S_NE PASS-17 — Nebraska arbitration award-to-judgment, confirmation, vacatur, modification, appeal, and stay boundaries
Actual fresh research date: October 26, 2026, Pacific / October 26, 2026 UTC
Mode/model: Regular Chat; GPT-5.6 Sol Pro
Review status: Same-coordinator continuation, not independent review.
This pass is limited to the treatment of an arbitration award after issuance: award form and delivery, arbitrator correction, judicial confirmation, vacatur, modification or correction, conversion to judgment, limited appealability, and the necessary stay or security boundaries.
PASS-08 through PASS-12, PASS-14, PASS-15, and PASS-16 remain saved but unreviewed or awaiting coordinator review. Their new conclusions are not accepted premises. Necessary formation and jurisdiction points were freshly read only where they control postaward review.
Actual arbitration agreement, governing law, FAA-commerce facts, administrator and rule version, award, delivery record, notice, service, court, motion dates, assignment, account, and party status remain unknown.
Focused determination
Nebraska and federal award review use similar but noninterchangeable systems.
Under the Nebraska Uniform Arbitration Act:
- the award must be written, signed by the participating arbitrators, and delivered personally, by registered or certified mail, or by another method agreed by the parties;
- a party ordinarily has 20 days after delivery to ask the arbitrators to clarify or correct limited errors;
- an application to vacate or judicially modify or correct generally must be made within 90 days after delivery;
- the fraud, corruption, or undue-means branch instead permits application within 90 days after the ground was known or should have been known;
- confirmation is mandatory unless timely vacatur or modification grounds are urged;
- the court must confirm within 60 days after the confirmation application; and
- only a Nebraska district court is the statutory UAA “court.” Nebraska Legislature+5
Under the Federal Arbitration Act:
- §§10 and 11 contain the exclusive statutory vacatur and modification grounds;
- notice of a motion to vacate, modify, or correct must be served within three months after the award is filed or delivered;
- the statute has no separate fraud-discovery extension comparable to Nebraska’s UAA;
- §9 confirmation presupposes an agreement that judgment may be entered on the award;
- the court must confirm unless §§10 or 11 apply; and
- the FAA itself does not create federal subject-matter jurisdiction. A freestanding §§9–10 application needs an independent federal jurisdictional basis, while a federal court that already had original jurisdiction and stayed the underlying action under FAA §3 retains jurisdiction over the resulting postaward motions. U.S. Code+6
Judicial review is exceptionally narrow under either system. A court does not rehear the contract dispute, recalculate the debt because it believes the arbitrator made a better-or-worse choice, or vacate merely for an error of Nebraska or federal law. Nebraska rejects “manifest disregard” as an independent UAA ground, and the FAA’s §§10–11 categories are exclusive. An arbitrator’s serious legal error is still not enough if the arbitrator was arguably interpreting the parties’ agreement rather than abandoning it. Nebraska.gov+3
An arbitration award is not yet an ordinary Nebraska court judgment. Once a court confirms, modifies, or corrects it, judgment is entered and has the same force as another judgment. Confirmation does not itself cause garnishment, asset seizure, lien attachment, credit-report deletion, a consumer refund, license discipline, or satisfaction of the judgment. Those consequences require their own legal predicates and remain later components. Nebraska Legislature+1

B. Award issuance, form, delivery, and arbitrator correction
B1. Nebraska award requirements
Nebraska §25-2609 requires the award to be:
- in writing;
- signed by the arbitrators who join in the award; and
- delivered to each party personally, by registered or certified mail, or as provided in the agreement.
The award must be made within the time fixed by the arbitration agreement. If the agreement supplies no time, the court may order a deadline no later than 30 days after the hearing. The parties may extend the time in writing. A party waives an objection that the award was late unless it notifies the arbitrators before delivery of the award. Nebraska Legislature
A missing signature can be an imperfection in form rather than a merits defect when the panel decision is otherwise established. That does not mean every signature problem is immaterial; panel composition, who participated, and whether the defect affects the award’s substance remain relevant. Nebraska Legislature+1
B2. Nebraska arbitrator correction or clarification
Within 20 days after delivery, a party may apply to the arbitrators to:
- correct an evident miscalculation;
- correct an evident mistake in a person, thing, or property description;
- correct an imperfection in form not affecting the merits; or
- clarify the award.
Written notice must be given promptly to the opposing party, which has ten days from notice to submit objections. A court considering a pending confirmation, vacatur, or modification application may submit the award back to the arbitrators for this limited work. The corrected award remains subject to judicial review under §§25-2612 through 25-2614. Nebraska Legislature
Clarification is not an invitation to reopen the merits. Nebraska appellate authority treats remand for clarification as exceptional. If the award’s intent can be ascertained from the award and record, the court should interpret and confirm it rather than ask the arbitrator to decide the merits again. Remand is appropriate only where the ambiguity is so substantial that the award’s meaning or intent cannot be resolved. Nebraska.gov
B3. AAA Consumer Rules, if actually incorporated
The current AAA Consumer Arbitration Rules are amended and effective May 1, 2025. They provide:
- an award ordinarily within 30 calendar days after hearing closure, or 14 days in a documents-only proceeding, absent party agreement, law, or unusual circumstances;
- a written award signed by a majority of the arbitrators, including electronic or digital signatures;
- a brief written explanation unless all parties agree otherwise;
- delivery through the same communications method AAA used during the case, including electronic transmission where permitted; and
- a 20-calendar-day request period for clerical, typographical, technical, computational correction, or clarification, with no power to redetermine the merits and ten days for opposition.
If applicable law provides another procedural period, AAA R-49 says the applicable-law procedure controls. These are private rules, not Nebraska statutes, and apply only if the actual contract and AAA administration make them operative. American Arbitration Association+2
B4. JAMS rules, if actually incorporated
The JAMS Comprehensive Rules currently published as effective June 1, 2021 generally require:
- a final or partial final award within 30 calendar days after hearing closure or final written submissions, subject to agreement or good cause;
- a written and signed disposition of each claim;
- concise written reasons unless all parties agree otherwise;
- service of the award on the parties;
- a correction request within seven calendar days after service;
- seven days for opposition;
- correction of computational, typographical, or similar errors rather than a merits redetermination; and
- private-rule finality 14 days after service if no correction is requested, or on service of the corrected award.
JAMS Rule 25 states that judicial enforcement, confirmation, modification, or vacatur is governed by the FAA or applicable state law. Its private “finality” rule does not conclusively determine whether Nebraska’s 90-day delivery clock or the FAA’s three-month filed-or-delivered clock began earlier. That issue remains dependent on the governing law, contract, and actual service record. JAMS+1
B5. No verified tolling from private correction request
Neither Nebraska §§25-2610, 25-2613, and 25-2614 nor FAA §12 states that a request to AAA, JAMS, or the arbitrator automatically tolls or restarts the judicial vacatur or modification window. A party should not assume that a pending correction request postpones the Nebraska 90-day or FAA three-month deadline without a controlling statute, court order, or agreement given legal effect. This pass located no controlling Nebraska or Eighth Circuit ordinary consumer-debt decision establishing such tolling. Nebraska Legislature+3
C. Confirmation and entry of judgment
C1. Nebraska UAA confirmation
A party applies by motion. Unless the parties agreed otherwise, notice of an initial UAA application must be served in the same manner as a summons. The statutory UAA court is a Nebraska district court. Venue is ordinarily:
- the county specified in the agreement for the arbitration hearing;
- the county where the hearing occurred;
- the county where the adverse party resides or has a place of business if no controlling hearing location exists; or
- any Nebraska county if the adverse party has no Nebraska residence or business.
Within 60 days after the confirmation application, the district court shall confirm unless timely vacatur, modification, or correction grounds are urged. Nebraska Legislature+3
Nebraska’s UAA does not state an outer period in §25-2612 for filing a confirmation application. That does not establish that confirmation is forever immune from every other defense, limitation, laches doctrine, satisfaction issue, or jurisdictional objection. No complete alternative-limitations audit was conducted in this pass.
County court does not have Nebraska UAA confirmation jurisdiction. In MBNA America Bank v. Hansen, a consumer-credit award filed in county court was dismissed because §25-2618 commits UAA confirmation jurisdiction to district court. Nebraska.gov
C2. Mandatory rather than discretionary confirmation
Once the prerequisites are met and no timely review ground is established, confirmation is mandatory. A court cannot use confirmation to rehear the merits, alter the arbitrator’s reasoning, or replace the award with relief the judge prefers. Nebraska Legislature+2
Nebraska also permits confirmation after the award has been paid. In Drummond v. State Farm, the Supreme Court rejected the contention that full payment necessarily made confirmation moot and directed the district court to apply the statute’s mandatory language. Confirmation does not authorize duplicate recovery; payment and judgment satisfaction remain distinct questions. Nebraska.gov
C3. Papers needed under Nebraska law
Unlike FAA §13, the Nebraska UAA does not enumerate one universal document packet for confirmation. The applicant must, at minimum, establish:
- an arbitration agreement within the UAA;
- the district court’s jurisdiction and proper venue;
- the award;
- its delivery;
- entitlement to invoke the award;
- compliance with motion and service requirements; and
- the absence or failure of timely vacatur or modification grounds.
The actual agreement, award, delivery proof, party identities, assignment, correction history, and notices remain unknown.
C4. FAA confirmation
FAA §9 applies when the parties agreed that judgment may be entered on the award. If the agreement specifies a court, application may be made there subject to jurisdiction. If no court is specified, §9 identifies a United States court in the district where the award was made. The court must confirm unless the award is vacated, modified, or corrected under §§10 or 11. U.S. Code
FAA §13 requires the moving party to file:
- the arbitration agreement;
- any papers relating to the appointment of the arbitrator or umpire;
- any written extension of the award period;
- the award;
- notices, affidavits, or other papers used on the confirmation or review application; and
- each court order.
The resulting judgment is docketed and has the same force and effect as another federal district-court judgment. U.S. Code
C5. FAA §9’s one-year language in the Eighth Circuit
FAA §9 says a party “may” apply within one year after the award. The Eighth Circuit squarely held in Val-U Construction v. Rosebud Sioux Tribe that the one-year language is permissive rather than a statute of limitations and allowed confirmation after one year. Justia Law+1
A later Eighth Circuit opinion, RGA Reinsurance v. Ulico, stated that a party “must” file within one year, but the petition there was timely and the court did not confront or overrule Val-U’s direct holding. The two descriptions are in tension. Val-U remains the directly reasoned Eighth Circuit holding on the one-year question, but this pass does not claim that every later petition is immune from other limitation, laches, jurisdictional, or contractual defenses. U.S. Court of Appeals+2
C6. Confirmation versus an untimely modification request
A party cannot avoid the review deadline by labeling a substantive change “confirmation.” A court may carry out a ministerial calculation clearly contemplated by an unambiguous award, but it may not use confirmation to add relief, recalculate the merits, or resolve an ambiguity that would require substantive arbitral judgment. U.S. Court of Appeals+2
In Palagi, no timely FAA vacatur or modification motion had been filed. The Nebraska Supreme Court held that the district court was required to confirm and could not use the confirmation proceeding to consider belated challenges to the underlying agreement’s validity or legality. Nebraska.gov
D. Nebraska UAA vacatur grounds
D1. Exhaustive statutory matrix
| Ground |
Exact statutory predicate |
Burden and practical limit |
| Corruption, fraud, or undue means |
Award was procured by one of those means |
Applicant must connect the misconduct to procurement of the award; timing uses discovery branch |
| Evident partiality by neutral arbitrator |
Neutral arbitrator showed evident partiality |
Nebraska uses an objective standard; mere adverse rulings or speculative relationships are insufficient |
| Corruption of an arbitrator |
Corruption by an arbitrator |
Actual proof required |
| Misconduct prejudicing rights |
Arbitrator misconduct substantially prejudiced a party |
Prejudice is essential |
| Exceeded powers |
Arbitrator exceeded contractually delegated authority |
Serious legal error is insufficient if arbitrator arguably interpreted the contract |
| Refusal to postpone |
Sufficient cause existed and refusal substantially prejudiced rights |
Requires preserved request, sufficient cause, and prejudice |
| Refusal to hear material evidence |
Material evidence was improperly excluded and rights substantially prejudiced |
Not every evidentiary ruling qualifies |
| Other contrary hearing conduct |
Hearing violated §25-2606 and substantially prejudiced rights |
Fair-hearing inquiry, not a trial-rules appeal |
| No arbitration agreement |
No agreement existed, issue was not already adversely determined under §25-2603, and party did not participate without objection |
A participant who proceeded without objection can lose this branch |
| Disqualified arbitrator failed to withdraw |
Timely demand under §25-2604.01 and statutory disqualification |
Requires timely demand before proceedings and qualifying relationship or judicial ground |
Nebraska §25-2613 supplies these grounds and states that the arbitrator’s grant of relief unavailable in court is not itself a vacatur ground. Nebraska Legislature+2
D2. Ninety-day timing
A Nebraska UAA application to vacate must generally be made within 90 days after the award is delivered. For corruption, fraud, or undue means, the application must be made within 90 days after the ground was known or should have been known. Nebraska Legislature
This discovery branch is ground-specific. It does not postpone the deadline for:
- legal error;
- excess-of-powers arguments known from the award;
- evident miscalculation;
- disagreement with damages;
- refusal to hear evidence known during the hearing;
- or an ordinary no-agreement objection.
D3. Formation challenge after the award
Nebraska’s no-agreement vacatur ground is available only if:
- no arbitration agreement existed;
- the issue was not previously adversely determined in a §25-2603 proceeding; and
- the party did not participate in the arbitration hearing without objection.
A party that timely and explicitly objects to arbitrability before participating can preserve the issue. A party that proceeds through the merits without objection risks losing it. Nebraska Legislature+1
D4. Evident partiality
Nebraska asks whether a reasonable person would have to conclude that partiality existed. The standard does not turn every nondisclosure, social connection, prior professional contact, or adverse ruling into evident partiality. The actual relationship, disclosure, materiality, timing, and objection record are necessary. Nebraska.gov
D5. Refusal to hear evidence and fair-hearing prejudice
A party seeking vacatur for refusal to hear material evidence must show more than an incorrect evidentiary ruling. It must demonstrate misconduct and substantial prejudice—effectively, deprivation of a fair hearing. In Lund-Ross, the Court of Appeals found prejudicial misconduct where the arbitrator permitted a late counterclaim but denied the opposing party a fair opportunity to present responsive evidence. The court treated partial vacatur as possible where the affected portion was severable. Nebraska.gov
D6. Exceeding powers
The question is not whether the arbitrator interpreted the contract correctly. It is whether the arbitrator was arguably construing the contract and acting within the submitted dispute. Vacatur is reserved for an award reflecting the arbitrator’s own conception of justice rather than a contractual interpretation. The applicant bears a heavy burden. Nebraska.gov+1
D7. Legal or factual error and manifest disregard
Nebraska courts do not vacate a UAA award merely because an arbitrator committed:
- an error of law;
- an error of fact;
- a serious legal error;
- a mistaken damages calculation that is not facially evident; or
- “manifest disregard” as an extra-statutory general ground.
The court’s review is not a substitute appeal on the merits. Nebraska.gov+1
D8. Narrow UAA public-policy doctrine
State v. Henderson recognizes a narrow Nebraska UAA refusal-to-enforce doctrine where an award violates an explicit, well-defined, and dominant public policy derived from law and legal precedent rather than generalized public interests. Seldin later confined that doctrine to the Nebraska UAA context and expressly rejected public policy as a FAA ground. Nebraska.gov+1
This narrow doctrine does not make every disputed fee, license issue, consumer statute, or alleged contract illegality a public-policy vacatur ground. The policy must meet the controlling standard and must be applied without relitigating facts entrusted to the arbitrator.
D9. Rehearing after vacatur
Where appropriate, the court may order a rehearing before new arbitrators or the original arbitrators, depending on the vacatur ground. Any contractual award deadline runs from the rehearing order. Nebraska Legislature
E. Nebraska judicial modification or correction
E1. Statutory grounds
A Nebraska district court may modify or correct an award only when:
- there is an evident miscalculation of figures;
- there is an evident mistake in the description of a person, thing, or property;
- the arbitrators decided a matter not submitted and the correction does not affect the merits of submitted issues; or
- the award contains an imperfection in form not affecting the merits.
The application must be made within 90 days after delivery. It may be joined with an alternative vacatur request. If the ground is proved, the court modifies or corrects the award to effect the arbitrators’ intent and confirms it as modified; otherwise it confirms the award. Nebraska Legislature
E2. “Evident” miscalculation
An evident miscalculation must be obvious and unambiguous from the award or incorporated figures. Judicial correction is not available merely because one party argues that the arbitrator should have valued evidence differently, used another rate, or selected a different component amount. Nebraska Legislature
E3. Form versus merits
A missing signature or similar formal defect may be correctable when it does not affect the panel’s actual decision. A modification cannot change who prevailed, supply an omitted merits determination, revisit credibility, or rewrite relief based on the court’s view of the law. Nebraska Legislature+2
F. FAA vacatur and modification
F1. FAA §10 grounds
FAA §10 permits vacatur where:
- the award was procured by corruption, fraud, or undue means;
- there was evident partiality or corruption in the arbitrators;
- the arbitrators were guilty of misconduct in refusing a sufficient postponement, refusing to hear material evidence, or otherwise prejudicing a party’s rights; or
- the arbitrators exceeded their powers or so imperfectly executed them that no mutual, final, and definite award was made.
The court may direct a rehearing where the award period has not expired. U.S. Code
F2. FAA §11 grounds
FAA §11 permits modification or correction for:
- evident material miscalculation;
- evident material mistake in a person, thing, or property description;
- an award on a matter not submitted, where correction does not affect submitted merits; or
- an imperfection in form not affecting the merits.
The court modifies or corrects to effect the award’s intent and promote justice between the parties. U.S. Code
F3. Exclusive grounds
Hall Street holds that FAA §§10 and 11 provide the exclusive statutory grounds for expedited judicial review under the FAA. Parties cannot create broader federal judicial review merely by contract. Supreme Court
Nebraska’s Seldin applies that rule and expressly rejects a nonstatutory public-policy vacatur ground under the FAA. Nebraska.gov
F4. Excess of powers and legal error
Under Oxford Health Plans, a party challenging under §10(a)(4) bears a heavy burden. So long as the arbitrator was arguably interpreting the contract, even a serious interpretive error does not permit vacatur. The court asks whether the arbitrator acted within the source of delegated authority—not whether the court agrees with the result. Supreme Court
F5. Fair-hearing misconduct
FAA §10(a)(3) requires proof that the challenged conduct deprived the party of a fair hearing or caused legally material prejudice. Nebraska’s Lund-Ross applied that standard to an FAA award and permitted relief only where the hearing structure actually denied an opportunity to respond to a late claim. Nebraska.gov
F6. Formation or arbitrability after award
Under First Options, a court independently reviews whether parties agreed to arbitrate arbitrability unless clear and unmistakable delegation was established. A person who objected to arbitral jurisdiction does not become bound merely by appearing to contest it. Supreme Court
The postaward claimant must still comply with FAA §12’s timing and service requirements. A formation objection does not, by itself, erase the statutory review window.
F7. Three-month service requirement
FAA §12 requires notice of the motion to vacate, modify, or correct to be served on the adverse party or attorney within three months after the award is filed or delivered. It is not enough merely to draft or file a motion if statutory service was not completed. The statute also specifies different resident and nonresident service routes. U.S. Code
Unlike Nebraska’s UAA, §12 contains no separate extension measured from discovery of fraud or corruption. This pass did not establish a generally available equitable tolling rule that overrides the statutory text.
F8. Karo and Seldin after Jules
Karo and Seldin characterized FAA §§9 and 12 notice and timing requirements as jurisdictional in Nebraska state proceedings. Nebraska.gov+3
The U.S. Supreme Court’s May 14, 2026 decision in Jules v. Andre Balazs Properties holds that a federal court with preexisting original jurisdiction that stayed the underlying case under FAA §3 retains subject-matter jurisdiction over the resulting §§9 and 10 motions. Jules rejects the proposition that the postaward service provisions necessarily destroy federal subject-matter jurisdiction in that pending-case posture. Supreme Court
The correct bounded conclusion is:
- §§9 and 12’s timing and service requirements remain mandatory statutory requirements;
- failure can forfeit or bar expedited FAA relief;
- Karo and Seldin remain material Nebraska precedent concerning state-court FAA applications;
- but their broad subject-matter-jurisdiction terminology is no longer safe as a universal description of every federal postaward proceeding after Jules.
F9. Confirmation cannot revive an expired review request
A party that did not timely seek FAA vacatur or modification ordinarily cannot resurrect those grounds by opposing confirmation. Palagi confirms that once the statutory review period has passed, the court’s role is confirmation rather than a belated merits or contract-legality review. Nebraska.gov

G1. Nebraska computation
Nebraska excludes the triggering day and includes the last day. If the last day falls on Saturday, Sunday, a statutory court holiday, or a day the court office is closed by order, the period extends to the next open day. Nebraska Legislature
Nebraska’s Rule §6-1106 three-day mail extension applies when a party must act after later Rule 5 service by specified mail methods. It should not be added automatically to a 90-day UAA period that runs directly from statutory delivery of the award. Nebraska Judicial Branch
An electronically filed Nebraska document is filed on the date received by the authorized system by 11:59:59 p.m. local time where the court is located. Nebraska Judicial Branch
G2. Federal computation
Federal Rule of Civil Procedure 6(a) governs federal time computation where applicable: exclude the triggering day, count every day, and extend a weekend or legal-holiday endpoint. Rule 6(d)’s additional three days applies when a period runs after specified service of a document; it does not automatically extend FAA §12’s three-month period, which runs from the award being filed or delivered rather than from service of the motion. The current federal rules PDF reflects amendments through December 1, 2025. United States Courts+1
A Nebraska state court applying FAA substantive law does not automatically import every federal procedural computation rule. The governing state procedural rule, FAA command, and court posture must be identified.
H. Appeals, finality, stays, and security
H1. Nebraska appealability
Nebraska §25-2620 permits appeal from:
- an order denying an application to compel arbitration;
- an order granting an application to stay arbitration;
- an order confirming or denying confirmation;
- an order modifying or correcting an award;
- an order vacating an award without directing rehearing;
- and a judgment or decree entered under the UAA.
An order denying vacatur is not separately listed as immediately appealable. Nebraska authority permits review of that denial on appeal from the later confirmation judgment. Nebraska Legislature+1
An order vacating and directing rehearing is not within the express “vacating without directing a rehearing” branch. General final-order law may still need examination; that complete analysis is outside this pass.
H2. Nebraska appeal period
A Nebraska notice of appeal and required docket fee ordinarily must be filed within 30 days after entry of the appealable judgment or final order. Specified timely postjudgment motions terminate the running of that period and require a new notice after disposition. Nebraska Legislature
H3. Nebraska appeal does not automatically stay
An appeal does not itself stay enforcement of a Nebraska money judgment. Section 25-1916 requires a qualifying supersedeas bond or cash deposit within the statutory period. For a money judgment, the security is generally the lesser of:
- judgment, costs, and estimated interest and appeal costs;
- 50% of the appellant’s net worth; or
- $50 million,
subject to statutory anti-dissipation protection and court determinations. Full supersedeas litigation and postjudgment enforcement are outside this pass. Nebraska Legislature
H4. FAA appealability
FAA §16 generally allows immediate appeal from:
- denial of a §3 stay;
- denial of a §4 petition to compel;
- denial of confirmation;
- an order confirming or denying confirmation;
- an order modifying, correcting, or vacating an award;
- certain injunction orders; and
- a final decision concerning arbitration.
It generally bars interlocutory appeal from an order compelling arbitration or granting a stay, subject to ordinary federal interlocutory certification rules. U.S. Code
FAA §16 governs federal appealability. Nebraska state appellate jurisdiction is governed by §25-2620 and Nebraska final-order law, not automatically by FAA §16.
H5. FAA stay of award enforcement
FAA §12 permits a judge, upon motion and notice, to stay proceedings to enforce an award on terms the court considers just. The statute does not create an automatic stay merely because a vacatur motion or appeal exists. U.S. Code
After a federal confirmation judgment, ordinary federal postjudgment stay and security rules may apply. Those rules were not comprehensively researched here.

J. Bounded examples
Example 1 — Nebraska confirmation after review period expires
Hypothetical facts
- Award personally delivered: Monday, February 2, 2026.
- No correction, vacatur, or modification application.
- No fraud issue.
- Confirmation application filed in Nebraska district court: Monday, June 1, 2026.
- Proper initial motion service is assumed.
- No court closure or separate defense.
Vacatur/modification computation
Plain text
Delivery day excluded February 2
Day 90 Sunday, May 3, 2026
Weekend extension Monday, May 4, 2026
The ordinary Nebraska vacatur/modification period conditionally ended May 4.
Confirmation directive
Plain text
Confirmation application June 1, 2026
60th day after application Friday, July 31, 2026
With no timely statutory ground, §25-2612 directs confirmation. The court’s failure to act by the 60th day was not separately analyzed for jurisdictional consequence. Nebraska Legislature+3
Example 2 — Postaward formation objection
Preserved branch
- Consumer expressly objected before the arbitration hearing that no arbitration agreement existed.
- Consumer participated only under that objection.
- No earlier §25-2603 court decision rejected the objection.
- A timely §25-2613 application follows delivery.
The court can consider the no-agreement vacatur branch.
Waived branch
- Consumer participated through the merits.
- No formation or arbitrability objection was made.
- The first objection appears after an adverse award.
Section 25-2613(a)(5) does not provide the same postaward route because participation occurred without objection. Nebraska Legislature+1
Under the FAA, First Options protects an objecting nonsignatory or party where arbitrability was not clearly delegated, but FAA §12’s three-month service window still must be addressed. Supreme Court+1
Example 3 — Nebraska fraud-discovery branch
Define:
Plain text
D = award delivery date
K = date fraud was actually known or reasonably should have been known
If the fraud or undue means could not reasonably have been known at delivery:
Plain text
Vacatur application deadline = K + 90 days
The applicant still must prove:
- fraud, corruption, or undue means;
- when it was known or reasonably discoverable;
- causal connection to procurement of the award; and
- timely application under the discovery branch.
Under the FAA, §12 contains no equivalent discovery trigger; the statutory text runs three months from filing or delivery of the award. Nebraska Legislature+1
Example 4 — Alleged legal error versus statutory ground
Assumed award components
Plain text
Principal found by arbitrator $5,000
Interest included in award 1,000
Total award $6,000
The losing party argues the arbitrator applied the wrong interest rule and should have awarded only $500 interest.
Plain text
Court-preferred arithmetic:
$5,000 + $500 = $5,500
The $500 mathematical difference does not establish a vacatur or modification ground. If the arbitrator interpreted the contract and applicable law, even serious legal error is insufficient. Relief would require proof that the arbitrator exceeded delegated powers or that another actual statutory ground applies. The example does not approve either interest figure. Nebraska.gov+2
Example 5 — Evident arithmetic correction versus merits rewrite
Award text
Plain text
Principal $1,000
Interest 200
Stated total 1,300
The component arithmetic is:
Plain text
$1,000 + $200 = $1,200
If the award unambiguously establishes that the stated total is the only mistake, the $100 discrepancy can qualify as an evident miscalculation.
If the dispute is instead whether the arbitrator intended:
- $200 interest and a $1,200 total; or
- $300 interest and a $1,300 total,
the court cannot choose between competing merits intentions unless the award and record resolve the question. Clarification or vacatur analysis may be required; judicial modification cannot become a merits rewrite. Nebraska Legislature+1
Example 6 — Confirmation motion does not extend opponent’s review period
Relative sequence
Plain text
Day 0 award delivered
Day 30 prevailing party applies to confirm
Day 90 Nebraska ordinary vacatur/modification deadline
The confirmation application does not restart or extend the opponent’s 90-day period. The opponent must timely assert a qualifying §25-2613 or §25-2614 ground rather than wait to raise it after the period as a defense to confirmation. Nebraska Legislature+3
The same bounded principle applies under the FAA: a confirmation proceeding does not revive a §12 period that has expired.
Example 7 — Award emailed, but governing delivery rule unknown
Facts
- An award PDF is emailed.
- No certified-mail copy is shown.
- The arbitration agreement is unavailable.
- It is unknown whether AAA, JAMS, or another rule set applies.
Classification
Plain text
Nebraska statutory personal/certified delivery not established
Agreement-authorized electronic delivery unknown
AAA R-48 electronic delivery unknown applicability
JAMS service and private finality unknown applicability
FAA filed-or-delivered trigger factually unresolved
The 20-day, 90-day, and three-month endpoints cannot be safely calculated until the agreement, administrator, rule version, transmission record, and governing law are identified. Nebraska Legislature+3
Example 8 — AAA or JAMS correction request does not safely postpone court review
AAA branch
Plain text
AAA correction request within 20 calendar days
Nebraska UAA court deadline 90 days from delivery
FAA court deadline 3 months from filed/delivered
JAMS branch
Plain text
JAMS correction request within 7 calendar days
JAMS private finality generally 14 days absent correction
Nebraska/FAA judicial deadline governed by applicable law
No reviewed statute or controlling case states that the private request tolls the judicial clock. Both must be protected independently unless actual governing authority says otherwise. American Arbitration Association+4
Example 9 — Freestanding federal motion versus retained federal jurisdiction
Freestanding application
A party files a standalone FAA §9 confirmation petition in federal court. The petition supplies no federal question apart from the FAA and does not establish diversity jurisdiction.
Result: Under Badgerow, the FAA alone does not create federal jurisdiction, and the court cannot use a look-through approach for §§9–10. Supreme Court
Existing stayed federal case
A federal court had original jurisdiction over the underlying action, stayed it under FAA §3, and the arbitration produced an award.
Result: Under Jules, the court retains jurisdiction to hear resulting §§9 and 10 motions in that same action. Supreme Court
Example 10 — Nebraska confirmation judgment, appeal, and stay
Facts
- District court confirms a Nebraska UAA award and enters a money judgment.
- Losing party files a timely appeal.
- No supersedeas bond or qualifying deposit is made.
Result
Plain text
Appealability established under §25-2620
Appeal notice ordinarily within 30 days
Automatic stay from appeal no
Enforcement stay requires statutory security/order
Garnishment or execution separate later procedure
The confirmation judgment is appealable, but the appeal alone does not suspend enforcement. The exact security depends on the judgment, costs, estimated interest, net worth, and court findings. Nebraska Legislature+2

Numerical self-check
The concrete Nebraska example was recalculated:
Plain text
Award delivered Monday, February 2, 2026
20th day Sunday, February 22, 2026
90th day Sunday, May 3, 2026
Weekend-adjusted 90-day endpoint Monday, May 4, 2026
Confirmation application Monday, June 1, 2026
60th day after application Friday, July 31, 2026
The calculation assumes:
- personal delivery on February 2;
- Nebraska §25-2221 applies;
- no special closure order;
- no different contractual rule;
- no correction that legally changes the award or delivery trigger; and
- no fraud-discovery branch.
The arithmetic does not establish any actual deadline.
Currentness and status
- Nebraska statutes and Judicial Branch rules were checked in their current public form on October 26, 2026.
- OLRC FAA pages display laws in effect through Public Law 119-124, October 15, 2026.
- Federal civil rules reflect amendments effective December 1, 2025.
- AAA Consumer Rules are amended and effective May 1, 2025.
- JAMS Comprehensive Rules are published as effective June 1, 2021.
- Jules was filed May 14, 2026 and was treated as current controlling U.S. Supreme Court authority.
- No proposed, future-effective, stayed, withdrawn, or vacated authority was used as operative law.
- This was not a complete legislative-history or commercial-citator audit.
Bounded unresolved searches
No controlling public Nebraska or Eighth Circuit authority was located that conclusively resolves:
- an outer Nebraska UAA confirmation-application period beyond §25-2612’s silence;
- automatic tolling of Nebraska or FAA court-review periods by an AAA, JAMS, or arbitrator correction request;
- the exact state-court computation rule for every FAA three-month motion;
- a uniform effect of electronic delivery where the agreement and administrator version are missing;
- a statewide Nebraska arbitration-award motion form;
- or the full present interaction between Jules and Nebraska’s older Karo/Seldin jurisdictional terminology in every state-court FAA posture.
These are bounded search results, not proof that no unpublished, trial-level, local, or commercial-database authority exists.
Not read or performed
- No actual arbitration agreement, award, administrator correspondence, delivery email, certified-mail receipt, correction request, motion, court order, notice, appeal, bond, judgment, account, provider agreement, assignment, or docket.
- No named consumer, creditor, debt buyer, provider, arbitrator, administrator, court, or case search.
- No filing, contact, records request, fee quote, paid database, private data, account access, or court-account access.
- No complete:award interest analysis;award preclusion analysis;federal appellate deadline report;confirmation-judgment duration or renewal report;lien, satisfaction, release, execution, garnishment, or exemption report;provider-remedy, secured-debt, medical, government, tax, support, education, probate, local, tribal, or foreign-law dossier.
- No Deep Research, Work, Codex research generation, API, purchase, account change, website action, publication, browser control, other Chat, CAPTCHA bypass, security workaround, or local-file save.
Focused disposition: Nebraska converts an arbitration award into an enforceable court judgment only through district-court confirmation, modification, or correction. State review ordinarily must be initiated within 90 days after delivery, with a separate fraud-discovery branch; federal review requires service within three months after the award is filed or delivered. Neither system permits a conventional merits appeal. Courts may correct obvious arithmetic or form defects but may not rewrite the arbitrator’s decision. Confirmation does not revive an expired challenge, and neither an administrator correction request nor an appeal automatically stays judicial enforcement.
