Research status: A substantive national gateway is established from enacted amendments, current published rules and final judgments. The complete current official Insolvency Act consolidation did not render. Section 149 was read in a statutory-text reproduction, but its complete official amendment and commencement chain remains a material jurisdiction hold. The Uniform Rules body read was updated through July 2025, not certified through October 2026.
Provenance: Regular Chat with public-source browsing. No Pro, power-setting, quota-reset, measured-ranking or independent-review claim is made. No actual creditor, debtor, estate, trustee, account, property, registration, case or docket was investigated.
A creditor’s sequestration application requires three separate substantive gates:
At the provisional stage, §10 requires a prima facie case. At the final hearing, §12 requires the court to be satisfied on the record. The creditor-advantage element remains a reason-to-believe test; it is not transformed into certainty of a particular dividend. The court retains discretion. C_ZA-P18-C009, C030, C035, C038. Polity.org.za+1
The monetary gateway established is R100 for one petitioning creditor, or R200 in aggregate for two or more petitioning creditors, with liquidated claims against the same debtor. The enacted wording still appears in pounds—£50 and £100. The R100 figure is expressly confirmed by the SCA, and the historic statutory-currency conversion is £1 = R2. No inflation uplift or new threshold instrument is assumed. C004–C005. Supreme Court of Appeal+2
A creditor cannot use sequestration merely to bypass a genuine dispute about whether a debt exists. In Osborne, the SCA dismissed the appeal because the applicant had not established the claim against the respondent; the majority also held the alleged damages claim was unliquidated. A concurring judge agreed with dismissal but differed on the liquidation analysis. C007–C008. Supreme Court of Appeal+1
The actual final Constitutional Court opinion in Stratford was obtained as a court-issued judgment PDF on a public mirror. It confirms that domestic employees are included, distinguishes furnishing the initial application from serving the later rule nisi, and permits departure from notice compliance only in exceptional provisional-order circumstances—not as a general exemption. C025–C027. Polity.org.za+1
A provisional order is legally consequential, but it is not a final order or a discharge of debts. It must ordinarily be accompanied by a rule nisi giving the debtor an opportunity to oppose final sequestration. At the return hearing, inadequate proof can require dismissal and setting aside of the provisional order, or a reasonable adjournment for further proof—not indefinite postponement. C031–C036, C046–C048. Polity.org.za+2
The Act’s “debtor” definition includes a person or estate capable of sequestration but excludes bodies capable of liquidation under company law. The definition of a sequestration order includes an unrescinded provisional order. Those distinctions matter to immediate effects, but this pass does not extend its conclusions to companies, partnerships, deceased estates or joint estates. C002, C057.
The ordinary application belongs in the competent High Court, not the NCR, NCT or Magistrates’ Court administration process. The jurisdiction text read links the court to a debtor who:
The reproduced provision also permits refusal or postponement where another domestic or relevant foreign forum is equitable or convenient. Because the full current official §149 chain was not verified, this is a partial jurisdiction finding, not permission to file in any particular division. Citizenship, a creditor’s office address or a website’s location alone does not establish the required nexus. C003, C063. Acts Online+1
Section 9 permits a creditor or authorised agent to petition if the creditor has a qualifying liquidated claim. Two or more creditors may aggregate qualifying claims against the same debtor. A claim that has accrued but is not yet due is expressly included by §9(2); that is different from an unaccrued contingency or speculative future loss. C004–C005. Acts Online
The applicant must establish the debt’s legal and factual basis. A stated amount in a demand or affidavit is not automatically liquidated, admitted or owed. A secured creditor is not excluded merely because security exists, but the petition must disclose the security’s nature and value. Security for the underlying debt is separate from the Master-certified security for application costs. C006–C008, C020.
The distinction is not simply “invoice versus damages”:
Osborne is used narrowly: sequestration was not a substitute for establishing the disputed claim through an appropriate evidential process. Its trust-related facts do not supply natural-person eligibility or trust-ownership rules here. C007–C008, C056. Supreme Court of Appeal+1
Section 9 permits either route. It is not necessary to prove both, but the qualifying claim and creditor-advantage requirements remain.
| §8 branch | Statutory conduct to establish | What is insufficient by itself |
|---|---|---|
| §8(a) | Leaving, remaining outside or departing the relevant dwelling with intent to evade or delay payment | Travel or absence without the statutory intent |
| §8(b) | Following judgment, failure on the executing officer’s demand to satisfy or identify sufficient disposable property, or the specified insufficient-property return | An unpaid invoice or ordinary demand |
| §8(c) | Disposition or attempted disposition with the statutory prejudicial/preferential effect | Every ordinary asset sale |
| §8(d) | Removal or attempted removal of property with the specified prejudicial/preferential intent | Relocation without that intent |
| §8(e) | An arrangement or offer to creditors for release wholly or partly from debts | Every routine query, dispute or instalment request |
| §8(f) | Specified failures following a voluntary-surrender notice | Not researched beyond this cross-route boundary |
| §8(g) | Written notice to a creditor that the debtor cannot pay debts | A denial of liability or refusal to pay a disputed claim |
| §8(h) | The specified trader notice followed by inability to pay all debts | A generic business announcement |
The complete current official §8 consolidation was not recovered; the table is supported by the statutory reproduction and, for relevant branches, final judgments and amending legislation. C009–C015. Acts Online+2
Necessary linked qualification: Section 8A states that applying for NCA debt review is not itself an act of insolvency. It does not immunise a debtor from an actual-insolvency allegation or an independently established act. This provision was inserted by the 2014 amendment, not the held 2019 debt-intervention module. C016, C065. https://www.gov.za/sites/default/files/gcis_document/201409/37665gon389.pdf, Schedule, printed Gazette p32 / zero PDF P16. South African Government+1
An actual-insolvency case requires evidence of the debtor’s asset and liability position. Mere nonpayment, temporary illiquidity or an adverse credit record does not automatically establish it. Values, security, disputed claims and contingent liabilities must be addressed rather than assuming that every recorded balance or estimate is correct. C017.
The cost-assets test for voluntary surrender under §6 is not imported as a separate statutory element of the creditor’s §§10/12 case. Application security under §9 and evidence of advantage after costs still matter, but they are not the same test. C058. Polity.org.za+1
The text read requires:
If required identity particulars cannot be supplied, the applicant must explain why; the provision is not permission to invent them. The applicant, authorised agent and affidavit deponent can have different roles. The evidence must establish authority and the deponent’s basis for factual assertions. C018–C019. Acts Online+1
Section 9(3)(b) requires a Master’s certificate issued not more than ten days before the petition, confirming sufficient security for:
The Act does not supply one universal rand amount. It is not the creditor’s security over the debtor’s property, nor a minimum dividend or estate-value threshold. C020. South African Government+1
Section 13 correction: Section 13 concerns partnership estates and associated partner-estate costs. It is not the ordinary natural-person applicant-security provision. Section 14 separately governs the petitioning creditor’s prosecution and cost exposure. C043–C044. Acts Online+1
Before presentation to court, copies of the petition and verifying affidavits must be lodged with the Master or the statutorily designated officer where applicable. The Master may report facts supporting postponement or dismissal; the report goes to the applicant or agent, who may respond by further affidavit. The court considers that material.
This is not a requirement that the Master grant the sequestration order. The court decides the application. C021, C023. Acts Online
When the petition is presented, the applicant must furnish it to:
| Recipient | Required qualification |
|---|---|
| Registered trade union | Every union that, so far as reasonably ascertainable, represents any employees |
| Employees | Effective access through the statutory method or another effective method consistent with Stratford |
| SARS | Separate mandatory recipient |
| Debtor | Unless the court dispenses with furnishing in the debtor’s or creditors’ interests |
Before or during the hearing, the applicant must file an affidavit from the person who actually furnished the petition, explaining compliance. An applicant’s assertion that “service was arranged” is not the same evidence. C022–C024. Polity.org.za+1
The final unanimous Constitutional Court judgment—not a pre-hearing summary—establishes that domestic employees are included. Furnishing is mandatory, while the method is directed at effective accessibility; it is distinct from serving the subsequent rule nisi. Exceptionally, urgent provisional relief may still be justified despite a notice defect, for example to prevent serious creditor prejudice through concealed assets. That is not a blanket permission to omit notices. C025–C027.
The case upheld the sequestration result while making the employee-protection declaration and addressing transitional cases. Its fact-specific finding about the method used there is not a universal approved service method. https://www.polity.org.za/attachment.php?aa_id=52923, paragraphs 37–42, printed pp18–21 / zero P17–P20. Polity.org.za+1
The official Uniform Rules body read requires application by notice of motion supported by affidavit. For an ordinary opposed application, the version read specifies:
Rule 1’s “court day” excludes Saturdays, Sundays and public holidays. That rules definition is not automatically transplanted to every unqualified period in the Insolvency Act. Rule 6 also permits oral evidence or trial directions for material factual disputes. C028–C029, C037. Justice+4
These are the rules in the compilation actually read, not a filing-ready October 2026 timetable. Urgency, the order, local directives, electronic filing and later amendments must be checked separately. A rule nisi’s return date is the date specified by the court.
A creditor’s application is not governed simply by copying the voluntary-surrender Gazette/newspaper 14–30-day procedure. Sections 9 and 11 have their own furnishing and service rules. Gazette publication appears in §11(2) as one possible court-authorised alternative for a debtor absent for the specified period; it is not a universal substitute for ordinary service. C033. Polity.org.za
| Stage | Statutory standard | Court’s options |
|---|---|---|
| §10 provisional | Prima facie qualifying claim; act of insolvency or actual insolvency; reason to believe creditor advantage | May grant a provisional order; provisional relief is not compulsory |
| §11 rule nisi | Provisional order must be accompanied by an opportunity to show cause on the court-set return date | Service, opposition and possible anticipation of the return date |
| §12 final | Court must be satisfied of the qualifying claim, insolvency alternative and reason to believe advantage | May make final order |
| §12(2) insufficient final proof | Court not satisfied on the record | Dismiss and set aside provisional order, or require further proof and postpone for a reasonable period—not indefinitely |
C030–C039. Polity.org.za+1
The SCA’s 2025 Van Rooyen decision confirms the importance of a genuine provisional stage rather than treating it as a final determination. Its respondent was a trust; P18 uses the procedural holding only, not trust-eligibility or ownership conclusions. C056. Supreme Court of Appeal
Section 11 requires the court to grant the rule nisi simultaneously with the provisional order. It calls upon the debtor to show cause why final sequestration should not follow.
A copy must also be served on the relevant union, employees and SARS. The sheriff must establish employee union representation and the existence of an accessible noticeboard for the service task. These are distinct from the initial §9(4A) furnishing affidavit. C031–C032. Polity.org.za
If the debtor has been absent for 21 days from the specified usual residence and business within South Africa, the court may authorise the §11(2) alternative method or another method. Twenty-one days is an absence predicate, not a universal return-day interval.
The debtor may apply to anticipate the return day for discharge of the provisional order after 24 hours’ notice to the petitioning creditor. The court must still decide that application. C033–C034. Polity.org.za
The applicant carries the evidentiary burden. Stratford treats advantage as a reasonable, non-remote prospect of pecuniary benefit, potentially including properly evidenced recoveries through insolvency investigation. A wish that “the trustee may find something” is not evidence.
The Court rejected a rigid cents-in-the-rand test in the hostile multi-creditor context. It did not create a universal rule that any positive spreadsheet percentage compels sequestration. Costs, proof of claims, recovery prospects and alternatives remain material. C038–C040. Polity.org.za
At the final stage, a creditor cannot simply repeat the prima facie application and disregard supported opposition. The court must deal with the evidence and genuine disputes. Uniform Rule 6(5)(g) permits directions for oral evidence or trial where appropriate; Osborne illustrates why disputed liability and speculative valuation can defeat the claim gateway. C007–C008, C037. Supreme Court of Appeal+2
Agreement between debtor and creditor does not replace proof of the statutory case. A cooperative application is not automatically unlawful, but fabricated debt, unsupported asset values, concealed arrangements or a proceeding pursued for an improper purpose can undermine it.
Section 15 permits the court, when satisfied that the petition is an abuse, malicious or vexatious, to allow the debtor to prove damage caused by presentation and award appropriate compensation. The text does not make prior dismissal of the petition an express prerequisite. It is not an automatic award whenever an application fails. C041–C042. Polity.org.za+1
A private settlement can affect the existence or amount of the applicant’s claim, but it does not automatically rescind a provisional court order or establish that all statutory issues have disappeared. Van Rooyen involved a settlement and later continuation of proceedings; it does not create a universal rule that settlement either guarantees or prevents sequestration. C045. Supreme Court of Appeal
Section 14 requires the petitioning creditor to prosecute at its own cost until a provisional trustee or trustee is appointed as specified. Reimbursement of taxed costs depends on available estate funds and the Act, and contribution exposure can remain. C044. https://www.acts.co.za/insolvency-act-1936/14__petitioning_creditor_to_prosecute_sequestration_proceedings_until_trustee_appointed Acts Online
Because the statutory definition includes a provisional sequestration order, consequential estate controls can arise before final confirmation. The text of §20 provides for vesting in the Master and then trustee, specified stays of civil proceedings and execution, and statutory exceptions.
Filing the petition alone is not that order. Nor does sequestration automatically discharge debt, release security, establish creditor priority or authorise the petitioning creditor to take assets privately. Full trustee powers, secured-realisation procedure and rehabilitation remain deferred. C046–C049. https://www.acts.co.za/insolvency-act-1936/20__effect_of_sequestration_on_insolvent_s_property Acts Online+1
These examples use invented facts. They are not court findings, current tariffs, valuations or actual deadlines.
| Stipulated claim | Calculation | Amount-gateway result |
|---|---|---|
| One creditor: R99.99 | R99.99 < R100 | Below single-creditor threshold |
| One creditor: R100 | R100 = R100 | Equality satisfies amount only |
| Two creditors: R60 and R140 | R60 + R140 = R200 | Aggregate amount satisfied |
| Two creditors: R60 and R139.99 | R60 + R139.99 = R199.99 | Below joint threshold |
Both joint claims must be qualifying claims against the same debtor. Passing the amount gate establishes neither insolvency nor creditor advantage. No rounding or inflation adjustment is used. C004–C005, C051.
Assume:
Calculation:
R300,000 − R25,000 = R275,000 net property proceeds
R275,000 − R220,000 = R55,000 surplus
R55,000 + R15,000 = R70,000 free residue
R70,000 − R35,000 = R35,000 possible concurrent distribution
R35,000 ÷ R350,000 × 100 = 10%
The 10% is only the result of stipulated assumptions. It does not establish the actual security allocation, costs, values, claim admission or statutory advantage. C038–C040, C052.
Keep the preceding assumptions except property realisation falls to R250,000:
R250,000 − R25,000 − R220,000 = R5,000 property surplus
R5,000 + R15,000 = R20,000 free residue
R20,000 − R35,000 = −R15,000 cost shortfall
There is no positive concurrent-distribution pool in that model. This is not a “negative dividend.” It exposes a funding/evidence deficiency. Properly evidenced recoveries or changed costs could alter the assessment; speculation cannot. C039, C053.
Let T be the petition date and C the certificate date.
Section 9(3)(b) requires the certificate to have been given not more than ten days before T.
The example assumes that age has already been computed correctly. It does not import the Uniform Rules’ court-day definition into the Act or resolve holidays, endpoint counting or receipt. The certificate must also actually certify sufficient security. C020, C054.
| Event | Source-based period | Limit |
|---|---|---|
| Ordinary notice of opposition | At least ten rule days allowed after service in the Rules version read | Urgent/court-order/local/currentness qualifications |
| Answering affidavit | Fifteen rule days after notice of opposition in the Rules version read | Applicable recess and procedural rules |
| Debtor seeks anticipation | Twenty-four hours’ notice to petitioning creditor under §11(3) | Court must grant the application |
| Rule nisi return | Date fixed in the actual order | No universal 21-day return period |
| §11(2) alternative service | Twenty-one-day absence predicate | Court authorisation required |
No actual calendar date is calculated. C028–C029, C031–C034, C055.
| No. | Assumed facts and actor | Gateway, required act and possible effect | Adverse alternative, clock and missing proof |
|---|---|---|---|
| 1 | One creditor alleges a fixed R20,000 loan against a natural person. | §9 amount may be satisfied if claim and standing are established. Insolvency alternative and advantage remain separate. C004–C009. | A disputed signature or payment defence can defeat the claim. Need agreement, ledger and authority. No automatic order. |
| 2 | Two creditors hold R60 and R140 liquidated claims against the same debtor. | Aggregate R200 meets the joint amount test. C004–C005, C051. | If one claim is contingent or against another debtor, aggregation fails. Need both causes of action and creditor participation/authority. |
| 3 | Invoice amount is fixed, but debtor produces evidence of full payment. | Liquidation of amount does not settle liability. A genuine dispute must be addressed. C007, C037. | Court may reject weak denials, require evidence or refuse final relief. Need payment and allocation records. |
| 4 | Creditor estimates R500,000 damages from alleged misconduct without an established amount. | An estimate does not automatically create a liquidated §9 claim. C008. | Damages may need ordinary proof. A separately established liquidated portion could require different analysis. |
| 5 | Debtor writes that they cannot pay their debts. | Potential §8(g) act; exact writing, author, context and delivery must be proved. C014. | “I dispute this invoice” is different. Claim and advantage still required; no insolvency admission is invented. |
| 6 | No §8 act is alleged, but reliable liabilities exceed properly assessed assets. | Actual insolvency is the alternative route. C009, C017. | Unsupported valuations or disputed liabilities may change the balance. Mere missed payment is insufficient. |
| 7 | Applicant furnishes debtor but omits a domestic employee, known union and SARS. | §9(4A) recipients are separate; Stratford includes domestic employees. C022–C027. | Exceptional urgent provisional relief is not a routine cure. Need evidence of effective furnishing and any court dispensation. |
| 8 | Applicant says “service arranged,” but no return or furnisher affidavit is available. | Applicant must distinguish initial furnishing from rule-nisi service and prove the relevant steps. C024, C028, C032. | Debtor-notice dispensation requires court authority. Need actual documents, method and dates. |
| 9 | Applicant knows of no assets and says an inquiry “might find something.” | Investigation can support advantage only on a grounded, non-remote prospect. C038–C040. | A bare hope fails to supply evidence. Need identified transactions, leads or recoveries, not invented assets. |
| 10 | Claimed 10% dividend relies on a high property valuation and ignores sale costs. | Model must account for security, distinct costs and credible realisation values. C052–C053. | Downside may eliminate distribution. Positive arithmetic alone never establishes advantage. |
| 11 | Provisional order was granted; by return date supported evidence undermines the claim or advantage. | Court applies §12 to the full record and may dismiss/set aside or seek further proof for a reasonable period. C035–C039. | Provisional findings are not conclusive. Need current evidence and the actual return date. |
| 12 | Debtor and a cooperative creditor manufacture a debt or inflate asset values to procure an order. | Consent does not replace proof; §15 may permit proven damages for abusive, malicious or vexatious presentation. C041–C042. | Cooperation alone is not illegality. Need actual agreement, genuine claim, valuation and purpose. |
| 13 | Debtor’s only known connection is citizenship; current residence, domicile, business and property are unknown. | Court jurisdiction is not established by that fact alone. C003, C063. | Current official §149 and actual connecting facts are required. No division chosen. |
| 14 | Creditor and debtor sign a payment settlement after provisional sequestration. | Settlement may alter the claim but does not itself set aside the court order. C045–C048. | Breach, performance, other creditors and order status matter. Court-controlled variation/discharge must be established separately. |

Final P18 disposition: The creditor-initiated natural-person sequestration portion of P05 D09 moves from wholly deferred to partial substantive national coverage. The core statutory gates, provisional/final distinction, actual Stratford notice holding, contested-claim boundary and public consequences are supported. Full current consolidation, jurisdiction, local procedure, actual facts and all parent/country/A066/A097/A098 acceptance remain held.
