Narrow correction: §87A suspension duration
Narrative correction verified Current operative status remains unverified
Research access: 26 October 2026, approximately 18:00–18:02 PDT (America/Los_Angeles); 27 October 2026, approximately 01:00–01:02 UTC; 27 October 2026, South African Standard Time.
Scope: One sentence in P02 G2. All other P01/P02 findings, claims, limitations and publication holds are preserved. This is a researcher self-check, not independent review or acceptance of the South African country report.
1. Finding and exact replacement sentence
The correction is supported by the final enacted English text of the National Credit Amendment Act 7 of 2019.
Inserted §87A(2)(b)(i) uses “for 12 months”, not an initial duration of any period up to 12 months. The expression “in part or in full” describes the extent of suspension of qualifying credit agreements; it does not modify the duration. The text permits one further 12-month period, but extension involves additional assessment, referral and Tribunal consideration. [C_ZA-P03-C002–C007; S001 §87A(1)–(5)]. gov.zagov.za
EXACT REUSABLE REPLACEMENT — P02 G2
“Under the enacted 2019 text, whose current operative status remains unverified, proposed §87A allows the National Consumer Tribunal, following a qualifying referral from the National Credit Regulator and consideration of the required information, to reject a debt-intervention application or suspend all qualifying credit agreements, in part or in full, for 12 months, with required financial-literacy participation; one further 12-month suspension period may be considered subject to the statutory factors and subsequent reassessment and referral requirements.”
This wording corrects the duration without suggesting:
- A discretionary shorter initial duration under §87A(2)(b)(i).
- An automatic extension or a guaranteed two-year suspension.
- Automatic extinguishment of a debt.
- An application service currently available to the public.
- Authority for a private debt negotiator to exercise the NCR’s or Tribunal’s functions.
Disposition: Correct the P02 G2 narrative only. Retain C_ZA-P02-C014 because its existing phrase “conditional 12-month full/partial suspension and one additional 12-month period” is consistent with the enacted wording. [C_ZA-P03-C010]
2. Narrow statutory reading
G1 — Duration, scope and decision-maker
The final Gazette is Government Gazette 42653, Government Notice 1086, dated 19 August 2019. Its explanatory page states that the earlier Gazette 42649 publication is withdrawn and replaced. The final text therefore supplies the controlling historical wording for this correction. [C_ZA-P03-C001; S001 PDF P1, Gazette p2]. gov.za
Inserted §87A(1) describes a referral under §86A(6)(e) considered by a member of the National Consumer Tribunal, with NCR documents and relevant credit-provider representations.
Under §87A(2), the Tribunal may reject the debt-intervention application or, instead, make the specified suspension order and require financial-literacy attendance.
Three distinct statutory choices must not be flattened together:
| Question |
What the enacted text says |
What must not be inferred |
| Initial duration |
For 12 months — §87A(2)(b)(i) |
A general initial duration of 1–12 months |
| Suspension scope |
Qualifying agreements may be suspended in part or in full |
That part/full means a shorter/longer duration |
| Further period |
One further 12-month period may be ordered, subject to the stated considerations and review/referral process |
Automatic renewal or a two-year entitlement |
[C_ZA-P03-C002, C003, C006, C007; S001 §§87A(2)–(5)]. gov.zagov.za
Section 87A(3) requires the Tribunal to consider relevant factors when considering suspension, part suspension, alteration, extension or possible later extinguishment. The factors include circumstances and conduct of the applicant and affected credit providers. These are decision-making predicates, not a generic permission to shorten the initial statutory term. [C_ZA-P03-C006; S001 §87A(3), PDF P19 and P21, Gazette pp20,22]. gov.zagov.za
G2 — Subsequent review does not make relief automatic
The enacted §87A(5) would require the NCR to review financial circumstances eight months after an initial suspension order. Depending on the resulting assessment, the NCR would refer the matter for possible rearrangement or for the Tribunal to consider extension. If an extension were ordered, another review would occur eight months into that further period. [C_ZA-P03-C007, C008; S001 §87A(5)]. gov.za
Potential extinguishment belongs to a later, separately conditioned decision under §87A(5)(c) and (6)–(9). It requires further referral, consideration of continuing financial insufficiency and statutory factors, and a Tribunal order. It does not follow automatically from either suspension period. [C_ZA-P03-C008; S001 PDF P21/P23, Gazette pp22/24]. gov.za
Those eight-month intervals are descriptions of the 2019 enacted mechanism, not current filing dates or proof that a live scheme exists.
Preserved commencement boundary
Section 32 provides commencement by a date fixed by the President through proclamation in the Gazette. The government's Act-listing page reproduces that requirement, but neither the 2019 Gazette's publication date nor the listing establishes an actual commencement proclamation. [C_ZA-P03-C009; S001 §32; S002]. gov.zaSouth African Government
This pass deliberately did not repeat P02's proclamation search or conduct a full post-2019 amendment search. Accordingly, P01 C032/C045 and P02's unknown-operative-status and publication holds remain unchanged. That is not a finding that no proclamation exists.
The separate P01 C038 proposition regarding existing NCA §§86–87 debt review—referring to a competent Tribunal or court, depending on the relevant route—is also preserved verbatim in substance. This P03 reading of proposed §87A must not become a claim that the Tribunal is the only possible decision-maker under the entire debt-review system.

6. Two invented classification examples
These are fictional editorial tests, not real borrower or provider situations and not assertions that the scheme presently operates.
Example 1 — Fixed wording without automatic benefit
Assumed facts: An article quotes the enacted 2019 §87A(2)(b)(i), but has no independently established proclamation, operational procedure or individual Tribunal order.
- Incorrect statement: “A qualified person may choose an initial suspension of up to 12 months and automatically renew it once.”
- Permissible statement: “The enacted text describes a possible Tribunal-ordered 12-month suspension, with one further 12-month period subject to separate requirements; its present operation has not been established.”
- Adverse branch: The Tribunal may reject the application. No later extension follows merely because an initial order was hypothetically made.
- Missing proof: Relevant commencement instrument, presently applicable rules and procedures, qualification findings and actual Tribunal decisions.
- Evidence: C002, C004, C006, C007, C009; S001 §§87A(1)–(5), 32.
Example 2 — Agreement scope is different from time
Assumed facts: A fictional statutory referral identifies three agreements solely for illustrating the grammar. No assertion is made that any one is legally qualifying.
- Question A — extent: Would the contemplated order suspend relevant obligations under qualifying agreements completely or only partly?
- Question B — duration: If the enacted §87A(2)(b)(i) suspension were ordered, what initial duration does that subsection state?
Correct classification: A addresses “in part or in full”. B answers 12 months. A partial suspension does not mean “six months,” and a full suspension does not establish a longer initial period.
Adverse branch: One or more agreements might fail the underlying qualification test, or the Tribunal might reject the application. This example supplies neither an operative procedure nor an individual entitlement.
Missing proof: Actual applicability and qualification of the agreements, current commencement/implementation, referral materials and Tribunal order.
Evidence: C002–C004, C009; S001 §87A(1)–(2).
7. Complete granular P03 coverage and deferral register
Meaning of status: answered applies only to the tightly framed historical-text or editorial-reconciliation question; it never means “the current debt-intervention service was verified.” partial and unresolved preserve explicit evidence gaps.

Exact next research question, if separately authorized
Did a valid presidential proclamation commence the relevant provisions of National Credit Amendment Act 7 of 2019, particularly inserted §87A(2)(b)(i), and has any subsequently commenced amendment altered its precise duration wording?
That question requires the actual proclamation and relevant later enacted/commenced bodies. It is not answered merely by this correction.
P03 disposition: One P02 narrative sentence corrected; C014 retained; all operative-status and whole-country holds preserved. No independent-review or country-acceptance claim.
