Bounded P13 payment-recipient qualification and source/claim/count traceability repair
Affected report: C_BR PASS-13, response 9aa45848-946d-457d-8a31-089db744a82d
Scope: Only:
- Civil Code arts. 298 and 308–312 payment-recipient and penhora qualifications;
- Civil Code art. 2.044 and CPC art. 1.045 commencement claim traceability; and
- P13 old-to-new crosswalk counting units.
All other P13 legal findings, source rows, court-authority qualifications, calculations, workflows, coverage dispositions, currentness limitations and private/local/foreign/A066/A097/A098/country holds remain unchanged.
PASS-14 is complete and captured but remains unreviewed and is not adopted. PASS-04, PASS-05, PASS-09 and PASS-10 also remain unreviewed and are not premises here.
Fresh PASS-15 source access: October 26, 2026 PDT / October 27, 2026 UTC.
Exact per-source opening clocks: Not logged and unknown.
New source families opened: Two official Planalto compiled bodies.
No exact effective date was calculated.
Patch determination
The narrow reread establishes three distinct rules that must not be merged:
| Provision |
Relevant actor and knowledge |
Legal event and consequence |
| Civil Code art. 298 |
The creditor knows that the claim has been attached; separately, the debtor has not been notified of the attachment. |
The knowing creditor can no longer transfer the attached claim. A debtor who pays without notification of the attachment is discharged, leaving the third party’s rights against the creditor. |
| Civil Code art. 310 |
The debtor knowingly pays the creditor when that creditor is incapable of giving valid discharge. |
The payment is ineffective unless the debtor proves that the payment actually benefited that creditor. |
| Civil Code art. 312 |
The debtor has been formally intimated of the attachment over the claim or of a third party’s opposition, but nevertheless pays the creditor. |
The payment is ineffective against those third parties; they may compel the debtor to pay again, while the debtor retains recourse against the creditor. |
These are different actors, knowledge predicates, events and consequences. Article 298 cannot be used as shorthand for art. 312, and art. 310 cannot be omitted from the payee-capacity analysis. Planalto+2
R1. Recipient and attachment-payment qualification
R1.1 Replacement for the affected portion of P13 G2.6
Replace only the affected payee and attachment discussion in P13 G2.6 with the following.
Creditor or rightful representative — art. 308
Payment ordinarily must be made to the creditor or to the person legally representing the creditor. Payment made to another recipient is effective only after the creditor ratifies it or to the extent it actually benefits the creditor.
This provision addresses the identity or authority of the recipient. It does not itself decide whether the creditor receiving the payment was legally capable of issuing valid discharge.

Pinpoint: art. 308. Planalto
Good-faith payment to a putative creditor — art. 309
Payment made in good faith to a person reasonably appearing to be the creditor can remain valid even if it is later proved that the recipient was not the creditor.
This is an exceptional appearance-and-good-faith rule. It does not excuse reliance on any unsolicited caller, payment link or unsupported ownership claim.
Full official URL: https://www.planalto.gov.br/ccivil_03/leis/2002/l10406compilada.htm
Pinpoint: art. 309. Planalto
Creditor incapable of giving valid discharge — art. 310
Payment knowingly made to the creditor when that creditor is incapable of giving valid discharge is ineffective unless the debtor proves that the payment actually benefited that creditor.
The exact predicates are:
- recipient: the creditor, rather than merely an unauthorized third party;
- knowledge: the debtor acts cientemente—with knowledge of the creditor’s inability to give valid discharge;
- default effect: the payment is ineffective;
- saving condition: the debtor proves actual benefit to that creditor.
This is not an automatic age rule. PASS-15 does not determine that any actual person was incapable, that any age or disability created incapacity, that a representative was required, or what amount of benefit was actually received.
It also differs from art. 308:
- art. 308 ordinarily concerns payment to the wrong or unauthorized recipient and allows ratification or proven benefit;
- art. 310 concerns payment to the creditor itself where the debtor knows that creditor cannot validly grant discharge.
Full official URL: https://www.planalto.gov.br/ccivil_03/leis/2002/l10406compilada.htm
Pinpoint: art. 310. Planalto
Bearer of the creditor’s receipt — art. 311
The bearer of the creditor’s quitação is presumed authorized to receive payment unless the circumstances rebut that presumption.
This remains a rebuttable authority rule and does not itself prove ownership, assignment, settlement authority or the validity of the receipt.
Full official URL: https://www.planalto.gov.br/ccivil_03/leis/2002/l10406compilada.htm
Pinpoint: art. 311. Planalto
R1.2 Replacement attachment discussion
Art. 298 — creditor’s knowing attempted transfer of an attached claim
Once the claim has been attached, a creditor who knows of the attachment can no longer transfer it. If the debtor pays without having been notified of that attachment, the debtor is discharged; the affected third party’s rights remain against the creditor.
Actor and knowledge structure:
- transfer restriction actor: creditor;
- creditor predicate: knowledge of the penhora;
- protected-payment actor: debtor;
- debtor predicate: absence of notification of the penhora;
- effect: debtor’s payment discharges the debtor, while third-party rights remain against the creditor.
Full official URL: https://www.planalto.gov.br/ccivil_03/leis/2002/l10406compilada.htm
Pinpoint: art. 298. Planalto
Art. 312 — debtor pays after formal intimation
If the debtor pays the creditor despite having been formally intimated of:
- the attachment over the claim; or
- an opposition asserted against the claim by third parties,
the payment is ineffective against those third parties. They may compel the debtor to pay again, and the debtor retains recourse against the creditor.
Actor and knowledge structure:
- actor: debtor;
- predicate: formal intimation of the penhora or third-party opposition;
- act: payment to the creditor despite that intimation;
- effect against third parties: ineffective payment;
- adverse consequence: possible second payment;
- debtor protection: recourse against the creditor.
PASS-15 does not decide whether any actual intimation was validly served, when it occurred, whether the claim was truly attached, whether the third party had priority, whether payment was compelled a second time, or the amount of any recourse.

Keep the two branches separate. Under art. 298, determine creditor knowledge of the penhora and whether the debtor lacked notification when paying. Under art. 312, determine whether the debtor was formally intimated of the penhora or third-party opposition before paying. Obtain the attachment instrument, intimation/service proof, payment chronology, transfer chronology and any claimed recourse. |
Bounded workflow qualification
P13’s ten workflows remain ten. No new workflow is added and no existing calculation is recomputed.
Replacement H03 adverse branch
P13 H03 — Partial payment to the original creditor before knowledge
The original conditional R$6,000 residual calculation remains unchanged.
Replace only its adverse-branch paragraph with:
Adverse branches and additional assumptions: The illustration assumes that the original creditor was legally capable of giving valid discharge, that the debtor did not knowingly pay a creditor incapable of quitar, and that no penhora or third-party opposition had been formally intimated to the debtor. If the debtor knowingly paid a creditor incapable of giving valid discharge, art. 310 makes the payment ineffective unless actual benefit to that creditor is proved. If the debtor had already been formally intimated of an attachment or third-party opposition, art. 312 can make the payment ineffective against those third parties and expose the debtor to a second payment, with recourse against the creditor. Separately, if the creditor knew that the claim was attached and nevertheless attempted to transfer it, art. 298 governs the transfer restriction; an unnotified debtor’s valid payment remains protected under that provision. No such incapacity, attachment, intimation, benefit, second payment or recourse is stipulated in H03.

R2. Source-claim traceability repair
R2.1 Civil Code commencement
Erroneous P13 reference
P13 G1.1 stated that the Civil Code entered into force one year after official publication but cited P13 C001, which is only the PASS-13 scope boundary.
Replacement paragraph
The current official compiled Civil Code is Lei 10.406, dated January 10, 2002. Article 2.044 states that the Code enters into force one year after publication. The Planalto footer identifies publication in the DOU on January 11, 2002. PASS-15 does not compute or certify an exact effective calendar date; it records only the enacted one-year vacatio and official publication footer. Claim: C_BR-P15-C004.

Replacement paragraph
The current official compiled CPC is Lei 13.105, dated March 16, 2015. Article 1.045 states that the Code enters into force after one year has elapsed from official publication. The Planalto footer identifies publication in the DOU on March 17, 2015. PASS-15 does not compute or certify an exact effective calendar date. Claim: C_BR-P15-C005.

P13 C001 remains the scope-boundary claim and is not rewritten.
R2.4 CPC succession claims remain unchanged
P13 C041 and C042 remain valid for their actual subjects:
- C041 — CPC art. 109 and transfer of a litigated right;
- C042 — CPC art. 778 and execution by an assignee or subrogee.
They are no longer used as commencement authority.
Minor crosswalk-count repair
The P13 old-to-new section contains two visible tables:
- the preserved original P01 D07 record, displayed as four field rows; and
- the PASS-13 disposition table, containing 12 disposition rows.
The accurate count is therefore:
- logical crosswalk items: 1 preserved record + 12 dispositions = 13;
- physical displayed data rows: 4 field rows + 12 disposition rows = 16.
The four fields composing the original record are one logical preserved record, but they remain four visibly displayed table rows.
Replacement P13 crosswalk-count sentence
Replace:
“Crosswalk count: 13 visible rows—one literal preservation row plus 12 narrow dispositions.”
with:
Crosswalk count: 13 logical items—one preserved P01 D07 record plus 12 PASS-13 disposition items. Because the preserved record is displayed through four separate field rows, the two crosswalk tables contain 16 physical displayed data rows in total: 4 original-record rows + 12 disposition rows.
Replacement P13 self-check cell
Replace:
“Old-to-new crosswalk — 13 visible rows, including the literal P01 D07 preservation.”
with:
Old-to-new crosswalk — 13 logical items and 16 physical displayed data rows: one preserved P01 record displayed through four field rows, plus 12 disposition rows.
These crosswalk rows are not source usages and are not part of P13’s 139 coverage rows.

Final patch disposition: PASS-15 adds the omitted Civil Code art. 310 payee-capacity rule; separates art. 298’s creditor-transfer and unnotified-debtor protections from art. 312’s formally intimated debtor-payment consequence; corrects Civil Code and CPC commencement claim references; and distinguishes 13 logical crosswalk items from 16 physical displayed crosswalk data rows. Nothing else in PASS-13 is altered or accepted by implication.
