Narrow provider-capacity gateway — publication holdResearch baseline: October 22, 2026, America/Los_Angeles
Actual primary-source research: October 26, 2026, approximately 16:54–17:00 PDT (23:54–00:00 UTC).
Scope: Brazilian law governing the capacity in which a service provider may advise, negotiate, represent, or handle money for debtors. No broad-country launch, provider approval, or cross-border authorization is implied.
Executive determination
Brazil has several distinct legal routes and restrictions relevant to a debtor-paid debt consultancy. A single, general-purpose “Brazilian debt settlement licence” cannot be established from the federal materials examined. That is a bounded research finding—not proof that an independently operating debt consultancy is universally unrestricted or that no state, municipal, professional, financial, or activity-specific requirement applies.
The governing distinction is what the person or business actually does.
| Activity |
Narrow gateway finding |
Status |
| General budgeting and financial education |
Potentially ordinary nonlegal services; paid consumer-facing services may fall under the Código de Defesa do Consumidor (CDC). |
Federal basis identified |
| Operational negotiation with a creditor on a debtor’s instructions |
The Civil Code recognizes mandato, but settlement authority requires appropriate powers. This does not authorize reserved legal advice. |
Conditional |
| Individualized Brazilian legal advice or judicial representation |
Professional restrictions under the Estatuto da Advocacia, Law 8.906/1994, apply. |
Restriction established |
| Nonprofit debt assistance |
Nonprofit status does not itself confer legal-practice, payment-services, or judicial powers. |
Capacity-specific |
| Public consumer conciliation and Defensoria services |
Statutory public functions exist, subject to the competent body's role and eligibility. |
Public mandate identified |
| Acting for a bank as a correspondente no País |
A separately regulated, institution-contracted relationship; not inherently an authorization to represent debtors independently. |
Regulated category |
| Receiving and distributing debtor payments |
Requires separate classification under mandate/custody, banking, payment-services and potentially other rules. |
Unresolved |
| Foreign remote advice into Brazil |
Brazilian professional, consumer and data-protection connections may arise; foreign credentials do not create a blanket passport. |
Further analysis required |
The three most consequential source-backed boundaries are:
Legal work: Law 8.906/1994, arts. 1(I–II), 3–5, reserves specified advocacy activities, including consultoria, assessoria e direção jurídicas, to the legally qualified profession. planalto.gov.brplanalto.gov.br
Ordinary agency: Civil Code arts. 653–663 recognize representation by mandato. Article 661 §1 requires special and express authority for transigir—settling or compromising rights. This ordinary agency mechanism is not an exemption from professional regulation. planalto.gov.br
Public superindebtedness procedure: CDC arts. 54-A and 104-A–104-C establish particular consumer processes and institutional roles. They do not appoint every commercial negotiator as a public conciliator, require all creditors to offer voluntary discounts, or make the procedure available to every debtor and debt type. planalto.gov.brplanalto.gov.brplanalto.gov.br
The remaining dossier separates findings supported by fully opened operative texts from source-access limitations, gives the actor/capacity classifications, and records every requested territorial and deferred-topic row.
A–C. Substantive legal perimeter
The classifications below are conditional. They answer what kind of activity a hypothetical provider may be performing; they do not certify any actual business as permitted to operate.
A. The controlling distinction is the activity, not the business label
C_BR-P01-C001 — Legislative competence. Brazil’s Constitution allocates civil, commercial and financial-system legislation principally to the Union; consumer protection also involves concurrent federal/state/Distrito Federal powers, while municipalities have local and supplementary competence. A nationwide private-service proposition therefore cannot be decided solely by finding—or failing to find—a single federal debt-adviser licence. Constitution arts. 22(I), 22(VII), 22(XVI), 24(V), 24(VIII), 30(I)–(II). planalto.gov.br+2
C_BR-P01-C002 — Consumer versus business debtor. Under the Código de Defesa do Consumidor (CDC), a consumidor can be an individual or legal entity that is the final recipient of a product or service. Whether a natural-person proprietor, MEI, company or guarantor qualifies depends on the actual transaction, not merely their name or registration. The CDC’s special superendividamento definition is narrower: it expressly concerns a good-faith natural-person consumer. CDC arts. 2, 3 and 54-A §1. planalto.gov.br+1
C_BR-P01-C003 — Debtor-paid service. A compensated commercial adviser can fall within the CDC’s supplier/service framework. The provider must separately consider clear information, misleading or abusive practices, service responsibility and contracts; a “free consultation” followed by a paid service does not establish an exemption. The precise fees, cancellation rights and remedies of a proposed engagement remain outside this gateway. CDC arts. 3 §2, 6(III)–(IV), 14 and 46–49. planalto.gov.br+3
C_BR-P01-C004–C006 — Ordinary mandato is not an occupational licence. The Civil Code recognizes mandato: one person receives powers to perform acts or administer interests on another’s behalf (art. 653). The mandate may be paid or unpaid, depending on the circumstances (art. 658). General wording ordinarily permits administration; to settle or compromise (transigir), the representative needs poderes especiais e expressos—specific, express powers (art. 661 §1). Acts exceeding authority may be ineffective against the principal unless ratified (art. 662). Acting in one’s own name changes liability analysis (art. 663). None of those provisions overrides lawyers’ reserved work, regulated financial services, payment rules, or a creditor’s right to reject a proposal. planalto.gov.br
C_BR-P01-C007–C010 — Legal-practice boundary. The Estatuto da Advocacia reserves consultoria, assessoria e direção jurídicas to advocacy, and generally limits lawyer practice to properly registered persons (Lei 8.906/1994 arts. 1(I)–(II), 3–5). The act of advising whether a claim is enforceable, pleading a defense or choosing a litigation position differs materially from calculating a budget or transmitting a client-approved payment proposal. Actual court postulação is governed additionally by CPC arts. 103–105, subject to statutory exceptions; powers to settle, receive and discharge in a judicial mandate demand express wording under CPC art. 105. OAB professional admission, territorial registration and professional incompatibilities must be checked for the actual lawyer. planalto.gov.br+2
C_BR-P01-C011 — Foreign-law professional. OAB Provimento 91/2000, arts. 1–2, provides a particular route for a qualified foreign-law professional practicing consultoria em direito estrangeiro in Brazil, through an OAB sectional authorization restricted to the relevant foreign law. It does not authorize consultation on Brazilian law or Brazilian court representation. This provision is not proof that every foreign company offering remote household-budget education must obtain that status; the place and character of the professional acts must be established first. Conselho Federal
C_BR-P01-C012–C014 — Other professional councils are material. Lei 6.839/1980 art. 1 connects company/professional council registration to the entity’s atividade básica or the nature of services supplied to third parties. Lei 4.769/1965 arts. 2–3 covers specified professional administration work, including administração financeira, and Lei 1.411/1951 arts. 1, 6 and 14 covers the economics profession and businesses carrying on technical economic/financial services. Consequently, one must test a genuine technical financial-administration/economic-consultancy offering against CRA/CORECON rules. These enactments do not prove that a simple personal household-budget worksheet, ordinary call scheduling, or every debtor negotiation is reserved professional work. The actual scripts, deliverables, economic substance and regional council interpretation matter. planalto.gov.br+2
C_BR-P01-C015–C018 — Financial, payment and AML branches. Lei 4.595/1964 arts. 17–18 governs activities characteristic of instituições financeiras, including financial resources, intermediation/application and custody, subject to Banco Central authorization where the conditions apply. Lei 12.865/2013 art. 6 defines instituição de pagamento by payment-account, transfer, remittance and related functions, with Banco Central regulatory powers in art. 9. A company taking periodic payments into its own account and remitting them to creditors requires a distinct characterization; calling the account “client trust” or describing its conduct as “debt advice” supplies no exemption. Lei 9.613/1998 arts. 9–11 also imposes AML controls on specified financial activities and advisers involved in listed transactions, not automatically on all household-budget educators. planalto.gov.br+2
C_BR-P01-C019–C022 — Status of adjacent registrations. COAF Resolution 34/2020 expressly revoked the older adviser-specific Resolution 24/2013; that old instrument is not current permission guidance. COAF’s current supervision and registration pages describe activity-specific obligations, not a general “debt negotiator licence.” CMN Resolution 4.935/2021 addresses institutional correspondentes no País under contracts with regulated institutions, a creditor/institution-side capacity that cannot simply be transferred to an independent debtor agent. An indexed current BCB text indicates later amendments. BCB Resolution 494/2025 also appears to have materially changed payment-institution authorization/transitions. The dynamic full bodies of these last two BCB instruments could not be opened: final conclusions on correspondent conditions or payment exemptions are on hold pending their operative consolidated texts. gov.br+4
B. Actor/activity/capacity matrix
“Potential” means the cited legal class exists; it does not mean the hypothetical provider has met all of its requirements.
| Actor and side |
Remuneration, authority and competent body |
Controlling condition and adverse branch |
Claims |
| Independent commercial adviser acting for debtor |
Debtor fee possible under ordinary service/mandato framework; contract and actual powers must be tested |
Budget and administrative negotiation may differ from Brazilian legal advice; express transigir power for settlement; CDC and professional-council tests remain |
C003–C008, C012–C014 |
| Nonprofit/association, debtor side |
Free or subsidized work is possible as an organizational form, not a universal permission |
Legal advice can still be reserved; professional, financial, payment, data and consumer consequences depend on conduct |
C003, C007, C012–C018 |
| Public Procon/SNDC body |
Official consumer-protection or conciliation mandate, not a commercial badge |
Competence and local procedures arise from public law; a private provider cannot appropriate agency status |
C023, C029–C030 |
| Defensoria Pública |
Statutory public legal-assistance function for its qualifying audience; professional authority associated with public office |
Not delegable to an unrelated private operator by advertising “Defensoria-style” assistance |
C024 |
| Advogado acting for debtor |
OAB admission and applicable court mandate; private fees otherwise require separate review |
Can carry out reserved legal acts within competence; OAB badge does not itself grant payment-institution authorization |
C007–C011, C027 |
| Administrator/economist offering technical financial services |
CRA/CORECON professional and company registration are conditional on substantive regulated work and its atividade básica |
A diploma or isolated credential does not automatically cover law practice, lending or payment operations |
C012–C014 |
| Bank/regulated lender, own or outsourced institutional activity |
Financial regulatory authorization and product-specific supervision by BCB/CMN |
Authorization for banking is not authorization for an unrelated private debt-settlement firm |
C015, C021 |
| Bank correspondente, institution side |
Contract with participating institution; 4.935 full-current-text validation pending |
Serves institutional tasks, not an independently assumed debtor fiduciary role; referral/certification terms need operative validation |
C021 |
| Fintech/referral/software provider |
Classify each feature: information-only, credit proposal, payment execution or regulated intermediation |
The word “software” cannot immunize a firm that actually handles funds, credit or legal advice |
C015–C018, C021–C022 |
| Creditor collecting own receivable |
Acting as claim owner; ordinary creditor authority and consumer treatment still matter |
Owning a claim is different from serving the debtor as a paid independent adviser |
C003, C047 |
| Collector/servicer for creditor |
Actual creditor appointment or servicing contract; related regulatory/professional characterization depends on acts |
Authority to negotiate for creditor does not establish authority to compromise for debtor |
C004–C006, C047 |
| Purchaser of receivables |
Claim acquisition documents and financial/factoring characterization needed |
Purchaser takes its own-claim risk; if also supplying technical credit-management services, separate council/AML issues may arise |
C014, C018, C040, C047 |
| Payment institution or debtor-funds distributor |
BCB payment and/or financial permission depends on real flows, relevant current rules and exemptions |
Periodic custody, payment accounts, transfers and remittance cannot be decided by label; current resolution body pending |
C015–C018, C022, C044 |
| Extrajudicial neutral mediator |
Lei 13.140/2015 art. 9 permits an appropriate capable person trusted by the parties, subject to neutrality |
A partisan paid negotiator who advances only the debtor’s position should not advertise neutral mediator status |
C025 |
| Judicial conciliator/mediator |
Court-center qualification, appointment/register and remuneration rules under CPC and Lei 13.140 |
A private mediation course is not a judicial appointment |
C026 |
| Judicial administrator |
Specific court appointment under applicable proceeding, including CDC art. 104-B or business insolvency law |
No self-appointment or generic commercial debt-adviser entitlement |
C030, C033 |
Specific authority for the public branches: CDC arts. 55, 104-A–C and 105; Decreto 2.181/1997 arts. 2–4; LC 80/1994 arts. 1 and 4; Lei 13.140/2015 arts. 1, 4, 9–13; CPC arts. 165–169; Lei 11.101/2005 arts. 1, 2 and 21. planalto.gov.br+5
C. Public-law gateway: superendividamento, proceedings and authority
C_BR-P01-C023–C024. The Sistema Nacional de Defesa do Consumidor involves federal, state, Distrito Federal, municipal and qualifying civil bodies; these bodies’ oversight and assistance powers are not licences to private commercial advisers. Defensoria Pública has its own constitutional and statutory legal-assistance remit. Each public institution’s territorial jurisdiction, audience and intake procedures require a separate check. planalto.gov.br+2
C_BR-P01-C025–C027. A mediator is an impartial third party, whereas a privately retained debtor negotiator ordinarily represents one side. Lei 13.140/2015 art. 9 treats extrajudicial mediators differently from judicial mediators, whose qualification, training and appointment rules appear in art. 11 and CPC arts. 165–169. Court postulação and powers to bind a litigant remain a separate question under CPC arts. 103–105. planalto.gov.br+2
C_BR-P01-C028–C030. CDC art. 54-A §1 defines superendividamento by the good-faith natural-person consumer’s manifest inability to pay the totality of consumer debts, due and falling due, without compromising the mínimo existencial. Under art. 104-A, the court may establish a conciliation hearing presided over by a judge or accredited conciliator, with a proposed payment arrangement of up to five years; specified secured, real-estate-financing and rural-credit obligations, along with debts contracted fraudulently or in bad faith, are excluded from that process. Article 104-B supplies a potential subsequent judicial repactuação route and permits an appointed administrator. Article 104-C concerns preventive/public consumer conciliation. These are procedural gateways, not a duty imposed on every creditor in an ordinary private telephone negotiation, not a five-year promise by an adviser and not a guaranteed concession. planalto.gov.br+2
C_BR-P01-C031–C032. Decreto 11.567/2023 amended Decreto 11.150/2022 so the published federal mínimo existencial amount reads R$600. On April 23, 2026, the STF reported a decision requiring annual CMN evaluation of the parameters and rejecting exclusion of crédito consignado instalments from protection of that minimum. The decree’s consolidated display and the STF press account must therefore be read together; the press report is not the dispositive text or proof that a later regulation has been made. No individual eligibility conclusion or numerical budgeting example follows from the R$600 figure here. The complete STF judgment, effects, subsequent compliance, amendments and any later CMN acts require validation. planalto.gov.br+2
C_BR-P01-C033–C034. Recuperação judicial, recuperação extrajudicial and falência under Lei 11.101/2005 primarily address an empresário or sociedade empresária within that law’s scope; a court appoints a judicial administrator under art. 21. This cannot be recast as a universal natural-person consumer solution. CPC art. 1.052 also maintains a transitional connection to older civil-insolvency proceedings until special legislation; eligibility and procedure were not researched in this narrow provider gateway. planalto.gov.br+1
C_BR-P01-C035–C037. LGPD art. 3 can attach to processing in Brazil or certain processing connected to offerings or individuals in Brazil, including a remotely operated service; this is a data-protection nexus, not a banking or OAB licence. A Receita Federal CNPJ/status record identifies tax-registration facts, not full occupational permission. For foreign advisers, the relevant facts are physical location of acts, target consumers, Brazilian-law advice, domestic staff/establishment, referral arrangements and every actual money movement. No foreign authorization passport was established. planalto.gov.br+3
C_BR-P01-C038–C041. IBGE’s current official states endpoint returned 26 named states plus Distrito Federal, enumerated individually below. São Paulo’s PROCON service charter describes a Programa de Apoio ao Superendividado in cooperation with a judicial dispute-resolution centre; interestingly, its service audience extends to some MEI/ME/nonprofit applicants, which must not be confused with CDC art. 54-A’s statutory natural-person definition. CORECON-SP’s guidance separately distinguishes technical third-party credit management from mere own-account receivables purchasing. An official congressional act identifies MP 1.355/2026 as having lost effectiveness; it must not be treated as continuing programme authority. servicodados.ibge.gov.br+3
C_BR-P01-C042–C048 — Qualified negative findings. Within the federal statutes, official regulators and OAB/professional bodies actually searched for this gateway, I did not establish a single dedicated, universal federal “paid debt negotiation adviser” authorization that covers all the activities in the user’s hypothetical. That is a bounded research result, not an opinion that any unnamed firm may open without registration, appointment, licensing, ordinary business compliance or local review. In particular:
- No current universal debtor-adviser fee ceiling, earned-fee event, refund entitlement or governmental authorization charge was verified here (C043, C051).
- Custody/title/safeguarding rules for a specific funds model are unresolved without the payment chain and current operative BCB rule text (C044).
- Judicial settlements, receipts and discharge documents have separate express-powers requirements (C045).
- The creditor’s willingness and authority to accept a proposal are factual, not produced by the adviser’s mandate (C046).
- Creditor-side collecting, own-claim purchasing and debtor-side advisory mandates cannot be interchanged (C047).
- CNPJ, incorporation, course certificate, private badge, membership or a free initial appointment proves none of these substantive authorizations by itself (C048).
D. Read-only public-authority verification method
A real provider cannot be classified from its trade name. The minimum evidence packet would contain:
- Exact contracting legal person and, if different, the individual adviser; legal name, CNPJ/CPF category as appropriate, establishment and jurisdictions served.
- The actual client agreement, fee schedule, advertising, call scripts, decision trees and promised deliverables.
- A list of actions performed: budgeting, factual debt inventory, legal interpretation, negotiating, signing, receiving a discharge, court representation, credit referral, receiving money or transferring money.
- The debtor’s capacity: natural person, proprietor/MEI, company, guarantor or joint obligor; household versus enterprise purpose; secured versus unsecured debt.
- A sample blank creditor-authority or debtor-procuração form showing whether transigir, payment receipt and dar quitação are expressly authorized.
- Any claimed OAB, CRA, CORECON, BCB, COAF, public-agency or court category, including effective date, territorial jurisdiction, exact authorized activity and restrictions.
- A funds-flow diagram specifying account owner, beneficial owner, payment processor, authorized signatories, custody duration, payment initiation, creditor settlement and return of unsuccessful transfers.
- Whether the adviser acts from Brazil or abroad, where the customer is located, which law is discussed and which subcontractors process personal data.
These are documents to request for a hypothetical future assessment, not records accessed in this research.

E. Worked invented classifications
Each example deliberately changes an activity or legal capacity. The facts are invented; no actual borrower, creditor or provider is represented.
| Scenario and assumed facts |
Conditional classification and evidence |
Missing documents; adverse branch; exact next question |
| H01 — Paid debtor negotiator, no funds. A Brazilian company sells a budget review, makes telephone proposals on the individual’s instructions, never gives legal opinions and never touches payments. |
Potential private debtor-side service and mandato, not automatically a financial institution. CDC duties apply where the customer is a consumer; special authority is needed for transigir. C003–C008, C012–C015, C042; S002, S004, S005, S022–S024. |
Obtain signed service contract, scripts, powers and precise professional output. Adverse: staff interpret enforceability or give technical regulated financial reports. Next question: “Will staff merely transmit a consumer-approved proposal, or recommend legally binding settlement terms and execute an acceptance?” |
| H02 — Volunteer association. A nonprofit offers free budgeting and helps arrange voluntary creditor conversations. |
Organizational status does not displace reserved legal work, applicable professional rules or public/private capacity boundaries. C003, C007, C012–C014, C023–C024; S002, S005, S008, S009, S022–S024. |
Obtain bylaws, actual payment sources, scripts, donor/sponsor arrangements and adviser qualifications. Adverse: it markets itself as Defensoria or performs legal practice without the appropriate capacity. Next question: “Is the association merely educating, representing an individual, or exercising a specifically delegated public function?” |
| H03 — Lawyer plus nonlawyer call team. An OAB lawyer decides a legal defense; nonlawyers conduct factual intake and negotiation calls. |
Legal consultation and judicial acts require proper professional capacity; ordinary intake alone does not establish lawyer status. C007–C010, C027, C045; S005–S006. |
Obtain OAB status, actual supervision, allocation of tasks, court mandate and special powers. Adverse: nonlawyers independently give reserved legal opinions or execute procedural acts. Next question: “Who decides legal merits, signs the advice, and performs any court filing?” |
| H04 — Creditor collector versus purchaser. Firm A is paid by a lender to collect; Firm B buys receivables outright and pursues its own claims. Neither contracts to advise debtors. |
Both are creditor-side, but contractual collection and own-claim purchase have different authority. CORECON-SP guidance recognizes a distinction between mere own-account purchases and third-party technical credit services. C004–C006, C014, C018, C040, C047; S004, S023–S025, S029. |
Obtain creditor agency agreement or title-transfer instruments, accounting and service descriptions. Adverse: purported purchaser actually supplies regulated services or solicits debtor-paid advice. Next question: “Does the firm own this claim, service another party’s claim, or advise the debtor under a separate engagement?” |
| H05 — Bank correspondent. An institution contracts a shop to take specified credit applications; the shop advertises debt reduction. |
Potential correspondente for institution-side tasks; current CMN 4.935 operative details remain on hold. No inference that it may provide independent debtor-paid settlement advice. C015, C021, C042; S014, S016. |
Obtain institution identity, contract, specific approved tasks, remuneration, staff qualification and operative consolidated CMN text. Adverse: it acts beyond its correspondent mandate or presents conflicted roles as independent. Next question: “Which exact activity does the institution contract the shop to perform, and who pays it?” |
| H06 — Fintech/referral/software. A website estimates a household budget and refers a visitor to a lender; a later feature may accept credit applications. |
A static educational calculator, a compensated referral, a loan-originating function and payment initiation are different products requiring separate characterization. C003, C015–C017, C021–C022, C035; S002, S014–S017, S020. |
Obtain functional specifications, referral contracts, compensation, application/API flow and data map. Adverse: “software-only” copy hides actual regulated payment/credit operations. Next question: “At which screen, if any, does the platform transmit a credit proposal, control money or make a decision on behalf of a lender?” |
| H07 — Monthly debtor-funds collector. Customers pay a company-owned account monthly; the company distributes money when settlements arise. |
Payment, custody, remittance, AML and potentially financial-institution questions are triggered separately from negotiation. Permission/exemption cannot be cleared without current BCB rules. C015–C018, C022, C044; S014, S015, S017, S025. |
Obtain bank-account ownership, processor licence, account agreements, legal title, safeguarding, insolvency treatment, reconciliation and payment records. Adverse: unauthorized payment/deposit activity or mishandled client property. Next question: “Who legally owns and controls each real at every moment between the customer’s payment and the creditor’s receipt?” |
| H08 — Foreign remote adviser. A company outside Brazil calls Brazilian individuals about budgeting, with no Brazilian staff; a second variant offers Brazilian-law debt advice. |
Mere foreign incorporation supplies no passport. LGPD nexus may exist. The second variant raises OAB reserved-work questions; OAB foreign-law consultant authorization does not permit Brazilian-law practice. C007, C011, C035–C036; S005, S018–S020. |
Obtain adviser physical locations, customer territories, governing contracts, language/scripts, Brazilian counsel relationships and processing/payment geography. Adverse: unauthorized Brazilian legal acts or financially regulated activity in Brazil. Next question: “Where is the substantive advice performed, and does anyone give conclusions about Brazilian legal rights?” |
| H09 — Neutral or judicial appointee. A private person facilitates an agreement acceptable to both sides; another person says they are a court conciliator after taking an online course. |
A capable independent extrajudicial mediator is distinct from a partisan adviser; judicial appointment requires the proper court regime. C025–C027, C030; S006–S007, S002. |
Obtain neutrality agreement, disclosures, training, applicable tribunal register and specific appointment. Adverse: unappointed person claims court status or partisan negotiator claims impartiality. Next question: “What exact tribunal or parties appointed this person, for what proceeding and in what role?” |
| H10 — Mixed debt classes. One person has household credit, MEI working-capital debt, a guarantee for a company and a vehicle-secured loan. |
Each obligation may involve a different consumer, contractual and court-process classification. Natural-person CDC superendividamento cannot simply be applied to company debt or all security interests. C002, C028–C034; S002, S006, S021. |
Obtain anonymized debt purpose, obligors, guarantee documents and security terms. Adverse: an adviser markets one universal statutory process for the entire portfolio. Next question: “Who is legally liable on each obligation, for whose purpose, and is it secured?” |
| H11 — Technical financial management firm. A paid practice delivers financial restructuring reports and manages accounts payable for third-party businesses. |
More likely to demand detailed CRA/CORECON atividade básica analysis than H01’s basic budget conversation. C012–C014, C018, C040; S022–S025, S029. |
Obtain scope of work, credentials, company objects, actual outputs and regional professional interpretation. Adverse: missing council registration for a regulated technical service; further payment issues if it executes transfers. Next question: “Are the outputs professional economic/financial-management services supplied to third parties, or merely factual consumer education?” |
Conditional numerical treatment
Two numbers appeared in opened operative sources: the CDC court-conciliation five-year maximum proposal horizon and the federal decree’s R$600 mínimo existencial. Neither is a private adviser’s legal fee, agency cost, success rate or commercial settlement period. The 2026 STF decision creates an important currentness condition for the latter. No defensible agency-licensing cost, bond, insurance, minimum capital, licence duration or permission-timeline arithmetic can be produced without first establishing the applicable capacity and reading its specific current fee instrument. Source totals: 40 displayed records: 23 opened statutory/constitutional/normative bodies (S001–S011 excluding nonstatutory distinction, S014–S015, S018–S026, S031, S038, according to the precise type indicated), nine additional opened official explanatory/guidance bodies, and eight indexed, landing-only or failed-access entries. The definitive accounting is the 40 individual status-coded rows, not an assertion that 40 operative laws were fully verified.
Claim/evidence register
Routing is provisional within this dossier: A097 denotes provider/activity/capacity propositions; A098 denotes verification, jurisdiction, consumer-public interface and currentness propositions. These tags do not imply findings from any other country or from external A097/A098 work. All propositions concern Brazil as of the October 26 research session, except where an expressly narrower state or historical date is shown.
For brevity, source pinpoints in this register refer to the full literal URL-bearing source rows above. Every C reference in the substantive findings, scenarios and coverage ledger refers to the corresponding C_BR-P01-C ID.

Editorial applications and publication decisions
Potentially useful HomeLoanWiki/SettleADebt-style content, if later cleared for Brazil, is capacity-first:
- “What is the debt adviser actually allowed to do?” An annotated comparison of factual budget help, mandato, transigir, legal advice and court representation. Display profession/council and local uncertainty, not an invented licence badge.
- “Who is representing whom?” Creditor collector, receivables purchaser, borrower adviser, neutral mediator, public conciliator and court administrator explained as different capacities.
- “Can the company hold my settlement money?” A funds-flow questionnaire, not a pass/fail regulator checker until full BCB payment norms and exact custody model are researched.
- “Is this ordinary negotiation or court repactuação?” Progressive disclosure: natural person/business; debt purpose; excluded security categories; consensual versus court channel. Do not calculate legal eligibility from income alone.
- “Verify the category, not the logo.” An annotated blank engagement checklist: person/company, OAB or professional registration if applicable, CNPJ, debtor authorization, recipient of fees, creditor authority and client-money flow.
- “Brazil federal rules versus local help.” State/DF-specific pages should remain unlaunched until each locality’s public aid, professionals, courts and relevant municipal implementation is actually checked.
Explicit publication holds
Do not publish as established
- “Debt settlement companies in Brazil need no licence.”
- “Any consultant can negotiate or sign for a debtor.”
- “A CNPJ, professional certificate, COAF registration or correspondent contract authorizes debt negotiation.”
- “Nonprofits and foreign online advisers are exempt.”
- “All household debts qualify for superendividamento.”
- “R$600 is a universal eligibility threshold or the currently final judicial interpretation.”
- “Clients’ monthly funds may be held in an adviser’s account without a separate authorization/safeguarding analysis.”
- “Courts, Procon or Defensoria will make a creditor accept a discount.”
- Any expected savings, interest reduction, fee ceiling, refund, payment timeframe, credit-score result, tax result or government endorsement.
Permissible provisional research notes may state what the specific cited operative provision says, with actor, activity, date, scope and unresolved qualifications visibly attached. They are not a publishable country page or an endorsement of a business model.
