This pass is limited to ordinary unsecured consumer-debt suits in Nebraska district court, regular county court, and Small Claims Court: court selection, jurisdiction, venue, real-party and representation rules, commencement, service, response timing, default entry, and bounded procedures for setting aside a default.
PASS-06 through PASS-11 remain saved but unreviewed. Their substantive contract, remedies, licensing, validation, reporting, and limitation conclusions are not accepted premises here. The narrow current §25-217 filing-and-service rules were freshly read to prevent a false “filing alone preserves the action” statement; this report does not determine whether any particular debt claim was substantively timely.
Mortgage foreclosure, vehicle deficiency, medical and public debts, landlord-tenant proceedings, probate claims, bankruptcy procedure, arbitration, complete standing and assignment proof, hearsay and authentication, postjudgment interest, judgment duration or renewal, liens, satisfaction, garnishment, exemptions, appellate procedure, and remedies remain separate required work.
Nebraska has three materially different ordinary civil routes:
For a regular county- or district-court action:
Initial service is not accomplished merely by emailing, texting, or electronically filing the complaint. Nebraska verifies personal service, residence service, certified mail, designated delivery, specified entity service, out-of-state methods, and court-authorized substitute or publication service. Email can be used for many later Rule 5 documents when the rule’s conditions are met, but not as an unrestricted substitute for the initial summons and complaint. (nebraskalegislature.gov)
A missed answer or hearing does not itself produce a money judgment. Since January 1, 2025, even a party who never appeared must be served with the motion for default judgment and notice of the hearing. The plaintiff must still establish the claim, and where proof, an accounting, or damages assessment is necessary, the court must receive evidence. In county court, default ordinarily requires a verified pleading, affidavits, or sworn testimony; a negotiable instrument relied upon must be surrendered to the court. (nebraskajudicial.gov)
Vacatur has separate branches:
| Route | Subject-matter and amount | Who may use it | Ordinary response structure | Important limits |
|---|---|---|---|---|
| Nebraska district court | General original jurisdiction unless law assigns the matter elsewhere | Real party in interest, qualifying assignee, or other statutorily authorized plaintiff | Written answer ordinarily due 30 days after service; ordinary pleading rules | Higher filing fee; entity ordinarily must appear through Nebraska counsel; full civil procedure applies |
| Regular county court | Concurrent civil jurisdiction through $70,000 from July 1, 2025 through June 30, 2030 | Real party in interest or qualifying assignee | Written answer ordinarily due 30 days after service | Claims shown to exceed jurisdiction may be transferred; regular evidentiary and pleading rules apply |
| Small Claims Court | $7,500 or less, exclusive of interest and costs | Only a party to the underlying transaction; no assigned claims | Hearing is set at filing; defendant appears at hearing; no ordinary answer unless case is transferred | Generally no attorney representation; no jury; no formal pleadings beyond claim, notice, and any setoff/counterclaim; filing frequency limits |
| Small claim transferred to regular county docket | Original claim may begin within small-claims limit; transfer can also follow excess counterclaim | Defendant or defendant’s attorney may transfer at least two days before hearing; excess counterclaim also transfers entire matter | Defendant must then file an answer | Transfer fee; ordinary county procedure follows, though pleading motions require court order upon showing |
| Federal court removal boundary | Federal-question jurisdiction or diversity with amount in controversy over $75,000 and complete diversity, subject to removal statutes | Defendant satisfying federal removal prerequisites | Federal procedure after valid removal | A federal defense or FDCPA counterclaim does not by itself make an ordinary state contract complaint removable |
District courts have general original jurisdiction. County-court civil jurisdiction is presently $70,000 or less. Small Claims Court is capped at $7,500 exclusive of interest and costs. Nebraska Legislature+2
Nebraska Small Claims Court permits individuals, partnerships, LLCs, corporations, unions, associations, and other organizations. An individual represents themself; a partnership may use a partner or employee; an LLC may use a member, manager, or employee; and a corporation may use an employee. That is a statutory small-claims exception to the ordinary rule requiring entities to appear through licensed counsel. (nebraskalegislature.gov)
Two limitations are especially important in purchased-debt cases:
An assignee or debt buyer may be able to sue in regular county or district court, but §25-2803 bars use of Small Claims Court for an assigned claim. The plaintiff also may not file more than two small claims in a calendar week or ten in a calendar year. (nebraskalegislature.gov)
Small claims is tried to the judge without a jury. Formal pleadings beyond the claim, notice, and any counterclaim or setoff are unnecessary, and the formal rules of evidence generally do not apply except for privileges. A setoff or counterclaim must be filed and delivered to the plaintiff at least two days before hearing; an excess counterclaim transfers the entire case to the regular county docket. (nebraskalegislature.gov)
A regular civil action must be prosecuted in the name of the real party in interest. The court may not dismiss immediately for a real-party defect; it must first allow a reasonable time for joinder or substitution. An assignee of a chose in action may sue in its own name, and an assignee holding a claim for collection may sue when the assignment is in writing. Nebraska authority requires proof of the written assignment by a preponderance of the evidence. Full account-level assignment proof and admissibility are deferred to the evidence component. (nebraskalegislature.gov)
These ordinary-assignment provisions do not override Small Claims Court’s specific ban on assigned claims.
Outside Small Claims Court’s statutory exception, an LLC, corporation, partnership, or comparable artificial entity ordinarily must act in court through a Nebraska-licensed attorney. In Steinhausen v. HomeServices of Nebraska, the Nebraska Supreme Court treated pleadings filed for an LLC by a nonlawyer as a nullity; the rule applied even to a single-member LLC. (nebraska.gov)
An individual may appear pro se. That permission does not authorize the individual to represent a separate corporation, LLC, trust, or another person.
For an ordinary contract action not governed by a more specific venue statute, venue is proper in:
Improper venue does not destroy subject-matter jurisdiction. On a timely defendant motion, the court must transfer the case to a proper county, and the receiving court may award reasonable transfer-related expenses and attorney fees. (nebraskalegislature.gov)
Small-claims venue is narrower in wording: where the defendant or the defendant’s agent resides or does business, or where the cause arose. (nebraskalegislature.gov)
When the plaintiff is a federal “debt collector” and the suit concerns a qualifying consumer debt, 15 U.S.C. §1692i generally requires a non-real-property debt action to be filed in the judicial district or similar legal entity where:
That federal provision does not create Nebraska jurisdiction or venue that otherwise does not exist. Debt-collector and consumer-debt status remain separate predicates. (uscode.house.gov)
Nebraska’s long-arm statute reaches enumerated Nebraska contacts and, through its catchall, extends to the limit of federal constitutional due process. Personal jurisdiction, subject-matter jurisdiction, and venue remain distinct. A defendant can waive personal-jurisdiction or service objections through a qualifying general appearance, but parties cannot create subject-matter jurisdiction by agreement or appearance. (nebraskalegislature.gov)
The Judicial Branch schedule effective July 1, 2026 shows:
| Filing route | Current listed court total | Important qualification |
|---|---|---|
| District-court civil filing | $144 | Service, publication, witness, copying, and other costs are separate |
| Regular county civil filing | $62–$82 | Varies by amount category |
| Small claim | $58 | Service cost is separate |
| Small-claim transfer to regular docket | $20 | Paid by transferring party |
A litigant unable to prepay fees, costs, or security may apply to proceed in forma pauperis under §§25-2301 through 25-2310. The current official application is DC 6:7.1, revised March 2025. Approval is a court determination, not automatic upon filing the form. (nebraskajudicial.gov)
An ordinary Nebraska civil action is commenced by filing the complaint in the proper court. The summons must direct the defendant to the action, identify the parties and plaintiff’s counsel or address, and notify the defendant that an appropriate written response must be filed within 30 days after service or judgment may follow. A copy of the complaint is served with the summons except in publication service. (nebraskalegislature.gov)
The plaintiff files a praecipe identifying the defendant, address, and requested service method. Separate or additional summonses may be issued on written request. Nebraska does not supply a separate ordinary “summons expires in X days” provision; the decisive outer requirement is that each defendant be properly served within §25-217’s 180-day period. (nebraskalegislature.gov)
Each named defendant must be properly served within 180 days after filing. If the action is stayed during that period, the statute generally permits service within 90 days after the stay allows the action to proceed.
Failure has a self-executing result:
Plain text
Complaint filed
↓
180-day service period runs
↓
No proper service by end of period
↓
Action automatically dismissed without prejudice
on the following day
The dismissal is automatic even without a defendant motion or court order. (nebraskalegislature.gov)
“Without prejudice” does not guarantee refiling. Nebraska’s savings clause expressly excludes an action that failed because the plaintiff did not serve the defendant within §25-217’s time. If the underlying limitation period has expired, a new action may be barred. This pass does not adopt PASS-11’s debt-specific limitation classifications or compute any actual claim deadline. (nebraskalegislature.gov)
| Method or person served | Authorized actor and required steps | When service is complete | Proof and principal limits |
|---|---|---|---|
| Personal service on adult individual | Sheriff, qualifying bonded process server, another authorized person, or specially appointed nonparty leaves summons with defendant | On delivery | Complaint accompanies summons |
| Residence service | Summons left at defendant’s usual residence with a resident of suitable age and discretion | On qualifying delivery | Actual “usual place” and resident status matter |
| Certified mail | Plaintiff or plaintiff’s attorney sends within 10 days after summons issuance, return receipt requested | On qualifying delivery shown by receipt | Proof with signed receipt filed within 10 days after receipt is received or electronically available |
| Designated delivery service | Plaintiff or attorney sends within 10 days and obtains signed delivery receipt | Delivery date on receipt | Service provider must qualify under federal designation |
| Corporation | Serve officer, director, managing agent, registered agent, employee at registered office, or certified/designated delivery to registered office | On qualifying delivery | Actual corporate status and recipient role matter |
| Individual under 14 | Serve adult parent, guardian, or caregiver with whom minor resides; if none found, personal service on minor | On qualifying statutory service | Defense must later be through appointed guardian for suit |
| Incapacitated or institutionalized individual | Serve individual by available method; notify guardian, conservator, or institutional official | Under ordinary service method | Statute says failure of the additional notice does not invalidate service on the incapacitated person |
| Out-of-state defendant | Nebraska method, law of place of service, letter rogatory, or court-directed method | Under governing authorized method | Must be reasonably calculated to give actual notice; proof must satisfy statute/order/place law |
| Court-authorized substitute service | Motion and affidavit showing ordinary statutory methods cannot be completed with reasonable diligence | As court order specifies | Court may authorize residence posting plus first-class mail, publication, or another reasonably calculated method |
| Publication | Court-authorized publication once each week for three successive weeks; known interested parties also mailed notice where required | Not until third publication | Mail copy within 5 days after first publication; affidavit within 10 days after mailing |
| Voluntary appearance | Defendant invokes court power beyond objections to personal jurisdiction, process, or service | Equivalent to service | Broad requests can waive service objections |
| Ordinary email or text of summons | Not independently authorized as ordinary initial service | Not valid merely because sent or received | Could become valid only if a court authorizes it as substitute service under §25-517.02 |
| Electronic court filing | Filing through authorized system | Files document with court | Does not itself serve initial summons and complaint |
Except for certified mail or designated delivery, service is ordinarily made by:
Certified-mail and designated-delivery service are made by the plaintiff or plaintiff’s attorney. (nebraskalegislature.gov)
A statutory private process server must be at least 21, not a party or relative of a party, have no interest in the action, not be a disqualified county official, and furnish a $15,000 corporate surety bond. Proof is by affidavit. The taxable service cost is capped at the lesser of actual cost or the statutory sheriff’s fee. (nebraskalegislature.gov)
Personal service leaves the summons with the defendant. Residence service leaves it at the defendant’s usual place of residence with a resident of suitable age and discretion. The actual address, whether it was the usual residence, and whether the recipient lived there are legal facts—not assumptions from a mailing database. (nebraskalegislature.gov)
Certified mail or designated delivery must be sent within ten days after issuance. The receipt must show to whom and where the documents were delivered and the delivery date. Proof must be filed within ten days after the signed receipt is received or becomes electronically available. Delay in filing proof does not itself invalidate otherwise valid service. (nebraskalegislature.gov)
Nebraska’s statute does not invariably require the addressee personally to sign the receipt, but due process still requires notice reasonably calculated to reach the defendant. Service at a workplace signed by an unauthorized employee and never received by the individual was held defective in the officially annotated Anthony K. decision. Conversely, the facts in Capital One Bank v. Lehmann supported valid certified-mail service despite a third-party household signature. The identity and relationship of the signer, address used, and actual delivery path matter. (nebraskalegislature.gov)
A corporation may be served on an officer, director, managing agent, or registered agent; by leaving process at the registered office with an employee; or by certified mail or designated delivery to the registered office. Service on an unrelated employee or an address that is not the registered office is not validated merely because the recipient works for an affiliated business. (nebraskalegislature.gov)
The exact service provisions for LLCs, partnerships, government entities, and other organizations require their corresponding statutes and entity facts. Those were not exhaustively reproduced here.
A person under 14 is ordinarily served through an adult parent, guardian, or caregiver with whom the minor resides; if none can be found, personal service on the minor is permitted. Once served, the minor’s defense must be conducted through a guardian for the suit, appointed after service. (nebraskalegislature.gov)
For an incapacitated person with a guardian or conservator, or someone confined in an institution, additional notice is given to the representative or institutional official. The statute states that failure to give that additional notice does not invalidate service on the incapacitated person, although default and due-process questions can still be fact-sensitive. (nebraskalegislature.gov)
Substitute service requires:
The court may authorize:
A party cannot unilaterally switch to substitute service, and certified mail cannot be substituted for the first-class mailing specified in the residence-posting branch. (nebraskalegislature.gov)
The Judicial Branch released forms CC 6:6.5, CC 6:6.6, and CC 6:6.7 in December 2025 for the motion, supporting affidavit, and proposed order. The forms facilitate the application; they do not guarantee that reasonable diligence or the proposed method will be approved. (nebraskajudicial.gov)
Publication is once each week for three successive weeks. Service is not complete until the third publication. When names and mailing addresses of parties with a direct legal interest are known, the initiating party generally must mail the published notice within five days after the first publication and file the mailing affidavit within ten days after mailing. (nebraskalegislature.gov)
The regular 30-day answer period begins after completion of publication service. The summons or published notice may specify the resulting answer date consistently with the governing rules.
When Nebraska law authorizes jurisdiction, out-of-state service may use:
The method must be reasonably calculated to give actual notice. Proof follows Nebraska law, the court order, or the law of the service location. (nebraskalegislature.gov)
A voluntary appearance is equivalent to service. A defendant preserves personal-jurisdiction, process, and service objections through the pleading procedures. But asking the court for affirmative relief on another subject can create a general appearance and waive those objections. Merely filing an appearance of counsel that seeks no general relief is not necessarily a waiver. (nebraskalegislature.gov)
No separate universal, court-approved ordinary-debt “waiver of summons” form was located in this pass. The verified Nebraska mechanism is the voluntary-appearance doctrine, with significant waiver consequences.
Nebraska permits email service for many documents after the original complaint when the person has supplied an email address under the applicable rule. That service is ineffective if the sender learns the document did not reach the recipient. It does not make email a standard method for initial process. (nebraskajudicial.gov)
A court could authorize email, text, social-media delivery, or another electronic method under §25-517.02 only after the required diligence showing and court order. Actual wording, account ownership, ability to receive, and the order’s conditions would control.
A defendant must serve an answer within 30 days after being served with the summons and complaint, or within 30 days after completion of publication service. The summons itself carries the same 30-day warning. (nebraskajudicial.gov)
An answer must admit or deny the complaint’s allegations and state defenses. An allegation other than the amount of damages is generally admitted if a responsive pleading is required and the defendant does not deny it. Affirmative defenses—including payment, release, arbitration, illegality, statute of frauds, and statute of limitations—must be affirmatively stated. (nebraskajudicial.gov)
The official CC 3:18 Answer and General Denial form provides a basic general denial and certificate of service. Its simplicity does not determine whether a specific affirmative defense, counterclaim, jurisdictional objection, or particularized admission is required in an actual case. (nebraskajudicial.gov)
A timely motion under §6-1112 changes the answer deadline:
A motion alters the answer deadline only if it is a qualifying, timely motion under the rule. A letter to the plaintiff, settlement call, administrative complaint, CRA dispute, furnisher dispute, FDCPA validation request, payment proposal, or ordinary motion not covered by §6-1112 does not automatically extend the answer date. (nebraskajudicial.gov)
Personal-jurisdiction, process, and service defenses can be waived if omitted from the first Rule 12 motion or responsive pleading as the rule requires. Subject-matter jurisdiction is different and cannot be conferred through waiver.
For deadlines set by court rule, the court may extend time for good cause if requested before expiration or, after expiration, on a showing of excusable neglect. A court may not extend a statutory deadline unless the statute permits it. (nebraskajudicial.gov)
A pending settlement negotiation is not itself a court order extending time.
The answer is filed with the court and served on the opposing party or opposing counsel under §6-1105. The CC 3:18 form includes a certificate for first-class-mail service. Electronic filing and service rules may apply depending on the party, representation, and court-authorized system.
Providing an answer only to the plaintiff without filing it with the court does not complete the filing obligation. Filing only with the court without required service on the opposing party does not complete the service obligation.
Small Claims Court does not use the ordinary 30-day answer structure. Filing the claim produces a hearing date, and the defendant receives the complaint and summons at least five days before hearing. The principal response is appearing at the scheduled hearing. (nebraskalegislature.gov)
A defendant may:
After transfer, an answer is required. The official transfer form is CC 4:3. (nebraskajudicial.gov)
A negotiation with the small-claims plaintiff does not continue the hearing unless the court changes the date or the case is formally dismissed or resolved.
Nebraska excludes the triggering day and includes the final day. If the final day falls on Saturday, Sunday, a listed court holiday, or a day when the court office is closed by order, the deadline extends to the next day the court office is open. (nebraskalegislature.gov)
This rule applies to the regular 30-day answer calculation unless another statute or rule supplies a different computation.
Three additional days apply when a party must act after being served with a later document by mail under §6-1105(b)(3)(C). The three days are added after the original period is calculated. (nebraskajudicial.gov)
That rule does not add three days to the initial 30-day answer period merely because the summons and complaint arrived by certified mail. The initial answer period runs from service under §6-1112 and the summons statutes.
An electronically transmitted document received by the court-authorized system by 11:59:59 p.m. local time where the court is located is deemed filed that date. For county and district court, the court’s location is the county seat of the county where the action is filed. (nebraskajudicial.gov)
Electronic filing does not enlarge a deadline, cure defective initial service, or authorize filing after midnight in the user’s different timezone.
The court may enter a corrective order when filing failed because of an unknown transmission error involving the court-authorized provider or a clerk processing error. A statutory terminating deadline may be corrected only on clear and convincing proof that the failure resulted solely from that provider or clerk error.
If the authorized system is unavailable for more than 24 hours, paper or court fax filing may become available under the rule. A user’s own computer, internet, email, or scanner failure is expressly excluded from that outage provision. (nebraskajudicial.gov)
Failure to answer can put the defendant in default, but a money judgment still requires court action. The plaintiff must request default, serve the required papers, and establish the legal and factual basis for relief.
Since January 1, 2025, §6-1105 requires service on a nonappearing defaulting party of:
A pleading asserting a new claim against a defaulting party must be served like a summons. (nebraskajudicial.gov)
In county court, a default judgment may be entered only on a verified petition, affidavits, or sworn testimony establishing the claim. If the claim is based on a negotiable instrument, the original instrument must be surrendered. Nebraska Supreme Court
More generally, when an account, factual proof, or damages assessment is necessary, the court may take the account, hear proof, assess damages, refer the issue, or direct a jury assessment. Damages allegations are not automatically admitted through failure to deny. (nebraskalegislature.gov)
The summons and complaint also limit default relief:
Full substantive proof of contract, ownership, account records, interest, fees, assignment, and hearsay foundations remains for the evidence pass.
A defendant who has appeared is entitled to the procedural notices applicable to later documents. The current rule now also requires default-motion and hearing notice even when the defendant never appeared.
An informal call to plaintiff’s counsel does not necessarily constitute a court appearance. A filed pleading, motion, or other request invoking court power can.
Before entering default against a nonappearing defendant, the court must require an affidavit stating whether the defendant is in military service and supporting facts, or explaining why military status could not be determined.
If the defendant is in military service:
The SCRA procedure does not establish that every veteran, reservist, or household member qualifies. (uscode.house.gov)
A minor’s defense must be through a guardian for the suit appointed after service. A default against a minor or a person of unsound mind can also implicate §25-2001(4)(d) where the condition did not appear in the record. (nebraskalegislature.gov)
| Disposition | Essential distinction |
|---|---|
| Default judgment | Defendant failed to plead or appear as required; plaintiff still obtains court judgment after procedural and proof requirements |
| Dismissal | Ends the plaintiff’s action, with or without prejudice depending on authority |
| Settlement | Parties agree to resolve the dispute; no judgment necessarily results |
| Consent judgment | Parties consent to entry of a judgment with its own terms and consequences |
| Judgment on the pleadings | Court decides based on pleadings after responsive pleadings have closed |
| Summary judgment | Court considers admissible evidence and determines no genuine dispute requires trial |
| Small-claims nonappearance judgment | Hearing-based default under Small Claims Act, followed by its appeal/new-trial/vacatur routes |
No seizure, garnishment, lien, or other asset enforcement occurs merely because an answer was late. Those require a judgment and separate postjudgment procedures.
| Branch | Timing | Required showing or procedure | Principal consequence |
|---|---|---|---|
| Void judgment—no personal jurisdiction | Can be attacked at any time | Establish lack of valid service or appearance and resulting lack of personal jurisdiction | Court must vacate void judgment; ordinary discretionary meritorious-defense prerequisite does not control in the same way |
| Same-term inherent power | During court term | Prompt application and a meritorious defense; court balances decision on merits and judicial efficiency | Discretionary relief on reasonable terms |
| §25-2001(1) motion | Motion filed within 6 months after entry | Same grounds as inherent term power; promptness and meritorious defense generally relevant | Timely motion preserves power even if decided after term or after six months |
| Clerical correction | Any time | True clerical mistake or oversight | Nunc pro tunc correction; cannot replace substantive reconsideration |
| After-term statutory grounds | Within 2 years after entry for listed §25-2001(4) grounds | New complaint identifying judgment, ground, and defense; summons served as new action; valid defense established | Court may vacate or modify |
| Equitable action | Not limited by §25-2001 text | Independent equitable predicates | Fact- and remedy-specific; not a catchall substitute for neglected statutory procedures |
| Small-claims new trial | Motion filed 10 days or less after entry | Grounds under referenced new-trial statutes; official CC 4:9 form available | Court may act without hearing |
| Small-claims later vacatur | More than 10 days after default | §25-2720.01 applies district-court vacatur powers to county/small claims | Uses corresponding §25-2001 framework |
| SCRA reopening | During military service or qualifying period after service | Material effect of military service plus meritorious or legal defense | Separate federal relief branch |
A judgment entered without personal jurisdiction is void. Every court has inherent power to vacate such a judgment during or after the term. In Capital One Bank v. Lehmann, the Nebraska Court of Appeals stated that a void judgment may be attacked at any time, but ultimately concluded that certified-mail service was valid on the specific household-delivery facts. The case does not make every third-party signature valid. (nebraska.gov)
A voidness challenge is different from asking the court to excuse a late answer despite valid service. The former contests personal jurisdiction; the latter invokes discretionary vacatur.
Nebraska courts favor decisions on the merits, but default relief is not automatic. Applied Underwriters v. Oceanside Laundry restates the rule that when a default judgment has been entered and a prompt same-term application is made with an answer or other proof disclosing a meritorious defense, the court should ordinarily set the judgment aside on reasonable terms. A “meritorious defense” need not be proven to final victory, but it must be nonfrivolous and worthy of judicial inquiry. (nebraska.gov)
Promptness, explanation for the default, prejudice, and the proposed defense are all relevant to discretion. A bare statement that “I disagree” is not necessarily enough.
Section 25-2001(1) permits the district court’s inherent term power to be exercised after term when the motion is filed within six months after judgment entry. In Hawk v. Hawk, the Nebraska Supreme Court held that timely filing within six months preserves that power even if the court rules after the term or after the six-month anniversary. (nebraska.gov)
District-court terms are fixed annually by district judges; they should not be assumed to match the calendar year. County court is statutorily treated as having a regular term beginning January 1 for this purpose. (nebraskalegislature.gov)
Section 25-2001(4) lists:
Proceedings on these grounds are commenced by a complaint, not merely a motion. The complaint must identify the judgment, ground, and defense; a summons issues and is served as in a new action. The applicant must establish a valid defense before the judgment is vacated. The proceeding generally must begin no later than two years after entry, subject to the disability rule stated in §25-2008. (nebraskalegislature.gov)
County court, including Small Claims Court, has the same set-aside, vacatur, and modification powers as district court insofar as applicable. (nebraskalegislature.gov)
For a Small Claims Court default:
Attorneys may represent parties for the purpose of filing the new-trial or vacatur motion, even though ordinary small-claims representation is otherwise restricted. (nebraskalegislature.gov)
A party contesting personal jurisdiction or service can waive that objection by simultaneously invoking the court’s power on unrelated merits matters. Herman v. Peter Tonn Enterprises confirms that a motion seeking relief beyond personal-jurisdiction issues can constitute a general appearance and corrects an overbroad aspect of the earlier Applied Underwriters statutory analysis. (nebraska.gov)
That does not mean a defendant can never combine arguments. It means the requested relief and sequence matter. This pass does not supply a sample vacatur motion.

The 2026 small-claims packets expressly state that costs and service fees can change and direct low-income litigants to the in forma pauperis application. (nebraskajudicial.gov)

Day 1 November 3

No three mailing days are added because the summons was personally served.
Facts

Actual send date assumed timely
Answer counting
Plain text
Service/delivery Friday, November 6
Trigger day excluded November 6
Day 30 Sunday, December 6
Weekend extension Monday, December 7
Conditional answer deadline: Monday, December 7, 2026.
The answer period runs from service/delivery, not from the mailing date. The three-day Rule 5 mail extension does not apply.
Facts
Counting
Plain text
Filing date excluded January 2
180th day Wednesday, July 1, 2026
Last day to complete proper service July 1
Automatic dismissal date Thursday, July 2
If service is not completed by July 1, the action is dismissed by operation of law on July 2. A later voluntary appearance cannot revive an already dismissed case, and the savings clause does not apply to this failure-to-serve branch.
Facts
Counting
Plain text
Notice day excluded December 10
21st day Thursday, December 31
Conditional answer deadline: Thursday, December 31, 2026.
A motion sent only to plaintiff’s counsel but not properly filed and served under the rules would not necessarily alter the deadline.
Facts
Result
Plain text
Court answer deadline remains December 2
Settlement discussion does not extend deadline
Administrative or bureau dispute does not extend deadline
Payment offer does not extend deadline
A private agreement may affect litigation only if it is enforceable and properly implemented; the court deadline does not move by assumption.
Facts
Result
Plain text
Actual awareness possible
Statutory initial service not established
30-day answer trigger not established
180-day service clock continues to run
Actual notice and valid service are different. A defendant’s later request for merits relief could create a voluntary appearance, but merely receiving or reading the email is not service.
Facts
Result
Service is complete when the court’s signed order says it is complete. Certified mail cannot be substituted for the ordered first-class mailing unless the court modifies the order.
Facts
Completion
Plain text
First publication November 4
Second publication November 11
Third publication November 18
Service complete November 18
30-day answer period begins after November 18
Under ordinary computation, the thirtieth day would be Friday, December 18, 2026. The result depends on the actual publication schedule, notice language, mailing, and court order.
Facts
Result
Plain text
Amount within $7,500 limit Yes
Notice interval 7 days
Minimum statutory notice 5 days
Ordinary written answer required No
Required response appear June 15
Transfer deadline at least 2 days before hearing
Counterclaim/setoff delivery at least 2 days before hearing
If the plaintiff is only an assignee, Small Claims Court is unavailable even though the amount is below $7,500.
Facts
Required sequence
Plain text
1. Plaintiff files default motion.
2. Motion and hearing notice are served on defendant.
3. Plaintiff supplies verified pleading, affidavit, or sworn evidence.
4. Court reviews claim, ownership, balance, and damages.
5. SCRA affidavit is supplied for a nonappearing defendant.
6. Court—not plaintiff—decides whether and for what amount judgment enters.
A late answer may create a default posture, but no judgment or asset seizure arises automatically.
Facts
Potential branch
If those facts establish that service did not comply with Nebraska law or due process and the court never obtained personal jurisdiction, the judgment is void and may be attacked at any time.
Different facts
If summons was delivered to the defendant’s residence and signed by a household member in circumstances reasonably calculated to give notice, Capital One demonstrates that the court may find service valid. The signer’s identity alone does not decide the issue.
Facts
Result
The judgment is not void. Relief is discretionary under §25-2001(1) and the same-term doctrine. Promptness and a meritorious defense are central.
Facts
Ten-day branch
Plain text
Entry day excluded June 1
Day 10 Thursday, June 11
A small-claims new-trial motion filed by June 11 is within the statutory ten-day branch, assuming no special court closure. After that period, the §25-2720.01/§25-2001 framework applies. The official CC 4:9 form addresses the new-trial route but does not cover every later voidness or statutory vacatur theory.
Facts
A defendant claims service was defective but files a motion asking the court both to:

The request for merits relief invokes powers beyond the personal-jurisdiction objection and can constitute a general appearance under Herman. That can waive service objections. This example does not determine the result of any particular motion; exact wording and sequence control.

PASS-06 through PASS-11 were not treated as reviewed or accepted premises. The current filing, service, answer, and vacatur statutes were freshly read. No prior conclusion about substantive limitations, contract validity, collector status, reporting, validation, assignment, or remedies was silently adopted.
The worked dates were recalculated independently:
The examples assume no special Chief Justice closure, local emergency order, or case-specific stay.
The public research did not establish:
These are bounded research gaps, not findings that no such authority or order exists.
Focused disposition: Nebraska’s regular civil route is complaint filing, proper service within 180 days, and a 30-day answer period. Small Claims Court is a separate hearing-driven forum with a $7,500 limit, no assigned claims, distinctive representation rules, and its own transfer/default procedure. Service must follow an authorized statute or court order; actual notice, email receipt, negotiation, bureau disputes, and payment discussions do not replace process or extend a court deadline. Default requires notice, evidence, and judicial action. Vacatur depends on the correct branch—voidness, same-term or six-month discretion, after-term statutory complaint, small-claims new trial, or SCRA—not on one universal “set aside default” rule.

A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Route · Subject-matter and amount · Who may use it · 5 data rows
