SettleADebt C_ZA PASS-22 — narrow correction to P21

Fresh access: 27 October 2026 UTC and America/Los_Angeles. The official-hosted subsection and its page image were read. Individual source-opening time was not logged.

1. Replacement for P21 §II.2.2’s §2(3) paragraph

Section 2(3) addresses provisions relating to superior courts other than the Constitutional Court, Supreme Court of Appeal and High Court of South Africa. Within that limited scope, the Superior Courts Act complements court-specific legislation, which prevails in a conflict. The subsection therefore does not establish the general High Court insolvency conflict rule previously attributed to it. No separately read authority is supplied here to establish that broader principle; it remains unresolved. Justice

The exclusion limits this subsection, not the application of the Superior Courts Act as a whole.

2. Replacement atomic claim

Claim ID Exact replacement proposition Source and pinpoint Scope and remaining limit
C_ZA-P21-C011 Section 2(3)’s complementarity and conflict rule concerns provisions relating to superior courts excluding the Constitutional Court, Supreme Court of Appeal and High Court of South Africa. For the covered courts, court-specific legislation prevails over conflicting provisions of this Act. C_ZA-P22-S001, Superior Courts Act 10 of 2013, §2(3), zero-based PDF P2. Justice Withdraw the former High Court-insolvency inference. A broader applicable conflict principle requires separate authority and is not established by this patch.

3. Replacement coverage cell

P21 row Replacement question/status Replacement finding and evidence Exact remaining evidence
C_ZA-P21-J11 §2(3) scope corrected; broader High Court specific-law interaction unresolved. C_ZA-P21-C011, as replaced above: the subsection expressly excludes the High Court of South Africa from this particular rule. C_ZA-P22-S001, §2(3), zero PDF P2. Justice Separately read authority supporting any broader High Court insolvency conflict principle. None is substituted here.

4. Effect on workflow and model references

P21 reference or location Required effect
A workflow/model using C_ZA-P21-C002–C011 as High Court support Remove C_ZA-P21-C011 from that supporting range. Retain only otherwise relevant claims within C_ZA-P21-C002–C010, with their existing evidence limits.
A workflow/model using C_ZA-P21-C002–C026 Exclude C_ZA-P21-C011 from the High Court reasoning. Any retained references must be expressed as relevant claims within C002–C010 and C012–C026, fully scoped to P21. This does not newly validate every claim in those ranges.
P21 Workflow 6 — Master’s office identified, jurisdiction unknown Replace the supporting references C010–C011, C025–C026 with C_ZA-P21-C010, C_ZA-P21-C025 and C_ZA-P21-C026. The distinction between administrative readiness and jurisdiction remains; §2(3) is not its authority.
P21 coverage J12 — local application, previously citing C008–C011 Narrow the references to C_ZA-P21-C008–C010. Actual court-area, seat and private-nexus evidence remain unresolved.
P21 Models A and B; separately supported C009/C010 No equation, nexus alternative or discretionary-forum branch changes. Preserve the existing §149 support, §6(3) area-notice analysis and §53 modern-court terminology bridge. They are not dependent on the rejected §2(3) inference.

Legal effect of this reference correction: §2(3) cannot supply the former High Court proposition; it does not negate separately sourced propositions merely because they appeared nearby. Justice

Retained provenance and holds

All other P21 evidence and qualifications remain unchanged. Mel Properties full-PDF/image access remains researcher-attributed, not coordinator-reverified following the coordinator’s failed retrievals. Chapman and Smith remain published primary-opinion reproductions, not official current statutory consolidations.

The current Insolvency Act definition and §149 amendment chain, foreign-designation procedure/proclamation/status, full rescission and §151 analysis, recognition, later citator, citation/source limits, actual private facts and all nine provincial/local branches remain unaccepted. No new examples, calculations, filings, local writes, independent-review claims or country/parent acceptance are added.

Displayed patch: one replacement passage, one replacement atomic claim, one replacement coverage cell, five coverage-effect rows and one fresh source row.
