contains the corresponding time/place restriction. A known inconvenient time or place can be prohibited within those hours. C015–C016.
Consumer initiates contact Regulation F permits the specified limited response to a consumer’s inconvenient-time communication. No unlimited future consent follows from that contact. A response opportunity is not permission for an ongoing campaign. C016, C019.
Represented consumer Known representation, ascertainable counsel contact, and the stated exceptions govern. § 504 contains a corresponding counsel restriction. Actual knowledge and reasonable attorney nonresponse or consent must be established. C017–C018.
Workplace Known or reasonably known employer prohibition restricts contact. § 307 and Rule 280-302 add a home-letter predicate before specified workplace letters or calls. Satisfying the state home-letter condition does not override the federal employer prohibition. C020–C021.
Third parties Collection disclosure is restricted, subject to specified recipients and exceptions. § 504(b) supplies a parallel statutory restriction. A spouse/representative definition for communications does not establish personal liability for the debt. C022–C023.
Location information Identify the caller, explain the location-information purpose, disclose employer only if requested, and do not disclose the debt; repeated contacts are restricted. § 503 separately supplies these conditions. Locating the consumer is not permission to pressure relatives or coworkers. C024.
Global cease request A qualifying written refusal or cease request restricts further communications, with three statutory exceptions. § 504(c) has its own written-request and receipt language. An exception does not authorize a false or unlawful threat. C025–C026.
Stop a particular medium Regulation F recognizes medium-specific requests, including oral requests, and limited exceptions. Do not assume that this is identical to Arkansas’s global written-cease procedure. Stopping email does not itself extinguish the debt or necessarily stop every other lawful medium. C027–C028.
Harassment General harassment prohibition applies across conduct and channels. § 505 independently prohibits listed and other harassing conduct. Numerical call presumptions are not universal safe harbors. C029, C044.
False statements and threats Character, amount, legal status, authority, legal documents, and threatened action must not be misrepresented. § 506 independently addresses corresponding conduct. No suit, arrest, seizure, or “legal department” threat is validated merely because a debt is alleged. C030–C031.
Added interest or charges An amount must be expressly authorized by the agreement creating the debt or permitted by law. § 507(b)(1) separately imposes that condition. A notice does not create an entitlement to a fee. C032.
Postdated instruments Special notice and timing restrictions apply; early deposit and prosecution threats are restricted. § 507 contains parallel provisions. This pass gives no payment or instrument-use advice. C033.
Postcards and envelopes Debt disclosure through postcards and prohibited envelope markings is restricted. § 507 separately addresses these practices. Business-name exceptions do not authorize a name that reveals collection contrary to the rule. C034.
Credit information A collector must not communicate known or reasonably known false credit information, including omission of a known dispute. § 506(b)(8) independently addresses disputed-debt representation. Full FCRA furnishing, investigation, and reporting-period duties remain deferred. C035–C037.
Identification and translated disclosures Initial and subsequent collector disclosures apply, with a formal-pleading exception; required disclosures must match the language used. Rule 280-302 requires agency/trade-style identification and specified collection information. Federal assumed-name or limited-content provisions do not automatically settle the state rule. C039, C089.

Sources include Arkansas §§ 503–508, the official Board rule, FDCPA §§ 1692b–1692g, and Regulation F §§ 6, 10, 14, 18, and 22. Justia Law+6

Arkansas workplace and identification provisions

The state workplace condition is specific: the reviewed text requires a good-faith attempt by letter at the debtor’s usual abode, with the mail not returned and no answer received, before the specified workplace contact. It is not a general rule that “one unanswered home call permits workplace calls.”

Rule 280-302 also requires the agency’s licensed name or authorized trade style and specified information in collection communications. The rule’s application to a federal limited-content voicemail remains a harmonization question—not an assumed safe harbor. C021, C039. Arkansas General Assembly+1

B2. Call-frequency presumptions

Regulation F has two separate telephone-frequency tests for a particular person and particular debt:

  • More than seven placed calls within seven consecutive days.
  • A placed call within seven consecutive days after a telephone conversation about that debt.

The conversation date is day one of the latter period. A consumer-initiated conversation can start it. Both tests and their exclusions matter. C040–C042. Consumer Financial Protection Bureau

Ringing and voicemail connections count even without an answered conversation. A busy signal or number-not-in-service result is an identified nonconnection example. Consent-based exclusions are limited in duration and scope; they do not establish unlimited consent. Calls discussing multiple debts and unanswered calls have distinct allocation rules. The special student-loan grouping rule is not a general account-consolidation permission. C042–C043. Consumer Financial Protection Bureau

Even a collector within the numerical presumption can face contrary evidence from concentrated calls, prior requests, abusive content, or the overall pattern. Arkansas’s harassment provision was not read as creating a seven-call safe harbor. C029, C044.

B3. Voicemail, email, text, and social media

A limited-content message is a narrowly defined voicemail, not any short message. It requires the specified non-debt-indicating business name, callback request, natural-person contact name, and number, with only the permitted optional additions. A qualifying message is not a federal “communication,” but remains an attempt to communicate and counts for relevant telephone rules. Adding debt information can change the classification. C038–C039. Consumer Financial Protection Bureau+1

The email and text procedures in § 1006.6(d) support a specified third-party-disclosure defense framework. They are not universal authorization to use every address or number.

Channel Material predicates actually read Limit
Consumer-provided email Direct use about the debt or direct consent, without relevant opt-out/withdrawal. An address somewhere in an old file is not automatically qualifying consent.
Creditor-transfer email route Prior creditor use, named-collector notice, shared-address warning, simple opt-out, at least 35 days to respond, and additional conditions. Not a shortcut for a known employer-provided email address.
Prior-collector email route Specified qualifying origin, actual use by the immediately preceding collector, and no opt-out. The collection chain must satisfy the rule’s facts.
Text Direct consumer text/consent plus the specified recent-contact or reassignment-check conditions. A voice call alone is not the consumer-text predicate.
Electronic opt-out Simple instructions in each covered electronic communication or attempt, without a fee or unnecessary additional information. Required disclosures cannot be sent to an opted-out address merely because they are required.
Social media Publicly viewable collection contact is prohibited; private contact remains subject to other rules. A private-message setting does not cure deception, third-party exposure, or lack of a lawful basis.

C. Initial validation, disputes, and resumption

C1. Workflow and clock matrix

This is also the 14-row workflow coverage register.

Row Actor/event Required step or effect Clock and qualification
W01 Collector selects a communication Establish collector, consumer, debt, and communication predicates. No actual role or debt is assumed. C001–C013.
W02 First covered communication Federal validation information may be provided initially or through the prescribed follow-up route. Five-day follow-up is distinct from assumed receipt. C050.
W03 Arkansas-covered initial contact State text requires written notice initially or within five days unless paid. Federal oral-only alternative is not expressly reproduced. C051–C053.
W04 Notice is prepared Identify collector, consumer, creditor, reference date, amounts, itemization, rights, and response information as applicable. Itemization is not proof of ownership or accrual. C054–C058.
W05 Notice is sent Use a method reasonably expected to provide actual notice and retainable access. Known nondelivery defeats that delivery attempt. C062–C063.
W06 Receipt is determined Apply actual receipt or the federal permitted assumption. Five excluded-day assumption differs from the thirty-day period. C059–C061.
W07 Consumer disputes orally Consider the dispute for applicable representation and reporting duties. Oral dispute alone does not establish the written-dispute pause. C035, C064.
W08 Consumer submits timely writing Accepted electronic channels can qualify federally. Submission and collector receipt are distinct events. C065–C066.
W09 Collector receives timely written dispute Stop collection of the debt or disputed portion until compliant response. Mere internal confirmation is insufficient. C066, C069.
W10 Collector receives timely original-creditor request Stop collection pending the required response. Special federal same-creditor procedure exists; state integration held. C067–C068.
W11 Collector verifies Obtain and send the required verification/judgment or creditor information. No universal thirty-day collector-response deadline was established. C069–C070.
W12 Repeated dispute arrives Apply the federal duplicative-dispute definition and required response. New material evidence defeats that shortcut; state counterpart not established. C071–C072.
W13 Collector considers resuming Confirm the applicable pause-ending event and all independent restrictions. Sending a sufficient response is not a universal license to contact by every medium. C069, C077–C078.
W14 Litigation or other process exists Treat its deadlines and defenses separately. A validation request does not itself extend an answer deadline or determine accrual. C077–C078.

State–federal differences that remain held

The text of Arkansas § 17-24-508 contains the written-notice and mailed-response requirements described above. It does not expressly reproduce the federal formal-pleading/privacy exclusions, Regulation F’s assumed-receipt mechanism, duplicative-dispute procedure, or all electronic-delivery alternatives.

That does not establish that electronic compliance is always impossible under Arkansas law. It means the relevant state electronic-transactions law, federal preemption/E-SIGN interaction, and controlling Arkansas interpretation must be examined before declaring those alternatives equivalent. C051–C053, C072. Justia Law+2

C2. What validation information establishes—and what it does not

Regulation F’s itemization date may be a permitted last-statement, charge-off, last-payment, transaction, or judgment date. A collector must use the chosen reference consistently for the required information. That choice is a disclosure convention, not a determination of the limitations trigger.

The notice’s required information includes the pertinent amount and itemization, collector and consumer information, current creditor, and applicable account and creditor-at-itemization information. The additional creditor-at-itemization and CFPB-information requirements depend on the consumer-financial-product-or-service predicate. An original-creditor identification request is a distinct right. C054–C057. Consumer Financial Protection Bureau+2

The model-form safe harbor concerns specified information/form and related overshadowing requirements. It does not establish accurate ownership, authorized interest, lawful collection, or proof sufficient for judgment. No model letter was adopted or sent in this pass. C058, C076–C078. Consumer Financial Protection Bureau+1

C3. Receipt and electronic-delivery distinctions

The federal validation period begins when the information is provided and ends thirty days after actual or assumed receipt. The permitted assumption allows at least five days after provision, excluding Saturdays, Sundays, and the referenced legal public holidays. Official commentary permits maintaining the disclosed assumed date even if a different actual-receipt date is later learned. C059–C061.

But a returned letter or bounce is not simply “five days, therefore received.” Section 1006.42’s actual-notice standard and the official interpretations require the delivery failure to be addressed. C062. Consumer Financial Protection Bureau+1

Certain follow-up validation notices and verification/original-creditor responses sent electronically must satisfy E-SIGN § 101(c). Its informed-consent and access requirements are not equivalent to merely knowing an email address. A consumer’s written dispute through an accepted electronic channel is a different transaction. C063–C065. U.S. Code+2

C4. Reporting and verification boundaries

A known dispute may be relevant even when communicated orally. Wilhelm distinguishes the duty not to omit a known dispute in a credit communication from a universal affirmative duty to update every earlier report under that FDCPA clause. Full FCRA duties remain open. C035–C036. U.S. Court of Appeals

Regulation F also imposes a contact/delivery prerequisite before specified furnishing. Its official interpretation identifies fourteen consecutive days as a reasonable waiting period in the addressed notice-and-undeliverability procedure. This is not a verification ruling, ownership finding, or general FCRA compliance certificate. C037. Consumer Financial Protection Bureau

D. Published judicial authorities

All six opinions below were read from official court or government repositories. No private docket was searched.

Authority Court/date, posture, and material majority holding Separate writing, treatment, and limits
Henson v. Santander, 582 U.S. 79 — S039 U.S. Supreme Court, June 12, 2017; unanimous. Purchasing and collecting owned debts did not satisfy the particular “owed another” branch adjudicated. Principal-purpose and other possible collection activity were expressly left unresolved. Later Reygadas analysis read.
Reygadas v. DNF Associates, 982 F.3d 1119 — S040 Eighth Circuit, December 14, 2020; published. Outsourced collection did not defeat principal-purpose status on the record. The liability judgment was vacated/remanded on separate agency/knowledge grounds. Principal’s counsel knowledge was not automatically imputed to the downstream agent. No separate opinion shown.
Heintz v. Jenkins, 514 U.S. 291 — S041 U.S. Supreme Court, April 18, 1995; unanimous. Regular consumer collection through attorney litigation falls within the FDCPA. Current pleading-specific exceptions remain separate. Not a ruling that all legal work is debt collection.
Obduskey v. McCarthy & Holthus, 586 U.S. 466 — S042 U.S. Supreme Court, March 20, 2019; unanimous. The nonjudicial security-enforcement activity before the Court received limited-purpose treatment. Sotomayor concurred. Broader money demands, judicial proceedings, and conduct outside the addressed enforcement activity were not universally exempted.
Dunham v. Portfolio Recovery Associates, 663 F.3d 997 — S043 Eighth Circuit, December 15, 2011; published. Wrongly targeted person could be an alleged consumer; verification was sufficient for the mistaken-identity dispute on the record. Affirmed on alternative reasoning; did not resolve every possible verification demand or trial-proof requirement. No separate opinion shown.
Wilhelm v. Credico, 519 F.3d 416 — S044 Eighth Circuit, March 3, 2008; published. Addressed known-dispute reporting and an allegedly deceptive litigation threat. Affirmed in part and reversed/remanded in part. Its reporting holding is not a complete FCRA rule. State-specific interest issues were not imported into Arkansas.

No full current citator was obtained. Older decisions predate Regulation F’s November 30, 2021 effective date; the current regulation must be considered separately. Authorities quoted inside those opinions were not represented as freshly opened underlying bodies. C082. Supreme Court+5

E. Four worked event/timing examples

All facts, actors, dates, channels, and communications below are fictional. Coverage is assumed only for demonstrating the stated rule. No actual collector license, consumer eligibility, debt ownership, or permission is established.

No payment is modeled. Debtor balances and provider receipts remain unchanged throughout. A notice, dispute, verification, or call does not itself create a payment, fee entitlement, or debt reduction.

Example 1 — Sent notice, assumed receipt, and different actual receipt

Fictional events

  • Initial covered communication: Thursday, October 8, 2026.
  • Proper written notice mailed: Friday, October 9.
  • No known delivery defect.

The notice was sent one day after the initial communication. No disputed five-day endpoint calculation is needed.

Federal assumed-receipt count

Date Treatment
October 10, Saturday Excluded
October 11, Sunday Excluded
October 12, statutory Columbus Day Excluded
October 13, Tuesday Day 1
October 14, Wednesday Day 2
October 15, Thursday Day 3
October 16, Friday Day 4
October 17–18, weekend Excluded
October 19, Monday Day 5: assumed receipt

The fictional federal notice uses October 19 as assumed receipt.

October 19, 2026+30 consecutive calendar days=November 18, 2026\text{October 19, 2026}+30\text{ consecutive calendar days} =\text{November 18, 2026}October 19, 2026+30 consecutive calendar days=November 18, 2026The October 19 trigger date is excluded from that thirty-day addition. Weekends and Veterans Day occurring inside those thirty days are not removed by the five-excluded-day assumption.

Alternative actual-receipt fact

Suppose the consumer actually received the notice on October 14:

October 14+30 calendar days=November 13\text{October 14}+30\text{ calendar days}=\text{November 13}October 14+30 calendar days=November 13Regulation F’s official interpretation permits retaining the disclosed assumed-receipt-based date. Arkansas § 508’s actual-receipt wording and its integration with that federal assumption remain a separate hold.

Adverse branch: If the letter is returned undeliverable, the collector cannot treat the calendar assumption as curing the failed delivery. New proper delivery and its applicable period must be evaluated.

Both illustrated endpoints are weekdays; no final-day extension rule is assumed. C050–C063. Consumer Financial Protection Bureau+2

Example 2 — Attempts, a conversation, two debts, and the rolling window

Assume one person, P, two ordinary debts A and B, convenient local times, no cease request, no counsel bar, and no special consent exclusion. The limited-content message is assumed to satisfy the federal definition; Arkansas compatibility is not thereby approved.

Event Date/time Debt/person Result Federal count treatment
1 Sept. 14, 10 a.m. A / P Rings, unanswered A +1
2 Sept. 15, 10 a.m. A / P Rings, unanswered A +1
3 Sept. 15, 11 a.m. B / P Rings, unanswered B +1
4 Sept. 16, 10 a.m. A / P Qualifying limited-content voicemail A +1
5 Sept. 16, 3 p.m. A / P Busy signal; not connected Excluded
6 Sept. 17, 10 a.m. A / P Rings, unanswered A +1
7 Sept. 18, 10 a.m. A / P Rings, unanswered A +1
8 Sept. 18, 11 a.m. B / P Rings, unanswered B +1
9 Sept. 19, 10 a.m. A / P Rings, unanswered A +1
10 Sept. 20, 10 a.m. A / P Rings, unanswered A +1
11 Sept. 20, 2 p.m. A / P P calls back; conversation about A Not an outbound placed call; starts conversation period
12 Sept. 21, 10 a.m. A / P Collector calls, phone rings A +1; conversation-period problem

September 14–20 reconciliation

  • Outbound attempts: 10.
  • Connected/countable calls: 9.
  • Debt A: 8 attempts − 1 busy exclusion = 7 counted calls.
  • Debt B: 2 counted calls.
  • Inbound conversation: 1, not added to outbound frequency.

For September 15–21, A still has seven counted calls because September 14 drops out and September 21 enters. Nevertheless, the September 21 call falls within the separate conversation period.

Conversation date September 20 is day one. The seven-consecutive-day period runs through September 26. Thus, satisfying the numerical placed-call count does not cure the conversation-prong problem.

Adverse branches: Another counted A call on September 20 would create eight within that seven-day window. A valid limited consent could affect counting only within its actual scope and duration. Even the original seven-call pattern is not blanket permission under federal harassment law or Arkansas law. C029, C038–C044. Consumer Financial Protection Bureau+1

Example 3 — Oral dispute, written dispute, and original-creditor request

Fictional sequence

Date Event Effect
Sept. 3, 2026 Proper written notice actually received Receipt predicate established for this illustration.
Sept. 10 Consumer orally disputes amount Dispute knowledge matters; writing-based pause not yet established by this event alone.
Sept. 14 Consumer mails written amount dispute and original-creditor request Submission occurs comfortably inside the period.
Sept. 16 Collector receives both Applicable collection pauses begin.
Sept. 22 Collector obtains internal verification Internal possession alone does not end the pause.
Sept. 24 Collector properly mails sufficient verification only The original-creditor request remains unanswered.
Sept. 28 Collector properly mails the different original creditor’s name/address On assumed sufficiency and compliance, both illustrated response requirements are satisfied.
Oct. 1 Consumer receives the second response Receipt is not substituted for the sending/mailing trigger specified in the provisions examined.

No fixed thirty-day deadline for the collector to complete verification is invented. Until the required response occurs, the relevant pause remains.

Adverse branches: An insufficient response, missing original-creditor information, global cease request, known representation, prohibited medium, or state electronic-delivery issue can independently prevent the proposed resumption. A completed validation exchange does not extend a court deadline or establish debt ownership. C064–C078. Consumer Financial Protection Bureau+1

Example 4 — Failed electronic notice, accepted electronic dispute, and opt-out

Date Fictional event Consequence on assumed facts
Aug. 3, 2026 Initial telephone communication Follow-up validation duty is triggered unless otherwise satisfied.
Aug. 4 Follow-up email bounces; required E-SIGN conditions also absent Two independent delivery/compliance defects; no valid assumption of receipt.
Aug. 5 Proper paper notice mailed A new delivery attempt, only two days after initial contact.
Aug. 10 Paper notice actually received Receipt established for this example.
Aug. 12 Consumer sends dispute to an email address the collector accepts for disputes Can satisfy the federal writing requirement; pause begins on collector receipt.
Aug. 13 Consumer opts out of collection email to that address Address-specific restriction applies.
Aug. 18 Collector emails verification to the opted-out address without required electronic-disclosure predicates Do not treat this as a compliant pause-ending response.
Aug. 20 Collector properly mails sufficient verification Can satisfy this response requirement on the assumed facts; other contact restrictions remain.

The consumer’s ability to submit an electronic dispute does not prove the collector obtained E-SIGN consent for its disclosures. An email opt-out is also not automatically a global cease request.

Arkansas’s written/mail text and electronic-law integration remain held; this example uses proper paper delivery for the operative response. C047, C062–C072. Consumer Financial Protection Bureau+2

F. Twelve additional fictional actor/channel postures

Posture Fictional facts Positive and adverse branches
P05 — Original creditor versus buyer An originating retailer collects in its own name; a separate purchaser acquires defaulted balances. Analyze each actor separately. Buyer ownership does not answer principal-purpose status; original-creditor status does not authorize deception. C003–C009.
P06 — Servicer and default Servicer obtains an account while current; a different company receives it after default. Acquisition timing can affect the specified exclusion, but does not replace the complete definition. C005.
P07 — Affiliate and employee One employee collects only for the employer; a separate affiliate regularly collects across a corporate group. Employment and affiliate exclusions require their distinct facts. C006.
P08 — Lawyer and known counsel Collection lawyer knows the consumer is represented concerning the debt. Lawyer status does not exempt the contact; counsel knowledge, contact availability, and exceptions must be tested. C010, C017–C018.
P09 — Workplace Home letter is unanswered; employer forbids collection calls. The Arkansas home-letter predicate does not override the federal employer restriction. C020–C021.
P10 — Relative’s location information Collector asks a sibling where the consumer lives. Limited location inquiry is different from disclosing the debt or asking the sibling to pressure payment. C022–C024.
P11 — Limited-content voicemail Voicemail contains all permitted federal elements, but the agency’s licensed name signals debt collection. Federal and Arkansas identification compatibility is unresolved; no script approval. C038–C039.
P12 — Global cease versus email opt-out Consumer first stops email, later sends a written global cease request. Different rules and exceptions apply; neither action extinguishes the debt. C025–C028, C047.
P13 — Known oral dispute and reporting Collector learns an oral dispute and then chooses to furnish information. Known dispute must not be concealed; full FCRA duties and prior-report updates remain separate. C035–C037.
P14 — Duplicate dispute with new proof Consumer repeats a dispute but adds a previously unprovided canceled check. New material information can defeat the federal duplicative-dispute shortcut. No payment-effect advice is supplied. C071–C072.
P15 — Pleading and ordinary demand Collector serves a formal pleading and separately sends an ordinary demand. Federal pleading exception is communication-specific; it does not exempt the separate demand or settle Arkansas’s differing text. C052–C053.
P16 — Itemization versus ownership A notice accurately reconciles a balance but does not establish the sender owns or may enforce the account. Disclosure arithmetic is not proof of title, standing, validity, or timeliness. C054–C058, C076–C078.

J. Researcher self-check

Freshly read: the relevant official Arkansas enactment and rule bodies; current displayed federal Code and Regulation F provisions; official interpretations; the linked E-SIGN and financial-product definitions; six official published judicial bodies; and the stated effective-date materials.

Not established: complete October 2026 Arkansas primary authentication, every original rule-adoption instrument, complete Arkansas–Regulation F electronic/exception harmonization, a full citator, local or tribal law, or any actual consumer/provider/contract/communication facts.

The principal unresolved applications are:

  • Arkansas’s written-notice and mailed-response text versus federal oral, electronic, same-creditor, and duplicative-dispute alternatives.
  • Arkansas agency-identification rules versus federal limited-content voicemail.
  • Actual receipt, known failed delivery, E-SIGN consent, and channel opt-out facts.
  • Remote-state nexus and the precise actor/debt classification.
  • Verification sufficiency for disputes materially different from the published cases examined.

Actor or obligation · Supported classification inquiry · Conditions and unresolved application · 12 data rows

Actor or obligationSupported classification inquiryConditions and unresolved application
Ordinary consumer obligationBoth the federal definition and Arkansas’s consumer-conduct subchapter address obligations arising primarily from personal, family, or household transactions.A natural-person obligor alone does not make a business obligation a consumer debt. Mixed-purpose transactions require actual facts. C001.
Person wrongly pursued“Consumer” includes an allegedly obligated person.Dunham rejected the proposition that mistaken identity necessarily removes the person from the Act’s protections. C002.
Original creditor collecting in its own nameOrdinarily requires analysis distinct from a collector regularly collecting another’s debt. The false-name provision and other statutory predicates can change the result. No universal original-creditor immunity is declared. C003–C004.
Purchaser of defaulted debtOwnership does not settle every federal collector-status question.Henson addressed the “owed another” branch; the principal-purpose branch remained open there. C008.
Debt buyer using outside collectorsPrincipal-purpose status can exist despite outsourcing.Reygadas applied that branch on its record; it did not declare every investment owner a collector or resolve every agency-liability question. C009.
ServicerAcquisition before or after default matters to the specified exclusion.Actual acquisition, default status, role, and statutory branch must be established. Default timing is not a universal standalone status test. C005.
Employee or affiliateThe employee and affiliate exclusions contain separate conditions.A common owner, salary, or corporate label does not automatically establish either exclusion. C006.
Fiduciary, government actor, process server, nonprofit counselorApply the particular statutory exclusion and its activity conditions. No generic fiduciary, nonprofit, or government-connected exemption is presumed. C007.
Attorney or law firmRegular consumer-debt collection through litigation can be covered.Heintz rejects a blanket federal attorney exemption. Particular formal-pleading exceptions do not exempt all attorney communications. C010.
Security-interest enforcerEnforcement-only activity can have limited-purpose treatment under the federal definition.Obduskey did not decide all judicial foreclosures, deficiency demands, or conduct beyond security enforcement. Ordinary money demands require separate analysis. C011.
State-license-exempt actorState credential treatment and consumer-conduct coverage are different inquiries. No conclusion from PASS-06 is adopted. C012.
Remote actor contacting ArkansasThe actual activity, consumer connection, applicable definition, and jurisdictional predicates matter.Interstate-commerce/mails language is not a complete personal-jurisdiction or choice-of-law holding. An out-of-state office alone supplies no categorical federal exemption. C013.

IssueFederal requirementArkansas requirement or additional conditionApplication boundary
Time and placeDefault convenient hours are after 8 a.m. and before 9 p.m. at the consumer’s location, absent contrary knowledge.§ 17-24-504 contains the corresponding time/place restriction.A known inconvenient time or place can be prohibited within those hours. C015–C016.
Consumer initiates contactRegulation F permits the specified limited response to a consumer’s inconvenient-time communication. No unlimited future consent follows from that contact.A response opportunity is not permission for an ongoing campaign. C016, C019.
Represented consumerKnown representation, ascertainable counsel contact, and the stated exceptions govern.§ 504 contains a corresponding counsel restriction.Actual knowledge and reasonable attorney nonresponse or consent must be established. C017–C018.
WorkplaceKnown or reasonably known employer prohibition restricts contact.§ 307 and Rule 280-302 add a home-letter predicate before specified workplace letters or calls.Satisfying the state home-letter condition does not override the federal employer prohibition. C020–C021.
Third partiesCollection disclosure is restricted, subject to specified recipients and exceptions.§ 504(b) supplies a parallel statutory restriction.A spouse/representative definition for communications does not establish personal liability for the debt. C022–C023.
Location informationIdentify the caller, explain the location-information purpose, disclose employer only if requested, and do not disclose the debt; repeated contacts are restricted.§ 503 separately supplies these conditions.Locating the consumer is not permission to pressure relatives or coworkers. C024.
Global cease requestA qualifying written refusal or cease request restricts further communications, with three statutory exceptions.§ 504(c) has its own written-request and receipt language. An exception does not authorize a false or unlawful threat. C025–C026.
Stop a particular mediumRegulation F recognizes medium-specific requests, including oral requests, and limited exceptions.Do not assume that this is identical to Arkansas’s global written-cease procedure.Stopping email does not itself extinguish the debt or necessarily stop every other lawful medium. C027–C028.
HarassmentGeneral harassment prohibition applies across conduct and channels.§ 505 independently prohibits listed and other harassing conduct.Numerical call presumptions are not universal safe harbors. C029, C044.
False statements and threatsCharacter, amount, legal status, authority, legal documents, and threatened action must not be misrepresented.§ 506 independently addresses corresponding conduct. No suit, arrest, seizure, or “legal department” threat is validated merely because a debt is alleged. C030–C031.
Added interest or chargesAn amount must be expressly authorized by the agreement creating the debt or permitted by law.§ 507(b)(1) separately imposes that condition.A notice does not create an entitlement to a fee. C032.
Postdated instrumentsSpecial notice and timing restrictions apply; early deposit and prosecution threats are restricted.§ 507 contains parallel provisions. This pass gives no payment or instrument-use advice. C033.
Postcards and envelopesDebt disclosure through postcards and prohibited envelope markings is restricted.§ 507 separately addresses these practices.Business-name exceptions do not authorize a name that reveals collection contrary to the rule. C034.
Credit informationA collector must not communicate known or reasonably known false credit information, including omission of a known dispute.§ 506(b)(8) independently addresses disputed-debt representation.Full FCRA furnishing, investigation, and reporting-period duties remain deferred. C035–C037.
Identification and translated disclosuresInitial and subsequent collector disclosures apply, with a formal-pleading exception; required disclosures must match the language used.Rule 280-302 requires agency/trade-style identification and specified collection information.Federal assumed-name or limited-content provisions do not automatically settle the state rule. C039, C089.

Consumer-provided emailDirect use about the debt or direct consent, without relevant opt-out/withdrawal.An address somewhere in an old file is not automatically qualifying consent.
Creditor-transfer email routePrior creditor use, named-collector notice, shared-address warning, simple opt-out, at least 35 days to respond, and additional conditions. Not a shortcut for a known employer-provided email address.
Prior-collector email routeSpecified qualifying origin, actual use by the immediately preceding collector, and no opt-out.The collection chain must satisfy the rule’s facts.
TextDirect consumer text/consent plus the specified recent-contact or reassignment-check conditions.A voice call alone is not the consumer-text predicate.
Electronic opt-outSimple instructions in each covered electronic communication or attempt, without a fee or unnecessary additional information.Required disclosures cannot be sent to an opted-out address merely because they are required.
Social mediaPublicly viewable collection contact is prohibited; private contact remains subject to other rules.A private-message setting does not cure deception, third-party exposure, or lack of a lawful basis.

Henson v. Santander, 582 U.S. 79 — S039U.S. Supreme Court, June 12, 2017; unanimous. Purchasing and collecting owned debts did not satisfy the particular “owed another” branch adjudicated.Principal-purpose and other possible collection activity were expressly left unresolved. Later Reygadas analysis read.
Reygadas v. DNF Associates, 982 F.3d 1119 — S040Eighth Circuit, December 14, 2020; published.
291 — S041U.S. Supreme Court, April 18, 1995; unanimous. Regular consumer collection through attorney litigation falls within the FDCPA.Current pleading-specific exceptions remain separate. Not a ruling that all legal work is debt collection.
Obduskey v. McCarthy & Holthus, 586 U.S. 466 — S042U.S. Supreme Court, March 20, 2019; unanimous. The nonjudicial security-enforcement activity before the Court received limited-purpose treatment.Sotomayor concurred. Broader money demands, judicial proceedings, and conduct outside the addressed enforcement activity were not universally exempted.
Dunham v. Portfolio Recovery Associates, 663 F.3d 997 — S043Eighth Circuit, December 15, 2011; published. Wrongly targeted person could be an alleged consumer; verification was sufficient for the mistaken-identity dispute on the record.Affirmed on alternative reasoning; did not resolve every possible verification demand or trial-proof requirement. No separate opinion shown.
Wilhelm v. Credico, 519 F.3d 416 — S044Eighth Circuit, March 3, 2008; published. Addressed known-dispute reporting and an allegedly deceptive litigation threat.Affirmed in part and reversed/remanded in part. Its reporting holding is not a complete FCRA rule. State-specific interest issues were not imported into Arkansas.
