Bounded P06 example-premise, claim-link, and case-use patch
Fresh access: October 27, 2026, Pacific Daylight Time and UTC. The session clock was observed at 10:32:47 PDT / 17:32:47 UTC; these are session observations, not individual source-fetch timestamps.
This patch does not rewrite P06’s original raw text or recorded 5.6SolPro provenance. The coordinator’s complete-review, hash, and scalar-check results are supplied provenance, not checks repeated here. P08 and P09 are not reopened or used as new premises.
A. Corrected S_IA-P6-E03 and affected matrix entry
S_IA-P6-E03 — Custodial contract and creditor-consent boundary
Preserved original inputs
Plain text
Creditors listed in the contract: 6
Creditors whose consent is established: 2
Additional creditor accepting a distribution: 1
The original scalar statements—2 + 1 = 3 and 3 / 6 = 50%—remain mathematically true. They do not establish three creditors qualifying under either statutory alternative. The original “Total qualifying creditors: 3” label and resulting legal qualification are withdrawn.
The statute states a consent alternative or a like-number accepted-distribution alternative. The supplied facts do not establish that the distribution-accepting creditor consented, or that three creditors accepted distributions. No controlling authority permitting the original aggregation is established in this patch; equally, this patch does not announce a categorical prohibition against every mixed arrangement. legis.iowa.gov
| E03 branch |
Stipulated facts and scalar comparison |
Corrected disposition |
| Original mixed case — retained as unresolved |
Six listed creditors; two established consents; one additional creditor established to have accepted a distribution. |
Neither independently stated threshold is established. No automatic fee qualification. Additional facts or controlling interpretation are required. |
| Alternative A — consent branch |
Three distinct creditors from the six-creditor contract list actually consent: 3 consenting creditors / 6 listed creditors = 50%. |
On these stipulated facts, the consent-count alternative is established, subject to C039’s complete scope and conditions. |
| Alternative B — accepted-distribution branch |
Three distinct listed creditors actually accept a payment distribution: 3 accepting creditors / 6 listed creditors = 50%. Three payments to one creditor are not three creditors. |
On these stipulated facts, the accepted-distribution-count alternative is established, subject to C039’s complete scope and conditions. |
Shared limits: These alternatives establish only the specified creditor-count predicate—not fee earning, lawful amount, collection timing, completed settlement, or actual provider compliance. All independent state and applicable federal fee conditions remain. The preserved budget, disclosure, contract, and true-copy requirements are not replaced by creditor participation. No fee calculation is rerun.
Necessary P06 §2.3 matrix replacement
| Existing row/cell |
Precise replacement |
| Custodial DMP — mandatory contract term |
Unchanged: Complete list of creditors to receive payments. |
| Custodial DMP — separate operational event or disclosure |
Apply S_IA-P6-C039’s alternative tests and debtor-notice duty. Do not treat the original E03 mixed count as an established threshold. |
| Custodial DMP — important boundary |
Satisfying one count alternative does not establish satisfaction of independent fee or enrollment requirements. The mixed-case interpretation remains unresolved. |
Authority: §533A.8(4)(h), subsection 5’s introductory language, and §533A.8(5)(d). Iowa Legislature+1

Conditions, exceptions, currentness, and confidence |
| S_IA-P6-C039 |
In §533A.8(5)’s model requiring the licensee or any licensee to receive debtor money or evidences thereof for creditor distribution, the receiving licensee must not receive a fee, or have or cause another licensee to receive one, except the initiation fee permitted by §533A.9(2), unless it has consent from at least 50% of all creditors listed in its debtor contract or a like number have accepted a payment distribution. It must inform the debtor which creditors have not agreed to its handling of the account. |
S_IA-P6-S001: subsection 5 introduction, printed p.6/PDF index5, extracted L341–L344; §533A.8(5)(d), printed p.7/index6, L357–L362. Iowa Legislature+1 |
High for the identified 2026 compilation. The mixed E03 facts establish neither alternative; mixed-aggregation authority remains unresolved. The initiation exception is limited to this paragraph and does not override independent state or federal fee restrictions. Actual consent, acceptance, actor, contract, earning, and currentness remain unverified. |
Replace only the existing consent coverage row
| Component — unchanged identity |
Status |
Claims — corrected |
Exact missing evidence / next action |
| Creditor-consent event |
Preserved conditional boundary |
S_IA-P6-C039, replacing C038 |
Actual creditor consent/distribution-acceptance evidence and debtor notice remain required. The original mixed case needs additional qualifying facts or controlling interpretation. Independent fee conditions remain controlling. |
S_IA-P6-C038 remains unchanged. It continues to address the distinct Iowa full-remittance settlement-completion and conditional federal first-customer-payment concepts. It is not expanded to absorb the creditor-count rule.
C. Bruggeman context, source-use, and citation qualification
Replacement for P06 §5.4’s Bruggeman discussion
In Bruggeman v. Narnus Property Management, LLC, No. 24-1486 (Iowa Ct. App. April 1, 2026), Judge Greer’s majority treated the particular emails and settlement drafts as establishing agreement and affirmed summary judgment. The formation discussion is on printed pages 7–15/PDF indices 6–14; the disposition is on printed page 16/index15. Judge Buller’s dissent, printed pages 17–18/indices16–17, disputed resolving materiality and intent at summary judgment. That dissent is not a competing holding. This ordinary-settlement decision supplies no Chapter 533A formalities exception. Iowa Judicial Branch+4
Precedential publication has not been verified. The summary page’s “Date Published” field is website metadata, not sufficient evidence of precedential designation. The opened selective Published Cases list topped at July 9, 2026 and did not contain Bruggeman. That observation is not a complete later-designation or citator audit. For this patch, the opinion is used only as noncontrolling contextual reasoning. Iowa Judicial Branch+2
The displayed December 2025 appellate-rule compilation, Rule 6.904(2)(a)(2), allows unpublished decisions to be cited for persuasive reasoning, not as controlling authority. It requires a Bluebook-type citation including the docket number and an accessible electronic-database citation if available. Where the decision is unavailable in such a database, a copy must be filed and served as an attachment with the citing paper. No database citation is invented, no filing is made, and later amendments remain held. Iowa Legislature+1
Limited C036 and E08 replacements
| Original entry |
Exact limited qualification |
| S_IA-P6-C036 |
Preserve the existing Burroughs proposition without claiming a fresh Burroughs read. Replace the Bruggeman portion with: “Bruggeman supplies fact-specific ordinary-settlement reasoning, subject to the majority/dissent, summary-judgment, and unverified-publication qualifications in amended §5.4. Neither cited case establishes Chapter 533A compliance.” Use S006, formation pp.7–15/indices6–14, result p.16/index15, and dissent pp.17–18/indices16–17. |
| S_IA-P6-E08 |
Preserve the fictional facts and the existing statutory noncompliance conclusion. Replace only its case-use sentence with: “The qualified Bruggeman comparison does not establish a route around the mandatory Chapter 533A enrollment requirements; it decided an ordinary settlement on its particular summary-judgment record, not this hypothetical debt-management enrollment.” |
The majority itself preserved the distinction for writings required by statute or court rule. Its cited underlying authorities were not separately opened or promoted to fresh primary reads in this patch. Iowa Judicial Branch

Preserved qualifications: All actual budget, disclosure, agreement, signature, retainability, educational-form, business-day-calendar, amendment, assignment, UETA §554D.110(4), E-SIGN applicability/preemption, currentness, ARC0368D, original2018-order, local, tribal, sector, and state/parent holds remain. The actual interpretation authorizing mixed aggregation and any later Bruggeman publication designation remain unestablished.
Researcher self-check: The selected statutory and opinion bodies, companion pages, and citation rule were freshly read as specified above. The coordinator’s earlier selected checks, five hash checks, and six scalar/term checks were not repeated or represented as independent work. No cited underlying case was claimed freshly read merely because Bruggeman quoted it. No local write, private lookup, filing, contact, account change, or publication occurred.
This is a bounded same-coordinator patch, not independent review, and grants no operational, contract, provider, component, Iowa, parent, A066, or publication approval.
