Arkansas consumer-debt limitations, accrual, acknowledgment, and judgment revival
Research access date: October 27, 2026. Exact source-opening times were not logged and are unknown.
Provenance: PASS-01 through PASS-03 remain unchanged. The supplied coordinator-review history is not an independent review or source-opening record. PASS-04 was not used as a premise. No local coordinator files were accessed or written.
Scope: The original claim’s limitations period; accrual, payments and acknowledgments; necessary tolling and choice-of-law boundaries; and money-judgment enforcement, revival, and lien duration. This is not an underlying-debt-validity determination or a complete Arkansas enforcement dossier.
Principal findings
The most important current-law development is Act 986 of 2025. It replaced the former scire-facias procedure in § 16-65-501 with a filed-notice procedure. Consequently, older decisions requiring issuance and service of a scire-facias writ cannot be presented as the unqualified procedure for a new revival today. The 2026 Williamsburg Management decision expressly applied the former law to earlier proceedings; it did not repeal the 2025 change. C052–C065. Arkansas Legislature+1
There is no universal Arkansas “three years” or “five years” rule for every consumer balance. The actual obligation may fall under the unwritten-contract statute, written-contract statute, Article 3 note provisions, Article 2 sales provisions, or another specific statute. Born treated the undisputed credit-card contract before it as written; Unifund involved procedurally admitted allegations of an open account. Neither decision permits classification from a marketing label or missing attachment alone. C002–C011. Justia Law+2
The original debt, the enforceable judgment, and the judgment’s real-estate lien have different clocks. A qualifying payment or judicial process may affect the underlying judgment period without extending the lien. Act 1113 of 2015 expressly preserves that distinction. C044–C051. Arkansas Legislature+1
A ledger credit is not automatically a limitations-resetting payment. The source, authority, date, purpose, and surrounding statements matter. Written acknowledgment also requires more than any communication mentioning an account. C019–C028. Justia Law+2
Currentness remains partially authenticated, not wholly resolved. Official enactments, published opinion bodies, and a June 2026 rule-adoption order were read. Much of the integrated Arkansas Code remains a 2025 secondary reproduction; the complete current official Code, rules, transition law, and citator chain were not obtained.
In the tables below, S001 means S_AR-P05-S001, and C001 means S_AR-P05-C001.
A. Original-debt clock matrix
| Obligation or event |
Supported rule and actual predicate |
Accrual or consequence |
Limits and claim IDs |
| Unwritten contract or covered open-account claim |
§ 16-56-105 supplies a three-year period for its enumerated categories. |
Requires identification of the particular obligation and breach. |
Not every credit-card account is an unwritten account. C002, C006. |
| Written obligation, duty, or right |
§ 16-56-111 generally supplies five years, subject to its stated exception. |
The claimant must establish the written obligation and when the actionable breach occurred. |
“Written” is not established merely by the collector’s characterization. C003. |
| Credit-card contract |
Born applied five years to the undisputed written contract before the court. |
Failure to attach the agreement did not transform that obligation into an oral contract. |
Actual agreement, acceptance, amendments, and claim remain necessary. C005. |
| Alleged open-account credit-card claim |
Unifund affirmed a judgment based on admitted allegations after failure to answer the counterclaim. |
The procedural admissions mattered. |
Not a merits holding that every card debt has three years. C006. |
| Sale-of-goods obligation |
§ 4-2-725 ordinarily supplies four years; an original agreement may shorten it to not less than one year but may not extend it. |
Breach-based accrual; the section contains warranty and other qualifications. |
A loan used to purchase goods is not automatically the seller’s Article 2 claim. C007–C008. |
| Negotiable note payable at a definite time |
§ 4-3-118(a) supplies five years from the stated due date or accelerated due date. |
Requires an Article 3 instrument, not merely any written promise. |
Negotiability and valid acceleration must be established. C009, C011. |
| Qualifying demand note |
§ 4-3-118(b) distinguishes a demand from a ten-year period without principal or interest payment when no demand is made. |
Five years after demand; separate no-demand/no-payment condition. |
An old case saying every demand note accrues immediately cannot displace this modern statutory analysis. C010. |
| Article 4 bank-deposit/collection claim |
§ 4-4-111 supplies three years for an obligation, duty, or right arising under that chapter. |
Applies to the chapter-defined claim. |
Not a three-year rule for every loan made by a bank. C004. |
| Installment debt without effective acceleration |
Each matured installment ordinarily has its own clock under the decisions read. |
Later installments do not become barred simply because the first default is old. |
Final maturity, contractual terms, and any acceleration alter the analysis. C013–C016. |
| Optional acceleration |
The option’s exercise—not merely the existence of the clause—matters. |
A valid exercise can make the remaining balance due. |
Notice, contractual predicates, and later abandonment must be examined. C014–C015. |
| Mutual open account current |
§ 16-56-127 refers to the last item proved in a genuinely mutual account. |
Not necessarily the last statement, demand, or collector entry. |
Reciprocal-account predicates must be established. C017. |
| Assignment or debt sale |
No new accrual event was established merely from transfer of ownership. |
The assignee’s acquisition date is not automatically a new default date. |
Ownership, contractual modification, and any new agreement remain separate issues. C018. |
The historical version of § 16-56-111 contained different language about the first legal right to demand the entire principal. Act 1048 of 1991 deleted that sentence, and Act 1164 of 1997 revised the relevant text again. Those historical clauses cannot be silently imported into the current installment analysis. Arkansas Legislature+2
A1. First uncured default, charge-off, and later conduct
A useful chronology must identify what became due, why it became due, and whether it remained unpaid. “First uncured default” may identify the first unpaid installment, but does not necessarily make every future installment immediately actionable. Likewise, this research did not establish a universal rule making charge-off, the last statement, a debt sale, or the collector’s first demand the accrual date. C012–C018.
Wilmington also demonstrates why later conduct matters: the court addressed abandonment of optional acceleration, subject to the debtor-reliance qualification discussed in the opinion. That is not permission to manufacture a new period through unilateral bookkeeping. Justia Law
A2. Payment and acknowledgment decision matrix
| Event |
What must be established |
What does not suffice automatically |
| Partial payment before expiration |
An actual payment, its date, its application to the obligation, and the debtor’s act or authorized/consensual participation. |
An unexplained credit or the creditor’s notation. |
| Payment accompanied by disputed purpose |
Whether the circumstances acknowledge the continued debt and obligation to pay the balance. |
Treating every payment as an unconditional admission. |
| Written acknowledgment/new promise |
Authorship, identified subsisting debt, proper recipient, and an unconditional promise or legally sufficient inference from the writing. |
A letter to the debtor’s own agent, a mere inquiry, or an unfulfilled conditional promise. |
| Acknowledgment after the original period |
The applicable new-promise doctrine and its evidentiary requirements. |
Assuming either that revival is impossible or that any signed document revives. |
| Joint debtor’s act |
Distinguish payment from a signed acknowledgment and distinguish before-bar from after-bar conduct. |
Automatically binding every co-obligor because one person acted. |
| Creditor’s unilateral endorsement |
Independent proof of payment and timing remains material. |
Treating the endorsement itself as proof. |
Sections 16-56-122–124 impose qualifications. Section 122 rejects reliance on a merely verbal acknowledgment or promise for the stated purpose. Section 124 expressly addresses a signed acknowledgment or promise by a joint contractor. Section 111(b), however, should not be rewritten as though it itself contains every authentication or signature requirement. C019–C028. Justia Law+2
In McMahon, the actual letters preceded expiration; the court nevertheless expressly discussed the rule concerning acknowledgments before and after the bar. That distinction is preserved here: the opinion’s announced rule is broader than its particular pre-expiration facts. Justia Law
A3. Tolling, moved parties, and choice of law
The following are targeted gateways, not universal extensions:
- Section 16-56-116 concerns specified disabilities of the person entitled to sue when the claim accrues. A debtor’s illness does not automatically trigger it.
- Section 16-56-119 concerns an injunction restraining commencement of an action. It is not proof that every appeal or collection stay pauses every clock.
- Sections 16-56-120–121 require their particular obstruction or fraudulent-absconding predicates. Moving to another county or state alone was not established as sufficient.
- Section 16-56-126’s saving provision requires its stated prior-action and termination predicates. It does not make every defective filing a valid commencement.
- Fraudulent concealment requires the applicable facts and legal relationship. Shelton rejected tolling on its record; the substituted Nichols majority held that adequately pleaded concealment in an attorney-client fiduciary relationship survived dismissal. Neither is a finding that an ordinary creditor-debtor relationship is fiduciary. C029–C037. Justia Law+4
The former borrowing act is not current law
Act 310 of 1999 repealed §§ 16-56-201–210, the Uniform Conflict of Laws Limitations Act. The old July 1, 1985 application language shown as deleted in that act is not the 1999 repeal’s commencement date. C038. arkleg.state.ar.us
Later decisions distinguish generally procedural limitation periods, ordinarily governed by forum law, from a time restriction inseparable from a substantive statutory right. Middleton applied Arkansas’s judgment limitation on its facts; Gomez applied the substantive foreign wrongful-death restriction. Hall held that the 1999 repeal did not resurrect the already-barred claim before it. C039–C043. Justia Law+2
A consumer contract’s choice-of-law clause, residence changes, foreign judgment, and any special statutory right therefore require their own analysis. Neither the repealed borrowing act nor the general forum rule supplies a universal answer.
B. Judgment duration, revival, and lien matrix
B1. Separate the three questions
| Question |
Supported answer |
Important limitation |
| When does the original judgment period begin? |
§ 16-56-114 supplies ten years after accrual; Middleton identifies entry of judgment, not an earlier oral announcement, in the posture examined. |
Finality, entry, stay, and appeal are different concepts. C044–C045. |
| Can a later event affect the underlying judgment period? |
Primus recognizes qualifying process/payment effects; the timely garnishment process there sufficed. |
Not every attempted, unissued, unserved, defective, or void writ was adjudicated sufficient. C046–C047. |
| Does that event extend the real-estate lien? |
Not automatically. Act 1113 states that events affecting § 16-56-114 do not revive the lien; § 501 governs lien revival. |
An enforceable judgment may lack the claimed continuing lien. C048–C051. |
| Does later recording create a fresh ten-year judgment? |
No such rule was established. Recording and indexing determine lien consequences under § 117. |
District judgments and other-county records have specific conditions. C049–C050. |
| Does assignment restart duration? |
Section 120 provides transfer/documentation consequences, not a new universal clock. |
Actual ownership and filing/notice consequences remain necessary. C070. |
These distinctions are supported by the actual 2015 enactment and published opinions, rather than by an assumption that every “renewal” event has the same effect. Arkansas Legislature+2
B2. Current § 16-65-501 notice procedure
| Element |
Act 986 / displayed § 501 requirement |
Hold or qualification |
| Actor |
Judgment creditor or legal representative. |
Ownership and authority must be proved. |
| Filing |
File notice that the judgment remains outstanding. |
The statute ties this route to an unexpired lien. |
| Contents |
Parties; court and case number; current balance after payments/credits; stated intent to maintain the county lien. |
A stale or inflated balance is not validated by filing. |
| Service |
First-class prepaid mail to the debtor’s last known address. |
Actual mailing and address facts matter. |
| Unknown whereabouts |
Four-week courthouse posting under the stated inability-to-serve-by-mail condition. |
Not a general substitute whenever mail is inconvenient. |
| Timing |
Subsection (a) says “before”; subsection (c)(1) says “on or before” lien expiration. |
Do not build an actual last-day filing conclusion on an unresolved textual edge. |
| First/successive periods |
Subsection (c)(2) uses ten years from judgment rendition or, for a previously revived judgment, the previous notice’s filing. |
Older revivals used orders, not notices; transition remains held. |
| Other county |
Record a copy of the filed notice where the judgment is recorded in another county. |
Filing in one county is not assumed to preserve every other county’s lien. |
The former show-cause/order language was removed. The amended section does not itself establish a new fixed debtor-objection deadline or a mandatory hearing in every case. Contested validity, defective notice, and relief procedures require the applicable rules and judicial authority. C052–C063. Arkansas Legislature+1
Commencement and transition
Act 986 was approved April 22, 2025, but approval is not its commencement date. It contains no express emergency, special effective-date, or transition provision. The accessible original-text reproduction of Attorney General Opinion 2025-032 identifies August 5, 2025 as the default effective date for qualifying 2025-session acts. An official legislative report corroborates that default-date treatment for another such act. Applying that general rule to Act 986 supports August 5, 2025, with the stated source and transition limits, rather than treating April 22 as commencement. C053. Ezel+1
The unresolved transition questions include a judgment already revived by an old court order, a pending pre-effective scire-facias proceeding, and a lien or judgment already expired before the new procedure. No language was found automatically resurrecting an expired judgment.
B3. Historical procedures remain relevant—but historically
Rose held a former-law revival defective where the required scire-facias writ was not issued and served. Williamsburg, decided in 2026, addressed older proceedings and expressly noted the later statutory change. Horne illustrates older three-year lien periods and defective earlier revivals. Baldwin addresses the preclusive effect of an unchallenged revival order, not a general license to file late. C064–C068. Justia Law+3
An independent action on a judgment was discussed through quoted precedent, but the underlying responsive authority and complete current procedure were not freshly established. It remains a separate held route—not a workaround presumed available whenever § 501 fails. C069.

C082–C087; no universal original-creditor/business-debt extension. |
C1. Procedural computation does not supply a substantive extension
The readable Rule 6 reproduction distinguishes event-day exclusion, final-day rules, and short periods. The Supreme Court’s June 4, 2026 final adoption of Rule 6(d) expressly includes electronic-filing service within its three-business-day service extension. That extension applies to the rule’s service-triggered setting; it is not automatically added to a statutory anniversary, a filing-triggered period, or every revival deadline. C073–C074. Justia Law+1
Rule 60’s different mistake, clerical, and later-relief provisions do not establish that a court may revive an expired statutory period whenever fairness is asserted. Rule 62 also distinguishes enforcement restrictions and stays from the separate limitations analysis. C075–C076. Court Rules Network+1
C2. Narrow federal time-barred-suit overlay
Under 12 C.F.R. § 1006.26, a covered debt collector may not bring or threaten legal action against a consumer to collect time-barred debt. Coverage requires the relevant consumer, debt, and collector definitions; a business debt or original-creditor collection is not automatically covered merely because a balance is old. C082–C084. Consumer Financial Protection Bureau+1
The regulation’s litigation prohibition expressly excludes filing a bankruptcy proof of claim from that paragraph. This is not blanket approval under every other law. Nor does the litigation ban itself create a universal disclosure rule or declare the debt extinguished. Directly relevant FDCPA provisions separately address false statements about legal status, unlawful-action threats, and false assertions that transfer causes loss of defenses. C085–C087. Consumer Financial Protection Bureau+1
D. Published-authority ledger
The source register supplies every direct URL. This ledger identifies the actual disposition and limits; it is not a complete citator.
| Authority / source |
Posture and material holding actually read |
Separate writing, later treatment, or limitation |
| Born v. Hosto, 2010 Ark. 292 — S033 |
Dismissal affirmed; undisputed credit-card agreement treated as written, despite attachment argument. |
Relevant limitations section read, not every unrelated claim. Quoted Pettingill was not separately opened. |
| Unifund v. Thornton, 2014 Ark. App. 307 — S034 |
Affirmed following unanswered counterclaim and admitted open-account allegations. |
Not a universal credit-card classification decision. |
| Karnes v. Marrow, 315 Ark. 37 — S035 |
Installment accrual and asserted payment arrangement examined; affirmed in part, reversed in part. |
Brown’s partial dissent concerned credits; Newbern did not participate. Foreclosure rules not adopted as a separate dossier. |
| NP191 v. Branch, 2023 Ark. App. 156 — S036 |
Reversed/remanded; unaccelerated installments analyzed separately. |
Transfer did not make every installment newly timely. Actual opinion’s inconsistent complaint-date reference not used for calculations. |
| Wilmington v. Smith, 2023 Ark. App. 326 — S037 |
Reversed/remanded; optional acceleration and abandonment analyzed; historical statutory amendment argument rejected. |
Underlying Mitchell/Dunnington bodies quoted there were not freshly read. |
| Helms v. UMKC, 65 Ark. App. 155 — S038 |
Affirmed; voluntary/authorized payment doctrine applied to tuition transaction and stopped check. |
Court did not choose Arkansas over Missouri limitations; it found the claim timely under either. |
| Root v. Thomas, 203 Ark. 1078 — S039 |
Writing to debtor’s own agent did not satisfy the required creditor-directed acknowledgment/promise. |
Historical rule; present authentication and electronic-record issues not resolved. |
| McMahon v. O’Keefe, 213 Ark. 105 — S040 |
Affirmed; letters acknowledged the debt and supplied inferred promise. |
Actual letters were pre-expiration; broader before/after discussion preserved. Old demand-note rule not substituted for modern § 4-3-118. |
| Buss v. Cooley, 205 Ark. 42 — S041 |
Reversed as to debtor, affirmed as to third party; writing sufficiently acknowledged remaining obligation on its facts. |
Conditional-promise and contrary-intent qualifications matter. Smith and Holt dissented; full separate rationale not available in reproduced body. |
| Smith v. Grimsley, 215 Ark. 279 — S042 |
Reversed/remanded because creditor failed to prove the payment date necessary to bind the appealing co-debtor. |

| Horne v. Cuthbert, 2015 Ark. App. 592 — S046 |
Reversed/dismissed; prior revivals entered without required notice were ineffective. |
Discusses old three-year liens and 1985 change. Original Act 228 was not read. |
| Baldwin v. Eberle, 2009 Ark. App. 222 — S047 |
Affirmed; prior unchallenged revival order had preclusive effect against later limitations attack. |
Not permission for a new late filing; distinguish voidness in Rose. |
| Middleton v. Lockhart, 2012 Ark. 131 — S048 |
Affirmed; entry, not earlier oral announcement, supplied relevant judgment date. |
Host URL/metadata says 2011; actual opinion body identifies March 29, 2012. |
| Durham v. Arkansas DHS, 322 Ark. 789 — S049 |
Affirmed recognition of Illinois renewal under the then-applicable framework. |
Former borrowing act and historical facts; dissent identified. No universal current foreign-registration rule. |

Repeal application, not a modern contract-choice shortcut. |
| Middleton v. Lockhart, 2003 — S051 |
Affirmed Arkansas forum limitation on judgment-enforcement facts. |
Chief Justice Arnold did not participate; no fresh registration clock inferred. |
| Gomez v. ITT, 348 Ark. 69 — S052 |
Affirmed; substantive foreign wrongful-death time restriction applied. |
Statutory-right exception, not a holding about every consumer choice-of-law clause. |
| Shelton v. Fiser, 340 Ark. 89 — S053 |
Affirmed; record did not establish fraudulent concealment sufficient to toll. |
Medical/minority-specific rules not generalized to consumer debt. |
| Nichols v. Swindoll, 2023 Ark. 146, October 12 — S054 |
Substituted rehearing opinion reversed/remanded; fiduciary concealment allegations survived dismissal. |
Kemp, Baker, and Hudson dissented. Earlier 2023 Ark. 97 disposition is not the operative substitute holding. |
The actual opinion bodies, not publisher summaries, support this ledger. Justia Law+2
E. Sixteen new fictional postures and three worked models
Common computational assumptions
Every date, party, contract, payment, and judgment below is fictional. Anniversary dates are unadjusted candidate endpoints, not executable filing deadlines. Elapsed days exclude the starting date. No weekend, holiday, clerk-closure, service extension, saving statute, or discretionary extension is applied unless expressly assumed. The governing rule’s applicability remains necessary.
Interest is either symbolic or expressly stipulated for arithmetic. No legal rate, fee entitlement, or actual collectibility is inferred.
Model 1 / P01 — Written card versus open account
Assume an actionable default on January 15, 2020, with no qualifying later reset or tolling event.
| Classification branch |
Calculation |
Candidate endpoint |
| Covered three-year unwritten/open-account claim |
January 15, 2020 + 3 calendar years; 1,096 elapsed days |
January 15, 2023 |
| Covered five-year written-contract claim |
January 15, 2020 + 5 calendar years; 1,827 elapsed days |
January 15, 2025 |
At a hypothetical assessment on January 16, 2024, 1,462 days have elapsed. That is after the first candidate date but before the second.
Balance
- Original principal: $6,000.00.
- Stipulated lawful interest: $300.00.
- Actual fictional credits made before the assumed default: $1,200.00.
6,000+300−1,200=5,1006{,}000+300-1{,}200=\boxed{5{,}100}6,000+300−1,200=5,100The $5,100 balance is identical under both classification branches. Correct arithmetic does not select the limitations period.
Adverse branch: January 15, 2023 was not treated as an automatically extended deadline. The actual agreement, breach, commencement/service rules, and any extension must be established. C002–C006, C012, C037.
Model 2 / P02 — Payment, disputed authority, and later writing
Assume a written obligation accrued June 15, 2018.
Initial five-year candidate endpoint:
June 15, 2018+5 years=June 15, 2023\text{June 15, 2018}+5\text{ years}=\text{June 15, 2023}June 15, 2018+5 years=June 15, 2023Elapsed interval: 1,826 days.
Branch A: qualifying payment
A $100 payment is actually credited on May 1, 2022. Assume it is a legally qualifying debtor payment.
- Elapsed since accrual: 1,416 days.
- Time remaining to original candidate endpoint: 410 days.
- Conditional new five-year endpoint: May 1, 2027.
- New interval: 1,826 days.
Branch B: credit does not establish a qualifying debtor act
Assume the creditor accepts the $100, but the payor’s authority or acknowledgment effect is not established.
The balance falls, but no reset is assumed. The original candidate endpoint remains June 15, 2023.
A signed writing dated July 1, 2023 is then asserted—16 days after that candidate expiration.
- If the writing satisfies the applicable new-promise doctrine, a conditional five-year candidate is July 1, 2028, 1,827 days later.
- If it is merely a dispute, an inquiry, an unfulfilled conditional promise, or an unauthorized writing, that result is not established.
- In Branch A, the same July 2023 writing would not be “after expiration,” because the assumed payment already changed the candidate date.
Balance
4,000 principal+200 stipulated interest−100 actual credit=4,1004{,}000\text{ principal}+200\text{ stipulated interest}-100\text{ actual credit}
=\boxed{4{,}100}4,000 principal+200 stipulated interest−100 actual credit=4,100If the “$100 credit” is only an unsupported ledger entry and no actual credit exists, the separate arithmetic would be $4,200. That factual dispute cannot be solved by labeling the entry a renewal.
Calendar hold: May 1, 2027 falls on a weekend. No automatic extension is applied to this candidate statutory endpoint. C019–C028, C073–C074.
Model 3 / P03 — Judgment enforcement versus lien revival
Assume:
- Oral announcement: May 10, 2016.
- Judgment entered and qualifying county lien created: May 20, 2016.
- Original judgment: $10,000.
- Properly qualifying collection process and $2,500 credit: June 1, 2021.
- No other clock-changing event until the illustrated notice.
Before the new revival notice
Original ten-year candidate:
May 20, 2016+10 years=May 20, 2026\text{May 20, 2016}+10\text{ years}=\text{May 20, 2026}May 20, 2016+10 years=May 20, 2026Elapsed interval: 3,652 days.
Assuming the June 1, 2021 process qualifies under Primus, the underlying judgment candidate becomes:
June 1, 2021+10 years=June 1, 2031\text{June 1, 2021}+10\text{ years}=\text{June 1, 2031}June 1, 2021+10 years=June 1, 2031Again, 3,652 days.
But the lien has not thereby been extended. Its original candidate remains May 20, 2026.
Timely notice branch
Assume a compliant Act 986 notice is filed May 1, 2026, with required service and accurate contents. This is 19 days before the original lien endpoint.
A conditional ten-year revived interval runs from that filing to May 1, 2036, 3,653 days later, subject to the statute’s application and transition issues. Other-county continuation requires its own recording step.
Late/defective branch
A notice first filed May 21, 2026 does not automatically restore the expired lien. The underlying judgment may still have the separately assumed June 2031 period, but that does not establish a valid lien revival. Missing service, an incorrect balance, or an unresolved old-order transition creates additional issues.
Balance
Let III be legally accrued interest through the notice date:
10,000+I−2,500=7,500+I10{,}000+I-2{,}500=\boxed{7{,}500+I}10,000+I−2,500=7,500+IFor arithmetic only, stipulate I=$1,200I=$1,200I=$1,200:
10,000+1,200−2,500=8,70010{,}000+1{,}200-2{,}500=\boxed{8{,}700}10,000+1,200−2,500=8,700A later actual $600 credit, with no additional interest assumed during that interval, leaves:
8,700−600=8,1008{,}700-600=\boxed{8{,}100}8,700−600=8,100The later credit’s possible clock effect is not decided by this balance calculation. C044–C063, C070–C071, C092.
Thirteen additional postures
| Posture |
Fictional facts |
Conditional result and adverse branch |
| P04 — Installments |
Four $1,000 installments due January 15 in 2020, 2021, 2022, and 2023; hypothetical suit February 1, 2025. |
Elapsed days: 1,844; 1,478; 1,113; 748. With separate five-year clocks and no tolling, only the first is beyond its candidate anniversary. Valid acceleration changes the analysis. C013–C016. |
| P05 — Acceleration alternative |
Same debt, but valid optional acceleration June 1, 2020. |
Candidate endpoint June 1, 2025; February 1, 2025 is 1,706 days after acceleration. Invalid notice or effective abandonment produces a different branch. C014–C015. |
| P06 — Demand note |
Qualifying note dated March 1, 2017; demand March 1, 2024. |
Conditional demand-based candidate March 1, 2029. If no demand and no principal/interest payment for ten continuous years, the separate statutory branch must be tested. C009–C011. |
| P07 — Mutual account |
Creditor issues monthly statements after all transactions ended. |
Statement dates do not establish a new “last item proved” in a mutual account. Actual reciprocity and items are required. C017. |
| P08 — Assignment and move |
Debt sold July 1, 2024; debtor moves to Arkansas August 1, 2024. |
Neither event alone is established as new accrual or revival. Governing law, original breach, and actual concealment predicates remain necessary. C018, C032–C043. |
| P09 — Old judgment |
Judgment entered April 1, 1984. |
Under a three-year historical lien rule, the unadjusted anniversary would be April 1, 1987. The 1985 amendment’s application cannot be assumed to create a fresh ten-year period. C066. |
| P10 — Former-law writ defect |
For a 2014 judgment, creditor filed a revival petition in March 2024 but no required writ issued. |
Former-law Rose issue; filing a petition alone is not assumed valid revival. New Act 986 does not retrospectively cure the defect without authority. C064, C068. |
| P11 — Older posting |
A 2022 former-law revival used four-week courthouse posting. |
Williamsburg may be relevant to those facts; its 2026 decision is not proof that a new 2026 proceeding still requires scire facias. C065. |
| P12 — Successive old order |
Judgment revived by court order in 2020; creditor seeks another revival in 2029. |
New statute refers to previous notice, not previous order. Exact transition and candidate-date authority remain held. C061–C063. |
| P13 — Stay/appeal |
Enforcement stayed for eighteen months pending appeal. |
Do not automatically add eighteen months to every limitations or lien period. Read the stay, statute, and applicable tolling authority. C031, C076. |
| P14 — Disability or concealment |
Debtor becomes ill; creditor alleges debtor concealed an address. |
Debtor illness is not the claimant-disability predicate in § 116. Address concealment must satisfy the actual prevention/obstruction rule. C029, C032–C035. |
| P15 — Time-barred threat |
Covered collector threatens an ordinary consumer-debt suit after the applicable period, with no revival. |
§ 1006.26 prohibition applies on those assumed predicates. Original-creditor or business-debt coverage cannot simply be presumed. C082–C087. |
| P16 — Paid or discharged debt |
Candidate limitations date remains in the future, but the debt was paid, released, invalid, or discharged. |
Timeliness does not establish debt validity or permission to sue. Those separate facts and authorities remain necessary. C090, C092. |

I. Researcher self-check
The material developments established through fresh reading are the 2025 notice-based revival amendment, the separate underlying-judgment and lien clocks, the 1999 borrowing-act repeal, and the distinctions among written contracts, open accounts, installments, demand notes, payments, and acknowledgments.
The largest unresolved legal issues are:
- Act 986 transition: prior revival orders, pending old proceedings, and already-expired judgments or liens.
- Complete official currentness: integrated Code and Rules 3, 69, 81, District Rule 10, and Administrative Order 2, together with material adoption history.
- Application: actual contract, accrual, payment authority, writing, service, judgment, transfer, stay, and interest facts.
- Current treatment: full citator review and the independent-action-on-judgment route.
No unseen model tier, independent review, actual filing deadline, claimant eligibility, provider permission, local write, publication readiness, or full-state/parent acceptance is asserted.
Register counts: 71 source/access records; 92 atomic claims; 22 published-decision entries; 16 fictional postures including 3 worked models; 16 workflow rows; 30 core-coverage rows; 9 currentness rows; 3 model rows; 12 deferred-family rows; 75 individual county holds plus 5 additional territorial/routing holds; and 1 P01 contribution crosswalk. These counts are separate categories, not a count of independently accepted legal propositions.
