Focused finding: 2019 debt-intervention commencement and implementation

Publication hold remains 2019 source discrepancy identified

The principal finding is a correction to the 2019 Act’s source record, not a reversal of P01’s cautious conclusion about commencement.

The official publication in Government Gazette 42653, Government Notice 1086, dated 19 August 2019, expressly withdrew and replaced the earlier publication in Gazette 42649. The replacement records presidential assent on 13 August 2019. P01 source C_ZA-S012 cited the earlier, withdrawn Gazette; the controlling enactment citation must instead be the replacement Gazette. This correction matters for source integrity even where the substantive commencement wording agrees. C_ZA-P02-C001. gov.zagov.za

Section 32 of the replacement Act provides for commencement on a date fixed by presidential proclamation in the Gazette. Neither assent nor publication on 19 August 2019 independently establishes the commencement date. C_ZA-P02-C002. gov.za

The enacted amendments describe a distinct prospective debt-intervention process involving the National Credit Regulator (NCR) and National Consumer Tribunal. But finding the statutory text, preparatory activity or a later document mentioning debt intervention does not, without the necessary commencement and operational instruments, establish that the 2019 process can presently be offered to consumers. C_ZA-P02-C003 (bounded evidentiary conclusion). gov.za

The appropriate interim disposition is therefore to retain P01 C032 and C045’s unknown-operative-status/publication hold, while correcting their reliance on the superseded Gazette. The complete instrument-chain findings and limitations follow.

Verification window and result

Fresh public-source checks were conducted 26 October 2026, approximately 17:24–17:28 Pacific daylight time (PDT); 27 October 2026, approximately 00:24–00:28 UTC, corresponding to 02:24–02:28 South African Standard Time (SAST).

Question Narrow result
Was Act 7 of 2019 enacted and officially published? Yes. The replacement Gazette 42653 was freshly read. C001.
Does the Act commence automatically on assent or publication? No. Section 32 specifies presidential proclamation. C002.
Was a qualifying 2019 Act commencement proclamation established through the research cutoff? No instrument established in the bounded search. Its operative status remains unresolved, not affirmatively disproved. C003.
Does Proclamation R.10 of 2015 answer that question? No. It commenced Act 19 of 2014, a different amendment. C004.
Do the identified 2025 draft withdrawal or 2026 NCR guideline commence debt intervention? No. They concern different instruments and procedures. C019–C021.
Can the 2019 debt-intervention benefits be described as operational today? Not on the established evidence. Publication remains on hold pending the actual commencement and implementation chain. C023.

G1 — Enactment, commencement and transitional status

  1. Enactment and source identity. Act 7 of 2019 was assented to on 13 August 2019 and published in replacement Gazette 42653, GoN 1086, on 19 August 2019. The text explicitly replaces Gazette 42649. The earlier Gazette must remain in the history as a withdrawn source, not be cited as the authoritative final promulgated copy. C001. gov.za

  2. Commencement trigger. Section 32 does not nominate 19 August 2019 or another self-executing date. It requires a date set by the President through a Gazette proclamation. That presidential instrument, its exact coverage and its stated operative date are separate evidence requirements. C002. gov.za

  3. Bounded 2026 check. Searches directed at official government, Presidency/Gazette, dtic, NCR, NCT and Government Printing Works sources did not yield a verified proclamation commencing Act 7 of 2019. The government’s Act landing page repeats the statutory proclamation mechanism, but does not itself identify an operative proclamation. The Government Printing Works archive pages were accessible as search-entry pages, without a complete searchable result set in the retrieved text. This supports “not established in this research”, not “no proclamation exists” or “the Act has never commenced.” C003. South African GovernmentGPW

  4. An important false positive was resolved. Proclamation R.10 of 2015, published in Gazette 38557 on 13 March 2015, says that the National Credit Amendment Act 19 of 2014 commences upon that proclamation’s publication. It invokes §39 of the 2014 Act. Its title is similar, but it predates and does not commence Act 7 of 2019. C004. gov.za

  5. Historical implementation evidence. The NCR’s 2022/23–2024/25 Annual Performance Plan described implementation of the 2019 measure as still being prepared. An NCT revised draft 2024/25 plan used prospective language about the Act extending the Tribunal’s functions once enforced. These are dated institutional statements, not commencement instruments, and they cannot conclusively determine status on 27 October 2026. C005. thedtic.gov.zathedtic.gov.za

  6. Transition. Section 31 would apply the amendment to certain earlier credit agreements within the principal Act’s Chapter 1 scope, excluding amending clauses 19, 25 and 26. The enacted section calls it the “National Credit Amendment Act, 2018” while §32 names the 2019 Act. This apparent drafting-year inconsistency is preserved verbatim as a source-text issue; no retrospective application is asserted without identifying commencement and the proper treatment of that inconsistency. C006. gov.za

  7. Later changes. No later, verified amendment, repeal, commencement modification or ministerial threshold-adjustment instrument specifically governing these 2019 debt-intervention provisions was established during the bounded search. The dtic-hosted consolidation labels them pending, but expressly dates its update to withdrawn Gazette 42649 in 2019; it is historical secondary compilation evidence, not a verified consolidation to October 2026. C018. thedtic.gov.za

G2 — Enacted operational architecture, with current availability unproved

The following describes what the 2019 enactment would establish if and to the extent the relevant provisions are brought into operation. These are not advertised current entitlement rules.

Applicant and agreement perimeter. The proposed inserted definition in §1 identifies a natural person or natural persons sharing a joint estate, restricted to stated unsecured credit categories, over-indebted and neither sequestrated nor under an administration order. The enacted income criterion is no income or a preceding-six-month average gross income not exceeding R7,500 per month, subject to an authorized change mechanism. The enacted §86A(1) total-unsecured-debt figure is R50,000, also subject to its specified adjustment mechanism. Developmental credit under §10 and agreements already taken to the §130 enforcement stage are excluded in the specified circumstances, with an express §85(c) qualification for the latter. These are 2019 text figures, not verified current operating limits. C007–C008. gov.zagov.za

Who could act. Proposed §15A gives assistance functions to the NCR. Its CEO or authorized employee could appoint suitable NCR or other state employees as debt-intervention officers, issuing the prescribed certificate. Such an officer would be deemed registered as a debt counsellor under §44 only for the stated §15A(1) services. That limited statutory deeming provision neither makes an unrelated commercial negotiator an NCR debt-intervention officer nor proves the necessary appointments and certificates were issued. C009. gov.zagov.za

Who receives, evaluates and recommends. Under proposed §86A:

  • The applicant would apply to the NCR in the prescribed manner and form; the NCR would assess using specified §86 procedures, engage the identified credit providers and provide financial-literacy counselling/access to training. C010.
  • Depending on its reasoned assessment, the NCR would reject; recommend consideration of a voluntary arrangement for a nonqualifying applicant in difficulty; refer apparent reckless, unlawful or prohibited-conduct agreements; recommend Tribunal rearrangement if qualifying obligations could be rearranged within five years or a longer prescribed period; or recommend the separate §87A Tribunal route where income and assets were insufficient for such rearrangement. C011.
  • The enacted text also provides for creditor representations, rules around termination before Tribunal filing, and the court’s potential resumption order. Those procedural predicates are not a present creditor-cooperation or protection promise. C012. gov.zagov.zagov.za

The unusually important sunset condition. Proposed §86A(12)(a) makes the §86A(6)(e) referral power, specifically, effective for 48 months from when that subsection becomes operational. A ministerial review report is required within 36 months after that operational trigger. These periods do not start merely because the statute was published in August 2019. Without the subsection’s proved operational date, neither the start nor the possible expiration of this branch can be assigned a calendar date. C013. gov.za

Who determines relief. Proposed §87(1A) assigns specified rearrangement determinations to the National Consumer Tribunal on an NCR recommendation. Proposed §87A separately permits a qualifying case to be rejected or to receive a discretionary suspension, initially up to 12 months with one further 12-month extension under stated conditions and financial-literacy participation. Subsequent NCR reassessments and the Tribunal’s further assessment precede any potential order extinguishing qualifying amounts. This is not an automatic two-year payment holiday or debt write-off. C014. gov.zagov.zagov.zagov.za

Linked record, effect and rehabilitation provisions. Proposed §§69A, 70–71A, 88A–88B and relevant Tribunal-jurisdiction amendments create recordkeeping, notification, credit-information, credit-restriction, enforcement-effect and potential rehabilitation mechanisms. They depend on the enacted statutory predicates and, in numerous places, prescribed forms or processes. Merely having an existing NCR system or a debt counsellor’s clearance certificate does not prove this separate 2019 system is operative. C015–C016. gov.zagov.za

Additional regulations and threshold notices. Proposed §171(1)(bA) and (bB) contemplate ministerial regulations for financial-literacy participation and specified interest/charge-order treatment. Proposed §171(2A) separately permits income and unsecured-debt amount adjustments by Gazette notice with the specified consideration, consultation, tabling and approval requirements; §171(2A)(e) constrains adjustment of the time-limited §86A(6)(e) branch. No completed current chain of those applicable rules, notices, forms, appointments and commencement instruments was verified. C017. gov.zagov.zagov.za

Existing debt review is a different pathway. The 2005 NCA’s §86 provides for an application to a debt counsellor, assessment and the specified route to the Magistrate’s Court under §87. The proposed §86A applies through the NCR, with designated Tribunal and court branches. A voluntary private workout, ordinary debt review and 2019 debt intervention should never be labelled as though they confer the same statutory status. Full current debt-review procedures remain P01-deferred. C022. justice.gov.zajustice.gov.zagov.za

G3 — The 2025–26 documents are different instrument families

  • August 2025 draft: Government Gazette 53154, Regulation Gazette 11867, GoN R.6510, 13 August 2025 publishes proposed National Credit Regulations amendments. Fresh visual inspection of all four PDF pages identifies changes addressing credit-information and credit assessment/reporting, including corporate/SME and educational-information issues. It does not purport to proclaim Act 7 of 2019’s §32 commencement or prescribe a §86A debt-intervention application system. It was a draft, not binding final rules. C019.

  • Withdrawal: The dtic’s 12 November 2025 parliamentary briefing, expressly marked as discussing withdrawn draft regulations, says the August draft was withdrawn in its entirety following objections. It explains that the educational-institution rule cited in the controversy was not itself newly inserted by that draft; the proposed change concerned expansion of credit-information treatment, notably for juristic persons and SMEs. The separate 12 September 2025 ministerial statement was supplied as a P01 source and is visible in official search, but fresh direct-page retrieval failed; this finding independently rests on the freshly opened parliamentary briefing. Withdrawal of this draft does not withdraw the 2019 Act or every other NCA rule. C020. thedtic.gov.zathedtic.gov.za

  • February 2026 NCR Guideline 001/2026: This concerns debt counsellors’ Form 19 clearance-certificate filing through the CBA debt-counselling platform, citing the existing NCA §71(4) clearance context. Its scope is neither presidential commencement of the 2019 Act nor an §86A implementation instrument. The guideline’s own rescission of previous clearance-filing guidance must not be enlarged into repeal or commencement of primary legislation. C021. ncr.org.zancr.org.za

G4 — Immediate claim disposition and publication rule

P01’s core safeguards survive: C032 and C045 remain correctly cautious, subject to the critical replacement of withdrawn source S012 with authoritative Gazette 42653. C038 continues to separate existing §§86–87 debt review and private negotiation from the contingent §86A scheme. C033 remains limited to the specific August 2025 credit-information draft withdrawal. C023–C024.

Permissible publication language:

South Africa enacted debt-intervention amendments in the National Credit Amendment Act 7 of 2019. The Act requires commencement by presidential proclamation. Our official-source verification through 27 October 2026 did not establish the relevant proclamation or a complete current implementation chain, so we cannot confirm that the new statutory process is operational. Existing debt review under the National Credit Act is a distinct process.

Withhold: “Applications are open”; “eligible if income is below R7,500”; “up to R50,000 will be written off”; “all unsecured debts can be suspended for two years”; “the 2019 scheme never commenced”; “it expired in 2023”; or “an NCR debt counsellor automatically acts as a debt-intervention officer.”

These assertions require different missing primary instruments or applicant-specific predicates. Neither the statutory text nor an inconclusive search supports them. C003, C007–C017, C023.

The registers below distinguish three evidence classes:

  • Fresh body read: the relevant statute, PDF pages or official institutional document were opened during P02.
  • Dated P01 attribution / fresh discovery only: the earlier researcher described access, but the relevant body was not successfully reopened in P02.
  • Catalog or failed-access boundary: identifies a search location or failed candidate; not affirmative proof that an instrument does not exist.

PDF page indices are zero-based. “Printed page” refers to numbering visible on the Gazette/document, where established. All listed fresh P02 checks occurred 26 October 2026 PDT / 27 October 2026 UTC; access times were not recorded separately for every retrieval. C_ZA-P02-C007 Enacted proposed §1 applicant class: natural person or joint-estate persons; specified unsecured-only consumer credit; average gross income ≤ R7,500/month over six preceding months or no income; over-indebted; not sequestrated or subject to an administration order. S001 Act §1(b), P3/GG p4; adjustment reference §171(2A)(a), P39–41/GG pp40–42. Applicant and covered agreements at application date; 2019 enacted conditional text, not verified current qualifying criteria. Exact debt and joint-estate classification remain fact-sensitive.
C_ZA-P02-C008 Proposed §86A(1) sets total unsecured debt ≤ R50,000 or prescribed adjusted amount; §86A(2) excludes §10 developmental credit and, subject to §85(c), agreements where §130 enforcement steps had begun at application. S001 §86A(1)–(2), P13, P15/GG pp14,16; §85(c), P13. Affected credit agreements; 2019 conditional text. Later threshold adjustment and commencement unknown. Not a current offer or all-debt eligibility rule.
C_ZA-P02-C009 Proposed §15A makes the NCR responsible for stated assistance; its CEO/authorized employee may appoint suitable NCR/state employees as officers and issue prescribed certificates, deeming §44 registration only for §15A(1) services. S001 §15A(1)–(2), P5, P7/GG pp6,8. NCR and appointed individual; conditional officer appointment, certificate and scope. No private actor, corporate employee or ordinary debt counsellor gains this capacity automatically. Actual appointments/forms unverified.
C_ZA-P02-C010 Under proposed §86A, an applicant addresses the NCR in prescribed form; NCR uses §86(4),(6), financial-literacy counselling/training and identified participants’ duties. S001 §86A(1),(3)–(5), P13, P15/GG pp14,16. NCR/qualifying applicant/credit providers; enacted dependency on operative section and actual prescribed procedure. No public application service verified.
C_ZA-P02-C011 Proposed §86A(6)(a)–(e) distinguishes rejection, voluntary-arrangement recommendation, prohibited-credit referral, Tribunal restructuring recommendation within five years or prescribed longer period, and §87A referral for insufficient income/assets. S001 §86A(6)–(8), P15–17/GG pp16–18. NCR evaluates then recommends/refers; Tribunal/court separately decides where designated. Voluntary consent is not compulsory creditor agreement; no automatic debt reduction.
C_ZA-P02-C012 Proposed §86A(9) allows affected creditor representations on the §86A(6)(e) referral; §§86A(10)–(11) describe qualified creditor termination/resumption branches. S001 §86A(9)–(11), P17/GG p18. Listed credit provider, NCR, Tribunal/court; conditions include the prescribed notice/period and whether matter already filed at Tribunal. No existing protection or calendar deadline inferred.
C_ZA-P02-C013 Proposed §86A(12) makes subsection (6)(e) effective for 48 months from its own operational start and calls for ministerial review report by 36 months after that start. S001 §86A(12)(a)–(b), P17/GG p18. Subsection-specific commencement trigger. No operative trigger date established; cannot date sunset from 2019 publication or assert currently open/expired.
C_ZA-P02-C014 Proposed §§87(1A) and 87A place specified decisions with NCT; §87A(2) permits conditional 12-month full/partial suspension and one additional 12-month period, with required financial literacy; §87A(5)–(8) controls reassessment and potential extinguishment. S001 §87(1A), P17–19/GG pp18–20; §87A(1)–(9), P19–23/GG pp20–24. NCT on NCR referral, with evidence/consideration/order required. Relief is discretionary and conditional, and potential extinguishment is not automatic. Operative status unknown.
C_ZA-P02-C015 Proposed §§88A–88B govern debt-intervention-related credit effects and rehabilitation; §69A establishes a proposed NCR record. S001 §69A, P7/GG p8; §§88A–88B, P23–27/GG pp24–28. NCR, affected consumer/credit providers, Tribunal; formal application/order and prescribed notifications/rehabilitation predicates. Do not equate clearance under existing debt review with this regime.
C_ZA-P02-C016 Proposed credit-information changes §§70–71A and jurisdiction/referral changes §§137(1A),142(3)(fA) form supporting architecture. S001 P7–10/GG pp8–11; §§137(1A),142(3)(fA), P31/GG p32. NCR/credit bureaux/NCT; prescribed filing/recording and hearing roles. Implementation rules, systems, forms and operative status not verified.
C_ZA-P02-C017 Proposed §171(1)(bA),(bB) requires specified financial-literacy and interest/charge-order regulations; §171(2A)(a)–(e) provides constrained threshold-adjustment/review/approval steps. S001 §171, P37, P39–41/GG pp38,40–42. Minister, Finance Minister consultation where stated, National Assembly and Gazette notices where required. Mandatory acts in the text are contingent on commencement; no finalized 2026 implementing/adjustment notice established.
C_ZA-P02-C018 No later amendment/repeal or operative adjustment governing these 2019 debt-intervention provisions was verified; the dtic-hosted compilation is dated to 2019 GG 42649 and labels 2019 changes pending. S006 P0, P8–9, P59–60; S001 source replacement; targeted audit. Bounded currentness limitation, not confirmation of unchanged law or universal 2026 noncommencement. Consolidation provenance is stale relative to withdrawn source.
C_ZA-P02-C019 August 2025 GoN R.6510 / GG 53154 was a draft NCA regulations amendment addressing credit-information matters, not a presidential Act 7/2019 commencement proclamation or §86A forms instrument. S009 scanned P0–3/GG pp3–6; S011 P5–7. Ministerial consultation draft; no operative debt-intervention capacity or commencement follows from publication.
C_ZA-P02-C020 The specific August 2025 draft was withdrawn in full according to dtic’s 12 Nov 2025 briefing; its scope involved credit information, educational-institution concerns and SMEs. S011 P1, P6–7/briefing slides 7–8; S010 P01-attributed statement and fresh discovery only. dtic explanatory/withdrawal status; not repeal of Act 7/2019, not withdrawal of every draft or regulation, and not a private statutory remedy created by the briefing.
C_ZA-P02-C021 NCR Guideline 001/2026 deals with filing debt-review Form 19 clearance certificates via the CBA platform under existing §71(4); it does not implement or commence §86A. S012 P0–2, guideline pp1–2. NCR guidance for participating debt counsellors and credit-bureau process. Changes to its own guidance must not be treated as changing Act §32. Other guideline compliance questions deferred.
C_ZA-P02-C022 Original NCA §86 uses a debt counsellor for debt review; §87 provides identified Magistrate’s Court orders. Proposed 2019 §86A instead uses the NCR and its new Tribunal/court branches. S005 §§86–87, PDF P59–61/GG pp118–122; S001 §86A, P13–17/GG pp14–18. Different statutory routes. Existing debt review does not become §86A intervention merely through rebranding; original-Act text alone does not settle every 2026 debt-review procedural detail.
C_ZA-P02-C023 Evidence is insufficient to advertise the 2019 intervention as an operating application, guaranteed suspension, eligibility approval or extinguishment benefit, or conclusively to say it never commenced. S001 §32, §86A, §§87–87A; S003; S013–S016 search bounds; C003. Research/publishing inference: require actual operative proclamation, any stages/exclusions, implementation instruments and individual predicates before representing the service or benefit as available.
C_ZA-P02-C024 P01 C032/C045 retain their bounded unknown-status/publication holds but must cite replacement S001 instead of withdrawn P01 S012; C033/C038 remain separate-subject distinctions. S001 P1 and §32 P41; S002 P0; S004; S005 §§86–87; S009–S012. Provenance correction and limited claim reconciliation only. Supplied P01 claims are historical records, not freshly re-reviewed P01 source bodies beyond the P02 records listed. No whole-country acceptance.
C_ZA-P02-C025 Proposed §85(c) lets a court considering an apparently qualifying consumer ask whether the consumer wishes to participate, then refer to NCR or, if sufficiently informed, consider a specified order. S001 Act §11 inserting NCA §85(c), PDF P13/GG p14. Court acting within an actual case; applicant choice, qualification and adequate information matter. This is a separate conditional court gateway, not a general private adviser’s power or evidence of present operation.

Enactment-to-operation dependency crosswalk

Targeted P01 old-to-new disposition

These are the four supplied actual claim rows being reconciled. No other P01 claim is implicitly reopened.

P01 claim Supplied P01 proposition and original support P02 primary evidence and precise correction Disposition
C_ZA-C032 Act 7/2019 §32 requires presidential proclamation; publication in August 2019 does not commence it; no qualifying proclamation established in P01 on 26 Oct 2026. Original support: P01 S012 §§31–32, withdrawn GG42649 PDF P40/GG p42; P01 S011 government metadata. P02 S001 §32, PDF P41/GG p42 verifies the same operative wording in replacement GG42653; S001 P1 records express withdrawal of GG42649. P02 S003 confirms official attachment identity. P02 search did not establish the further presidential instrument. P02 C001–C003. Retained with source-provenance correction. The unknown-status conclusion remains bounded. Replace the controlling S012 citation with S001, retain S012 as withdrawn historical source.
C_ZA-C045 Do not advertise the 2019 intervention as an operating statutory benefit without independently established commencement and procedures. Original support: P01 S012 §32; S011 metadata. Replacement P02 S001 §§15A,86A–87A,171,32 details additional service dependencies; P02 S003 is metadata, not proclamation. P02 C002–C003,C009–C017,C023. Retained and made more specific. Withhold availability, automatic relief, current eligibility thresholds and sunset-date claims. Not a determination of permanent noncommencement.
C_ZA-C038 Statutory debt review uses NCA §§86–87, distinguishable from private voluntary workout. Original support: P01 S001 §§86–87, S002 amended §86, S013 PDF P6–8; P01 exact source URLs were not supplied in this handoff. Fresh P02 S005 §§86–87, P59–61/GG pp118–122 establishes original statutory route; P02 S001 §86A P13–17/GG pp14–18 establishes distinct proposed NCR pathway; §85(c) adds a conditional court connection. P02 C022,C025. Retained within P01 limits; scope clarified. No claim that the entire §§86–87 regime was newly consolidated/recertified through 2026.
C_ZA-C033 The specific August 2025 credit-information-related draft was withdrawn, without global effect on unrelated NCA regulations. Original support: P01 S021 briefing P1/P4–7 and S036 ministerial HTML statement. Fresh P02 S009 GG53154/R.6510 P0–3 identifies the draft’s actual subject; S011 P6–7 expressly reports withdrawal of that draft as a whole; S010 press statement remains P01-attributed, fresh full fetch unsuccessful. P02 C019–C021. Retained, narrowly. No change to the 2019 Act’s enactment/commencement status.

Correction rule: P02 does not silently overwrite P01. The original P01 source identifier and source-access attribution remain in history; a future consolidated report should show P01 S012 (withdrawn) → P02 S001 (replacement) explicitly.

Worked status-classification examples

The examples below are invented evidentiary situations, not actual consumers, providers, proclamations, applications or decisions. They test what a researcher may truthfully write. No fictional Gazette number, effective date or actual transaction is implied.

Example 1 — Published Act, no commencement instrument in the evidence file

Assumed documents: A researcher possesses replacement GG42653 and the official Act landing page, but no verified presidential proclamation or subsequent implementation regulations.

Test: GG42653 proves assent, publication and statutory design. Section 32 independently requires a presidential proclamation. The landing page states that requirement but does not supply the implementing instrument.

Permissible statement: “The 2019 debt-intervention amendment was enacted; its operative commencement was not established by the available evidence.”

Adverse branch: If a later authoritative Gazette proclamation is located, the researcher must inspect its exact Act identity, provision coverage, operative date, exclusions and any later alteration. The earlier absence-of-proof report must then be updated; it cannot be defended as a claim of permanent noncommencement.

Missing document: Relevant proclamation plus commencement/currentness reconciliation. C001–C003,C023.

Example 2 — Hypothetical staged commencement; one section operative, another withheld

Purely hypothetical assumed instrument: Suppose a future authenticated proclamation, with no invented identifier or calendar date here, expressly commences the provisions establishing NCR administrative preparation but reserves §86A(6)(e) and §87A for a later proclamation.

Test: Do not infer that every part of the 2019 intervention is available just because one related section has commenced. Read the proclamation section by section, together with later instruments. The §86A(12) 48-month clock specifically depends on the operational start of §86A(6)(e), not the date of any other provision’s commencement.

Permissible statement: “Only the sections expressly brought into operation by the verified instrument have been shown to commence; the §86A(6)(e)/§87A suspension and possible extinguishment route remains unestablished.”

Adverse branch: If a later proclamation separately commences §86A(6)(e), recalculate the branch’s validity from that verified trigger, test amendments and complete prescribed processes. A staged proclamation alone still would not guarantee any Tribunal order or private application service.

Missing documents: Real staged proclamation, subsequent commencement for excluded sections, any applicable finalized procedures. C002,C009–C017,C023.

Example 3 — An unrelated draft or current guideline is presented as proof

Assumed assertion: A publisher cites the August 2025 Gazette credit-information draft or the NCR’s February 2026 Form 19 guideline to claim that 2019 debt intervention is operating.

Test: Inspect the instruments’ titles, issuing authorities, powers invoked and operative bodies. The August document proposes changes to regulations concerning credit information and was subsequently withdrawn. The February guideline describes an existing debt-review clearance-certificate platform. Neither is a presidential proclamation under Act 7/2019 §32 or the complete implementation of §86A.

Permissible statement: “These documents concern separate NCA regulation and clearance processes and do not establish commencement of the 2019 debt-intervention scheme.”

Adverse branch: Even if a later version of the credit-information rules is finalized, the resulting instrument would have to expressly satisfy the specific missing statutory dependency before being relevant; the label “National Credit” is insufficient.

Missing documents: An actual §32 commencement proclamation and, if necessary, §86A/§171 final implementing instruments. C002–C003,C019–C023.

Example 4 — The statutory 48-month rule is mistaken for a 2019–2023 calendar window

Assumed assertion: “The law was published in 2019, so the 48-month debt-intervention provision expired four years later.”

Test: The text identifies the date §86A(6)(e) becomes operational as the trigger. It does not say the clock begins with assent or publication.

Permissible statement: “The enacted subsection specifies a 48-month duration beginning on its verified operational date; that date, any later modifying law and resulting current validity remain unresolved.”

Adverse branch: If proof establishes a valid commencement date T, the period must be analyzed using T + 48 calendar months, the exact operative wording and later changes—not the 2019 publication date. This symbolic expression is not an actual expiry date or eligibility decision.

Missing documents: Specific operational commencement and later-law review. C013,C018,C023.

Search and read audit

Official repositories and actual bounds

Repository / access route What was actually retrieved or searched Result and limit
gov.za Acts/Gazettes Direct final and earlier 2019 PDFs; Act listing; searches for Act 7 of 2019, commencement, debt intervention, proclamation and related wording. Verified 42653 replacing 42649 and §32. No qualifying 2019 commencement instrument established. Not a full-Gazette enumeration.
gov.za Notices catalogue Title-sorted official indexed results and direct catalogue fetch. Discovered same-name 2015 candidate; direct candidate-index retrieval timed out. Full 2015 P10 read separately and ruled out.
Government Printing Works Official site and 2016–2020, 2021–2024, 2025–2028 Gazette archive entry pages. Archive year pages opened but displayed only search interfaces, not an exhaustive record export or actual responsive issue list. No claim every issue was searched.
Presidency / official proclamation-focused web queries Restricted official-domain searches for 2019 Act title, Act number, commencement and debt intervention. No qualifying post-2019 presidential proclamation body surfaced. Presidency’s complete proclamation register was not independently enumerated.
dtic Historic NCA consolidation, NCR 2022 plan, NCT 2024 revised draft, 2025 ministerial statement discovery and full 2025 parliamentary briefing. Dated planning/policy evidence; confirmed withdrawal of a different draft; no 2019 §32 proclamation. One HTML statement repeatedly inaccessible by direct fetch, so no fresh full-body certification of it.
NCR February 2026 Guideline 001/2026. Fresh body read; clearly existing Form 19 clearance process, not §86A commencement. Broader NCR registers not exhaustively surveyed.
Department of Justice Official hosted original National Credit Act 34/2005 §§86–87. Confirms historic statutory debt-review actor/process distinction; not a current full consolidation.
NCT / parliamentary material Institutional planning text and targeted official search for debt-intervention implementation. Prospective planning statement; no authoritative new operative §86A referral rule, effective regulation or Tribunal mechanism verified.

The search was directed at 2019 through the research cutoff of 27 October 2026 SAST, including the exact-number/title combination and likely implementing bodies. It was not a certified, exhaustive search of every Gazette, gazette supplement, legislative update, court interpretation or institutional archive.

Unresolved primary candidates and prioritized retrieval

  1. Presidential proclamation for Act 7 of 2019 under §32. This is the highest-priority missing item. Search the official complete Gazette records for the Act’s exact title and number; record any proclamation number, Gazette, signature, publication, sections and effective dates.

  2. Any later presidential proclamation varying or staging the 2019 commencement. Compare its precise scope with §86A(6)(e), §87A, §15A and §171. A document bringing one section into force cannot be presumed to bring all the others into force.

  3. Final debt-intervention-specific implementing regulations, forms and notices. Test the enabling statutory section: §§15A,86A,87A,88B,137,142 and 171. Distinguish real final rules from proposed, unrelated or historical regulations.

  4. Threshold-adjustment instruments under proposed §171(2A). Establish the actual Gazette notice and satisfaction of applicable approval/reporting predicates before showing anything other than the original 2019 figures labelled “enacted, operative status unverified.”

  5. Later amendments or repeals to Act 7/2019 or the affected NCA provisions. A dated historic consolidation, especially one based on the withdrawn Gazette, cannot close currentness.

  6. An authoritative recent NCR/NCT implementation notice, if published. This can corroborate implementation, but cannot replace legal proof of commencement.

No application form, licence, provider or borrower was searched or submitted. No agency was contacted and no records request made.

Researcher self-check and publication controls

Check Outcome
Final Gazette versus withdrawn Gazette Resolved: S001 final 42653; S002 historical 42649.
Assent/publication versus commencement Separated: C001 versus C002–C003.
2015 same-title proclamation Resolved: applies to 2014 Act, not 2019.
48-month sunset Correct trigger: operation of §86A(6)(e), not 2019 publication. No actual expiration date asserted.
R7,500 and R50,000 Enacted conditional numbers only. Not published as current eligibility limits.
Suspension/extinguishment Conditional Tribunal powers only. No present automatic relief claim.
NCR employee versus private counsellor Capacity limited by proposed §15A text; no appointment inferred.
2025 draft withdrawal Specific to the identified draft. Not generalized.
2026 clearance guidance Separate existing debt-review process. Not commencement.
Current-source completeness Not established. Gazette search and later amendment/rule verification remain incomplete.
Independent review None claimed. This is the researcher's own crosscheck, not coordinator sign-off.
Files/sites/actions None created, saved or changed. This answer is the complete visible P02 record.

Displayed register counts

  • 16 P02 source rows: C_ZA-P02-S001–S016.
  • 25 P02 atomic claim rows: C_ZA-P02-C001–C025.
  • 30 enactment-to-operation crosswalk rows.
  • 4 P01 old-to-new disposition rows.
  • 4 worked status-classification examples.
  • 84 coverage rows: G1 16 + G2 17 + G3 7 + G4 7 + deferred D 37.

These counts refer to actually displayed rows in this response, not to an external file, hidden dataset or claimed coordinator acceptance.

Evidence-grounded next publishing opportunity

A limited article or verification tool could safely explain “What is the difference between South Africa’s existing debt review and the 2019 debt-intervention amendments?” It should show a dated source trail, the 2019 enacted pathway as conditional, a prominently visible unresolved-commencement warning, and the exact documents required before a current-availability statement can be made.

It must not solicit applications for the unverified 2019 scheme, calculate assured eligibility or savings, suggest a new private authorization, or state that a debt will be suspended or extinguished.

Final P02 disposition: Source provenance materially improved; the P01 unknown-operative-status safeguard remains justified as a bounded research conclusion. The remaining official proclamation and implementation chain prevents current-benefit publication. A097, A098, the broad South African country root and overall P01 acceptance remain held.
