Iowa collection actors, notification/licensing boundaries, security, and public consumer-procedure gateway
Fresh access date: October 27, 2026, Pacific Daylight Time and UTC. Observed session-clock checkpoints included 10:44:09 PDT / 17:44:09 UTC and 10:59:47 PDT / 17:59:47 UTC. These are not individual source-fetch timestamps or a complete session interval.
Review status: Same-coordinator research, not independent review. Earlier provider, funds, bond, agreement, and limitation reports do not establish collector authorization. P08 supplies no limitation premise here.
Register counts: 21 source groups; 50 claim entries; six case entries—five published Iowa Supreme Court opinions and one Court of Appeals opinion used only with an unverified-publication qualification; four fictional models; 16 shorter postures; and 56 coverage entries. Multiple sections of Chapter 537 are grouped by subject, not treated as independent corroboration.
Principal findings
Iowa’s ordinary collection framework is notification plus conduct regulation—not a general debt-collector license. The Attorney General’s official instructions expressly distinguish notification from licensing. The controlling notification provisions are Iowa Code §§537.6201–.6203, administered through the Attorney General. But that conclusion has an important exception: direct collection or enforcement of supervised loans can require separate authorization under §537.2301. “No ordinary collector license” therefore does not mean unrestricted collection authority. Iowa Attorney General+2
Iowa’s collection-conduct definition reaches original creditors as well as third parties. Section 537.7102 includes collection for oneself, one’s employer, or others. Yet the underlying obligation must meet Iowa’s actual statutory debt definition. In Degeneffe, the Iowa Supreme Court held that payment due upon completion, accompanied by late charges, did not itself establish the required grant of credit. An unpaid household bill is not automatically a covered consumer-credit debt. Iowa Legislature+1
A material notification-threshold discrepancy remains unresolved. The 2026 statute uses the indexed “threshold amount” for the preceding year but retains $25,000 for the current-year alternative. The compiled administrative rule still uses $25,000 for both years. The current AG page uses $73,400 for either year. The federal source confirms $73,400 as the 2026 indexed amount, but that does not erase the different current-year statutory wording. This report preserves—not silently reconciles—that discrepancy. Iowa Legislature+3
No ordinary collection-agency bond, consumer recovery bond, or general collector trust-account scheme was established from the notification provisions, compiled Chapter 22, or blank notification form. That bounded finding does not eliminate specialized loan, attorney-client trust, money-transmission, debt-management, local, or other requirements. No amount from Chapters 533A or 533C is imported.
A. Debt, conduct, actor, and territorial classification
A1. The underlying obligation must qualify
Section 537.7102 supplies article-specific definitions:
| Element |
Verified statutory meaning or boundary |
Consequence |
| Creditor |
Person to whom the debtor is directly or indirectly obligated. |
An assignee or owner may be a creditor, but ownership still must be established. |
| Debt |
Actual or alleged obligation arising from the listed consumer-credit, rental-purchase, expanded hypothetical-transaction, check, and Chapter 533D categories. |
“Alleged” does not validate a nonexistent balance; it permits conduct regulation concerning an asserted obligation. |
| Debt collection |
Soliciting debts for collection, collecting, or attempting collection. |
Conduct can be covered before money is received or litigation begins. |
| Debt collector |
Person acting directly or indirectly for self, employer, or others; also specified sellers of collection-system forms. |
Original-creditor status is not a general Iowa conduct exemption. |
| Debtor |
Person obligated for article 7 purposes. |
Identity and obligation remain factual questions. |
The broader Chapter 537 definitions separately require, for the principal sale/loan categories, qualifying credit, a person other than an “organization,” primarily personal/family/household purpose, the relevant installment/finance-charge condition, and applicable amount or other limits. “Organization” and “person” have distinct statutory definitions; this should not be reduced to an unsupported rule that every possible entity arrangement is treated identically. Iowa Legislature+1
Credit must actually have been granted
Under §537.1301(16), credit concerns a granted right to defer payment. In Degeneffe v. Home Pride Contractors, an ordinary home-improvement contract requiring payment at completion did not become a consumer-credit transaction merely because late payment could produce charges. The court also examined the requirement that the seller regularly engage in the relevant credit transactions. iowacourts.gov
Consequently:
- A genuine installment sale or loan may qualify.
- A cash-on-completion transaction does not automatically qualify because the customer later fails to pay.
- A late fee is not by itself proof of a contractual right to defer payment.
- The expanded debt and check categories in §537.7102(3) must be considered separately; Degeneffe is not a blanket exclusion of every unpaid service bill.
- Business-purpose obligations, government-provided benefits, regulated utilities, and other special categories require their own statutory analysis.
Section 537.1202 excludes specified transactions, including certain government, insurance, regulated public-utility/common-carrier, securities-broker, and pawn transactions, subject to its qualifications. Section 537.1301(12) separately excludes benefits provided by or on behalf of the state or a state agency from “consumer credit transaction.” These provisions do not establish every government actor’s immunity or every federal institution’s preemption position. A3. Iowa and federal definitions do not match
The federal FDCPA definition generally uses the principal-purpose and regularly-collecting-another’s-debts tests, plus the creditor false-name provision and specified exclusions. The statute separately addresses employees, certain affiliates, government employees, process servers, qualifying nonprofit counseling, fiduciary activity, originated debts, debts not in default when obtained, and specified commercial-security situations. US Code
Accordingly:
- Iowa self-collection coverage does not prove federal FDCPA coverage.
- Original-creditor status does not resolve every federal false-name or principal-purpose issue.
- Buying a defaulted debt does not alone answer every federal status question.
- An affiliate exception must satisfy its actual conditions.
- The federal nonprofit-counseling exception is conditional, not a nonprofit label exemption.
- Attorney status does not supply a current categorical federal exemption.
This is a definition boundary only, not a full FDCPA communications, validation, reporting, or remedies report.
A4. Remote and out-of-state conduct
Section 537.1201 contains transaction-origin and territorial rules, including consumer residence, communications, receipt, and significant-relationship provisions. It also reaches specified collection and enforcement activity in Iowa even where the transaction originated elsewhere. Iowa Legislature
An out-of-state headquarters, online-only interaction, or absence of an Iowa office therefore does not automatically eliminate Chapter 537. Conversely, an Iowa consumer’s presence does not answer every foreign-law, federal-charter, local, or tribal issue. No actual location, solicitation, transaction, or communication record is supplied.
B. Actual market-access regime
B1. Notification is not a collection license
The operative ordinary framework is:
- Determine whether the debt and activity fall within Chapter 537.
- Determine whether creditor or collector notification applies.
- Apply the actual statutory exemptions.
- File the required information and pay applicable government fees.
- Separately determine whether supervised-loan, professional, entity-qualification, investigation, or other specialized authority is required.
The AG’s operational page calls this notification/registration and expressly says no ordinary debt-collector license is issued. A submitted form, processing entry, or annual payment is not an adjudication that the filer owns an account, may impose a charge, or may litigate it. Iowa Attorney General+1
B2. Threshold and version discrepancy
| Source |
Actual displayed rule |
Status and permissible use |
| 2026 Code §537.6201(2) |
Preceding-year total exceeds the defined “threshold amount”; if not, current-year total exceeds $25,000. |
Controlling compiled statutory wording, subject to later-law audit. |
| §537.1301(47) |
Defines the threshold by reference to 12 CFR1026.3(b) as in effect when the transaction is entered. |
Raises an application question when used for an aggregate collection threshold. |
| Compiled 61—22.2 |
Still uses $25,000 for both years and retains other outdated references. |
Official compiled rule text, but not a basis to overwrite the statute. |
| Current AG notification page |
Uses $73,400 for either preceding or current year, aggregated from all sources rather than Iowa accounts alone. |
Current operational instruction, not a statutory amendment. |
| Official Regulation Z interpretation |
Confirms $73,400 for January1–December31,2026. |
Establishes the federal indexed amount; does not resolve Iowa’s separate current-year wording. |
No CPI calculation was performed. No authoritative reconciliation of the statute’s $25,000 current-year branch, the rule’s older wording, and the AG’s $73,400 instruction was established. A collector between those figures cannot be declared exempt from this record. Iowa Legislature+4
The separate creditor-notification provision does not depend on importing the collector’s volume threshold. The AG states that most own-creditor businesses do not file as debt collectors, while a creditor/assignee filing may still apply. Iowa Attorney General+1
B3. Notification, fees, exemptions, and security matrix

Volume-fee base
The additional statutory fee is $10 for each $100,000, or qualifying residual amount exceeding $10,000, of the prescribed average unpaid balances. The seller/lender branch includes specified balances held by an immediate or remote assignee that has not notified; the assignee branch addresses assigned obligations held at month-end. These are not a commission, tax on cash collected, or fee chargeable automatically to a debtor. Iowa Legislature
The AG’s creditor/assignee schedule is operational guidance. Its boundary presentation should not silently replace the statute’s residual-amount wording. The model below deliberately avoids the disputed boundary.
Rule history actually checked
Two final adopted notices were read:
- ARC3629C, effective March21,2018: Chapter22 late-charge amendment.
- ARC4969C, effective April15,2020: Chapter22 base-fee amendment reflecting the statutory change.
The October14,2026 agency compilation still contains Chapter22. Its future rescission notation is not treated as present repeal or as a complete prediction of future rule status. No complete amendment-chain or post-October14 audit was performed. Iowa Administrative Rules+2
B4. Specialized loan collection can require authorization
Section 537.2301 prohibits an unauthorized person from engaging in the business of making supervised loans or undertaking direct collection/enforcement arising from supervised loans.
Its branches matter:
- Authorized supervised financial organizations and licensees under Chapter536 or536A may qualify.
- The limited remote-lender branch requires fewer than ten supervised loans per year in Iowa, no Iowa office, and no face-to-face solicitation in Iowa.
- The three-month collection/enforcement window without a license requires a prompt application that has not been denied.
- A supervised loan made in violation of subsection2 is subject to the statute’s voidness and recovery consequences.
The last point must not be rewritten as “any collection by an unauthorized actor voids an otherwise valid loan.” The statute distinguishes unlawful making from collection authority. A “supervised loan” is defined through the applicable rate relationship to Chapter535, not through an invented universal rate in this report. Iowa Legislature+1
The complete Chapter536/536A application, branch, security, fee, and exemption regimes were not investigated here. Their applicability is an explicit remaining gateway.
B5. General entity qualification and investigation work
Iowa’s foreign-corporation and foreign-LLC statutes list specified debt acquisition, securing, collection, and enforcement activity among activities that do not, by themselves, constitute transacting business for those registration provisions. They expressly preserve other service, taxation, and regulatory questions. Therefore, a remote collector cannot automatically be told it must foreign-qualify merely because it collects a debt; nor can it assume all its other business activity is exempt. Iowa Legislature+1
Chapter80A’s private-security-business definition excludes debt collection, but separate private-investigation activity can create a different issue. Skip tracing, locating persons, and investigative services require their actual activity analysis. The AG FAQ warns about that distinction. No Chapter80A application, bond, or professional authority is inferred from ordinary collector notification. Iowa Legislature+1
C. Actor-specific duties and authority limits
C1. Narrow conduct and charge matrix
| Duty or authority issue |
Governing requirement |
What notification does not establish |
| True identity |
§537.7103(4) restricts false names, identity, and misleading collection representations. |
A registered DBA does not permit false lawyer, government, creditor, or court identity. |
| Assignee identification |
The specified demand must identify the assignee as required by §7103(4)(d). |
It does not prove the assignment or balance. |
| Amount/status/authority |
False representations about character, amount, legal status, government endorsement/bonding, or legal process are prohibited. |
Filing notification is not government endorsement or proof of a recovery bond. |
| Paragraph-specific disclosure exceptions |
§7103(4)(b) contains specified formal-pleading and institutional/affiliate/personnel exceptions with conditions. |
These are not wholesale exemptions from §7103. |
| Collection-service fees |
§7103(5)(c) requires a legally chargeable fee reasonably related to acts actually performed. |
A collector’s internal percentage schedule is insufficient. |
| Incidental charges |
§7103(5)(d) requires express agreement plus legal chargeability, or other legal permission. |
Contract wording alone cannot validate an unlawful charge. |
| Consumer-credit attorney fees |
§537.2507 generally prohibits such agreements, with a specified larger, land-secured exception. |
The exception is not an ordinary unsecured-account authorization. |
| Default charges |
§537.3402 restricts unauthorized default charges, with its stated security-realization and lease qualifications. |
“Collection cost” is not an unrestricted default-charge category. |
| Assignment notice/proof |
§537.3204 permits payment to the original creditor until adequate assignment notice; a requested proof branch also applies. |
No automatic title or admissibility conclusion from the word “assignee.” |
| Judicial entitlement |
§537.5114 requires specified allegations and verified complaint or sworn proof before default judgment. |
Notification does not prove contract, default, amount, calculation, or standing. |
These are selected identity, authority, and charge provisions—not a complete communications or litigation report. Iowa Legislature+4
C2. Legal-practice boundaries
In A-1 Associates, a collection arrangement disguised as an assignment did not authorize a nonlawyer collection company to provide legal services for the original creditors. The court examined the actual economics and retained creditor benefit, not merely the assignment’s caption. Its discussion of a genuine purchase does not supply a present blanket corporate self-representation permission. FindLaw Caselaw
The retrieved professional rule32:5.5 prohibits unauthorized practice and assistance in unauthorized practice, while providing conditional rules for qualifying out-of-state lawyers. The displayed professional-rule compilation is dated December2020; a complete later-amendment audit was not performed. A law degree, attorney label, out-of-state admission, collection-company ownership, or online service does not establish the necessary Iowa authority. Iowa Legislature+1
C3. Client money is not consumer-fee permission
For a lawyer holding client or third-party property in connection with representation, rule32:1.15 imposes segregation, notification, delivery, accounting, and disputed-fund duties. Advance fees, earned fees, disputed amounts, and client principal must be distinguished. Chapter45 supplies additional trust-account rules that were not comprehensively examined. Iowa Legislature
For an ordinary nonlawyer agency, this pass did not establish a universal statutory remittance deadline, trust-account architecture, retention period, reserve rule, or bond for client collections. The agency contract and other applicable fiduciary, payment, transmission, and sector law remain necessary. No P04 custody conclusion is imported.
A debtor’s payment can be credited fully to the debt while a separate lawful creditor-agency commission is paid from the creditor’s proceeds. That does not convert the commission into an additional consumer obligation. The fictional ledger below separates those flows.
D. Public consumer procedure and remedy gateway
D1. Responsible bodies and public entry routes
| Body/route |
Verified role |
Limits |
| Iowa Attorney General, Consumer Protection Division |
Administrator of Chapter537; receives generic consumer complaints and administers notification. |
Not private counsel; complaint does not guarantee investigation, refund, or litigation. |
| Appropriate financial supervisory authority |
§537.6105 allocates examination, investigation, and administrative functions for specified supervised institutions. |
Exact charter and activity must be known; no institution was queried. |
| Court in Chapter537 enforcement |
May decide injunctions, penalties, consumer claims, and statutory relief when properly invoked. |
An administrative complaint is not a court filing or stay. |
| Attorney Disciplinary Board |
Receives and investigates lawyer complaints; discipline operates through the professional-regulation system. |
Not a substitute for a damages action or a fee/balance adjudication. |
| Commission on Unauthorized Practice of Law |
Generic public complaint route for alleged unauthorized practice. |
Current detailed Chapter38 procedure was not recovered; no actual submission or status inquiry occurred. |
The AG page also directs users to appropriate financial complaint routes. Choosing an agency does not establish coverage, cure a judicial deadline, stay collection, or adjudicate ownership. Iowa Attorney General+4

Eligible consumer under §5201(1), including §7103 violations. |
Actual damages; in a nonclass action, court-selected penalty $100–$1,000. |
Not every Chapter537 violation is enumerated; consumer-rental-purchase lessee exclusion applies to this branch. |
| Excess charge/refund |
§5201(2)–(3), with the particular charge or refund-demand conditions. |
Excess/refund plus, in a qualifying nonclass action, $200–$2,000 court penalty. |
Thirty days is presumed reasonable for the refund-demand branch; no automatic stacking with another penalty. |
| Consumer costs/attorney fees |

Private-action qualifications
Section5201 distinguishes:
- Actual damages, which require proof of legally attributable loss.
- Statutory penalties, selected by a court within the applicable range.
- Excess charges, which the consumer is not obliged to pay and may recover if paid.
- Refund mechanics, including restrictions on simply reducing the balance instead of paying a requested refund.
- Defenses and corrective action.
Subsection6 contains its own self-notification/correction sequence, including correction within forty-five days. Its “before written notice … or before action” wording is preserved without resolving competing hypothetical notice dates. Subsection7 separately requires proof that the violation was unintentional, a bona fide error, and occurred despite reasonably adapted procedures. Chrysler applies those elements to its particular record; it is not a universal collector safe harbor. Iowa Legislature+1
For the necessary remedy gateway only, §5201(1)(b) uses two years after the violation for specified open-end-credit violations and one year after the last scheduled due date for other covered transactions. Subsection3 has its own excess-charge trigger. These are freshly read remedy-specific provisions, not a P08 limitation conclusion or a calculated deadline for anyone. Iowa Legislature
Failure to notify alone is not the same claim as abusive collection
The Taylor opinion rejected the particular theory that failure to notify alone supplied the asserted private Chapter537 cause of action. It did not decide all exemption/preemption questions and does not eliminate the express §5201 route for §7103 misconduct. Because precedential publication was not verified, Taylor is used only as qualified, noncontrolling reasoning. The statute remains the primary basis for separating public notification enforcement from enumerated consumer remedies. Iowa Judicial Branch+2

These cases support different propositions. National Farmers and Degeneffe concern debt/credit coverage; Monahan and Chrysler concern the private-remedy gateway and defense; A-1 concerns legal-practice boundaries. Taylor is not treated as a binding substitute for the statutory text. Justia Law+5
Citation-rule qualification
The displayed December2025 compilation’s Rule6.904(2)(a)(2) permits unpublished decisions as persuasive reasoning, not controlling authority, and specifies docket/database citation and copy conditions where applicable. No database citation or publication designation was invented. Later amendments remain held. Iowa Legislature
F. Four bounded fictional models
These models contain no actual consumer, provider, license, contract, or account. Monetary amounts are USD, rounded to two decimals. Correct arithmetic does not establish coverage, title, fee entitlement, or an award.
M01 — Same obligation, three different collection actors
Shared stipulations
Plain text
Unpaid contractual balance: $1,000.00
Purpose: Personal/household
Transaction: Genuine covered consumer credit
Security: None
Supervised-loan status: Stipulated not a supervised loan
Discharge/release/identity dispute: None assumed for this model
Annual collection total for agency/buyer: $100,000.00
| Actor branch |
Iowa consequence |
Independent questions |
| A. Originating creditor |
Own-debt collection can fall under §7103. Creditor notification is separately analyzed. |
Institutional exemption; actual fee/assignment facts; federal false-name/principal-purpose questions. |
| B. Third-party agency |
Collection conduct is covered; $100,000 exceeds both competing notification figures used in the sources. |
Actual agency authority; no ownership inferred; federal regular-collection/means tests and exclusions. |
| C. Defaulted-debt purchaser |
Ownership does not remove Iowa collection coverage; assignee and collector notification categories must be tested. |
Actual transfer, supervised-loan status, volume-fee base, federal principal-purpose/other status tests. |
The same $1,000 obligation does not become more valid, larger, or collectible merely because a different actor seeks it. No branch automatically establishes federal FDCPA status. C001–C012, C019, C021, C028.
M02 — Remote entity, general qualification, and government fees
Ordinary collector branch
Plain text
Entity: One foreign LLC
Principal office: Outside Iowa
Iowa offices: None
Business names used: Three DBAs
Prior-year total collections: $100,000.00
Activity assumed: Collection only
Subject to actual Chapter537 applicability and exemptions:
Plain text
Annual notification fee:
1 notifying person × $50.00 = $50.00
Paper payment route: $50.00
Online route described by AG:
$50.00 + $1.00 convenience fee = $51.00
Three DBAs do not create a verified three-times statutory fee. The filing identifies all business names and the required Iowa agent. Initial thirty-day and subsequent January31 requirements apply; no actual commencement calendar is supplied.
The foreign-LLC collection-only exception may mean this activity alone does not require foreign registration. Other activity can change that result. No Secretary of State fee is invented.
Separate assignee-volume branch
Assume the same person independently qualifies as a notified assignee and holds qualifying Iowa obligations with a $120,000 month-end balance in each of twelve months:
Plain text
Sum of twelve month-end balances:
12 × $120,000.00 = $1,440,000.00
Average unpaid balance:
$1,440,000.00 / 12 = $120,000.00
First $100,000 unit: $10.00
Residual $20,000 exceeds $10,000: $10.00
Additional volume fee: $20.00
Base $50.00 + volume $20.00 = $70.00
This uses unpaid balances, not the $100,000 cash-collection total. The legal predicates for including each obligation remain stipulated. Borderline current-year collection totals remain subject to the unresolved threshold discrepancy. C010–C020.
M03 — Demanded collection cost and a separate client-money ledger
Demand
Plain text
Established debt for model: $1,000.00
Additional demanded collection charge: $100.00
Evidence legally authorizing add-on: Not supplied
The demanded $100 is not added to the established model balance merely because the agency requests it. Section7103’s legal-entitlement and charge conditions must be satisfied.
Actual payment and separate commission
Assume the consumer pays $500, all of it properly credited to the debt. Separately stipulate a lawful creditor-agency agreement paying the agency 20% of receipts from the creditor’s proceeds, not as a consumer add-on.
Plain text
Consumer payment received: $500.00
Consumer debt credit: $500.00
Remaining model debt:
$1,000.00 − $500.00 = $500.00
Agency commission from creditor proceeds:
20% × $500.00 = $100.00
Net amount remitted to creditor:
$500.00 − $100.00 = $400.00
The consumer’s debt falls by $500, not $400. The creditor’s $100 commission expense is not automatically a new consumer debt.
This model stipulates completed remittance and no pending transfer, reversal, interest, or other charge. It does not establish a statutory trust account, remittance deadline, lawful commission agreement, or actual money-transmission exemption. If the commission premise is unproved, the subtraction remains arithmetic only. C026–C032.
M04 — Complaint, private recovery, and public enforcement
Branch A: proven collection violation
Assume an eligible consumer proves a §7103 violation, $250 actual damages, a timely nonclass action, and no applicable defense.
Plain text
Actual damages: $250.00
Statutory penalty range: $100.00–$1,000.00
Illustrative combined range:
$250.00 + $100.00 = $350.00
$250.00 + $1,000.00 = $1,250.00
The court selects the penalty. This is not a per-call formula. Recoverable costs and attorney fees require the statutory finding and reasonable amount.
Branch B: distinct excess-charge claim
Instead, assume a legally established $80 paid excess charge, the applicable §5201(3) conditions, and a timely nonclass claim:
Plain text
Excess/refund: $80.00
Penalty range: $200.00–$2,000.00
Illustrative range: $280.00–$2,080.00
This branch is not automatically added to Branch A for the same harm. Actual overlap and remedy rules require separate analysis.
Branch C: public notification enforcement
Assume one legally required $50 fee remains unpaid and the AG proves §6113(3)’s conditions:
Plain text
Three times unpaid fee:
3 × $50.00 = $150.00
Penalty ceiling:
greater of $150.00 or $1,000.00 = $1,000.00
Unpaid fee + maximum penalty comparison:
$50.00 + $1,000.00 = $1,050.00
Seven-percent annual interest and reasonable enforcement costs are separate; no elapsed-time amount is calculated. The public penalty is not paid automatically to the complainant. The separate up-to-$10,000 repeated-intentional-violation provision also requires its own proof and is not stacked here.
Merely submitting a complaint produces none of these awards. C036–C046.

Source-claim rule |
Required missing fact |
Conditional consequence / next question |
| P01 Own creditor |
C003, C009 |
Qualifying debt and institutional status |
State conduct coverage may apply despite no third-party agency. Which notification branch applies? |
| P02 Debt purchaser |
C007, C019, C028 |
Actual assignment and principal business |
Ownership label does not settle federal status or account entitlement. |
| P03 Third-party agency |
C008–C011 |
Annual totals and Iowa conduct |
Notification may apply; borderline threshold requires reconciliation. |
| P04 Affiliate employee |
C003, C007, C012 |
Employer/affiliate relationship and statutory conditions |
No universal Iowa exemption; federal exclusions differ. |
| P05 Attorney label |
C006, C030–C031 |
Actual admission and capacity |
A company name containing “legal” is not law-practice authority. |
| P06 Business-purpose purchase |
C001–C004 |
Actual predominant purpose and entity |
Ordinary consumer protection may not apply; no commercial-regime conclusion. |
| P07 Remote collector |
C005, C014, C020 |
Activities beyond collection and Iowa contacts |
No Iowa office is not automatic notification exemption or corporate-registration duty. |
| P08 Unverifiable assignment |
C028–C029 |
Adequate notice, requested proof, litigation evidence |
Registration does not prove ownership; statutory payment/proof branches matter. |
| P09 False official authority |
C024–C025 |
Exact representation and debt coverage |
A claim of state approval or bonding can be misleading; no actual security inferred. |
| P10 Unapproved collection cost |
C026–C027 |
Contract, legal authorization, acts performed |
Charge cannot be justified solely by agency policy. |
| P11 Held client money |
C032 |
Lawyer/nonlawyer capacity, contract, actual receipt |
Lawyer trust duties may apply; no universal nonlawyer remittance period established. |
| P12 Wrong complaint agency |
C033, C046–C047 |
Charter, professional status, conduct |
Routing can change; filing a complaint does not stay a lawsuit. |
| P13 Supervised loan |
C021–C022 |
Rate category and statutory authorization |
Direct collection may require specialized authority; notification alone insufficient. |
| P14 Utility/government account |
C004 |
Exact provider, tariff, benefit and statutory exception |
Ordinary model cannot be applied from the bill’s label. |
| P15 Local/tribal activity |
C005, C049 |
Jurisdiction, tribal status, local ordinance |
State notification research is not local/tribal clearance. |
| P16 Low-volume collector |
C010–C011 |
Prior/current totals and correct threshold interpretation |
Low volume may affect notification, not necessarily conduct coverage. |

Actual Iowa actor/debt definitions, notification framework, threshold discrepancy, specialized-loan exception and narrow authority boundaries. |
No full collector compliance or actual-entity authorization. |
| Parent category2: collection licensing/original creditor versus third party |
Statutory and case-based distinctions, entity-specific exemptions, public filing requirements, fees and bounded security finding. |

Full communication, validation, reporting, payment-allocation, merits and litigation components. |
| Other reviewed/unreviewed passes |
Their status and holds preserved. |
No provider, funds, agreement, bond or limitation conclusion accepted by implication. |
The crosswalk does not add coverage rows or establish acceptance.
K2. Actual reads and source limitations
Fresh work included:
- The complete selected Chapter537 bodies identified in S001–S005 and S011.
- Complete compiled Chapter22, plus the two identified final adoption notices.
- The current AG generic instructions and two-page blank collector form.
- The actual federal definition and 2026 Regulation Z threshold interpretation.
- Selected foreign-entity, professional-rule and public complaint materials.
- The six majority opinion bodies within the stated read bounds.
The PDF page-inspection claims are confined to pages specifically identified in the source and case registers. No whole-agency, whole-code, full professional-rules, complete session-law, or full citator review is claimed.
Failed routes and nonrelied material
The legacy OLRC view route for §1692a failed; the separately identified official section route succeeded.
Both attempted current Chapter38 PDF routes failed:
The public professional-regulation pages remained readable. Older Chapter38 search results were not promoted into current operative rules. A page-index error while requesting a nonexistent second page of §80A.1 was corrected to its actual one-page document; it was not treated as missing law.
The AG informal-opinion index was inspected as discovery, but no responsive formal interpretation resolving the threshold discrepancy was authenticated. No collector registration list, real provider record, actual complaint, or licensing file was opened.
K3. Remaining currentness and interpretation holds
The most consequential unresolved issues are:
- The notification threshold conflict: statute, compiled rule and current AG instructions do not use the same current-year test.
- The transaction-date indexed definition: its application to an annual aggregate requires authoritative clarification.
- Specialized supervised-loan authority: applicability is established as a gateway, but the full Chapters536/536A package is not.
- Professional-rule currency: the retrieved Chapter32 compilation displays December2020; detailed current Chapter38 procedure was not recovered.
- Ordinary nonlawyer client-money duties: no general trust/remittance/security regime was established in the limited notification sources.
- Actual private/public recovery: no violation, loss, charge, defense, entitlement, deadline, or award was proved.
- Complete later-law and case treatment: selected primary bodies and final rules were checked, not every enactment, amendment, designation, or negative treatment.
No ambiguity was resolved by borrowing an unrelated Chapter533A bond, Chapter533C account rule, provider license, or an unreviewed prior report.
K4. Actions not taken
No real borrower, creditor, provider, DBA, attorney, account, assignment, property, license, docket, complaint, judgment, or payment was queried. Published opinions were read as legal authorities, not investigated as private case records.
No filing, form submission, signature, contact, purchase, account access, record request, browser control, local artifact, hash check, site change, or publication occurred. No unseen model/mode verification or independent review is claimed.
Disposition: This pass establishes a supported, conditional gateway for Iowa collection actors and notification, identifies a material unresolved threshold conflict, and separates public enforcement from private recovery. It does not establish a legitimate balance, authorized charge, licensed or notified entity, collectible debt, security recovery, operational permission, full component acceptance, Iowa acceptance, parent acceptance, A066 acceptance, or publication readiness.
