Arkansas ordinary consumer money-debt litigation: court selection, venue, service, response, default, and relief
Research access date: October 27, 2026. Exact source-opening times were not logged and are unknown. The October 22 baseline is not a current-verification date.
Provenance: Earlier raw answers remain unchanged. The supplied coordinator-review history is not an independent review or a source-opening record. PASS-04 through PASS-08 were not used as legal premises. No local coordinator files were accessed or written.
Scope: Entry into an ordinary money-debt action, the proper court and party, venue, commencement and service, responses, default, and the necessary set-aside and appeal boundaries. No actual claim, defendant, judgment, filing deadline, or entitlement is determined.
Principal findings
Amount alone does not establish the correct court or small-claims eligibility. The ordinary state-district civil ceiling is $25,000 under Administrative Order 18’s state-district provisions; small claims remains $5,000. Contract amounts exclude interest, costs, and attorney fees for these jurisdictional calculations. Collection agencies, collection agents, assignees, and money-lending businesses face express small-claims plaintiff restrictions. C001–C012. Court Rules Network+1
Actual knowledge of a lawsuit is not necessarily valid service. Current Rule 4(k) has conditions; it is not a universal actual-notice cure. The 2026 Shack and Syoboda decisions illustrate that a conclusory return or delivery to a cashier does not establish missing service predicates. C030–C049. law.justia.com+1
Thirty days is the ordinary original-answer period in the circuit, district, and small-claims bodies examined, but the documents, service rules, extension provisions, and exceptions differ. District court uses a combined complaint and notice rather than a separate summons. Its commencement/service-extension text is not identical to circuit Rule 4. Three additional business days are not automatically added to initial service. C022–C029, C050–C062. Court Rules Network+2
Missing a response date does not itself create a clerk-entered money judgment. Arkansas Rule 55 makes default judgment a judicial act. Appearance can create a notice right even when a response was late. Liability, the amount recoverable, fees, and proper service remain distinct issues. C063–C077. Court Rules Network+1
Two October 1, 2026 final orders matter. The court adopted changes to Rule 54(b)/Appellate Rule 4(a) and Rule 54(e)(2), following June proposals. A rule compilation last updated in September can therefore omit operative October changes. C074, C097–C098, C109. Justia Law+1
Currentness is partially authenticated, not comprehensively certified. Selected official enactments, official forms, published judicial orders and opinions, and federal statutory bodies were read. Several integrated Arkansas rules were accessible only through nonofficial reproductions. Those limits are retained below.

A. Court, actor, amount, and venue
A1. Court-selection matrix
| Route |
Supported gateway |
Material restrictions and consequences |
| Circuit court |
Amendment 80 supplies general original jurisdiction over justiciable matters not otherwise assigned. |
Do not overlook district court’s exclusive contract jurisdiction at the stated $100-or-less level. Circuit venue, personal jurisdiction, service, and party capacity remain separate. C001–C002. |
| State district court, civil division |
AO 18 § 6(a) provides concurrent contract jurisdiction up to $25,000, excluding interest, costs, and attorney fees. |
The particular court’s territorial authority and applicable state-district status must be established. A court directory alone is not the governing rule. C003–C004. |
| Small-claims division |
AO 18 § 4 refers to the $5,000 jurisdictional amounts in § 3. |
The $25,000 state-district civil ceiling does not become the small-claims ceiling. C005. |
| Small-claims plaintiff |
An eligible individual may bring a qualifying claim; certain Arkansas corporations have a specific exception. |
Collection agencies, collection agents, assignees, and businesses lending money at interest are expressly restricted from bringing actions there. C006–C008. |
| Qualifying corporation in small claims |
AO 18 specifies stockholder/ownership alternatives and representation by an officer. |
This is not a general rule permitting any LLC or corporation to appear through any employee. C008–C009. |
| Attorney participation in small claims |
When the judge determines that an attorney represents a party, AO 18 directs transfer to the civil docket. |
Retaining counsel is not forbidden; the administrative track changes. C007. |
| Plaintiff’s claim exceeds district jurisdiction |
District Rule 7(b) directs dismissal for lack of subject-matter jurisdiction. |
The rule does not simply direct automatic transfer of every excessive plaintiff claim. C010. |
| Compulsory counterclaim or setoff exceeds district jurisdiction |
Rule 7(c) directs transfer of the entire case to circuit court. |
A permissive counterclaim, cross-claim, or third-party claim is treated differently under Rule 7(d). C010–C011. |
| District appeal to circuit |
District Rule 9 supplies a separate, document-specific appeal route. |
A notice of appeal alone is not the prescribed district-to-circuit filing package. C092–C094. |
| Removed federal action |
Federal procedure governs the removed case; Arkansas Rule 55(f) protects specified federal answers or Rule 12 motions after remand. |
No federal answer clock is supplied here. Removal does not make Arkansas response rules universally controlling in federal court. C062. |
AO 18’s division designations concern administration and caseload management, not an independent division-based subject-matter barrier. The reproduction still contains historical wording in places; the current judiciary page corroborates the ordinary $25,000/$5,000 framework, but the complete consolidated adoption chain and every local department assignment remain held. Court Rules Network+1
An individual’s business-purpose obligation may be an ordinary contract claim within a court’s monetary jurisdiction while falling outside the consumer-purpose predicates of the FDCPA. Conversely, an amount below $5,000 does not make a debt buyer eligible to sue in small claims.
A2. Venue is not subject-matter jurisdiction or service
General circuit-court venue
The displayed § 16-60-101, supported by Act 830 of 2015, identifies general circuit venues subject to specified exceptions: a substantial part of the relevant events or omissions; the defendant’s residence or qualifying entity office at the relevant time; or the plaintiff’s corresponding residence or office. The precise statutory predicates must be used—not a generic present-address rule. C013–C014.
Act 830 also removed the former debt-specific § 16-60-111 language. That historical section cannot be presented as current merely because an older guide or decision quotes it. C015. Justia Law+1
Covered debt-collector venue
For the ordinary consumer-debt action in this pass:
- 15 U.S.C. § 1692i(a)(2) uses the judicial district or similar legal entity where the consumer signed the contract sued upon or resided when the action commenced.
- Arkansas § 17-24-510(a)(2) uses the corresponding stated county alternatives.
- The real-property-enforcement branch is separate and deferred.
- These provisions do not themselves authorize an otherwise unavailable action. C016–C018.
Coverage requires the actual consumer, debt, collector, and legal-action predicates. An original creditor, debt buyer, servicer, attorney, or state-license-exempt actor is not classified solely by its label. The relevant definitions were freshly read for this pass. U.S. Code+2
Preservation and waiver
Personal jurisdiction, venue, process, and service objections are not identical to subject-matter jurisdiction. Rule 12’s consolidation and waiver provisions matter. In Farm Bureau, the defendant preserved service and personal-jurisdiction objections in its original response; discovery participation without seeking affirmative relief did not waive them on that record. That holding is not permission to omit the objections and raise them at any later time. C019–C021. Justia Law
The complete general district-court venue hierarchy and every territorial statute were not established. Section 16-60-101 should not be mechanically transferred from circuit court to every district department.
B. Commencement and service
B1. Commencement is more than obtaining a file number
| Issue |
Circuit route |
District/small-claims qualification |
| Filing |
Rule 3 requires filing with the proper clerk, who records date and precise time. |
District Rule 3 also uses filing, but expressly conditions commencement against a defendant on timely service or a qualifying extension. |
| Initial process |
Rule 4 summons issued by clerk, with complaint served together. |
District Rule 4 uses a signed complaint containing the notice and proof-of-service form; no separate summons is required. |
| Written instrument |
Rule 10(d) generally requires attachment of the instrument on which the claim or defense is based unless good cause is shown. |
Court-specific incorporation and the actual claim remain material. |
| Initial service window |
Circuit Rule 4(i) ordinarily uses 120 days. |
District Rule 3 also uses 120 days, but its extension language is different. |
| Extension |
Circuit rule requires timely written motion, good cause, and an order entered by the applicable later deadline. |
District Rule 3 says the extension must be made by written order or docket entry within the 120-day period. |
| Failure |
Dismissal consequences follow the applicable rule. |
“Without prejudice” does not itself guarantee a later action will be timely; saving and limitation questions are deferred. |
C022–C029. The circuit rule’s order deadline—thirty days after the timely extension motion, the original period’s end, or the prior extension’s end, whichever is later—must not be silently substituted into District Rule 3. Court Rules Network+2
B2. Service-method matrix
| Method or actor |
Necessary predicates actually examined |
What does not establish service by itself |
| Summons content |
Clerk signature, court seal/date, party and court information, response command and default warning, and other Rule 4(b) requirements. |
A complaint copy or collection letter without the required process. C030. |
| Authorized server |
Sheriff/deputy, qualifying appointed server, or other rule-authorized person; mail/carrier provisions separately allow the stated sender. |
A person’s title or declaration without proof of appointment/authority. C031. |
| Personal delivery |
Delivery under Rule 4(f)(1). If the person refuses, the server must first make the purpose known and then leave papers in the required proximity. |
A checked “refused” box without the necessary event facts. C032. |
| Residential substitute |
The specified family member, at least eighteen, at a place where the defendant resides. |
Any co-occupant, an old address, or a place associated only with domicile. C033. |
| Agent |
Actual authority under the rule, statute, or appointment. |
Relationship, employment, or willingness to accept papers alone. C034. |
| Minor/incapacitated person |
Special Rule 4 service and Rule 17 representation conditions. |
Treating ordinary adult service as sufficient without considering the protected status. C035. |
| Incarcerated person |
Current Rule 4(f)(4), including the June 4, 2026 amendment, addresses the designated agent/person-in-charge route and related delivery requirements. |
Merely sending papers to a prison address. C036. |
| Corporation/LLC/organization |
Applicable Rule 4(f) category; qualifying registered agent, officer, manager, or other specified agent. |
An on-duty cashier or ordinary employee automatically qualifying. C037. |
| Statutory entity fallback |
§ 4-20-113’s ordered alternatives require the preceding conditions and diligence. |
Skipping directly to a person in charge without establishing the statutory fallback. C038. |
| Certified/registered mail |
Rule 4(g)(1)’s address, receipt, addressee/authorized-agent, and default-proof conditions. |
Mailing alone, an unauthorized signature, or an “unclaimed” return. C039–C040. |
| Mail refusal |
Actual qualifying refusal evidence and prompt first-class follow-up with the required warning. |
Equating unclaimed mail with refusal. C040. |
| First-class acknowledgment |
Required notice, acknowledgment copies and prepaid return mechanism; signed acknowledgment establishes the relevant receipt facts. |
The twenty-day acknowledgment request is not the answer period. C041. |
| Commercial carrier |
Approved carrier and applicable signature/refusal/follow-up proof. |
A tracking entry alone establishing every predicate. C042. |
| Ordinary warning order |
The rule’s eligible nonpersonal-jurisdiction setting, diligent-inquiry affidavit, publication/mailing or permitted posting, and default prerequisites. |
General inability to find someone, without actual diligence; or assuming publication always supports a personal money judgment. C043. |
| Court-ordered alternative |
A qualifying motion, affidavit and court order specifying a method reasonably calculated to give notice. |
A plaintiff inventing an alternative method without the required order. C044. |
| Out-of-state/international service |
Rule 4(h), applicable law and any treaty; personal jurisdiction still required. |
Service outside Arkansas itself creating adjudicatory jurisdiction. C045. |
| Waiver/appearance |
Signed filed waiver or legally sufficient conduct, with Rule 12 preservation analyzed separately. |
Actual knowledge automatically waiving every defect. C047–C049. |
The statute’s entity-mail fallback includes a conditional service-effect rule tied to receipt, signed return, or the stated post-deposit period. It is not a general rule that every mailed summons becomes effective after five days. C038.
B3. Warning orders and default prerequisites
Current Rule 4(g)(3) is not a universal substitute for personal jurisdiction in an ordinary money action. Its eligible category, diligent inquiry, weekly publication, mailing to a known last address, indigent-posting alternative, and required proof must be satisfied. The applicable thirty-day waiting condition before default is distinct from the ordinary personal-service answer clock.
Rule 4(g)(4) separately permits a court-authorized alternative after the prescribed showing. Whether that method constitutionally and procedurally supports the particular personal money judgment must be established. C043–C045.
Self found the affidavit’s conclusory diligence insufficient under the rule version then governing. It is useful for the factual diligence problem, but its old subsection numbering and exact text cannot replace the 2019 rewrite. Justia Law+1
B4. Proof, actual notice, and technical defects
A return is evidence of service; it is not conclusive proof of an unperformed statutory act. Rule 4 permits appropriate proof amendments, and failure to file proof is not necessarily failure of service. Conversely, a timely-looking return does not cure invalid service. C046.
The relevant distinctions are:
- Shack: missing announcement-before-refusal facts were not supplied by the return’s conclusion.
- Syoboda: service on a cashier did not establish authorized-agent status or the statutory fallback.
- Prowse: Rule 4(k) did not cure complete failure to serve a summons.
- Wine: a dismissal motion was not the timely answer required for the Rule 4(k) route examined.
- White: the actual service-date version of the rule mattered; an old family address did not automatically become a qualifying residence.

C. Response, default, and relief
C1. Response and computation matrix
| Event |
Rule and ordinary period |
Qualification |
| Circuit original answer |
Rule 12(a): ordinarily 30 days after service, for resident and nonresident defendants. |
Arkansas-incarcerated defendant has the specified sixty-day branch; warning-order response differs. |
| District original answer |
District Rule 6(b): 30 days after complaint service. |
Written, signed answer; factual defenses and requested affirmative relief must be addressed. |
| District counterclaim/cross-claim response |
Current reproduction states 30 days. |
The 2012 amendment history is identified; its original adoption body was not separately obtained. |
| Small-claims original response |
The adopted 2011 amendment changed the ordinary period to 30 days. |
Old twenty-day notices are not current authority. Current complete Rule 10 integration remains partially held. |
| Rule 12 motion |
The specified motions alter the answer time under Rule 12(a). |
Denial/deferred ruling or more-definite-statement events have their own trigger; a generic letter does not qualify. |
| Amended pleading |
Rule 15 supplies the remaining-time-or-twenty-day rule, whichever is longer, unless ordered otherwise. |
Amendment does not automatically restore a defense already waived under Rule 12. |
| Trigger-day computation |
Rule 6 excludes the triggering day; applies final-day weekend/holiday/closure rules. |
For periods under fourteen days, intermediate excluded days matter. |
| Additional service days |
Current Rule 6(d) provides three business days for specified service methods. |
It does not add three days to the initial Rule 4 answer or preanswer-motion period. |
| Electronic filing |
Filing and service are separate. |
Current AO 21 cutoff, rejection and outage mechanics were not authenticated; no universal midnight rule is supplied. |
C050–C061. A demand-letter response, validation request, settlement discussion, complaint to an agency, or phone call to the creditor does not inherently constitute the court-filed and served answer required by these rules. Court Rules Network+2
C2. Default is a judicial decision, not an automatic balance award
Rule 55(a) says the court may enter default judgment when a party fails to plead or otherwise defend. Arkansas’s rule does not adopt the federal clerk-default structure as a universal state procedure. District Rule 8 likewise uses discretionary judgment language and requires a docket entry of date and amount. C063–C064. Court Rules Network+1
An appearance and a timely defense are not identical. An untimely answer may fail to prevent default liability yet still create the Rule 55(b) right to written notice of the application at least three days before the hearing. Robinson also recognized the appearing defendant’s opportunity to participate on damages. C065–C066.
Default does not make every requested dollar recoverable. Rule 54(c) limits default relief to the kind and amount demanded. The court may need evidence or a hearing on the amount, interest, fees, or other necessary facts. McGraw upheld default liability on its record but reversed the damages disposition for inadequate proof. Its historical twenty-day answer discussion is not used as a current clock. C067–C074. Justia Law+2
Account affidavits
Section 16-45-104 supplies a special account-proof mechanism, including credit-card and revolving accounts. The affidavit must satisfy the statute’s listed creditor, debtor, assignment, authority, records, amount, and interest-source requirements and be attached to the complaint. A sworn denial requires proof by other evidence of the disputed portion.
This is not a rule that any collection statement proves ownership, service, or every fee. Nor is it a complete trial-evidence dossier. C071–C072. Justia Law+1
Protected defendants
Rule 55(b) does not authorize default judgment against an infant or incompetent person. Rule 17’s representative/guardian safeguards must be considered. A deceased person, estate, executor, or administrator presents additional capacity and substitution questions not resolved by ordinary adult service. C035, C075.
For a nonappearing defendant, 50 U.S.C. § 3931 requires the specified military-status affidavit or equivalent declaration, with facts or the stated inability to determine status. Depending on the result, appointment of counsel, a stay of at least ninety days, or security can be required. Its reopening provision has separate service-period, application-time, material-effect, and defense predicates. No actual military-status inquiry was made. C076–C077. U.S. Code
C3. Relief routes are not interchangeable
| Route |
Supported rule |
Time/proof distinction |
| Default judgment: Rule 55(c) |
Mistake, inadvertence, surprise, excusable neglect; voidness; fraud/misrepresentation/misconduct; or other justifying reason. |
Meritorious defense ordinarily required; not required if judgment is void. The rule contains no express motion deadline, but appeal and other issues remain separate. |
| Nondefault correction: Rule 60(a) |
Errors/mistakes or miscarriage of justice, with prior notice. |
Court action within ninety days after filing of judgment/order; not a universal default-relief clock. |
| Clerical correction: Rule 60(b) |
Clerical mistakes or oversight/omission. |
Not a vehicle to make a new substantive decision; appeal-stage leave rules matter. |
| Specified later nondefault relief: Rule 60(c) |
Enumerated grounds, including certain newly discovered grounds, constructive-service situations, fraud, clerk misprision, protected persons, or death before judgment. |
Some grounds have explicit one- or two-year limits and service conditions. The rule’s exclusion of default judgments must be respected. |
| Defense showing: Rule 60(d) |
Prima facie valid defense under its stated conditions. |
Do not substitute this provision for Rule 55’s void-default exception. |
| Stay pending relief |
Rule 60(j), Rule 62, and other applicable provisions require their predicates and court action. |
Filing a motion does not itself suspend operation or finality under Rule 60(k). |
| Appeal |
Separate circuit-appellate and district-to-circuit rules. |
A motion does not automatically extend either clock. |
C078–C091. Gurien distinguishes a Rule 55(c) motion from an untimely attempt to appeal the original district judgment. Peralta holds, on its no-service/no-notice posture, that relief cannot be conditioned on showing a meritorious defense. Neither decision supplies permission to ignore current appellate requirements. Justia Law+2
C4. Necessary appeal and finality boundaries
District to circuit: Rule 9(a) measures thirty days from the docket entry awarding judgment, regardless of a later separate written judgment, and says postjudgment motions do not extend that period. Rule 9(b) requires the specified certified docket/record and certified complaint or small-claims claim form. The special forty-day affidavit route requires actual clerk-failure predicates. Appeal service and supersedeas have separate requirements. C092–C094.
Circuit appellate route: Appellate Rule 4 generally uses thirty days from entry, subject to its actual exceptions. Qualifying timely postjudgment motions can trigger the decision/deemed-denial provisions; merely naming a motion “Rule 55” or “Rule 60” does not prove that extension. The no-notice provision separately requires failure of notice, diligence, lack of prejudice, and the stated motion period. C095–C096.
October 1, 2026 amendment: Rule 54(b) now permits the certification to be attached or separately filed, with specified fourteen-, thirty-, and forty-five-day provisions. Appellate Rule 4(a) measures the relevant appeal from entry of the certification in that setting. This is not a new answer period or a universal appeal-extension device. C097–C098. D. Official forms and government charges
D1. Forms actually inspected
| Form/body |
What was read |
Authority/revision limitation |
| Arkansas Supreme Court Form of Summons |
Caption, defendant identification, thirty-/sixty-day response directions, default warning, clerk signature/seal, and proof-of-service alternatives. |
Official PDF identifies January 1, 2019 revision. It contains a stale proof-rule cross-reference; form text does not supersede later rules. |
| Notice and Acknowledgment for Service by Mail |
Complaint/summons notice, acknowledgment, sender expense warning, twenty-day return request, actual receipt/date and signature/authority fields. |
Official 2019 form. The acknowledgment-return period is not the answer period. |
| District complaint/notice form in Rule 4 |
Claim basis, amount, parties/addresses, signed complaint, thirty-day notice and service proof. |
Current reproduction plus adopted 2011 change; no separate summons. |
| District answer form in Rule 6 |
Denials, affirmative defenses, requested affirmative relief, factual bases, address, signature and certificate. |
Reproduction read; exact current clerk-specific packet not authenticated. |
| Small-claims forms in adoption orders |
Historical claim/response fields and adopted thirty-day amendment. |
Not a certification of every current local form. |

D2. Verified fee components, not an all-in quote
| Component |
Amount supported |
Qualification |
| Circuit civil filing base |
$150 |
§ 21-6-403; exceptions and actual filing type matter. |
| District civil filing base |
$65 |
§ 16-17-705 and Act 345 of 2009. |
| Small-claims filing base |
$50 |
Same authority. |
| Technology charge |
$15 |
§ 21-6-416 and selected 2025 enactments. |
| Statutory summons issuance item outside small claims |
$2.50 |
§ 16-17-126; not automatically added to a district combined complaint where no separate summons is issued. |
| Process service, postage, copies, local or other charges |
Not completely verified |
Unknown is not zero. |
| Indigency relief |
Rule 72 requires its showing and court permission. |
Not an automatic fee waiver from a self-description of poverty. |
Supported component subtotals are therefore $165 circuit, $80 district civil, and $65 small claims, before unverified additional applicable charges. These are not actual bills or a complete statewide fee schedule. C101–C102.
The § 21-6-416 mirror carries a July 1, 2026 version boundary. Act 518’s examined amendment changes the juvenile-exemption cross-reference; it does not itself delete the ordinary $15 charge. The entire 393-page act and every commencement provision were not read. Justia Law+3
E. Published holdings actually examined
| Authority |
Court/date; posture and material holding |
Limits and separate writings |
| Shack v. Munn, 2026 Ark. App. 296 — S051 |
May 13, 2026. Default based on alleged refusal service; required announcement facts were missing. Reversed and vacated. |
A return’s conclusion did not supply the missing act. Current-rule application; no separate opinion shown. |
| Syoboda, Inc. v. Garrett, 2026 Ark. App. 391 — S052 |
September 9, 2026. Cashier service and statutory fallback failed; affirmed court’s sua sponte vacatur of void default. |
Not an affirmative Rule 54 holding and not permission to serve any employee. No separate opinion shown. |
| Prowse v. Union Pacific, 2024 Ark. App. 594 — S053 |
December 4, 2024. Actual notice and timely answer did not cure complete failure to serve summons under Rule 4(k). |
Distinguished a total omission from a curable technical defect. No separate opinion shown. |
| Wine v. Chandler, 2020 Ark. App. 412 — S054 |
September 16, 2020. Dismissal motion was not the timely answer required for the Rule 4(k) analysis. |
Mixed disposition; only the material service branch used. |
| Self v. Hustead, 2017 Ark. App. 339 — S055 |
May 24, 2017. Conclusory diligent-inquiry showing did not establish warning-order service. |
Applied former rule version; current subsection numbering differs. |
| McGraw v. Jones, 367 Ark. 138 — S056 |
June 29, 2006. Affirmed default liability, reversed damages determination for inadequate proof. |
Old twenty-day answer period not imported. Glaze concurred; Corbin, joined by Hannah and Gunter, dissented in part. |
| Gurien v. Access Credit Management, 2011 Ark. App. 711 — S057 |
November 16, 2011. Rule 55(c) motion had no express deadline; district appeal analysis did not eliminate that relief route. |
Reversed/remanded without adjudicating entitlement to vacatur. Current Rule 9 filing details separately read. |
| White v. Owen, 2021 Ark. 31 — S058 |
February 18, 2021. Service-date rule version mattered; old family address did not satisfy residence facts. |
Related saving-statute and unruled-motion issues not expanded into a limitations dossier. |
| Robinson v. Robinson, 2008 — S061 |
September 24, 2008. Late answer constituted appearance; notice and damages participation mattered. |
Not a holding that every late response prevents default. |
| DeSoto Gathering Co. v. Hill, 2017 Ark. 326 — S062 |
November 30, 2017. Nonlawyer corporate representative’s court filings were a nullity in the tax-appeal posture. |
Hart dissented. AO 18’s express qualifying small-claims corporation exception is separately preserved. |
| Farm Bureau v. Campbell, 315 Ark. 136 — S063 |
November 15, 1993. Reserved service/PJ objections were not waived by defensive discovery conduct without affirmative relief. |
Historical service version; not permission to omit defenses. |
| Turley v. Staley, 2009 Ark. App. 840 — S064 |
December 9, 2009. Timely co-defendant answer supplied a common defense, supporting denial of default. |
Only the default portion used; land-contract merits are outside scope. |
| Peralta v. Heights Medical Center, 485 U.S. 80 — S050 |
U.S. Supreme Court, February 24, 1988. No-service/no-notice judgment could not be preserved solely because defendant lacked a meritorious defense. |
Texas procedural clocks not imported. Kennedy did not participate. |
These are actual opinion-body readings, not private docket checks. Quoted underlying precedents were not automatically treated as separately read. A complete current citator and all subsequent treatment remain held. Justia Law+2
F. Four worked event examples
All persons, obligations, service events, amounts, dates, and court actions below are fictional. The calculations use stipulated valid predicates, not findings about a real case. No court-specific closure calendar or electronic-filing cutoff is assumed.
Model 1 / P01 — Circuit personal service and original response
Stipulated facts: Competent adult defendant; ordinary circuit debt action; valid summons and complaint personally served Tuesday, September 8, 2026; no special statute, motion, court order, waiver, military issue, or defect changes the period.
Rule 12 supplies thirty days after service. Rule 6 excludes September 8:
| Count segment |
Days |
| September 9–30 |
22 |
| October 1–8 |
8 |
| Total |
30 |
Conditional endpoint: Thursday, October 8, 2026.
A fictional answer filed and properly served October 7 is a nonboundary event inside that period. No three-day mail addition applies merely because initial service could have been made by mail.
Adverse branches: Invalid service changes the premise. A qualifying Rule 12 motion invokes its own response trigger. Negotiating with the creditor or sending a validation dispute does not itself satisfy the court response requirement. The example does not establish a current AO 21 after-hours filing cutoff. C050–C061.
Model 2 / P02 — District versus small claims: amount and actor
District-civil branch
Assume a qualifying contract claim in the relevant state district court:
- Principal sought: $24,900.
- Stipulated lawful interest sought: $600.
- Illustrative supported filing components: $80.
- Attorney fee requested, but not yet established: $500.
24,900+600+80+500=$26,080 requested24{,}900+600+80+500=\boxed{$26{,}080\text{ requested}}24,900+600+80+500=$26,080 requestedThe contract jurisdictional amount is $24,900, because the governing amount clause excludes interest, costs, and attorney fees. The $26,080 request does not itself prove those excluded items are recoverable.
Assume valid service Tuesday, October 6, 2026:
October 7–31=25 days;November 1–5=5 days\text{October 7–31}=25\text{ days};\quad
\text{November 1–5}=5\text{ days}October 7–31=25 days;November 1–5=5 daysConditional thirty-day endpoint: Thursday, November 5.
Small-claims branch
Assume an eligible original individual claimant and a $4,800 qualifying contract claim:
4,800+300 stipulated interest+65 filing components+600 requested fee=$5,7654{,}800+300\text{ stipulated interest}+65\text{ filing components}
+600\text{ requested fee}
=\boxed{$5{,}765}4,800+300 stipulated interest+65 filing components+600 requested fee=$5,765The jurisdictional claim amount is $4,800, but the fee and interest still require legal entitlement. If an attorney represents a party, the small-claims routing rule becomes material.
Assume service Wednesday, October 7: the conditional endpoint is Friday, November 6.
Adverse branches: An assignee or money-lending business cannot infer small-claims plaintiff eligibility from $4,800. A $25,100 principal claim is not made jurisdictionally proper by calling the excess a cost. A compulsory counterclaim and a permissive claim above the limit have different Rule 7 consequences. C003–C011, C052–C053, C101–C102.
Model 3 / P03 — Unclaimed mail, refusal, acknowledgment, and appearance
Branch A: unclaimed certified mail
- Complaint filed: September 1, 2026.
- Certified packet returned unclaimed September 4.
- Defendant informally learns of the case September 10.
- Valid personal service later occurs September 15.
Unclaimed mail is not treated as refusal. Informal knowledge is not substituted for the missing service.
From September 15 personal service:
September 16–30=15;October 1–15=15\text{September 16–30}=15;\quad
\text{October 1–15}=15September 16–30=15;October 1–15=15Conditional original-answer endpoint: Thursday, October 15.
Branch B: actual refusal
A postal refusal record, required follow-up first-class mailing, correct address and other Rule 4 predicates must be established. The word “refused” alone does not authorize a deadline calculation. This branch remains held without those facts.
Branch C: acknowledgment route
Assume the proper first-class notice/acknowledgment packet is actually received October 6, and the defendant signs and returns acknowledgment October 7.
The twenty-day acknowledgment-return request is not the answer period. On the stipulated service/receipt facts, the thirty-day original-response calculation reaches November 5.
If no acknowledgment is received within the specified twenty days, the rule requires another permitted service route; mailing an acknowledgment form does not by itself establish completed service.
Appearance branch
A properly filed response expressly preserving service and personal-jurisdiction objections must be evaluated under Rule 12. Defensive participation is not automatically waiver, but an omitted defense or affirmative relief can change the result. C039–C049, C050, C059.
Model 4 / P04 — Late appearance, default application, amount, and relief
Stipulated valid-service branch
- Valid personal service: September 8, 2026.
- Conditional answer endpoint: October 8.
- Late answer filed: October 20.
- Written default application personally served: Monday, November 2.
- Hearing: Friday, November 6.
For the Rule 55(b) minimum notice:
| Day |
Treatment |
| November 2 |
Trigger excluded |
| November 3 |
Day 1 |
| November 4 |
Day 2 |
| November 5 |
Day 3 |
| November 6 |
Hearing |
The late answer is assumed to be an appearance for notice purposes. It does not automatically erase the earlier failure to respond.
Amount arithmetic
Assume the court is asked to consider:
- Original principal: $6,000.
- Actual credited payment: $500.
- Stipulated legally authorized and proved interest: $150.
- Assumed taxable and proved costs: $165.
- Attorney fee requested, not yet established: $600.
6,000−500+150+165=$5,8156{,}000-500+150+165=\boxed{$5{,}815}6,000−500+150+165=$5,8155,815+600=$6,415 requested total5{,}815+600=\boxed{$6{,}415\text{ requested total}}5,815+600=$6,415 requested totalThe second number is not an automatic award. Proof, legal entitlement, the demand limitation, and the applicable account-affidavit rule remain necessary.
Judgment and appeal boundary
Assume a final judgment is entered Tuesday, November 10. With no qualifying tolling motion or other exception:
November 11–30=20;December 1–10=10\text{November 11–30}=20;\quad
\text{December 1–10}=10November 11–30=20;December 1–10=10Conditional ordinary circuit notice-of-appeal endpoint: Thursday, December 10.
Assume a Rule 55(c) motion is filed December 1. It does not automatically extend that appeal period or stay enforcement. Any asserted Appellate Rule 4(b) extension must satisfy its actual timing and motion predicates.
Defective-service alternative
If the September 8 event did not constitute valid service and jurisdiction was not otherwise obtained or waived, the voidness branch differs. Rule 55(c)(2) and Peralta do not require a meritorious defense to preserve a void judgment merely because the underlying debt might be owed. Actual defect, waiver, and jurisdiction facts still require adjudication.
The Rule 60(a) ninety-day provision is not substituted as a universal deadline for this default-relief motion. C063–C098.
Twelve additional postures
| Posture |
Fictional facts |
Bounded result |
| P05 |
Debt buyer holds a $900 assigned consumer account. |
Amount does not establish small-claims plaintiff eligibility. |
| P06 |
Arkansas corporation has two shareholders and no lawyer in small claims. |
Test AO 18’s corporation and officer conditions; do not generalize to every LLC. |
| P07 |
Collection attorney files where creditor’s office is located. |
Establish both general venue and covered debt-collector venue; office location alone may not satisfy the latter. |
| P08 |
Defendant currently lives in another state. |
Service, personal jurisdiction, venue and actor coverage remain separate; ordinary nonresident answer period is not automatically sixty days. |
| P09 |
Papers are left with a seventeen-year-old nonfamily roommate. |
Do not assume current residential-substitute predicates are met. |
| P10 |
Server leaves papers with a store cashier. |
Actual agent authority and any statutory fallback must be established. |
| P11 |
Plaintiff submits a one-line “diligent search” affidavit. |
Conclusory language does not establish all warning-order facts or personal money jurisdiction. |
| P12 |
Defendant sees the lawsuit online and files a dismissal motion. |
Actual knowledge, a motion, a timely answer and Rule 4(k) are distinct. |
| P13 |
Defendant is a minor or lacks legal capacity. |
Special service, representative and default safeguards apply; ordinary default is not assumed available. |
| P14 |
Defendant may be in military service and has not appeared. |
Apply the SCRA affidavit, counsel and stay predicates; no actual status query is performed. |
| P15 |
Co-defendant timely pleads a defense common to all defendants. |
The common-defense doctrine can matter; a personal defense is not automatically shared. |
| P16 |
District default is followed by a motion to vacate. |
The motion and the original thirty-day district appeal route remain distinct; an approved supersedeas, not filing alone, supplies the specified stay. |

J. Researcher self-check
The important fresh findings are the October 1, 2026 adopted amendments, the court-specific service and response distinctions, the current Rule 4(k) limits, the separation of default liability from amount proof, and the different Rule 55, Rule 60, district-appeal and circuit-appeal paths.
The remaining material holds include complete official rule consolidation, current Rule 10/Rule 81/AO21 bodies, exact local filing and closure practices, full statutory commencement chains, current citator treatment, and every actual party/service/judgment fact.
Register counts: 64 source/access records; 113 atomic claims; 13 published-case entries; 4 worked models plus 12 additional fictional postures; 32 core-coverage rows; 12 workflow rows; 8 currentness rows; 4 model rows; 6 territorial/actual-record rows; 10 deferred-family rows; and 3 scope-crosswalk rows. These categories are not summed as independently accepted legal propositions.
No independent review, unseen model setting, local write, actual permission, pleading preparation, filing, publication readiness, or full-state/parent/A066/A097/A098 acceptance is claimed.
