Three bounded repairs to P12, plus count and link consistency

Scope: This patch changes only the identified P12 qualifications, source identity, cross-references and counts. It does not rerun P12 prescription research, adopt P13, or reopen fees, contracts, PDA funds, enforcement or the 2019 debt-intervention work.

Fresh P14 access: 26 October 2026 PDT / 27 October 2026 UTC. Exact source-opening clock times were not logged and are unknown.

Provenance: The complete P12 response and its coordinator review remain preserved. Where P14 freshly reopened a source, that is identified below. The original P12 researcher access history is not retroactively rewritten.

Focused disposition

  1. The KLD Residential exception permitting use of a without-prejudice acknowledgment solely to prove interruption of prescription is fact-specific, not absolute, and may be expressly or impliedly excluded by the parties’ discussions. The admission remains protected as proof of the debt’s existence and quantum. Supreme Court of Appeal+1
  2. Prescription Act §15 ordinarily requires service of process claiming payment, but §15(5) creates one express deemed-service rule: a person joined as defendant on that person’s own application is deemed served on the joinder date. Ordinary issuing or filing alone remains insufficient absent actual service or that specific statutory deemed service. South African Government+1
  3. P12 S007 misidentified the 3 July 2026 Justice/Gazette item as the introduced Bill. The introduced Parliament Bill states that Gazette 54941 contained the explanatory summary and prior notice of introduction. The introduced Bill itself is B26—2026, introduced on 17 September 2026. Its schedule item 81 proposes repeal of the Prescription Amendment Act 11 of 1984. The 21 October 2026 National Assembly Order Paper still listed it under the Joint Tagging Mechanism and bills referred to committees; Parliament’s metadata displayed the stage as Introduction on P14 access. The proposal was therefore non-operative in this evidence set. Parliament of South Africa+4

Replacement narrative passages

Replacement for P12 G2.2 — acknowledgment during negotiations

Under Prescription Act §14, an express or tacit acknowledgment of liability can interrupt a running period. A payment, part payment, offer or settlement communication does not do so automatically; the communication must objectively acknowledge the relevant liability.

The majority in KLD Residential recognised a limited exception under which an acknowledgment made during without-prejudice settlement negotiations may be admitted solely to prove interruption of prescription. Paragraph 39 makes three additional qualifications explicit: the exception is fact-specific rather than absolute; the parties may expressly or impliedly exclude it in their discussions; and the admission remains protected insofar as proof of the debt’s existence and quantum is concerned. P12 therefore does not treat every settlement offer as an acknowledgment or every without-prejudice acknowledgment as admissible regardless of the parties’ agreed negotiation framework. Supreme Court of Appeal+1

Replacement for P12 G2.3 — service and deemed service

Prescription Act §15(1) ordinarily interrupts prescription through service on the debtor of process by which the creditor claims payment of the debt. Issuing, preparing or filing process without evidence of actual service does not satisfy that requirement.

Section 15(5) supplies one express qualification: where a person is joined as a defendant on that person’s own application, the payment process is deemed to have been served on that person on the date of joinder. This does not make ordinary filing equivalent to service, does not decide whether another service rule or curative doctrine applies, and does not establish qualifying joinder in any actual case. South African Government+1

Replacement for P12 G1.1 — 2026 Bill currentness

The 2026 repeal proposal remains non-operative in this evidence set. P12’s Justice/Gazette 54941 source was imprecisely identified: the freshly opened Parliament Bill says Gazette 54941 of 3 July 2026 contained the explanatory summary and prior notice of introduction, not the introduced Bill itself. The introduced Bill is B26—2026; Parliament records introduction on 17 September 2026. Its clauses 1–2 and schedule propose repeal of listed obsolete amendment Acts, including the Prescription Amendment Act 11 of 1984 at schedule item 81. Its memorandum explains that the amendments made by such Acts were already incorporated into the principal Acts and that the proposal is intended as statute-book cleanup. P14 therefore does not infer that enactment would restore the old pre-1984 contractual limitation in §12(3). Parliament of South Africa+3

On 21 October 2026 the National Assembly Order Paper listed B26—2026 both among Bills referred to the Joint Tagging Mechanism and among Bills referred to committees. Parliament’s bill page displayed the stage as “Introduction” when accessed in P14. These are bounded status records, not a certificate that no later legislative event can occur. Parliament of South Africa+2

Replacement for P12 search/read audit — Bill sources

The original P12 Justice URL for Gazette 54941 was not reopened successfully in P14 and is no longer treated as the introduced-Bill body or schedule source. A genuinely different official source—the Parliament introduced Bill—was freshly opened and supplies the cover identity, clauses, schedule item 81 and memorandum. The Parliament bill-status page and the 21 October 2026 National Assembly Order Paper were also freshly opened. No hidden endpoint, API, security workaround or repeated failed fetch was used.

C_ZA-P12-C035 — replace A communication made without prejudice that actually constitutes an acknowledgment of liability under Prescription Act §14 may be admitted solely to prove interruption of prescription. The exception is fact-specific, is not absolute and may be expressly or impliedly excluded by the parties in their negotiations. The admission remains protected for proving the existence and quantum of the debt. Not every offer or negotiation communication constitutes an acknowledgment. C_ZA-P12-C037 — replace Issuing, preparing or filing process alone does not prove interruption absent actual service or an applicable statutory deemed-service event such as §15(5) joinder on the defendant’s own application. C_ZA-P12-C056 — replace The Repeal of Certain Pre-1994 Justice Laws Bill B26—2026 was introduced in the National Assembly on 17 September 2026. Its schedule item 81 proposes repeal of the Prescription Amendment Act 11 of 1984. The 21 October 2026 Order Paper listed it under the Joint Tagging Mechanism and referral to the Justice Committee, and Parliament’s current page displayed “Introduction” on P14 access. The proposal was therefore not operative in the bodies read. The 3 July 2026 Gazette item was the explanatory summary and prior notice, not the introduced Bill itself. No restoration of the former §12(3) wording is inferred. Parliament of South Africa+5
C_ZA-P12-C057 — retain Calendar timelines in P12 use anniversary arithmetic, not business-day computation. Exact final instants, holidays, procedural filing rules and actual deadlines remain held. P14 correction: Workflow 1 must cite C057 rather than C051.

C_ZA-P12-C035 — replaceA communication made without prejudice that actually constitutes an acknowledgment of liability under Prescription Act §14 may be admitted solely to prove interruption of prescription. The exception is fact-specific, is not absolute and may be expressly or impliedly excluded by the parties in their negotiations. The admission remains protected for proving the existence and quantum of the debt. Not every offer or negotiation communication constitutes an acknowledgment. Source: KLD Residential CC v Empire Earth Investments 17 (Pty) Ltd [2017] ZASCA 98, majority paragraph 39, zero PDF P13 / printed page 14. Supreme Court of Appeal +1
C_ZA-P12-C036 — replaceJudicial interruption ordinarily requires service on the debtor of process claiming payment of the debt. Under Prescription Act §15(5), if a person is joined as defendant on that person’s own application, that process is deemed served on the joinder date. Source: Prescription Act 68 of 1969 §15(1),(5), zero PDF P4 / printed Gazette page 8. South African Government +1
C_ZA-P12-C037 — replaceIssuing, preparing or filing process alone does not prove interruption absent actual service or an applicable statutory deemed-service event such as §15(5) joinder on the defendant’s own application. P12 does not determine any other deemed-service, waiver or curative doctrine. Source: Prescription Act §15(1),(5), zero PDF P4 / printed Gazette page 8. South African Government +1
C_ZA-P12-C056 — replaceThe Repeal of Certain Pre-1994 Justice Laws Bill B26—2026 was introduced in the National Assembly on 17 September 2026. Parliament of South Africa +5
C_ZA-P12-C057 — retainCalendar timelines in P12 use anniversary arithmetic, not business-day computation. Exact final instants, holidays, procedural filing rules and actual deadlines remain held. P14 correction: Workflow 1 must cite C057 rather than C051.

Corrections, review and scope

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
