S_NE PASS-22 — bounded PASS-19 procedure and source-precision corrections
Actual fresh check: October 26, 2026 Pacific / October 26, 2026 UTC
Status: Same-coordinator bounded correction; not independent review. PASS-19 remains immutable. Only the affected sections, claims, source annotations, matrix rows, and coverage classifications below are replaced or qualified. PASS-21 was completed before this response.
Disposition of the three correction groups
| Group |
Disposition |
Effect on PASS-19 |
| 1. Nonweekly Nebraska rule and rounding edge |
Common nonweekly periods answered; uncommon periods and legal rounding convention remain partial. The complete one-page Nebraska Department of Labor rule was visually read. It prescribes 60, 65, and 130 times the federal minimum wage for biweekly, semimonthly, and monthly pay periods. |
Replace PASS-19 §C3 and change “Other pay periods” from fully answered to partial. Preserve the core lesser-of formulas and all 13 original examples. |
| 2. Twenty-day trigger and mandatory continuing-lien language |
Answered for the unsatisfactory-answer branch. The 20 days run from filing of the garnishee’s interrogatory answers. The separate court-order-noncompliance trigger remains unresolved. Section 25-1056(2) uses mandatory “shall” language once all listed predicates exist. |
Replace C030, C021, §F3, the corresponding master-matrix rows, and their coverage rows. |
| 3. Source versions and limited outcome annotations |
Answered with explicit source limitations. The CC 3:8N public PDF has conflicting text-layer and rendered-page revision indicators; Florence Lake’s disclosure discussion and actual ERISA outcome are now precisely separated; the CCPA body is verified from the official 2024 U.S. Code edition, but the prior claimed OLRC 119-124 header was not replicated. |
Replace the CC 3:8N form annotation, Florence Lake pinpoint/outcome annotation, P19 S010 currentness statement, and qualify C037’s payment-plan/stay wording. |
GROUP 1 — Nebraska nonweekly pay-period rule and rounding qualification
1A. Replacement for PASS-19 §C3, “Current pay-period floors”
Neb. Rev. Stat. §25-1558(7) directs the Nebraska Commissioner of Labor to prescribe an equivalent federal-minimum-wage multiple for pay periods other than a week. The current Nebraska Department of Labor regulations index lists Title 230 — Labor Standards, Chapter 2 — Wages; Subject To Garnishment, and links to a one-page rule. The rule states:
- Biweekly: 60 times the federal minimum hourly wage.
- Semimonthly: 65 times the federal minimum hourly wage.
- Monthly: 130 times the federal minimum hourly wage.
The PDF states that it was adopted under §25-1558(7). It bears an Attorney General approval dated April 10, 1991, Governor approval dated May 17, 1991, and Secretary of State filing stamp dated May 17, 1991. It does not display a separate effective date, later amendment history, or superseding rulemaking order. Its inclusion in NDOL’s current public regulations index supports current publication status, but a complete rulemaking-history audit was not performed. Nebraska Department of Labor+2
At the presently verified federal minimum wage of $7.25 per hour, the Nebraska regulatory floors are:
| Pay period |
Nebraska Title 230 multiplier |
Protected floor |
| Biweekly |
60 × $7.25 |
$435.00 |
| Semimonthly |
65 × $7.25 |
$471.25 |
| Monthly |
130 × $7.25 |
$942.50 |
The current federal minimum wage remains $7.25. Department of Labor+2
Correct combined Nebraska formulas
Let:
Plain text
D = disposable earnings for the pay period
F = Nebraska regulatory floor for that pay period
For a debtor who is not head of a family:
Plain text
Maximum ordinary withholding
= max(0, lesser of:
25% × D
D − F)
For a debtor who is head of a family:
Plain text
Maximum ordinary withholding
= max(0, lesser of:
25% × D
D − F
15% × D)
Because 15% is always less than 25%, the head-of-family formula can be expressed mathematically as:
Plain text
max(0, lesser of:
15% × D
D − F)
This is a synthesis of §25-1558(1) and (7) with Title 230, Chapter 2; it is not a separate sentence appearing verbatim in the regulation. Nebraska Legislature+1
The federal rule independently transforms the weekly formula for longer pay periods by using workweeks or fractions of workweeks and treats a month as 4⅓ workweeks. Its present biweekly, semimonthly, and monthly floors agree with Nebraska’s 60/65/130 multipliers. Federal §870.10 also says the date earnings are paid or payable controls the applicable federal minimum wage. eCFR+2
Remaining state-rule gap for uncommon pay periods
Nebraska Title 230, Chapter 2 expressly lists only:
- biweekly;
- semimonthly; and
- monthly pay periods.
It does not state a separate Nebraska multiplier for an irregular ten-day, quarterly, four-week, or other uncommon nonweekly pay period. Federal §870.10 supplies a federal workweek-or-fraction method for other longer pay periods, but no separate current Nebraska rule or controlling Nebraska opinion was located prescribing the state-law multiplier for every unlisted pay period.
Replacement coverage classification: common nonweekly periods are answered; unlisted Nebraska pay periods remain partial/unresolved.
1B. Narrow rounding and transition-point correction
The December 2024 DOL Fact Sheet #30 publishes these rounded transition figures:
- semimonthly: $628.33;
- monthly: $1,256.66.
Those are DOL’s published guidance figures, not fabricated amounts and not grounds to reject PASS-19’s 13 worked examples. Department of Labor+1
The exact mathematical crossing between the 25% branch and the amount-above-floor branch is:
Plain text
0.25D = D − F
0.75D = F
D = F ÷ 0.75
| Period |
Floor F |
Exact crossing F ÷ .75 |
Published DOL display |
| Semimonthly |
$471.25 |
$628.333333… |
$628.33 |
| Monthly |
$942.50 |
$1,256.666666… |
$1,256.66 |
Bounded monthly edge example
Assume:
Plain text
Monthly disposable earnings D = $1,256.66
Monthly floor F = $942.50
Calculations:
Plain text
25% branch:
$1,256.66 × .25 = $314.165
Amount-above-floor branch:
$1,256.66 − $942.50 = $314.16
Exact lesser amount:
lesser of $314.165 and $314.16 = $314.16
On those inputs, the mathematical ceiling is $314.16, not $314.17.
The same narrow issue appears at semimonthly disposable earnings of $628.33:
Plain text
25% branch:
$628.33 × .25 = $157.0825
Amount-above-floor branch:
$628.33 − $471.25 = $157.08
Exact lesser amount:
$157.08
No Nebraska statute, Title 230 clause, federal regulation, or official guidance located in this bounded pass prescribes a universal payroll rule for rounding a half-cent generated by one branch. The safe legal relationship is therefore:
The published rounded transition table does not displace the statutory lesser-of equation, and a withholding calculation should not exceed the lower branch on the actual disposable-earnings inputs.
This is a mathematical and source-precision clarification, not a new payroll-rounding rule.
Effect on original examples
All 13 PASS-19 examples remain unchanged. None used the $1,256.66 monthly edge in a way that exceeded the lower branch.
GROUP 2 — twenty-day trigger and mandatory conditional wording
2A. Replacement for PASS-19 C030 and §F3
Correct unsatisfactory-answer trigger
When a creditor is dissatisfied with the garnishee’s interrogatory answers, the creditor’s application to determine garnishee liability must be filed within 20 days after the answers are filed with the court.
It does not run from:
- service of the answers on the creditor;
- the creditor’s actual receipt;
- the creditor’s discovery of the filing; or
- the date the garnishment summons was served.
In Huntington v. Pedersen, the Nebraska Supreme Court held that failing to apply within 20 days after the garnishee filed its answers produces the mandatory statutory result that the garnishee is released and discharged. The controlling discussion is at printed pages 305–306, zero-based PDF indices 11–12. Nebraska.gov+2
Complete replacement claim for original P19 C030
If the creditor is dissatisfied with a garnishee’s filed interrogatory answers, an application to determine garnishee liability must be filed within 20 days after those answers are filed. Failure to do so requires release and discharge of the garnishee in the affected garnishment-liability proceeding. The deadline does not wait for service or actual notice to the creditor.
Source: Neb. Rev. Stat. §25-1030; Huntington v. Pedersen, 294 Neb. 294, printed pp.305–306/PDF indices 11–12.
Limit: This correction does not establish universal immunity from a later, valid garnishment directed at different funds, property, or a later service-date obligation.
Separate court-order-noncompliance branch remains held
Section 25-1030 also applies where a garnishee fails to comply with a court order by:
- delivering property;
- paying money into court; or
- giving the undertaking required by §25-1029.
The statute says the creditor may file an application “within twenty days,” but it does not expressly identify whether that branch runs from:
- entry of the order;
- service of the order;
- the compliance date stated in the order;
- the first act of noncompliance; or
- another event.
Huntington decided the filed-answer branch. It did not resolve this separate trigger. The trigger for court-order noncompliance therefore remains unresolved. Nebraska Legislature+1
2B. Replacement master-matrix rows
| Stage |
Correct trigger |
Required action |
Consequence |
Qualification |
| Creditor challenges an unsatisfactory garnishee answer |
Filing of garnishee’s answers |
Application to determine liability within 20 days after filing |
Garnishee released and discharged if application is untimely |
No service or actual-notice trigger |
| Garnishee fails to comply with court delivery/payment/undertaking order |
Unresolved |
§25-1030 says an application must be filed within 20 days |
Untimely failure can result in discharge, but exact trigger is held |
Order, service, compliance date, and controlling interpretation needed |
| Continuing-lien transfer/order |
Qualifying answer + no successful written objection + creditor application |
Court shall order transfer of withheld nonexempt earnings; on creditor application, court shall further order continuing lien |
Mandatory conditional order |
No automatic lien without application, predicates, and court order |
2C. Replacement for original P19 C021
The prior “court may order” wording is replaced with:
If the garnishee’s answer shows that the debtor was employed, that earnings were owed when the garnishment order was served, or that earnings will be owed within 60 days; no successful written objection to the order or answer has been filed; and the judgment creditor applies, the court shall order transfer of the nonexempt earnings withheld after service. Upon the creditor’s application, the court shall further order a continuing lien.
The statute’s language is mandatory once every listed predicate is satisfied. It does not create an automatic lien upon service, employment, or filing of the employer’s answer alone. Nebraska Legislature
2D. Narrow replacement for original P19 C037
Neb. Rev. Stat. §25-1056(3)(d) makes a continuing lien invalid when the proceedings are stayed by a court of competent jurisdiction, including the U.S. Bankruptcy Court. Mere:
- negotiations;
- an administrative complaint;
- a payment request;
- a unilateral proposal; or
- informal discussion
does not itself establish that statutory court stay. Nebraska Legislature
A separate agreed payment plan or forbearance can impose contract-specific restrictions. The current Judicial Branch plaintiff and defendant packets state that payment plans should be written and filed with the court and that garnishment should not proceed while the debtor is performing under the plan. Those statements are operational guidance, not the text of §25-1056(3)(d). The actual agreement, authority, filing, conditions, missed-payment event, enforceability, and any court order remain record dependent. Nebraska Judicial Branch+3
GROUP 3 — source-version and opinion-outcome annotations
3A. CC 3:8N source-version replacement
The original PASS-19 observation that the rendered CC 3:8N form displayed Rev. 03/2022 remains historically accurate.
The fresh October 26, 2026 public-source check produced conflicting official-PDF indicators:
- the direct PDF’s parsed/accessibility text identified CC 3:8N Rev. 08/2026;
- the rendered page image returned through the same public PDF path displayed Rev. 03/2022;
- the current companion instructions, CC 3:8Na, display Rev. 08/2026;
- the current defendant packet displays Rev. 08/2026 and directs users to CC 3:8N and CC 3:8Na. Nebraska Judicial Branch+4
Replacement source annotation
CC 3:8N has inconsistent public rendering/version evidence as of October 26, 2026. The extracted text identifies Rev. 08/2026, while a rendered-page image surfaced Rev. 03/2022. Current CC 3:8Na instructions and the defendant packet are Rev. 08/2026. No precise file-replacement date is inferred. The form is operational guidance; §25-1011 and other controlling law govern.
No form was completed or submitted.
3B. Florence Lake Investments source and outcome replacement
The prior limited use of Florence Lake Investments v. Berg is clarified as follows.
At printed pages 197–198, zero-based PDF indices 14–15, the Nebraska Supreme Court majority explained that:
- garnishment is a postjudgment procedure;
- the garnishee must answer and disclose debtor property or credits within its possession or control;
- liability is measured at the time of service; and
- the judgment creditor can recover no more against the garnishee than the debtor could recover. Nebraska.gov+1
At printed page 204, zero-based PDF index 21, the majority held that ERISA’s anti-alienation provision prevented the judgment creditor from acquiring the debtor’s rights to the 401(k) funds. It therefore affirmed the ruling that the plan administrator was not liable under the facts. The majority simultaneously emphasized that ERISA plan administrators must comply with Nebraska’s interrogatory-answer requirement and that willful refusal could still be addressed through the court’s contempt power. The concurrence begins after the majority’s conclusion and is not the majority holding. Nebraska.gov
Replacement qualification
A statutory duty to answer and disclose is not itself a holding that the garnishee is liable for the disclosed property. Florence Lake affirmed no liability because ERISA prevented the creditor from acquiring rights to the plan funds, while preserving the administrator’s duty to answer.
This patch does not undertake a complete ERISA or retirement-benefit analysis.
3C. Federal CCPA source-currentness replacement
PASS-19 S010 previously identified six OLRC 119-124 pages for 15 U.S.C. §§1672–1677 as displaying currency through Public Law 119-124, October 15, 2026. That exact header was not replicated in the coordinator’s bounded checks, and the unchanged failed routes were not repeatedly retried in PASS-22.
The official accessible substitute was:
Plain text
https://www.govinfo.gov/link/uscode/15/1673
That two-page official GovInfo PDF contains the complete operative bodies of §§1671–1677 at:
- printed page 1550 / zero-based PDF index 0; and
- printed page 1551 / zero-based PDF index 1.
GovInfo’s content-details page identifies the material as the 2024 Edition of the United States Code, which it describes as the most recent edition available on that site. The PDF itself does not display a Public Law 119-124 / October 15, 2026 currency header. GovInfo+2
Replacement source-currentness annotation
The substantive bodies of 15 U.S.C. §§1672–1677 were verified from the official 2024 U.S. Code edition on GovInfo. Exact compilation currency through Public Law 119-124, October 15, 2026 was not independently replicated and remains held. No claim is made that the 2024 Edition proves the absence of later statutory amendments.
The current eCFR source is different. Title 29 stated that it was up to date through October 22, 2026 and last amended October 14, 2026. The complete material §870.10 body was checked there. That verifies the current regulatory text; it does not independently authenticate the unreplicated OLRC statutory-compilation header. eCFR
The DOL’s current public minimum-wage pages and December 2024 Fact Sheet #30 identify the federal minimum wage as $7.25, and the July 1, 2026 consolidated state table likewise treats $7.25 as the federal rate. Department of Labor+2
