S_NE PASS-34 — C032/S019 search-scope attribution correction
Date: October 26, 2026, Pacific / UTC
Scope: One source-attribution correction to PASS-32. No new substantive legal findings, searches, or claim IDs.
This correction relies exclusively on the supplied PASS-29/PASS-32 records. It does not rely on unreviewed PASS-33 findings or independently certify PASS-33's external saved-output status.
1. Replacement PASS-32 C032 crosslink row
The following replaces the entire existing C032 row in PASS-32's 33-claim source-crosslink table.
| Existing claim ID |
Correct existing source IDs |
Precise statutory basis and read extent |
Retained conclusion and limits |
| S_NE-P29-C032 |
S_NE-P29-S001; S_NE-P29-S002; S_NE-P29-S003; S_NE-P29-S004 |
Previously reviewed Nebraska Collection Agency Act statutory text: §45-601 licensing/offense; §45-602(2)–(3) definitions/exclusions; §45-608 bond and qualifying claims; §§45-612–45-617 licensing discipline, administrative complaints, hearings and appeals. These are dated P26/P29 statutory readings, not a newly performed private-action search. |
Preserve C032: “A Collection Agency Act violation still does not expressly create automatic private damages, debt cancellation, dismissal, or judgment invalidity.” This remains a bounded statutory-text conclusion, not a controlling judicial holding that no implied private action could exist. Implied private-action availability remains unresolved. No general/private-action negative search is attributed to these sources or to S019. |
Relevant original primary-source locators include:
https://nebraskalegislature.gov/laws/statutes.php?statute=45-601
https://nebraskalegislature.gov/laws/statutes.php?statute=45-602
https://nebraskalegislature.gov/laws/statutes.php?statute=45-608
https://nebraskalegislature.gov/laws/statutes.php?statute=45-612
https://nebraskalegislature.gov/laws/statutes.php?statute=45-615
No new reading of those statutes is claimed in PASS-34.
2. S_NE-P29-S019 — correct original search scope
Preserve the original S_NE-P29-S019 record unchanged.
Its actual documented scope was limited to:
- §45-601 criminal culpability and the unresolved mental-state construction; and
- the current Nebraska malicious-prosecution limitations period.
Its original bounded searches used:
https://www.nebraska.gov/apps-courts-epub/
https://nebraskalegislature.gov/laws/statutes.php?statute=45-601
That record does not document a search for a general or implied private cause of action under the Collection Agency Act.
Accordingly, S019 remains a properly scoped historical search source for:
- S_NE-P29-C001: unresolved §45-601 culpability construction.
- S_NE-P29-C031: unresolved modern malicious-prosecution limitation.
It is removed from C032's supporting source IDs. The phrase “bounded private-action search” is removed from C032's pinpoint/description cell.
No new private-action search is asserted, and no negative-search result is converted into proof of statutory nonexistence.
3. Coverage and effect matrix
| Requested issue |
Disposition |
Affected existing claims |
Exact remaining hold |
| C032 incorrectly attributed a private-action search to S019 |
Corrected — S019 removed from C032; unsupported search label removed |

Express statutory-text finding preserved; implied cause of action unresolved |
| Original S019 culpability-search role |
Preserved unchanged |
S_NE-P29-C001 |
Criminal mental-state construction unresolved |
| Original S019 malicious-prosecution-period search role |
Preserved unchanged |
S_NE-P29-C031 |
Current controlling limitation/accrual authority unresolved |
| Remaining PASS-32 crosslinks, source cells and coverage |
Unchanged |
C002–C030, C033 and all other unaffected entries |
All original qualifications and holds preserved |
4. Observer and currentness preservation
This is a source-mapping correction, not new statutory or appellate research.
The PASS-29 and PASS-32 accounts of actual source readings, currentness, reporter identities, McKinney majority/dissent pinpoints, and observer-specific access results remain unchanged.
In particular, the Title 433 clause/adoption/fee-status observations remain researcher-attributed and not independently replicated by the coordinator. The operative §1692n body remains supported through GovInfo, while the exact reported OLRC compilation header remains separately qualified.
All four PASS-29 correction examples, eleven original PASS-26 examples, and seven reviewed numerical calculations remain unchanged, including the expressly rejected automatic $1,600 NCPA enhanced award and $2,000 FDCPA two-letter award.
Self-check: One C032 crosslink row replaced; S019 historical record preserved; C001 and C031 search attribution maintained; no new claim IDs, statutory holdings, searches, calculations, private-record access or local-file writes.
No independent review, whole-component completion, Nebraska-state completion, parent/A066 acceptance, operational approval or publication readiness is claimed.
END S_NE PASS-34.
